📜 The text of the Shulchan Aruch — 4 seifim
summary: the siman's heading, then seif א. A cistern between two courtyards with no opening or window between them through which they could make an eruv, or with one, but they did not make the eruv: one does not draw from it on Shabbos unless a partition of ten [tefachim] was made above the water, a tefach of which goes down into the water; if the partition is entirely in the water, a tefach of it must come out above the water, so that the domain of the one is distinguished from the domain of the other; likewise, with a beam four tefachim wide over the mouth of the cistern, one draws on the side of the beam and the other on the other side. The Rema's gloss: this only if he comes to draw with utensils of the house; with utensils of the courtyard no remedy is needed, since the courtyards are one domain, as in siman 372 (Hagahos Maimoniyos).
summary: a well in the middle of the path, between two courtyard walls: although it is four tefachim away from each wall, both draw from it, and they do not need projections (zizin) over it, for one does not forbid to his fellow by way of the air. The Rema's gloss: this only when the courtyards open onto the path by windows alone (Tur, and the Maggid Mishneh); and some say that if they are not four [tefachim] away, they forbid even in this case (Beis Yosef in the name of Rashi).
summary: two courtyards, and three ruins between them: each is permitted in the one next to him, to use it through the windows, by throwing; the middle one is permitted to both. If all three were adjacent to the houses, the middle one facing the two, like the three heads of a kankan, each is permitted in the ruin next to him, and the third, which is near both courtyards, is forbidden to both.
summary: a privy between the two houses, whose [residents] did not make an eruv together: the domain of both prevails over it, and they are forbidden. In small print, in parentheses, without the word הגה: and see above, siman 355.
1. The Mishnah and the Gemara — the partition, below or above (seif א)
The Beis Yosef gives the source of this passage of the Tur: « משנה בפרק כיצד משתתפין » (בית יוסף או״ח שע״ו). Rabban Shimon ben Gamliel reports there a dispute between the two schools: « רַבָּן שִׁמְעוֹן בֶּן גַּמְלִיאֵל אוֹמֵר: בֵּית שַׁמַּאי אוֹמְרִים מִלְּמַטָּה, וּבֵית הִלֵּל אוֹמְרִים מִלְּמַעְלָה » (עירובין פ״ו ע״א).
The Gemara reports two readings of these two words. Rav Huna: « אָמַר רַב הוּנָא: לְמַטָּה — לְמַטָּה מַמָּשׁ, לְמַעְלָה — לְמַעְלָה מַמָּשׁ, וְזֶה וָזֶה בְּבוֹר » (עירובין פ״ו ע״א). Rav Yehudah: « וְרַב יְהוּדָה אָמַר: לְמַטָּה — לְמַטָּה מִן הַמַּיִם, לְמַעְלָה — לְמַעְלָה מִן הַמַּיִם » (עירובין פ״ו ע״א).
Rav Huna or Rav Yehudah? The Beis Yosef lists the Rishonim: « ופסקו ר״ח והתוספות והרי״ף והרא״ש כרב יהודה וכ״ד הרמב״ם בפ״ג מה״ע וכ״כ סמ״ג ורש״י פסק כרב הונא וכן דעת הראב״ד והרז״ה » (בית יוסף או״ח שע״ו) — Rabbeinu Chananel, Tosafos, the Rif and the Rosh rule like Rav Yehudah, this is the view of the Rambam, and the Smag writes so; Rashi rules like Rav Huna, and this is the view of the Raavad and the Razah. He concludes: « וכיון דהרי״ף והרמב״ם והרא״ש מסכימים לדעת אחת הכי נקטינן » (בית יוסף או״ח שע״ו).
The Tur reports Rashi's view: « ולרש״י שרי אפילו המחיצה למעלה בפי הבור בתוכו » (טור או״ח שע״ו), and the Beis Yosef specifies that these words refer to the partition, not to the beam: « לאו אקורה קאי אלא ארישא קאי והוא אשר כתבתי דרש״י פסק כרב הונא » (בית יוסף או״ח שע״ו).
A partition of ten, placed at the top of the cistern, inside its rim, that does not reach the water. According to Rashi, who rules like Rav Huna, it suffices — this is what the Tur reports in his name. According to Rav Yehudah, followed notably by the Rif, the Rambam and the Rosh, a tefach of the partition must go down into the water: this is what seif א writes.
The Biur Halachah notes, on the opening words of the seif: « אפילו אין מימיו עמוקין י׳ טפחים » (ביאור הלכה שע״ו) — and he refers to the תו״ש.
2. The courtyard wall, and a partition made for the purpose (seif א)
The Mishnah also reports the view of Rabbi Yehudah: « אָמַר רַבִּי יְהוּדָה: לֹא תְּהֵא מְחִיצָה גְּדוֹלָה מִן הַכּוֹתֶל שֶׁבֵּינֵיהֶם » (עירובין פ״ו ע״א). Rashi says which wall is meant: « שמפסקת בין החצירות ומפסקת על פני הבור ואע״פ שאינה נכנסת לתוך אוגנו » (רש״י עירובין פ״ו ע״א) — the wall that separates the courtyards and passes over the cistern, although it does not enter inside its rim.
The Tur writes, following Rashi's view: « ובלבד שתהא עשויה לכך להתיר למלאות » (טור או״ח שע״ו), and the Beis Yosef: « הוא לאפוקי מר״י דאמר שם באותה משנה לא תהא מחיצה גדולה מן הכותל שביניהם » (בית יוסף או״ח שע״ו); he then bases this exclusion on a rule of the Gemara, at the end of chapter חלון (Eruvin 81b).
