Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and numbering of the seifim. Here the Shulchan Aruch HaRav has 5 seifim, and the Shulchan Aruch of the Mechaber 5 as well, divided the same way: each of the Rav's seifim 1 to 5 carries the cases of the Mechaber's seif of the same rank (א to ה), and what the Rema's gloss adds to the Mechaber's seif ד is found in the Rav's seif 4. References on this page follow the Rav's numbering, unless the Mechaber's Shulchan Aruch is named; the Mechaber's seifim are designated by their Hebrew letter.
This page gathers, for Siman 378, the full text of the Rav with its translation, where his text differs from that of the Mechaber and the Rema, and the practical conduct that follows from it.

The law of courtyards that open onto one another; it contains 5 seifim:
Three courtyards that open onto one another, and all of them open also onto a mavoy or onto the public domain (reshus harabim); each of the outer [courtyards] made an eruv with the middle one, and the outer ones did not make an eruv with each other: the outer ones are forbidden with each other — [forbidden] to take out objects that rested (shavsu) in the houses [when Shabbos began], from one to the other, by way of the middle one —; and the middle one is permitted with each of them, and they are permitted with it.
When was this said? When the middle one gave its eruv in this one and its eruv in that one: for then the residents (diyurei) of the middle one are [regarded as dwelling] in the outer ones — for the eruv [works] by reason of dwelling (dirah) —, and the residents of the outer ones are not in the middle one, since their eruv is not there. Or even if the outer ones gave their eruv in the middle one, to make an eruv with it, but did not both give it in one house of the middle one — this one gave it in one house and that one in another house of the middle one —: for then too the residents of the outer ones were not joined with each other, since the residents of this one are in one house and the residents of that one in the other; therefore they are forbidden to each other. But if they gave it in one house in the middle one, the residents of all three have been joined in that house; they are joined by the eruv (me'oravos), and all of them are permitted with one another.
Two courtyards, one inside the other; the outer one opens onto the mavoy, and the inner one onto the outer one and not onto the mavoy — and because of this it has a right of passage (derisas haregel) over the outer one, since it has no way to go out to the mavoy except through the outer one. If the inner one made an eruv for itself and the outer one made no eruv at all, or made one and its eruv is not effective — for example, one of the people of the courtyard forgot and did not make the eruv with the residents of the courtyard, for he prohibits the courtyard to them until he renounces his domain (yevatel reshuso), as will be explained in Siman 380 —: the inner one is permitted to take out into its courtyard objects that rested in the houses, and the outer one does not prohibit it, since there is a partition (mechitzah) between them and the outer one has no right of passage over it.
If the outer one made an eruv for itself and the inner one made no eruv at all, or one of the inner one forgot and did not make the eruv: both are forbidden. For since the inner one is forbidden in its own courtyard and has a right of passage over the outer one, it prohibits it; for a foot that is forbidden in its own place prohibits outside its place (regel ha'asurah bimkomah oseres shelo bimkomah) when it has a right of passage there.
If each made an eruv for itself: each is permitted in its own courtyard, and the inner one does not prohibit the outer one, even though it did not make the eruv with it, since it is permitted in its own courtyard; and a foot that is permitted in its own place does not prohibit outside its place.
If the inner one and the outer one made the eruv together and placed their eruv in the inner one, and one of the inner one forgot and did not make the eruv: both are forbidden; for since the inner one is forbidden in its own courtyard, it also prohibits the outer one, over which it has a right of passage.
But if one of the outer one forgot and did not make the eruv: the outer one is forbidden and the inner one permitted. For since its eruv is with it, and the outer one has a right of passage over it only because of its eruv, which brings it in regularly, it will remove it (tesalkenah) from itself, remain alone with its eruv that is with it, and be permitted.
But if they placed their eruv in the outer one, even if one of the outer one forgot and did not make the eruv: both are forbidden. For even if the inner one removes the outer one from itself, its eruv is not with it; and by what would its residents be joined by the eruv?
If a single person lives in the inner one and a single person in the outer one, or even if two live in the outer one and made an eruv between themselves: the single person in the inner one does not prohibit the outer one, even though they did not make an eruv together, since it is a foot permitted in its own place, for there is no one there who would prohibit him.
The same applies to several people who are like a single person, who do not prohibit one another and need not make an eruv between themselves — for example, a father with his sons who receive their portion (pras) from him —, and to every similar case among what was explained in Siman 370.
