summary: heading of the siman, then the seif. A gallery that is the way to the upper rooms that open onto it, that stands in the courtyard, that one climbs to by a ladder, and from which the residents of the upper rooms go down to the courtyard and pass on to the public domain: they do not forbid the residents of the courtyard, since the ladder has the status of an opening, and it is like two courtyards with an opening between them — if they wish, they make the eruv together, and if they wish, each makes the eruv for itself; provided that all the residents of the gallery make an eruv among themselves, so that it is a foot permitted in its place.
summary: if they did not make an eruv together, and there is in the courtyard a mound or a pillar shared by the two: if they are not ten tefachim high, they count both to the courtyard and to the gallery, and both are forbidden to carry out there the utensils of the houses. Ten tefachim high above the floor of the courtyard (parenthesis as printed, with a reference to the Tur: and within ten of the gallery) and within four tefachim of the gallery: the residents of the gallery are permitted, since its use is easier for them than for the residents of the courtyard. Four tefachim or more away from the gallery, even though ten high (parenthesis as printed, with a reference to the Tur: from the courtyard, within ten of the gallery): they belong both to the courtyard and to the gallery, since both can use them by throwing; therefore both are forbidden to carry out there utensils that rested in the houses, until they make an eruv. [Sources of this seif are studied in sections 4 to 6; for the case-by-case synthesis, see the table in section 5 of Level 3.]
summary: if there is a matzeivah of four tefachim in front of the gallery, the gallery does not forbid the residents of the courtyard, since it has separated from them [the seif does not say whether the four tefachim are its height or its width — section 8].
summary: ledges (zizim) projecting from the walls: what is below ten tefachim counts to the courtyard, and the residents of the courtyard use it; what is within the upper ten tefachim, near the upper room, the people of the upper room use it; what remains between the lower ten and the start of the upper ten is forbidden to both, and one does not use it with utensils that rested in the houses, unless they made an eruv.
1. The sugya — the gallery, Rashi, and the ladder as opening and partition (seif 1)
The Mishnah, and Rashi
The Beis Yosef connects the seif to the Mishnah of the chapter Keitzad mishtatfin (Eruvin 83b): « אַנְשֵׁי חָצֵר וְאַנְשֵׁי מִרְפֶּסֶת שֶׁשָּׁכְחוּ וְלֹא עֵירְבוּ, כׇּל שֶׁגָּבוֹהַּ עֲשָׂרָה טְפָחִים — לְמִרְפֶּסֶת. וְאֵיזוֹ הִיא סְמוּכָה — כׇּל שֶׁאֵינָהּ רְחוֹקָה אַרְבָּעָה טְפָחִים » (עירובין פ״ג ע״ב) — residents of the courtyard and residents of the gallery who forgot and did not make an eruv: whatever is ten tefachim high belongs to the gallery; less than that, to the courtyard. The rim of the cistern and the rock, ten tefachim high, to the gallery; less than that, to the courtyard. When is this said? When [the thing] is close; but when it is set apart, even ten tefachim high, to the courtyard. And which is close? Whatever is not four tefachim away. The Mishnah thus limits to the close case what it gives to the gallery; for what to the courtyard means, see section 4; for the mound four away, sections 5 and 6. The Mishnah does not describe the gallery, nor who failed to make an eruv with whom. Rashi specifies it: « ולא עירבו אלו עם אלו אבל עירבו אלו לעצמן ואלו לעצמן » (רש״י עירובין פ״ג ע״ב) — they did not make an eruv with one another, but these made an eruv for themselves and those for themselves; and he describes the gallery: « מרפסת ארוכה היא והרבה פתחי עליות פתוחין לה וכולן יוצאין בסולם א׳ לחצר וממנה לרה״ר » (רש״י עירובין פ״ג ע״ב) — the gallery is long, many doorways of upper rooms open onto it, and they all go out by a single ladder to the courtyard, and from there to the public domain.
Then he explains why they do not forbid the residents of the courtyard: « ואעפ״כ אין אוסרין הואיל וגבוה מרפסת י׳ שלא הלכו בסולם אלא להקל ואמרינן תורת מחיצה עליו ואינן אוסרין » (רש״י עירובין פ״ג ע״ב) — and even so they do not forbid, since the gallery is ten high: the ladder was followed only to be lenient, and we say it has the status of a partition, and they do not forbid. He refers to the chapter Keitzad me'abrin: « סולם תורת פתח עליו ותורת מחיצה עליו והכל להקל ומ״מ שני רשויות הן ואין מוציאין מזו לזו » (רש״י עירובין פ״ג ע״ב) — the ladder has the status of an opening and the status of a partition, and all to be lenient; nevertheless, they are two domains, and one does not carry out from one to the other.
Rav's statement
In the chapter Keitzad me'abrin, Rav Ami bar Ada of Harpania asks Rabbah: « בָּעֵי מִינֵּיהּ רַב אַמֵּי בַּר אַדָּא הַרְפַּנָּאָה מֵרַבָּה: סוּלָּם מִכָּאן וּפֶתַח מִכָּאן, מַהוּ? אֲמַר לֵיהּ, הָכִי אָמַר רַב: סוּלָּם תּוֹרַת פֶּתַח עָלָיו » (עירובין נ״ט ע״ב) — a ladder on one side and an opening on the other? Thus said Rav: the ladder has the status of an opening. The case there is a town; Rashi explains the ladder: « שעולין ויורדין בו חוץ לחומתה » (רש״י עירובין נ״ט ע״ב) — by which one goes up and down outside its wall. Rav Nachman replies: « אֲמַר לְהוּ רַב נַחְמָן: לָא תְּצִיתוּ לֵיהּ, הָכִי אָמַר רַב אַדָּא אָמַר רַב: סוּלָּם תּוֹרַת פֶּתַח עָלָיו, וְתוֹרַת מְחִיצָה עָלָיו » (עירובין נ״ט ע״ב) — do not listen to him: thus said Rav Ada in the name of Rav: the ladder has the status of an opening, and the status of a partition; « תּוֹרַת מְחִיצָה עָלָיו, כְּדַאֲמַרַן. תּוֹרַת פֶּתַח עָלָיו, בְּסוּלָּם שֶׁבֵּין שְׁתֵּי חֲצֵירוֹת, רָצוּ — אֶחָד מְעָרֵב, רָצוּ — שְׁנַיִם מְעָרְבִין » (עירובין נ״ט ע״ב) — the status of a partition, as we said; the status of an opening, for the ladder between two courtyards: if they wish, one eruv; if they wish, they make two eruvin. Rashi explains the status of a partition: « כלומר אינו מבטל את הסתימה להיות כפתח » (רש״י עירובין נ״ט ע״ב) — it does not cancel the closure so as to make it an opening.
The seif copies the Tur almost word for word; the Tur too writes: « דסולם תורת פתח עליו והוי כשתי חצירות ופתח ביניהן » (טור או״ח שע״ה) . The seif thus names one side of Rav's statement, the status of an opening; Rashi explains the Mishnah by the other, the status of a partition. Are these two ways of saying the same rule? That is the question of section 2.