יסוד — Rashi, on the words מתוך אוגנו in the Mishnah, explains why a partition that does not reach the water can suffice, and on what condition: « אע״פ שאינה נוגעת במים קל הוא שהקילו חכמים במים דאמר ביה גוד אחית למחיצה ובלבד שתהא בתוך אוגן הבור שתראה כהפסקה » (רש״י עירובין פ״ו ע״א) — one says of the partition gud achis [that it extends downward], provided it is inside the rim of the cistern, so that it is seen as a separation.
The Mishnah Berurah: « ומחיצת הכותל שעומד ע״ג הבור אין מועיל לזה כלל דבעינן דוקא שתהא עשויה לשם כך ובתוך אוגן הבור » (משנה ברורה שע״ו ס״ק ג). The Shulchan Aruch HaRav also writes gud achis, and its reason: « הוֹאִיל וְיֵשׁ בָּהּ הֶכֵּר וְזִכָּרוֹן שֶׁלֹּא יָבֹאוּ לְטַלְטֵל מֵחָצֵר לְחָצֵר בְּמָקוֹם אַחֵר שֶׁלֹּא בִּמְקוֹם מִלּוּי מַיִם » (שו״ע הרב שע״ו:א); and of the wall: « אֲבָל כֹּתֶל הֶחָצֵר שֶׁמְּהַלֵּךְ עַל גַּבֵּי הַבּוֹר אֵינוֹ נִדּוֹן מִשּׁוּם מְחִצָּה, לְפִי שֶׁאֵין בּוֹ הֶכֵּר כְּלָל, הוֹאִיל וְלֹא נַעֲשָׂה בִּשְׁבִיל כָּךְ » (שו״ע הרב שע״ו:א); see Level 4, point א.
3. A tefach in the water, a tefach above it — separation or sign? (seif א)
On Rav Yehudah's explanation, the Gemara twice objects that the water mixes. For the partition planted in the bottom: « לְמַטָּה מִן הַמַּיִם נָמֵי, הָא עֲרִיבִי מַיָּא » (עירובין פ״ו ע״א) — and it answers with a statement of Rav Yehudah in the name of Rav: « צָרִיךְ שֶׁיֵּרָאוּ רֹאשָׁן שֶׁל קָנִים לְמַעְלָה מִן הַמַּיִם טֶפַח » (עירובין פ״ו ע״א). For the partition above the water: « לְמַעְלָה מִן הַמַּיִם נָמֵי, הָא עֲרִיבִי מַיָּא » (עירובין פ״ו ע״א) — and it answers with what Yaakov Karchina'a taught: « צָרִיךְ שֶׁיְּשַׁקַּע רָאשֵׁי קָנִים בַּמַּיִם טֶפַח » (עירובין פ״ו ע״א).
Seif א writes both cases, in the Rambam's order: first the partition above the water, a tefach of which goes down into the water, then « ואם הית׳ המחיצ׳ כולה בתוך המים צריך שיהי׳ טפח יוצא ממנה למעלה מן המים כדי שתהי׳ ניכרת רשות זה מרשות זה » (שו״ע או״ח שע״ו:א).
חקירה — must the partition in the water separate the waters, or only mark the separation? Rashi, on Yaakov Karchina'a's statement: « ובהא פליגי דבית שמאי בעו מחיצה המפסקת עד התהום וב״ה בעו היכר מחיצה » (רש״י עירובין פ״ו ע״א) — Beis Shammai require a partition that separates down to the bottom, Beis Hillel a sign of a partition.
The Mishnah Berurah speaks of a leniency granted for water: « קל הוא שהקילו במים להתיר במחיצה כזו דבעינן רק שלא יכנס הדלי בהדיא לחלק חבירו » (משנה ברורה שע״ו ס״ק ד). The Shulchan Aruch HaRav writes it in these words: « שֶׁקַּל הוּא שֶׁהֵקֵלּוּ חֲכָמִים בְּמַיִם שֶׁלֹּא לְהַצְרִיךְ בָּהֶם מְחִצָּה גְמוּרָה לְהַבְדִּיל בֵּין מַיִם לְמַיִם לְגַמְרֵי, אֶלָּא שֶׁיְּהֵא נִרְאֶה כְּמֻבְדָּלִים » (שו״ע הרב שע״ו:א).
The case the Tur does not mention. The Tur writes only the partition above the water, a tefach of which is sunk into the water. The Beis Yosef writes that this is what emerges from the Rif and from Rabbi Meir, whom the Rosh reports, and that it is the view of the Rambam — a partition entirely in the water also suffices, if a tefach of it comes out —, and he adds: « ולא ידעתי למה השמיטו רבינו » (בית יוסף או״ח שע״ו).
The Taz: « ונ״ל דהוא מסופק דשמא הלכה כרב הונא דאוסר בזה כמ״ש ב״י בשם רש״י והראב״ד והרז״ה » (ט״ז או״ח שע״ו ס״ק א) — it seems to him that the Tur is in doubt: perhaps the halachah follows Rav Huna, who forbids in this case; « ע״כ לא נקט אלא מאי דשרי לתרוייהו דהיינו למעל׳ מהמים סמוך למים » (ט״ז או״ח שע״ו ס״ק א) — therefore he wrote only what is permitted according to both.
4. The beam four tefachim wide — the bucket and the edge of the roof (seif א)
The Gemara reports, from Rav Nachman in the name of Rabbah bar Avuha: « קוֹרָה אַרְבָּעָה מַתֶּרֶת בְּמַיִם » (עירובין פ״ו ע״ב). Then the objection, and the answer: « הָא קָא אָזֵיל דְּלִי לְאִידַּךְ גִּיסָא, וּמַיְיתֵי? Rashi, on this answer: « וליתא לדרב יהודה אלא כדרב הונא דב״ה למעלה ממש קאמרי » (רש״י עירובין פ״ו ע״ב) — Rav Yehudah's view does not stand; rather [one follows] Rav Huna: Beis Hillel speak of [a partition] really at the top. This is what the Beis Yosef reports: Rashi rules like Rav Huna (section 1).
