📜 The text of the Shulchan Aruch — 4 seifim

summary: heading of the siman, then seif א. [Two courtyards] that made an eruv through a window or a doorway between them, and [the opening] was closed up on Shabbos: one may make use [of them] over the top of the wall and through its holes. Even if the eruv was made for the year, the doorway was closed up on a weekday and opened on Shabbos — in small type, in parentheses, without the word הגה: (even if he closed it up deliberately) (Agur) —, the eruv returns to its permission. According to the Rambam, one may carry only in each one by itself, and not from one to the other.

summary: the wall between two courtyards, each having made an eruv for itself, was breached on Shabbos: each person carries in his own courtyard, even the utensils of the house. But a courtyard breached on Shabbos onto the public domain or onto a karmelis is forbidden.

summary: a small courtyard breached before Shabbos, along its full width, onto a large one, the breach being no more than ten amos: the large one may take out into its courtyard utensils that were in the house at the start of Shabbos, if it made an eruv for itself; the small one may not, unless they made an eruv together. This is when the walls of the small one enter the large one, and when they are three tefachim away from the walls along the length of the large one; otherwise, the small one would be permitted by the principle seen from outside and even from inside.

summary: a small roof open before Shabbos, along its full width, onto a large one: one may not bring up onto the small one utensils that were in the house at the start of Shabbos; onto the large one it is permitted — provided the walls of the house are recognizable to one standing on the roof. If they are not, for example if the roof juts out over them, it is a karmelis, unless a window of four by four opens to it from the house.

1. Rabbah's sugya — the Shabbos that has been permitted (seif א)

The Gemara cites a dispute between Rav Huna and Rabbi Yitzchak, about three [people] of whom one dies, or two to whom others are added: « שְׁלֹשָׁה וּמֵת אֶחָד מֵהֶן, שְׁנַיִם וְנִתּוֹסְפוּ עֲלֵיהֶן — רַב הוּנָא וְרַבִּי יִצְחָק, חַד אָמַר: שַׁבָּת גּוֹרֶמֶת, וְחַד אָמַר: דָּיוֹרִין גּוֹרְמִין » (עירובין י״ז ע״א) — one says: Shabbos determines; the other: the residents determine. It establishes who said what: « תִּסְתַּיֵּים דְּרַב הוּנָא הוּא דְּאָמַר שַׁבָּת גּוֹרֶמֶת » (עירובין י״ז ע״א), from what Rabbah reports: « דְּאָמַר רַבָּה: בְּעַאי מֵרַב הוּנָא, וּבְעַאי מֵרַב יְהוּדָה: עֵירַב דֶּרֶךְ הַפֶּתַח וְנִסְתַּם הַפֶּתַח, דֶּרֶךְ הַחַלּוֹן וְנִסְתַּם הַחַלּוֹן, מַהוּ? וְאָמַר לִי: שַׁבָּת הוֹאִיל וְהוּתְרָה — הוּתְּרָה » (עירובין י״ז ע״א). Rabbah asked Rav Huna and Rav Yehudah: an eruv was made through a doorway, and the doorway was closed up; through a window, and the window was closed up — what is the law? He was told: Shabbos, since it was permitted, remains permitted.

The Tur — writes the rule with this reason: « עירבו דרך חלון או פתח שביניהן ונסתם בשבת מותרין להשתמש דרך גובה הכותל וחוריו דשבת כיון שהותרה הותרה » (טור או״ח שע״ד). Seif א writes the same rule, without the reason.

יסוד — the Mishnah Berurah gives the same reason, on the words דרך גובה הכותל וחוריו: « אפ״ה לא נתבטל העירוב על שבת זו דכיון שהותר בתחלת השבת הותר לכל השבת » (משנה ברורה שע״ד ס״ק ג) — although, the doorway being closed, the holes do not have the measure of a window, the eruv is not cancelled for this Shabbos: permitted at the start of Shabbos, it is permitted for the whole of Shabbos.

The Shulchan Aruch HaRav writes, in its seif 1: « מֻתָּרִים לְהִשְׁתַּמֵּשׁ מִזֶּה לְזֶה דֶּרֶךְ גֹּבַהּ כֹּתֶל וְחוֹרָיו, שֶׁשַּׁבָּת כֵּיוָן שֶׁהֻתְּרָה — הֻתְּרָה » (שו״ע הרב שע״ד:א) — they may make use from one to the other over the top of the wall and through its holes, for Shabbos, since it was permitted, remains permitted; see Level 4, point א.

If the doorway was closed up while it was still day, the Biur Halachah writes, on the words ונסתם בשבת: « אבל אם נסתם מבעוד יום אפילו חזר ונפתח בשבת אסורין לפי שעדיין לא קנו עירוב מעולם שקניית העירוב הוא בה״ש וכאן לא היה עירוב ביה״ש כיון שהפתח סתום ואפילו אם עירבו כבר לפני שבת שעברה לשבת אחת ואותו עירוב נשאר עדיין קיים אין יכולין לסמוך עליו בשבת זו אחר שנפתח הפתח הואיל וכבר נתבטל מבעוד יום כשנסתם ואינו חוזר וניעור משתחשך » (ביאור הלכה שע״ד) — forbidden even if reopened on Shabbos, since the eruv is acquired at twilight; and even an eruv made before a past Shabbos, for a single Shabbos, does not help.

2. The eruv made for the year (seif א)

Seif א continues: « ואפי׳ אם עירב לשנה ונסתם הפתח בחול ונפתח בשבת » (שו״ע או״ח שע״ד:א), and concludes that the eruv returns to its permission. The Tur writes the same sentence, with an aside after the words "closed up on a weekday": « ואפילו אם עירבו לשנה ונסתם הפתח בחול דהשתא לא נכנסה השבת בהיתר ונפתח בשבת חזר העירוב להתירו » (טור או״ח שע״ד) — since the doorway was closed up on a weekday, Shabbos did not begin in a state of permission. The Beis Yosef gives the source: « ומ״ש ואפילו עירבו לשנה וכו׳ כ״כ הרא״ש בספ״ק דעירובין » (בית יוסף או״ח שע״ד) — the Rosh writes it at the end of the first chapter of Eruvin.

The Biur Halachah distinguishes the eruv made for the year from the rule of section 1: « ועירב לשנה שאני שמערב מתחלה על כל השבתות וקנה העירוב בשבת ראשונה שהיה הפתח פתוח ולכן אפילו אם אח״כ נסתם הפתח ונפתח בשבת אחרת ואפילו בסוף השנה חוזר העירוב וניעור » (ביאור הלכה שע״ד) — made from the outset for all the Shabbosos, it was acquired on the first Shabbos while the doorway was open; it comes back to life when the doorway reopens on another Shabbos, even at the end of the year.

