📜 The text of the Shulchan Aruch — 1 seif
summary: the heading of the siman, then the seif. Two balconies jutting out from two upper storeys, facing each other, with a plank four [tefachim] wide laid between them: it is like an opening, and they make the eruv together. The Rema's gloss: if the distance between them is not four [tefachim], even without a plank the law is the same. If they wish, each makes the eruv for itself. If they are not facing each other — one offset to the east and the other to the west —, they cannot make the eruv together; if one is higher than the other, it is not an opening. This applies when the gap is three tefachim; within three, whether in offset or in height, it does count as an opening.
1. The sugya — the ditch, the plank and the two balconies, in Eruvin 78b-79a
The source in the Gemara
The Beis Yosef connects the beginning of the seif to the Mishnah of the chapter Ha-chalon: « משנה שם בפרק חלון » (בית יוסף או״ח שע״ג) — and its continuation, balconies that do not face each other, to a statement of Rava: « ומ״ש אבל היו זו שלא כנגד זו וכו׳ ג״ז שם » (בית יוסף או״ח שע״ג).
The Mishnah (78b) first deals with the ditch between two courtyards: « חָרִיץ שֶׁבֵּין שְׁתֵּי חֲצֵירוֹת, עָמוֹק עֲשָׂרָה וְרוֹחַב אַרְבָּעָה — מְעָרְבִין שְׁנַיִם, וְאֵין מְעָרְבִין אֶחָד » (עירובין ע״ח ע״ב) — ten deep and four [tefachim] wide: they make two eruvin, and not one. Then comes the plank, and with it the two balconies: « נָתַן עָלָיו נֶסֶר שֶׁרָחָב אַרְבָּעָה טְפָחִים, וְכֵן שְׁתֵּי גְזוּזְטְרָאוֹת זוֹ כְּנֶגֶד זוֹ — מְעָרְבִין שְׁנַיִם, וְאִם רָצוּ מְעָרְבִין אֶחָד » (עירובין ע״ח ע״ב) — a plank four tefachim wide was laid over it, and likewise two balconies facing each other: they make two eruvin, and, if they wish, one. And: « פָּחוֹת מִכָּאן — מְעָרְבִין שְׁנַיִם, וְאֵין מְעָרְבִין אֶחָד » (עירובין ע״ח ע״ב) — less than this [according to Rashi, a plank that is not four wide: see section 2], they make two eruvin, and not one.
The Gemara (79a) comments on the plank and on the balconies, each with a statement of Rava. On the plank: « אָמַר רָבָא: לֹא שָׁנוּ אֶלָּא שֶׁנָּתַן לְרׇחְבּוֹ, אֲבָל לְאׇרְכּוֹ — אֲפִילּוּ כָּל שֶׁהוּא נָמֵי, שֶׁהֲרֵי מִיעֲטוֹ מֵאַרְבָּעָה » (עירובין ע״ט ע״א) — this is when it was laid across the width [of the ditch]; laid along its length, even [a plank] of any size suffices, since it has reduced it below four. On the balconies: « אָמַר רָבָא: הָא דְּאָמְרַתְּ זוֹ כְּנֶגֶד זוֹ — אִין, זוֹ שֶׁלֹּא כְּנֶגֶד זוֹ — לֹא, וְזוֹ לְמַעְלָה מִזּוֹ נָמֵי » (עירובין ע״ט ע״א) — facing each other, yes; not facing each other, no; and one above the other, also not; « לָא אֲמַרַן אֶלָּא שֶׁיֵּשׁ בֵּין זֶה לָזֶה שְׁלֹשָׁה טְפָחִים, אֲבָל אֵין בֵּין זֶה לָזֶה שְׁלֹשָׁה — גְּזוּזְטְרָא עֲקוּמָּה הִיא » (עירובין ע״ט ע״א) — this is when there are three tefachim between one and the other; within three, it is a bent balcony.
The seif takes up only the balconies; the ditch is in siman שע״ב, to which the Taz refers (ס״ק ב). It writes the plank into the case of the balconies itself, ונתן ביניהם נסר; the Mishnah writes וְכֵן שְׁתֵּי גְזוּזְטְרָאוֹת right after the plank laid over the ditch, without repeating the plank. What does this "likewise" refer to? That is the question of section 2.