חקירה — does the beam make a partition, or is it enough that the bucket does not go beyond it? The Beis Yosef gives the reason: « וטעמא לפי שאנו רואים כאילו קורה זו מחיצה שנמשכה ירדה עד המים וחלק כל רשות לעצמו » (בית יוסף או״ח שע״ו). He then reports, from the Maggid Mishneh in the name of the Rashba: « ויראה לי שהמחיצה י׳ בזמן שהיא רחבה ד׳ מותרת לד״ה משום שאין הכלי הולך יותר מד״ט ולפיכך מותר אע״פ שא״א במחיצה פי תקרה יורד וסותם » (בית יוסף או״ח שע״ו) — it seems to him that a partition of ten that is four wide is permitted according to all, because the utensil does not go beyond four tefachim, even though one does not say, of a partition, pi tikrah yored vesosem.
The Magen Avraham: « דלא אזיל דלי יותר מד׳ ואף על גב דעירבו מיא תחת הקורה קל הוא שהקילו חכמים במים » (מגן אברהם שע״ו ס״ק ב). The Mishnah Berurah, in ס״ק ט, writes both reasons, and so does the Shulchan Aruch HaRav: « וּכְאִלּוּ פִּי הַתִּקְרָה הוּא מְחִצָּה יוֹרֶדֶת עַד קַרְקָעִית הַבּוֹר » (שו״ע הרב שע״ו:א), then « לְפִי שֶׁשִּׁעֲרוּ חֲכָמִים שֶׁאֵין דְּלִי מְהַלֵּךְ יוֹתֵר מִד׳ טְפָחִים » (שו״ע הרב שע״ו:א).
A partition four tefachim thick, and a beam outside the rim. On the beam's position, he notes that the words of the seif come from the Rambam, and reports other views: « ובעבודת הקודש ראיתי שכתב אם הקורה בתוך אוגן הבור וכן ג״כ דעת רבינו ירוחם בנתיב י״ב חלק י״ז עי״ש וצ״ע למעשה » (ביאור הלכה שע״ו) — he leaves the question open for practice.
Why fear the bucket here, and not for the balcony (siman 355)?
The Beis Yosef proposes: « ונראה דשאני גזוזטרא דכי אזיל דלי לבראי לא אזיל לרשות אדם אחר » (בית יוסף או״ח שע״ו) — from the balcony, a bucket that goes out does not go into someone else's domain. The Magen Avraham, on the words שתהיה נכרת in the seif, answers differently: « דשאני התם שהוא עומד למעלה ומשלשל דרך הנקב ביושר לא חיישינן שיצא חוץ למחיצה משא״כ כאן דעומד אצל הבור ומשלשל חיישינן שילך באלכסון » (מגן אברהם שע״ו ס״ק א). The Biur Halachah, on the words וצריך שיהיה טפח, refers notably to the Beis Yosef, the Bach and the Magen Avraham, and writes that the Rashba and the Ritva already dealt with much of it in their chiddushim.
5. The utensils of the courtyard — the Rema's gloss (seif א)
The Rema's gloss: « ודוקא אם בא למלאות בכלים של בית אבל בכלים של חצר לא בעינן שום תיקון דהא חצירות רשות אחת הן » (רמ״א או״ח שע״ו:א), with the Hagahos Maimoniyos as its source. The rule of the courtyards to which it refers (siman 372) is found in the Rambam: « כֻּלָּן רְשׁוּת אַחַת הֵן וּמְטַלְטְלִין בְּכֻלָּן בְּלֹא עֵרוּב כֵּלִים שֶׁשָּׁבְתוּ בְּתוֹכָן. אֲבָל לֹא כֵּלִים שֶׁשָּׁבְתוּ בְּתוֹךְ הַבַּיִת אֶלָּא אִם כֵּן עֵרְבוּ » (הלכות עירובין פ״ג הי״ח); and for a utensil that spent Shabbos in the house and was taken out into the courtyard: « וְכֵן אִם שָׁבַת הַכְּלִי בַּבַּיִת וְהוֹצִיאוֹ לֶחָצֵר לֹא יַעֲבִירֶנּוּ לְחָצֵר אַחֶרֶת אוֹ לְגַג אַחֵר אוֹ לְרֹאשׁ הַכֹּתֶל אוֹ לְקַרְפָּף אֶלָּא אִם כֵּן עֵרְבוּ אַנְשֵׁי כָּל הַמְּקוֹמוֹת שֶׁמַּעֲבִירִין בָּהֶן כְּלִי זֶה עֵרוּב אֶחָד » (הלכות עירובין פ״ג ה״כ) — one may not move it into another courtyard, onto another roof, onto the top of the wall or into an enclosure, unless the people of all the places through which this vessel is moved have made a single eruv.
חקירה — what requires the remedy: the utensil one draws with, or the water brought into the house? The Rema speaks only of the utensils. The Magen Avraham adds, following the Hagahos Maimoniyos: « ועכ״פ אסור להכניס המים לבית אם לא עשו תיקון » (מגן אברהם שע״ו ס״ק ג), and the Mishnah Berurah: « ועכ״פ אסור להכניס המים לבית אם לא עשו שום תיקון דהא לא עירבו שתי החצרות ביחד » (משנה ברורה שע״ו ס״ק י).
The Shulchan Aruch HaRav writes both: « וְכָל זֶה לְמַלֹּאת הַמַּיִם וּלְהַכְנִיסָם לַבַּיִת, אוֹ אֲפִלּוּ יִשְׁתַּמֵּשׁ בָּהֶם בֶּחָצֵר אֶלָּא שֶׁדּוֹלֶה בִּדְלִי שֶׁשָּׁבַת בַּבַּיִת » (שו״ע הרב שע״ו:א); and the reason for the permission: « שֶׁהֲרֵי כָּל הַחֲצֵרוֹת רְשׁוּת אֶחָד הֵן לְכֵלִים שֶׁשָּׁבְתוּ בְּתוֹכָן, אַף עַל פִּי שֶׁלֹּא עֵרְבוּ » (שו״ע הרב שע״ו:א); see Level 4, point א.
