summary: heading of the siman, then seif א. Three courtyards that open onto one another and open onto the public domain; each of the outer ones made the eruv with the middle one, and the outer ones did not make it together: the outer ones are forbidden with one another, the middle one is permitted with each of them, and they with it. This is when the middle one gave its eruv in each of them, or when the outer ones gave theirs in the middle one, in two houses; if the two outer ones gave it in the middle one, in a single house, all three are permitted with one another.
summary: two courtyards, one inside the other: the inner one opens onto the outer one, the outer one onto the mavoi, and the inner one has a passage through the outer one. If the inner one made the eruv and not the outer one, or each made it for itself and one resident of the outer one forgot and did not make it: the inner one is permitted, the outer one forbidden. If the outer one made the eruv and not the inner one, or each made it for itself and one resident of the inner one forgot and did not make it: both are forbidden. If each made the eruv for itself: each is permitted in its own courtyard.
summary: they made the eruv together. If they placed it in the outer one and one resident, of the inner or of the outer one, forgot and did not make it: both are forbidden, until he renounces his domain. If they placed it in the inner one: one resident of the inner one forgot, both are forbidden; one resident of the outer one forgot, the inner one is permitted.
summary: a single [resident] in the inner one, and a single one in the outer one, or two in the outer one who made the eruv: the one who is alone in the inner one does not forbid the outer one. Gloss of the Rema: likewise several who are like a single one and do not need to make the eruv, as was explained in siman 370 (the Maggid [Mishneh], chapter 4).
summary: three courtyards, one inside the other, a single [resident] in each: even though many pass through the outer one, they do not forbid, since each one is permitted in its place. If there are two in the inner one who did not make the eruv, they forbid those who are alone in the middle one and in the outer one. This is the rule: a foot forbidden in its place forbids outside its place, and a permitted foot does not forbid outside its place.
1. Rabbi Shimon's Mishnah and the Gemara's question (seif א)
Seif א comes from a Mishnah in the chapter Mi shehotziuhu: there Rabbi Shimon compares to three courtyards the case of three men whose [four] amos overlap, the middle one being enclosed between the other two: « אָמַר רַבִּי שִׁמְעוֹן, לְמָה הַדָּבָר דּוֹמֶה, לְשָׁלֹשׁ חֲצֵרוֹת הַפְּתוּחוֹת זוֹ לָזוֹ וּפְתוּחוֹת לִרְשׁוּת הָרַבִּים, עֵרְבוּ שְׁתֵּיהֶן עִם הָאֶמְצָעִית, הִיא מֻתֶּרֶת עִמָּהֶם וְהֵן מֻתָּרוֹת עִמָּהּ, וּשְׁתַּיִם הַחִיצוֹנוֹת אֲסוּרוֹת זוֹ עִם זוֹ » (משנה עירובין ד:ו).
The Tur writes open onto a mavoi, and the Beis Yosef wonders at it: « ולא ידעתי למה כתב רבינו ופתוחות למבוי במקום מה ששנינו ופתוחות לר״ה » (בית יוסף או״ח שע״ח). The Mishnah Berurah, on seif It thus applies to seif א the rule of seif ב, the foot permitted in its place. The Shulchan Aruch HaRav writes in its seif 1 « וּפְתוּחוֹת כֻּלָּן גַּם כֵּן לְמָבוֹי אוֹ לִרְשׁוּת הָרַבִּים » (שו״ע הרב שע״ח:א) (level 4). This page does not say how the Acharonim cited by the Mishnah Berurah read Rashi's remark.
The Gemara asks why the outer courtyards remain forbidden: « וְאַמַּאי? Rav Yehudah answers: « אָמַר רַב יְהוּדָה: כְּגוֹן שֶׁנָּתְנָה אֶמְצָעִית עֵירוּבָהּ בָּזוֹ וְעֵירוּבָהּ בָּזוֹ » (עירובין מ״ח ע״א). Rav Sheshes: « וְרַב שֵׁשֶׁת אָמַר: אֲפִילּוּ תֵּימָא שֶׁנָּתְנוּ עֵירוּבָן בָּאֶמְצָעִית, כְּגוֹן שֶׁנְּתָנוּהוּ » (עירובין מ״ח ע״א) — the sentence ends on the next page: « בִּשְׁנֵי בָתִּים » (עירובין מ״ח ע״ב).
