summary: the heading of the siman, then seif 1. Roofs, courtyards and karpef are a single domain for the objects that rested in them: one may carry them from one to another even if they belong to many owners who made no eruv together — from one courtyard to another, to a roof or to the top of the wall between them, from a roof to an adjoining roof even much higher, from the roof to a karpef of no more than beis sasayim or enclosed for dwelling, or to a mavoi fitted with a lechi or a korah. Even if the residents of a courtyard made an eruv among themselves, one may carry the objects that rested in that courtyard to another courtyard, and there is no concern that one will also carry those that rested in the house.
summary: a karpef of more than beis sasayim that was not enclosed for dwelling is a karmelis: one may not carry from it to another karpef [a similar one, Mishnah Berurah ס״ק י״ח], except two amos in this one and two amos in that one.
summary: two courtyards that want to join so as to permit also the objects that rested in the houses need no other eruv: one of the residents carries the eruv already made, for all of them, into a house of the second courtyard, or even bread of his own, and all are permitted. Gloss of the Rema: provided the residents of his courtyard first made the eruv with him, or do not need to make one (siman 370). The Mechaber resumes: provided the second courtyard made its own eruv; it needs no other bread.
summary: two courtyards make an eruv together only if there is between them an opening, or a window of four tefachim by four, part of which is within the ten tefachim closest to the ground; then, as they choose, together or each by itself. Parenthesis without הגה: a reference to siman 386, seif 2.
summary: a window between two houses, even above ten, allows them, if they wish, a joint eruv; likewise the skylight between a house and the upper storey, even above ten and even without a ladder. Gloss of the Rema: in any case it must be four by four; a lattice in front of the window removes its status of a window.
summary: a house open to two courtyards, which made an eruv with each of them while the courtyards did not make one with each other, does not let the objects that rested in the houses pass from one courtyard to the other. A wall of ten (or ground raised by five with a partition of five) prevents a joint eruv. On a wall ten high for both courtyards: the fruit on its top may be brought down into the courtyards, and fruit that rested in the courtyards may be brought up onto it and passed to the other courtyard, whether it is four wide or not; fruit that rested in the house: forbidden if it is four wide, permitted otherwise (parenthesis: provided they do not exchange, siman 346). Ten high on one side only: the one for whom it is not ten high uses it even with the objects of the house, the other not even with those of the courtyard — when the wall is four wide; otherwise both may use it, even from the houses, even if each made its own eruv.
summary: a breach of up to ten amos counts as an opening, provided the wall has not fallen along its whole extent; beyond that it is one courtyard, and they must make the eruv together. Parenthesis (R. Yehonasan): all the more so if there is no partition of ten between them.
summary: ladders four wide on either side of a wall ten high for both courtyards: an opening if they are less than three [tefachim] from each other, or even farther if the wall is four wide; the ladder has four rungs, or else its sides and rungs are heavy. Against a wall of only ten, a ladder of seven and a bit, over four, serves both to use the wall and to make the eruv together, since less than three remain to the top. A course removed from the top of the wall: over four, an opening and use of the whole wall; less, neither an opening nor use of the whole wall — one uses only opposite the reduced place.
summary: a bench four long along the wall and projecting four, which brings it below ten, allows the use of the whole wall, but counts as an opening for a joint eruv only if it reaches the top [or stops less than three tefachim from it, Mishnah Berurah ס״ק פ״ג]; without four by four, it does not allow use even opposite it.
summary: an overturned basin of four by four, of any height, which brings [the wall] below ten: one may use [the wall] opposite the reduction, provided it is fixed with clay.
summary: a bench on a bench — the lower one four by four; or, if not, the upper one four by four, with less than three tefachim between them: it allows use [of the wall], not making it an opening for a joint eruv.
summary: a projection (ziz) of four by four, with a ladder of any size placed on it, allows use of the wall — the bottom rung less than three from the ground, less than three between rungs, the ladder set on the ziz and not beside it; below twenty tefachim, one ziz in the middle suffices; at twenty, two zizim, one in the lower ten and the other above it in the upper ten, not directly opposite each other.
summary: two ladders spread apart to make four between them, with stubble in between: of no effect for use or for a joint eruv, for the foot is placed in the middle of the ladder and one does not climb on stubble; the ladder in the middle and the stubble at the side: effective for use as for a joint eruv.
summary: a ladder less than four wide completed by a groove cut into the wall: cutting to a height of ten suffices; rungs cut into the wall with no ladder at all: over the whole height of the wall, and this serves for use as for a joint eruv.
summary: a tree beside the wall made into a ladder for the wall: if they wish, they make one eruv; an asheirah, not, for climbing it is forbidden by Torah law, since one may derive no benefit from it. The Rosh writes the reverse: the tree does not help, the asheirah helps, provided it is dry.
summary: a ditch ten deep and four wide: no joint eruv, even full of straw and stubble, as long as it has not been nullified; full of earth and pebbles, even without nullifying, they must make the eruv together (parenthesis: siman 358, seif 2). Gloss of the Rema: some say that, filled with fruit, it is nullified without specifying, since it is customary to make a store of them there.
summary: a plank laid across the ditch, from one edge to the other, four wide: an opening; they make one eruv, or two if they wish. Gloss of the Rema: likewise if it was filled over a width of four with something that nullifies it there. A plank along the length of the ditch, over four, even narrow: an opening, since it brought it below four.
summary: a ditch ten deep for one and not for the other, or the same for both: the law of the wall.
summary: a stack of straw ten high between two courtyards: each makes its own eruv; reduced below ten on a weekday, they must make the eruv together. As long as it has not been reduced, each is forbidden, on Shabbos, to put straw into his basket to feed his animal, and even to stand the animal there to eat — but one may stand in front of it so that it has no way to turn except there. According to the Rosh, even on a weekday one may not put from it into one's basket, nor stand the animal there by hand. Between two houses, one may feed one's animal from the stack by hand.
1. One domain — Rabbi Shimon, Rav and Shmuel (seif 1)
Seif 1 copies the view of Rabbi Shimon in the Mishnah: « רַבִּי שִׁמְעוֹן אוֹמֵר: אֶחָד גַּגּוֹת וְאֶחָד חֲצֵירוֹת וְאֶחָד קַרְפֵּיפוֹת — רְשׁוּת אַחַת הֵן לְכֵלִים שֶׁשָּׁבְתוּ לְתוֹכָן, וְלֹא לְכֵלִים שֶׁשָּׁבְתוּ בְּתוֹךְ הַבַּיִת » (עירובין פ״ט ע״א). The same Mishnah brings two other views: for Rabbi Meir, all the roofs of the town are one domain, provided none is ten higher or ten lower; for the Sages, each one is a domain of its own.
