Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has 5 seifim, while the Mechaber's Shulchan Aruch has 4; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.
This page gathers, for Siman 375, the full text of the Rav with its translation, where his text differs from the Mechaber's, and the practical conduct that follows from it.

What are the things situated in the courtyard that do not forbid; it contains 5 seifim:
A long gallery (mirpeses) in front of the upper rooms (aliyos), standing in the courtyard, which one climbs by a ladder; the people of the upper rooms go out onto it through their doors that open onto it, go down from it by the ladder to the courtyard, and pass on to the public domain — this gallery is to the upper rooms as a courtyard is to houses: if they did not make the eruv together, it is forbidden to take out onto it objects that rested on Shabbos (shavsu) in the upper rooms, for the people of the upper rooms forbid it to one another, since it serves them all and they all open onto it, as the houses open onto the courtyard.
But there is no need to make the eruv with the people of the courtyard: for although they eirvu [so the word Sefaria serves; see the note below the text] to the public domain through the courtyard, they do not forbid it to them, since they do not open onto it but only onto the gallery; and an ordinary gallery (stam mirpeses) is ten [tefachim] high, and whatever is ten high is a domain of its own, separated from the domain next to it.
Nevertheless, if they wish to make the eruv with the people of the courtyard, so that they too may take out to the courtyard objects that rested on Shabbos in their upper rooms, they may make the eruv by means of the ladder that goes from the courtyard to the gallery, which is judged as an opening (pesach), as was explained in Siman 372; they are then like two courtyards with an opening between them: if they wish, they make the eruv together, and if they wish, each makes the eruv for itself. And although the ladder has the status (toras) of an opening, the upper rooms are not thereby considered as opening onto the courtyard, because the ladder has the status of an opening only to be lenient — that one may make the eruv together by a ladder between them as by an opening — but not to be stringent.
In what case was it said that the people of the gallery, that is, the people of the upper rooms, do not forbid in the courtyard? When they make the eruv together, so that they are permitted in their gallery: it is then a “foot” (regel) permitted in its place, which does not forbid outside its place, as will be explained in Siman 378. But if they did not make the eruv, since they are forbidden in their gallery, it is a foot forbidden in its place, which forbids outside its place until they make the eruv there, as will be explained there.

If the people of the gallery made the eruv among themselves and did not make the eruv with the people of the courtyard, and there is in the courtyard a mound (tel) or a pillar (amud) that belongs to the people of the courtyard and the people of the gallery in partnership, and both use it on weekdays: if it is ten [tefachim] high from the floor of the courtyard and not ten lower than the gallery, it is given to the people of the gallery — they are permitted to use it on Shabbos with objects that rested on Shabbos in the upper rooms, and not the people of the courtyard with objects that rested on Shabbos in the house — because for them its use is easy (b'nachas), since it is within ten for them, while for the people of the courtyard its use is difficult (b'kasheh): it is not usual to use it in the courtyard except to rest a heavy load on it from the shoulder (l'kasef), and since it is ten high, it is fit for resting a load from the shoulder only with difficulty. And whatever is easy to use for one and difficult for the other is given to the one for whom it is easy.
When is this said? When it is close to the gallery. But if it is four tefachim away from in front of it, since it can be used from the gallery only by throwing through the air across a width of four tefachim, this too is a difficult use; therefore they forbid it to each other, and both are forbidden to use it with objects that rested on Shabbos in the house, until they make the eruv.
And if it is within ten for both, or more than ten for both: if it is four away from in front of the gallery, it is given to the courtyard, for its use is easier for it than for the gallery; and if it is not four away, both are forbidden.
And if it is within ten for the courtyard and more than ten for the gallery, it is given to the courtyard in any case, even if it is not four away from in front of the gallery.

And even if the cistern is full of water up to the height of the rim, close to the gallery, it is forbidden, by a preventive decree (gezeirah) lest the water decrease on Shabbos and they use it as at first. But if the cistern was full of something that may not be taken on Shabbos, it is like a pillar or a mound ten high from the courtyard and within ten for the gallery, which is given to the gallery if it is not four away from in front of it.