The Gemara then reports whose rule this is, and what the Sages hold. Rav Yehudah, in the name of Rav: « אָמַר רַב יְהוּדָה אָמַר רַב: זוֹ דִּבְרֵי רַבִּי שִׁמְעוֹן. When Rav Yehudah said this before Shmuel, Shmuel told him: « אַף זוֹ דִּבְרֵי רַבִּי שִׁמְעוֹן, אֲבָל חֲכָמִים אוֹמְרִים: שְׁלָשְׁתָּן אֲסוּרוֹת » (עירובין מ״ט ע״א). Finally it reports: « אָמַר רַבָּה אָמַר רַב חָמָא בַּר גּוּרְיָא אָמַר רַב: הֲלָכָה כְּרַבִּי שִׁמְעוֹן » (עירובין מ״ט ע״ב). Seif א writes the rule of Rabbi Shimon's Mishnah, with the two cases of Rav Yehudah and Rav Sheshes.
2. One house or two, one vessel or two (seif א)
The Gemara asks whether Rav Sheshes follows Beis Shammai: « כְּמַאן?
The objection of Rav Acha son of Rav Avya to Rav Ashi. Against Rav Yehudah: « לְרַב יְהוּדָה קַשְׁיָא דְּאָמַר: כְּגוֹן שֶׁנָּתְנָה אֶמְצָעִית עֵירוּבָהּ בָּזוֹ וְעֵירוּבָהּ בָּזוֹ, וְכֵיוָן דְּעֵירְבָה אֶמְצָעִית בַּהֲדֵי חִיצוֹנָה הָוְיָא לֵיהּ חֲדָא, וְכִי הָדְרָה וְעָרְבָה בַּהֲדֵי אִידַּךְ — שְׁלִיחוּתָהּ עָבְדָה » (עירובין מ״ח ע״ב) — the middle one, having made the eruv with one outer courtyard, has become one with it, and when it then makes it with the other, it also acts as the first one's agent.
Rav Ashi answers, for Rav Yehudah: « לְרַב יְהוּדָה לָא קַשְׁיָא: כֵּיוָן דְּעֵירְבָה לַהּ אֶמְצָעִית בַּהֲדֵי חִיצוֹנָה, וּשְׁתַּיִם חִיצוֹנוֹת בַּהֲדֵי הֲדָדֵי לָא עֵירְבוּ — גַּלְּיָא דַּעְתֵּיהּ דִּבְהָא נִיחָא לֵיהּ, וּבְהָא לָא נִיחָא לֵיהּ » (עירובין מ״ח ע״ב) — the intention is revealed: this one is wanted, that one is not. For Rav Sheshes: « וּלְרַב שֵׁשֶׁת לָא קַשְׁיָא: אִם אָמְרוּ דָּיוֹרִין לְהָקֵל, יֹאמְרוּ דָּיוֹרִין לְהַחְמִיר » (עירובין מ״ח ע״ב).
חקירה — what joins the outer courtyards, or fails to: the dwelling that the eruv establishes where it is placed, or the intention revealed by the way it is placed? The Taz explains the first case by the dwelling: « דאז דמיא אמצעית כאלו דרה בהן ואין דיורים חיצוניות באמצעית למימרא דכי הדדי נינהו אבל אם עירובן באמצעיות דאז דמי כאלו כולהו דרים באותו בית וחצר דההוא בית הוין » (ט״ז או״ח שע״ח ס״ק א); so does the Mishnah Berurah: « דאז דיורי האמצעית בחיצונה ואין דיורי חיצונה באמצעית למהוי כולהו כי חדא אבל אם נתנו עירובן באמצעית הוי כאלו כולן דרין באמצעית » (משנה ברורה שע״ח ס״ק ג). The Shulchan Aruch HaRav writes it for the first case: « שֶׁאָז דִּיּוּרֵי הָאֶמְצָעִית בַּחִיצוֹנוֹת, שֶׁהָעֵרוּב הוּא מִשּׁוּם דִּירָה, וְאֵין דִּיּוּרֵי הַחִיצוֹנִים בָּאֶמְצָעִית, שֶׁהֲרֵי אֵין עֵרוּבָן בָּהּ » (שו״ע הרב שע״ח:א), and for the second: « שֶׁאָז גַּם כֵּן לֹא נִתְחַבְּרוּ דִּיּוּרֵי הַחִיצוֹנוֹת זוֹ עִם זוֹ, שֶׁדִּיּוּרֵי זוֹ הֵם בְּבַיִת זֶה וְדִיּוּרֵי זוֹ בְּזֶה, וְלָכֵן הֵן אֲסוּרוֹת זוֹ עַל זוֹ » (שו״ע הרב שע״ח:א). In the Gemara, it is by intention (גַּלְּיָא דַּעְתֵּיהּ) that Rav Ashi answers the objection to Rav Yehudah. This page notes both formulations; it draws from them no consequence that the texts do not draw.
