Daat HaRav — The Shulchan Aruch HaRav on Siman 379

Two courtyards and houses between them: when three houses between them are open to one another and all wish to make the eruv together, the eruv placed in the middle house, none of the three houses needing to give bread (379:1); when each courtyard made its eruv for itself and placed it in the house next to the other courtyard: they have not acquired the eruv (379:2). The 2 seifim of the Shulchan Aruch HaRav, compared with the 2 seifim of the Mechaber.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has 2 seifim, and the Mechaber's Shulchan Aruch has 2 as well, divided the same way: the Rav's seif 1 corresponds to the Mechaber's seif א, and seif 2 to seif ב. The references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.

This page gathers, for Siman 379, the full text of the Rav with its translation, where his text differs from that of the Mechaber, and the practical conduct that follows from it.

The law of courtyards and the houses between them; it contains 2 seifim:

Two courtyards and three houses between them, open to one another, and all of them wish to make the eruv together: the resident of this courtyard comes through the house open to his courtyard and places his eruv in the middle house, and he makes the house open to his courtyard like a gatehouse (beis sha'ar) of his courtyard, to pass through it to the middle one; and likewise the resident of the other courtyard comes through the house open to it, places the eruv in the middle one, and makes the house open to his courtyard like a gatehouse of his courtyard. And none of these three houses needs to give bread for the eruv: for the two adjoining the courtyards are like a gatehouse, and a gatehouse does not prohibit; and the middle one is the house in which the eruv is placed, and it need not give the bread. And some say (yesh omrim) that even if they placed the eruv in one of the houses adjoining the courtyards, or even in one of the houses of the courtyards themselves, these three houses need not give bread, because they have all become like a gatehouse for that courtyard which carries its eruv through them to the other courtyard.

Two courtyards and two houses between them, and they did not make the eruv together but each one for itself; and each courtyard did not place its eruv in the house open to it, but made it a gatehouse: [its resident] came through the house next to him and placed his eruv in the house adjoining the other courtyard; and the resident of the second courtyard did likewise, he too placed his eruv in the house adjoining the other courtyard. They have not acquired the eruv, for each one placed his eruv in the gatehouse of another courtyard, and it is not an eruv, as was explained in Siman 366.

2 · The Rav's text and the Mechaber's

Where the Rav's text differs from the Mechaber's seif

Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 2 seifim, designated by their letter) and the corresponding seif of the Shulchan Aruch HaRav (its own numbering, also 2 seifim, divided the same way), and notes only what the comparison of the two texts shows. A point noted here is not thereby peculiar to the Rav: the page names where it is already found — Rashi and Tosafos on the Gemara, the Magen Avraham, before him; the Mishnah Berurah, later than the Rav — and where a commentator reads the point in the Mechaber's own words, it says so.