Rebbi relates that when they were learning Torah with Rabbi Shimon in Tekoa: « הָיִינוּ מַעֲלִין שֶׁמֶן וַאֲלוּנְטִית מִגַּג לְגַג, וּמִגַּג לְחָצֵר, וּמֵחָצֵר לְחָצֵר, וּמֵחָצֵר לְקַרְפֵּף, וּמִקַּרְפֵּף לְקַרְפֵּף אַחֵר » (עירובין צ״א ע״א), until they reached the spring where they would bathe.
Seif 1 joins to this domain only a karpef of no more than beis sasayim, or enclosed for dwelling. The Beis Yosef establishes the limit of the karpef: Rashi writes it on the Mishnah and the Gemara, and it is explicit in the chapter Osin Passin (Eruvin 22a): « דלא שרי ר״ש אלא בקרפף בית סאתים » (בית יוסף או״ח שע״ב). The Rambam, in his list of the places that form one domain, writes likewise: « עִם כָּל הַקַּרְפִּיפוֹת שֶׁהֻקְּפוּ שֶׁלֹּא לְשֵׁם דִּירָה שֶׁאֵין בְּכָל אֶחָד מֵהֶן יֶתֶר עַל בֵּית סָאתַיִם » (רמב״ם הלכות עירובין פ״ג הי״ח).
When the courtyards have made their eruv. Rav Chisda challenges them: « יֹאמְרוּ: שְׁנֵי כֵלִים בְּחָצֵר אַחַת, זֶה מוּתָּר וְזֶה אָסוּר » (עירובין צ״א ע״א); the Gemara answers: « רַבִּי שִׁמְעוֹן לְטַעְמֵיהּ, דְּלָא גָּזַר » (עירובין צ״א ע״א) — Rabbi Shimon does not decree, as his comparison of the three courtyards, cited on the same page, shows.
The Beis Yosef: « ומשמע דהלכה כרבי יוחנן לגבי רב וכ״ש השתא דאיכא שמואל בהדיה וכן פסקו הפוסקים » (בית יוסף או״ח שע״ב), and not like the Baal HaItur, who writes that the halachah follows Rav. Seif 1 writes, like Shmuel and Rabbi Yochanan: « ואע״פ שעירבו בני חצר לעצמן דשכיחי מאני דבתים בחצר מותר לטלטל כלים ששבתו בחצר זו לחצר אחר׳ ולא חיישינן שמא יטלטל גם כלים ששבתו בבית לחצר אחרת או לגג וקרפף » (שו״ע או״ח שע״ב:א).
Rabbi Yochanan against himself? The Gemara challenges: « וְהָא אָמַר רַבִּי יוֹחָנָן: הֲלָכָה כִּסְתַם מִשְׁנָה » (עירובין צ״ב ע״א) — and the anonymous Mishnah of the wall (Eruvin 76b, seif 6) says the fruit on its top is not brought down below. It answers: « מַאי ״לְמַטָּה״ — לְמַטָּה לַבָּתִּים » (עירובין צ״ב ע״א). The Beis Yosef cites this discussion: the limit in the Mishnah of the wall refers only to the houses (section 6).
2. The underlying hakira — a domain, or the objects of the house (seif 1, end)
חקירה — for Rabbi Shimon, the status of these places depends on their use. The Mishnah Berurah says the same, and draws from it what the eruv of courtyards comes to permit: « ולא הצריכו חכמים ע״ח אלא משום שיהיה מותר להוציא לתוכה כלי הבית ששבתו בבית מבעוד יום וכן מחצר לבית » (משנה ברורה שע״ב ס״ק ג).
There remains the object that rested in the house and is already in the courtyard. But may it be moved within that courtyard itself? The Biur Halachah sets out the question from both sides:
- First side: « מי נימא דלא אסרו אלא ההוצאה מרשות אחד לחבירו אבל בחצר זה גופא אף ששבתו בבית לא אסרו בטלטול כשכבר הוציאן שם בין שהוציאן דרך היתר כגון ע״י מלבוש או אפילו דרך איסור » (ביאור הלכה שע״ב) — only taking out from one domain to another would have been forbidden, not moving within the courtyard itself;
- Second side: « או אפשר דכיון שאינה מעורבת ורשות כל בני החצר שולטין עליה עשאוה כעין ר״ה ואסור לטלטל אף בחצר זה גופא יותר מד״א » (ביאור הלכה שע״ב) — the courtyard not joined by an eruv would have been treated like a public domain.
He brings a dispute among the poskim: the Even HaOzer forbids, and writes that this is explicit in the Avodas HaKodesh; for Rashi (Shabbos 130b) and for Tosafos (Eruvin 91b) one may move it throughout the courtyard, and the Biur Halachah infers their reasoning: « וע״כ דס״ל דגזירת חכמים לא היה אלא בהוצאה מרשות לרשות כגון מבית לחצר שאינה מעורבת או מחצר לחצר אחרת בכלים ששבתו בבית אבל על חצר עצמו לא היה גזירת חז״ל כלל » (ביאור הלכה שע״ב).
The house. The Mishnah Berurah concludes with a case where the question does not arise: « ועכ״פ אם הביא משקין ע״י נכרי לבית אחר שלא עירב עמה כיון שבית רשות יחיד הוא מותר לישראל לטלטל המשקין אח״כ בכל הבית לכו״ע » (משנה ברורה שע״ב ס״ק ט״ז).
Objects of the house to a karpef. The Magen Avraham, following Rashi and Tosafos: « וכלים ששבתו בבית אסור לטלטל מחצר לקרפף שלא הוקף לדירה אפי׳ הם של אדם א׳ » (מגן אברהם שע״ב ס״ק א) — the Biur Halachah specifies the case: a karpef not enclosed for dwelling, which holds no more than beis sasayim. The Magen Avraham notes that the Rambam's wording implies that an eruv would help for the karpef, finds this difficult in light of the Gemara, and suggests that the Rambam is not speaking of the karpef. The Biur Halachah reports that the Beis Meir and others rejected this suggestion, proving it from the Rambam himself, and writes: « והעיקר דיש בזה פלוגתא בין הראשונים » (ביאור הלכה שע״ב) — the Rambam, the Smag, the Ra'ah and the Ritva are lenient when both places belong to one person or an eruv was made between them; Rashi, Tosafos, the Rashba and the Rosh forbid, and this is what the Tur and the Shulchan Aruch state without attribution in siman 358, seif 10.