Three cases. With a bucket that spent Shabbos in the courtyard, to use the water in the courtyard: no remedy (the Rema's gloss; the Rav: toward the courtyards). With the same bucket, to bring the water into the house: the Magen Avraham (ס״ק ג), the Mishnah Berurah (ס״ק י) and the Rav require the remedy. With a bucket that spent Shabbos in the house, even to use the water in the courtyard: the Rema's gloss (בכלים של בית) and the Rav require it.
6. The well in the path — Rav, Shmuel and the way of the air (seif ב)
The case of seif ב is that of a statement Rav Yehudah reports in the name of Shmuel (Beis Yosef): « בּוֹר שֶׁבֵּין שְׁתֵּי חֲצֵירוֹת, מוּפְלֶגֶת מִכּוֹתֶל זֶה אַרְבָּעָה וּמִכּוֹתֶל זֶה אַרְבָּעָה — זֶה מוֹצִיא זִיז כׇּל שֶׁהוּא וּמְמַלֵּא, וְזֶה מוֹצִיא זִיז כׇּל שֶׁהוּא וּמְמַלֵּא » (עירובין פ״ה ע״א); Rav Yehudah himself says: « וְרַב יְהוּדָה דִּידֵיהּ אָמַר: אֲפִילּוּ קַנְיָא » (עירובין פ״ה ע״א) — even a reed [suffices]. Abaye says to Rav Yosef: « הָא דְּרַב יְהוּדָה דִּשְׁמוּאֵל הִיא, דְּאִי דְּרַב, הָא אָמַר: אֵין אָדָם אוֹסֵר עַל חֲבֵירוֹ דֶּרֶךְ אֲוִיר » (עירובין פ״ה ע״א).
The Gemara shows where Shmuel's view is derived from: « טַעְמָא דְּאַפֵּיק, הָא לָא אַפֵּיק — אָמְרִינַן: אָדָם אוֹסֵר עַל חֲבֵירוֹ דֶּרֶךְ אֲוִיר » (עירובין פ״ה ע״א); and, for Rav's view, it cites notably the rule of the three ruins (section 10): « שְׁנֵי בָתִּים וְשָׁלֹשׁ חוֹרָבוֹת בֵּינֵיהֶם » (עירובין פ״ה ע״א).
The Rambam: « וְאֵין צְרִיכִין לְהוֹצִיא זִיזִין עַל גַּבָּהּ שֶׁאֵין אָדָם אוֹסֵר עַל חֲבֵרוֹ דֶּרֶךְ אֲוִיר » (הלכות עירובין פ״ג הכ״ג) — and seif ב takes up his words almost as they are. The Mishnah Berurah: « בא לאפוקי ממ״ד בגמרא דבעינן דוקא שיוציא כ״א זיז כל שהוא מכותלו עד לבור להכירא שלא יבוא לטלטל בעלמא מרשות לרשות » (משנה ברורה שע״ו ס״ק י״ג).
7. Four tefachim, windows or doors — Rashi and the Rambam (the Rema's gloss, seif ב)
Shmuel speaks of a cistern four away from each wall. Rashi describes the case: « הפרודות זו מזו ומפסיק ביניהן כעין מבוי קטן ואין דיורין פתוחין לו » (רש״י עירובין פ״ה ע״א), and explains why the distance: « דאי לאו הכי דמופלג הוי תשמישו בנחת והוי כמו שהבור חציה בחצר זו וחציה בחצר זו שרשות שניהן שולטת בה » (רש״י עירובין פ״ה ע״א).
"Four away": a condition, or a fortiori? The Beis Yosef cites the Rambam's words, and draws from them: « ולפ״ז מופלג דנקט שמואל אינו בדוקא כפירש״י אלא לרבותא נקט מופלגת בד׳ וכ״ש בפחות מכאן » (בית יוסף או״ח שע״ו). He reports from the Maggid Mishneh: « וכתב ה״ה שנראה עוד מדבריו שאע״פ שהחצירות פתוחות לשביל מותר למלאות דרך חלונות » (בית יוסף או״ח שע״ו); and, in the name of the Rashba: « וכתב בשם הרשב״א דלרש״י האי מימרא בשאין חצירות פתוחות לשביל בדוקא היא שאם היו פתוחות כל שלא עירבו שניהם אסורים בו » (בית יוסף או״ח שע״ו).
Seif ב writes the Rambam's words. The Magen Avraham, on the words The Rema's gloss writes the two limits that the Rashba and the Beis Yosef report in Rashi's name: windows alone (sources: the Tur and the Maggid Mishneh), then, in the form וי״א, the distance of four (source: the Beis Yosef in the name of Rashi). The Magen Avraham, on the word
The Tur writes the case as Rashi does: « ואם אין הבור קרוב להם אלא רחוק מכל אחד ד׳ טפחים כגון שיש שביל קטן בין שתי החצירות והבור בתוכו ואין דיורין פתוחין לו אלא ממלאין דרך חלונות הפתוחין לו מב׳ החצירות » (טור או״ח שע״ו) — and he permits, since one does not forbid by way of the air; the Beis Yosef says so: « שתשמיש בני החצירות בבור אינו אלא דרך אויר לדעת רש״י שסתם רבינו דבריו לדעתו » (בית יוסף או״ח שע״ו).