Where does this rule come from? The Biur Halachah first refers to the Magen Avraham: « עיין במגן אברהם סימן שפ״ג שנשאר בדין זה בצ״ע אכן כמה אחרונים יישבו קושיותיו שם » (ביאור הלכה שע״ד) — the Magen Avraham, in siman 383, leaves this rule with a צ״ע; however, several Acharonim resolved his difficulties there. It then writes that, even so, the rule is not clear, and gives its source: « ומ״מ אין דין זה ברור דהנה מקור זה הדין נובע מדברי הרא״ש ספ״ק דעירובין דהביא ראיה מדין ספינות שנפסקו וחזרו ונתקשרו [שבת דף ק״א] דחזרו להתירן הראשון » (ביאור הלכה שע״ד). The Rosh drew a proof: « והוכיח הרא״ש דמיירי שנפסקו בחול ואפ״ה מהני כשחזרו ונתקשרו אח״כ בשבת דאי נפסקו בשבת אפילו לא חזרו ונתקשרו מותרין משום דהותרה הותרה » (ביאור הלכה שע״ד) — had the baraisa spoken of boats separated on Shabbos, they would be permitted even without being retied; so it speaks of boats separated on a weekday. חָזְרוּ וְנִקְשְׁרוּ, בֵּין שׁוֹגְגִין וּבֵין מְזִידִין בֵּין אֲנוּסִין בֵּין מוּטְעִין — חָזְרוּ לְהֶיתֵּרָן הָרִאשׁוֹן » (שבת ק״א ע״ב) — tied boats: one makes an eruv and carries from one to the other; separated, they are forbidden; retied, whether unintentionally or deliberately, under duress or by mistake, they return to their original permission. After the rest of the baraisa (the mats, and the rule that any partition made on Shabbos, whether unintentionally or deliberately, is a partition), the Gemara objects and answers: « אִינִי?! וְהָאָמַר רַב נַחְמָן: לֹא שָׁנוּ אֶלָּא לִזְרוֹק, אֲבָל לְטַלְטֵל אָסוּר! כִּי אִיתְּמַר דְּרַב נַחְמָן — אַמֵּזִיד אִיתְּמַר » (שבת ק״א ע״ב) — but did Rav Nachman not say: it was taught [that it is a partition] only for [making liable one who] throws, but carrying is forbidden! — Rav Nachman's statement was said of the deliberate case. According to Rashi on this passage, retied deliberately, one does not carry from one to the other: a partition made deliberately counts only to make liable one who throws from there into the public domain, or the reverse.

But others read the baraisa differently: « אכן לדברי התוספות [בשבת ק״א] וכן לכמה ראשונים [הרמב״ם עי״ש ובהרה״מ ספ״ג והרשב״א והריטב״א] שפירשו להך ברייתא דאפילו נפסקו בשבת אסור משום דכיון דבלא הקשר שביניהם ניידי ממקומם הוי כמפסיק כרמלית ביניהם ולא שייך בזה לומר כיון שהותרה הותרה א״כ אין שום מקור לדין זה » (ביאור הלכה שע״ד) — even if separated on Shabbos they are forbidden, since the space between them is like an intervening karmelis; on their reading, the rule has no source. The Rambam writes, of the boats: « וְכֵן שְׁתֵּי סְפִינוֹת שֶׁהָיוּ קְשׁוּרוֹת זוֹ בָּזוֹ וְעֵרְבוּ וְנִפְסְקוּ אָסוּר לְטַלְטֵל מִזּוֹ לָזוֹ וַאֲפִלּוּ הָיָה מֻקָּפוֹת מְחִצָּה. חָזְרוּ וְנִקְשְׁרוּ בְּשׁוֹגֵג חָזְרוּ לְהֶתֵּרָן » (הלכות עירובין פ״ג הכ״ה) — two tied boats that made an eruv and then separated: one may not carry from one to the other, even if they are surrounded by a partition; retied unintentionally, they return to their permission. And the Biur Halachah writes, by reasoning: « ומסברא אין לומר כן שיועיל מה שחל בשבת אחת לשבת אחרת כיון שבה״ש של אותו שבת היה בטול » (ביאור הלכה שע״ד) — one cannot say that what took effect on one Shabbos helps for another Shabbos, whose twilight was without an eruv.

Tosafos in one place and in another. The Magen Avraham notes that Tosafos do not write the same thing in the two places: « ומ״מ התו׳ ד׳ י״ז כ׳ ג״כ דאפי׳ נפתח בשבת שרי והביאו ראיה מספינה ובד׳ ק״א בשבת כתבו דאפי׳ נפתח בשבת אסור » (מגן אברהם שע״ד ס״ק א) — in Eruvin daf 17 they write that even if it reopened on Shabbos it is permitted, bringing a proof from the boat; in Shabbos daf 101, that even if it reopened on Shabbos it is forbidden; and he proposes: « לכן צ״ל דראייתם כי היכי דהתם מחזר ממילא להתיר׳ הראשון ה״נ כן » (מגן אברהם שע״ד ס״ק א) — their proof is only that the eruv returns by itself to its original permission, as with the boats. The Biur Halachah writes: « אלא דדעת התוספות גופא אינה ברורה בזה דבעירובין דף י״ז כתבו התוספות בשם ר״י דין זה וגם ראיה מהא דספינה ומשמע דלרבותינו בעלי התוספות היו בזה דעות חלוקות » (ביאור הלכה שע״ד) — the view of Tosafos themselves is not clear: in Eruvin daf 17 they write this rule in the name of the Ri, with the proof from the boat; it seems that the Ba'alei HaTosafos held divided views on it. It rejects the Magen Avraham's reconciliation: « ומה שרצה המגן אברהם לתרץ קצת דעות התוספות להדדי לא נהירא » (ביאור הלכה שע״ד) — it does not seem right to it.

It nevertheless concludes: « ומ״מ אחרי שהרא״ש והטור והמחבר והאחרונים שאחרי השו״ע העתיקו דין זה בודאי אין לדחותו מהלכה » (ביאור הלכה שע״ד) — since the Rosh, the Tur, the Mechaber and the Acharonim after the Shulchan Aruch copied this rule, it is certainly not to be rejected from the halachah.

חקירה — an eruv acquired once, or acquired every Shabbos? According to the Mishnah Berurah, the eruv took effect when it was placed for several Shabbosos, and it is not cancelled: « כיון שבעת הנחת העירוב שהניח לכמה שבתות או לשנה היה פתח מזו לזו וחל העירוב לכן אף שבשבת אחרת היה סתום מתחלת השבת ולא היה אז העירוב מועיל לכולם מ״מ לא נתבטל ומיד שנפתח חזר העירוב להתירו הראשון » (משנה ברורה שע״ד ס״ק ד). The Biur Halachah writes the same of the eruv made for the year (above). The other side is the difficulty it states itself: what took effect on one Shabbos should not help for another Shabbos, whose twilight was without an eruv. The Shulchan Aruch HaRav writes the rule with the condition of the first Shabbos: « וְקָנוּ עֵרוּב בְּבֵין הַשְּׁמָשׁוֹת שֶׁל שַׁבָּת רִאשׁוֹנָה, שֶׁהָיָה הַפֶּתַח פָּתוּחַ » (שו״ע הרב שע״ד:א); see Level 4, point ב.