The Shulchan Aruch HaRav (seif 1 of its numbering; Level 4, point ①) writes: « אֲבָל לְקַרְפֵּף שֶׁלֹּא הֻקַּף לְדִירָה, אֲפִלּוּ הוּא פָּחוֹת מִבֵּית סָאתַיִם — אֵין עֵרוּב מוֹעִיל, שֶׁאֲפִלּוּ הוּא שֶׁלּוֹ אָסוּר לְהוֹצִיא לְתוֹכוֹ כֵּלִים שֶׁשָּׁבְתוּ » (שו״ע הרב שע״ב:א) — the Rav's text writes no leniency for a time of pressing need (the one the Biur Halachah would later bring).
3. The large karpef, a karmelis (seif 2)
4. Two courtyards that join — the eruv already made (seif 3 and the gloss of the Rema)
According to the Beis Yosef, the source is a baraisa (Eruvin 49a): « ה׳ שגבו עירוב כשהן מוליכין עירובן למקום אחד אחד מוליך לכולן » (בית יוסף או״ח שע״ב), and Rashi adds: « ואפילו נתן הוא לבדו פת אחת בשבילן הואיל והוא כבר עירב עם חבירו קונה לצורך כולן » (בית יוסף או״ח שע״ב).
יסוד — one who has already made the eruv with his own people acts for all (Rashi). For one who carries bread of his own, the gloss of the Rema sets the condition: « והוא שעירבו בני חצירו עמו תחלה » (רמ״א או״ח שע״ב:ג). The Mishnah Berurah gives the reason, and its limit: « דאל״כ הא בעת שהוליך פת שלו עדיין לא היה מעורב עמהם ואף שאח״כ עירבו יחד לא חל העירוב למפרע מיהו נראה דאם אחר שעירבו בני חצירו חזר וסמך בהדיא על אותו פת שהוליך קודם לעירובן ודאי מהני » (משנה ברורה שע״ב ס״ק כ״ב) — the eruv made afterwards does not take effect retroactively; but if he then explicitly relies on that bread, it helps, since the eruv is acquired at bein hashmashos.
The Rema's second case — those who do not need to make an eruv among themselves — is the one the Beis Yosef derives from the Gemara: « ומשמע בגמרא דה״ה אם חצר אחת דרים אב ובניו המקבלים פרס ממנו וכן הרב ותלמידיו המקבלים פרס ממנו דקי״ל דכל שאין דיורין אחרים בחצר אינם צריכין לערב כמ״ש בסימן ש״ע אם באים לערב בחצר הסמוכה להם אחד מוליך לכולן » (בית יוסף או״ח שע״ב).
5. The opening between two courtyards — the window, and the house as if full (seifim 4-5 and the gloss of the Rema)
It continues that a window of less than four, or above ten, does not allow a joint eruv; the Gemara asks why this needed saying, and answers: « הָא קָא מַשְׁמַע לַן טַעְמָא דְּכוּלֵּיהּ לְמַעְלָה מֵעֲשָׂרָה, אֲבָל מִקְצָתוֹ בְּתוֹךְ עֲשָׂרָה — מְעָרְבִין שְׁנַיִם, וְאִם רָצוּ — מְעָרְבִין אֶחָד » (עירובין ע״ו ע״א). This is seif 4: « ויהי׳ קצתו בתוך י״ט הנמוכים לארץ » (שו״ע או״ח שע״ב:ד) — part of it within the ten tefachim closest to the ground.
The round window. Rabbi Yochanan: « חַלּוֹן עָגוֹל צָרִיךְ שֶׁיְּהֵא בְּהֶיקֵּפוֹ עֶשְׂרִים וְאַרְבָּעָה טְפָחִים » (עירובין ע״ו ע״א). The Gemara objects: « בְּשֵׁיבְסַר נְכֵי חוּמְשָׁא סַגִּיא » (עירובין ע״ו ע״ב) — seventeen tefachim of circumference, less a fifth, should suffice —, and answers that Rabbi Yochanan follows the judges of Caesarea (in another version, the Sages of Caesarea); the Beis Yosef writes that it was concluded that this measure suffices, and reports that the Maggid Mishneh considers this calculation approximate. The Magen Avraham (ס״ק ה) copies this measure, and writes of the long window: « ואפי׳ הוא ארוך הרב׳ צריך שיהי׳ ברחבו ד׳ » (מגן אברהם שע״ב ס״ק ה).
Between two houses. Rava challenges him from a baraisa that lists windows between two courtyards, two houses, two upper storeys, two roofs and two rooms, and says: « כּוּלָּן אַרְבָּעָה עַל אַרְבָּעָה בְּתוֹךְ עֲשָׂרָה » (עירובין ע״ו ע״ב). The answer: « תַּרְגּוּמָא אַחֲצֵירוֹת. תַּרְגּוּמָא אַאַרְבָּעָה עַל אַרְבָּעָה » (עירובין ע״ו ע״ב) — within ten refers only to the courtyards, while the measure of four by four applies to all. The Beis Yosef writes that the Gemara thus requires four by four even where within ten is not required, and the Rema copies this citing the Beis Yosef.
The skylight to the upper storey: Rabbi Abba asks Rav Nachman whether it requires a fixed ladder, and the conclusion, in Rav Nachman's name, is: « אֶחָד סוּלָּם קָבוּעַ וְאֶחָד סוּלָּם עֲרַאי — אֵינוֹ צָרִיךְ » (עירובין ע״ו ע״ב). The Mishnah Berurah (ס״ק ל״ד) explains as if full: « לפי שהבית כיון שהוא מקורה הרי הוא כמלא » (משנה ברורה שע״ב ס״ק ל״ד).
