Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and numbering of the seifim. Here the Shulchan Aruch HaRav has 4 seifim, and the Shulchan Aruch of the Mechaber 4 as well; each of the Rav's seifim 1 to 4 deals with the case of the Mechaber's seif in the same position (א to ד). The references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named. In the English text, the Mechaber's seifim are designated by their Hebrew letter and the Rav's by their number; in the Hebrew addresses in parentheses, both numberings are written in letters, and each reference names its work: (שו״ע או״ח …) for the Mechaber, (שו״ע הרב …) for the Rav.
This page gathers, for Siman 374, the full text of the Rav with its translation, where his text differs from that of the Mechaber and from the parenthesis in his seif, and the practical conduct that follows from it.

A doorway or window that was closed up on Shabbos, in the place through which one made the eruv; and it contains 4 seifim:
Two houses or two courtyards that made an eruv together by means of a window or a doorway that was between them, and it was closed up on Shabbos: they are permitted to make use from one to the other by way of the top of the wall and its holes, for Shabbos, once it has been permitted, remains permitted (keivan shehutrah hutrah).
But if it was closed up while it was still day, even if it opened again on Shabbos, they are forbidden, because they have never yet acquired the eruv: the acquisition of the eruv takes place at bein hashmashos, and here there was no eruv at bein hashmashos, since the doorway was closed up; and after nightfall they did not acquire the eruv, for one does not make an eruv after nightfall.
And even if they had already made the eruv before the previous Shabbos, and that eruv still remains in existence, they cannot rely on it on this Shabbos after the doorway opened, since it was already annulled while it was still day, and it does not come back to life (chozer v'nei'or) after nightfall. But if from the outset they made the eruv for many Shabbosos — even if they made it for a year or more — and they acquired the eruv at bein hashmashos of the first Shabbos, when the doorway was open, and afterwards the doorway was closed up and it opened on another Shabbos, even at the end of the year, the eruv comes back to life, even if he closed it up deliberately (b'meizid). And there is one who is concerned to be stringent if he closed it up deliberately: since he showed by this closing up that he does not want the eruv, it does not come back to life when it opens. And as for the halachah: in the words of the Sofrim, follow the one who is lenient.

There was a wall between [two] courtyards, and each one made an eruv for itself, and the wall was breached on Shabbos: they are permitted to carry (l'taltel), each one in his courtyard, up to the place of the wall, even utensils that were in the house at the start of Shabbos [when Shabbos began] (keilim shesh'vsu babayis), for Shabbos, once it has been permitted, remains permitted.
But a courtyard that was breached on Shabbos into the public domain (reshus harabim) or into a karmelis, by a breach that renders it forbidden: one does not say “Shabbos, once it has been permitted, remains permitted,” as was explained in Siman 362.

A small courtyard that was breached, while it was still day, along its full width (bimlo'ah) into a large one, and the breach is not more than ten amos: the large one is permitted to carry out utensils that were in the house at the start of Shabbos into its courtyard, if it made an eruv for itself; and even though it did not make an eruv with the small one, the small one does not prohibit it, because this breach is, for the large one, like a doorway, since for it [the breach] is not along its full width: there remained in it remnants of wall (gipufim) that extend beyond the breach of the small one, on either side. And the small one is forbidden to carry out utensils that were in the house at the start of Shabbos into its courtyard, since it was breached along its full width into the large one, unless it made an eruv with the large one.
When does this apply? When the long walls of the small one enter into the large one and are set apart there by 3 tefachim from the long walls of the large one; for otherwise the small one too is permitted by means of the remnants of wall of the large one, because of “seen from outside and even from inside” (nireh mibachuts ve-shaveh mibifnim), as was explained in Siman 360.

And likewise, a small roof surrounded all around by a parapet (ma'akeh) ten [tefachim] high above it, which was breached there along its full width into a large roof surrounded likewise, and the houses did not make an eruv together: the small one is forbidden — one may not bring up onto it utensils that were in the house at the start of Shabbos — if its partitions enter into the large one, since it has no partition to separate between it and the large one, which did not make an eruv with it; and the large one is permitted, because it has remnants of wall that extend beyond the breach of the small one.
And likewise, even if they are not surrounded by a parapet at all, but the partitions of the house all around are recognizable and visible to one who stands at the edge of the roof when he looks beneath his feet: for then one says of them “gud assik” [extend upward], and it is as if they stood above, at the edge of the roof, as was explained in Siman 345. But the partition of the house that is between the small one and the large one — one does not say of it “gud assik,” since it is not visible to one who stands there above: for the roofs are joined to each other and cover the breach of the small one, and it is not seen; and the place of this partition, above, is like a breach along its full width from the small one into the large one, and for the large one it is not along its full width, for the wall of the large house extends on either side and is visible to one who stands at the edge of the roof. Therefore the large one is permitted, and the small one forbidden if the walls of its house enter into the large one.