Source: Sefaria — Shulchan Arukh HaRav, Orach Chayim 375. Sefaria gives no Kuntres Acharon entry for this siman. The text is copied as Sefaria serves it. In seif א, the vocalized edition of the Shulchan Aruch HaRav served by Sefaria reads « שֶׁאַף שֶׁהֵם עֵרְבוּ לִרְשׁוּת הָרַבִּים דֶּרֶךְ הֶחָצֵר » (שו״ע הרב שע״ה:א), and the unvocalized edition « שאף שהם עירבו לרשות הרבים דרך החצר » (שו״ע הרב שע״ה:א); the vocalized edition places on this word a call to a note of the Kehot editors (note ה), whose text Sefaria does not serve; the beginning of the seif says of the same people « וְעוֹבְרִים לִרְשׁוּת הָרַבִּים » (שו״ע הרב שע״ה:א). The word eirvu is left as it is, and the translation does not correct it: the question of how to read it, and of what note ה of the Kehot editors says, is put to the Rav.
לשון הרב מול סעיף המחבר
Where the Rav's text differs from the Mechaber's seif
Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 4 seifim) and the corresponding seif of the Shulchan Aruch HaRav (its own numbering, 5 seifim), in the order of the Rav's seifim, and notes only what the comparison of the texts shows. The two divisions correspond as follows (seif of the Rav → seif of the Mechaber): 1 → 1; 2 → 2; 3 → no seif of the Mechaber; 4 → 3; 5 → 4. The siman has no gloss of the Rema opened by the word hagah; seif 2 of the Mechaber carries two parentheses in small print, with a reference to the Tur; the first of them the Taz attributes to the Rema (point ב). What is missing from the Mechaber's text is not new for that reason: several of the Rav's details are already found, among others, in Rashi, the Tur, the Beis Yosef, the Magen Avraham or the Taz; each point names, among others, where what the Rav writes is already found. A detail whose source we did not find is not thereby presented as unique to the Rav.
נקודה א — המרפסת, בני העליות ובני החצר (שו״ע הרב שע״ה:א)
Point א — The gallery, the people of the upper rooms and the people of the courtyard (Shulchan Aruch HaRav 375:1)
Why the people of the upper rooms do not forbid the courtyard
What the Mechaber writes: in seif 1 he writes « מרפסת שהוא דרך לעליות הפתוחים לה ועומדת בחצר ועולים לה בסולם ובני העליות יורדים ממנה לחצר ועוברים לרשות הרבים אינם אוסרים על בני החצר דסולם תורת פתח עליו והוי כשתי חצרות ופתח ביניהם » (שו״ע או״ח שע״ה:א), then sets the condition « ובלבד שיערבו כל בני מרפסת לעצמן כדי שתהא רגל המותרת במקומה » (שו״ע או״ח שע״ה:א). The reason he gives for the people of the upper rooms not forbidding the courtyard is the ladder, which has the status of an opening, so that they are like two courtyards with an opening between them.
What the Rav writes: he first writes « הֲרֵי מִרְפֶּסֶת זוֹ לָעֲלִיּוֹת כְּחָצֵר לְבָתִּים » (שו״ע הרב שע״ה:א), and draws from it the rule « וְאִם לֹא עֵרְבוּ יַחַד אֲסוּרִים לְהוֹצִיא לָהּ כֵּלִים שֶׁשָּׁבְתוּ בָּעֲלִיּוֹת, שֶׁבְּנֵי הָעֲלִיּוֹת אוֹסְרִים אוֹתָהּ זֶה עַל זֶה » (שו״ע הרב שע״ה:א). For the courtyard he gives another reason: « הוֹאִיל וְאֵינָן פְּתוּחִים לָהּ אֶלָּא לְמִרְפֶּסֶת, וּסְתָם מִרְפֶּסֶת גָּבוֹהַּ עֲשָׂרָה, וְכָל גָּבוֹהַּ עֲשָׂרָה רְשׁוּת בִּפְנֵי עַצְמוֹ הוּא וּמֻחְלֶקֶת מֵרְשׁוּת שֶׁאֶצְלָהּ » (שו״ע הרב שע״ה:א). With him, the ladder serves only to permit a joint eruv, if they wish: « יְכוֹלִים לְעָרֵב עַל יְדֵי הַסֻּלָּם שֶׁמֵּחָצֵר לְמִרְפֶּסֶת, שֶׁהוּא נִדּוֹן כְּפֶתַח » (שו״ע הרב שע״ה:א); and he sets its limit: « לְפִי שֶׁהַסֻּלָּם אֵין תּוֹרַת פֶּתַח עָלָיו אֶלָּא לְהָקֵל, שֶׁיְּכוֹלִים לְעָרֵב יַחַד עַל יְדֵי סֻלָּם שֶׁבֵּינֵיהֶן כְּמוֹ עַל יְדֵי פֶּתַח, אֲבָל לֹא לְהַחֲמִיר » (שו״ע הרב שע״ה:א). He ends with the condition « אֲבָל אִם לֹא עֵרְבוּ, כֵּיוָן שֶׁהֵם אֲסוּרִים בְּמִרְפֶּסֶת שֶׁלָּהֶם — הֲרֵי זֶה רֶגֶל הָאֲסוּרָה בִּמְקוֹמָהּ וְאוֹסֶרֶת שֶׁלֹּא בִמְקוֹמָהּ » (שו״ע הרב שע״ה:א), and refers to Siman 378, « כְּמוֹ שֶׁיִּתְבָּאֵר בְּסִמָּן שע״ח » (שו״ע הרב שע״ה:א).