The Beis Yosef cites from the Maggid Mishneh what the Rashba concluded from the sugya: « וגם ה״ה כתב בפ״ד מה״ע בשם הרשב״א וכתב שהעלה מהסוגיא שאם נתנו העירוב באמצעית בבית אחד ובכלי א׳ או בב׳ כלים ובבית אחד וכגון שהיה האחד מלא והותיר הרי שלשתן מותרות זו עם זו ואולי לזה כתב רבינו עד שיעשו שלשתן עירוב א׳ עכ״ל » (בית יוסף או״ח שע״ח). In the text of the Maggid Mishneh that Sefaria serves, he adds that, when one of the vessels was full and overflowed, this is not dividing one's eruv, of which the Gemara says: « אָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: הַחוֹלֵק אֶת עֵירוּבוֹ — אֵינוֹ עֵירוּב » (עירובין מ״ט ע״א).
The Mishnah Berurah, on the words in two houses: « ואפילו מלאוהו לכלי אחת ואייתר ונתנו אח״כ לכלי אחר דבכה״ג היה מהני אם היו נותנים אותו בבית אחד כמ״ש סימן שס״ו ס״ד אבל אם נתנו בשני בתים לא משתרי החיצונות זו בזו כיון דלא מיחברי אהדדי » (משנה ברורה שע״ח ס״ק ד); and on the words in a single house: « והיינו בכלי אחד או דמליא למנא ואייתר [אחרונים] » (משנה ברורה שע״ח ס״ק ה). Seif 1 of the Shulchan Aruch HaRav writes « אֲבָל אִם נְתָנוּהוּ בְּבַיִת אֶחָד בָּאֶמְצָעִית — הֲרֵי נִתְחַבְּרוּ דִּיּוּרֵי שְׁלָשְׁתָּן בְּבַיִת זֶה, וּמְעֹרָבוֹת הֵן, וְכֻלָּן מֻתָּרוֹת זוֹ עִם זוֹ » (שו״ע הרב שע״ח:א), without repeating the condition of the vessel; he sets down the rule of the single vessel for the eruv in Siman 366: « צָרִיךְ לִתֵּן כָּל הָעֵרוּב בִּכְלִי אֶחָד, וְאִם חִלְּקוֹ וּנְתָנוֹ בִּשְׁנֵי כֵלִים — אֵינוֹ עֵרוּב…
Two vessels. In one house of the middle courtyard: according to the Rashba, cited by the Maggid Mishneh and the Beis Yosef, the three courtyards are permitted when one of the vessels was full and overflowed; the Mishnah Berurah writes the same, in the name of the Acharonim (ס״ק ה). In two houses: according to the Mishnah Berurah it does not help, even if one vessel was filled and the surplus put into another (ס״ק ד).
3. The Rishonim who omit these cases, and the wording of the Rambam and the Tur (seif א)
The Beis Yosef wonders at the absence of these cases in the Rif, the Rosh and the Rambam: « ולא ידעתי למה הרי״ף והרא״ש והרמב״ם השמיטו כל זה אבל הגהות אשיר״י כתבו שם וכגון שנתנה אמצעית עירובה בזו ועירובה בזו אבל אם נתנו החיצונות עירובן באמצעית בבית א׳ ה״ל חדא ושרו שלשתן לכ״ע » (בית יוסף או״ח שע״ח).
Does the Rambam really omit them? The Maggid Mishneh, in the words the Beis Yosef cites (section 2), suggests, with a ואולי, that the Rambam alludes to this conclusion. The words he has in mind are in the Rambam: « שָׁלֹשׁ חֲצֵרוֹת הַפְּתוּחוֹת זוֹ לָזוֹ וְרַבִּים בְּכָל חָצֵר מֵהֶן.
The Beis Yosef proposes, with a ואפשר, the same reading for the Tur: « ואפשר שגם רבינו שכתב והחיצונות לא עירבו יחד לכך כיון » (בית יוסף או״ח שע״ח); and the Tur does write « והחיצונות לא עירבו יחד » (טור או״ח שע״ח). Seif א, for its part, writes out the Gemara's two cases and the single house (section 1).