But if the partitions of the house all around are also not recognizable and visible to one who stands at the edge of the roof — for example, if the roof projects over them — it is a karmelis, as was explained in Siman 345, unless a window of 4 by 4 [tefachim] opens onto it from the house (and then it is a private domain, as was explained there). But in any case, if they did not make an eruv together, even the large one is forbidden for utensils that were in the house at the start of Shabbos, because it has no remnants of wall extending on either side: for of the wall of the house one does not say “gud assik,” since it is not recognizable to one who stands above.

לשון הרב מול סעיף המחבר
Where the Rav's text differs from the Mechaber's seif
Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 4 seifim, designated by their letter) and the seif in the same position in the Shulchan Aruch HaRav (its own numbering, also 4 seifim), in the order of the Rav's seifim, and notes only what the comparison of the two texts shows. A point noted is not thereby peculiar to the Rav: each point names, among others, where what the Rav writes is already found — in the Tur, the Beis Yosef and Rashi whom he cites, the Magen Avraham and the Taz, before him —, and, where relevant, what is not found there, as well as what the Mishnah Berurah and the Biur Halachah, later than the Rav, write about it; and when these commentators read the point into the Mechaber's own words, the page says so. The Rishonim cited by the Beis Yosef have not been checked one by one. In the Mechaber's seif א, the words « ואפילו סתמה במזיד » (שו״ע או״ח שע״ד:א) are printed in small type, in parentheses, without the word הגה, followed by their source, the Agur; the text does not name their author, and the Biur Halachah attributes them to the Rema (point ג).
נקודה א — שימוש מזו לזו, ודעת הרמב״ם (שו״ע הרב שע״ד:א)
Point א — making use from one to the other, and the view of the Rambam (Shulchan Aruch HaRav 374:1)
A doorway closed up on Shabbos
What the Mechaber writes: « ערבו דרך חלון או פתח שביניהם ונסתם בשבת מותרים להשתמש דרך גובה הכותל וחוריו » (שו״ע או״ח שע״ד:א), without giving the reason; and at the end of the seif he cites the view of the Rambam: « ולהרמב״ם אין מותר לטלטל אלא כל אחת לעצמה אבל מזו לזו לא » (שו״ע או״ח שע״ד:א).
What the Rav writes: he names the case, « ב׳ בָּתִּים אוֹ ב׳ חֲצֵרוֹת שֶׁעֵרְבוּ יַחַד עַל יְדֵי שֶׁהָיָה בֵּינֵיהֶם חַלּוֹן אוֹ פֶּתַח » (שו״ע הרב שע״ד:א), and writes: « מֻתָּרִים לְהִשְׁתַּמֵּשׁ מִזֶּה לְזֶה דֶּרֶךְ גֹּבַהּ כֹּתֶל וְחוֹרָיו, שֶׁשַּׁבָּת כֵּיוָן שֶׁהֻתְּרָה — הֻתְּרָה » (שו״ע הרב שע״ד:א). His seif 1 does not cite the view of the Rambam.
The difference: the Mechaber's seif א states the rule without its reason, and cites after it the view of the Rambam, for whom each courtyard is permitted only for itself; the Rav's text writes « מִזֶּה לְזֶה » (שו״ע הרב שע״ד:א), gives the reason, and does not cite the view of the Rambam. The reason and the reading “from one to the other” are not peculiar to the Rav: the Tur gives the reason, « דשבת כיון שהותרה הותרה » (טור או״ח שע״ד), and the Beis Yosef writes that this is how the Tur explains it: « ופירש רבינו דמותרין לטלטל מזו לזו כמו שהיו » (בית יוסף או״ח שע״ד), before citing the Rambam, « אבל הרמב״ם בפ״ג מה״ע כתב שכל א׳ מותר לעצמה » (בית יוסף או״ח שע״ד). That the Rav does not cite the view of the Rambam, the page notes without drawing a reason from it.
Among the Mechaber's commentators: the Magen Avraham writes on the Rambam's words « דוקא כשהפתח סתום » (מגן אברהם שע״ד ס״ק ב) and « אבל כשנפתח הפתח חזרו שניהם להיתרן » (מגן אברהם שע״ד ס״ק ב). The Mishnah Berurah, later than the Rav, reads the first view « מזו לזו בשבת זו וכ״ש כל אחת לעצמה » (משנה ברורה שע״ד ס״ק ב), and writes on the view of the Rambam: « ולענין הלכה העיקר כסברא הראשונה כ״כ האחרונים » (משנה ברורה שע״ד ס״ק ו).
Practical consequence: according to the Rav's text, two houses or two courtyards that made an eruv together through a window or doorway that was closed up on Shabbos may make use from one to the other, by way of the top of the wall and its holes (Shulchan Aruch HaRav 374:1); see section 4, point ①.
נקודה ב — נסתם מבעוד יום, ועירוב לשבתות הרבה (שו״ע הרב שע״ד:א)
Point ב — a doorway closed up while it was still day, and an eruv made for many Shabbosos (Shulchan Aruch HaRav 374:1)
When was the eruv acquired?