What is already found before him: the reason of the height and the limit of the ladder are already found in Rashi on the Mishnah, which the Beis Yosef cites: « ואעפ״כ אין אוסרין הואיל וגבוה מרפסת י׳ שלא הלכו בסולם אלא להקל ואמרינן תורת מחיצה עליו ואינן אוסרין » (רש״י עירובין פ״ג ע״ב); and he relies on the Gemara he cites, « סולם תורת פתח עליו ותורת מחיצה עליו והכל להקל » (רש״י עירובין פ״ג ע״ב). On the condition of the seif, the Beis Yosef writes « אבל אם לא עירבו בני מרפסת לעצמן ודאי אסרי אבני חצר דרגל האסורה במקומה אוסרת שלא במקומה » (בית יוסף או״ח שע״ה).
The difference: the Mechaber bases the rule on the ladder, which makes the upper rooms and the courtyard two courtyards joined by an opening; the Rav bases it on the upper rooms opening only onto the gallery, and on an ordinary gallery being ten high — a reason Rashi already gives —, and gives the ladder the status of an opening only to permit a joint eruv, to be lenient and not to be stringent. The Rav also writes, before the rule of the courtyard, that the gallery is to the upper rooms as a courtyard is to houses, so that the people of the upper rooms forbid it to one another as long as they have not made the eruv. The Mechaber's condition already names the foot permitted in its place, « ובלבד שיערבו כל בני מרפסת לעצמן כדי שתהא רגל המותרת במקומה » (שו״ע או״ח שע״ה:א); the Rav also writes the converse — the foot forbidden in its place, which forbids outside its place until they make the eruv —, which the Beis Yosef already writes. The Rav writes « וּסְתָם מִרְפֶּסֶת גָּבוֹהַּ עֲשָׂרָה » (שו״ע הרב שע״ה:א) and does not say, in this seif, what the law is for a lower gallery; after him, the Mishnah Berurah writes « ומיירי כשהמרפסת גבוה י״ט מן החצר דאי לא היה גבוה י״ט הוי ליה עם החצר כחצר אחת » (משנה ברורה שע״ה ס״ק א); this page does not decide.
Practical consequence: in an ordinary gallery, ten [tefachim] high, onto which the upper rooms open and which one climbs from the courtyard by a ladder, the people of the upper rooms may not take out onto the gallery objects that rested on Shabbos in their upper rooms as long as they have not made the eruv among themselves; they need not make it with the people of the courtyard, but if they wish — so as to take out to the courtyard as well objects from their upper rooms — they may do so by means of the ladder; and if they did not make the eruv among themselves, they forbid in the courtyard until they make it (Shulchan Aruch HaRav 375:1).

What the Mechaber writes: in seif 2 he writes « אם לא עירבו יחד ויש בחצר תל או עמוד שהוא משותף בין שניהם אם אינם גבוהים י״ט הרי אלו נחשבי׳ בין החצר ובין המרפסת ושניהם אסורים להוציא שם כלים שבבתים » (שו״ע או״ח שע״ה:ב); then « ואם הם גבוהים מקרקעית החצר י״ט (ובתוך עשרה למרפסת (טור) והם בתוך ד׳ טפחים למרפסת בני מרפסת מותרים לפי שתשמישו (להם) בנחת מלבני החצר » (שו״ע או״ח שע״ה:ב); then « ואם היו רחוקים מהמרפס׳ ד״ט או יותר אע״פ שגבוהים עשרה (מן החצר לתוך עשרה למרפסת) (טור) הרי אלו בכלל החצר והמרפס׳ לפי ששניהם אפשר להשתמש בהם על ידי זריקה לפיכך שניהם אסורים להוציא שם כלים ששבתו בבתים עד שיערבו » (שו״ע או״ח שע״ה:ב). The first of the two parentheses in small print with the reference to the Tur, the Taz attributes to the Rema: « ורמ״א הכניס לתוך דברי הרמב״ם מן שיטת הטור דהיינו ובתוך י׳ למרפסת בבבא דגבוהים י׳ » (ט״ז או״ח שע״ה ס״ק ב).