And the opening (פתח)? Seif 4 names an opening without giving its measure. The Biur Halachah reports that the Chayei Adam seems to accept, for an opening as well, the small measure of the window, and that according to Rabbeinu Chananel an opening made for going in and out needs a person's full height; he writes: « מ״מ נראה שצריך לחוש גם לדברי ר״ח בזה שאפשר שגם הם ס״ל דיש חילוק בין חלון לפתח דבפתח בעינן שיהא ראוי לפתח לכנוס ולצאת בו » (ביאור הלכה שע״ב), and adds: « ומ״מ נראה דגם לפיר״ח יהיה די בחלל הפתח שיש בו עשרה טפחים » (ביאור הלכה שע״ב), the measure of an opening for mezuzah (Yoreh De'ah 287). The Shulchan Aruch HaRav, in the corresponding seif (seif 5 of its numbering, Level 4), gives a measure of width: « אֶלָּא אִם כֵּן יִהְיֶה בֵּינֵיהֶם פֶּתַח רָחָב ד׳ טְפָחִים » (שו״ע הרב שע״ב:ה); the Mishnah Berurah, on seif 17, names four tefachim as the ordinary measure of an opening: « דבעלמא שיעור פתח הוא בד״ט » (משנה ברורה שע״ב ס״ק קכ״ט).
6. The wall between two courtyards, and the fruit on its top (seif 6)
The seif opens with the house located between two courtyards. The Beis Yosef reports it, in the continuation of what he cites from the Shibbolei HaLeket: « ב׳ חצירות ובית אחד ביניהם והבית פתוח לשתי החצירות והבית עירב עם שתיהם אבל החצירות לא עירבו שתיהם זה עם זה פשיטא שאין לטלטל מחצר לחצר ע״י בית האמצעי שביניהם » (בית יוסף או״ח שע״ב). Then the wall, in the Mishnah: « כּוֹתֶל שֶׁבֵּין שְׁתֵּי חֲצֵירוֹת, גָּבוֹהַּ עֲשָׂרָה וְרוֹחַב אַרְבָּעָה — מְעָרְבִין שְׁנַיִם, וְאֵין מְעָרְבִין אֶחָד » (עירובין ע״ו ע״ב); ground raised by five completed by a partition of five falls, according to the Beis Yosef, under the rule established in the chapter Kol Gaggos (Eruvin 93b): « גידוד ה׳ ומחיצה ה׳ מצטרפין » (בית יוסף או״ח שע״ב).
The fruit on its top, in the same Mishnah: « הָיוּ בְּרֹאשׁוֹ פֵּירוֹת — אֵלּוּ עוֹלִין מִכָּאן וְאוֹכְלִין, וְאֵלּוּ עוֹלִין מִכָּאן וְאוֹכְלִין, וּבִלְבַד שֶׁלֹּא יוֹרִידוּ לְמַטָּן » (עירובין ע״ו ע״ב).
A wall that is not four wide. Rabbi Yochanan: « וְרַבִּי יוֹחָנָן אָמַר: אֵלּוּ מַעֲלִין מִכָּאן וְאוֹכְלִין, וְאֵלּוּ מַעֲלִין מִכָּאן וְאוֹכְלִין » (עירובין ע״ז ע״א). The Gemara challenges him that the Mishnah says they go up and not they bring up, and answers: « יֵשׁ בּוֹ אַרְבָּעָה עַל אַרְבָּעָה, עוֹלִין — אִין, מַעֲלִין — לָא. אֵין בּוֹ אַרְבָּעָה עַל אַרְבָּעָה — מַעֲלִין נָמֵי » (עירובין ע״ז ע״א); Rabbi Yochanan follows his own rule here, which Rav Dimi reports in his name: « מָקוֹם שֶׁאֵין בּוֹ אַרְבָּעָה עַל אַרְבָּעָה — מוּתָּר לִבְנֵי רְשׁוּת הָרַבִּים וְלִבְנֵי רְשׁוּת הַיָּחִיד לְכַתֵּף עָלָיו, וּבִלְבַד שֶׁלֹּא יַחֲלִיפוּ » (עירובין ע״ז ע״א). For Rav, the Gemara answers: « הָכָא בְּמַאי עָסְקִינַן — בִּרְשׁוּיוֹת דְּרַבָּנַן.
Bring up from where? The Beis Yosef brings several readings. For Rashi, bringing up is from the courtyard, the top that is not four wide being an exempt place (מקום פטור); but: « אבל התוס׳ פירשו אלו מעלין מן הבית דמן החצר אפילו ברחב ד׳ שרי » (בית יוסף או״ח שע״ב) — for Rabbi Shimon, whom Rabbi Yochanan follows, the courtyard is permitted even on a wall four wide. And, following the Gemara of Eruvin 92a (section 1): « והרי״ף והרא״ש כתבו הא דקתני ובלבד שלא יורידו למטה אוקימנא בפרק כל גגות למטה לבתים אבל לחצירות מורידין דקי״ל כר״ש » (בית יוסף או״ח שע״ב).
The Tur writes: « אבל אינן יכולין להעלות מפירות הבית עליו ולא להוריד ממנו להכניסן לבית אפי׳ אין בו רוחב ד׳ » (טור או״ח שע״ב). The Beis Yosef wonders at this: « והא ליתא אלא ברחב ד׳ דוקא אבל אם אינו רחב ד׳ מותר וצ״ע » (בית יוסף או״ח שע״ב). Seif 6 of the Shulchan Aruch writes like the Beis Yosef: « אבל פירות ששבתו בבית אם הכותל רחב ד׳ אסור להעלות לו ולא להוריד ממנו ואם אינו רחב ד׳ מותר » (שו״ע או״ח שע״ב:ו), then the parenthesis: « ובלבד שלא יחליפו כדלעיל סי׳ שמ״ו ס״א » (שו״ע או״ח שע״ב:ו).
Provided they do not exchange. The Beis Yosef: « כבר כתבתי בסימן שמ״ו דהיינו לדעת הרשב״א אבל לדעת הרי״ף והרמב״ם כל כה״ג מותר להחליף דהא רשויות דרבנן הם » (בית יוסף או״ח שע״ב). The Mishnah Berurah (ס״ק מ״ט) explains the exchange — bringing up from the houses onto the wall and then down into the other courtyard —, recalls that the Mechaber brings two views on this in siman 346, seif 1, and writes: « ומלשון הרמ״א כאן משמע דחשש להחמיר » (משנה ברורה שע״ב ס״ק מ״ט).