What the Mechaber writes: « ואפי׳ אם עירב לשנה ונסתם הפתח בחול ונפתח בשבת » (שו״ע או״ח שע״ד:א), then, after the parenthesis in small type (point ג), « חזר העירוב להתירו » (שו״ע או״ח שע״ד:א). He writes neither the case of an eruv made for a single Shabbos nor the reason.
What the Rav writes: « אֲבָל אִם נִסְתַּם מִבְּעוֹד יוֹם, אֲפִלּוּ חָזַר וְנִפְתַּח בְּשַׁבָּת — אֲסוּרִים » (שו״ע הרב שע״ד:א), « לְפִי שֶׁעֲדַיִן לֹא קָנוּ עֵרוּב מֵעוֹלָם, שֶׁקְּנִיַּת הָעֵרוּב הוּא בֵּין הַשְּׁמָשׁוֹת » (שו״ע הרב שע״ד:א); then « וַאֲפִלּוּ עֵרְבוּ כְּבָר לִפְנֵי שַׁבָּת שֶׁעָבְרָה, וְאוֹתוֹ עֵרוּב נִשְׁאָר עֲדַיִן קַיָּם — אֵינָן יְכוֹלִים לִסְמוֹךְ עָלָיו בְּשַׁבָּת זוֹ » (שו״ע הרב שע״ד:א); and for an eruv made for many Shabbosos, « וְקָנוּ עֵרוּב בְּבֵין הַשְּׁמָשׁוֹת שֶׁל שַׁבָּת רִאשׁוֹנָה, שֶׁהָיָה הַפֶּתַח פָּתוּחַ » (שו״ע הרב שע״ד:א), « אֲפִלּוּ בְּסוֹף הַשָּׁנָה — חוֹזֵר הָעֵרוּב וְנֵעוֹר » (שו״ע הרב שע״ד:א).
The difference: the Mechaber's seif א writes the case of the eruv made for the year and its conclusion; the Rav's text also writes the opposite case — the doorway closed up while it was still day, the eruv made before a previous Shabbos — and the reason for both: the eruv is acquired at bein hashmashos. The Tur, in the case of the eruv made for the year, notes that Shabbos did not begin in a state of permission, « דהשתא לא נכנסה השבת בהיתר » (טור או״ח שע״ד), and concludes that the eruv returns; he writes neither the opposite case nor this reason. The Magen Avraham, before the Rav, already writes that the eruv is acquired at bein hashmashos, regarding the doorway reopened before Shabbos: « דכשחוזר ופותח׳ קודם שבת הרי הם כשותפין בפת ובין השמשו׳ שהוא קונה עירוב הרי יש פתח ביניהם ראוי לערב » (מגן אברהם שע״ד ס״ק א).
Among the Mechaber's commentators: the Mishnah Berurah, later than the Rav, explains the case of the year thus: « כיון שבעת הנחת העירוב שהניח לכמה שבתות או לשנה היה פתח מזו לזו וחל העירוב » (משנה ברורה שע״ד ס״ק ד). The Biur Halachah, later than the Rav, opens his comment on « ונסתם בשבת » (שו״ע או״ח שע״ד:א) with the same rule, in words very close to the Rav's, without naming a source: « אבל אם נסתם מבעוד יום אפילו חזר ונפתח בשבת אסורין לפי שעדיין לא קנו עירוב מעולם שקניית העירוב הוא בה״ש » (ביאור הלכה שע״ד), and « ועירב לשנה שאני שמערב מתחלה על כל השבתות וקנה העירוב בשבת ראשונה שהיה הפתח פתוח ולכן אפילו אם אח״כ נסתם הפתח ונפתח בשבת אחרת ואפילו בסוף השנה חוזר העירוב וניעור » (ביאור הלכה שע״ד). He then discusses the very rule of the eruv made for the year, « ועכ״פ אין דין זה ברור » (ביאור הלכה שע״ד), and concludes: « ומ״מ אחרי שהרא״ש והטור והמחבר והאחרונים שאחרי השו״ע העתיקו דין זה בודאי אין לדחותו מהלכה » (ביאור הלכה שע״ד).
Practical consequence: according to the Rav's text, if the doorway was closed up while it was still day, they are forbidden even if it opened again on Shabbos, and an eruv made before a previous Shabbos does not help; but if the eruv was made from the outset for many Shabbosos and acquired at bein hashmashos of the first Shabbos, when the doorway was open, it comes back to life when the doorway opens on another Shabbos, even at the end of the year (Shulchan Aruch HaRav 374:1); see section 4, point ②.
נקודה ג — סתמו במזיד (שו״ע הרב שע״ד:א)
Point ג — a doorway closed up deliberately (Shulchan Aruch HaRav 374:1)
A doorway closed up deliberately
What the Mechaber's seif contains: in the case of the eruv made for the year, the parenthesis in small type « ואפילו סתמה במזיד » (שו״ע או״ח שע״ד:א), followed by its source (אגור), with no dissenting view. The text does not name its author; the Biur Halachah attributes it to the Rema and writes « את סברת הרמ״א דמתיר בכל גווני » (ביאור הלכה שע״ד).