What the Rav writes: where the Mechaber writes « אם לא עירבו יחד » (שו״ע או״ח שע״ה:ב), he writes « אִם עֵרְבוּ בְּנֵי הַמִּרְפֶּסֶת לְעַצְמָן וְלֹא עֵרְבוּ עִם בְּנֵי הֶחָצֵר » (שו״ע הרב שע״ה:ב), and adds « וּשְׁנֵיהֶם מִשְׁתַּמְּשִׁים בּוֹ בְּחֹל » (שו״ע הרב שע״ה:ב); then « אִם הוּא גָבוֹהַּ עֲשָׂרָה מִקַּרְקָעִית הֶחָצֵר וְאֵינוֹ נָמוּךְ עֲשָׂרָה מִמִּרְפֶּסֶת, נוֹתְנִים אוֹתוֹ לִבְנֵי הַמִּרְפֶּסֶת » (שו״ע הרב שע״ה:ב), with the reason it is difficult for the courtyard, « שֶׁאֵין דֶּרֶךְ לְהִשְׁתַּמֵּשׁ בּוֹ בְּחָצֵר אֶלָּא לְכַתֵּף עָלָיו מַשּׂוֹי כָּבֵד » (שו״ע הרב שע״ה:ב), and the rule « וְכֹל שֶׁלְּזֶה תַּשְׁמִישׁוֹ בְּנַחַת וּלְזֶה תַּשְׁמִישׁוֹ בְּקָשֶׁה — נוֹתְנִים אוֹתוֹ לְזֶה שֶׁבְּנַחַת » (שו״ע הרב שע״ה:ב).
What is already found before him: that the seif speaks of people of the gallery who made an eruv among themselves, and not with those of the courtyard, Rashi already reads in the mishnah: « ולא עירבו אלו עם אלו אבל עירבו אלו לעצמן ואלו לעצמן » (רש״י עירובין פ״ג ע״ב); and the Rambam writes it in the halachah that precedes the case of the mound: « וְעֵרְבוּ אַנְשֵׁי הֶחָצֵר לְעַצְמָן וְאַנְשֵׁי הַמִּרְפֶּסֶת לְעַצְמָן » (הלכות עירובין פ״ד הט״ו). The cases of the mound and the pillar are already found in the Mishnah and the Gemara (Eruvin 83b-84a), then, among others, in the Tur, the Beis Yosef, the Magen Avraham and the Taz, who disagree on several of them; the rule of easy or difficult use, the Gemara gives in Shmuel's words, and, among others, the Beis Yosef and the Taz say how it is understood according to Rav, whom the halachah follows (Level 2, section 4). The table in section 5 of Level 3 gives, case by case, what the voices of its columns write; Level 2 studies sources on them.
The difference: the Mechaber's seif, as printed, writes three cases, for carrying out there objects of the houses: the mound that is not ten high, forbidden to both, without stating its distance from the gallery or its height below it; ten high and within four of the gallery, to the gallery; four away, even ten high, forbidden to both; two parentheses add to the last two cases: within ten of the gallery. The Rav writes each case according to the height above the courtyard, the height below the gallery and the distance of four from in front of the gallery, and sets as a general rule that what is of easy use for one and of difficult use for the other is given to the one for whom it is easy; the Mechaber's seif gives a reason only in its last two cases. The Rav gives to the courtyard the mound less than ten above the courtyard when it is four away from the gallery, or ten lower than it; and he writes cases that the Mechaber's seif, as printed, does not write: more than ten for both, he gives it to the courtyard if it is four away, and forbids it to both if it is not. On several of these cases, the commentators on the Mechaber disagree: see the table in section 5 of Level 3; Level 2 studies sources on them. Two details of the Rav on the use — that both use it on weekdays, and that the courtyard's usual use of it is only to rest a load on it from the shoulder — are found neither in the Mechaber's seif nor in the Tur, the Beis Yosef, the Magen Avraham or the Taz on this siman (as surveyed in their entries served by Sefaria). Rashi, on the Gemara, already uses their terms in other cases: weekday use, for a courtyard ten higher than the mound, « כגון חצר גבוהה מן התל י׳ דאינה משתמשת עליו בחול אלא בשלשול וחברתה שוה לה » (רש״י עירובין פ״ג ע״ב); the load carried on the shoulder, for a place less than four by four, permitted to the people of the private and of the public domain, « מקום שאין בו ד׳ על ד׳ מותר לבני רה״י ולבני רה״ר לכתף עליו דמקום פטור הוא » (רש״י עירובין פ״ג ע״ב). That both use it on weekdays, and that the courtyard uses the mound in this way, this page does not say where the Rav takes from.