2. The underlying hakira — the ladder: an opening or a partition? (seif 1)
חקירה — the residents of the gallery pass through the courtyard to reach the public domain. Why do they not forbid the residents of the courtyard? Because the ladder is an opening, making the gallery and the courtyard two courtyards joined by an opening, each of which may make its eruv for itself; or because the gallery, ten high, is a domain separated by its height, and the ladder does not erase that partition? The question is posed by this page; the texts that follow are some of those that can be ranged on each side.
- First side — the opening. The seif: « אינם אוסרים על בני החצר דסולם תורת פתח עליו והוי כשתי חצרות ופתח ביניהם » (שו״ע או״ח שע״ה:א) , and it continues: « שאם רצו מערבים יחד ואם רצו כל א׳ מערב לעצמו » (שו״ע או״ח שע״ה:א) . The Taz reads the condition that follows in this sense: « וקמ״ל דלא תימה דהוה כחצר אחרת שעירבה חציה לעצמה וחציה לעצמה דאסרי אהדדי אלא הוה כב׳ חצירות » (ט״ז או״ח שע״ה ס״ק א) — it teaches us that this is not like a courtyard each half of which made an eruv for itself, so that they forbid one another, but like two courtyards [the text served by Sefaria reads כחצר אחרת, another courtyard; the Beis Yosef and the Mishnah Berurah write כחצר אחד, one courtyard, which the translation follows].
- Second side — the partition. Rashi, quoted in section 1, gives as the reason the height of ten and the ladder's status of a partition. The Shulchan Aruch HaRav (seif 1 in its numbering) also bases the rule on the height: « הוֹאִיל וְאֵינָן פְּתוּחִים לָהּ אֶלָּא לְמִרְפֶּסֶת, וּסְתָם מִרְפֶּסֶת גָּבוֹהַּ עֲשָׂרָה, וְכָל גָּבוֹהַּ עֲשָׂרָה רְשׁוּת בִּפְנֵי עַצְמוֹ הוּא וּמֻחְלֶקֶת מֵרְשׁוּת שֶׁאֶצְלָהּ » (שו״ע הרב שע״ה:א) ; and he gives the ladder the status of an opening only for a joint eruv: « לְפִי שֶׁהַסֻּלָּם אֵין תּוֹרַת פֶּתַח עָלָיו אֶלָּא לְהָקֵל, שֶׁיְּכוֹלִים לְעָרֵב יַחַד עַל יְדֵי סֻלָּם שֶׁבֵּינֵיהֶן כְּמוֹ עַל יְדֵי פֶּתַח, אֲבָל לֹא לְהַחֲמִיר » (שו״ע הרב שע״ה:א) .
A gallery that is not ten high. The Gemara at once objects to Rav Nachman from a statement he reports in the name of Shmuel: « וּמִי אָמַר רַב נַחְמָן הָכִי? וְהָאָמַר רַב נַחְמָן אָמַר שְׁמוּאֵל: אַנְשֵׁי חָצֵר וְאַנְשֵׁי מִרְפֶּסֶת שֶׁשָּׁכְחוּ » (עירובין נ״ט ע״ב) « וְלֹא עֵירְבוּ, אִם יֵשׁ לִפְנֵיהֶם דַּקָּה אַרְבָּעָה — אֵינָהּ אוֹסֶרֶת, וְאִם לָאו — אוֹסֶרֶת » (עירובין ס׳ ע״א) — residents of the courtyard and residents of the gallery who forgot and did not make an eruv: if there is a dakah of four in front of it, it does not forbid; if not, it forbids. Rashi: « אלמא תורת פתח עליו ואפילו לחומרא » (רש״י עירובין ס׳ ע״א) — so the ladder would have the status of an opening even to be stringent. The answer: « הָכָא בְּמַאי עָסְקִינַן, בִּדְלֹא גְּבוֹהָ מִרְפֶּסֶת עֲשָׂרָה » (עירובין ס׳ ע״א) ; Rashi: « בדלא גבוה י׳ - דליכא למימר תורת מחיצה עליה » (רש״י עירובין ס׳ ע״א) — there, one cannot say it has the status of a partition. The seif does not mention the height of the gallery; the Mishnah Berurah writes, in the name of the Acharonim: « ומיירי כשהמרפסת גבוה י״ט מן החצר דאי לא היה גבוה י״ט הוי ליה עם החצר כחצר אחת » (משנה ברורה שע״ה ס״ק א) — if it is not ten high, it forms a single courtyard with the courtyard. The Shulchan Aruch HaRav writes that an ordinary gallery is ten high, and does not say, in this seif, what the law is for a lower gallery (Level 4, point א). The continuation of the Gemara, on the dakah, is in section 8.
3. The condition — the foot permitted in its place, and what forbidding means (seif 1, end)
The seif concludes: « ובלבד שיערבו כל בני מרפסת לעצמן כדי שתהא רגל המותרת במקומה » (שו״ע או״ח שע״ה:א) . Rashi already reads the Mishnah this way (section 1): those of the gallery made an eruv for themselves. The Beis Yosef: « אבל אם לא עירבו בני מרפסת לעצמן ודאי אסרי אבני חצר דרגל האסורה במקומה אוסרת שלא במקומה » (בית יוסף או״ח שע״ה) — if they did not, they certainly forbid the residents of the courtyard, since a foot forbidden in its place forbids outside its place. The Mishnah Berurah gives the reason: « דמרפסת כיון שאין לו דרך אחר לר״ה כ״א ע״י חצר הו״ל כחצר זה לפנים מזה שאין לו דרך אחר כ״א ע״י חצר החיצונה » (משנה ברורה שע״ה ס״ק ג) — the gallery has no other way to the public domain except through the courtyard; it is like one courtyard inside another, which has no other way except through the outer courtyard. It refers to siman שע״ח.
יסוד — what forbidding means. The Beis Yosef, following the Rambam and the Maggid Mishneh: « והאי אוסרים ואינם אוסרים דקתני פי׳ הרמב״ם וה״ה בפ״ד דלענין כלים ששבתו בבית היא » (בית יוסף או״ח שע״ה) — the words forbid and do not forbid in the Mishnah concern utensils that rested in the house; « כלומר דאילו לכלים ששבתו בחצר אפילו לא עירבו כלל מותר לטלטל מן החצר למרפסת והרי הם בכלל גגות וחצירות שהן רשות אחת » (בית יוסף או״ח שע״ה) — for utensils that rested in the courtyard, even with no eruv at all, one may carry from the courtyard to the gallery, since they are included among the roofs and courtyards, which form a single domain (see siman שע״ב, seif 1). The Rambam writes the case where each made an eruv for itself: « אַנְשֵׁי הַמִּרְפֶּסֶת אוֹ אַנְשֵׁי הָעֲלִיָּה מְטַלְטְלִין כֵּלִים שֶׁשָּׁבְתוּ בְּבָתֵּיהֶן בְּכָל הַמִּרְפֶּסֶת » (רמב״ם הלכות עירובין פ״ד הט״ו) — the people of the gallery, or the people of the upper room, carry the utensils that rested in their houses throughout the gallery. The Mishnah Berurah specifies what remains forbidden: « ר״ל ומותר לטלטל אפילו כלי הבית לחצר וכן כלי עליה למרפסת אבל כלי הבית למרפסת או כלי עליה לחצר אסור כיון שלא עירבו יחד » (משנה ברורה שע״ה ס״ק ב) . This is the end of Rashi's sentence quoted in section 1: two domains, and one does not carry out from one to the other.