What the Rav writes: « וַאֲפִלּוּ סְתָמוֹ בְּמֵזִיד » (שו״ע הרב שע״ד:א); then he cites a stringent view, without naming it, with its reason, « וְיֵשׁ מִי שֶׁחוֹשֵׁשׁ לְהַחֲמִיר אִם סְתָמוֹ בְּמֵזִיד, הוֹאִיל וְגִלָּה דַעְתּוֹ בִּסְתִימָה זוֹ שֶׁאֵינוֹ חָפֵץ בָּעֵרוּב » (שו״ע הרב שע״ד:א), and decides: « וּלְעִנְיַן הֲלָכָה, בְּדִבְרֵי סוֹפְרִים הַלֵּךְ אַחַר הַמֵּקֵל » (שו״ע הרב שע״ד:א).
The difference: the Mechaber's seif א carries the parenthesis with no dissenting view; the Rav's text writes it, cites the stringent view and its reason, and writes that for the halachah, in the words of the Sofrim, one follows the lenient one. This reason is found before him in the Magen Avraham, who refers to the responsa of the Maharil, on the words « ואפי׳ סתמה במזיד » (מגן אברהם שע״ד ס״ק א): « כשנפתח בשבת אסור דכיון דסתמו במזיד גלי דעתי׳ שאינו חפץ בעירו׳ וא״כ ב״ה לא קנה עירוב » (מגן אברהם שע״ד ס״ק א); he adds that this is what the Agur meant, « ולזה נתכוין האגו׳ שכ׳ בשם מהרי״ל » (מגן אברהם שע״ד ס״ק א). The Rav does not name the one who is stringent, and the page does not name him in his place. The Taz, before the Rav, rejects on these same words the distinction of his father-in-law — that of the Bach, which the Magen Avraham cites, « והב״ח כתב דבפרץ פצימיו בטל העירוב » (מגן אברהם שע״ד ס״ק א) — and writes « אלא ודאי דהעיקר תלוי בעשיי׳ העירוב כיון דהיה ראוי באותה שעה » (ט״ז או״ח שע״ד ס״ק א).
Among the Mechaber's commentators: the Mishnah Berurah, later than the Rav, writes « ודע דמ״א וכמה אחרונים צידדו לאסור בזה כשחזר ונפתח בשבת » (משנה ברורה שע״ד ס״ק ה), then « ואין להקל כשסתמו במזיד אלא כשנפתח קודם השבת » (משנה ברורה שע״ד ס״ק ה) — except « אכן אם בעת שסתמו היה בדעתו רק לפי שעה ואח״כ לחזור ולפתחו מסתברא דמותר אף כשחזר ונפתח בשבת » (משנה ברורה שע״ד ס״ק ה). The Biur Halachah writes « ומ״מ לענין סתמו במזיד שהמ״א הביא ממהרי״ל שלא התיר אלא דוקא בשנפתח קודם השבת » (ביאור הלכה שע״ד), and concludes « מ״מ למעשה נראה שאין להקל » (ביאור הלכה שע״ד). In the case the Rav writes, the doorway opens « בְּשַׁבָּת אַחֶרֶת » (שו״ע הרב שע״ד:א): for a doorway closed up deliberately and opened on Shabbos, the Rav's text is lenient; the Mishnah Berurah and the Biur Halachah are not; the Mishnah Berurah nevertheless holds that it stands to reason to permit if he closed it up only for the time being, intending to open it again.
Practical consequence: according to the Rav's text, an eruv made for many Shabbosos comes back to life even if the doorway was closed up deliberately; he cites a stringent view, and writes that in the words of the Sofrim one follows the lenient one (Shulchan Aruch HaRav 374:1). The Mishnah Berurah and the Biur Halachah write that one should not be lenient when the doorway, closed up deliberately, opened on Shabbos; if he closed it up only for the time being, intending to open it again, the Mishnah Berurah holds that it stands to reason that it is permitted (above): consult your Rav. See section 4, point ②.
נקודה ד — כותל שנפרץ בשבת, וחצר שנפרצה לרשות הרבים (שו״ע הרב שע״ד:ב)
Point ד — a wall breached on Shabbos, and a courtyard breached into the public domain (Shulchan Aruch HaRav 374:2)
Up to the place of the wall
What the Mechaber writes: « היה כותל בין שתי חצרו׳ ועירבה כל אחת לעצמה ונפרץ הכותל בשבת מותרים לטלטל כל א׳ בחצרו אפי׳ כלי הבי׳ » (שו״ע או״ח שע״ד:ב), then « אבל חצר שנפרצה בשבת לרשו׳ הרבים או לכרמלית אסור » (שו״ע או״ח שע״ד:ב). He gives the reason for neither.