4. The permitted foot and the forbidden foot — three views (seif ב)
Seifim ב to ד follow the Mishnah at the end of the chapter Ha-dar (level 1, section 2). It ends with a dispute: « רַבִּי עֲקִיבָא אוֹסֵר הַחִיצוֹנָה, שֶׁדְּרִיסַת הָרֶגֶל אוֹסַרְתָּהּ. Rav Dimi reports, in the name of Rabbi Yannai, that the Mishnah follows Rabbi Akiva: « כִּי אֲתָא רַב דִּימִי אָמַר רַבִּי יַנַּאי: זוֹ דִּבְרֵי רַבִּי עֲקִיבָא, דְּאָמַר: אֲפִילּוּ רֶגֶל הַמּוּתֶּרֶת בִּמְקוֹמָהּ — אוֹסֶרֶת שֶׁלֹּא בִּמְקוֹמָהּ. The Gemara discusses this reading — raising against it, among others, the objections of Rav Bivi bar Abaye and of Ravina, drawn from the continuation of the Mishnah —, and then: « אֶלָּא כִּי אֲתָא רָבִין אָמַר רַבִּי יַנַּאי: שָׁלֹשׁ מַחְלוֹקוֹת בַּדָּבָר: תַּנָּא קַמָּא סָבַר: רֶגֶל הַמּוּתֶּרֶת — אֵינָהּ אוֹסֶרֶת, רֶגֶל הָאֲסוּרָה — אוֹסֶרֶת.
Three views, according to Ravin. The first Tanna: the permitted foot does not forbid, the forbidden foot forbids. Rabbi Akiva: even the permitted foot forbids. The later Sages (רַבָּנַן בָּתְרָאֵי): the forbidden foot forbids no more than the permitted one. The Beis Yosef writes that all these rules are plain, according to the first Tanna: « וכל אלו הדינים פשוטים בס״פ הדר (עירובין דף עה) במשנה ובגמ׳ לדעת ת״ק דאמר רגל המותרת במקומה אינה אוסרת שלא במקומה ורגל האסורה במקומה אוסרת שלא במקומה ופסק הרא״ש כמותו וכ״ד הרמב״ם בפ״ד מה״ע » (בית יוסף או״ח שע״ח).
The Rambam gives the reason for the case where both are forbidden: « עֵרְבָה הַחִיצוֹנָה וְלֹא עֵרְבָה הַפְּנִימִית שְׁתֵּיהֶן אֲסוּרוֹת. Seif ב writes of this last case « עירבה כל אחת לעצמה כל אחת מותרת בחצרה » (שו״ע או״ח שע״ח:ב); the Mishnah Berurah explains: « ר״ל שאין הפנימי אוסר על בני החיצונה אף שיש לו דריסת הרגל עליו » (משנה ברורה שע״ח ס״ק י״ג).
יסוד — in the Rambam's words, cited above, what makes the inner courtyard forbid the outer one is the passage of its residents through it: he writes that the outer one is forbidden because of those who did not make the eruv and who pass through it. The Shulchan Aruch HaRav specifies, in siman 381, that it is not mere passage that forbids, but passage together with use of the courtyard: « שֶׁזֶּה שֶׁאָמְרוּ שֶׁהַפְּנִימִית אוֹסֶרֶת בִּדְרִיסַת רַגְלָהּ עַל חִיצוֹנָה — אֵין הַכַּוָּנָה שֶׁדְּרִיסַת וְהַעֲבָרַת הָרֶגֶל בִּלְבַדָּהּ תֶּאֱסוֹר, אֶלָּא דְּרִיסַת הָרֶגֶל כְּשֶׁדּוֹרֶסֶת שָׁם וּמִשְׁתַּמֶּשֶׁת בִּצְרָכֶיהָ בְּדֶרֶךְ תַּשְׁמִישׁ הֶחָצֵר לְבָתִּים הִיא אוֹסֶרֶת אוֹתָהּ » (שו״ע הרב שפ״א:ב). Seif ב sets this passage down in its first sentence: « ויש לפנימי׳ דריכת רגל על החיצונה » (שו״ע או״ח שע״ח:ב) — the Maginei Eretz edition reads דריכת, where the Mishnah writes דריסת (level 1, section 2), as does the Torat Emet 363 (level 1, section 3). The Taz explains: « כלומר ולא למבוי ועי״כ יש לה דריסת הרגל על החיצונה דאין לה מקום לכנוס מהמבוי לפנימית אלא דרך החיצונה » (ט״ז או״ח שע״ח ס״ק ב). The Tur gives the reason for the case where both are forbidden: « דכיון דפנימית אסורה בחצירה אוסרת גם על החיצונה » (טור או״ח שע״ח).