4. Rav and Shmuel — one by lowering, the other by throwing (seif 2)
The Gemara ranks places lying between two domains by the way each side uses them: on the level, by an opening; upwards, by throwing; downwards, by lowering. It treats as obvious the cases where the use is the same for both (the window, the wall, the ditch between two courtyards), and those where one uses it by an opening (Rabbah bar Rav Huna and Rav Shizvi, in the name of Rav Nachman). The last case remains: « לָזֶה בְּשִׁלְשׁוּל וְלָזֶה בִּזְרִיקָה, מַאי? אָמַר רַב: שְׁנֵיהֶן אֲסוּרִין. וּשְׁמוּאֵל אָמַר: נוֹתְנִין אוֹתוֹ לָזֶה שֶׁבְּשִׁלְשׁוּל » (עירובין פ״ג ע״ב) — one by lowering, the other by throwing: Rav says both are forbidden; Shmuel says it is given to the one who lowers, « שֶׁלָּזֶה תַּשְׁמִישׁוֹ בְּנַחַת, וְלָזֶה תַּשְׁמִישׁוֹ בְּקָשֶׁה, וְכׇל דָּבָר שֶׁתַּשְׁמִישׁוֹ לָזֶה בְּנַחַת וְלָזֶה בְּקָשֶׁה — נוֹתְנִים אוֹתוֹ לָזֶה שֶׁתַּשְׁמִישׁוֹ בְּנַחַת » (עירובין פ״ג ע״ב) . Rashi gives the example: « כגון חצר זו גבוהה מזה התל י׳ וזו נמוכה ממנו י׳ » (רש״י עירובין פ״ג ע״ב) — one courtyard higher than the mound by ten, and the other lower than it by ten.
The Mishnah against Rav. The Gemara first assumes that the residents of the gallery are the residents of the upper rooms: « בְּנֵי עֲלִיָּיה. וּמַאי קָרוּ לַהּ מִרְפֶּסֶת? דְּקָסָלְקִי בְּמִרְפֶּסֶת, אַלְמָא: כָּל לָזֶה בְּשִׁלְשׁוּל וְלָזֶה בִּזְרִיקָה — נוֹתְנִין אוֹתוֹ לָזֶה שֶׁבְּשִׁלְשׁוּל » (עירובין פ״ד ע״א) — they would be so called because they go up by the gallery; the Mishnah would then give the mound of ten to the one who lowers, like Shmuel. The answer: « כִּדְאָמַר רַב הוּנָא: לְאוֹתָן הַדָּרִים בַּמִּרְפֶּסֶת. הָכִי נָמֵי: לְאוֹתָן הַדָּרִין בַּמִּרְפֶּסֶת » (עירובין פ״ד ע״א) — as Rav Huna said: those who live on the gallery. Rashi: « כגון שיש בה דיורין דלדידהו הוי האי תל שבחצר שוה להן בתוך עשרה או נמוך או גבוה מהם פחות מי׳ » (רש״י עירובין פ״ד ע״א) — for them, the mound in the courtyard is as if on the level, less than ten above or below them. And the end of the Mishnah: « אִי הָכִי, אֵימָא סֵיפָא: פָּחוֹת מִכָּאן — לֶחָצֵר. אַמַּאי? לָזֶה בְּפֶתַח וְלָזֶה בְּפֶתַח הוּא! מַאי ״לֶחָצֵר״? אַף לֶחָצֵר. וּשְׁנֵיהֶן אֲסוּרִין » (עירובין פ״ד ע״א) — to the courtyard means also to the courtyard, and both are forbidden. The Gemara proves it from the next sentence of the Mishnah: « הָכִי נָמֵי מִסְתַּבְּרָא, מִדְּקָתָנֵי סֵיפָא: בַּמֶּה דְּבָרִים אֲמוּרִים בִּסְמוּכָה. שְׁמַע מִינַּהּ » (עירובין פ״ד ע״א) — the mound that is away, even ten high, is not to the courtyard and permitted, since it is the domain of both: it is also to the courtyard, and both are forbidden; so too the mound less than ten high. Rashi: « אלא - על כרחך אף לחצר ואסורין לרב נמי דמתרץ לה בדיורי מרפסת מאי לחצר דקתני אפחות מכאן אף לחצר קאמר ואסורין » (רש״י עירובין פ״ד ע״א) — necessarily, also to the courtyard, and forbidden; and likewise, according to Rav, who explains it as the people who live on the gallery, to the courtyard, which the Mishnah says of the mound less than ten high, means also to the courtyard, and forbidden.
The halachah: the Beis Yosef, « וידוע דהלכה כרב באיסורי וכן פסק הרא״ש שם והרמב״ם בפ״ד מה״ע » (בית יוסף או״ח שע״ה) — it is known that the halachah follows Rav in prohibitions; so ruled the Rosh there, and the Rambam in chapter 4 of the laws of eruvin; the Taz, « ורב סבירא ליה דלא מיקרי נחת אלא במשתמש דרך פתח אבל כאן לא אכפת לן בנחת קצת ושלשול וזריקה שוין הם ואסור והכי קי״ל » (ט״ז או״ח שע״ה ס״ק ב) — Rav holds that only use through a doorway is called easy; here a little ease does not matter: lowering and throwing are equal, and it is forbidden; and so we hold. The case in which the seif gives the mound to the residents of the gallery — its second case, studied in section 6, after the first (section 5) — is the one where the mound is on the level for them and, for the courtyard, reached by throwing: the case of the Gemara where one uses it by an opening and the other by throwing.