Not listed here as separate points are details of the Rav's text that make explicit the corresponding seif of the Mechaber, nor passages where he writes in other words what that seif says. The Rav writes that the resident makes the house open to his courtyard a gatehouse « לַעֲבוֹר דֶּרֶךְ עָלָיו לְהָאֶמְצָעִי » (שו״ע הרב שע״ט:א); he writes that none of the three houses needs to give bread, « וְאֵין אֶחָד מִג׳ בָּתִּים אֵלּוּ צָרִיךְ לִתֵּן פַּת לָעֵרוּב » (שו״ע הרב שע״ט:א) — the Mechaber writes it too, twice: « וא״צ ליתן פת » (שו״ע או״ח שע״ט:א) —, and gives its reason: « כִּי שְׁנַיִם הַסְּמוּכִים לַחֲצֵרוֹת הֵם כְּבֵית שַׁעַר, וּבֵית שַׁעַר אֵינוֹ אוֹסֵר » (שו״ע הרב שע״ט:א). Rashi already writes both on the Gemara: « ועשה בית הפתוח לו כבית שער לעבור דרך עליו לאמצעי » (רש״י עירובין ע״ה ע״ב), and « אין אחד מדיורי הבתים האלה צריך ליתן פת אלו משום בית שער ואמצעי משום בית שמניחין בו עירוב » (רש״י עירובין ע״ה ע״ב). The Mishnah Berurah, later than the Rav, reads the Mechaber's seif in this way: « אחרי שבני החצר מוליכין עירובן דרך עליה לאמצעית » (משנה ברורה שע״ט ס״ק ג); and it explains « ומותרים בשלשתן » (שו״ע או״ח שע״ט:א) as permission to carry in those houses, and [for the people of the] houses in [the courtyards], although they did not give a share in the eruv: « שהם מותרים לטלטל באותן הבתים והבתים בהן אע״פ שלא נתנו חלק בעירוב » (משנה ברורה שע״ט ס״ק ב). The Rav, for his part, does not have the words « ומותרים בשלשתן » (שו״ע או״ח שע״ט:א). In their place he writes, as we have seen, that none of the three houses needs to give bread, because the two houses adjoining the courtyards are like a gatehouse and « וּבֵית שַׁעַר אֵינוֹ אוֹסֵר » (שו״ע הרב שע״ט:א); and « וְהָאֶמְצָעִי הוּא בַּיִת שֶׁמַּנִּיחִים בּוֹ אֶת הָעֵרוּב » (שו״ע הרב שע״ט:א). In siman 370, he writes: « הַדָּר בְּבֵית שַׁעַר, אַף עַל פִּי שֶׁיֵּשׁ לוֹ ד׳ מְחִצּוֹת, כֵּיוָן שֶׁרַבִּים עוֹבְרִים דֶּרֶךְ שָׁם לְבָתֵּיהֶם — אֵין עָלָיו תּוֹרַת בַּיִת אֶלָּא תּוֹרַת חָצֵר, וְאֵין צָרִיךְ לְעָרֵב עִם שְׁאָר הַבָּתִּים » (שו״ע הרב ש״ע:א) — one who lives in a gatehouse, although it has four walls, since many pass through there to their houses, does not have the status of a house but that of a courtyard, and need not make the eruv with the other houses; and, in the case of the ten houses, he sets in the same siman the limit « וּבֵית שַׁעַר שֶׁל בַּיִת אֶחָד אֵינוֹ מִתְבַּטֵּל מִתּוֹרַת בַּיִת » (שו״ע הרב ש״ע:ח) — the gatehouse of a single house does not lose the status of a house (Level 2, section 2). The comparison of the two texts shows no rule that the Mechaber writes and the Rav sets aside: the difference is one of wording. The Rav writes the permission through « וּבֵית שַׁעַר אֵינוֹ אוֹסֵר » (שו״ע הרב שע״ט:א), and, in siman 370, through the courtyard status of the gatehouse, whose resident need not make the eruv with the other houses (שו״ע הרב ש״ע:א). The Rav specifies that each courtyard « לֹא נָתְנָה עֵרוּבָהּ בַּבַּיִת הַפָּתוּחַ לָהּ אֶלָּא עֲשָׂאַתּוּ בֵּית שַׁעַר » (שו״ע הרב שע״ט:ב); Rashi already writes this on the Gemara: « וכל חצר לא הניחה