The Mishnah Berurah writes the rule with its condition, and the renunciation that would lift the prohibition: « דקי״ל רגל האסורה במקומה אוסרת שלא במקומה כשיש לו דריסת רגל שם אם לא שיבטל את רשותו לבני הפנימית וגם רשות דריסת הרגל שיש לו בחיצונה לבני חיצונה » (משנה ברורה שע״ח ס״ק י״א). The Shulchan Aruch HaRav writes the same condition in its seif 2: « שֶׁרֶגֶל הָאֲסוּרָה בִּמְקוֹמָהּ אוֹסֶרֶת שֶׁלֹּא בִמְקוֹמָהּ כְּשֶׁיֵּשׁ לָהּ שָׁם דְּרִיסַת הָרֶגֶל » (שו״ע הרב שע״ח:ב); and for the permitted inner one: « הוֹאִיל וְיֵשׁ מְחִצָּה בֵּינֵיהֶן וְאֵין לַחִיצוֹנָה דְּרִיסַת הָרֶגֶל עָלֶיהָ » (שו״ע הרב שע״ח:ב) (level 4, point ב).
For the inner courtyard that made the eruv when the outer one did not, the Mishnah Berurah: «
5. The joint eruv: the single place, the door that is shut, and renouncing from courtyard to courtyard (seif ג)
The next Mishnah (ו:י) begins with a resident who forgot — of the outer one: the inner one is permitted and the outer one forbidden; of the inner one: both are forbidden —, then: when they gave their eruv in one place and one forgot, from the inner or from the outer courtyard, both are forbidden (level 1, section 2). The Gemara asks « מַאי מָקוֹם אֶחָד » (עירובין ע״ה ע״א); « אָמַר רַב יְהוּדָה אָמַר רַב: חִיצוֹנָה, וּמַאי קָרוּ לָהּ ״מָקוֹם אֶחָד״ — מָקוֹם הַמְיוּחָד לִשְׁתֵּיהֶן » (עירובין ע״ה ע״א). A baraisa supports this, and distinguishes the eruv placed in the inner one: « תַּנְיָא נָמֵי הָכִי: נָתְנוּ עֵירוּבָן בַּחִיצוֹנָה, וְשָׁכַח אֶחָד, בֵּין מִן הַחִיצוֹנָה וּבֵין מִן הַפְּנִימִית, וְלֹא עֵירַב — שְׁתֵּיהֶן אֲסוּרוֹת, נָתְנוּ עֵירוּבָן בַּפְּנִימִית, וְשָׁכַח אֶחָד מִן הַפְּנִימִית וְלֹא עֵירַב — שְׁתֵּיהֶן אֲסוּרוֹת.
Why do the Sages permit the inner courtyard? According to the Sages the inner one is permitted because it shuts its door and makes use [of its courtyard] — let Rabbi Akiva say so too! Abaye answers: the eruv draws it in [the outer one's eruv, placed in the inner one, draws the outer one into it].
And according to the Sages? דְּאָמְרָה: לְתַקּוֹנֵי שַׁיתַּפְתִּיךְ, וְלָא לְעַוּוֹתֵי » (עירובין ע״ה ע״ב) — it says [to the outer one]: I joined with you only to improve, not to harm. And why would Rabbi Akiva not say so? וְרַבָּנַן, אֵין בִּיטּוּל רְשׁוּת מֵחָצֵר לְחָצֵר » (עירובין ע״ה ע״ב) — according to Rabbi Akiva, the outer one answers that it cedes its domain to it; and the Sages hold that there is no renouncing of domain from courtyard to courtyard.
The Gemara asks whether Shmuel and Rabbi Yochanan follow this dispute: « לֵימָא שְׁמוּאֵל וְרַבִּי יוֹחָנָן בִּפְלוּגְתָּא דְּרַבָּנַן וְרַבִּי עֲקִיבָא קָא מִיפַּלְגִי. According to this answer of Rabbi Yochanan, the Sages do not rely here on there being no renouncing from courtyard to courtyard: the inner one says to the outer one until you renounce for me, you forbid me.