The tzuras hapesach of the alley, repaired on Shabbos. The Biur Halachah extends the rule of the eruv made for the year to an eruv chatzeiros cancelled because the tzuras hapesach of the alley was damaged, when it was repaired on Shabbos by a non-Jew or the like, and writes: « ואף דיש לחלק קצת דאפשר בנפרץ המחיצות גרע טפי ולא יועיל בזה מה שעירב לכל השנה מ״מ בשעת הדחק יש להקל גם בזה » (ביאור הלכה שע״ד) — one could distinguish, a breach in the partitions perhaps being more severe; nevertheless, in a pressing need, one may be lenient here too. For an eruv made for a single Shabbos, it rejects the leniency of the Nishmas Adam: « אכן מה שמצדד שם להקל אף כשעירב לשבת אחת ונודע שמבעוד יום נתקלקל הצוה״פ וחזר ונתקן הצוה״פ בשבת ע״י עכו״ם דהעירובי חצרות לא חל כלל עוד בבין השמשות ומטעם דכיון שבאותו המקום רגילין לעשות צוה״פ תמיד א״כ עומד להתקן ולכן כשמתקנים אותו אח״כ בשבת חל העירובי חצרות למפרע לא נהירין דבריו כלל » (ביאור הלכה שע״ד) — the Nishmas Adam leans to be lenient even for an eruv made for one Shabbos, when the tzuras hapesach was damaged by day and repaired on Shabbos by a non-Jew, the eruv taking effect retroactively, since a tzuras hapesach is always made there; its words, writes the Biur Halachah, do not seem correct to him at all. This case is not in the seif; it is the Biur Halachah that discusses it.

3. The doorway closed up deliberately (seif א)

In seif א, between ונפתח בשבת and חזר העירוב להתירו, there is a parenthesis in small type, without the word הגה: « ואפילו סתמה במזיד » (שו״ע או״ח שע״ד:א), followed by its source, the Agur. The Beis Yosef reports that the Agur writes in the name of the Maharil (מהר״י מולין): « וכתב האגור בשם מהר״י מולין שנשאל אם סתם הפתח ואח״כ נמלך לפתחו אם חזר העירוב להיתרו הראשון לשבת הבאה או נאמר דוקא כשנסתם הפתח מעצמו והשי׳ אין בידו לחלק בין שוגג למזיד כיון דחזר העירוב למקומו » (בית יוסף או״ח שע״ד) — the Maharil was asked about one who closed up the doorway and then changed his mind and reopened it: does the eruv return to its original permission for the next Shabbos, or only when the doorway closed up by itself? He answered that he has no basis to distinguish between unintentional and deliberate, since the eruv has returned to its place.

Reopened before Shabbos, or on Shabbos? The Magen Avraham, on the words « ואפי׳ סתמה במזיד » (מגן אברהם שע״ד ס״ק א), gives the reason for the leniency when it was reopened before Shabbos: « דכשחוזר ופותח׳ קודם שבת הרי הם כשותפין בפת ובין השמשו׳ שהוא קונה עירוב הרי יש פתח ביניהם ראוי לערב » (מגן אברהם שע״ד ס״ק א) — at twilight, when the eruv is acquired, there is a doorway between them fit for an eruv; but reopened on Shabbos: « א״כ כשנפתח בשבת אסור דכיון דסתמו במזיד גלי דעתי׳ שאינו חפץ בעירו׳ וא״כ ב״ה לא קנה עירוב ולזה נתכוין האגו׳ שכ׳ בשם מהרי״ל » (מגן אברהם שע״ד ס״ק א) — since he closed it up deliberately, he revealed that he does not want the eruv, and at twilight it was not acquired; this is what the Agur meant. It ends with a reservation: « ומיהו בסתמא במזיד לא מהני נפתח בשבת וצ״ע » (מגן אברהם שע״ד ס״ק א) — however, when it was closed up deliberately, reopening on Shabbos does not help, and this requires further study.

The Mishnah Berurah: « ודע דמ״א וכמה אחרונים צידדו לאסור בזה כשחזר ונפתח בשבת דכיון שסתם הפתח שבין שתי החצרות במזיד הוי כביטל העירוב בידים » (משנה ברורה שע״ד ס״ק ה) — the Magen Avraham and several Acharonim lean to forbid; then: « ואין להקל כשסתמו במזיד אלא כשנפתח קודם השבת דאז אמרינן אף שנתבטל מעיקרא כיון שחזר ונפתח הרי עכ״פ הם שותפין בפת של עירוב וביה״ש שהוא זמן קניית העירוב הרי יש פתח ביניהם שראוי לערב ועיין בבה״ל שביארנו שכן ראוי לנהוג למעשה » (משנה ברורה שע״ד ס״ק ה) — one is lenient, when it was closed up deliberately, only if it reopened before Shabbos: then, even if the eruv was cancelled at first, they are partners in the bread of the eruv, and at twilight there is a doorway between them fit for an eruv; it refers to the Biur Halachah, where it writes that this is how one should act in practice. It adds an exception: « אכן אם בעת שסתמו היה בדעתו רק לפי שעה ואח״כ לחזור ולפתחו מסתברא דמותר אף כשחזר ונפתח בשבת » (משנה ברורה שע״ד ס״ק ה) — if he closed it up only for a time, intending to reopen it, it stands to reason that it is permitted, even if it reopened on Shabbos.

The Biur Halachah: « ומ״מ לענין סתמו במזיד שהמ״א הביא ממהרי״ל שלא התיר אלא דוקא בשנפתח קודם השבת וכן הסכים בא״ר ותו״ש בודאי אין להקל בזה כיון דמעיקר הדין אפילו נפתח בשבת בשוגג ג״כ אין הדין ברור להקל כנ״ל » (ביאור הלכה שע״ד) — certainly not to be lenient, since even when it reopened unintentionally on Shabbos, the rule is not clear; on the view of the one it calls the Rema: « ואף שיש אחרונים שמיישבין בדוחק את סברת הרמ״א דמתיר בכל גווני מ״מ למעשה נראה שאין להקל וכנ״ל » (ביאור הלכה שע״ד) — although some Acharonim justify, with difficulty, the view of the Rema who permits in all cases, in practice it appears that one should not be lenient; finally it reports: « ובספר נתיב חיים לבעל ק״נ דעתו דאף הרמ״א עצמו לא הקיל בזה אלא בשנפתח אח״כ בחול » (ביאור הלכה שע״ד) — according to the Nesiv Chaim, even the Rema was lenient only when the doorway reopened afterwards on a weekday. The text of the seif does not name the author of the parenthesis; it is the Biur Halachah that attributes it to the Rema.