Likewise, three courtyards one inside the other, with a single [resident] in each: even though the two inner [residents] pass through the outer one, they do not prohibit it, because it is a foot permitted in its own place. And if there were two in the third, the inner one, and they did not make an eruv between themselves: they prohibit the single [residents] of the middle one and of the outer one, because it is a foot forbidden in its own place.

Where the Rav's text differs from the Mechaber's seif and the Rema's
Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 5 seifim, designated by their letter) and the corresponding seif of the Shulchan Aruch HaRav (its own numbering, also 5 seifim, divided the same way), in the order of the Rav's seifim, and notes only what the comparison of the two texts shows. A point noted is not thereby peculiar to the Rav: at each point, this page names the Mechaber's commentators who already carry it — the Taz, before him; the Mishnah Berurah, later than the Rav — and when they read that point into the Mechaber's own words, it says so. The Tur is named where it already carries what the Rav writes (notably at points ב, ג and ה), and Rashi, reported by the Beis Yosef, at point א; the other Rishonim reported by the Beis Yosef have not been checked one by one. Sefaria gives no entry of the Magen Avraham or of the Biur Halachah for this siman.
Not listed here as a separate point is a detail of the Rav's text that makes explicit the corresponding seif of the Mechaber. In seif 1, the Rav writes that the three courtyards are « וּפְתוּחוֹת כֻּלָּן גַּם כֵּן לְמָבוֹי אוֹ לִרְשׁוּת הָרַבִּים » (שו״ע הרב שע״ח:א), where the Mechaber writes « ופתוחות לרשות הרבים » (שו״ע או״ח שע״ח:א); the Tur writes « ופתוחות למבוי » (טור או״ח שע״ח), and the Mishnah Berurah, later than the Rav: « וה״ה כשפתוחות למבוי » (משנה ברורה שע״ח ס״ק ב).
Point א — what is forbidden to the outer courtyards, and why (Shulchan Aruch HaRav 378:1)
The outer courtyards and the eruv placed in the middle one
What the Mechaber writes: « החיצונות אסורות זו עם זו והאמצעי׳ מותרת עם כל אחת מהן והן מותרות עמה » (שו״ע או״ח שע״ח:א), then « במה דברים אמורים כשנתנה אמצעי׳ עירובה בזו ועירובה בזו או שנתנו החיצונות עירובן באמצעי׳ בשני בתים אבל אם נתנו שתי החיצונו׳ עירובן באמצעי׳ בבית א׳ שלשתן מותרות זו עם זו » (שו״ע או״ח שע״ח:א). His seif א does not say in what respect the outer courtyards are forbidden, nor why an eruv placed in two houses does not join them.
What the Rav writes: « הֲרֵי הַחִיצוֹנוֹת אֲסוּרוֹת זוֹ עִם זוֹ, לְהוֹצִיא כֵּלִים שֶׁשָּׁבְתוּ בַּבָּתִּים מִזּוֹ לְזוֹ דֶּרֶךְ הָאֶמְצָעִית » (שו״ע הרב שע״ח:א); he gives the reason for the first case, « שֶׁאָז דִּיּוּרֵי הָאֶמְצָעִית בַּחִיצוֹנוֹת, שֶׁהָעֵרוּב הוּא מִשּׁוּם דִּירָה, וְאֵין דִּיּוּרֵי הַחִיצוֹנִים בָּאֶמְצָעִית, שֶׁהֲרֵי אֵין עֵרוּבָן בָּהּ » (שו״ע הרב שע״ח:א), and for the second, « שֶׁאָז גַּם כֵּן לֹא נִתְחַבְּרוּ דִּיּוּרֵי הַחִיצוֹנוֹת זוֹ עִם זוֹ, שֶׁדִּיּוּרֵי זוֹ הֵם בְּבַיִת זֶה וְדִיּוּרֵי זוֹ בְּזֶה, וְלָכֵן הֵן אֲסוּרוֹת זוֹ עַל זוֹ » (שו״ע הרב שע״ח:א); and when the eruv is placed in a single house: « הֲרֵי נִתְחַבְּרוּ דִּיּוּרֵי שְׁלָשְׁתָּן בְּבַיִת זֶה, וּמְעֹרָבוֹת הֵן, וְכֻלָּן מֻתָּרוֹת זוֹ עִם זוֹ » (שו״ע הרב שע״ח:א).
The difference: the Mechaber's seif א gives the cases and their rule; the Rav's text also says what the prohibition covers — taking out, from one outer courtyard to the other by way of the middle one, objects that rested in the houses — and grounds each case in the dwelling (dirah) that the eruv establishes where it is placed.