The Mechaber writes in siman 381: « יש ביטול רשות מחצר לחצר » (שו״ע או״ח שפ״א:ב); for two courtyards one inside the other where only the outer one made the eruv (our seif ב): « לא שנא שתי חצירו׳ זו לפנים מזו ולא עירבו אלא החיצונה לבדה שפנימי׳ אוסרה על החיצונה יכולה לבטל לה רשות׳ שלא תשתמש ולא תעבור עליה אלא בשעה שצריכה לצאת ותהיה החיצונה מותר׳ » (שו״ע או״ח שפ״א:ב); and for a joint eruv placed in the outer courtyard, when a resident of the inner one forgot: « או אם עירבו יחד ונתנו עירובן בחיצונה ושכח א׳ מהפנימי׳ ולא עירב יכול לבטל רשותו דהיינו שיבטל רשותו לכל א׳ מבני הפנימי׳ וגם לכל א׳ מבני החיצונה ויהיה הוא לבדו אסור וכולם מותרים » (שו״ע או״ח שפ״א:ב). In seif ג of our siman, of the eruv placed in the outer courtyard: « שתיהן אסורות עד שיבטל רשותו » (שו״ע או״ח שע״ח:ג), which the Mishnah Berurah reads: « ר״ל לשתי החצירות וכמבואר בסי׳ שפ״א » (משנה ברורה שע״ח ס״ק ט״ו).
יסוד — the place of the eruv decides. The Beis Yosef explains both cases: « משום דכשנתנו עירובן בפנימית יכולה היא להסתלק מהחיצונה דאחדא דשא ומשתמשת ואע״פ שעירוב החיצונה נתון בפנימית אמרת לה לתקוני שתפתיך ולא לעוותי אבל כשנתנו עירובה בחיצונה גם הפנימית אסורה משום שכחת א׳ מהחיצונה דאי אמרת פנימית תיחוד דשא הרי אין עירובה אצלה הילכך גם היא אסורה » (בית יוסף או״ח שע״ח). The Tur gives the reason for the permitted inner courtyard: « דכיון שעירובה אצלה ואין לחיצונה דריסת רגל עליה אלא בשביל עירובה שמרגילה לתוכה יסלקנה מעליה ותשאר עירובה אצלה לבדה ותהיה מותרת » (טור או״ח שע״ח) — the word מרגילה is Abaye's.
When the eruv is in the outer courtyard, the inner one gains nothing by shutting its door; the Mishnah Berurah: « ואפילו אם השוכח מן החיצונה אז החיצונה ודאי אסורה וגם הפנימית אסורה אף שאין לחיצונה דריסת הרגל עליה דכיון שעירבו יחד הרי היא כמו שדרה בחיצונה ואוסרת עליה ולא מהני בזה שיסתלקו מבני החיצונה ותסגור פתחה דהא ליתה לעירובה גבה ועיקר העירוב משום דירה דהוי כאלו דר במקום העירוב » (משנה ברורה שע״ח ס״ק י״ד); the Rav: « אֲבָל אִם נָתְנוּ עֵרוּבָן בַּחִיצוֹנָה, אֲפִלּוּ שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵרֵב — שְׁתֵּיהֶן אֲסוּרוֹת, שֶׁאַף אִם הַפְּנִימִית תְּסַלֵּק אֶת הַחִיצוֹנָה מֵעָלֶיהָ, הֲרֵי אֵין עֵרוּבָהּ אֶצְלָהּ, וּבַמֶּה יִתְעָרְבוּ דִּיּוּרֶיהָ » (שו״ע הרב שע״ח:ג) (level 4, point ג).
When the eruv is in the inner courtyard, the Rambam writes, for the forgetting of a resident of the outer one and then for that of a resident of the inner one: « וְאִם הִנִּיחוּ עֵרוּבָן בַּפְּנִימִית וְשָׁכַח אֶחָד מִבְּנֵי הַחִיצוֹנָה וְלֹא עֵרֵב הַחִיצוֹנָה אֲסוּרָה וּפְנִימִית מֻתֶּרֶת בִּמְקוֹמָהּ. For the permitted inner courtyard, it repeats the Sages' words: « דיכולה היא להסתלק מהחיצונה דאחדא לדשא ומשתמשת דהא עירובה אצלה ואע״ג דמתחלה נשתתפו יחד יכולה לחזור בה ולומר לה לתקוני שיתפתיך ולא לעוותי כי לא היה בדעתי שיעוות אחד מבני חצרך ולא יתן חלק בעירוב » (משנה ברורה שע״ח ס״ק י״ז).
6. The single residents: Rav Ada bar Ahavah and Shmuel (seif ד)
The Mishnah ends: « וְאִם הָיוּ שֶׁל יְחִידִים — אֵינָן צְרִיכִין לְעָרֵב » (עירובין ע״ה ע״א).
Rav Bivi thus attributes these words to Rav Ada bar Ahavah — since I call those in the outer courtyard many —, and Rav Yosef acknowledges having taken רבים for רבי.