Practical consequence: a mound or pillar in the courtyard, belonging to the people of the courtyard and of the gallery in partnership, which both use on weekdays, when the people of the gallery made the eruv among themselves and not with those of the courtyard: ten high from the floor of the courtyard, not ten lower than the gallery and close to it, it is given to the people of the gallery, for objects that rested on Shabbos in the upper rooms; four away from in front of the gallery, they forbid it to each other, for objects that rested on Shabbos in the house, until they make the eruv; within ten for both, or more than ten for both, it is given to the courtyard if it is four away from in front of the gallery, and both are forbidden if it is not; within ten for the courtyard and more than ten for the gallery, it is given to the courtyard in any case (Shulchan Aruch HaRav 375:2). Other voices, case by case: see the table in section 5 of Level 3; Level 2 studies sources on them; consult your Rav.
נקודה ג — בור שבחצר וחוליתו (שו״ע הרב שע״ה:ג)
Point ג — The cistern in the courtyard and its rim (Shulchan Aruch HaRav 375:3)
A seif the Mechaber's Shulchan Aruch does not have
What the Mechaber writes: the Mechaber's Shulchan Aruch has no seif on the cistern. The Beis Yosef writes why the Tur does not write the cistern full of tevel produce, which the Rambam writes: « ורבינו לא חשש לכותבו משום דכיון שהוא מלא דבר שאינו ניטל בשבת ה״ל בכלל תל או עמוד שכתב » (בית יוסף או״ח שע״ה).
What the Rav writes: he writes the case of a cistern surrounded by a rim ten high and close to the gallery: « אַף עַל פִּי שֶׁבְּנֵי הֶחָצֵר מִשְׁתַּמְּשִׁים בּוֹ בְּשִׁלְשׁוּל וּבִזְרִיקָה, שֶׁזּוֹרְקִין דְּלִי לְמַעְלָה מִן הַחֻלְיָא וּמְשַׁלְשְׁלִין אוֹתוֹ לַבּוֹר, וּבְנֵי מִרְפֶּסֶת מִשְׁתַּמְּשִׁים בְּשִׁלְשׁוּל בִּלְבָד » (שו״ע הרב שע״ה:ג) — « אַף עַל פִּי כֵן אוֹסְרִים זֶה עַל זֶה לְמַלֹּאת בִּדְלִי שֶׁשָּׁבַת בְּבֵיתוֹ אוֹ בָּעֲלִיּוֹת » (שו״ע הרב שע״ה:ג), « הוֹאִיל וְגַם לָהֶם תַּשְׁמִישׁוֹ בְּקָשֶׁה עַל יְדֵי שִׁלְשׁוּל י׳ טְפָחִים » (שו״ע הרב שע״ה:ג); then « וַאֲפִלּוּ אִם הַבּוֹר מָלֵא מַיִם עַד גֹּבַהּ הַחֻלְיָא סָמוּךְ לַמִּרְפֶּסֶת — אָסוּר, מִשּׁוּם גְּזֵרָה שֶׁמָּא יַחְסְרוּ הַמַּיִם בְּשַׁבָּת וְיִשְׁתַּמְּשׁוּ בּוֹ כְּבַתְּחִלָּה » (שו״ע הרב שע״ה:ג); and finally « אֲבָל אִם הָיָה הַבּוֹר מָלֵא בְּדָבָר שֶׁאֵינוֹ נִטָּל בְּשַׁבָּת — הֲרֵי הוּא כְּעַמּוּד אוֹ תֵּל גָּבוֹהַּ עֲשָׂרָה מֵחָצֵר וְתוֹךְ עֲשָׂרָה לַמִּרְפֶּסֶת, שֶׁנּוֹתְנִים אוֹתוֹ לַמִּרְפֶּסֶת אִם אֵינוֹ מֻפְלָג מִכְּנֶגְדָּהּ ד׳ » (שו״ע הרב שע״ה:ג).