What the Rav writes: « מֻתָּרִים לְטַלְטֵל כָּל אֶחָד בַּחֲצֵרוֹ עַד מְקוֹם הַכֹּתֶל אֲפִלּוּ כֵּלִים שֶׁשָּׁבְתוּ בַּבַּיִת, שֶׁשַּׁבָּת כֵּיוָן שֶׁהֻתְּרָה — הֻתְּרָה » (שו״ע הרב שע״ד:ב); then « אֲבָל חָצֵר שֶׁנִּפְרְצָה בְּשַׁבָּת לִרְשׁוּת הָרַבִּים אוֹ לְכַרְמְלִית פִּרְצָה הָאוֹסַרְתָּהּ — אֵין אוֹמְרִים » (שו״ע הרב שע״ד:ב) that Shabbos, once permitted, remains permitted, « כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שס״ב » (שו״ע הרב שע״ד:ב).
The difference: the Mechaber's seif ב writes « אפי׳ כלי הבי׳ » (שו״ע או״ח שע״ד:ב) without saying how far one carries, and forbids the courtyard breached into the public domain, without a reason; the Rav's text writes « עַד מְקוֹם הַכֹּתֶל » (שו״ע הרב שע״ד:ב), the reason for the permission, and, for the courtyard breached into the public domain or a karmelis, it specifies « פִּרְצָה הָאוֹסַרְתָּהּ » (שו״ע הרב שע״ד:ב) and writes that one does not say there that Shabbos, once permitted, remains permitted, referring to Siman 362. These details are already found in the Beis Yosef, who cites the ruling of Shmuel, « זה מטלטל עד עיקר מחיצה כדמעיקרא דאמרינן הואיל והותרה הותרה » (בית יוסף או״ח שע״ד), and who writes for the courtyard breached into the public domain « אבל כשנפרץ לרשות אחרת ממש דהיינו לר״ה או לכרמלית לא אמרי׳ ביה הואיל והותרה הותרה » (בית יוסף או״ח שע״ד); for the size of the breach he refers to another siman: « ושיעור פירצה זו ליאסר לטלטל בחצר מפניה נתבאר בסימן ש״ס » (בית יוסף או״ח שע״ד).
Among the Mechaber's commentators: the Taz gives the reason for the difference between the two cases, « כיון דלא נפרץ לרשות אחר אלא לחצר משא״כ בסיפא שנפרץ לרשות הרבים או לכרמלית » (ט״ז או״ח שע״ד ס״ק ב), and the Magen Avraham that of the prohibition, « כיון שאין המחיצות קיימו׳ » (מגן אברהם שע״ד ס״ק ג). The Mishnah Berurah, later than the Rav, writes of the courtyard breached into the public domain « בזה לא אמרינן כיון שהותרה הותרה » (משנה ברורה שע״ד ס״ק ט), and the Biur Halachah specifies, on « ונפרץ הכותל בשבת » (שו״ע או״ח שע״ד:ב), « היינו במילואו או ביותר מעשר אמות » (ביאור הלכה שע״ד).
Practical consequence: according to the Rav's text, if the wall between two courtyards that had each made an eruv for itself was breached on Shabbos, each may carry in his courtyard up to the place of the wall, even utensils that were in the house at the start of Shabbos; but for a courtyard breached on Shabbos into the public domain or a karmelis, by a breach that renders it forbidden, one does not say that Shabbos, once permitted, remains permitted (Shulchan Aruch HaRav 374:2); see section 4, point ③.
נקודה ה — חצר קטנה שנפרצה לגדולה (שו״ע הרב שע״ד:ג)
Point ה — a small courtyard breached into a large one (Shulchan Aruch HaRav 374:3)
Why the small one does not prohibit the large one
What the Mechaber writes: « גדול׳ מותרת להוציא כלי׳ ששבתו בבית לחצרה אם עירבה לעצמה » (שו״ע או״ח שע״ד:ג), without saying why the small one does not prohibit it; then « והיינו כשנכנסין כותלי קטנה לגדולה וכשכתלי קטנה מופלגים ג״ט מכותלי אורך הגדולה » (שו״ע או״ח שע״ד:ג), and, for the opposite case, the reason: « דאם לא כן היתה קטנה ניתרת ע״י נראה מבחוץ ושוה מבפנים » (שו״ע או״ח שע״ד:ג).