Rav Ada's three: two readings, and the ruling. The Rosh: « ובפלוגתא דרב אדא ושמואל גם הרא״ש פסק כשמואל דהלכה כדברי המיקל בעירוב » (בית יוסף או״ח שע״ח). And the Rambam, according to the Beis Yosef: « נראה שהוא מפרש כפירוש הרי״ף ופסק כשמואל וגם מתוך דבריו נראה דדוקא שנים בפנימית הוא דאסרי אבל א׳ בפנימית וב׳ בחיצונה לא גזרינן בהו ואע״פ שקודם זה כתב היה א׳ דר בחצר זו וא׳ דר בחצר זו אינם צריכים לערב לאו דוקא א׳ בזו וא׳ בזו דה״ה לב׳ בחיצונה וא׳ בפנימית » (בית יוסף או״ח שע״ח).
The Mishnah Berurah reads its scope: « היינו אותם השנים לבד אבל לא עם הפנימית ואשמועינן בזה דלא תימא דגזרינן משום שיסברו שיש שנים בפנימית כמו בחיצונה ונבוא להתיר גם בזה והתם בודאי אסור מדינא דהוי רגל האסורה במקומה » (משנה ברורה שע״ח ס״ק י״ח) — the concern it sets aside is the one Rashi describes; and: « ר״ל אף שלא עירבו יחד דרגל המותרת במקומה אינה אוסרת שלא במקומה » (משנה ברורה שע״ח ס״ק י״ט). The Shulchan Aruch HaRav gives the same reason: « הוֹאִיל וְהִיא רֶגֶל הַמֻּתֶּרֶת בִּמְקוֹמָהּ, שֶׁאֵין שָׁם מִי שֶׁיֶּאֱסֹר עָלָיו » (שו״ע הרב שע״ח:ד) (level 4, point ד).
One resident in the inner courtyard, two in the outer one who made the eruv between them. According to Rashi, who explains the Mishnah and Rav Ada this way (Beis Yosef), the two courtyards must make the eruv together. According to seif ד, as the Mishnah Berurah reads it, the resident of the inner courtyard does not forbid, even though they did not make the eruv together (ס״ק י״ח and י״ט).
The seif does not speak of the non-Jew.
7. The Rema's gloss: several who are like a single one (seif ד)
The Beis Yosef writes that this is what a question in the Gemara indicates: « בָּעֵי רָמֵי בַּר חָמָא מֵרַב חִסְדָּא: אָב וּבְנוֹ, הָרַב וְתַלְמִידוֹ, כְּרַבִּים דָּמוּ אוֹ כִּיחִידִים דָּמוּ » (עירובין ע״ג ע״א); « אֲמַר לֵיהּ, תְּנֵיתוּהָ: אָב וּבְנוֹ, הָרַב וְתַלְמִידוֹ, בִּזְמַן שֶׁאֵין עִמָּהֶן דָּיוֹרִין הֲרֵי הֵן כִּיחִידִים, וְאֵין צְרִיכִין לְעָרֵב, וּמָבוֹי שֶׁלָּהֶן נִיתָּר בְּלֶחִי וְקוֹרָה » (עירובין ע״ג ע״א).
The Rambam writes, earlier in the same chapter (4:5): « הָאָב וּבְנוֹ וְהָרַב וְתַלְמִידוֹ שֶׁהֵן שְׁרוּיִין בְּחָצֵר אֵינָן צְרִיכִין לְעָרֵב מִפְּנֵי שֶׁהֵן כְּבַיִת אֶחָד. This page does not decide how this wording agrees with Rabbeinu Yehonasan's condition.
The Mishnah Berurah gives the example: « היינו שהיו בפנימית האב עם בניו שמקבלים ממנו פרס וכל כיוצא בהם ע״ש בסי׳ ש״ע » (משנה ברורה שע״ח ס״ק כ׳); the Shulchan Aruch HaRav writes it in its seif 4: « וְהוּא הַדִּין רַבִּים שֶׁהֵם כְּיָחִיד, שֶׁאֵינָן אוֹסְרִים זֶה עַל זֶה וְאֵינָן צְרִיכִים לְעָרֵב בֵּינֵיהֶן, כְּגוֹן הָאָב עִם בָּנָיו שֶׁמְּקַבְּלִים מִמֶּנּוּ פְּרָס, וְכָל כַּיּוֹצֵא בָהֶם מִמַּה שֶּׁנִּתְבָּאֵר בְּסִמָּן ש״ע » (שו״ע הרב שע״ח:ד) (level 4, point ד).