7. The breach (seif 7)
יסוד — the breach is like an opening as long as some of the wall remains. The Beis Yosef cites R. Yehonasan: « נפרץ הכותל י׳ אמות ונשאר משהו מכאן ומשהו מכאן או מצד אחד לבדו ונשאר ד״ט רוחב בגובה י׳ מערבין ב׳ אם ירצו אלו לעצמן ואלו לעצמן ואין אוסרין זה ע״ז שהרי לא נפרצה במילואה » (בית יוסף או״ח שע״ב); and for a breach of more than ten: « ואם עירב כל אחת לעצמה הוי כחולקין את עירובן ואוסרים אלו על אלו » (בית יוסף או״ח שע״ב); and he concludes that these words are clear. The Magen Avraham (ס״ק י״ד) explains fallen along its whole extent: « כגון שנשאר מכל צד משהו או פס ד׳ לצד א׳ » (מגן אברהם שע״ב ס״ק י״ד). The Biur Halachah: « ואפילו נשארו מן הכותל גידודים סמוך לארץ כל שאינם גבוהים עשרה טפחים לא חשיבי » (ביאור הלכה שע״ב). The Mishnah Berurah (ס״ק נ״ט): « אכן אם עשו צורת הפתח במקום הפרצה חשוב כפתח ואם רצו מערבין שנים » (משנה ברורה שע״ב ס״ק נ״ט).
The parenthesis in small print in seif 7, which refers to R. Yehonasan (chapter Chalon), adds: «
8. The ladders and the removed course (seif 8)
The Magen Avraham (ס״ק ט״ו) gives the reason: « שיכול להוליך מסולם לסולם » (מגן אברהם שע״ב ס״ק ט״ו). The Rambam also writes of the ladder that does not reach the top: « וַאֲפִלּוּ לֹא הָיָה מַגִּיעַ רֹאשׁ הַסֻּלָּם לְרֹאשׁ הַכֹּתֶל אִם נִשְׁאַר בֵּינֵיהֶן פָּחוֹת מִשְּׁלֹשָׁה הֲרֵי זֶה מַתִּיר וּמְעָרְבִין אֶחָד אִם רָצוּ » (רמב״ם הלכות עירובין פ״ג ה״ג).
The width of the ladder. The Beis Yosef cites the Maggid Mishneh on the Rambam: «
Which ladder? The Biur Halachah reports: « הא״ז דייק מדין זה דסולם המצרי שהוא קל ג״כ מתיר » (ביאור הלכה שע״ב), in support of Rabbeinu Shmuel, who does not require four rungs; but: « אכן לפי דעת הרבה פוסקים שפליגי על ר״ש וסתם הטוש״ע כוותייהו ע״כ דבזה ג״כ מיירי שהיה בו ד׳ שליבות או שזרועותיו ושליבותיו כבדות » (ביאור הלכה שע״ב).
Seven and a bit. Rav Yehudah in the name of Shmuel: « כּוֹתֶל עֲשָׂרָה — צָרִיךְ סוּלָּם אַרְבָּעָה עָשָׂר לְהַתִּירוֹ » (עירובין ע״ח ע״א); Rav Yosef and Abaye reduce the measure, and finally: « רַב הוּנָא בְּרֵיהּ דְּרַב יְהוֹשֻׁעַ אָמַר: אֲפִילּוּ שִׁבְעָה וּמַשֶּׁהוּ » (עירובין ע״ח ע״א). The Beis Yosef: « ופסקו הפוסקים כרב הונא בריה דרב יהושע ובספרי רבינו יש ט״ס בזה » (בית יוסף או״ח שע״ב) — and he gives the corrected reading of the Tur, the one seif 8 copies.
Rashi, cited by the Beis Yosef: reduced over four in length, the removed course is an opening for the whole wall; « בציר מהכי פתחא הוא דלא הוי אבל לאישתמושי ביה שרי דכיון דלא גבוה י׳ לא הוי רשותא » (בית יוסף או״ח שע״ב). This is the end of seif 8: one uses only opposite the reduced place.
The Mishnah Berurah (ס״ק ע״ד) distinguishes the two effects of the ladder: « מכלי הבית כשלא עשה אלא סולם מצד אחד ולערב יחד כשהעמידו סולם משני הצדדין » (משנה ברורה שע״ב ס״ק ע״ד).
9. The bench, the basin and the bench on a bench (seifim 9-11)
Seif 9 concludes: « אבל אינו חשוב כפתח לערב יחד עד שיגיע לראש הכותל » (שו״ע או״ח שע״ב:ט). This condition is disputed.
Does the bench count as an opening? The Rosh, cited by the Beis Yosef, notes on the bench placed on a bench that Rashi seems not to require four by four, while further on the Gemara requires the ladder to reach the top of the wall. He answers: « ונ״ל דהכא בעי ד׳ על ד׳ שאז ראוי לעמוד עליו ולעלות על הכותל ולהכי לא בעי׳ אלא שיתמעט הכותל מי׳ » (בית יוסף או״ח שע״ב).
The Biur Halachah: « ומ״מ בשו״ע סתם כוותיה דהטור בזה » (ביאור הלכה שע״ב); he reports that the Even HaOzer also wonders at this, and that: « ובאמת רוב הפוסקים סתמו בזה להקל דכונת הגמרא הוא אפילו לענין לערב יחד » (ביאור הלכה שע״ב) — among them the Rambam, the Rashba, Rabbeinu Chananel and the Or Zarua, the Ritva leaning more towards R. Meir; he concludes: « וע״כ בשעת הדחק יש לסמוך להקל בזה » (ביאור הלכה שע״ב).
The Shulchan Aruch HaRav (372:13) writes, as the Mechaber does, that the bench does not count as an opening for the joint eruv, and gives the reason: « אֲבָל אֵינָהּ חֲשׁוּבָה כְּפֶתַח לְכֹתֶל זֶה לְעָרֵב יַחַד, אֲפִלּוּ עָשָׂה כֵּן גַּם בְּחָצֵר הַשְּׁנִיָּה, הוֹאִיל וְיֵשׁ מִמֶּנָּה לְרֹאשׁוֹ ג׳ טְפָחִים » (שו״ע הרב שע״ב:יג); where the Mechaber writes « עד שיגיע לראש הכותל » (שו״ע או״ח שע״ב:ט), the Rav speaks of the three tefachim that remain to the top. The Mishnah Berurah, writing later, reads this limit in the Mechaber's own words: « וה״ה אם היה נמוך מזה פחות מג״ט ג״כ דינא הכי וכנ״ל בס״ח לענין סולם » (משנה ברורה שע״ב ס״ק פ״ג); for a bench that stops less than three tefachim below the top, the page does not decide what the law is according to the Rav — consult your Rav. The Rav's text writes no leniency for a time of pressing need (the one the Biur Halachah would later propose).