חקירה — on what does the return of the eruv depend? The Taz reports the distinction of his father-in-law: « כתב מו״ח ז״ל ול״נ לחלק דאם פרץ פצימיו נתבטל העירוב ואם לא פרץ פצימיו דכשסתם פתחו לא סילק מזוזתו ומשקופו ומפתנו דגלי דעתיה דלא סילק לנפשיה חזר העירוב למקומו והכי מחלק תלמודא פ״ק דב״ב דף י״א עכ״ל » (ט״ז או״ח שע״ד ס״ק א) — if he broke down the doorposts, the eruv is cancelled; if he did not, having removed neither doorpost, lintel nor threshold when closing up the doorway, he showed that he did not withdraw himself, and the eruv returns to its place. The Taz rejects it: « ולי מהא לא אירי׳ דשאני התם בב״ב שתליא מילתא בגליא דעתיה אבל הכא לא איכפת לן באסוחי דעתיה » (ט״ז או״ח שע״ד ס״ק א) — in the passage of Bava Basra cited, everything depends on revealed intention, but here a diversion of the mind does not matter; and concludes: « אלא ודאי דהעיקר תלוי בעשיי׳ העירוב כיון דהיה ראוי באותה שעה דאע״פ שנתקלקל אח״כ כיון דנתקון אח״כ לית לן בה וחזר העירוב למקומו » (ט״ז או״ח שע״ד ס״ק א) — everything depends on the making of the eruv, made at a time when it was possible. The Magen Avraham, on the Bach's distinction: « והב״ח כתב דבפרץ פצימיו בטל העירוב ואינו מוכרח » (מגן אברהם שע״ד ס״ק א) — it is not compelling. For the Taz, the diversion of the mind does not count; for the Magen Avraham, closing it up deliberately shows that he does not want the eruv (above).

According to when the doorway is reopened. Reopened before Shabbos: the Magen Avraham and the Mishnah Berurah permit, the doorway being open at twilight. Reopened on Shabbos: the Magen Avraham forbids, ending with a צ״ע; the Mishnah Berurah and the Biur Halachah are not lenient. Closed up deliberately, but only for a time, intending to reopen it: the Mishnah Berurah writes that it stands to reason that it is permitted, even if it reopened on Shabbos.

The Shulchan Aruch HaRav writes: « וַאֲפִלּוּ סְתָמוֹ בְּמֵזִיד. וּלְעִנְיַן הֲלָכָה, בְּדִבְרֵי סוֹפְרִים הַלֵּךְ אַחַר הַמֵּקֵל » (שו״ע הרב שע״ד:א) — and even if he closed it up deliberately; and there is one who is concerned to be stringent if he closed it up deliberately, since he thereby revealed that he does not want the eruv; and as for the halachah, in rabbinic matters follow the lenient view. It reports the stringent view without naming it; see Level 4, point ג.

4. The Rambam's view — each one by itself (seif א)

Seif א ends with the Rambam's view. It first writes מותרים להשתמש, without saying "from one to the other", then: ולהרמב״ם — according to the Rambam, each one by itself only.

From one to the other, or each by itself? The Beis Yosef reports how the Tur understands the permission: « ופירש רבינו דמותרין לטלטל מזו לזו כמו שהיו לומר מותר לטלטל מזו לזו דרך גובה הכותל וחורין וסדקין וכן פירש״י » (בית יוסף או״ח שע״ד) — one carries from one to the other as before, over the top of the wall, through the holes and the cracks, and this is how Rashi explains it. He then reports the Rambam's view, with the Maggid Mishneh's explanation: « אבל הרמב״ם בפ״ג מה״ע כתב שכל א׳ מותר לעצמה וכתב ה״ה דקמ״ל שאע״פ שהעירוב מונח באחד מהם וא״א לחצר שנייה ליטלו אבל מזו לזו דרך חורין או דרך אויר על גבי הכותל לא » (בית יוסף או״ח שע״ד) — each is permitted by itself; the novelty is that even the one in which the eruv is not placed, and which cannot go to take it, is permitted; but from one to the other, through the holes or over the wall, no. The Rambam's words: « שְׁתֵּי חֲצֵרוֹת שֶׁעֵרְבוּ עֵרוּב אֶחָד דֶּרֶךְ הַפֶּתַח שֶׁבֵּינֵיהֶן אוֹ דֶּרֶךְ הַחַלּוֹן וְנִסְתַּם הַפֶּתַח אוֹ הַחַלּוֹן בְּשַׁבָּת כָּל אַחַת וְאַחַת מֻתֶּרֶת לְעַצְמָהּ הוֹאִיל וְהֻתְּרָה מִקְצָת שַׁבָּת הֻתְּרָה כֻּלָּהּ » (הלכות עירובין פ״ג הכ״ה).

The Magen Avraham limits that view: « דוקא כשהפתח סתום דאעפ״י שהעירוב מונח בחצר אחרת מותר לטלטל לעצמה אבל כשנפתח הפתח חזרו שניהם להיתרן » (מגן אברהם שע״ד ס״ק ב) — only as long as the doorway is closed; once it has opened, both return to their permission.

חקירה — what does the Shabbos that has been permitted preserve? Two readings can be seen here. According to the Mishnah Berurah, it is the eruv itself that is not cancelled for this Shabbos (ס״ק ג, section 1), and it reads the first opinion: « מזו לזו בשבת זו וכ״ש כל אחת לעצמה דמותרת אף אותה שאין העירוב מונחת בתוכה » (משנה ברורה שע״ד ס״ק ב). According to the Rambam, as the Maggid Mishneh explains him in the Beis Yosef, it is the permission of each courtyard by itself, even of the one in which the eruv is not placed; the Mishnah Berurah writes this too of the Rambam's view: « והרבותא הוא דאפילו אותה חצר שאין העירוב מונח בתוכה מותרת ומ״מ אם חזר ונפתח לכו״ע מותר לטלטל מזו לזו כמו מתחלה » (משנה ברורה שע״ד ס״ק ו) — the novelty is that even the one in which the eruv is not placed is permitted; and if the doorway reopened, all agree that one carries from one to the other, as at first. For the halachah, it writes: « ולענין הלכה העיקר כסברא הראשונה כ״כ האחרונים » (משנה ברורה שע״ד ס״ק ו).

The Shulchan Aruch HaRav writes "from one to the other" (section 1), and its seif 1 does not report the Rambam's view; see Level 4, point א.

5. The wall between two courtyards that fell on Shabbos — Rav and Shmuel (seif ב)

The Gemara: « כּוֹתֶל שֶׁבֵּין שְׁתֵּי חֲצֵירוֹת שֶׁנָּפַל, רַב אָמַר: אֵין מְטַלְטְלִין בּוֹ אֶלָּא בְּאַרְבַּע אַמּוֹת » (עירובין צ״ג ע״ב) — Rav says one carries in it only within four amos; and Shmuel says: « זֶה מְטַלְטֵל עַד עִיקַּר מְחִיצָה, וְזֶה מְטַלְטֵל עַד עִיקַּר מְחִיצָה » (עירובין צ״ד ע״א) — each one carries up to the place of the partition. The Gemara adds: « וְהָא דְּרַב לָאו בְּפֵירוּשׁ אִתְּמַר, אֶלָּא מִכְּלָלָא אִתְּמַר » (עירובין צ״ד ע״א) — Rav's view was not stated explicitly but inferred from an incident: Rav and Shmuel were sitting in a courtyard whose dividing wall fell; Shmuel said to spread out a cloak, and Rav turned his face away. The Gemara answers, for Shmuel: « שְׁמוּאֵל עָבֵיד לִצְנִיעוּתָא בְּעָלְמָא » (עירובין צ״ד ע״א) — he did it for modesty only.