The Tur's formula. The Tur ends the siman with: « אבל כל שתשמישו בנחת יותר מלחבירו נותנין אותו למי שהוא בנחת בין אם הוא עליון או תחתון » (טור או״ח שע״ה) . The Beis Yosef: « אין לשון זה נוח לי דהא אליבא דשמואל הוא דאמרינן נותנין אותו לזה שתשמישו בנחת אבל לרב שניהם אסורים עד שיהא לזה בנחת לגמרי דומיא דפתח ולזה בקשה » (בית יוסף או״ח שע״ה) — this formula is Shmuel's; according to Rav, both are forbidden unless the use is entirely easy for one, like an opening, and difficult for the other. The Taz answers: « ונ״ל דכיון דכבר כ׳ הטור דין שלשול וזריקה דאסור ממילא לפרש הך מלתא על ענין שלזה יש ריעותא ולזה אין ריעותא » (ט״ז או״ח שע״ה ס״ק ב) — since the Tur already wrote that lowering against throwing is forbidden, his formula refers to the case where one has a drawback and the other has none. At the head of the same ס״ק, the Taz sets out the general rule he draws from this seif, and counts the distance among the difficult uses: « הכלל מסעי׳ זה דכל שלזה תשמישו בנחת ולזה בקשה לא מקרי רק רשות לאותו שתשמישו בנחת ואין השני יכול למחות בידו כלל אבל אם שניהם שוים הן בנחת כגון ששניהם משתמשים ע״י פתח הן בקשה שייך לשניהם ואוסרין זה על זה אלא דיש פלוגתא בגמ׳ איזה מקרי בנחת ואיזה בקשה דהיינו כל שצריך לתשמישו זריקה דהיינו שהמקום ההוא גבוה ממנו י״ט וצריך לזרוק שם מקרי קשה וכן בשלשול דהיינו שהמקום נמוך ממנו י״ט וצריך לשלשל שם ואם הוא פחות מי״ט הן בזריקה והן בשלשול לא מקרי קשה ועוד קרוי קשה אפי׳ אם הוא פחות מי׳ טפחים כגון אם הוא מופלג בריחוק המשך ממנו ד״ט אלא דאם לא׳ בזריקה ולא׳ בשלשול ס״ל לשמואל דאע״פ דתרווייהו קשים הם מ״מ שלשול אינו קשה כל כך כמו זריקה ע״כ הוא שייך לבעל השלשול דהוא בעל נחת ורב סבירא ליה דלא מיקרי נחת אלא במשתמש דרך פתח אבל כאן לא אכפת לן בנחת קצת ושלשול וזריקה שוין הם ואסור והכי קי״ל » (ט״ז או״ח שע״ה ס״ק ב) — what is easy to use for one and difficult for the other is the domain only of the one for whom it is easy, and the other cannot object; but if they are equal, its use being easy for both (for instance, both use it by an opening) or difficult for both, it belongs to both, and they forbid it to each other. The Gemara is divided over what is called easy or difficult: what can be used only by throwing, the place being ten tefachim higher, is called difficult, and so too what can be used only by lowering, the place being ten lower; within ten, neither throwing nor lowering is called difficult. A place four tefachim away in distance is also called difficult, even within ten tefachim. When one throws and the other lowers, Shmuel holds that lowering, though difficult, is less so than throwing, and the place goes to the one who lowers; Rav holds that only use by an opening is easy, that lowering and throwing are equal, and that it is forbidden; and so we hold (above). He writes further on that all this is the Tur's view, and that the Rambam does not hold it: « כל זה שיטת הטור אבל הרמב״ם לא ס״ל כך » (ט״ז או״ח שע״ה ס״ק ב) (section 6).
5. The mound less than ten — the Rambam, the Tur and the seif (seif 2)
The beginning of the seif takes up the Rambam's words: « אִם אֵינָן גְּבוֹהִין עֲשָׂרָה טְפָחִים הֲרֵי אֵלּוּ נֶחְשָׁבִין בֵּין הֶחָצֵר וּבֵין הַמִּרְפֶּסֶת וּשְׁנֵיהֶן אֲסוּרִין לְהוֹצִיא שָׁם כֵּלִים שֶׁבַּבָּתִּים » (רמב״ם הלכות עירובין פ״ד הט״ז) ; the seif: « אם אינם גבוהים י״ט הרי אלו נחשבי׳ בין החצר ובין המרפסת ושניהם אסורים להוציא שם כלים שבבתים » (שו״ע או״ח שע״ה:ב) — if they are not ten tefachim high, they count both to the courtyard and to the gallery, and both are forbidden to carry out there the utensils of the houses. The Tur writes: « ואם אינו גבוה י׳ לבני החצר וממנו למרפסת ארבעה או אם הוא תוך י׳ לשניהן ורחוק מן המרפסת ד׳ טפחים בני החצר מותרין בו שהוא נוח להם יותר » (טור או״ח שע״ה) — if it is not ten high for the residents of the courtyard and from it to the gallery there are four, or if it is within ten for both and four tefachim away from the gallery, the residents of the courtyard are permitted to use it, since it is easier for them. He continues, for the mound equal for both: « ואם הוא לשניהן שוה תוך י׳ או יותר מי׳ והוא בתוך ד׳ למרפסת … שניהם אסורין » (טור או״ח שע״ה) — if it is equal for both, within ten or more than ten, and within four of the gallery, […] both are forbidden.
Four away from the gallery. The Beis Yosef reads the Rambam: « ומרישא דלישניה שכתב אם אינם גבוהין י׳ טפחים הרי אלו נחשבין בין החצר והמרפסת ושניהם אסורין ולא חילק בין אם מופלגים ארבעה לאם אינם מופלגין משמע נמי דאע״פ שהן מופלגין מן המרפסת ד׳ ואינם גבוהין י׳ טפחים רשות מרפסת שולטת בהם ג״כ » (בית יוסף או״ח שע״ה) — he did not distinguish between four away and not four away; even four away and less than ten high, the domain of the gallery extends to it too. And he concludes: « ולא משכחת לה צד היתר אלא בגבוהים י׳ ואינם מופלגים ד׳ דהשתא הוי לבני מרפסת בנחת ולבני חצר בזריקה ונותנין אותה לזה שבנחת » (בית יוסף או״ח שע״ה) — there is a permitted case only when ten high and not four away, the use then being easy for the gallery and by throwing for the courtyard. He adds that the plain sense of the Mishnah proves it: « ופשטא דמתני׳ כוותיה מוכחא דקתני בד״א בסמוכה אבל במופלגת אפילו גבוה י׳ טפחים לחצר ומשמע דה״ק בד״א דגבוה י׳ טפחים למרפסת בסמוכה אבל במופלגת בין גבוה י׳ טפחים בין פחות מי׳ לחצר כלומר אף לחצר כדמוקי בגמרא הרי בהדיא לא משכחת לה צד היתרא אלא בשני תנאים גבוהים י׳ טפחים וסמוכים דאז בני מרפסת מותרין הא פחות מגובה י׳ אפילו הם סמוכים או מופלגים אע״ג שגבוהים י׳ הוי אף לחצר ושניהם אסורים » (בית יוסף או״ח שע״ה) — the Mishnah says: when it is close; but away, even ten high, to the courtyard — that is: ten high, to the gallery when it is close; away, whether ten high or less, to the courtyard, that is, also to the courtyard, as the Gemara establishes (section 4); so, explicitly, there is a permitted case only under two conditions, ten high and close, when the people of the gallery are permitted; less than ten high, even close; or away, though ten high: it is also to the courtyard, and both are forbidden. In these passages, the Beis Yosef does not name the height of the mound below the gallery. On the Tur's view he writes: « ולדעת רבינו צריך לדחוק ולומר שהוא סובר דכי אקשינן מאי לחצר אילימא לחצר ושרי אמאי רשותא דתרווייהו הוא לא קשיא לן הכי אלא בגבוהין י׳ דהוי תשמישן לחצר נמי בקושי אבל היכא דאינם גבוהים י׳ ניחא דליהוי לחצר ושרי דהא כיון דאינם גבוהים י׳ הוי תשמישן לחצר בנחת וא״כ כי אוקימנא אף לחצר לא הוי אלא בגבוהים י׳ אבל באינם גבוהים י׳ הוי לחצר דוקא ושרי ולפ״ז מתני׳ דקתני אבל במופלגת אפילו גבוה י׳ טפחים לחצר דלישנא דאפילו משמע בין גבוה מי׳ בין פחות מי׳ לצדדין קתני דבגבוה מי׳ הוי אף לחצר ושניהם אסורים ובפחות מי׳ הוי דוקא לחצר ושרי » (בית יוסף או״ח שע״ה) — according to the Tur one must force the text and say that the Gemara's question (if to the courtyard means to the courtyard, and permitted, why, since it is the domain of both?) is asked only of the mound ten high, whose use is difficult for the courtyard too; less than ten high, its use is easy for the courtyard, and it is to the courtyard alone, and permitted; and the Mishnah, whose even covers both the mound ten high and the mound less than ten, speaks of two cases at once: ten high, also to the courtyard, and both are forbidden; less than ten, to the courtyard alone, and permitted. The Taz, on the Rambam's words, which are those of the seif: « מבואר דברישא באין גבוהין י׳ אסור לשניהם אפילו במופלג ד׳ ממרפסת מדלא זכר ברישא מחילוק מופלג או סמוך וכ״כ ב״י וכ״מ » (ט״ז או״ח שע״ה ס״ק ב) — it is clear that in the first clause a mound less than ten high is forbidden to both, even if it is four away from the gallery, since the clause makes no distinction between four away and close; so wrote the Beis Yosef and the Kesef Mishneh.