The overturned basin (seif 10). Rav Yechiel: « אָמַר רַב יְחִיאֵל: כָּפָה סֵפֶל — מְמַעֵט » (עירובין ע״ז ע״א). The Gemara: « וְאַמַּאי? The Rambam states the rule in general terms: « וְכָל הַדָּבָר הַנִּטָּל בְּשַׁבָּת כְּגוֹן הַסַּל וְהַסֵּפֶל אֵין מְמַעֲטִין בּוֹ אֶלָּא אִם כֵּן חִבְּרוֹ בָּאָרֶץ חִבּוּר שֶׁאִי אֶפְשָׁר לְשָׁמְטוֹ עַד שֶׁיַּחְפֹּר בְּדֶקֶר » (רמב״ם הלכות עירובין פ״ג הי״ג). The Gemara and the Rambam write ספל; the Mishnah Berurah (ס״ק פ״ה) reads ספסל, which is also the word of the Tur as the Beis Yosef cites it.
On the words opposite the reduction in seif 10, the Taz: « משמע אבל לא בכל הכותל וקשה מ״ש מסולם דס״ח דמהני לכל הכותל » (ט״ז שע״ב ס״ק ז); the Mishnah Berurah: « הסכימו האחרונים דמה שכתב כנגד המיעוט ט״ס הוא וצ״ל אפילו שלא כנגד המיעוט » (משנה ברורה שע״ב ס״ק פ״ו). Level 4 (point א) compares the Rav's text with the Mechaber's on this point.
10. The ziz, the stubble and the groove (seifim 12-14)
Rav Nachman in the name of Rabbah bar Avuha: « זִיז הַיּוֹצֵא מִן הַכּוֹתֶל אַרְבָּעָה עַל אַרְבָּעָה, וְהִנִּיחַ עָלָיו סוּלָּם כׇּל שֶׁהוּא — מִיעֲטוֹ » (עירובין ע״ח ע״א); « וְלָא אֲמַרַן אֶלָּא דְּאוֹתְבֵיהּ עֲלֵיהּ, אֲבָל אוֹתְבֵיהּ בַּהֲדֵיהּ אַרְווֹחֵי אַרְוְחֵיהּ » (עירובין ע״ח ע״א).
The wall of twenty. For Rashi, cited by the Beis Yosef, they are offset so: « שיכול לקבוע סולם שני מזה לזה » (בית יוסף או״ח שע״ב); the Tur writes: « והוא שלא יהו הזיזין זה כנגד זה שראוי להטות סולם מזה לזה » (טור או״ח שע״ב), and seif 12: « שראוי להטיל סולם מזה לזה » (שו״ע או״ח שע״ב:יב). But the Beis Yosef: « ואין כן דעת הרמב״ם בפ״ג מה״ע אלא דהני מימרי דרב נחמן לענין לערב אחד הם » (בית יוסף או״ח שע״ב) — and according to the Maggid Mishneh's explanation of the Rambam: « ולפי פי׳ זה הא דצריך ששני הזיזים יהיו זה שלא כנגד זה הוא כדי שיוכל לעלות מזיז לחבירו שאם היו מכוונים זה למעלה מזה אינו יכול לעלות מאחד לחבירו » (בית יוסף או״ח שע״ב). The Rambam: « הָיָה הַכֹּתֶל גָּבוֹהַּ עֶשְׂרִים טְפָחִים צָרִיךְ שְׁנֵי זִיזִין זֶה שֶׁלֹּא כְּנֶגֶד זֶה » (רמב״ם הלכות עירובין פ״ג ה״ו). The Mishnah Berurah (ס״ק צ״ו): « אבל לעשותו פתח לערב יחד אינו מועיל אא״כ הזיז הוא בפחות מג״ט לראש הכותל והשני עשה ג״כ כזה מעבר השני » (משנה ברורה שע״ב ס״ק צ״ו).
The stubble (seif 13). The Rambam: « הָיָה סֻלָּם בָּאֶמְצַע וְקַשִּׁין מִכָּאן וְקַשִּׁין מִכָּאן אִם רָצוּ מְעָרְבִין שְׁנַיִם » (רמב״ם הלכות עירובין פ״ג ה״ז); and the Beis Yosef: « ודברי רבינו הם כפי׳ רש״י ולהרמב״ם וה״ה פי׳ אחר באבעיות אלו » (בית יוסף או״ח שע״ב). The Mishnah Berurah (ס״ק ק״ה) explains the second case: « לפי שכף הרגל עולה בסולם והקש שמן הצד ראוי להחזיק בו בידיו ולעלות » (משנה ברורה שע״ב ס״ק ק״ה).
The groove (seif 14). Rashi, cited by the Beis Yosef, understands it of a narrow ladder completed by a groove, and explains the difference: « התם כי איכא סולם מגיע לראש הכותל נוח לעלות בו ומיהו לא חשיב למיהוי פתח בציר מרוחב ד׳ הלכך כי משוי ליה רוחב ד׳ בגובה י׳ פתחא הוי אבל הכא אין נוח לעלות כ״כ אבל הרמב״ם פ״ג מה״ע פירשה לענין אחר » (בית יוסף או״ח שע״ב) — with a ladder reaching the top it is easy to climb, and ten high by four wide make an opening; without a ladder it is not as easy to climb; the Rambam explains it of the breach: « הָיְתָה הַפִּרְצָה פְּחוּתָה מֵעֶשֶׂר וּבָא לְהַשְׁלִימָהּ לְיֶתֶר מֵעֶשֶׂר חוֹקֵק בַּכֹּתֶל גֹּבַהּ עֲשָׂרָה טְפָחִים וּמְעָרְבִין עֵרוּב אֶחָד » (רמב״ם הלכות עירובין פ״ג הי״א); the Beis Yosef writes that the Maggid Mishneh already explained the sugya according to him.