In the Beis Yosef and the Mechaber's commentators: the Beis Yosef already reports Rashi's explanation of both cases, « ופירש״י שנתנה אמצעית עירובה בזו ובזו דדמיא אמצעית כאילו דרה בהם ואין דיורי חיצונות באמצעית למימרא דכי הדדי נינהו » (בית יוסף או״ח שע״ח) and « ופרש״י דהשתא לא מחברן חיצונות בהדדי » (בית יוסף או״ח שע״ח), which the Be'er HaGolah takes up on the Mechaber's seif א. The Taz gives the reason for the first case and for the single house, « דאז דמיא אמצעית כאלו דרה בהן ואין דיורים חיצוניות באמצעית למימרא דכי הדדי נינהו אבל אם עירובן באמצעיות דאז דמי כאלו כולהו דרים באותו בית וחצר דההוא בית הוין » (ט״ז או״ח שע״ח ס״ק א), as does the Mishnah Berurah, later than the Rav, « דאז דיורי האמצעית בחיצונה ואין דיורי חיצונה באמצעית למהוי כולהו כי חדא אבל אם נתנו עירובן באמצעית הוי כאלו כולן דרין באמצעית » (משנה ברורה שע״ח ס״ק ג); on the two houses, the Mishnah Berurah writes « אבל אם נתנו בשני בתים לא משתרי החיצונות זו בזו כיון דלא מיחברי אהדדי » (משנה ברורה שע״ח ס״ק ד). On the single house, it further writes, referring to the Acharonim ([אחרונים]): « והיינו בכלי אחד או דמליא למנא ואייתר » (משנה ברורה שע״ח ס״ק ה) — the rule of the single vessel, which the Mechaber sets down for the eruv in Siman 366 (seif ד), to which it refers at ס״ק ד, and which the Beis Yosef reports here from the Maggid Mishneh, in the name of the Rashba (Level 2). The Rav's seif 1 writes « אֲבָל אִם נְתָנוּהוּ בְּבַיִת אֶחָד בָּאֶמְצָעִית » (שו״ע הרב שע״ח:א) without repeating it; he sets it down for the eruv in Siman 366: « צָרִיךְ לִתֵּן כָּל הָעֵרוּב בִּכְלִי אֶחָד, וְאִם חִלְּקוֹ וּנְתָנוֹ בִּשְׁנֵי כֵלִים — אֵינוֹ עֵרוּב…
Practical consequence: according to the Rav's text, when the three courtyards all open also onto a mavoy or onto the public domain, and each of the outer courtyards made an eruv with the middle one, without their making one with each other, and their eruv was not placed in one house of the middle one, one does not take out, from one outer courtyard to the other by way of the middle one, objects that rested in the houses; the middle one is permitted with each (378:1); see section 4, point ①.
Point ב — the right of passage, and a foot forbidden in its own place (Shulchan Aruch HaRav 378:2)
The inner courtyard's right of passage
What the Mechaber writes: « ופנימי׳ פתוחה לחיצונה והחיצונה למבוי ויש לפנימי׳ דריכת רגל על החיצונה » (שו״ע או״ח שע״ח:ב), and « עירבה חיצונה ולא פנימית או שעירבה כל אחת לעצמה ושכח א׳ מהפנימי׳ ולא עירב שתיהן אסורות » (שו״ע או״ח שע״ח:ב). His seif ב gives the cases without their reason; the rule « זה הכלל רגל האסור׳ במקומה אוסר׳ שלא במקומה ורגל המותרת אינה אוסר׳ שלא במקומה » (שו״ע או״ח שע״ח:ה) comes only at the end of his seif ה.
What the Rav writes: he says where the right of passage comes from, « וּפְנִימִית לְחִיצוֹנָה וְלֹא לְמָבוֹי, וְעַל יְדֵי כָךְ יֵשׁ לָהּ דְּרִיסַת הָרֶגֶל עַל הַחִיצוֹנָה, שֶׁאֵין לָהּ דֶּרֶךְ לָצֵאת לְמָבוֹי אֶלָּא דֶּרֶךְ הַחִיצוֹנָה » (שו״ע הרב שע״ח:ב), and gives the reason for each case in this very seif: for the inner one that is permitted, « הוֹאִיל וְיֵשׁ מְחִצָּה בֵּינֵיהֶן וְאֵין לַחִיצוֹנָה דְּרִיסַת הָרֶגֶל עָלֶיהָ » (שו״ע הרב שע״ח:ב); for both being forbidden, « שֶׁרֶגֶל הָאֲסוּרָה בִּמְקוֹמָהּ אוֹסֶרֶת שֶׁלֹּא בִמְקוֹמָהּ כְּשֶׁיֵּשׁ לָהּ שָׁם דְּרִיסַת הָרֶגֶל » (שו״ע הרב שע״ח:ב); when each made its own eruv, « וְרֶגֶל הַמֻּתֶּרֶת בִּמְקוֹמָהּ אֵינָהּ אוֹסֶרֶת שֶׁלֹּא בִמְקוֹמָהּ » (שו״ע הרב שע״ח:ב).