חקירה — what is "the way of the air": the window, or the distance? For the view in the seif, the Mishnah Berurah: « והטעם דתשמיש שהוא דרך חלון ס״ל לדעה זו דתמיד מיקרי דרך אויר בין כשהוא מופלג ד״ט ובין פחות מד״ט » (משנה ברורה שע״ו ס״ק י״ב). For the view the Rema reports: « דעה זו ס״ל להיפוך מדעה קמייתא דאין להתיר רק דוקא כשהבור מופלג מן כותלי החצרות ד״ט דאז מקרי התשמיש דרך אויר אבל כשהוא פחות מד״ט לשניהם לא מקרי דרך אויר אלא חשיב התשמיש לשניהם בנחת ואוסרין זה ע״ז אפילו אם אין פתחים להחצרות ותשמישן הוא רק דרך חלונות שבכותל ופסקו האחרונים כדעה זו » (משנה ברורה שע״ו ס״ק ט״ו).
The Taz gives Rashi's reading: « דלא אמרו אין אדם אוסר דרך אויר אלא דוקא בתרתי לריעות׳ דהיינו באינו יכול להשתמש אלא דרך זריק׳ או שלשול כזה בבאר ועוד ריעותא דבעי׳ שיהיה מופלג מן רשותו ד״ט » (ט״ז או״ח שע״ו ס״ק ג) — two drawbacks together: a use made only by throwing or lowering [the bucket], and the distance of four tefachim. The Biur Halachah: « עיין מ״ב דהסכמת הפוסקים הוא כדעת ההגה״ה דהוא דוקא במופלג ד׳ » (ביאור הלכה שע״ו).
A well less than four tefachim from the walls, drawn from through the windows. According to the view in the seif, as read by the Magen Avraham (ס״ק ד) and the Mishnah Berurah (ס״ק י״ב), it is permitted all the more so. According to the view the Rema reports next, it is forbidden; the Mishnah Berurah writes that the Acharonim ruled so (ס״ק ט״ו). A well, when the courtyards have doors onto the path. According to the Magen Avraham, the view in the seif permits (ס״ק ד) — he writes it right after what he says of a well less than four tefachim away, and this page does not decide whether he says it at four as well; the Rema's gloss forbids, and the Magen Avraham explains: the path is then like a courtyard without an eruv (ס״ק ה). The Shulchan Aruch HaRav states the permission for a cistern « רָחוֹק מִכָּל אֶחָד ד׳ טְפָחִים » (שו״ע הרב שע״ו:ב), in the Tur's words, and writes for doors: « אֲבָל אִם חֲצֵרוֹת פְּתוּחוֹת לַשְּׁבִיל — רְשׁוּת שְׁנֵיהֶם שׁוֹלֶטֶת בּוֹ וַהֲרֵי הוּא כְּחָצֵר שֶׁל שְׁנֵיהֶם, וַאֲסוּרִים בּוֹ עַד שֶׁיְּעָרְבוּ » (שו״ע הרב שע״ו:ב); the case of a closer cistern, his seif 2 does not write (Level 4, point ב).
8. The question raised from siman 375 — the Taz and the Biur Halachah (seif ב)
The mound in the courtyard. The Taz, on the words שאין אדם אוסר על חבירו דרך אויר, asks: « למה פסק הרמב״ם בסי׳ שע״ה ס״ג גבי תל שבחצר שבעל החצר אוסר על בעל המרפס׳ בגבוה י׳ והלא אין תשמישו על התל אלא בזריקה והיינו דרך אויר » (ט״ז או״ח שע״ו ס״ק ב) — why was it ruled, in siman 375, seif ג [so numbered by the Taz; in the Shulchan Aruch, the case of the mound is in seif ב of siman 375, and seif ג there deals with the pillar], regarding a mound in the courtyard, that the owner of the courtyard forbids to the owner of the balcony, at a height of ten? His use of the mound is only by throwing, which is the way of the air. The Biur Halachah reports the same difficulty: « והאחרונים הקשו מהא דסימן שע״ה דבני מרפסת אוסרין על בני חצר אף במופלג ד׳ » (ביאור הלכה שע״ו) — the people of the balcony forbid to the people of the courtyard, even at a distance of four. In seif ב of siman 375, when the mound, ten high, is four away from the balcony, the Shulchan Aruch writes: « לפיכך שניהם אסורים להוציא שם כלים ששבתו בבתים עד שיערבו » (שו״ע או״ח שע״ה:ב) — both are forbidden there; the Taz speaks of the prohibition the owner of the courtyard causes the owner of the balcony, the Biur Halachah of the one the people of the balcony cause the people of the courtyard.
The Taz answers first: « וצ״ל דלא אמרו האי מילתא אלא במים שאין שם תשמיש רק מילוי מים וכן בחורבה דאמרי׳ בגמ׳ שאין אדם אוסר דרך אויר כמ״ש בסמוך שם ג״כ אין דרך להשתמש בחורבה אבל בתל שבחצ׳ דרך להשתמש שם בתשמיש קבוע » (ט״ז או״ח שע״ו ס״ק ב) — this was said only of water, whose only use is drawing, and of the ruin; but the mound in the courtyard has a fixed use. In ס״ק ג, he writes that according to Rashi the difficulty does not arise: « ולפ״ז לק״מ במ״ש בסמו׳ להרמב״ם מדין התל שבחצר דלרש״י שהוא כשיטת הטור לא תמצא שם תרתי לריעותא » (ט״ז או״ח שע״ו ס״ק ג) — according to Rashi, which is the Tur's approach, the two drawbacks together are not found there (section 7). He then reports the answer of his father-in-law, the Bach: « ותי׳ דדוקא גבי בור וחורבה דאין שם תשמיש כלל בחול אלא ע״י זריקה משך ד״ט דרך אויר אמרו אין אדם אוסר דרך אויר » (ט״ז או״ח שע״ו ס״ק ג), and at once writes: « ובסמוך יתבאר דרש״י לא כ״כ והקושיא מעיקרא ליתא כמ״ש לדעת רש״י » (ט״ז או״ח שע״ו ס״ק ג) — it will be explained below that Rashi does not write so, and the difficulty does not arise in the first place, as he wrote according to Rashi.