The Magen Avraham writes on the opening words of the seif, and reports the Beis Yosef under this gloss: « וגם למרפסת אין גבוהים י׳ דהוי לשניהם בנחת וכתב הב״י דאף ע״פ שרחוק ד׳ מן המרפסת שניהם אסורים דבני המרפסת יכולים להשתמש עליו בזריקה » (מגן אברהם שע״ה ס״ק א) — and, relative to the gallery too, they are not [lower than it by] ten, so that its use is easy for both; and the Beis Yosef wrote that even if it is four away from the gallery, both are forbidden, since the residents of the gallery can use it by throwing. His gloss limits the seif's first sentence to a mound less than ten below the gallery, and it is under it that he reports the Beis Yosef's prohibition for the mound four away; then: « אבל בטור ובפוסקים משמע דכל פחות מי׳ לאו כלום הוא ונותנין אותו לבני החצר אם הוא רחוק ד׳ מן המרפסת או נמוך ממנו י׳ דאין אדם אוסר על חבירו דרך אויר » (מגן אברהם שע״ה ס״ק א) — according to the Tur and the poskim, below ten it counts for nothing, and it is given to the residents of the courtyard if it is four away from the gallery, or ten lower than it, since one does not forbid one's fellow through the air; and he adds: « ואפשר שגם דעת הרמב״ם כן אלא שדרכו לסתום » (מגן אברהם שע״ה ס״ק א) — perhaps this is also the Rambam's view, but his way is to write without specifying.
The Mishnah Berurah writes on these words of the seif: « ודוקא כשהיה התל והעמוד סמוך להמרפסת בתוך ד״ט דאם היו רחוקים ממנו ד״ט א״כ תשמיש המרפסת עליו בקשה והחצר בנחת ונותנים אותו לבני החצר » (משנה ברורה שע״ה ס״ק ז) — and only when the mound or the pillar is close to the gallery, within four tefachim; if they are four tefachim away from it, the gallery's use of it is difficult and the courtyard's easy, and it is given to the residents of the courtyard; and, on the height in relation to the gallery: « וגם מן המרפסת שלמעלה מהם אין נמוך ממנה עשרה טפחים דאז נוח לשניהם להשתמש שם ולכן אוסרים זה על זה דאם היה נמוך מן המרפסת עשרה טפחים אז היו נותנים אותו לבני החצר » (משנה ברורה שע״ה ס״ק ו) — and also, relative to the gallery above them, it is not ten tefachim lower than it, for then its use is easy for both, and therefore they forbid each other; were it ten tefachim lower than the gallery, it would be given to the residents of the courtyard. The Shulchan Aruch HaRav writes (seif 2 in its numbering): « וְאִם הוּא תּוֹךְ עֲשָׂרָה לִשְׁנֵיהֶם, אוֹ יוֹתֵר מֵעֲשָׂרָה לִשְׁנֵיהֶם — אִם הוּא מֻפְלָג מִכְּנֶגֶד הַמִּרְפֶּסֶת ד׳, נוֹתְנִים אוֹתוֹ לֶחָצֵר, שֶׁתַּשְׁמִישׁוֹ לָהּ בְּנַחַת יוֹתֵר מִלַּמִּרְפֶּסֶת. וְאִם אֵינוֹ מֻפְלָג ד׳, שְׁנֵיהֶם אֲסוּרִים » (שו״ע הרב שע״ה:ב) — if it is within ten for both, or more than ten for both: if it is four away from in front of the gallery, it is given to the courtyard, for its use is easier for it than for the gallery; and if it is not four away, both are forbidden; and: « וְאִם הוּא תּוֹךְ עֲשָׂרָה לֶחָצֵר, וְיוֹתֵר מֵעֲשָׂרָה לַמִּרְפֶּסֶת — נוֹתְנִים אוֹתוֹ לֶחָצֵר בְּכָל עִנְיָן » (שו״ע הרב שע״ה:ב) — if it is within ten for the courtyard and more than ten for the gallery, it is given to the courtyard in any case (Level 4, point ב).
The reading of the Tur. In the Tur's first case, there are four from the mound to the gallery. The Beis Yosef explains: « ומ״ש ואם אינו גבוה י׳ לבני החצר וממנו למרפסת ד׳ כלומר והוא רחוק ממרפסת י׳ » (בית יוסף או״ח שע״ה) — that is: and it is ten away from the gallery; it is then not given to the gallery for two reasons, ten away from it and four removed from it, and he continues that even with one reason, being four removed, it is not given to the gallery. The Taz: « ובטור כתוב ואם אינו גבוה י׳ לבני החצר וממנו למרפסת ד׳ צ״ל יו״ד במקום דל״ת וכן הגיה מו״ח ז״ל והוא פשוט וא״צ למה שנדחק ב״י לפרשו » (ט״ז או״ח שע״ה ס״ק ב) — one must read yod (ten) instead of dalet (four); his father-in-law (מו״ח) emended it so, it is simple, and there is no need for the Beis Yosef's forced explanation.
For the case-by-case synthesis, see the table in section 5 of Level 3. For halachah lema'aseh, consult your Rav.
6. The parentheses with a reference to the Tur, and the mound too low for the gallery (seif 2)
To give the gallery the mound that is ten high, the Tur sets a condition: « אם הוא גבוה מקרקעית החצר י׳ טפחים ואין מראשו למרפסת י׳ טפחים והוא בתוך ד״ט למרפסת בני מרפסת מותרין בו לפי שתשמישו להם בנחת מלבני החצר » (טור או״ח שע״ה) — and from its top to the gallery there are not ten tefachim. The Beis Yosef derives it from Rav Huna's answer (section 4): « ומ״ש ואין מראשו למרפסת י״ט הוא מדאוקימנא מאי מרפסת לאותם הדרין במרפסת » (בית יוסף או״ח שע״ה) — what he writes, and from its top to the gallery there are not ten tefachim, comes from our having established that the gallery means those who live on the gallery. The Rambam does not write it: « וְאִם גְּבוֹהִין עֲשָׂרָה וְהָיָה בֵּינֵיהֶן וּבֵין הַמִּרְפֶּסֶת פָּחוֹת מֵאַרְבָּעָה טְפָחִים הֲרֵי אֵלּוּ נֶחְשָׁבִין עִם הַמִּרְפֶּסֶת שֶׁהֲרֵי הֵן שָׁוִין לָהּ וּבְנֵי מִרְפֶּסֶת מֻתָּרִין בָּהֶם » (רמב״ם הלכות עירובין פ״ד הט״ז) — if they are ten high and there are less than four tefachim between them and the gallery, they count with the gallery, for they are equal to it, and the residents of the gallery are permitted to use them. In the seif it is printed in small letters, in parentheses, with a reference to the Tur: « ואם הם גבוהים מקרקעית החצר י״ט (ובתוך עשרה למרפסת (טור » (שו״ע או״ח שע״ה:ב) . The word (להם), also in parentheses in the seif, is in the Tur's sentence quoted here.