What is already found before him: the Gemara (Eruvin 84a) already forbids the cistern full of water, because it is forbidden when it decreases (Level 2, section 7); the Rambam writes the cistern full of tevel produce, « בּוֹר שֶׁבֶּחָצֵר אִם הָיָה מָלֵא פֵּרוֹת טְבָלִים שֶׁאָסוּר לְטַלְטְלָן בְּשַׁבָּת וְכַיּוֹצֵא בָּהֶן הֲרֵי הוּא וְחֻלְיָתוֹ כְּסֶלַע אוֹ תֵּל שֶׁבֶּחָצֵר » (הלכות עירובין פ״ד הי״ח), when it is ten high and close to the gallery, « וְהָיָה סָמוּךְ לַמִּרְפֶּסֶת » (הלכות עירובין פ״ד הי״ח); and the cistern full of water, « אֲבָל אִם הָיָה מָלֵא מַיִם אֵין בְּנֵי חָצֵר וְלֹא בְּנֵי מִרְפֶּסֶת מַכְנִיסִין מִמֶּנּוּ לַבָּתִּים עַד שֶׁיְּעָרְבוּ » (הלכות עירובין פ״ד הי״ח). The Magen Avraham cites it, and gives the reason for the cistern full of water: « אבל מלא מים אסור שמא ימלא ממנה ותחסר מי׳ » (מגן אברהם שע״ה ס״ק א). That the people of the gallery too use the cistern by lowering, Rashi writes in the discussion of the Gemara: « תשמישתו בשלשול הוא אפילו לבני מרפסת שהרי מקרקעיתו דולין » (רש״י עירובין פ״ד ע״א). And that the people of the courtyard use it by throwing the bucket over the rim, Rashi writes in the same place: « שאין יכולין למלאות אלא א״כ זורקין דלי למעלה מן החוליא » (רש״י עירובין פ״ד ע״א). And that when one uses it by lowering and the other by throwing both are forbidden, the Taz writes as the halachah: « ורב סבירא ליה דלא מיקרי נחת אלא במשתמש דרך פתח אבל כאן לא אכפת לן בנחת קצת ושלשול וזריקה שוין הם ואסור והכי קי״ל » (ט״ז או״ח שע״ה ס״ק ב).
The difference: the Rav makes the cistern a seif, which the Mechaber does not have; he writes in it that both forbid it to each other, although the courtyard uses the cistern by throwing and lowering and the gallery by lowering alone — the rule the Taz gives as the halachah; for the cistern full of water he frames as a preventive decree, lest the water decrease, the prohibition the Gemara already draws from the cistern that decreases, as the Magen Avraham does in his own words, where the Rambam, in the halachah cited, writes that one does not bring its water into the houses until they make the eruv. For the cistern full of something that may not be taken on Shabbos, he writes the condition by its measure — that it be not four away from in front of the gallery — where the Rambam writes « וְהָיָה סָמוּךְ לַמִּרְפֶּסֶת » (הלכות עירובין פ״ד הי״ח); this is not a difference in the law: the Mishnah already defines closeness by this measure, « וְאֵיזוֹ הִיא סְמוּכָה — כׇּל שֶׁאֵינָהּ רְחוֹקָה אַרְבָּעָה טְפָחִים » (עירובין פ״ג ע״ב). He also compares this cistern to a mound « גָּבוֹהַּ עֲשָׂרָה מֵחָצֵר וְתוֹךְ עֲשָׂרָה לַמִּרְפֶּסֶת » (שו״ע הרב שע״ה:ג), a condition the Rambam does not write here, and which the Taz notes is absent from his words on the mound (Level 2, section 6). After him, the Mishnah Berurah writes the case of the cistern in terms close to his: « משום גזירה שמא יחסרו המים בשבת וישתמשו בו כבתחלה אבל אם היה הבור מלא בדבר שאין ניטל בשבת הרי הוא כעמוד או תל גבוה י׳ מחצר ותוך עשרה למרפסת שנותנין אותו לבני מרפסת [כשאינו מופלג מכנגדה ד״ט וכנ״ל] להשתמש על גבה » (משנה ברורה שע״ה ס״ק י״א).
Practical consequence: a cistern in the courtyard, belonging to the people of the courtyard and of the gallery in partnership, surrounded by a rim ten high and close to the gallery: when they have not made the eruv together, they forbid each other to draw from it with a bucket that rested on Shabbos in the house or in the upper rooms, or to bring the water in light vessels to store them there, even if it is full of water up to the height of the rim; if it is full of something that may not be taken on Shabbos, it is like a mound ten high from the courtyard and within ten of the gallery, and it is given to the gallery, provided it is not four away from in front of it (Shulchan Aruch HaRav 375:3).