The Biur Halachah reports the Rashba's answer: « וראיתי שכבר הקשה זה בחידושי הרשב״א בנדפס מחדש ותירץ דהתם כשעשו התל בשותפות ובחול משתמשין בו שניהם דרך החצר הלכך לאו תשמיש אויר לחוד הוא » (ביאור הלכה שע״ו) — and adds that the Bach arrived at the same idea on his own.
The Shulchan Aruch HaRav does not raise the question; he writes, in his seif 2, that this drawing through the air « וְאֵינוֹ כְּדַאי לֶאֱסוֹר עַל חֲבֵרוֹ אֶלָּא אִם כֵּן הוּא בְּתוֹךְ עֲשָׂרָה, עַיֵּן סִמָּן שע״ה » (שו״ע הרב שע״ו:ב), and he places a condition on the permission: « אִם יֵשׁ מִן הַחַלּוֹנוֹת לְמַיִם י׳ טְפָחִים, שֶׁתַּשְׁמִישׁ מִלּוּי זֶה הוּא תַּשְׁמִישׁ בְּקֹשִׁי » (שו״ע הרב שע״ו:ב). This condition is neither in the Mechaber's seif nor in the Rema's gloss; the Rav himself refers to siman 375, where, in seif ב, additions in parentheses, in the name of the Tur, write for the mound « ובתוך עשרה למרפסת » (שו״ע או״ח שע״ה:ב); this page does not say it is the same condition, nor how the Rav answers the Acharonim's difficulty (Level 4, point ב).
9. The curb ten high, and the path that is not a private domain (seif ב)
The Beis Yosef reports from Tosafos Ri's explanation of Shmuel's case, in two ways.
Why these two ways? The Beis Yosef explains: «
The Beis Yosef continues, citing Rashi: « אבל רש״י כתב דלא דמי לההיא דב׳ בתים וג׳ חורבות ביניהם דאילו חורבה משתמשים בה נמי בסמוך אבל הכא במבוי ליכא שום תשמי׳ אלא מילוי והוא ע״י הפלגת אויר ד׳ » (בית יוסף או״ח שע״ו) — in the path there is no use but drawing, and it is done across four tefachim of air.
The curb ten high. The Raavad, in his hasagos on the Rambam (Hilchos Eruvin 3:23), places a condition on this halachah: that the curb of the cistern be ten tefachim high; then the air of the public domain does not forbid it, nor does his fellow's domain, by way of the air; without it, one does not draw; and he refers to the Mishnah in chapter המוצא תפילין. The Maggid Mishneh wonders at this: in his view, the Rambam deals here with the prohibition the owners impose on one another, and he set out what depends on the nature of the domains in chapter 15 of Hilchos Shabbos.
The Shulchan Aruch HaRav distinguishes: « בַּמֶּה דְּבָרִים אֲמוּרִים? These texts are read side by side: the Raavad requires the curb without distinguishing, Ri's second way places the case in a path that is a public domain or a karmelis, where the cistern's walls are ten high, and the Rav requires the curb only for a path that is a karmelis. This page does not say where the Rav draws his distinction from.
10. The three ruins — in a row, or כחצובה (seif ג)
The Gemara reports, from Rav Nachman in the name of Rabbah bar Avuha in the name of Rav: « שְׁנֵי בָתִּים וְשָׁלֹשׁ חוֹרָבוֹת בֵּינֵיהֶם. Rashi describes the ruins: « מחיצות פרוצות זו לזו ואין בהן דיורין ואין להן בעלים אלא בני הבתים האלו ויש חלונות בבתים פתוחין לחורבה » (רש״י עירובין פ״ה ע״א).
Rabbi Eliezer's objection. He asks Rav: « וְהָא מָר הוּא דְּאָמַר: לָזֶה בְּשִׁלְשׁוּל וְלָזֶה בִּזְרִיקָה — שְׁנֵיהֶן אֲסוּרִין » (עירובין פ״ה ע״ב). Rashi: « אלמא אף על גב דשלשול נוח מזריקה הואיל דאינו ממש לאחד מהן כפתח לא שרינן ליה לחד מינייהו » (רש״י עירובין פ״ה ע״ב) — although lowering [an object] is more convenient than throwing, since it is not truly like a door for either of them, we do not permit it to either of them.
לָא — דְּקָיְימִי כַּחֲצוּבָה » (עירובין פ״ה ע״ב) — do you think they stand in a row? No: they stand כחצובה. Rashi, on the row: « זו אצל זו שתהא החיצונה מפסקת בין הבית ולאמצעי » (רש״י עירובין פ״ה ע״ב) — one next to the other, the outer one separating the house from the middle one; and on כחצובה: « ושלשתן סמוכין לבתים האמצעי כנגד השתים כשלשה רגלי הקנקן הלכך הסמוכין מותרין דאין אדם אוסר על חברו דרך אויר והאמצעי אסור דשניהן משתמשין בה בשלשול ורשות שניהם היא » (רש״י עירובין פ״ה ע״ב) — all three adjacent to the houses, the middle one facing the two, like the three legs of a kankan; therefore the adjacent ones are permitted, for one does not forbid to his fellow by way of the air, and the middle one is forbidden, for both use it by lowering [objects], and it is the domain of both. He adds: « ואף על גב דשתים הסמוכות פרוצות לאמצעי האוסר לא אחמור רבנן במקום שאין לו תשמיש גמור שיהא אסור משום פרוץ » (רש״י עירובין פ״ה ע״ב) — the Mishnah Berurah copies this (ס״ק כ״ב).
יסוד — seif ג first writes the case in which the middle ruin is permitted to both; the Beis Yosef explains it as the row: « וכי קיימי כשורה זו אצל זו שהחיצונה מפסקת בין הבית לאמצעי ושניהם אין משתמשין בה אלא דרך אויר שניהם מותרים בה דאינם אוסרים זה על זה דרך אויר » (בית יוסף או״ח שע״ו). Arranged « כשלשה ראשי קנקן » (שו״ע או״ח שע״ו:ג), the third, near both courtyards, is forbidden to both. The Magen Avraham gives the reason for each: « כיון דאין ב׳ החצירות משתמשות בו אלא דרך אויר זריקה » (מגן אברהם שע״ו ס״ק ז); « כיון דמשתמשין בחורבה ע״י שלשול מה שאין כן בס״ב דהוי דרך אויר » (מגן אברהם שע״ו ס״ק ח).
The texts do not all have the same word: the Rashi that Sefaria serves writes « כשלשה רגלי הקנקן » (רש״י עירובין פ״ה ע״ב), the Beis Yosef cites him as « כג׳ ראשי קנקן » (בית יוסף או״ח שע״ו), the seif writes « כשלשה ראשי קנקן » (שו״ע או״ח שע״ו:ג), and the Shulchan Aruch HaRav « כְּג׳ רַגְלֵי הַקַּנְקַן » (שו״ע הרב שע״ו:ג); the Gemara says « כַּחֲצוּבָה » (עירובין פ״ה ע״ב). The Taz, in ס״ק ה, reports the difficulty Rashi raises from the well of seif ב, and his answer: the ruin serves many uses, near and far, the well only for drawing (section 9).
11. Ruins that have owners (seif ג)
Rashi writes that the ruins have no owners other than the people of the houses (section 10). The Beis Yosef reports the Rosh's reaction: « ועל מה שפירש״י שאין לחורבות בעלים אלא בעלי בתים הללו כתב הרא״ש משמע דס״ל דאם יש להם בעלים אוסרין אותם הבעלים על בעלי בתים אע״פ שאין לבעלים דיורים בחורבה וקשה דהא קי״ל דירה בלא בעלים לא שמה דירה » (בית יוסף או״ח שע״ו).
חקירה — a dwelling without its owner does not forbid others; but may one carry inside it? The Rosh proposes, for Rashi: « ונראה דרש״י סובר דנהי שאינה אוסרת את החצר ואת המבוי שהיא פתוחה להם בתוכה מיהו אסור לטלטל » (בית יוסף או״ח שע״ו); and he concludes: « וקשה לעשות דירה בלא בעלים דירה לחצאין הלכך נראה דאינה אוסרת כלום » (בית יוסף או״ח שע״ו). The Beis Yosef: « ורבינו סתם דבריו כדעת הרא״ש » (בית יוסף או״ח שע״ו) — and the Tur indeed writes: « ואפי׳ יש לחורבות בעלים אינן אוסרים כיון שאין דרים בהם » (טור או״ח שע״ו).
The Biur Halachah sets out the views. On one side: « הנה דעת רש״י דדוקא כשאין להחורבות בעלים אחרים אלא בעלי החצרות שותפין בהן » (ביאור הלכה שע״ו), and « וכן הוא ג״כ דעת בעל המאור ובחידושי הרשב״א הביא שכן הוא ג״כ דעת הראב״ד » (ביאור הלכה שע״ו). On the other: « אבל בתוספות הביאו בשם ר״י שחולק על רש״י וס״ל דאפילו יש להן בעלים ג״כ מותר לפי שאינה בית דירה » (ביאור הלכה שע״ו); this is also, he writes, the view of the Rosh and the Rashba, and the Tur ruled so.
The Shulchan Aruch HaRav, at the end of his seif 3: « וְחֻרְבּוֹת אֵלּוּ, אַף עַל פִּי שֶׁיֵּשׁ לָהֶם בְּעָלִים, מֻתָּרִים בְּנֵי חֲצֵרוֹת הַסְּמוּכוֹת לָהֶן לְהִשְׁתַּמֵּשׁ בָּהֶן וְאֵין הַבְּעָלִים אוֹסְרִים עֲלֵיהֶן, הוֹאִיל וְאֵינָן דָּרִים בָּהֶם, וְדִירָה בְּלֹא בְעָלִים אֵינָהּ אוֹסֶרֶת » (שו״ע הרב שע״ו:ג); see Level 4, point ג.
Ruins belonging to others, who do not live in them. According to Rashi — and, according to the Biur Halachah, the Baal HaMaor and the Raavad — one does not use them; according to Ri in Tosafos, the Rosh, the Rashba and the Tur, one uses them; the Biur Halachah writes that the Levush ruled so explicitly, and the Rav likewise, and that the Mechaber perhaps said so by his silence.
12. The privy between two houses (seif ד)
The Beis Yosef gives the source of seif ד, the Hagahos Maimoniyos: « כתוב בהגהות פט״ו מה״ש בית הכסא שבין שני בתים אם יש ביניהם פתח שיכולין לערב יחד מערבין ומותרים בו ואם לאו רשות שניהם שולטת בו ואסורין » (בית יוסף או״ח שע״ו), and gives the reason: « וטעמא משום דדמי לבור שבין ב׳ חצירות ואין מחיצה תלויה מועלת בבית הכסא כמו בבור דאין מחיצה תלויה מתרת אלא במים » (בית יוסף או״ח שע״ו). The rule he invokes is Rav's answer to Rabbi Tavla, in the Gemara: « אֵין מְחִיצָה תְּלוּיָה מַתֶּרֶת אֶלָּא בְּמַיִם, קַל הוּא שֶׁהֵקֵילּוּ חֲכָמִים בַּמַּיִם » (עירובין פ״ו ע״ב).