What the Taz writes here for the Rambam is his reading. The Rambam himself, and the Mechaber in seif ד, give the courtyard the ledge that is less than ten above the courtyard, the upper room being more than twenty tefachim above the ground: « זיזים היוצאים מהכתלים כל שהוא למטה מעשרה טפחים הרי זה נחשב מהחצר ובני החצר משתמשין בו » (שו״ע או״ח שע״ה:ד) ; « מיירי בשהיו יותר מעשרים טפחים מן העליה לקרקע החצר » (משנה ברורה שע״ה ס״ק ט״ו) — and the Taz does not say how he reconciles his reading with that seif (section 9). At the head of the same ס״ק (section 4), the Taz counts lowering by ten as difficult use: « וכן בשלשול דהיינו שהמקום נמוך ממנו י״ט וצריך לשלשל שם » (ט״ז או״ח שע״ה ס״ק ב) — and likewise lowering: the place is ten tefachim lower than the one using it, and one must lower there. For the Rambam, he writes that when both have a drawback they forbid each other, and that the gallery is permitted only when it has the advantage and the courtyard the drawback, ten high and within four, without naming there the height below the gallery (below); he does not write, according to the Rambam, the mound ten high, ten lower than the gallery and close to it.
The second parenthesis specifies the case of the mound four away: « ואם היו רחוקים מהמרפס׳ ד״ט או יותר אע״פ שגבוהים עשרה (מן החצר לתוך עשרה למרפסת) (טור » (שו״ע או״ח שע״ה:ב) — ten high from the courtyard, and within ten of the gallery. The Tur, to which it refers, writes this mound forbidden to both: « או שהוא גבוה י׳ לבני החצר ורחוק ד׳ מן המרפסת … שניהם אסורין » (טור או״ח שע״ה) — or if it is ten high for the people of the courtyard and four away from the gallery, […] both are forbidden; he does not fix there the height below the gallery, and the parenthesis, which refers to him, adds: within ten of the gallery. The Taz: « היינו שלכל א׳ יש לבעל החצר ריעות׳ מכח זריקה ולבעל מרפסת מכח הפלגה ד״ט ולגביה אין ריעותא מכח שלשול כיון שהוא תוך י׳ שלו וע״כ אסור ששניהם שולטים בו » (ט״ז או״ח שע״ה ס״ק ב) — each has its drawback: the courtyard must throw, the gallery is four removed; for the gallery there is no drawback of lowering, since it is within ten of it; therefore it is forbidden, since both have a hold on it. The Mishnah Berurah: « אפ״ה כיון שמופלגין ממנה ד״ט וכשרוצים בני מרפסת להשתמש שם הוא רק ע״י זריקה מקרי תשמישו ג״כ בקשה זה מחמת גובהו וזה מחמת רחקו » (משנה ברורה שע״ה ס״ק י) — even so, since they are four tefachim away from it, and when the residents of the gallery want to use it, it is only by throwing, their use too is called difficult: for the one because of its height, for the other because of its distance.
Ten high for the courtyard, ten below the gallery, and removed from it. The Taz: « ואם היו תרתי לריעות׳ לבעל המרפסת דהיינו למעלה מי׳ ומופלג נ״ל שמותר בעל החצר בהתל ואין בעל המרפסת יוכל לאסור עליו מפני שאין אדם אוסר דרך אויר » (ט״ז או״ח שע״ה ס״ק ב) — when the gallery has both drawbacks, it seems to him that the courtyard is permitted, since one does not forbid through the air. Further on in the same ס״ק, he writes that all this is the Tur's view, and that the Rambam, whose words the seif takes up, does not hold it: « כל זה שיטת הטור אבל הרמב״ם לא ס״ל כך » (ט״ז או״ח שע״ה ס״ק ב) ; « וכן אם לשניהם ריעותא ג״כ אוסרים זה על זה אלא שאם יש למרפסת מעלה ולחצר ריעותא אז יש היתר למרפסת היינו בגובה י׳ ואינם רחוקים ד׳ טפחים » (ט״ז או״ח שע״ה ס״ק ב) — according to the Rambam, when both have a drawback, both forbid each other; the gallery is permitted only when it has the advantage and the courtyard the drawback, ten high and within four. The Mishnah Berurah reports two views: « יש אומרים דכיון שלבעל המרפסת יש שתי ריעותות שנמוכים מעשרה וגם מופלגים ד״ט א״כ תשמיש של אנשי החצר נוח יותר שם ונותנין אותו להם » (משנה ברורה שע״ה ס״ק י״א) — some say: since the owner of the gallery has two drawbacks, being ten lower and also four tefachim away, the use of the people of the courtyard is easier there, and it is given to them; « ויש אומרים דכיון שלהחצר נמי גבוה י״ט מקרי לשניהם תשמישו בקשה ואוסרין זה ע״ז » (משנה ברורה שע״ה ס״ק י״א) — others say: since for the courtyard too it is ten tefachim high, its use is called difficult for both, and they forbid each other. The Beis Yosef copies Rashi's explanation of the Gemara, according to which this mound is forbidden to both, even according to Shmuel — the gallery must both throw across the distance and lower: « דלשניהם תשמישו בקשה לחצר בזריקת גובה ולעלייה בזריקה את משך ההפלגה ובשלשול את הנמוכות ונהי דלשמואל שלשול לגבי זריקת גובה נוח היא הכא דאיכא שלשול וזריקת משך שוים הם לזריקת גובה ואמאי לחצר » (בית יוסף או״ח שע״ה) — for both its use is difficult: for the courtyard, by throwing upward; for the upper room, by throwing across the length of the distance, and by lowering toward what is lower; and though according to Shmuel lowering is easy compared with throwing upward, here, where there are lowering and throwing across a length, they are equal to throwing upward: why then to the courtyard? For the case-by-case synthesis, see the table in section 5 of Level 3.