נקודה ד — מצבה לפני המרפסת (שו״ע הרב שע״ה:ד)
Point ד — The matzeivah in front of the gallery (Shulchan Aruch HaRav 375:4)
Four high, and the reason
What the Mechaber writes: in seif 3 he writes « היתה מצבה ארבע׳ טפחים לפני המרפס׳ אין המרפסת אוסר׳ על בני החצר שהרי נחלקה מהם » (שו״ע או״ח שע״ה:ג), without saying whether the four tefachim are of height or of width.
What the Rav writes: he writes « הָיְתָה מַצֵּבָה גָּבוֹהַּ ד׳ טְפָחִים לִפְנֵי הַמִּרְפֶּסֶת » (שו״ע הרב שע״ה:ד); he extends the rule, « אֲפִלּוּ תֵּל וְעַמּוּד הַסְּמוּכָה לָהּ » (שו״ע הרב שע״ה:ד); and gives its reason: « שֶׁכֵּיוָן שֶׁעָשׂוּ הֶפְסֵק לִפְנֵי הַמִּרְפֶּסֶת, גִּלּוּ דַעְתָּם שֶׁסִּלְּקוּ עַצְמָן מֵהֶחָצֵר » (שו״ע הרב שע״ה:ד).
What is already found before him: the reason is already in the Gemara, on the dakah in front of the gallery: « דְּכֵיוָן דְּעָבֵיד דַּקָּה — אִיסְתַּלּוֹקֵי אִיסְתַּלּוּק לֵיהּ מֵהָכָא » (עירובין ס׳ ע״א), Level 2, section 8; and the Taz gives it on this seif of the Mechaber: « דכיון שעשה הפסק לפני המרפסת גילה דעתיה דסליק נפשיה מהחצר » (ט״ז או״ח שע״ה ס״ק ג). The Maggid Mishneh, cited by the Beis Yosef, writes that it appears from the Rambam's words that he understands the matzeivah to permit also the domains said above to be forbidden: « ומדבריו נראה שהוא מפרש שהמצבה הזאת מתרת הרשויות שנאמר עליהם למעלה שהם אסורים » (בית יוסף או״ח שע״ה). The text of the Rambam served by Sefaria reads « הָיְתָה מַצֵּבָה רְחָבָה אַרְבָּעָה טְפָחִים לִפְנֵי הַמִּרְפֶּסֶת » (הלכות עירובין פ״ד הט״ז). Rashi, on the Gemara, describes the dakah as four high (Level 2, section 8).
The difference: the Mechaber gives as the reason « שהרי נחלקה מהם » (שו״ע או״ח שע״ה:ג); the Rav writes the reason that the Taz gives to the Mechaber's words, which is that of the Gemara — by the separation, the people of the gallery showed that they withdrew from the courtyard — and writes in the seif that the rule applies even to a mound or pillar close to the gallery; according to the reading of the Rambam that the Maggid Mishneh, cited by the Beis Yosef, proposes, the matzeivah already applies to what is forbidden above, and this page does not say whether the two extensions coincide. He writes that the matzeivah is four high, where the Mechaber does not say whether his four tefachim are height or width, and the text of the Rambam served by Sefaria writes that it is four wide; after him, the Mishnah Berurah writes on the four tefachim « בגובה שלה » (משנה ברורה שע״ה ס״ק י״ב), and on the rule « ר״ל אפילו התל ועמוד הסמוכה לה בתוך ד״ט וגבוה י״ט » (משנה ברורה שע״ה ס״ק י״ג). This page does not say whether the Rav means to exclude a matzeivah four wide that is not four high: the question is put to the Rav.
Practical consequence: a matzeivah four tefachim high in front of the gallery: the gallery does not forbid to the people of the courtyard, even a mound or pillar close to it (Shulchan Aruch HaRav 375:4).
נקודה ה — זיזין היוצאין מן הכתלים (שו״ע הרב שע״ה:ה)
Point ה — The ledges jutting out from the walls (Shulchan Aruch HaRav 375:5)
To whom the ledges belong, and which eruv permits them
What the Mechaber writes: in seif 4 he writes « זיזים היוצאים מהכתלים כל שהוא למטה מעשרה טפחים הרי זה נחשב מהחצר ובני החצר משתמשין בו » (שו״ע או״ח שע״ה:ד), and for what remains between them, « שניהם אסורים בו ואין משתמשין בהם בכלים ששבתו בבתים אלא אם כן עירבו » (שו״ע או״ח שע״ה:ד), without saying to whom the ledges belong.