The Beis Yosef — on the utensils of which Shmuel speaks, and on the ruling: « ובכלי הבית קאמר שמואל דאי כששבתו בחצר אפילו מחצר לחצר נמי ופסקו הרי״ף והרא״ש כשמואל וכן דעת הרמב״ם בפ״ג מה״ע » (בית יוסף או״ח שע״ד) — Shmuel speaks of the utensils of the house, since those that were in the courtyard when Shabbos began may be carried even from courtyard to courtyard; the Rif and the Rosh ruled like Shmuel, and so is the Rambam's view. Seif ב writes « אפי׳ כלי הבי׳ » (שו״ע או״ח שע״ד:ב); the Mishnah Berurah: « דאלו כלי החצר מותר לטלטל אף מחצר לחצר גם כשנפרץ דכל החצרות רשות אחת » (משנה ברורה שע״ד ס״ק ח) — the utensils of the courtyard may be carried even from courtyard to courtyard when the wall is breached, all courtyards being one domain.

יסוד — the Rambam writes the rule with its reason, and adds a sentence about the residents: « וְכֵן שְׁתֵּי חֲצֵרוֹת שֶׁעֵרְבָה זוֹ לְעַצְמָהּ וְזוֹ לְעַצְמָהּ וְנָפַל הַכֹּתֶל שֶׁבֵּינֵיהֶן בְּשַׁבָּת אֵלּוּ מֻתָּרִים לְעַצְמָן וּמוֹצִיאִין מִבָּתֵּיהֶן וּמְטַלְטְלִין עַד עִקַּר הַמְּחִצָּה. וְאַף עַל פִּי שֶׁנִּתְוַסְּפוּ הַדִּיּוּרִין שֶׁהַדִּיּוּרִין הַבָּאִין בְּשַׁבָּת אֵינָן אוֹסְרִין » (הלכות עירובין פ״ג הכ״ה) — each is permitted for itself: they take out of their houses and carry up to the place of the partition, since, permitted for part of Shabbos, it is permitted for all of it; and although residents were added, residents who come on Shabbos do not forbid. The Mishnah Berurah: « מ״מ כיון שבין השמשות היה מותר הותר לכל השבת » (משנה ברורה שע״ד ס״ק ז) — [although each courtyard is now open onto a domain with which it is not joined,] nevertheless, since it was permitted at twilight (bein hashmashos), it is permitted for the whole of Shabbos.

The Taz gives the reason for the difference from the end of the seif: « כיון דלא נפרץ לרשות אחר אלא לחצר משא״כ בסיפא שנפרץ לרשות הרבים או לכרמלית » (ט״ז או״ח שע״ד ס״ק ב) — since it was breached only onto a courtyard, not onto another domain, unlike the end of the seif. The Biur Halachah specifies which breach the seif speaks of: « היינו במילואו או ביותר מעשר אמות » (ביאור הלכה שע״ד) — along its full width, or over more than ten amos. The Shulchan Aruch HaRav also writes up to the place of the wall: « מֻתָּרִים לְטַלְטֵל כָּל אֶחָד בַּחֲצֵרוֹ עַד מְקוֹם הַכֹּתֶל אֲפִלּוּ כֵּלִים שֶׁשָּׁבְתוּ בַּבַּיִת » (שו״ע הרב שע״ד:ב); see Level 4, point ד.

6. The courtyard breached onto the public domain or a karmelis (seif ב)

וַחֲכָמִים אוֹמְרִים: מִתּוֹכָהּ לִרְשׁוּת הָרַבִּים אוֹ מֵרְשׁוּת הָרַבִּים לְתוֹכָהּ — פָּטוּר, מִפְּנֵי שֶׁהִיא כְּכַרְמְלִית » (עירובין צ״ד ע״א) — according to the Sages, a courtyard breached onto the public domain is like a karmelis. And the next Mishnah: « חָצֵר שֶׁנִּפְרְצָה לִרְשׁוּת הָרַבִּים מִשְׁתֵּי רוּחוֹתֶיהָ, וְכֵן בַּיִת שֶׁנִּפְרַץ מִשְׁתֵּי רוּחוֹתָיו, וְכֵן מָבוֹי שֶׁנִּטְּלוּ קוֹרוֹתָיו אוֹ לְחָיָיו — מוּתָּרִים בְּאוֹתוֹ שַׁבָּת, וַאֲסוּרִים לֶעָתִיד לָבֹא, דִּבְרֵי רַבִּי יְהוּדָה. רַבִּי יוֹסֵי אוֹמֵר: אִם מוּתָּרִין לְאוֹתוֹ שַׁבָּת — מוּתָּרִין לֶעָתִיד לָבֹא, וְאִם אֲסוּרִין לֶעָתִיד לָבֹא — אֲסוּרִין לְאוֹתוֹ שַׁבָּת » (עירובין צ״ד ע״א) — according to Rabbi Yehudah, permitted on that Shabbos and forbidden in the future; according to Rabbi Yosei, if they are forbidden in the future, they are forbidden on that Shabbos. The Beis Yosef writes that the Tur understands that a breach made on Shabbos is included: « ומשמע לרבינו דאפילו בנפרץ בשבת מיירי » (בית יוסף או״ח שע״ד), and that « ואיפסיקא התם הלכתא כרבי יוסי דאסר אפילו באותה שבת » (בית יוסף או״ח שע״ד).

The Beis Yosef's question. « ואע״ג דבס״פ הנזכר בכותל שבין ב׳ חצירות שנפל פסקו הפוסקים כשמואל דשרי לטלטל כמו קודם שנפל וטעמא ודאי משום דשבת הואיל והותרה הותרה » (בית יוסף או״ח שע״ד) — for the wall between two courtyards that fell, the poskim ruled like Shmuel, and the reason is that Shabbos, once permitted, remains permitted: why not here?

« שאני התם דלא נפרץ אלא לחצר אחד שהוא רה״י כמוהו ואין ביניהם אלא שזה של יחיד א׳ הוא וזה של יחיד אחר אבל כשנפרץ לרשות אחרת ממש דהיינו לר״ה או לכרמלית לא אמרי׳ ביה הואיל והותרה הותרה » (בית יוסף או״ח שע״ד) — there, the courtyard was breached only onto another courtyard, a private domain like itself; here, onto a truly different domain. The Taz (section 5) and the Mishnah Berurah (ס״ק ט) also write this. The Magen Avraham gives the reason for the prohibition: « כיון שאין המחיצות קיימו׳ » (מגן אברהם שע״ד ס״ק ג) — since the partitions are no longer standing.

יסוד — in Rabbah's sugya (section 1), the Gemara asks whether Rav Huna and Rabbi Yitzchak hold the same dispute as Rabbi Yosei and Rabbi Yehudah in the Mishnah of the courtyard breached on two sides: « לֵימָא רַב הוּנָא וְרַבִּי יִצְחָק בִּפְלוּגְתָּא דְּרַבִּי יוֹסֵי וְרַבִּי יְהוּדָה קָמִיפַּלְגִי » (עירובין י״ז ע״א), and answers, for Rav Huna: « אָמַר לְךָ רַב הוּנָא: אֲנָא דַּאֲמַרִי אֲפִילּוּ לְרַבִּי יוֹסֵי, עַד כָּאן לָא קָאָמַר רַבִּי יוֹסֵי הָתָם — אֶלָּא דְּלֵיתַנְהוּ לִמְחִיצוֹת, הָכָא — אִיתַנְהוּ לִמְחִיצוֹת » (עירובין י״ז ע״א); for Rabbi Yitzchak: « וְרַבִּי יִצְחָק אָמַר: אֲנָא דַּאֲמַרִי אֲפִילּוּ לְרַבִּי יְהוּדָה, עַד כָּאן לָא קָאָמַר רַבִּי יְהוּדָה הָתָם — אֶלָּא דְּאִיתַנְהוּ לְדָיוֹרִין, הָכָא — לֵיתַנְהוּ לְדָיוֹרִין » (עירובין י״ז ע״א). According to Rav Huna, Rabbi Yosei said it only where the partitions are no longer there, not where they are; according to Rabbi Yitzchak, Rabbi Yehudah said it only where the residents are present, not where they are not. The comparison with the Magen Avraham's reason, the partitions no longer standing, is the page's own.