עירובה בבית הפתוח לה אלא עשאתו בית שער » (רש״י עירובין ע״ו ע״א). The Rav adds to the reason « וְאֵינוֹ עֵרוּב, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שס״ו » (שו״ע הרב שע״ט:ב); in Siman 366 he writes of the eruv « אֵין מַנִּיחִין אוֹתוֹ אֶלָּא בְּבַיִת הָרָאוּי לְדִירָה, אֲבָל לֹא בְּאַכְסַדְרָה וּמִרְפֶּסֶת וְלֹא בְּבֵית שַׁעַר » (שו״ע הרב שס״ו:ה), and the Mechaber writes this too in his Siman 366: « לאפוקי בית שער אכסדר׳ ומרפסת » (שו״ע או״ח שס״ו:ג). The same seif of the Mechaber carries a gloss of the Rema, « והמנהג בזמן הזה להניח העירוב בבית הכנסת וכן נהגו הקדמונים ונראה לי הטעם דעירובין שלנו יש להם דין שתוף ואין צריך להניח בבית דירה וע׳ לקמן סי׳ שפ״ו ושפ״ז » (רמ״א או״ח שס״ו:ג), who gives this reason as his own ("it seems to me") and refers to simanim 386 and 387; and the Rav, in the next seif of his Siman 366, writes « וְהַמִּנְהָג בִּזְמַן הַזֶּה לְהַנִּיחַ הָעֵרוּב בְּבֵית הַכְּנֶסֶת, אַף עַל פִּי שֶׁבֵּית הַכְּנֶסֶת אֵינוֹ רָאוּי לְדִירָה מִפְּנֵי קְדֻשָּׁתוֹ » (שו״ע הרב שס״ו:ו) — the custom, in his time, is to place the eruv in the synagogue, although the synagogue is not fit for dwelling, because of its sanctity: the Rav writes this himself — and reports the same reason in the name of "some": « וְיֵשׁ שֶׁנָּתְנוּ טַעַם לַמִּנְהָג, לְפִי שֶׁעֵרוּבִין שֶׁלָּנוּ יֵשׁ לָהֶם דִּין שִׁתּוּף מְבוֹאוֹת » (שו״ע הרב שס״ו:ו). In the same seif, he also writes: « וּמְקוֹמוֹת שֶׁאֵין לָהֶם לֶחִי אוֹ קוֹרָה לִמְבוֹאוֹתֵיהֶם, אוֹ שֶׁבֵּית הַכְּנֶסֶת אֵינוֹ בְּמָבוֹי הַמְּתֻקָּן בְּלֶחִי אוֹ קוֹרָה, שֶׁאֵין מַנִּיחִים שָׁם עֵרוּב בְּבֵית הַכְּנֶסֶת, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שס״ה » (שו״ע הרב שס״ו:ו) — places whose mavo'os have neither a lechi nor a korah, or whose synagogue is not in a mavoy fixed with a lechi or a korah, where the eruv is not placed in the synagogue, as explained in siman 365. This clause describes those places and refers, for the rule, to siman 365; the Rav's sentence goes on with a permission: « אַף עַל פִּי כֵן מֻתָּרִים לְטַלְטֵל בְּבֵית הַכְּנֶסֶת… » (שו״ע הרב שס״ו:ו) — nevertheless, one may carry in the synagogue. The Tur gives a second reason, « ואם נחשוב אותם כבית גמור הרי כל החצר מפסיק בית בינו ובין הבית שנתן בו עירובו » (טור או״ח שע״ט), which the Magen Avraham reports in the Tur's name: « ואם נחשוב אותו כבית גמור א״כ כל חצר מפסיק בינו ובין הבית שנתן שם עירובו » (מגן אברהם שע״ט ס״ק ב); the Rav's text, like the Mechaber's seif ב, gives only the first. On our siman, the Eliyah Rabbah, commenting on the Levush, writes in the name of the Perishah: « מכאן יש סתירה למנהג קצת מקומות שנתנו עירובין בבית הכנסת ובתי כותים הם מפסיקן ביניהם ובין העירוב ואין יכולין לטלטל לבית הכנסת למקום עירוב » (אליה רבה שע״ט ס״ק ב) — from here there is a contradiction to the custom of some places that placed the eruvin in the synagogue while houses of Kutim [non-Jews] interpose between them and the eruv, and they cannot carry to the synagogue, the place of the eruv. What this custom changes in the case of seif 2 of our siman, this page does not decide: consult your Rav.