The difference: the rule of the forbidden foot and the permitted foot, which the Mechaber sets down at the end of his seif ה, the Rav gives already in seif 2, as the reason for its second and third cases, with, for the first of the two, the condition that the inner courtyard has a right of passage over the outer one; and he says where that right comes from: the inner one has no other way to the mavoy.
In the Tur and the Mechaber's commentators: the Tur already gives the reason for the second case: « שתיהן אסורות דכיון דפנימית אסורה בחצירה אוסרת גם על החיצונה » (טור או״ח שע״ח). The Taz reads into the Mechaber's seif ב what the Rav writes about the opening, « כלומר ולא למבוי ועי״כ יש לה דריסת הרגל על החיצונה דאין לה מקום לכנוס מהמבוי לפנימית אלא דרך החיצונה » (ט״ז או״ח שע״ח ס״ק ב), and, on the words « שתיהן אסורות » (שו״ע או״ח שע״ח:ב), gives the rule as the reason: « דקיימא לן רגל האוסרת במקומה אוסרת שלא במקומה » (ט״ז או״ח שע״ח ס״ק ג). The Mishnah Berurah, later than the Rav, writes it with the condition and with renunciation: « דקי״ל רגל האסורה במקומה אוסרת שלא במקומה כשיש לו דריסת רגל שם אם לא שיבטל את רשותו לבני הפנימית וגם רשות דריסת הרגל שיש לו בחיצונה לבני חיצונה » (משנה ברורה שע״ח ס״ק י״א); and when each made its own eruv: « דרגל המותרת במקומה אינה אוסרת שלא במקומה » (משנה ברורה שע״ח ס״ק י״ב).
Practical consequence: according to the Rav's text, when the inner courtyard opens only onto the outer one: if the inner one made its eruv and the outer one has no effective one, the inner one is permitted and the outer one does not prohibit it — and when the outer one's eruv is not effective because one of its residents forgot, he prohibits their courtyard to them until he renounces, « שֶׁהוּא אוֹסֵר עֲלֵיהֶם הֶחָצֵר עַד שֶׁיְּבַטֵּל רְשׁוּתוֹ » (שו״ע הרב שע״ח:ב); if the outer one made its eruv and the inner one did not, or one of its residents forgot, both are forbidden; if each made its own, each is permitted in its own courtyard (378:2); see section 4, point ②.
Point ג — a joint eruv: the order of the cases, and the inner courtyard that removes the outer one (Shulchan Aruch HaRav 378:3)
A joint eruv placed in one courtyard or the other
What the Mechaber writes: he begins with the eruv placed in the outer one, « עירבו ביחד ונתנו עירובן בחיצונה ושכח א׳ בין מן הפנימי׳ בין מן החיצונה ולא עירב שתיהן אסורות עד שיבטל רשותו » (שו״ע או״ח שע״ח:ג), then comes to the eruv placed in the inner one: « ואם נתנו עירובן בפנימי׳ ושכח א׳ מן הפנימי׳ ולא עירב שתיהן אסורות אבל אם שכח א׳ מן החיצונה ולא עירב פנימית מותרת » (שו״ע או״ח שע״ח:ג). His seif ג does not give the reason for these rules.