2. The underlying hakira — does the Mishnah of the balconies speak of the plank? Rashi and Rabbeinu Tam
Hakira — in the Mishnah, does וְכֵן שְׁתֵּי גְזוּזְטְרָאוֹת refer to the plank before it — two balconies joined by a plank of four are like the ditch covered by a plank —, or to the ditch itself — two balconies separated by empty space are like the ditch, and their law depends on the gap between them?
- First side — Rashi: the plank. « נסרין בולטין משפת תקרת העלייה לרה״ר וקורין לו אלדויי״ר ואם ישנן זו אצל זו בשתי עליות של שני דיורין ונתן נסר רחב ד׳ כמין גשר מזו לזו הוי נמי פתח » (רש״י עירובין ע״ח ע״ב) — boards jutting out from the edge of the ceiling of the upper storey into the public domain, called aldouyir; if they are next to each other, on two upper storeys of two residents, and a plank four wide was laid like a bridge from one to the other, it too is an opening. And on "less than this": « פחות מכאן - שאינו רחב » (רש״י עירובין ע״ח ע״ב) — [a plank] that is not [four] wide. The Rashba reports Rashi thus: « פירש רש״י ז״ל: אם יש בין זו לזו ארבעה ונתן בין זו לזו נסר רחב ארבעה לגשר מערבין שנים ואם רצו מערבין אחד » (רשב״א עירובין ע״ח ע״ב) — if there are four between them and a plank four wide was laid as a bridge, they make two eruvin, and, if they wish, one.
- Second side — Rabbeinu Tam: the ditch. Tosafos first report Rashi, « פירש בקונטר׳ בנותן נסר רחב ד׳ מזו לזו דהוי נמי פתח » (תוספות עירובין ע״ח ע״ב) , and object: « ותימה כיון דע״י נסר רחב ד׳ איירי » (תוספות עירובין ע״ח ע״ב) — summary of what follows: if a plank of four is meant, why does the Gemara exclude balconies that do not face each other? even far apart, the plank of four should permit them, as was said above of a wall four wide. Then: « ומפרש ר״ת דלא איירי בנותן נסר מזו לזו ודין חריץ נותן לגזוזטראות דאם יש מזו לזו ד׳ מערבין שנים ואין מערבין אחד כמו חריץ » (תוספות עירובין ע״ח ע״ב) — Rabbeinu Tam explains that the Mishnah does not deal with a plank laid from one to the other: it gives the balconies the law of the ditch; if there are four between them, they make two eruvin, and not one, as with the ditch; « אבל בפחות מד׳ רגיל לפסוע מזו לזו כמו גבי חריץ » (תוספות עירובין ע״ח ע״ב) — within four, one usually steps across from one to the other, as with the ditch; « מש״ה כי ליכא ד׳ מזו לזו מערבין שנים ואם רצו מערבין אחד אפילו היא מופלגת שלשה כשהן זו כנגד זו אבל זו שלא כנגד זו אין מערבין אחד כשמשוכות זו מזו שלשה כדאמרינן בגמרא » (תוספות עירובין ע״ח ע״ב) — therefore, when there are not four between them, they make two eruvin, and, if they wish, one, even if one is three apart, when they face each other; but not facing each other, they do not make one eruv when they are offset by three, as the Gemara says. And, in brackets in the text of Tosafos, the Mishnah's "less than this" חוזר וקאי אנסר: it returns to the plank.
Nafka mina — according to Rashi, the Mishnah speaks of two balconies joined by a plank; according to Rabbeinu Tam, of two balconies without a plank, separated by empty space. The Rema's gloss — within four, even without a plank — is connected by the Taz to Rabbeinu Tam's explanation (section 4); and for offset balconies joined by a plank, the Biur Halachah connects the question to this same alternative (section 6). Rabbeinu Tam's explanation is read here in two forms — "two eruvin, and if they wish one" in Tosafos, "one eruv, and not two" in the Rashba —: both come back in section 4.
3. The plank — "like a bridge", and what makes it an opening
The seif: « שתי גזוזטראו׳ הבולטו׳ משני עליו׳ זו כנגד זו ונתן ביניהם נסר רחב ארבע׳ הרי הוא כפתח ומערבין יחד » (שו״ע או״ח שע״ג:א). On the plank laid over the ditch, Rashi writes: « משפתו לשפתו כעין גשר והוי כפתח » (רש״י עירובין ע״ח ע״ב) — from edge to edge, like a bridge, and it is like an opening. The Taz explains what the opening achieves: « פי׳ על ידי זה מותר לטלטל בשני החצירות מזה לזה אם ירצו לערב יחד » (ט״ז או״ח שע״ג ס״ק ב) — through it, one may carry in both courtyards, from one to the other, if they wish to make the eruv together. The Mishnah Berurah gives the reason: « דכיון שיש נסר ביניהם רחב ארבע הרי יכול בקל לילך מפתח העליה זו להעליה שכנגדו ומצטרפים » (משנה ברורה שע״ג ס״ק ג) — since there is a plank four wide between them, one can easily walk from the opening of one upper storey to the upper storey opposite, and they combine.
4. The Rema's gloss — without a plank, within four: two eruvin, or one?
The gloss: « ואם אין המרחק שביניהם ארבעה אפילו בלא נסר נמי דינא הכי » (רמ״א או״ח שע״ג:א) — if the distance between them is not four, even without a plank the law is the same; the Rema gives his source in parentheses, המגיד פ״ג. The Taz explains: « ועל זה כ׳ רמ״א דאם אין המרחק שביניהם ד׳ אפי׳ בלא נסר הוה שם כפתח כיון דיכול לפסוע מזה לזה » (ט״ז או״ח שע״ג ס״ק ב) — since one can step across from one to the other; and he connects it to Rabbeinu Tam's explanation in Tosafos (section 2): « משום הכי אמר היכא דליכא ד׳ מזו לזו מערבין שנים ואם רצו א׳ כו׳ והיינו כמ״ש » (ט״ז או״ח שע״ג ס״ק ב). The Mishnah Berurah describes the case, « היינו שאין בין גזוזטרא לגזוזטרא הפסק אויר רק פחות מד״ט וא״כ יוכל לפסוע בקל מזה לזה » (משנה ברורה שע״ג ס״ק ד) — between one balcony and the other there is only a gap of less than four tefachim, so one can easily step across from one to the other —, and reads "the law is the same" as the law of the plank: « כמו בנסר שיכולין לערב יחד כשירצו ואם רצו מערבין שנים ודוקא שסמיכת הגזוזטראות זו לזו לא היה באורך כל הכותל דאלו אם היה סמיכתן באורך כל הכותל או שהיה נמשך הסמיכה זו לזו ביותר מעשר אמות אז מערבין אחד ולא שנים » (משנה ברורה שע״ג ס״ק ה) — as with the plank, they can make the eruv together if they wish, and, if they wish, make two; only if the closeness of the balconies does not run along the whole length of the wall; if it runs along the whole length of the wall, or extends over more than ten amos, they then make one eruv, and not two.
Two eruvin, or one?
- Tosafos, in the name of Rabbeinu Tam: they make two eruvin, and, if they wish, one (section 2) — the reading the Taz finds in the Rema's gloss.
- The Rashba, reporting Rabbeinu Tam: one eruv, and not two (section 2). The Tosefta, as Sefaria serves it, teaches this rule: « שתי גזוזטראות זו כנגד זו ברה״ר [בין] זו לזו ארבעה טפחים מערבין ב׳ ואין מערבין א׳ פחות מכאן מערבין אחד ואין מערבין שנים » (תוספתא עירובין פ״ח ה״ב) — two balconies facing each other in the public domain, four tefachim apart: they make two eruvin, and not one; less than this, they make one eruv, and not two.
- The Ritva, in the reading of Rabbeinu Tam that seems best to him: « שבשתיהן אם רצו מערבין שנים ואם רצו מערבין אחד » (ריטב״א עירובין ע״ח ע״ב) — in both cases [balconies within four, without a plank, and the ditch covered by a plank of four], two eruvin if they wish, one if they wish; and here he rejects the rule of one eruv and not two: « ואין אומר בזה דכיון שאין בין זה לזה ד׳ טפחים שמערבין אחד ולא שנים כדין חריץ » (ריטב״א עירובין ע״ח ע״ב). He adds that the Tosefta agrees with Rabbeinu Tam: « ובאמת כי כן הדין שנוי בתוספתא כדברי ר״ת ז״ל ברוב הנסחאות » (ריטב״א עירובין ע״ח ע״ב) — indeed, the law is taught this way in the Tosefta, according to the words of Rabbeinu Tam, in most versions; but the Tosefta he copies does not have the wording of the one Sefaria serves: « שתי גזוזטראות זו כנגד זו ואין בין זו לזו ד׳ טפחים מערבין שנים ואין מערבין א׳ (יתר) מכן מערבין א׳ ואין מערבין שנים » (ריטב״א עירובין ע״ח ע״ב) ; and he concludes from it: « הרי שדין גזוזטראות זו כנגד זו שאין ביניהם נסר כדין חריץ ממש שאין עליו נסר אבל א״א לפרש כן לפי לשון משנתינו » (ריטב״א עירובין ע״ח ע״ב) — the Tosefta gives facing balconies without a plank the very law of the ditch without a plank; but our Mishnah cannot be read that way. He concludes that Rashi's explanation is the correct one (section 2).
- The Maggid Mishneh, on the Rambam (Hilchos Eruvin 3:14), writes the rule of one eruv, and not two, in the name of the Rashba; the Beis Yosef reports it: « וכתב ה׳ המגיד בפ״ג שהוכיח הרשב״א מהתוספות שאם אין ביניהם מרחק ד׳ אינו צריך נסר מזו לזו אלא אף בלא נסר מערבין אחד ואין מערבין שנים כל שהן זו כנגד זו » (בית יוסף או״ח שע״ג) — the Maggid Mishneh wrote that the Rashba demonstrated that, if the distance between them is not four, no plank is needed from one to the other: even without a plank, they make one eruv and not two, as long as they face each other. Where the Beis Yosef writes מהתוספות ("from Tosafos"), the text of the Maggid Mishneh that Sefaria serves writes מכח התוספתא ("on the strength of the Tosefta"). This page does not decide between these two readings: the question is put to the Rav.
The Taz notes the contradiction: « והנה זה סותר מ״ש בשם התו׳ ודברי הרמ״א ולק״מ דזה מיירי במערב לטלטל מגזוזטרא לחברתה והם רחבות הרבה נמצא שההפסק אויר שביניהם שאין בו ארבע טפחים מבטל הפתח ודומה לחריץ וכותל שנפרצו יתר מעשר דא״א לערב אלא א׳ » (ט״ז או״ח שע״ג ס״ק ב) — this contradicts what is written in the name of Tosafos and the words of the Rema; but there is no difficulty: that case concerns one who makes the eruv in order to carry from one balcony to the other, and balconies that are very wide; the gap of less than four tefachim between them cancels the opening, and it is like the ditch or the wall breached over more than ten [amos], where one can make only one eruv.
« משא״כ בדברי תו׳ ורמ״א כאן שהגזוזטרא אינם רחבים ואינו רוצה להשתמש שם רק שעל ידיהם יהיה פתח מחצר לחצר ובזה מערבין כמו שרוצים כל זה בריר ופשוט » (ט״ז או״ח שע״ג ס״ק ב) — whereas in the words of Tosafos and the Rema here, the balconies are not wide; one does not want to use them, only that through them there be an opening from courtyard to courtyard, and in that case they make the eruv as they wish; all this, the Taz concludes, is clear and simple.
The Taz and the Magen Avraham place the formula "one eruv, and not two" in different cases: the Taz, in very wide balconies on which one wants to carry; the Magen Avraham, in a closeness that runs over more than ten amos or along the whole length of the balconies — and he names the Maggid Mishneh in the name of the Rashba. The text of the Maggid Mishneh that Sefaria serves does not mention ten amos. The Mishnah Berurah (ס״ק ה) writes the Magen Avraham's limit. This page does not say whether these two ways of bounding the formula amount to the same: the question is put to the Rav.
5. "And if they wish, each for itself" — the order of the Mishnah and that of the seif
The seif first writes ומערבין יחד, then: « ואם רצו כל א׳ מערבת לעצמה » (שו״ע או״ח שע״ג:א) — and if they wish, each makes the eruv for itself. The Mishnah said the reverse: "two eruvin, and, if they wish, one" (section 1). The Tur writes it like the Mishnah: « שני גזוזטראות הבולטות משתי עליות זו כנגד זו ונתן ביניהן נסר רחב ד׳ חשוב כפתח ואם רוצין מערבין יחד » (טור או״ח שע״ג) — it counts as an opening, and if they wish, they make the eruv together. The Rambam writes it like the seif, first for the ditch, « נָתַן לוּחַ שֶׁרָחָב אַרְבָּעָה טְפָחִים עַל רֹחַב הֶחָרִיץ מְעָרְבִין אֶחָד וְאִם רָצוּ מְעָרְבִין שְׁנֵי עֵרוּבִין » (רמב״ם הלכות עירובין פ״ג הי״ד) , then for the balconies: « וְכֵן שְׁתֵּי גְּזֻזְטְרָאוֹת זוֹ כְּנֶגֶד זוֹ אִם הוֹשִׁיט לוּחַ שֶׁרָחָב אַרְבָּעָה טְפָחִים מִזּוֹ לְזוֹ מְעָרְבִין עֵרוּב אֶחָד. וְאִם רָצוּ מְעָרְבִין שְׁנֵי עֵרוּבִין אֵלּוּ לְעַצְמָן וְאֵלּוּ לְעַצְמָן » (רמב״ם הלכות עירובין פ״ג הי״ד) — they make one eruv; and if they wish, they make two eruvin, these for themselves and those for themselves.
The order of the seif is the Rambam's; that of the Tur, the Mishnah's. The commentators on the seif that we opened — the Taz, the Magen Avraham, the Mishnah Berurah, the Biur Halachah — say nothing about it, and this page gives no weight to this difference of order: the question is put to the Rav.
6. Balconies that are offset — the form of the opening, or the fear of crossing?
The seif: « אבל אם היו זו שלא כנגד זו שאחת משוכה למזרח וא׳ למערב אינם יכולים לערב יחד » (שו״ע או״ח שע״ג:א). The Mishnah Berurah defines the offset, « ר״ל משוכה ממקום חברתה לצד מזרח » (משנה ברורה שע״ג ס״ק ח) — drawn away from the place of the other, toward the east —, whereas Rashi wrote, on Rava's statement: « שהיתה זו בולטת לרה״ר יותר מחברתה לא סגי להו בנסר ארבעה » (רש״י עירובין ע״ט ע״א) — one jutted further into the public domain than the other, and the plank of four does not suffice for them. The Tur writes the case with its reason: « אבל היו זו שלא כנגד זו שאחת משוכה למזרח והשנייה למערב כזה אין יכולין לערב שכשיתנו הנסר מזו לזו יבא מקרן זוית של זו לשל זו ולא חשיב פתח דפתחא בקרן זוית לא עבדי אינשי » (טור או״ח שע״ג) — but if they did not face each other, one offset to the east and the other to the west — « כזה », like this [the word announces a figure, which the text served by Sefaria does not carry] —, they cannot make the eruv: the plank laid from one to the other would run from the corner of one to that of the other, which does not count as an opening, for people do not make an opening in a corner; the Magen Avraham repeats it: « שכשיתנו הנסר מזו לזו יבא מקרן זויות של זו לשל זו ופתחא בקרן זויות לא עבדי אינשי » (מגן אברהם שע״ג ס״ק ג).
Hakira — what is lacking in a plank laid between two offset balconies: the form of an opening, or the ease of crossing? The Mishnah Berurah writes both reasons, one after the other:
- The form: « שכשיתנו הנסר מזו לזו יבא מקרן זוית של זו לזו ופתחא בקרן זוית לא עבדי אינשי » (משנה ברורה שע״ג ס״ק ט) — the Tur's reason.
- The crossing: « וגם לפי שאין הגשר ישר אלא באלכסון עומד מתירא אדם לעבור בו » (משנה ברורה שע״ג ס״ק ט) — the bridge not being straight but diagonal, a person is afraid to cross it.
The first concerns the corner; the second, the slant itself.
This is Tosafos' question on Rashi (section 2): with a plank of four, why must they face each other? The Rashba reports it, with the answer they propose for Rashi: « והקשו עליו בתוספות דכיון שעל ידי נסר רחב ארבעה מיירי, מאי קא דייק בגמרא » (רשב״א עירובין ע״ח ע״ב) ; « והם ז״ל תירצו דשמא נאמר דכיון שמשוכות זו מכנגד זו אם נתן נסר מזו לזו לצד קרן זוית של זו ושל זו הוה ליה פיתחא בקרן זוית ופיתחא בקרן זוית לא עבדי אנשי » (רשב״א עירובין ע״ח ע״ב) — perhaps one should say that, since they are offset, the plank laid from one to the other would be at the side of the corner of each, and it would be an opening in a corner, which people do not make. He continues: « ועדיין קשה דמאי שנא מההיא דאביי דלעיל » (רשב״א עירובין ע״ח ע״ב) — the difficulty remains: how is this different from Abaye's case above? summary of what follows: there, with a wall four wide, [the ladders help] even far apart. And he answers: « ומסתברא שאין זה קשה כלל, דהתם הוה להו שתי הסולמות כשני פתחים הפתוחים על גג משותף כיון שרחב הכותל ארבעה » (רשב״א עירובין ע״ח ע״ב) — this is no difficulty: there the two ladders are like two openings onto a shared roof, since the wall is four wide.
A slanted plank, but not at the corners —
- The Taz infers from the Tur's reason: « משמע כל שאינם בקרן זוית שפיר מהני הנסר אע״ג דהוה בעיקום וכ״מ בקושיית התוספות דבנסר מהני אפילו זו שלא כנגד זו » (ט״ז או״ח שע״ג ס״ק ג) — it follows that as long as they are not at a corner, the plank does help, even slanted; and this is what he reads in Tosafos' question: with a plank, it helps even when they do not face each other.
- The Biur Halachah first reports the Taz's reading: « עיין בט״ז דמשמע מיניה דהמחבר ג״כ ס״ל כהתוספות וע״כ הסכים דמשום עיקום לבד לא הוי ריעותא ומהני נסר » (ביאור הלכה שע״ג) — according to the Taz, the Mechaber too holds like Tosafos, and the slant alone is not a flaw; then the view of the Eliyah Rabbah: « והנה בא״ר חולק עליו וסובר דאין נ״מ אלא כל שהוא מעוקם בג״ט לא מהני נסר וכתב דכן משמע בשו״ע שלא חילק בזה והמחבר סתם כרש״י ודלא כדעת התוספות בשם ר״ת וכן משמע בעו״ש דהמחבר סתם כדעת רש״י » (ביאור הלכה שע״ג) — there is no difference: whenever there is a slant of three tefachim, the plank does not help; this is implied by the Shulchan Aruch, which does not distinguish, and the Mechaber wrote without qualification like Rashi, and not like Tosafos in the name of Rabbeinu Tam; and so it is implied by the עו״ש [the Olas Shabbos]. In brackets, he objects to the Taz: « ובאמת דברי הט״ז קשה מאד דמשמע מניה דהתוס׳ ג״כ מודים היכא דאיתרמי שהניח הנסר בקרן זוית של הגזוזטרא מזו לזו לא חשבינן אותו כפתח והמעיין בחידושי הרשב״א יראה להדיא דלהתוס׳ דמקשים מהא דסולם והביאו מזה ראי׳ דמהני הוא אפילו היכא דהנסר מונח בקרן זוית וא״כ ע״כ דהשו״ע לא סתם כהתוספות » (ביאור הלכה שע״ג) — according to the Taz, Tosafos would agree that a plank laid at the corner is not an opening; yet in the Chiddushei HaRashba one sees clearly that for Tosafos, who object from the case of the ladder, the plank helps even laid at the corner; hence the Shulchan Aruch did not write like Tosafos.
Nafka mina — two balconies offset by three tefachim or more, and a plank laid on a slant that does not start from the corners. The Taz bases on the reason of the corner his inference that it helps; the Eliyah Rabbah, whom the Biur Halachah follows (וכן עיקר), writes that it does not help. The Biur Halachah gives as the basis of this conclusion the reading of Rashi that, he writes, many Rishonim hold; he does not invoke here the Mishnah Berurah's second reason. For halachah lema'aseh, consult your Rav.
7. One higher than the other — the height, and the reading of the Gemara
The seif: « וכן אם היתה אחת גבוה מחבירת׳ לא חשיב פתח » (שו״ע או״ח שע״ג:א) — the Gemara: "and one above the other, also not" (section 1).
The Rashba, on the height: « וטפי קשה לי לדידי מזו למעלה מזו דמאי שנא מסולם שבין חצר לעליה. ושמא אינו כגירסת אלה הספרים. וכן אינה במקצת הספרים שלנו, אבל בפר״ח ז״ל ישנה » (רשב״א עירובין ע״ח ע״ב) — the case of one above the other is even harder for him: how is it different from the ladder between a courtyard and an upper storey? Perhaps, he writes, this is not the reading of these books: it is missing in some of his books, but it is found in Rabbeinu Chananel.
8. Less than three tefachim — "a bent balcony"
The seif: « והני מילי כשמרוחקו׳ זו מזו ג״ט אבל אם הם תוך ג׳ זו לזו בין בריחוק בין בגובה חשיב שפיר כפתח » (שו״ע או״ח שע״ג:א). The Tur wrote: « אבל אם הם תוך שלשה זו לזו בין בריחוק בין בגובה חשיב שפיר כפתח » (טור או״ח שע״ג) ; the words והני מילי כשמרוחקו׳ זו מזו ג״ט of the seif are not in the Tur; they take up, in substance, Rava's statement, "this is when there are three tefachim between one and the other" (section 1).
Yesod — the Mishnah Berurah reads "whether in offset or in height": « דע דמה שאמרו בין בריחוק בין בגובה היינו שמרוחק זה מזה יותר מד׳ טפחים באויר שבין זו לזו אלא שזו גבוה מזו בפחות מג׳ טפחים אז אמרינן דהוי כאלו הם שניהם זו כנגד זו ונותן נסר מזו לזו כיון שהמרחק שביניהם יותר מד׳ טפחים » (משנה ברורה שע״ג ס״ק י״א) — the gap between them, in the air, is more than four tefachim, but one is higher than the other by less than three: then it is as if both faced each other, and one lays a plank from one to the other, since the distance between them exceeds four; « וה״ה נמי כשמרוחק זו מזו בפחות מג׳ טפחים בריחוק שזו לצד מזרח וזו לצד מערב ואינם זה כנגד זה ממש רק שמרוחק פחות מג״ט אמרינן לבוד והוי כאלו הם זו כנגד זו ואז אף שעדיין יש אויר רחוק בין זו לזו יותר מד״ט מותר ע״י נסר שנותן בין זו לזו » (משנה ברורה שע״ג ס״ק י״א) — likewise, when the offset to the east or the west is less than three tefachim, we apply lavud, and it is as if they faced each other; and then, although there is still more than four tefachim of air between them, it is permitted through the plank laid from one to the other. The lavud of three tefachim makes them face each other; when the gap between them exceeds four, it does not dispense with the plank.
9. Summary of the shitos and halachic conclusion
The foundation — the Mishnah of Eruvin 78b and Rava's statements in 79a, which the Rishonim and Acharonim read as follows:
- the ditch, the plank, the two balconies, and Rava on the offset, the height and the three tefachim — section 1;
- the Mishnah of the balconies speaks of the plank according to Rashi — whom, according to the Biur Halachah, the Rashba and the Ritva, among others, follow —, and of the empty space between them according to Rabbeinu Tam in Tosafos — section 2;
- the plank: like a bridge, and an opening through which one carries from courtyard to courtyard, if they make the eruv together; fixed with a nail (the Magen Avraham in the name of the Shiltei HaGiborim; the Mishnah Berurah); inhabited upper storeys (the Pri Megadim, cited by the Mishnah Berurah) — section 3;
- the Rema's gloss, within four without a plank: two eruvin or one according to Tosafos, whom the Rema follows according to the Taz; one eruv, and not two, in the Tosefta as Sefaria serves it, in Rabbeinu Tam's explanation as the Rashba reports it, who rejects it as a reading of the Mishnah (section 2), and in the Maggid Mishneh, in the Rashba's name, as reported by the Beis Yosef (the Maggid Mishneh's text served by Sefaria says "from the Tosefta", the Beis Yosef "from Tosafos"); the Taz's distinction; the limit of ten amos (the Magen Avraham; the Mishnah Berurah) — section 4;
- "and if they wish": the order of the Mishnah and the Tur, and that of the Rambam and the seif; the limit of ten amos for the plank, and the prohibition that the Mishnah Berurah finds reasonable on the plank itself — section 5;
- offset balconies: the reason of the corner (the Tur; the Magen Avraham; the Mishnah Berurah) and that of the slanted crossing (the Mishnah Berurah); the Taz and the Eliyah Rabbah, and the Biur Halachah, which concludes וכן עיקר — section 6;
- one higher than the other: the Rambam; the Maggid Mishneh, who reports Rashi on height; the reading the Rashba doubts — section 7;
- less than three tefachim: the sentence that the seif adds to the Tur; lavud, which does not dispense with the plank when the gap exceeds four (the Mishnah Berurah, ס״ק י״א); the Magen Avraham (ס״ק ה) — section 8.