11. The tree and the asheirah — an opening with a lion crouching on it (seif 15)
Rav Yosef asks Rabbah: « עֲשָׂאוֹ לָאִילָן סוּלָּם, מַהוּ » (עירובין ע״ח ע״ב). The question arises according to Rebbi: « עַד כָּאן לָא קָאָמַר רַבִּי הָתָם כׇּל דָּבָר שֶׁהוּא מִשּׁוּם שְׁבוּת לֹא גָּזְרוּ עָלָיו — הָנֵי מִילֵּי בֵּין הַשְּׁמָשׁוֹת, אֲבָל כּוּלֵּי יוֹמָא — לָא » (עירובין ע״ח ע״ב); and according to the Rabbanan: « אוֹ דִילְמָא אֲפִילּוּ לְרַבָּנַן: פִּיתְחָא הוּא, וְאַרְיָא הוּא דִּרְבִיעַ עֲלֵיהּ » (עירובין ע״ח ע״ב). The same question for the asheirah, according to Rabbi Yehudah: « עַד כָּאן לָא קָאָמַר רַבִּי יְהוּדָה הָתָם דְּמוּתָּר לִקְנוֹת בַּיִת בְּאִיסּוּרֵי הֲנָאָה, אֶלָּא הָתָם, דְּבָתַר דִּקְנָה לֵיהּ עֵירוּב לָא נִיחָא לֵיהּ דְּלִינְּטַר » (עירובין ע״ח ע״ב).
חקירה — does what one is forbidden to use count as an opening? On one side, the opening is there, and the prohibition is only a lion crouching on it; on the other, what one cannot pass through opens nothing. The Gemara brings in support of Rav Chisda what Ravin, when he came, said in the name of Rabbi Elazar — and according to another version, Rabbi Abahu in the name of Rabbi Yochanan: « כֹּל שֶׁאִיסּוּר שַׁבָּת גָּרַם לוֹ — אָסוּר, כֹּל שֶׁאִיסּוּר דָּבָר אַחֵר גָּרַם לוֹ — מוּתָּר » (עירובין ע״ח ע״ב). Rav Nachman bar Yitzchak teaches it otherwise: « אִילָן — פְּלוּגְתָּא דְּרַבִּי וְרַבָּנַן.
The Rambam and the Rosh. The Rambam writes like Rabbah: « הוֹאִיל וְאִסּוּר שְׁבוּת הוּא שֶׁגָּרַם לוֹ שֶׁלֹּא יַעֲלֶה בָּאִילָן » (רמב״ם הלכות עירובין פ״ג ה״ח). The Beis Yosef: « ונחלקו הרמב״ם והרא״ש בפסק ההלכה » (בית יוסף או״ח שע״ב). Seif 15 of the Shulchan Aruch first writes the Rambam's view, then the Rosh's.
The reasons: the Magen Avraham, for the first view: « דמה שאסור לעלות באילן אינו אלא שבות ולא גזרו עליו ב״ה » (מגן אברהם שע״ב ס״ק כ״ד); the Mishnah Berurah, for the Rosh: « דכיון שאסור לעלות בו בשבת והאיסור בא מכח שבת ואיך יתיר דבר לשבת דהו״ל כשני סותרין » (משנה ברורה שע״ב ס״ק קי״ד). On the dry asheirah, the Magen Avraham challenges: « צ״ע דברסי׳ של״ו פסק דאסור להשתמש אפילו ביבשה » (מגן אברהם שע״ב ס״ק כ״ו). The Mishnah Berurah, on the dry asheirah: « ומותר לעלות עליו בשבת מדינא אי לאו משום איסור אשרה ועיין לעיל סימן של״ו דיש ליזהר שלא לעלות אפילו באילן יבש התם רק משום סייג וגדר שלא יבואו להקל בשאר אילנות » (משנה ברורה שע״ב ס״ק קט״ז) — by law one could climb it, were it not for the prohibition of the asheirah; in siman 336, if one must take care not to climb even a dry tree, that is only a protective fence, lest people come to be lenient with other trees. Level 4 (point ב) notes that the Rav's text brings only the first view.
12. The ditch — separation, nullification, plank (seifim 16-18)
Does straw not separate? The Gemara, from the Mishnah of the stack (seif 19): « וְתֶבֶן לָא חָיֵיץ? Abaye: « לְעִנְיַן מְחִיצָה — כּוּלֵּי עָלְמָא לָא פְּלִיגִי דְּהָוְיָא מְחִיצָה, אֲבָל לְעִנְיַן חֲצִיצָה, אִי בַּטְּלֵיהּ — חָיֵיץ, וְאִי לָא בַּטְּלֵיהּ — לָא חָיֵיץ » (עירובין ע״ח ע״ב) — straw that stands as a partition is a partition; straw that fills a ditch reduces it only if it was nullified.
Earth and pebbles, even without nullifying? The Gemara challenges from the Mishnah of Ohalos: « בַּיִת שֶׁמִּילְּאָהוּ תֶּבֶן אוֹ צְרוֹרוֹת וּבִיטְּלוֹ — בָּטֵל » (עירובין ע״ח ע״ב) — nullified, yes; not nullified, no. After other answers, Rav Ashi: « בַּיִת אַחָרִיץ קָא רָמֵית?! » (עירובין ע״ט ע״א) — a ditch stands to be filled in, a house does not: the Mishnah of Ohalos, which speaks of a house, therefore does not contradict the rule of the ditch. On as long as it has not been nullified, the Mishnah Berurah
Fruit — the gloss of the Rema. The Beis Yosef cites the Hagahos Asheri: « ואם מילא פירות אפילו סתמא בטלי להו הואיל ודרכם לעשות מהם אוצר » (בית יוסף או״ח שע״ב). The Magen Avraham challenges: « וקשה דבגמרא דף פ״ד מוקי לה בפירות טבלים משמע דבשאר פירות אסור » (מגן אברהם שע״ב ס״ק כ״ח); and further: « וע״ק על רמ״א דהא פסק בסי׳ של״ג דמותר להסתפק ממנו א״כ הוה ליה דבר הניטל בשבת ואינו ממעט » (מגן אברהם שע״ב ס״ק כ״ח) — and leaves the question open (וצ״ע). The Mishnah Berurah (ס״ק קכ״ה) reports that the Vilna Gaon agrees with him.
The plank (seif 17). The Mishnah Berurah (ס״ק קכ״ח) sets its limit: « ודע דלא חשבינן אותו כפתח אלא מד״ט רוחב עד עשר אמות אבל ביותר מזה חשוב כפרצה » (משנה ברורה שע״ב ס״ק קכ״ח); the Magen Avraham (ס״ק כ״ט), following the Bach and the Rambam, writes this of a plank laid lengthwise.