What the Rav writes: he begins with the eruv placed in the inner one, « עֵרְבוּ הַפְּנִימִית וְהַחִיצוֹנָה בְּיַחַד וְנָתְנוּ עֵרוּבָן בַּפְּנִימִית » (שו״ע הרב שע״ח:ג); if one of the inner one forgot, « וְשָׁכַח אֶחָד מִן הַפְּנִימִית וְלֹא עֵרֵב — שְׁתֵּיהֶן אֲסוּרוֹת, שֶׁכֵּיוָן שֶׁהַפְּנִימִית אֲסוּרָה בַּחֲצֵרָה, אוֹסֶרֶת גַּם הַחִיצוֹנָה שֶׁיֵּשׁ לָהּ עָלֶיהָ דְּרִיסַת הָרֶגֶל » (שו״ע הרב שע״ח:ג); if one of the outer one forgot, « חִיצוֹנָה אֲסוּרָה וּפְנִימִית מֻתֶּרֶת, דְּכֵיוָן שֶׁעֵרוּבָהּ אֶצְלָהּ, וְאֵין לַחִיצוֹנָה דְּרִיסַת הָרֶגֶל עָלֶיהָ אֶלָּא בִּשְׁבִיל עֵרוּבָהּ שֶׁמַּרְגִּילָהּ לְתוֹכָהּ, תְּסַלְּקֶנָּהּ מֵעָלֶיהָ וְתִשָּׁאֵר לְבַדָּהּ בְּעֵרוּבָהּ שֶׁאֶצְלָהּ, וְתִהְיֶה מֻתֶּרֶת » (שו״ע הרב שע״ח:ג); then he comes to the eruv placed in the outer one: « אֲבָל אִם נָתְנוּ עֵרוּבָן בַּחִיצוֹנָה, אֲפִלּוּ שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵרֵב — שְׁתֵּיהֶן אֲסוּרוֹת, שֶׁאַף אִם הַפְּנִימִית תְּסַלֵּק אֶת הַחִיצוֹנָה מֵעָלֶיהָ, הֲרֵי אֵין עֵרוּבָהּ אֶצְלָהּ, וּבַמֶּה יִתְעָרְבוּ דִּיּוּרֶיהָ » (שו״ע הרב שע״ח:ג).
The difference: both texts carry the same cases, in reverse order: the Mechaber begins with the eruv placed in the outer one, the Rav with the eruv placed in the inner one. When the eruv is placed in the inner one and the forgetting is by a resident of the outer one, the Rav further writes « חִיצוֹנָה אֲסוּרָה » (שו״ע הרב שע״ח:ג), which the Mechaber's seif ג does not say in words, but which the baraita and the Rambam already write: « וַחֲכָמִים אוֹמְרִים: בָּזוֹ, פְּנִימִית מוּתֶּרֶת וְחִיצוֹנָה אֲסוּרָה » (עירובין ע״ה ע״ב); « וְאִם הִנִּיחוּ עֵרוּבָן בַּפְּנִימִית וְשָׁכַח אֶחָד מִבְּנֵי הַחִיצוֹנָה וְלֹא עֵרֵב הַחִיצוֹנָה אֲסוּרָה וּפְנִימִית מֻתֶּרֶת בִּמְקוֹמָהּ » (הלכות עירובין פ״ד הכ״א) (level 2, section 5). The Rav also gives the reason for each rule: the inner one that has the eruv with it can remove the outer one; the one that does not have it with it gains nothing by doing so, since its eruv is not with it. For the eruv placed in the outer one, the Mechaber writes « בין מן הפנימי׳ בין מן החיצונה » (שו״ע או״ח שע״ח:ג) and adds « שתיהן אסורות עד שיבטל רשותו » (שו״ע או״ח שע״ח:ג); the Rav writes « אֲפִלּוּ שָׁכַח אֶחָד מִן הַחִיצוֹנָה » (שו״ע הרב שע״ח:ג), and his seif 3 does not mention the renunciation. In seif 2 he writes « שֶׁהוּא אוֹסֵר עֲלֵיהֶם הֶחָצֵר עַד שֶׁיְּבַטֵּל רְשׁוּתוֹ, כְּמוֹ שֶׁיִּתְבָּאֵר בְּסִמָּן ש״פ » (שו״ע הרב שע״ח:ב) of another case — each courtyard made its own eruv, and the resident of the outer one who forgot forbids his own courtyard. In Siman 381 he writes the renunciation for an eruv made together, without naming there the courtyard where the eruv was deposited. When a resident of the inner one forgot: « וְכֵן אִם עֵרְבוּ הַפְּנִימִית וְהַחִיצוֹנָה בְּיַחַד, וְשָׁכַח אֶחָד מֵהַפְּנִימִית וְלֹא עֵרֵב, שֶׁשְׁתֵּיהֶן אֲסוּרוֹת, כְּמוֹ שֶׁנִּתְבָּאֵר שָׁם — יָכוֹל הוּא לְבַטֵּל לָהֶם רְשׁוּתוֹ, וְצָרִיךְ שֶׁיְּבַטֵּל לְכָל אֶחָד מֵהַפְּנִימִית וּלְכָל אֶחָד מֵהַחִיצוֹנָה, וְאָז הוּא