A view that permits. The Beis Yosef continues: « וכ״כ המרדכי בפרק הזורק אך כתב שה״ר יעקב מקינון מתיר משום דצואה מקום פטור הוא » (בית יוסף או״ח שע״ו) — the Mordechai writes the same, but reports that Rabbi Yaakov of Chinon permits, because excrement is a makom petur. Seif ד writes the prohibition without reporting this view.
חקירה — what is forbidden? The Magen Avraham: « דדמי לכלים ששבתו בבית » (מגן אברהם שע״ו ס״ק ט). The Shulchan Aruch HaRav writes the condition: « אִם הוּא שֶׁל שְׁנֵיהֶם בְּשֻׁתָּפוּת וְלֹא עֵרְבוּ יַחַד — אֲסוּרִים לִפָּנוֹת לוֹ לְכַתְּחִלָּה בְּשַׁבָּת » (שו״ע הרב שע״ו:ד), and the Magen Avraham's reason: « וְהַצּוֹאָה הִיא כְּכֵלִים שֶׁשָּׁבְתוּ בַּבַּיִת, וְאָסוּר לְהוֹצִיאָם אֲפִלּוּ מֵחָצֵר לְחָצֵר » (שו״ע הרב שע״ו:ד). He writes the condition of partnership without distinguishing between the seat and the pit; this page does not decide how these texts fit together (Level 4, point ד).
The prohibition lechatchilah and the remedy, which the Rav's seif 4 writes, are already found there. On the remedy, the Mishnah Berurah writes: « היינו תיקון דדף או קנה. The Rav too compares the place to a courtyard, but to derive the prohibition from it: « לְפִי שֶׁהוּא כְּחָצֵר שֶׁל שְׁנֵיהֶם » (שו״ע הרב שע״ו:ד); in the Rema, « כמו חצר שאינה מעורבת » (רמ״א או״ח שנ״ה:ג) comes after « דאז שרי » (רמ״א או״ח שנ״ה:ג), once the remedy has been made, and the Mishnah Berurah writes on the reference that follows: « דשם מבואר דבחצר שאינה מעורבת לכו״ע מותר כחו » (משנה ברורה שנ״ה ס״ק ל״ו); in Siman 355, the Rav himself writes of this case « אִם לֹא עַל יְדֵי דַף וְקָנֶה » (שו״ע הרב שנ״ה:י״ב) (Level 4, point ד).
For one who forgot to make the eruv, the Mishnah Berurah: « דאם שכח ולא עירב בדיעבד מותר לפנות דגדול כבוד הבריות » (משנה ברורה שע״ו ס״ק כ״ד); the Rav's seif 4 writes « לְכַתְּחִלָּה » (שו״ע הרב שע״ו:ד), and does not say what the rule is after the fact; the Rav writes it in Siman 355, in the seif that follows the one cited above: « וְכָל זֶה לְכַתְּחִלָּה. אֲבָל בְּדִיעֲבַד, שֶׁשָּׁכְחוּ וְלֹא עֵרְבוּ — מֻתָּר מִשּׁוּם כְּבוֹד הַבְּרִיּוֹת » (שו״ע הרב שנ״ה:י״ג), as does the Rema's gloss on siman 355 (above).
13. Summary of the shitos and halachic conclusion
The foundation — for water, a leniency was granted: what is required is that the domains be distinguished, and that the bucket not go openly into the other's share (Mishnah Berurah, ס״ק ד and ט); and a use that passes only through the air does not forbid to the other, notably in seifim ב and ג:
- the cistern between two courtyards that cannot make an eruv, or did not: no drawing on Shabbos without a partition of ten [tefachim] above the water, a tefach of which goes down into the water — or, if it is entirely in the water, a tefach of which comes out — (seif א, according to Rav Yehudah, followed notably by the Rif, the Rambam and the Rosh); according to the Mishnah Berurah, a partition made for the purpose, inside the rim; the courtyard wall does not count (ס״ק ג);
- or a beam four tefachim wide over the mouth (seif א) — because it is seen as descending to the water, and a bucket does not go beyond four tefachim (Mishnah Berurah, ס״ק ט; the Rav); the Biur Halachah leaves open, for practice, the question of a beam outside the rim;
- the Rema's gloss: this only with utensils of the house; with those of the courtyard, no remedy (seif א) — but, according to the Magen Avraham and the Mishnah Berurah, one does not bring the water into the house without a remedy (ס״ק ג; ס״ק י), which the Rav also writes;
- the well in the middle of the path, even four tefachim from each wall: both draw from it, without projections (seif ב), like Rav; the Rema's gloss: only if the courtyards open onto the path by windows alone; and some say that if it is not four tefachim away, they forbid even then — the Mishnah Berurah writes that the Acharonim ruled so (ס״ק ט״ו); the Rav writes the permission for a path that is a private domain, when the courtyards have only windows onto it, the cistern being four tefachim from each courtyard and the windows ten tefachim above the water, and, for a path that is a karmelis, requires a rim ten high;
- the three ruins: each uses his own by throwing through the windows, and the middle one is permitted to both — when they stand in a row, explains the Beis Yosef; arranged like the three heads of a kankan, the third, near both courtyards, is forbidden to both (seif ג); for ruins that have other owners, the Biur Halachah reports the dispute of Rashi and Tosafos, and cites notably the Levush and the Rav, who permit;
- the privy between two houses without an eruv: the domain of both prevails over it, and they are forbidden (seif ד) — a suspended partition helps only for water (Beis Yosef); according to the Mishnah Berurah, when only the pit is shared (ס״ק כ״ג), and, for one who forgot to make the eruv, after the fact one may use it (ס״ק כ״ד); the Rav: forbidden lechatchilah, when it belongs to both in partnership, until they make the eruv or a remedy — in Siman 355, the Rav writes for this case a board or a reed, and, for one who forgot to make the eruv, that after the fact it is permitted (seif 13).