Point א — an eruv placed in an adjoining house, or in a house of the courtyards (Shulchan Aruch HaRav 379:1)

An eruv placed elsewhere than in the middle house

What the Mechaber writes: « והאמצעי הוא בית שמניחין בו עירוב וא״צ ליתן פת » (שו״ע או״ח שע״ט:א). His seif א speaks only of an eruv placed in the middle house.

What the Rav writes: after the same rule, he reports: « וְיֵשׁ אוֹמְרִים שֶׁאֲפִלּוּ נָתְנוּ עֵרוּב בְּאֶחָד מִבָּתִּים הַסְּמוּכִים לַחֲצֵרוֹת, אוֹ אֲפִלּוּ בְּאֶחָד מִבָּתֵּי הַחֲצֵרוֹת עַצְמָן — אֵין ג׳ בָּתִּים אֵלּוּ צְרִיכִים לִתֵּן פַּת » (שו״ע הרב שע״ט:א), with the reason « לְפִי שֶׁנַּעֲשׂוּ כֻלָּם כְּבֵית שַׁעַר לְאוֹתָהּ חָצֵר הַמּוֹלֶכֶת עֵרוּבָהּ דֶּרֶךְ עֲלֵיהֶם לְחָצֵר הָאַחֶרֶת » (שו״ע הרב שע״ט:א).

The difference: the Mechaber's seif א does not report this view; the Rav reports it, under « וְיֵשׁ אוֹמְרִים » (שו״ע הרב שע״ט:א), after the rule he writes without attribution, and he does not write in this seif whether one may rely on this view. The view is not peculiar to the Rav: it is that of Tosafos, « נראה דאפי׳ יתנו העירוב באחד הבתים הסמוכים לחצירות או אפילו באחד מבתי החצירות אלו ג׳ בתים אין צריכין ליתן עירוב דנעשו כולם בית שער לאותה חצר המוליכה עירוב דרך עליהן לחצר אחרת » (תוספות עירובין ע״ו ע״א).

Among the Mechaber's commentators: the Magen Avraham reports it in the name of Tosafos, on the Mechaber's words « בבי׳ שבאמצע » (שו״ע או״ח שע״ט:א): « והתוס׳ כתבו דאפי׳ נתנו העירוב באחד מבתים הסמוכים לחצירות או באחד מבתי החצר אלו הג׳ בתים א״צ ליתן עירוב דנעשו כלם בית שער לאותה חצר המולכת עירוב דרך עליהם לחצר אחרת » (מגן אברהם שע״ט ס״ק א). The Mishnah Berurah, later than the Rav, reports it too: « ויש שכתבו דה״ה אם נתנו שניהם העירוב באחד מבתים הסמוכים לחצרות או באחד משאר בתים שבשתי החצרות אלו השלשה בתים אין צריכין ליתן עירוב » (משנה ברורה שע״ט ס״ק ג).

Practical consequence: the Rav's text reports this view under « וְיֵשׁ אוֹמְרִים » (שו״ע הרב שע״ט:א), without writing in this seif whether one may rely on it; the Mishnah Berurah reports it under « ויש שכתבו » (משנה ברורה שע״ט ס״ק ג). For an eruv placed elsewhere than in the middle house: consult your Rav. See section 4, point ②.

The practical Chabad conduct

Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 379, in the Chabad sensibility. Each point refers to its seif of the Rav, in the order of the text.

For the Chabad Chassid — Siman 379

  • ① Two courtyards and three houses: two courtyards have three houses between them, open to one another, and all wish to make the eruv together. The resident of each courtyard passes through the house open to his courtyard, which he makes like a gatehouse of his courtyard, and places his eruv in the middle house; none of the three houses needs to give bread for the eruv: the two houses adjoining the courtyards are like a gatehouse, which does not prohibit, and the middle one is the house in which the eruv is placed (379:1). Reference: Shulchan Aruch HaRav 379:1.
  • ② An eruv placed elsewhere than in the middle house: the Rav reports a view, introduced by yesh omrim (some say), that even if the eruv was placed in one of the houses adjoining the courtyards, or even in one of the houses of the courtyards themselves, these three houses need not give bread, because they have all become like a gatehouse for the courtyard that carries its eruv through them to the other courtyard; he does not write in this seif whether one may rely on it (379:1). Consult your Rav (what the commentators on the Mechaber write about it is in section 2, point א). Reference: Shulchan Aruch HaRav 379:1.
  • ③ Two courtyards and two houses: two courtyards have two houses between them, and did not make the eruv together but each one for itself. If each courtyard did not place its eruv in the house open to it but made it a gatehouse, and its resident placed his eruv in the house adjoining the other courtyard, and the resident of the other courtyard did likewise, they have not acquired the eruv: each placed his eruv in the gatehouse of another courtyard, and it is not an eruv (379:2).