לְבַדּוֹ אָסוּר וְכֻלָּם מֻתָּרִים. When a resident of the outer one forgot, he writes in the same seif: « אֲבָל אִם שָׁכַח אֶחָד מִן הַחִיצוֹנָה וְלֹא עֵרֵב — אֵין צָרִיךְ לְבַטֵּל לְהַפְּנִימִית, שֶׁאַף אִם לֹא עֵרְבָה הַחִיצוֹנָה כְּלָל אֶלָּא הַפְּנִימִית לְבַדָּהּ, אֵין הַחִיצוֹנָה אוֹסֶרֶת אֶת הַפְּנִימִית, הוֹאִיל וְאֵין לָהּ דְּרִיסַת הָרֶגֶל עָלֶיהָ, וְאֵין הָעֵרוּב מַרְגִּילָהּ לְתוֹכָהּ » (שו״ע הרב שפ״א:ב), for the inner one can say to the outer one « לְתִקּוּנֵי שִׁתַּפְתִּיךָ עִמִּי וְלֹא לְעִוּוּתֵי » (שו״ע הרב שפ״א:ב). His reasons are those that his seif 3 of Siman 378 gives for the eruv placed in the inner one: the eruv that brings the outer one into the inner one, « שֶׁמַּרְגִּילָהּ לְתוֹכָהּ » (שו״ע הרב שע״ח:ג), and the inner one's removing the outer one — a reason he sets aside when the eruv is placed in the outer one: « שֶׁאַף אִם הַפְּנִימִית תְּסַלֵּק אֶת הַחִיצוֹנָה מֵעָלֶיהָ, הֲרֵי אֵין עֵרוּבָהּ אֶצְלָהּ » (שו״ע הרב שע״ח:ג). The Mishnah Berurah, later than the Rav, also writes, for the eruv placed in the inner one, that renouncing to the residents of the inner one alone does not help (ס״ק ט״ז), and gives this answer (ס״ק י״ז). For the eruv placed in the outer one, the Rav does not write, in Siman 378 or in Siman 381, to whom the one who forgot renounces, whether he is of the one courtyard or of the other.
In the Tur and the Mechaber's commentators: the Tur, which follows the same order as the Mechaber, already carries the reason, in terms very close to the Rav's: « דכיון שעירובה אצלה ואין לחיצונה דריסת רגל עליה אלא בשביל עירובה שמרגילה לתוכה יסלקנה מעליה ותשאר עירובה אצלה לבדה ותהיה מותרת » (טור או״ח שע״ח). The Taz writes it too: « דיכולה היא להסתלק מהחיצונה דאחדא לדשא באפה ומשתמשת דהא עירובה אצלה ואע״ג דעירוב החיצונה נתון בפנימי׳ אמר׳ לי׳ לתקוני שדרתיך ולא לעוותי » (ט״ז או״ח שע״ח ס״ק ד). The Mishnah Berurah, later than the Rav, gives the reason for the case of the eruv placed in the outer one, « ולא מהני בזה שיסתלקו מבני החיצונה ותסגור פתחה דהא ליתה לעירובה גבה ועיקר העירוב משום דירה דהוי כאלו דר במקום העירוב » (משנה ברורה שע״ח ס״ק י״ד), and reads « עד שיבטל רשותו » (שו״ע או״ח שע״ח:ג) as follows: « ר״ל לשתי החצירות וכמבואר בסי׳ שפ״א » (משנה ברורה שע״ח ס״ק ט״ו).
Practical consequence: according to the Rav's text, when the two courtyards made the eruv together: if it was placed in the inner one, the forgetting of a resident of the inner one forbids both courtyards, and the forgetting of a resident of the outer one forbids only the outer one; if it was placed in the outer one, even the forgetting of a resident of the outer one forbids both (378:3); see section 4, point ③.
Point ד — several who are like a single person (Shulchan Aruch HaRav 378:4)
The Rema's gloss in the Rav's seif
What the Mechaber writes: « אם יחיד דר בפנימי׳ ויחיד בחיצונה או שנים בחיצונה ועירבו אין היחיד שבפנימי׳ אוסר על החיצונה » (שו״ע או״ח שע״ח:ד); the Rema adds in his gloss: « וה״ה רבים שהם כיחיד ואינן צריכין לערב כדרך שנתבאר לעיל סימן ש״ע » (רמ״א או״ח שע״ח:ד).