Within four amos, from the courtyard to the karmelis. The Beis Yosef: « ומיהו איכא חומרא בנפרצה לר״ה או רה״י מבנפרצה לכרמלית דבנפרצה לר״ה או לרה״י אסור לטלטל מהחצר להם אפילו בתוך ד״א ואילו בנפרצה לכרמלית מותר לטלטל מהחצר לכרמלית תוך ד״א » (בית יוסף או״ח שע״ד) — a breach onto the public domain or a private domain is more severe: one may not carry from the courtyard to them even within four amos; onto a karmelis, one may carry from the courtyard to the karmelis within four amos. The Magen Avraham is in doubt: « ואפשר דאע״פ שנפרץ שם חצר עליו ואסור לטלטל ממנו לכרמלית » (מגן אברהם שע״ד ס״ק ג) — perhaps, although it is breached, it keeps the name of a courtyard, and one may not carry from it to the karmelis. The Biur Halachah reports both sides and concludes: « והנה בתו״ש הביא ראיה מתוספות שבת דף ט׳ דמותר וכן הביא בחידושי רע״א ובספר נהר שלום הביא דבעבוה״ק שער הרשויות דין א׳ איתא בהדיא לאיסור וכן בתו״ש הנ״ל הוכיח מרש״י דף כ״ד לאיסור ע״ש וע״כ נראה שאין להקל » (ביאור הלכה שע״ד) — the Tosefes Shabbos brings a proof from Tosafos (Shabbos daf 9) to permit, and so does Rabbi Akiva Eiger; the Nahar Shalom reports that the Avodas HaKodesh explicitly forbids, and the Tosefes Shabbos also proves this from Rashi (daf 24); therefore it appears that one should not be lenient.

The measure of the breach the Beis Yosef refers to another siman: « ושיעור פירצה זו ליאסר לטלטל בחצר מפניה נתבאר בסימן ש״ס » (בית יוסף או״ח שע״ד) — explained in siman 360. The Shulchan Aruch HaRav writes: « אֲבָל חָצֵר שֶׁנִּפְרְצָה בְּשַׁבָּת לִרְשׁוּת הָרַבִּים אוֹ לְכַרְמְלִית פִּרְצָה הָאוֹסַרְתָּהּ » (שו״ע הרב שע״ד:ב) — by a breach that forbids it —, writes that one does not say there that Shabbos, once permitted, remains permitted, and refers to siman 362; see Level 4, point ד.

7. The small courtyard breached onto the large one (seif ג)

Seif ג specifies that the small one was breached before Shabbos, along its full width, and that the breach is no more than ten amos.

יסוד — why before Shabbos. The Gemara cites Rav Hoshaya's question, and the proof Rav Chisda brings from the Mishnah: « בָּעֵי רַב הוֹשַׁעְיָא: דָּיוֹרִין הַבָּאִין בְּשַׁבָּת, מַהוּ שֶׁיֵּאָסְרוּ? אֲמַר לֵיהּ אַבָּיֵי: לָא תֵּימָא מָר ״אֵימַר״, אֶלָּא וַדַּאי מִבְּעוֹד יוֹם נִפְרְצָה » (עירובין צ״ג ע״ב) — do residents who come on Shabbos forbid? Rav Chisda brings the Mishnah; Rabbah answers: say it was breached while it was still day; Abaye: do not say "say", but: certainly while it was still day, « דְּהָא מָר הוּא דְּאָמַר, בְּעַי מִינֵּיהּ מֵרַב הוּנָא וּבְעַי מִינֵּיהּ מֵרַב יְהוּדָה: עֵירַב דֶּרֶךְ הַפֶּתַח וְנִסְתַּם הַפֶּתַח, עֵירַב דֶּרֶךְ חַלּוֹן וְנִסְתַּם הַחַלּוֹן, מַהוּ? וְאָמַר לִי: שַׁבָּת, כֵּיוָן שֶׁהוּתְּרָה הוּתְּרָה » (עירובין צ״ג ע״ב) — since it is you who reported the answer: Shabbos, since it was permitted, remains permitted. According to Abaye, then, the Mishnah necessarily speaks of a breach made by day: had it been made on Shabbos, it would come under the rule of section 1. The Mishnah Berurah, on the words שנפרצה קודם שבת: « דאלו בשבת אמרינן כיון שהותרה הותרה » (משנה ברורה שע״ד ס״ק י) — on Shabbos, we say that what was permitted remains permitted; and the Beis Yosef: « והא דאסרינן בחצר קטנה וכן בגג קטן דבסמוך היינו בנפרצו קודם שבת זה דאילו נפרצו בשבת מותרין באותה שבת דהא קי״ל דשבת כיון שהותרה הותרה כמ״ש בראש הסימן » (בית יוסף או״ח שע״ד) — the prohibition of the small courtyard, and of the small roof, applies when the breach was made before that Shabbos; made on Shabbos, they are permitted on that Shabbos. On the subject of Rav Hoshaya's question, the Rambam writes that residents who come on Shabbos do not forbid (הלכות עירובין פ״ג הכ״ה; section 5).

On the breach of no more than ten amos, the Mishnah Berurah: « דאלו יותר מעשרה לא שייך לומר דקטנה היא כפתחה של גדולה דפתחא יותר מעשר אמות לא עבדי אינשי » (משנה ברורה שע״ד ס״ק י״ב) — beyond ten, one cannot say that the small one is like the doorway of the large one, since people do not make a doorway of more than ten amos.

Rashi, reported by the Beis Yosef, on the large one being permitted: « ופירש״י גדולה מותרת. להוציא כלי הבתים שבה אם עירבו לעצמה ולא אסרי עלה בני קטנה » (בית יוסף או״ח שע״ד) — the large one may take out the utensils of its houses, if it made an eruv for itself, and the residents of the small one do not forbid it. Rabbah, Rabbi Zeira and Rabbah bar Rav Chanan, sitting with Abaye, infer from the Mishnah: « שְׁמַע מִינַּהּ מִמַּתְנִיתִין דָּיוֹרֵי גְדוֹלָה בַּקְּטַנָּה, וְאֵין דָּיוֹרֵי קְטַנָּה בַּגְּדוֹלָה » (עירובין צ״ב ע״א) — the residents of the large one count in the small one, and those of the small one do not count in the large one. In the course of the discussion, Rabbi Zeira says to Abaye, about this Mishnah, and Abaye answers him: « וְאִילּוּ הִשְׁוָה אֶת גִּיפּוּפֶיהָ גְּדוֹלָה נָמֵי אֲסוּרָה! אֲמַר לֵיהּ, הָתָם סִילּוּק מְחִיצּוֹת הוּא » (עירובין צ״ב ע״ב) — had the large one leveled its remnants of wall, it too would be forbidden; there, Abaye answers, it is a removal of partitions.