8. Three courtyards, one inside the other (seif ה)
Seif ה closely follows the second part of a halachah of the Rambam: « הָיָה בְּכָל חָצֵר מֵהֶן אֶחָד אַף עַל פִּי שֶׁרַבִּים דּוֹרְסִין בַּחִיצוֹנָה אֵינָן צְרִיכִין לְעָרֵב שֶׁכָּל אֶחָד מֵהֶן מֻתָּר בִּמְקוֹמוֹ. The Rambam writes this case after that of the three courtyards that open onto one another; the Beis Yosef reads his words according to the Rif, for whom these three courtyards are one inside the other (section 6).
חקירה — who are the רבים passing through the outer courtyard? In the Rif's reading, cited by the Beis Yosef (section 6), Rav Ada's argument is that the three residents passing through the outer courtyard are many: « דכל ג׳ רבים הם » (בית יוסף או״ח שע״ח); seif ה, with the Rambam, writes that even though many pass through the outer one, they do not forbid. The Tur names the two who pass: « וכן ג׳ חצירות זו לפנים מזו ויחיד בכל אחד ואחד אף ע״פ ששניהם עוברים על החיצונה אין אוסרין עליה » (טור או״ח שע״ח).
Two in the inner courtyard who did not make the eruv forbid those who are alone in the middle one and in the outer one; seif ה ends with the rule: « זה הכלל רגל האסור׳ במקומה אוסר׳ שלא במקומה ורגל המותרת אינה אוסר׳ שלא במקומה » (שו״ע או״ח שע״ח:ה).
9. Summary of the shitos and halachic conclusion
The foundation — a foot permitted in its place does not forbid outside its place (Mishnah Berurah, ס״ק י״ב), a foot forbidden in its place forbids, when it has a right of passage there (ס״ק י״א); and where the eruv is placed, those who took part in it are as if they lived there (Mishnah Berurah, ס״ק ג and י״ד):
- three courtyards that open onto one another and onto the public domain, each of the outer ones having made the eruv with the middle one, and not with each other: the outer ones are forbidden with one another, the middle one is permitted with each — when the middle one gave its eruv in each (Rav Yehudah), or the outer ones gave theirs in the middle one, in two houses (Rav Sheshes); in a single house, all three are permitted (seif א) — according to the Mishnah Berurah, in a single vessel, or a vessel filled whose surplus remained (ס״ק ה, in the name of the Acharonim), a rule that the Shulchan Aruch HaRav, which does not repeat it in seif 1, sets down in Siman 366 (its seif 9), as does the Mechaber (Siman 366, seif ד); the Gemara reports, in the name of Rav, that the halachah follows Rabbi Shimon;
- two courtyards, one inside the other, the inner one open onto the outer one and having a right of passage over it (with no other way out, according to the Taz): the inner one's eruv permits it, even if the outer one did not make it or one of its residents forgot, the outer one remaining forbidden; the outer one's eruv alone, or the forgetting of a resident of the inner one, forbids both; if each made its own, each is permitted in its own courtyard (seif ב; when it is a resident who forgot, the prohibition ends if he renounces, according to the Mishnah Berurah, ס״ק י and י״א) — according to the first Tanna, in Ravin's version, as the Rosh and the Rambam rule (Beis Yosef);
- the joint eruv: placed in the outer courtyard, the forgetting of a resident, of either one, forbids both, until he renounces his domain (seif ג) — to both courtyards (Mishnah Berurah, ס״ק ט״ו); placed in the inner courtyard, the forgetting of a resident of the inner one forbids both — unless he renounces to both courtyards (Mishnah Berurah, ס״ק ט״ז, in the name of the Acharonim) —, and that of a resident of the outer one leaves the inner one permitted, which can shut its door and say it joined only to improve (Gemara; Mishnah Berurah, ס״ק י״ז; seif ג);
- a single resident in the inner courtyard does not forbid the outer one, when the outer one has a single resident, or two who made the eruv — between themselves alone, according to the Mishnah Berurah (ס״ק י״ח), who writes that no decree is made here for the concern Rashi describes — (seif ד), as Shmuel says, whom the Rosh and the Rambam follow (Beis Yosef); according to the Rema's gloss, likewise several who are like a single one (seif ד; siman 370) — those who receive their portion, according to the Beis Yosef in the name of Rabbeinu Yehonasan; the father with his sons who receive their portion from him, according to the Mishnah Berurah (ס״ק כ׳) and the Shulchan Aruch HaRav (seif 4 in its numbering);
- three courtyards, one inside the other, a single resident in each: they do not forbid; two in the inner one who did not make the eruv forbid those who are alone in the middle one and in the outer one (seif ה, in the Rambam's words, which the Beis Yosef reads according to the Rif).