What the Rav writes: « וְאַף עַל פִּי שֶׁלֹּא עֵרְבָה עִם הַקְּטַנָּה, אֵין הַקְּטַנָּה אוֹסֶרֶת עָלֶיהָ » (שו״ע הרב שע״ד:ג), « מִפְּנֵי שֶׁפִּרְצָה זוֹ הִיא לַגְּדוֹלָה כְּפֶתַח שֶׁאֵין לָהּ בְּמִלּוּאָהּ, אֶלָּא נִשְׁתַּיְּרוּ בָּהּ גִּפּוּפִים עוֹדְפִים עַל פִּרְצַת הַקְּטַנָּה מִכַּאן וּמִכַּאן » (שו״ע הרב שע״ד:ג); the small one is forbidden « הוֹאִיל וְנִפְרְצָה בְּמִלּוּאָהּ לְהַגְּדוֹלָה » (שו״ע הרב שע״ד:ג); and he writes the condition as a single clause, « כְּשֶׁנִּכְנָסִין כָּתְלֵי אֹרֶךְ הַקְּטַנָּה לְתוֹךְ הַגְּדוֹלָה וּמֻפְלָגִין שָׁם ג׳ טְפָחִים מִכָּתְלֵי אֹרֶךְ הַגְּדוֹלָה » (שו״ע הרב שע״ד:ג), and, for the opposite case, the reason: « שֶׁאִם לֹא כֵן אַף הַקְּטַנָּה נִתֶּרֶת עַל יְדֵי גִפּוּפֵי הַגְּדוֹלָה, מִשּׁוּם נִרְאֶה מִבְּחוּץ וְשָׁוֶה מִבִּפְנִים » (שו״ע הרב שע״ד:ג), referring to Siman 360.
The difference: the Mechaber's seif ג states both rules without their reasons, and his condition as two clauses; the Rav's text writes that the small one does not prohibit the large one even without an eruv between them, gives the reason — the breach is, for the large one, like a doorway —, gives the reason for the prohibition of the small one, and writes the condition as a single clause. The reasons are not peculiar to the Rav: the Beis Yosef cites the Mishnah, « גדולה מותרת וקטנה אסורה מפני שהיא כפתחה של גדולה » (בית יוסף או״ח שע״ד), and Rashi, « ולא אסרי עלה בני קטנה » (בית יוסף או״ח שע״ד); the Magen Avraham gives the reason for the prohibition, « דנפרצה במלואה » (מגן אברהם שע״ד ס״ק ד). For the opposite case, the Rav gives the same reason as the Mechaber, « מִשּׁוּם נִרְאֶה מִבְּחוּץ וְשָׁוֶה מִבִּפְנִים » (שו״ע הרב שע״ד:ג), specifying that the small one is then permitted « עַל יְדֵי גִפּוּפֵי הַגְּדוֹלָה » (שו״ע הרב שע״ד:ג), and refers to Siman 360. For the gap of three tefachim, the Beis Yosef names lavud and explains it at once: « ומוקי לה נמי בשכותלי קטנה מופלגים ג׳ טפחים מכותלי אורך הגדולה דאל״כ הוה מישתרי קטנה ע״י לבוד כלומר דהוה אמרינן חזינן כאילו ראשי כניסת של כתלי קטנה סניפין לצד כתלי אורך הגדולה דהדר הויא להו הכניסה להך גיפופי נראים מבחוץ » (בית יוסף או״ח שע״ד) — without that gap, one would see the ends of the small one's walls, where they enter, as joined to the long walls of the large one, and the projection would again be remnants of wall visible from outside. The Beis Yosef thus brings lavud back to the same reason: it is not a separate reason.
Among the Mechaber's commentators: the Mishnah Berurah, later than the Rav, writes « ואין הקטנה אוסרת עליה דהא הגדולה יש לה גיפופין » (משנה ברורה שע״ד ס״ק י״ג), and for the gap, like the Beis Yosef, « והא דבעינן שלשה טפחים דאל״ה אמרינן לבוד לאורך הגדולה והוי כאלו לא היה מופלג כלל » (משנה ברורה שע״ד ס״ק י״ח). The Biur Halachah writes on « וכשכותלי קטנה מופלגים ג״ט » (ביאור הלכה שע״ד), in the name of the Gra, « לאו דוקא דאף כותל אחד סגי » (ביאור הלכה שע״ד), and explains: « ור״ל דאף אם היה רק כותל אחד מופלג ג״ט והשני היה פחות מזה ג״כ אסור » (ביאור הלכה שע״ד); the Rav's text writes, like the Mechaber, the walls in the plural, and the page does not say what he holds when only one wall is set apart.
Practical consequence: according to the Rav's text, when a small courtyard was breached, while it was still day, along its full width into a large one, and the breach is not more than ten amos, the large one may carry out utensils that were in the house at the start of Shabbos into its courtyard if it made an eruv for itself, even without an eruv with the small one; the small one may not, unless it made an eruv with the large one. This applies when the long walls of the small one enter into the large one and are set apart there by three tefachim from its long walls; otherwise the small one too is permitted (Shulchan Aruch HaRav 374:3). If only one wall is set apart three tefachim, the Biur Halachah, in the name of the Vilna Gaon, forbids the small one; what the Rav holds in this case, the page does not say (above): consult your Rav. See section 4, point ④.
נקודה ו — גג קטן שנפרץ לגג גדול (שו״ע הרב שע״ד:ד)
Point ו — a small roof breached into a large one (Shulchan Aruch HaRav 374:4)
The parapet, the visible partitions, and the large roof
What the Mechaber writes: « גג קטן שנפרץ קודם שבת במילואו לגג גדול קטן אסור להעלות עליו כלים ששבתו בבית וגדול מותר והוא שיהו מחיצות הבית ניכרות למי שעומד על הגג » (שו״ע או״ח שע״ד:ד), then « אבל אם אינם ניכרות כגון שהגג בולט עליהם הוי כרמלית אלא אם כן פתוח לו מהבית חלון ארבע על ארבע » (שו״ע או״ח שע״ד:ד).