The Taz explains otherwise: R. Yehonasan's words refer to the plank of the Mishnah, and come to teach: « קמ״ל דאפי׳ נסתם החריץ עד י׳ אמה דנשארו חריצין מכאן ומכאן אפ״ה לא נחשב לפרצה רק לפתח ויוכל לערב ב׳ » (ט״ז שע״ב ס״ק ט).
13. The stack of straw — the concern it will be reduced, or muktzeh (seif 19)
Rav Huna: « וּבִלְבַד שֶׁלֹּא יִתֵּן לְתוֹךְ קוּפָּתוֹ וְיַאֲכִיל » (עירובין ע״ט ע״א). The Gemara challenges him: « וּלְאוֹקֹמֵי שְׁרֵי? A baraisa, about the house: « בַּיִת שֶׁבֵּין שְׁתֵּי חֲצֵירוֹת וּמִילְּאָהוּ תֶּבֶן — מְעָרְבִין שְׁנַיִם וְאֵין מְעָרְבִין אֶחָד.
Why not into the basket? Rashi, cited by the Beis Yosef: « שלא יתן בידים לתוך קופתו דילמא שקיל טובא וממעיט ליה מי׳ וקא מטלטל בחצר האסור » (בית יוסף או״ח שע״ב); and according to another version: « ל״א לא יתן לתוך קופתו משום דמוקצה מאתמול למחיצה זו » (בית יוסף או״ח שע״ב). « והרא״ש הקשה עליו ופירש דאלו מאכילין מכאן וכו׳ בחול קאמר » (בית יוסף או״ח שע״ב) — according to the Rosh, the Mishnah speaks of a weekday. The Magen Avraham, following the Rosh, rejects the reason of muktzeh: « ומשום מוקצה ליכא דדוקא בבית שנפל בשבת כיון שהיה אסור ב״ה משום סתיר׳ אוהל אסור גם בשבת אבל הכא לא הוה מוקצה » (מגן אברהם שע״ב ס״ק ל׳); and, following the Yerushalmi: « דאינו כסותר אהלים אלא כסומך אהלים » (מגן אברהם שע״ב ס״ק ל׳); then: « ורש״י ס״ל דהוי מוקצה מה שלמטה מי׳ » (מגן אברהם שע״ב ס״ק ל׳).
The Mishnah Berurah (ס״ק קל״ז): « דחיישינן דלמא שקיל טובא וממעט ליה מי״ט וקאתי לטלטל בחצר ואע״ג דבשבת זו מותר מדינא דהואיל והותרה הותרה חיישינן שמא יבוא לטלטל גם בשבת הבאה » (משנה ברורה שע״ב ס״ק קל״ז) — a concern for the following Shabbos, this Shabbos being permitted by law —; and also brings the reason of muktzeh, under the formula וי״א. On the view of the Rosh, he writes: « ודוקא בנוטל מעט מעט חיישינן לזה אבל לא במסלק כולו בבת אחת. The Biur Halachah: « עיין בא״ר ותו״ש שכתבו שלשון זה מגומגם דלהרא״ש דוקא בחול אבל בשבת אין לנו לחוש שמא יתמעט דאפילו נתמעט שרי מטעם שהותר מעיקרא ובמאמ״ר כתב דלשון אפילו הוא רק לאפוקי מדעה ראשונה דס״ל דבחול שרי » (ביאור הלכה שע״ב) — the Eliyah Rabbah and the Tosefes Shabbos write that this wording is awkward, since according to the Rosh the prohibition applies only on a weekday; the Maamar Mordechai writes that the word even serves only to exclude the first view, which permits on a weekday.
The wall and the ditch, when the courtyards have made their eruv. The Taz concludes — the Beis Yosef cites it from the Hagahos Asheri, in the name of the Or Zarua: « הני מילי דכותל וחריץ מיירי בלא עירבו בני החצר אבל עירבו בני החצר מותר הכל » (ט״ז שע״ב ס״ק י).
14. Summary of the shitos and the halachic conclusion
The foundation — for Rabbi Shimon, roofs, courtyards and karpef are not places of reserved and constant use, and the eruv of courtyards comes only for the objects of the houses (Rashi, cited by the Beis Yosef; Mishnah Berurah ס״ק ג). In the order of the seifim:
- seif 1: the halachah follows Shmuel and Rabbi Yochanan, even when the courtyards made their eruv (Beis Yosef); the object of the house does not pass from one courtyard to another (Rambam; Mishnah Berurah ס״ק ט״ז), and moving it within the courtyard itself is disputed (Biur Halachah);
- seifim 1-2: the karpef of no more than beis sasayim, or enclosed for dwelling; beyond that, a karmelis; objects of the house to a karpef not enclosed for dwelling (of no more than beis sasayim) are the subject of a dispute among the Rishonim (Biur Halachah), and the Shulchan Aruch HaRav (seif 1 of its numbering) writes that, for such a karpef, an eruv does not help there, even if it is his own;
- seif 3: one who has already made the eruv with his own people acts for all (Rashi on Eruvin 49a, cited by the Beis Yosef; see also Eruvin 73a); the Rema's condition, and its limit (Mishnah Berurah ס״ק כ״ב);
- seifim 4-5: the window of four by four, partly within ten; between two houses as if full, but always four by four (Eruvin 76b);
- seif 6: the wall of ten; fruit of the house according to the width of four, like the Beis Yosef and against the Tur; the wall high on one side and four wide, given to the one who uses it easily;
- seif 7: the breach up to ten amos, if some of the wall remains (R. Yehonasan);
- seifim 8-14: ladders, course, benches, basin, ziz, stubble and grooves — an opening, or only use of the wall; the condition of seif 9, which the Beis Yosef discusses: the Biur Halachah writes that in a time of pressing need one may rely on the lenient view; the Shulchan Aruch HaRav (seif 13 of its numbering) writes, as the Mechaber does, that the bench is not an opening for the joint eruv — giving as the reason the three tefachim that remain to the top, a limit the Mishnah Berurah (ס״ק פ״ג) also reads in the Mechaber's words — and writes no leniency for a time of pressing need, which the Biur Halachah would write later;
- seif 15: the tree and the asheirah, between Rabbah and Rav Chisda, between the Rambam and the Rosh;
- seifim 16-18: the ditch, which separates, when full of straw and stubble, as long as it is not nullified; earth, nullified without specifying; the fruit of the Rema's gloss, which the Magen Avraham calls into question; the plank; the law of the wall;
- seif 19: the stack of straw, and the reasons for the prohibition — the concern it will be reduced, or muktzeh.