7. The cistern — what the seif does not write (Mishnah Berurah, ס״ק י״א)
The Mishnah mentions, together with the rock, the rim of the cistern. בּוֹר מַאי אִיכָּא לְמֵימַר » (עירובין פ״ד ע״א) — for a rock, fine; but for a cistern, what can one say? Rashi: « שממלאים הימנו תשמישתו בשלשול הוא אפילו לבני מרפסת שהרי מקרקעיתו דולין » (רש״י עירובין פ״ד ע״א) — one draws water from it, and for the residents of the gallery too its use is by lowering, since one draws from its bottom; the Mishnah would then give the cistern to those who lower, like Shmuel. Rav Yitzchak son of Rav Yehudah answers, and the Gemara rejects it: « אָמַר רַב יִצְחָק בְּרֵיהּ דְּרַב יְהוּדָה: הָכָא בְּבוֹר מְלֵאָה מַיִם עָסְקִינַן. בְּטִיבְלָא » (עירובין פ״ד ע״א) — a cistern full of tevel produce, which one does not take on Shabbos and which therefore does not diminish, like the rock. Why mention both? « צְרִיכָא, דְּאִי אַשְׁמְעִינַן סֶלַע — דְּלֵיכָּא לְמִיגְזַר, אֲבָל בּוֹר — לִיגְזוֹר זִמְנִין דְּמַלְיָא פֵּירוֹת מְתוּקָּנִין, צְרִיכָא » (עירובין פ״ד ע״א) — both were needed: had it taught the rock, where there is no reason to decree, [one would have said] but the cistern, let us decree, since it is sometimes full of prepared produce. Rashi on the prepared produce: « דשקלי מנייהו וחסרי ואתו לידי שילשול » (רש״י עירובין פ״ד ע״א) — one takes from it, it diminishes, and one comes to lowering.
יסוד — the Mishnah Berurah writes the case of the shared water cistern at the end of ס״ק י״א: « בור שבחצר. [של בני המרפסת ובני החצר בשותפות] ומקיפתו חוליא גבוה י׳ טפחים וסמוכה למרפסת בתוך ד״ט אוסרין זה על זה כשלא עירבו יחד » (משנה ברורה שע״ה ס״ק י״א) ; « ואפילו אם הבור מלא מים עד גובה החוליא שסמוכה למרפסת אסור משום גזירה שמא יחסרו המים בשבת וישתמשו בו כבתחלה אבל אם היה הבור מלא בדבר שאין ניטל בשבת הרי הוא כעמוד או תל גבוה י׳ מחצר ותוך עשרה למרפסת שנותנין אותו לבני מרפסת [כשאינו מופלג מכנגדה ד״ט וכנ״ל] להשתמש על גבה » (משנה ברורה שע״ה ס״ק י״א) — even if the cistern is full of water up to the height of the rim close to the gallery, it is forbidden, by a preventive decree, lest the water diminish on Shabbos and they use it as at first; but if it is full of something not taken on Shabbos, it is like a pillar or a mound ten high from the courtyard and within ten of the gallery, which is given to the people of the gallery [when it is not four tefachim removed from in front of it, as above] to use on top of it. The Shulchan Aruch HaRav makes it a seif, seif 3 in its numbering, in close terms: « וַאֲפִלּוּ אִם הַבּוֹר מָלֵא מַיִם עַד גֹּבַהּ הַחֻלְיָא סָמוּךְ לַמִּרְפֶּסֶת — אָסוּר, מִשּׁוּם גְּזֵרָה שֶׁמָּא יַחְסְרוּ הַמַּיִם בְּשַׁבָּת וְיִשְׁתַּמְּשׁוּ בּוֹ כְּבַתְּחִלָּה. In the Gemara, the water cistern is forbidden even when full, because it is forbidden when it diminishes (the Gemara's rejoinder to Rav Yitzchak, above).
8. The matzeivah — the dakah of four, and those who withdraw (seif 3)
The seif takes up the Rambam: « הָיְתָה מַצֵּבָה רְחָבָה אַרְבָּעָה טְפָחִים לִפְנֵי הַמִּרְפֶּסֶת אֵין הַמִּרְפֶּסֶת אוֹסֶרֶת עַל בְּנֵי הֶחָצֵר שֶׁהֲרֵי נֶחְלְקָה מֵהֶן » (רמב״ם הלכות עירובין פ״ד הט״ז) ; the seif: « היתה מצבה ארבע׳ טפחים לפני המרפס׳ אין המרפסת אוסר׳ על בני החצר שהרי נחלקה מהם » (שו״ע או״ח שע״ה:ג) — without the word wide. The Maggid Mishneh, reported by the Beis Yosef, gives as the source Rav Nachman's statement in the name of Shmuel on the dakah (section 2), and writes: « ויש שם על מימרא זו אוקימתות ורבינו כתבה כפשטה ומדבריו נראה שהוא מפרש שהמצבה הזאת מתרת הרשויות שנאמר עליהם למעלה שהם אסורים » (בית יוסף או״ח שע״ה) — the Gemara offers several restricting explanations of this statement, the Rambam wrote it according to its plain sense, and he seems to understand that the matzeivah permits the domains he said above are forbidden.
The Gemara. After the answer quoted in section 2, it asks: « וְאִי לֹא גְּבוֹהָ מִרְפֶּסֶת עֲשָׂרָה, כִּי קָא עָבֵיד דַּקָּה, מַאי הָוֵי? בִּמְגוּפֶּפֶת עַד עֶשֶׂר אַמּוֹת, דְּכֵיוָן דְּעָבֵיד דַּקָּה — אִיסְתַּלּוֹקֵי אִיסְתַּלּוּק לֵיהּ מֵהָכָא » (עירובין ס׳ ע״א) — if the gallery is not ten high, what difference does a dakah make? In a gallery enclosed [by a partition] up to ten amos: once one makes a dakah, one has withdrawn from here. Rashi on where the dakah is: « לפני המרפסת לרגלי הכבש בתחלת עלייתה » (רש״י עירובין ס׳ ע״א) ; on what it is: « פתח קטן גובה ארבעה אין אוסרין בני מרפסת על בני החצר דהא איסתלק להו » (רש״י עירובין ס׳ ע״א) — a small opening, four high: the residents of the gallery do not forbid the residents of the courtyard, since they have withdrawn; and on the enclosed gallery: « מוקפת מחיצה סביב אלא שנשאר לפנים י׳ אמות כדין פתח בלא היקף » (רש״י עירובין ס׳ ע״א) — enclosed by a partition all around, except for ten amos left in front, like an opening. Earlier (59b), Rav Idi bar Avin says in the name of Rav Chisda, of a resident of a mavoi: « אֶחָד מִבְּנֵי מָבוֹי שֶׁעָשָׂה דַּקָּה לְפִתְחוֹ — אֵינוֹ אוֹסֵר עַל בְּנֵי מָבוֹי » (עירובין נ״ט ע״ב) ; Rashi, on the sentence before it — a town where each mavoi made a dakah —, then on this one: « דעבוד דקה - פתח נמוך בראש כל מבוי דגלו אדעתייהו לאסתלוקי כל חד מחבריה: לפתחו - לפתח חצירו: אינו אוסר על המבוי - אם לא נשתתף עמהן דגלי אדעתיה דאסתלק » (רש״י עירובין נ״ט ע״ב) — a low opening at the entrance of each mavoi, by which each shows that he withdraws from the others; at his door, at the door of his courtyard: he does not forbid the mavoi if he did not join with them, since he showed that he withdraws.