What the Rav writes: he first sets out the case of roofs surrounded by a parapet, « וְכֵן גַּג קָטָן הַמֻּקָּף מַעֲקֶה סְבִיבוֹ גְּבוֹהָה עָלָיו עֲשָׂרָה » (שו״ע הרב שע״ד:ד), « וְלֹא עֵרְבוּ הַבָּתִּים יַחַד » (שו״ע הרב שע״ד:ד), and forbids the small one « אִם מְחִצּוֹתָיו נִכְנָסוֹת לְתוֹךְ הַגָּדוֹל » (שו״ע הרב שע״ד:ד); then « וְכֵן אֲפִלּוּ אִם אֵינָן מֻקָּפִים מַעֲקֶה כְּלָל » (שו״ע הרב שע״ד:ד), when the partitions of the house are visible from the edge of the roof; he writes that one does not say gud assik of the partition between the small one and the large one, « הוֹאִיל וְאֵינָהּ נִרְאֵית לְמִי שֶׁעוֹמֵד שָׁם מִלְמַעְלָה » (שו״ע הרב שע״ד:ד); and, after the case of the karmelis and the window, « אֲבָל מִכָּל מָקוֹם אִם לֹא עֵרְבוּ יַחַד אַף הַגָּדוֹל אָסוּר בְּכֵלִים שֶׁשָּׁבְתוּ בַּבַּיִת » (שו״ע הרב שע״ד:ד).
The difference: the Mechaber's seif ד does not speak of a parapet, does not say that the houses did not make an eruv together, does not set for the roof the condition of partitions entering into the large one — which he sets, in seif ג, for the courtyard —, does not say why the partition between the two roofs does not count, and does not write the sentence the Rav writes after the window: that, if they did not make an eruv together, even the large one is forbidden for utensils that were in the house at the start of Shabbos. The Rav's text writes all of this. The condition of visible partitions, for its part, is in the Mechaber's seif ד itself, « והוא שיהו מחיצות הבית ניכרות למי שעומד על הגג » (שו״ע או״ח שע״ד:ד); the Rav makes it precise, « לְמִי שֶׁעוֹמֵד עַל שְׂפַת הַגַּג כְּשֶׁמִּסְתַּכֵּל תַּחַת רַגְלָיו » (שו״ע הרב שע״ד:ד), as the Mishnah Berurah does after him (below). Rashi, cited by the Beis Yosef, explains it: « נהי דשרינן ליה במחיצות התחתונות משום גוד אסיק מיהו מחיצות ניכרות בעינן שלא יהיה גג בולט חוצה להם » (בית יוסף או״ח שע״ד). Rashi also writes, of the roof whose partitions are not visible, « וגדול נמי אסור דאין שם שום מחיצה וכל שאין לו מחיצות אינו רה״י » (בית יוסף או״ח שע״ד): he speaks of a roof which, lacking any partition, is not a private domain. The Rav writes his sentence right after the window that makes the roof a private domain, « וְאָז הוּא רְשׁוּת הַיָּחִיד כְּמוֹ שֶׁנִּתְבָּאֵר שָׁם » (שו״ע הרב שע״ד:ד), and introduces it with « אֲבָל מִכָּל מָקוֹם » (שו״ע הרב שע״ד:ד); Rashi's sentence seems to address another case (this is the page's reading, submitted to the Rav), and it is the Mishnah Berurah, later than the Rav, that writes the same rule for the roof with the window (ס״ק כ״ט, below). The Beis Yosef notes that the Rosh requires for the window the size of four by four, « אלא שהרא״ש הצריך שיהיה החלון ד׳ על ד׳ » (בית יוסף או״ח שע״ד). The parapet, and the condition of partitions entering into the large one, are found neither in the Tur, nor in the Beis Yosef, nor in the Magen Avraham, nor in the Taz, nor in the Mishnah Berurah on this siman (according to their entries served by Sefaria).