What the Rav writes: he gives the reason for the first case, « הוֹאִיל וְהִיא רֶגֶל הַמֻּתֶּרֶת בִּמְקוֹמָהּ, שֶׁאֵין שָׁם מִי שֶׁיֶּאֱסֹר עָלָיו » (שו״ע הרב שע״ח:ד), then writes in his own seif what the gloss says, with an example: « וְהוּא הַדִּין רַבִּים שֶׁהֵם כְּיָחִיד, שֶׁאֵינָן אוֹסְרִים זֶה עַל זֶה וְאֵינָן צְרִיכִים לְעָרֵב בֵּינֵיהֶן, כְּגוֹן הָאָב עִם בָּנָיו שֶׁמְּקַבְּלִים מִמֶּנּוּ פְּרָס, וְכָל כַּיּוֹצֵא בָהֶם מִמַּה שֶּׁנִּתְבָּאֵר בְּסִמָּן ש״ע » (שו״ע הרב שע״ח:ד).
The difference: in the Mechaber, the case « וה״ה רבים שהם כיחיד » (רמ״א או״ח שע״ח:ד) is a gloss of the Rema; the Rav writes it in the body of his seif 4, and gives an example of it, a father with his sons who receive their portion from him. He also gives the reason for the first case, the foot permitted in its own place, and he also spells out the case: the two in the outer one made the eruv between themselves, « אוֹ אֲפִלּוּ שְׁנַיִם דָּרִים בַּחִיצוֹנָה וְעֵרְבוּ בֵּינֵיהֶם » (שו״ע הרב שע״ח:ד), and the resident of the inner one does not prohibit « אַף עַל פִּי שֶׁלֹּא עֵרְבוּ יַחַד » (שו״ע הרב שע״ח:ד).
Among the Mechaber's commentators: the Mishnah Berurah, later than the Rav, reads these details the same way into the Mechaber's seif ד, « היינו אותם השנים לבד אבל לא עם הפנימית » (משנה ברורה שע״ח ס״ק י״ח) and « ר״ל אף שלא עירבו יחד דרגל המותרת במקומה אינה אוסרת שלא במקומה » (משנה ברורה שע״ח ס״ק י״ט), with the same reason; and on the Rema's gloss it gives the same example as the Rav: « היינו שהיו בפנימית האב עם בניו שמקבלים ממנו פרס וכל כיוצא בהם ע״ש בסי׳ ש״ע » (משנה ברורה שע״ח ס״ק כ׳).
Practical consequence: according to the Rav's text, the single resident of the inner courtyard does not prohibit the outer courtyard, even though they did not make an eruv together, when the outer one has a single resident, or two who made an eruv between themselves; the same applies to several who are like a single person, such as a father with his sons who receive their portion from him (378:4); see section 4, point ④.
Point ה — three courtyards, a single resident in each (Shulchan Aruch HaRav 378:5)
Three courtyards one inside the other
What the Mechaber writes: « שלשה חצרו׳ זו לפנים מזו ויחיד בכל אחת אע״פ שרבים דורסים בחיצונה אינם אוסרים שכל אחת מותר׳ במקומה » (שו״ע או״ח שע״ח:ה); then « ואם היו שנים בפנימי׳ ולא עירבו הרי הם אוסרים על היחידים שבאמצעי׳ ושבחיצונה » (שו״ע או״ח שע״ח:ה); and he closes his seif with the general rule: « זה הכלל רגל האסור׳ במקומה אוסר׳ שלא במקומה ורגל המותרת אינה אוסר׳ שלא במקומה » (שו״ע או״ח שע״ח:ה).
What the Rav writes: « אַף עַל פִּי שֶׁשְּׁנַיִם הַפְּנִימִים עוֹבְרִים עַל הַחִיצוֹנָה — אֵינָן אוֹסְרִים עָלֶיהָ, מִפְּנֵי שֶׁהִיא רֶגֶל הַמֻּתֶּרֶת בִּמְקוֹמָהּ » (שו״ע הרב שע״ח:ה); then « וְאִם הָיוּ שְׁנַיִם בַּשְּׁלִישִׁית הַפְּנִימִית וְלֹא עֵרְבוּ בֵּינֵיהֶם — אוֹסְרִים עַל הַיְחִידִים שֶׁבָּאֶמְצָעִית וְשֶׁבַּחִיצוֹנָה, מִפְּנֵי שֶׁהִיא רֶגֶל הָאֲסוּרָה בִּמְקוֹמָהּ » (שו״ע הרב שע״ח:ה).
The difference: where the Mechaber writes « אע״פ שרבים דורסים בחיצונה » (שו״ע או״ח שע״ח:ה), the Rav writes that they are the two residents of the inner courtyards; and he names the courtyard of the two who did not make an eruv: the third, the inner one. The Mechaber's seif ה closes with the general rule; the Rav's seif 5 does not repeat it in that form, and gives each of its cases its reason by that rule, which he set down in seif 2 (point ב).