What the Rav writes: he writes that they belong to both, « וְהֵם מִבְּנֵי הֶחָצֵר וְהָעֲלִיּוֹת בְּשֻׁתָּפוּת » (שו״ע הרב שע״ה:ה), and that the eruv that permits is that of the people of the courtyard with those of the upper rooms: « אֶלָּא אִם כֵּן עֵרְבוּ יַחַד בְּנֵי הֶחָצֵר עִם בְּנֵי הָעֲלִיּוֹת » (שו״ע הרב שע״ה:ה).
What is already found before him: for the mound and the pillar, the Mechaber already writes « שהוא משותף בין שניהם » (שו״ע או״ח שע״ה:ב), and the Beis Yosef explains the condition: « שאילו היה של א׳ מהם לא היו האחרים אוסרים עליהם » (בית יוסף או״ח שע״ה). For the ledges, the condition is found neither in the Tur nor in the Beis Yosef, the Magen Avraham or the Taz on this siman (as surveyed in their entries served by Sefaria); this page does not say where the Rav takes it from. The Gemara's baraisa already speaks of the people of the courtyard and the people of the upper room who forgot and did not make an eruv (Eruvin 84a; Level 2, section 9).
The difference: the Rav writes for the ledges the condition of partnership, which the Mechaber's seif writes for the mound and the pillar and not for the ledges, and he names those who must make the eruv together. After him, the Mishnah Berurah also writes « ושהזיזים היו שייכין לבני החצר והעליה בשותפות » (משנה ברורה שע״ה ס״ק י״ד); it adds, in the name of Rashi, « וגם מיירי שהזיזין היו רחבים ד״ט » (משנה ברורה שע״ה ס״ק י״ד), which the Rav does not write in this seif.
Practical consequence: ledges jutting out from the walls, belonging to the people of the courtyard and of the upper rooms in partnership: below ten, the people of the courtyard use them; within the upper ten tefachim, close to the upper room, the people of the upper room use them; between the two, both are forbidden to use them with objects that rested on Shabbos in the houses, unless the people of the courtyard made the eruv with the people of the upper rooms (Shulchan Aruch HaRav 375:5).

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 375, in the Chabad sensibility, in the order of its seifim. The seif numbers are the Rav's.
For the Chabad Chassid — Siman 375
- ① The gallery of the upper rooms and the courtyard: in an ordinary gallery, ten [tefachim] high, onto which the upper rooms open and which one climbs from the courtyard by a ladder, the people of the upper rooms may not take out onto it objects that rested on Shabbos in their upper rooms as long as they have not made the eruv among themselves; they need not make it with the people of the courtyard, and if they wish, they may do so by means of the ladder; if they did not make the eruv among themselves, they forbid in the courtyard until they make it. For a lower gallery, which the Rav does not treat in this seif, see section 2, and consult your Rav. Reference: Shulchan Aruch HaRav 375:1.
- ② The mound or pillar: owned in common by the people of the courtyard and of the gallery, who use it on weekdays, when the people of the gallery made the eruv among themselves and not with those of the courtyard: ten high from the courtyard, not ten lower than the gallery and close to it, it belongs to the people of the gallery, for objects that rested on Shabbos in the upper rooms; four away from in front of it, it is forbidden to both with objects that rested on Shabbos in the house, until the eruv; within ten for both, or more than ten for both, it belongs to the courtyard if it is four away from in front of the gallery, and is forbidden to both if it is not; within ten for the courtyard and more than ten for the gallery, it belongs to the courtyard in any case. Other voices, case by case: see the table in section 5 of Level 3; Level 2 studies sources on them; consult your Rav. See section 2. Reference: Shulchan Aruch HaRav 375:2.
- ③ The cistern: a cistern in partnership, surrounded by a rim ten high and close to the gallery, is forbidden to both, when they have not made the eruv together — to draw from it with a bucket that rested on Shabbos in the house or in the upper rooms, or to bring the water in light vessels to store them there — even when it is full of water up to the height of the rim; full of something that may not be taken on Shabbos, it is like a mound ten high from the courtyard and within ten of the gallery: it belongs to the gallery if it is not four away from in front of it. See section 2. Reference: Shulchan Aruch HaRav 375:3.
- ④ The matzeivah: a matzeivah four tefachim high in front of the gallery: the gallery does not forbid to the people of the courtyard, even a mound or pillar close to it. See section 2. Reference: Shulchan Aruch HaRav 375:4.
- ⑤ The ledges from the wall: in partnership between the people of the courtyard and of the upper rooms: below ten, for the people of the courtyard; within the upper ten tefachim, for the people of the upper room; between the two, forbidden with objects that rested on Shabbos in the houses, unless the people of the courtyard made the eruv with those of the upper rooms. See section 2. Reference: Shulchan Aruch HaRav 375:5.