Among the Mechaber's commentators: the Mishnah Berurah, later than the Rav, writes « ומיירי נמי שלא עירבו בעליהם יחד וגם שאין גג הקטן מחזיק יותר מעשר אמות » (משנה ברורה שע״ד ס״ק כ״ג). The Biur Halachah asks why the small roof is not permitted by the remnants of wall of the large one, because of “seen from outside and even from inside”, as in seif ג, and answers according to the Ritva: « י״ל דכי אמרינן גוד אסיק לגבי גג הגדול עצמו אבל לא להתיר הגג קטן בגיפופי גדול » (ביאור הלכה שע״ד); the Rav's text gives the reason that the partition between the two roofs is not visible from above. Whether the two explanations come to the same thing, the page does not say. The Mishnah Berurah explains the visible partitions, « נראין מחיצות הבית לעומדין על שפת הגג כשמסתכלין תחת רגליהם ואז אמרינן גוד אסיק מחיצתא » (משנה ברורה שע״ד ס״ק כ״ז). On the projecting roof, the Magen Avraham writes, from the Tosafos (daf 89), « בתו׳ דף פ״ט משמע דוקא כשבולט ד׳ לר״ה ור״ה מהלכת תחתיו » (מגן אברהם שע״ד ס״ק ה), and the Mishnah Berurah « דוקא כשבולט ד״ט » (משנה ברורה שע״ד ס״ק כ״ח); the Rav's text gives no measure here, and refers to Siman 345, which this page does not cite. On the window, the Mishnah Berurah writes « אבל להעלות עליו כלים ששבתו בבית אסור כ״ז שלא עירבו יחד כיון שאין המחיצות ניכרות עליו » (משנה ברורה שע״ד ס״ק כ״ט).
Practical consequence: according to the Rav's text, when a small roof surrounded by a parapet ten [tefachim] high was breached along its full width into a large roof surrounded likewise, and the houses did not make an eruv together, one may not bring up onto the small one utensils that were in the house at the start of Shabbos if its partitions enter into the large one, and the large one is permitted (the Mishnah Berurah adds that the small roof is not more than ten amos, ס״ק כ״ג); likewise without a parapet, when the partitions of the house are visible from the edge of the roof. If they are not, it is a karmelis, unless a window of four by four [tefachim] opens onto the roof from the house; and even with this window, if they did not make an eruv together, even the large one is forbidden for utensils that were in the house at the start of Shabbos, since the wall of the house is not recognizable from above (Shulchan Aruch HaRav 374:4); see section 4, point ⑤.

Practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 374, in the Chabad sensibility. Each point refers to its seif of the Rav, in the order of the text.
For the Chabad Chassid — Siman 374
- ① A doorway closed up on Shabbos: two houses or two courtyards that made an eruv together through a window or doorway between them, which was closed up on Shabbos, may make use from one to the other by way of the top of the wall and its holes, for Shabbos, once it has been permitted, remains permitted (374:1). See section 2, point א. Reference: Shulchan Aruch HaRav 374:1.
- ② A doorway closed up before Shabbos: if it was closed up while it was still day, they are forbidden even if it opened again on Shabbos, and an eruv made before a previous Shabbos does not help. If the eruv was made from the outset for many Shabbosos, even for a year or more, and acquired at bein hashmashos of the first Shabbos, when the doorway was open, it comes back to life when the doorway opens on another Shabbos, even at the end of the year, and even if it was closed up deliberately; on this last case the Rav cites a stringent view, and writes that in the words of the Sofrim one follows the lenient one (374:1). For a doorway closed up deliberately and opened on Shabbos, consult your Rav (what the Mishnah Berurah and the Biur Halachah write about it is in section 2, point ג). See section 2, points ב and ג. Reference: Shulchan Aruch HaRav 374:1.
- ③ A wall breached on Shabbos: between two courtyards that had each made an eruv for itself, each may carry in his courtyard up to the place of the wall, even utensils that were in the house at the start of Shabbos. But for a courtyard breached on Shabbos into the public domain or a karmelis, by a breach that renders it forbidden, one does not say that Shabbos, once permitted, remains permitted — the Rav refers to Siman 362 (374:2). See section 2, point ד. Reference: Shulchan Aruch HaRav 374:2.
- ④ A small courtyard breached into a large one: breached while it was still day, along its full width, by a breach of no more than ten amos: the large one may carry out utensils that were in the house at the start of Shabbos into its courtyard if it made an eruv for itself, even without an eruv with the small one; the small one may not, unless it made an eruv with the large one. This applies when the long walls of the small one enter into the large one and are set apart there by three tefachim from its long walls; otherwise the small one too is permitted (374:3). If only one wall is set apart three tefachim, the Biur Halachah, in the name of the Vilna Gaon, forbids the small one; what the Rav holds in this case, the page does not say: consult your Rav. See section 2, point ה. Reference: Shulchan Aruch HaRav 374:3.
- ⑤ A small roof breached along its full width into a large one: the roofs being surrounded by a parapet ten [tefachim] high, or, without a parapet, the partitions of the house being visible from the edge of the roof, and the houses not having made an eruv together: one may not bring up onto the small one utensils that were in the house at the start of Shabbos if its partitions enter into the large one, and the large one is permitted (the Mishnah Berurah adds that the small roof is not more than ten amos, ס״ק כ״ג). If the partitions are not visible from the edge of the roof, it is a karmelis, unless a window of four by four [tefachim] opens onto the roof from the house; and even with this window, if they did not make an eruv together, even the large one is forbidden for utensils that were in the house at the start of Shabbos, since the wall of the house is not recognizable from above (374:4). See section 2, point ו. Reference: Shulchan Aruch HaRav 374:4.