שֶׁדִּיּוּרִין שֶׁל גְּדוֹלָה חֲשׁוּבִין כִּקְטַנָּה וְאֵין דִּיּוּרֵי קְטַנָּה חֲשׁוּבִין כִּגְדוֹלָה » (הלכות עירובין פ״ג הכ״ד) — a small courtyard breached along its full width onto a large one while it was still day: the people of the large one make an eruv for themselves and are permitted, since doorposts remain to them on either side; those of the small one may not take out of their houses into their courtyard until they make one eruv with those of the large one, for the residents of the large one count in the small one, and those of the small one do not count in the large one. He writes מבעוד יום, the reason of the doorposts that remain to the large one on either side, and the rule of the residents that the Gemara infers from the Mishnah.

Why is the small one not permitted? וְאִם אִיתָא, קְטַנָּה נָמֵי תִּשְׁתְּרֵי בְּנִרְאֶה מִבַּחוּץ וְשָׁוֶה מִבִּפְנִים » (עירובין ט׳ ע״ב) — Rabbah bar Rav Huna says that seen from outside and even from inside is judged as a lechi; Rabbah objects from our Mishnah: the small one too should then be permitted. Rabbi Zeira answers, and the Gemara objects at once: « אָמַר רַבִּי זֵירָא: בְּנִכְנָסִין כּוֹתְלֵי קְטַנָּה לִגְדוֹלָה. וְלֵימָא לָבוּד וְתִשְׁתְּרֵי » (עירובין ט׳ ע״ב) — when the walls of the small one enter the large one; then let us say lavud, and let it be permitted!

The Beis Yosef summarizes what follows: « ומוקי לה נמי בשכותלי קטנה מופלגים ג׳ טפחים מכותלי אורך הגדולה דאל״כ הוה מישתרי קטנה ע״י לבוד כלומר דהוה אמרינן חזינן כאילו ראשי כניסת של כתלי קטנה סניפין לצד כתלי אורך הגדולה דהדר הויא להו הכניסה להך גיפופי נראים מבחוץ » (בית יוסף או״ח שע״ד) — the walls of the small one must be three tefachim away, otherwise one would say lavud: one would see the ends of the small one's walls, where they enter, as joined to the long walls of the large one, and the projection would again be remnants of wall visible from outside. He explains why the Tur does not write it: « ולא חש רבינו לכתוב כל זה לפי שסמך על מ״ש בסימן שע״ג דנראה מבחוץ ושוה מבפנים נדון משום לחי » (בית יוסף או״ח שע״ד) — the Tur did not trouble to write all this, relying on what he wrote in siman שע״ג (so in the text served by Sefaria; the Tur writes this rule in siman 363, שס״ג): seen from outside and even from inside is judged as a lechi. The Mishnah Berurah: « ר״ל אימתי הקטנה אסורה בשכותליה נכנסין ובולטין לתוך הגדולה בשתים וג׳ אמות » (משנה ברורה שע״ד ס״ק י״ז) — the small one is forbidden when its walls enter and jut into the large one by two or three amos.

A single wall set apart. The seif writes the walls in the plural. The Biur Halachah: « לאו דוקא דאף כותל אחד סגי [הגר״א] ור״ל דאף אם היה רק כותל אחד מופלג ג״ט והשני היה פחות מזה ג״כ אסור דמה הני שנאמר לבוד מצד אחד הרי בעינן דוקא פס משהו מכאן ומכאן או פס רחב ד׳ טפחים מצד אחד » (ביאור הלכה שע״ד) — even if only one wall is three tefachim away and the other less, it is forbidden: what use would it be to say lavud on one side, since one needs a post, however small, on each side, or a post four tefachim wide on one side.

The Shulchan Aruch HaRav gives the reason for the permission of the large one: « מִפְּנֵי שֶׁפִּרְצָה זוֹ הִיא לַגְּדוֹלָה כְּפֶתַח שֶׁאֵין לָהּ בְּמִלּוּאָהּ, אֶלָּא נִשְׁתַּיְּרוּ בָּהּ גִּפּוּפִים עוֹדְפִים עַל פִּרְצַת הַקְּטַנָּה מִכַּאן וּמִכַּאן » (שו״ע הרב שע״ד:ג) — the breach is for the large one like a doorway, since it still has remnants of wall extending beyond the breach of the small one on either side; and, for the case where the walls of the small one do not enter the large one: « שֶׁאִם לֹא כֵן אַף הַקְּטַנָּה נִתֶּרֶת עַל יְדֵי גִפּוּפֵי הַגְּדוֹלָה » (שו״ע הרב שע״ד:ג) — otherwise the small one too is permitted by the remnants of wall of the large one, and the Rav continues « מִשּׁוּם נִרְאֶה מִבְּחוּץ וְשָׁוֶה מִבִּפְנִים » (שו״ע הרב שע״ד:ג) — because of seen from outside and even from inside: the Mechaber's own reason, to which the Beis Yosef also brings back lavud (above); see Level 4, point ה.

8. The small roof open onto a large one (seif ד)

The Mishnah: « גַּג גָּדוֹל סָמוּךְ לְקָטָן — הַגָּדוֹל מוּתָּר, וְהַקָּטָן אָסוּר » (עירובין צ״ב ע״א) — a large roof adjoining a small one: the large one is permitted, and the small one forbidden.

Two equal roofs, the word "breached", and the large roof. On two equal roofs, the Mishnah Berurah: « אבל אם שני הגגין שוין אוסרין זה על זה אפילו אם אינם יותר מעשר אמות דהרי נפרצו במילואן זה לזה » (משנה ברורה שע״ד ס״ק כ׳) — they forbid each other, even if they are no more than ten amos, being open onto each other along their full width. On the word "breached", which is not literal for a roof: « לאו דוקא והכונה שהיה פתוח לגג הסמוך לו דבגג לא איירי בשהיה מתחלה מחיצה ונקט לשון נפרץ איידי דסעיף ג׳ » (משנה ברורה שע״ד ס״ק כ״א) — there was no partition at first; the text uses this word because of seif ג. And for the large roof: « דגג הקטן לגביה נחשב כפתח בעלמא כיון שאין בו יותר מעשר אמות » (משנה ברורה שע״ד ס״ק כ״ו) — the small one counts as a mere doorway, since it is no more than ten amos.

Why is the small roof not permitted by the remnants of wall of the large one? The Biur Halachah: « הא דלא מישתרי גג קטן בגיפופי גג גדול משום נראה מבחוץ ושוה מבפנים וכדלעיל בס״ג דהלא לענין גג גדול אמרינן גוד אסיק מחיצתא והוי כאלו יש לו גיפופים וא״כ ליהני ד״ז גם לגבי קטן » (ביאור הלכה שע״ד) — since, for the large roof, one says gud asik and it is as though it had remnants of wall, this should also help the small one, as for the courtyard in seif ג.