In the Tur: it already writes, like the Rav, that it is the two who pass through: « אף ע״פ ששניהם עוברים על החיצונה אין אוסרין עליה » (טור או״ח שע״ח).
Practical consequence: according to the Rav's text, in three courtyards one inside the other, with a single resident in each, the two of the inner courtyards who pass through the outer one do not prohibit it; if two live in the third, the inner one, without having made an eruv between themselves, they prohibit the single residents of the middle one and of the outer one (378:5); see section 4, point ⑤.

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 378, in the Chabad sensibility. Each point refers to its seif of the Rav, in the order of the text.
For the Chabad Chassid — Siman 378
- ① Three courtyards that open onto one another, and all of them also onto a mavoy or onto the public domain: when each of the outer courtyards made an eruv with the middle one, and not with each other, the middle one is permitted with each, and each with it; but one does not take out, from one outer courtyard to the other by way of the middle one, objects that rested in the houses — whether the middle one gave its eruv in each of them, or the outer ones gave theirs in the middle one, each in a different house. If they gave it in one house of the middle one, all three are permitted with one another (378:1). Seif 1 does not repeat here the rule of the single vessel, which the Rav sets down for the eruv in Siman 366: the whole eruv in one vessel — divided deliberately into two vessels, it is not an eruv —; when the first vessel is full, the surplus may be put in a second one, both in one house (366:9; section 2, point א). Reference: Shulchan Aruch HaRav 378:1; 366:9.
- ② Two courtyards, one inside the other: the inner one opens only onto the outer one, and so has a right of passage over it. If the inner one made its eruv and the outer one did not, or its eruv is not effective, for example because one of its residents forgot to make the eruv — he prohibits the courtyard to them until he renounces his domain (the Rav refers to Siman 380) —, the inner one may take out into its courtyard the objects that rested in the houses, and the outer one does not prohibit it. If the outer one made its eruv and the inner one did not, or one of the inner one forgot, both are forbidden; when the inner one made no eruv at all, the Rav writes in Siman 381 that it can renounce in favor of the outer one its right to use it and pass through it, so that it neither uses it nor passes through it except when it needs to go out and come in, and the outer one becomes permitted (381:2). If each made its own, each is permitted in its own courtyard, and the inner one does not prohibit the outer one (378:2). Reference: Shulchan Aruch HaRav 378:2; 381:2.
- ③ A joint eruv of the two courtyards: if it was placed in the inner one and one of the inner one forgot, both are forbidden; if one of the outer one forgot, the outer one is forbidden and the inner one permitted, for it can remove the outer one. If it was placed in the outer one, even if one of the outer one forgot, both are forbidden (378:3). In Siman 381 the Rav writes, of an eruv made together, without naming the courtyard where it was deposited: when a resident of the inner one forgot, he can renounce his domain to each of the residents of the inner one and of the outer one: then he alone is forbidden, and all the others are permitted; if he renounces only in favor of the inner one, the inner one too is forbidden, for the eruv that the outer one made with it brings the outer one into it, as if it lived there; when a resident of the outer one forgot, he need not renounce in favor of the inner one, since even when only the inner one made the eruv, the outer one does not prohibit it, having no right of passage over it, the eruv does not bring it in, and the inner one can say to it « לְתִקּוּנֵי שִׁתַּפְתִּיךָ עִמִּי וְלֹא לְעִוּוּתֵי » (שו״ע הרב שפ״א:ב). These reasons are those the Rav gives in Siman 378 for the eruv placed in the inner one (378:3, above). For the eruv placed in the outer one, he does not write, in Siman 378 or in Siman 381, to whom the one who forgot renounces: consult your Rav. Reference: Shulchan Aruch HaRav 378:3; 381:2.
- ④ A single resident in the inner courtyard: he does not prohibit the outer one, even though they did not make an eruv together, when the outer one has a single resident, or two who made an eruv between themselves; likewise several who are like a single person, such as a father with his sons who receive their portion from him, and every similar case explained in Siman 370 (378:4). Reference: Shulchan Aruch HaRav 378:4.
- ⑤ Three courtyards one inside the other: with a single resident in each, the two of the inner courtyards who pass through the outer one do not prohibit it; if two live in the third, the inner one, without having made an eruv between themselves, they prohibit the single residents of the middle one and of the outer one (378:5).