A rule without a source? The Beis Yosef: « ולא ידעתי למה השמיט הרא״ש מימרא זו וגם הרמב״ם שהזכירה לא כתב החילוקים שנאמרו בה » (בית יוסף או״ח שע״ה) — he does not know why the Rosh omitted this statement, nor why the Rambam, who wrote it, did not write the distinctions made in it. The Biur Halachah: « עיין בב״י שמתמיה על הרמב״ם שלפי מה שמפרש הגמרא דף ס׳ למימרא דשמואל אין מקור לדין זה ובבית מאיר מיישב קצת » (ביאור הלכה שע״ה) — according to the way the Gemara explains Shmuel's statement, this rule has no source; the Beis Meir somewhat reconciles [the Rambam]. This page does not decide.
Four tefachim of what? The Rambam writes four wide (above); the seif writes of four tefachim without saying of what; Rashi describes the dakah as four high (above); the Mishnah Berurah: « ארבעה טפחים - בגובה שלה » (משנה ברורה שע״ה ס״ק י״ב) ; the Shulchan Aruch HaRav: « הָיְתָה מַצֵּבָה גָּבוֹהַּ ד׳ טְפָחִים לִפְנֵי הַמִּרְפֶּסֶת » (שו״ע הרב שע״ה:ד) . This page does not say whether a matzeivah four wide and less than four high suffices; the question is put to the Rav.
9. The ledges — Rav, Shmuel and the wall of nineteen (seif 4)
In the discussion of Rav and Shmuel, the Gemara brings a baraisa: « תָּא שְׁמַע: אַנְשֵׁי חָצֵר וְאַנְשֵׁי עֲלִיָּיה שֶׁשָּׁכְחוּ וְלֹא עֵירְבוּ — אַנְשֵׁי חָצֵר מִשְׁתַּמְּשִׁין בָּעֲשָׂרָה הַתַּחְתּוֹנִים, וְאַנְשֵׁי עֲלִיָּיה מִשְׁתַּמְּשִׁין בָּעֲשָׂרָה הָעֶלְיוֹנִים. כֵּיצַד? זִיז יוֹצֵא מִן הַכּוֹתֶל לְמַטָּה מֵעֲשָׂרָה — לֶחָצֵר, לְמַעְלָה מֵעֲשָׂרָה — לָעֲלִיָּיה » (עירובין פ״ד ע״א) — residents of the courtyard and residents of the upper room who forgot and did not make an eruv: the residents of the courtyard use the lower ten [tefachim], and the residents of the upper room the upper ten; a ledge projecting from the wall below ten, to the courtyard; above ten, to the upper room. It infers: « הָא דְּבֵינֵי בֵּינֵי — אָסוּר » (עירובין פ״ד ע״א) — what is in between is forbidden; Rashi: « אסור - לתרוייהו כרב » (רש״י עירובין פ״ד ע״א) . לְמַעְלָה מֵעֲשָׂרָה — לָזֶה בְּפֶתַח, וְלָזֶה בִּזְרִיקָה » (עירובין פ״ד ע״א) — the baraisa speaks of a wall of nineteen; Rashi: « בכותל תשעה עשר עסקינן - דליכא ביני » (רש״י עירובין פ״ד ע״א) — there is no in-between. Rashi also sets the width: « ובזיז רחב ארבעה עסקינן דבציר מהכי לא הוה רשותא ומקום פטור הוא ובטיל להכא ולהכא » (רש״י עירובין פ״ד ע״א) .
The conditions of the seif, according to the Mishnah Berurah: « גם זה הסעיף מיירי שבני החצר ובני העליה עירבו כ״א לעצמן ושהזיזים היו שייכין לבני החצר והעליה בשותפות » (משנה ברורה שע״ה ס״ק י״ד) ; « וגם מיירי שהזיזין היו רחבים ד״ט דאל״ה הוי מקום פטור ובטיל להכא ולהכא » (משנה ברורה שע״ה ס״ק י״ד) — in the name of Rashi; and: « מיירי בשהיו יותר מעשרים טפחים מן העליה לקרקע החצר וה״ה כשהיה פחות מעשרים טפחים והזיז עומד באמצע ואין ממנו עשרה טפחים לא לזה ולא לזה » (משנה ברורה שע״ה ס״ק ט״ו) . The Shulchan Aruch HaRav (seif 5 in its numbering) writes in the seif that the ledges are shared, « זִיזִין הַיּוֹצְאִין מִן הַכְּתָלִים וְהֵם מִבְּנֵי הֶחָצֵר וְהָעֲלִיּוֹת בְּשֻׁתָּפוּת » (שו״ע הרב שע״ה:ה) , and names the eruv that permits them: « אֶלָּא אִם כֵּן עֵרְבוּ יַחַד בְּנֵי הֶחָצֵר עִם בְּנֵי הָעֲלִיּוֹת » (שו״ע הרב שע״ה:ה) (Level 4, point ה).
10. Summary of the shitos and halachic conclusion
The foundation — seif ב gives the residents of the gallery the mound ten tefachim high above the floor of the courtyard and within four tefachim of the gallery (and, according to a parenthesis with a reference to the Tur, within ten of the gallery), because its use is easier for them than for the residents of the courtyard; and it forbids to both, for the utensils of the houses, the mound four tefachim or more away from the gallery, even ten high (and, according to the second parenthesis, within ten of the gallery), because both can use it by throwing; sources for it are studied in sections 4 to 6; for the case-by-case synthesis, see the table in section 5 of Level 3. In the order of the seifim:
- seif 1: the residents of the gallery do not forbid the residents of the courtyard; the seif, like the Tur, gives as the reason the ladder, which has the status of an opening; Rashi, the height of ten and the ladder's status of a partition, following Rav's statement in Eruvin 59b; for a gallery that is not ten high, among others the Gemara (60a) and the Mishnah Berurah (ס״ק א) — sections 1 and 2;
- seif 1, end: the condition that the residents of the gallery make an eruv among themselves, otherwise they forbid (among others Beis Yosef; Mishnah Berurah, ס״ק ג); forbidding concerns only utensils that rested in the houses (among others Beis Yosef, following the Rambam and the Maggid Mishneh; Mishnah Berurah, ס״ק ב) — section 3;
- seif 2: the discussion of Rav and Shmuel (Eruvin 83b-84a), on which the seif rests — section 4;
- seif 2: the mound less than ten above the courtyard — four away from the gallery, or ten lower than it —, and the reading of the Tur, which the Taz emends — section 5;
- seif 2: the two parentheses with a reference to the Tur, the first of which the Taz attributes to the Rema; the mound ten high above the courtyard and less than ten below the gallery, near it or four away; and the mound ten high and ten lower than the gallery, near it or four away; the width (Biur Halachah) — section 6; for the case-by-case synthesis, see the table in section 5 of Level 3;
- the cistern, which the seif does not write: among others the Gemara (84a), the Rambam, the Beis Yosef; the shared cistern surrounded by a rim ten high and close to the gallery: without a joint eruv, drawing from it with a bucket that rested in the houses is forbidden to both, because its use is difficult for both; full of water up to the rim, it is forbidden too, by a preventive decree (Mishnah Berurah, ס״ק י״א) — section 7;
- seif 3: the matzeivah of four tefachim; the dakah of the Gemara (59b-60a); the question of the Beis Yosef and the Biur Halachah; height or width — section 8;
- seif 4: the ledges; the in-between forbidden, according to Rav (Beis Yosef); the conditions of the Mishnah Berurah (ס״ק י״ד, ט״ו) — section 9.