« י״ל דכי אמרינן גוד אסיק לגבי גג הגדול עצמו אבל לא להתיר הגג קטן בגיפופי גדול [ריטב״א ובזה נסתלק קושית הדרישה והובא בחידושי רע״א] » (ביאור הלכה שע״ד) — one says gud asik for the large roof itself, not to permit the small one by the remnants of wall of the large one.

On the condition of recognizable walls, the Gemara asks why the Mishnah teaches both cases, the roof and the courtyard, and answers according to Rav and according to Shmuel: « לְמָה לֵיהּ לְמִיתְנֵי תַּרְתֵּי? לְרַב, קָתָנֵי גַּג דּוּמְיָא דְחָצֵר: מָה חָצֵר מִנַּכְרָא מְחִיצְתָּא, אַף גַּג נָמֵי מִנַּכְרָא מְחִיצְתָּא » (עירובין צ״ב ע״א) — according to Rav, the roof is taught like the courtyard: as the partitions of the courtyard are recognizable, so must those of the roof be; « וְלִשְׁמוּאֵל, גַּג דּוּמְיָא דְחָצֵר: מָה חָצֵר דְּקָא דָרְסִי לַהּ רַבִּים, אַף גַּג נָמֵי דְּקָא דָרְסִי לֵיהּ רַבִּים » (עירובין צ״ב ע״א) — according to Shmuel, as the courtyard is trodden by the public, so is the roof. The page does not report here the positions of Rav and Shmuel on roofs to which this answer refers.

Rashi, reported by the Beis Yosef — on Rav's reading: « ופירש״י אף גג. נהי דשרינן ליה במחיצות התחתונות משום גוד אסיק מיהו מחיצות ניכרות בעינן שלא יהיה גג בולט חוצה להם דאי לא מינכר לא אמרינן גוד אסיק וגדול נמי אסור דאין שם שום מחיצה וכל שאין לו מחיצות אינו רה״י ומשמע מדברי הרא״ש שם דהכי קי״ל » (בית יוסף או״ח שע״ד) — the roof is permitted by the lower partitions, by virtue of gud asik, but recognizable partitions are required; otherwise even the large one is forbidden, having no partition at all. The Beis Yosef gives as the source of the seif's condition, « והוא שיהו מחיצות הבית ניכרות » (שו״ע או״ח שע״ד:ד), this reading of Rav, which he reads in the Rosh.

The jutting roof. The Magen Avraham: « בתו׳ דף פ״ט משמע דוקא כשבולט ד׳ לר״ה ור״ה מהלכת תחתיו אם כן הוי אותה בליטה כרמלית וכל שאר הגג נפרצה לו במלואו ע״ש וכ״מ ברא״ש אבל אם אין בולט לא, דלא גרע מעמוד דהוי רשות היחיד בסי׳ שמ״ה ס״י » (מגן אברהם שע״ד ס״ק ה) — according to Tosafos (daf 89), only when it juts out four over the public domain, the public walking beneath it: that projection is then a karmelis, and the whole rest of the roof is open onto it along its full width; if it does not jut out, no, for it is no worse than a pillar, which is a private domain (siman 345); and « ומ״מ כששני הגגין פרוצים זה לזה אוסרין זה על זה וכ״כ הרשב״א בגיטין דף ע״ט » (מגן אברהם שע״ד ס״ק ה) — in any case, two roofs open onto each other forbid each other, as the Rashba writes. The Mishnah Berurah: « דוקא כשבולט ד״ט אבל אם אין בולט ארבעה טפחים הוי כמחיצות ניכרות » (משנה ברורה שע״ד ס״ק כ״ח) — only when it juts out four tefachim; otherwise it is like recognizable partitions.

The window of four by four — the Tur writes: « אבל אם אינן ניכרות כגון שהגג בולט עליהן הוי כרמלית אא״כ חלון מהבית פתוח לו » (טור או״ח שע״ד) — unless a window from the house opens to it —, without a measure. The Beis Yosef: « ומ״ש אא״כ חלון מהבית פתוח לו כ״כ הרא״ש שם וטעמא משום דהוו כחורי רה״י אלא שהרא״ש הצריך שיהיה החלון ד׳ על ד׳ ורבינו כתב סתם חלון ונראה שסמך על שיעור חלון שכתב בסי׳ שע״ב » (בית יוסף או״ח שע״ד) — the Rosh writes it, since [the roof] is like the holes of the private domain; but the Rosh requires a window of four by four, and the Tur wrote "window" without more, relying, it seems, on the measure of a window he wrote in siman 372. Seif ד writes the measure: « אלא אם כן פתוח לו מהבית חלון ארבע על ארבע » (שו״ע או״ח שע״ד:ד).

What the window permits, the Mishnah Berurah specifies: « ומ״מ לא מהני זה אלא להתיר להשתמש על גגו בכלים ששבתו בתוכו דיש עליו עי״ז שם רה״י אבל להעלות עליו כלים ששבתו בבית אסור כ״ז שלא עירבו יחד כיון שאין המחיצות ניכרות עליו » (משנה ברורה שע״ד ס״ק כ״ט) — it serves only to make use on the roof of utensils that were בתוכו when Shabbos began, the roof thereby taking the name of a private domain; but bringing up onto it utensils that were in the house at the start of Shabbos remains forbidden as long as they have not made an eruv together, the partitions not being recognizable there.

The Shulchan Aruch HaRav first sets out the case of roofs surrounded by a parapet: « וְכֵן גַּג קָטָן הַמֻּקָּף מַעֲקֶה סְבִיבוֹ גְּבוֹהָה עָלָיו עֲשָׂרָה » (שו״ע הרב שע״ד:ד) — a small roof surrounded by a parapet ten [tefachim] high; and after the window it writes: « אֲבָל מִכָּל מָקוֹם אִם לֹא עֵרְבוּ יַחַד אַף הַגָּדוֹל אָסוּר בְּכֵלִים שֶׁשָּׁבְתוּ בַּבַּיִת » (שו״ע הרב שע״ד:ד) — in any case, if they did not make an eruv together, even the large one is forbidden for utensils that were in the house at the start of Shabbos. Rashi, reported by the Beis Yosef, writes for the roof whose partitions are not recognizable: « וגדול נמי אסור דאין שם שום מחיצה » (בית יוסף או״ח שע״ד) — the large one too is forbidden, having no partition at all: Rashi speaks of a roof that is not a private domain, « וכל שאין לו מחיצות אינו רה״י » (בית יוסף או״ח שע״ד). The Rav writes his sentence right after the window, which makes the roof a private domain, and introduces it with אֲבָל מִכָּל מָקוֹם; the page reads his sentence as the rule the Mishnah Berurah, later than the Rav, writes for the roof with the window (ס״ק כ״ט, above), and Rashi as speaking of another case — a reading submitted to the Rav; see Level 4, point ו.

9. Summary of the shitos and halachic conclusion

The foundation — the Shabbos that has been permitted remains permitted (the answer Rabbah reports from Rav Huna and Rav Yehudah, עירובין י״ז ע״א and צ״ג ע״ב; Tur); it recurs notably in seifim א, ב and ג:
