summary: title of the siman, then seif א. One who lives with a non-Jew (akum) in a courtyard: [the non-Jew] does not forbid [carrying] to him, until two Jews live in two houses and forbid [carrying] to each other; then the non-Jew forbids them, and it does not help for the non-Jew to renounce his domain: they must rent [his domain] from him. Gloss of the Rema: a Jew who rented or lent his house to a non-Jew: [the non-Jew] does not forbid him, for he did not rent or lend him his house so that he should forbid him [reference as printed: המגיד פרק ב׳]; but if the house belongs to the non-Jew, and a Jew rented it from him, and the non-Jew lives in the house with him, the rental of the house does not count as the rental [required] for the eruv [א״ז]; a Jew who lent or rented a house to his fellow (in a place where non-Jews live), even though he keeps a hold (tefisah) in the house, it does not help, and they must rent from the non-Jew [ב״י בשם מצאתי כתוב].

summary: If the Jews renounced their domain in favor of one of them, so that he be counted as alone with the non-Jew, it does not help.

summary: If the non-Jew has no right of passage (derisas regel) over the Jews, he does not forbid; for example, two courtyards open to each other, without a right of passage of one over the other, in one of which a non-Jew lives and in the other two Jews or more: one brings in and takes out [objects] from one courtyard to the other on Shabbos, through the window between them, and there is no need to rent from the non-Jew.

summary: One who rents from the non-Jew without specifying (stam): it works; there is no need to explain to him that it is to permit carrying, nor to write anything about the rental.

summary: One rents from a non-Jew even for less than the value of a perutah. In small print, without the word הגה: and it is permitted to rent from him on Shabbos [reference as printed: מרדכי ריש פרק הדר] (and see below siman 383).

summary: As long as the non-Jew does not retract, the rental works, even for a long time. Parenthesis in small print, without the word הגה: (and he cannot retract his rental until he returns the money) [reference as printed: ב״י בשם רש״י פרק הדר].

summary: If they rented from the non-Jew for a fixed period, when the period ends one must rent a second time, and one must make the eruv again, for the first eruv does not revive.

summary: If they rented from the non-Jew for a fixed period, and within that period the non-Jew rented his dwelling to another, the first rental suffices.

summary: Five who live in one courtyard: [one of them] rents from the non-Jew on behalf of all of them.

summary: If they rented from him against his will, it does not help, even though he used to rent previously.

summary: But from his wife, or from his hired worker or seasonal worker (sechiro u'lekito), one rents even if he protests. Parenthesis in small print, without the word הגה: (and the hired worker of the householder's hired or seasonal worker is like the hired worker of the householder himself) [reference as printed: ריב״ש סי׳ תכ״ז].

summary: If he does not want to rent, one of the residents of the courtyard should become close to him until he lends him his domain, so that he has the right to put something there; for he is then like his hired or seasonal worker, and he rents [the domain] out without the non-Jew's knowledge. And some say that he need not rent it out, but gives his share of the eruv, and that suffices.

summary: If he assigned him a [particular] place in the house he lends him: since he is not like his agent in the whole house, it does not help.

summary: If they rented from his hired or seasonal worker for a [fixed] period, even if he dismissed him within the period from being his hired or seasonal worker, they are permitted until the end of the period; but if they rented from him without specifying, once he dismissed him, the rental is void. Gloss of the Rema: and the same applies if they rented from the king's treasurer and he was entirely removed from the king; but if he was removed only from the treasury and still eats the king's allowance (peras), he is still called his hired or seasonal worker, and one may rent from him; and therefore the first rental also still stands [reference as printed: ב״י בשם תשובת רשב״א].

summary: If a Jew and a non-Jew live in one house, one must rent from the non-Jew and make the eruv with the Jew. Gloss of the Rema: if each has a dwelling of his own; and the same applies to two (non-Jews) who live thus in one house: one must rent (from both) [reference as printed: ב״י בשם הג״א].

summary: If the non-Jew has five Jewish hired or seasonal workers living in his house, their dwelling is not counted as a dwelling such that they forbid one another. Parenthesis in small print, without the word הגה: (for the rental [printed word: « שכירות »] of a non-Jew does not forbid, if one rented from the householder) [reference as printed: ב״י]. [The Mishnah Berurah, ס״ק נ״ה, reads « ושכירו »: and his hired worker does not forbid.]

summary: Two courtyards, one inside the other: a Jew and a non-Jew in the inner one and a Jew in the outer one; or a Jew and a non-Jew in the outer one and a Jew in the inner one; and even a non-Jew in the inner one and two Jews in the outer one: he forbids. And there is one who says that even a non-Jew in the inner one and a single Jew in the outer one, he forbids.

summary: A non-Jew who rented his house to a fellow non-Jew: if he keeps some hold (tefisah) in the house — that he has the right to put utensils there —, one may rent from him; and if he keeps no hold at all: if the lessor can remove the lessee within his term, one may rent from him; and if not, it does not help, unless one rents from the lessee. Gloss of the Rema: and the same applies to a person (ish a׳) who has a hold in the house: one may rent from him, for he is no less than a hired or seasonal worker [reference as printed: ב״י בשם ריב״ש סי׳ תנ״ז].

summary: A courtyard in which a Jew and a non-Jew live; and the house of [another] Jew is next to this one's house, it does not open onto the courtyard, and there are windows between them: he cannot make an eruv with him through the window between them in order to take his utensils out through his neighbor's house, which opens onto the courtyard; but if there is an open doorway (pesach) between them, it is permitted. And there is one who says that even if there is an open doorway between them, it is forbidden.

summary: A courtyard in which Jews and a non-Jew dwell, with windows open from the house of one Jew to the house of the other, and they made the eruv through the windows: although they are permitted to carry from house to house through the windows, they are forbidden to carry from house to house through the doorways (pesachim), because of the non-Jew, until there is a rental [of his domain]. Gloss of the Rema: a ship with many Jews on it, who have separate quarters there: they must make an eruv and rent the domain from the non-Jew who owns the ship, or include it in the fare [reference as printed: ב״י בשם שבולי לקט]; and see above siman 366, seif ב.

1. The Mishnah and the decree: why the non-Jew forbids, and why one must rent (seifim א-ג)

The Mishnah opens the chapter רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: לְעוֹלָם אֵינוֹ אוֹסֵר עַד שֶׁיְּהוּ שְׁנֵי יִשְׂרְאֵלִים אוֹסְרִין זֶה עַל זֶה » (עירובין ס״א ע״ב) — one who lives with a non-Jew in a courtyard, or with one who does not acknowledge the eruv: he forbids [carrying] to him; Rabbi Eliezer ben Yaakov says: he never forbids, until two Jews forbid each other. The Beis Yosef reports the ruling: « ובגמרא אמרינן דהלכה כר׳ אליעזר בן יעקב דאמר לעולם אינו אוסר עד שיהו שני ישראלים אוסרים זה על זה ואע״ג דאיכא התם מאן דפליג ואמר דלא דרשינן לה בפירקא כל הפוסקים פסקו דהלכה כראב״י » (בית יוסף או״ח שפ״ב) — in the Gemara we say that the halachah follows Rabbi Eliezer ben Yaakov, who says that he never forbids until two Jews forbid each other; and although someone there disagrees and says that it is not expounded in the public lecture, all the poskim ruled like him. Seif א writes accordingly.

יסוד — why does the non-Jew forbid? Abaye: « דְּכוּלֵּי עָלְמָא דִּירַת גּוֹי לֹא שְׁמָהּ דִּירָה, וְהָכָא בִּגְזֵירָה שֶׁמָּא יִלְמַד מִמַּעֲשָׂיו קָא מִיפַּלְגִי » (עירובין ס״ב ע״א) — according to all, a non-Jew's dwelling is not called a dwelling; here they disagree about the decree lest he learn from his deeds. וְרַבִּי מֵאִיר סָבַר: זִמְנִין דְּמִקְּרֵי וְדָיֵיר » (עירובין ס״ב ע״א) — Rabbi Eliezer ben Yaakov holds that, since the non-Jew is suspected of bloodshed, two, who commonly live [with him], were included in the decree; one alone is not common, and the Sages did not decree for him; Rabbi Meir holds that sometimes it happens that he lives [so]. וְגוֹי לָא מוֹגַר » (עירובין ס״ב ע״א) — the Sages said: neither an eruv nor the renunciation of one's domain helps where there is a non-Jew, until he rents; and the non-Jew does not rent. Rashi explains what the decree aims at: « הטריחוהו והפסידוהו חכמים לישראל הדר עמו כדי שיקשה בעיניו ליתן שכר בכל שבת ושבת ויצא משם » (רש״י עירובין ס״ב ע״א) — the Sages imposed this trouble and loss on the Jew who lives with him, so that it be hard for him to pay rent every Shabbos and he leave the place.

Renouncing in favor of one (seif ב). Residents of an alley where a non-Jew who refused to rent was living came to Abaye, who told them: « זִילוּ בַּטִּילוּ רְשׁוּתַיְיכוּ לְגַבֵּי חַד, הָוֵה לֵיהּ יָחִיד בִּמְקוֹם גּוֹי, וְיָחִיד בִּמְקוֹם גּוֹי לָא אָסַר. אֲמַר לְהוּ: כׇּל בַּטּוֹלֵי רְשׁוּתַיְיהוּ גַּבֵּי חַד, מִילְּתָא דְלָא שְׁכִיחָא הִיא, וּמִילְּתָא דְלָא שְׁכִיחָא, לָא גְּזַרוּ בַּהּ רַבָּנַן » (עירובין ס״ג ע״ב) — go and renounce your domains in favor of one: he will be a single [Jew] where there is a non-Jew, and a single one where there is a non-Jew does not forbid; they objected that the reason is only that it is not common [for a single Jew] to live [with him], while here they do live there; he answered that all renouncing in favor of one is not common, and for what is not common the Sages did not decree. Rav Huna son of Rav Yehoshua reported this teaching before Rava, who said: « אִם כֵּן, בִּיטַּלְתָּ תּוֹרַת עֵירוּב מֵאוֹתוֹ מָבוֹי » (עירובין ס״ד ע״א) — if so, you have abolished the law of eruv from that alley. The Mishnah Berurah, on seif ב: « דא״כ בטלת תורת עירוב מאותו מבוי שהרי לא יצטרכו לשכור כלל ויוכלו תמיד לבטל וישכח תורת עירוב » (משנה ברורה שפ״ב ס״ק י״ג) — for then the law of eruv would be abolished from that alley: they would never need to rent, they could always renounce, and the law of eruv would be forgotten.

Two courtyards side by side (seif ג). The Biur Halachah, on « וא״צ לשכור מהעכו״ם », reports that the Beis Yosef cites at the end of the siman another opinion, in the name of the Mordechai, and that the seif here holds like the Rosh, who permits even through a doorway. The Mordechai adds a second point: « אבל אם פתחיהם יוצאות למבוי אחת שאוסרים זה על זה במבוי עד שישכרו רשותו [וכגון דאיכא שתי חצרות של ישראל] בזה אסורים לטלטל מחצר לחצר בכל גווני אפילו דרך כותל למעלה » (ביאור הלכה שפ״ב) — but if their doorways open onto one alley, where they forbid each other until they rent his domain [for example if there are two courtyards of Jews], it is forbidden to carry from courtyard to courtyard in any way, even over the top of the wall. On this point, the Biur Halachah notes that, from the words of the Vilna Gaon (ס״ק ח), the seif speaks of a case where they forbid each other the alley, and the Mechaber nonetheless permits; then he writes: « ומ״מ לדינא נראה דיש להחמיר בכגון זה עכ״פ להוציא דרך חלון שהוא למטה מעשרה ומכ״ש דרך פתח מאחר שהב״ח [והעתיקו גם הא״ר] והחכ״צ נוטים לדעת המרדכי בזה אפילו בחלון שהוא למעלה מי׳ » (ביאור הלכה שפ״ב) — nevertheless, for the halachah, it seems one should be stringent in such a case, at least for carrying out through a window below ten [tefachim], and all the more so through a doorway, since the Bach [copied also by the Eliyah Rabbah] and the Chacham Tzvi lean here toward the Mordechai's opinion, even for a window above ten. The Rav's text on this seif is at Level 4, point א. This page does not decide: consult your Rav.

2. A weak rental, for less than a perutah, and on Shabbos (seifim ד-ה)

Seif ד is satisfied with an unspecified rental, without explanation and without a document. וְרַב שֵׁשֶׁת אָמַר: שְׂכִירוּת רְעוּעָה » (עירובין ס״ב ע״א) — Rav Chisda says: a firm rental; Rav Sheshes says: a weak rental; and, after rejecting another explanation, it defines these words: « בְּרִיאָה — בְּמוּהְרְקֵי וָאבוּרְגָנֵי, רְעוּעָה — בְּלָא מוּהְרְקֵי וָאבוּרְגָנֵי » (עירובין ס״ב ע״א) — firm, with מוהרקי and אבורגני; weak, without them (the Beis Yosef reports several explanations of these terms). The Beis Yosef reports the ruling: « וכתב הרא״ש דהלכה כדברי המיקל בעירוב » (בית יוסף או״ח שפ״ב) — the Rosh writes that the halachah follows the lenient view in matters of eruv. And the Mishnah Berurah, on seif ד: « דדי בשכירות חלושה ולא בעינן שכירות בריאה » (משנה ברורה שפ״ב ס״ק כ) — a weak rental is enough; a firm rental is not required.

For less than the value of a perutah (seif ה), the Gemara: « הֲווֹ יוֹדְעִין שֶׁשּׂוֹכְרִין מִן הַגּוֹי אֲפִילּוּ בְּפָחוֹת מִשָּׁוֶה פְּרוּטָה. וְאָמַר רַבִּי חִיָּיא בַּר אַבָּא אָמַר רַבִּי יוֹחָנָן: בֶּן נֹחַ נֶהֱרָג עַל פָּחוֹת מִשָּׁוֶה פְּרוּטָה, וְלֹא נִיתָּן לְהִשָּׁבוֹן » (עירובין ס״ב ע״א) — know that one rents from a non-Jew even for less than the value of a perutah; and Rabbi Chiya bar Abba said in the name of Rabbi Yochanan: a descendant of Noach is put to death for less than the value of a perutah, and [what he took] is not subject to restitution.

Renting on Shabbos (the small-print passage of seif ה). Sages who came to an inn whose non-Jewish owner arrived on Shabbos asked whether they could rent from him: « שׂוֹכֵר כִּמְעָרֵב דָּמֵי — מָה מְעָרֵב מִבְּעוֹד יוֹם, אַף שׂוֹכֵר מִבְּעוֹד יוֹם. אוֹ דִילְמָא שׂוֹכֵר כִּמְבַטֵּל רְשׁוּת דָּמֵי, מָה מְבַטֵּל רְשׁוּת וַאֲפִילּוּ בְּשַׁבָּת, אַף שׂוֹכֵר וַאֲפִילּוּ בְּשַׁבָּת » (עירובין ס״ה ע״ב) — is one who rents like one who makes an eruv: as the eruv is made while it is still day, so too the rental? Or is he like one who renounces his domain: as renunciation is done even on Shabbos, so too the rental? « רַבִּי חֲנִינָא בַּר יוֹסֵף אָמַר: נִשְׂכּוֹר, וְרַבִּי אַסִּי אָמַר: לֹא נִשְׂכּוֹר, אֲמַר לְהוּ רַבִּי חִיָּיא בַּר אַבָּא: נִסְמוֹךְ עַל דִּבְרֵי זָקֵן וְנִשְׂכּוֹר » (עירובין ס״ה ע״ב) — Rabbi Chanina bar Yosef said: let us rent; Rabbi Assi said: let us not rent; Rabbi Chiya bar Abba told them: let us rely on the words of the elder and rent. They went and asked Rabbi Yochanan, who told them: « יָפֶה עֲשִׂיתֶם שֶׁשְּׂכַרְתֶּם » (עירובין ס״ו ע״א) — you did well to rent. The Sages of Nehardea wondered: « וּמִי אָמַר רַבִּי יוֹחָנָן הָכִי? Did he not say: one who rents is like one who makes an eruv; is it not: as the eruv is made while it is still day, so too the rental? No: as the eruv [is effective] even for less than the value of a perutah, so too the rental for less than the value of a perutah; and the Gemara continues this comparison.

On this passage of seif ה, the Taz: « דאין זה כמקח וממכר שאין זה אלא כמתנה להתיר טלטול בשבת » (ט״ז או״ח שפ״ב ס״ק ז) — this is not like a sale; it is only like a gift to permit carrying on Shabbos; and the Mishnah Berurah: « שאינו שכירות ודאית אלא כביטול רשות והיכר בעלמא » (משנה ברורה שפ״ב ס״ק כ״ב) — it is not a definite rental, but like a renunciation and a mere sign; it adds that, according to the poskim, one gives him a food or an object that may be moved, but moving money is forbidden; and, referring to siman 383, « דהעירוב נתבטל וצריכין לבטל רשותם לגבי אחד » (משנה ברורה שפ״ב ס״ק כ״ב) — the eruv is void, and they must renounce their domain in favor of one of them. The Rav's text, which gives this reason and writes that acquiring a domain on Shabbos remains forbidden, is at Level 4, point ב.

3. The non-Jew going back on the rental, and its term (seifim ו-ח)

Seif ו: « כל זמן שאין העכו״ם חוזר בו מועיל השכירו׳ ואפילו לזמן מרובה » (שו״ע או״ח שפ״ב:ו) — as long as the non-Jew does not go back on it, the rental is effective, even for a long time. The Beis Yosef gives its source: « כן כתבו המרדכי והרא״ש בר״פ הדר בשם ר״מ ז״ל » (בית יוסף או״ח שפ״ב) — so wrote the Mordechai and the Rosh, at the beginning of the chapter הדר, in the name of ר״מ. He sets aside the contrary view: « ואע״פ שכתב בהגהת אשיר״י שם בשם א״ז דצריך להשכיר מן הכותי בכל שבת לא שבקינן כל הני רבוותא מקמי א״ז » (בית יוסף או״ח שפ״ב) — although the Hagahos Asheri write in the name of the Or Zarua that one must rent from the non-Jew every Shabbos, we do not abandon all these authorities for the Or Zarua; he traces that view to a statement of Rashi about the trouble of renting every Erev Shabbos, and reports that the Rosh explains it: one rents again only if the non-Jew has gone back on the rental.

The parenthesis of seif ו: « ואינו יכול לחזור משכירתו עד שיחזור הדמים » (שו״ע או״ח שפ״ב:ו) — he cannot go back on his rental until he returns the money. Rashi, on the Sadducee of the Mishnah: « וש״מ דאינו כנכרי דאי אגירו מיניה היכי מצי למהדר אע״ג דמפיק לא אסר דהא נקיט דמי » (רש״י עירובין ס״א ע״ב) — we learn that he is not like a non-Jew: if they had rented from him, how could he go back? Even if he took [objects] out, he would not forbid, since he has taken money. The Beis Yosef derives from this: « דכל דנקט דמי אינו יכול לחזור משכירותו עד שיחזיר הדמים » (בית יוסף או״ח שפ״ב) — as long as he has taken money, he can go back on his rental only by returning the money.

For which Shabbos? And during the term? The commentators differ. The Magen Avraham: « היינו כששכרו סתם וחזר בו קודם שבת ראשונה ואם החזיר בו משנכנס השבת שוב אינו יכול לחזור בו ואם שכרו לזמן אינו יכול לחזור בו עד כלות הזמן » (מגן אברהם שפ״ב ס״ק ו) — this is when they rented without specifying and he goes back before the first Shabbos; if he החזיר בו once Shabbos has begun, he can no longer go back [the text as printed; the parallel passage in the Shulchan Aruch HaRav, 382:9, speaks here of the residents who took possession (החזיקו) of the courtyard after Shabbos began]; and if they rented for a term, he cannot go back before the term ends. The Taz: « משמע מזה אפי׳ שכרו לזמן מצי למיהדר אפי׳ תוך הזמן אם נותן הדמים » (ט״ז או״ח שפ״ב ס״ק ח) — this implies that even if they rented for a term, he can go back even during the term, if he gives the money. The Mishnah Berurah: « מיירי ששכרו ממנו בסתם ולא פירש שום זמן דאי שכרו לזמן ידוע כשעבר הזמן צריך לשכור שנית בכל ענין כמבואר בסעיף שאח״ז וקודם שעבר הזמן אינו יכול לחזור בשום ענין » (משנה ברורה שפ״ב ס״ק כ״ג) — [the seif] speaks of a rental without a specified term; if they rented for a fixed term, once the term has passed one must rent again in every case, as in the next seif, and before the term has passed he cannot go back in any way; « כיון שלא פירש זמן בשכירות מהני כ״ז שאינו חוזר העכו״ם בפירוש אבל אם רוצה הנכרי יכול לחזור בו מיד אחר שבת הראשונה ואוסר עליו דכיון שלא השכיר לו אלא בסתם יכול לומר לו לא כוונתי אלא על שבת אחת » (משנה ברורה שפ״ב ס״ק כ״ד) — since he specified no term, [the rental] is effective as long as the non-Jew does not explicitly go back; but if the non-Jew wishes, he can go back right after the first Shabbos and forbid him, for, having rented only without specifying, he can say to him: I meant only one Shabbos; « ר״ל דמה שאמרנו דאחר שבת הראשונה יכול העכו״ם לחזור היינו דוקא כשמחזיר הדמים דאל״כ יכול הישראל לומר לו אנכי כונתי לשכור ממך על כמה שבתות וע״ד כן נתתי לך דמי השכירות ובכגון זה הקילו חכמים במקום עכו״ם שאינו יכול לאסור עליו והרבה חולקים ע״ז ולדבריהם יכול העכו״ם לחזור אחר שבת ראשונה אפילו בלא חזרת דמים דכיון דלא פירש לכמה שבתות יכול לומר לא כוונתי אלא על שבת אחת » (משנה ברורה שפ״ב ס״ק כ״ה) — what we said, that after the first Shabbos the non-Jew can go back, holds only when he returns the money; otherwise the Jew can say to him: I meant to rent from you for several Shabbosos, and with that in mind I gave you the rent; in such a case the Sages were lenient, where a non-Jew is concerned, [saying] that he cannot forbid him; and many disagree with this: according to them, the non-Jew can go back after the first Shabbos even without returning the money, for, since he did not specify for how many Shabbosos, he can say: I meant only one Shabbos.

The Biur Halachah: « יש בענין הזה מבוכה רבה בין המפרשים והמחוורת שבכולם היא שיטת הב״ח וא״ר [כי כמה אחרונים עומדים בשיטתם] דכשהשכירו לזמן קצוב אינו יכול לחזור באמצע הזמן וכדמוכח מסי״ד וכ״כ בתמים דעים דקודם הזמן שקצב אינו יכול לחזור ואפילו אם יחזיר לו הדמים » (ביאור הלכה שפ״ב) — there is great confusion on this subject among the commentators; the clearest of all is the view of the Bach and the Eliyah Rabbah [for several Acharonim hold it]: when he rented for a fixed term, he cannot go back in the middle of the term, as is evident from seif יד; and so writes the Tamim De'im: before the term he fixed, he cannot go back, even if he returns the money to him. On Rashi's words, he reports that Acharonim have already written that there is no proof from them: « דאין כונת רש״י במה שכתב דנקט דמי מפני שהמעות בידו אלא הכונה שהרי לקח דמים וממילא נקנה הרשות לשוכר » (ביאור הלכה שפ״ב) — Rashi's intent, when he writes he has taken money, is not that the money is in his hands, but: since he took money, the domain is thereby acquired by the renter. And he concludes: « אכן בהשכירו סתם דעת הפוסקים שאחר שבת ראשונה יכול לחזור שיכול העכו״ם לומר לא השכרתיך אלא על שבת אחת אמנם כ״ז שלא חזר עומד השכירות בתקפו ובזה מיירי השו״ע » (ביאור הלכה שפ״ב) — but when he rented without specifying, the view of the poskim is that after the first Shabbos he can go back, for the non-Jew can say: I rented to you only for one Shabbos; yet as long as he has not gone back, the rental stands in full force, and that is what the Shulchan Aruch speaks of.

The Rav's text on these questions is at Level 4, point ג. This page does not decide: consult your Rav.

Death or sale during the term (seifim ז-ח). On seif ז, the Taz: « נראה לי דאם שוכרין מעכו״ם ומת והניח יורש אין מועיל מה ששכרו מן המוריש דאז נתבטל כח השכירו׳ דהא אפי׳ בחייו מצי למיהדר ביה אם ירצה » (ט״ז או״ח שפ״ב ס״ק ט) — it seems to me that if one rents from a non-Jew and he dies leaving an heir, what was rented from the one he inherits from is not effective, for then the force of the rental is canceled, since even in his lifetime he could go back if he wished. The Mishnah Berurah: « וזהו לשיטתו לעיל שכתב בס״ו דאפילו בתוך זמן יכול לחזור אבל לפי מה שהסכימו האחרונים שם דבתוך הזמן אינו יכול לחזור בשום ענין א״כ אפילו מת לא נתבטל השכירות ואפילו היורש עומד ומוחה וכ״כ הא״ר ועוד הרבה אחרונים מיהו בשכר ממנו סתם ומת מסתברא דנתבטל ממילא השכירות וכדברי הט״ז » (משנה ברורה שפ״ב ס״ק כ״ו) — this follows his view, since he wrote above, at seif ו, that even during the term he can go back; but according to what the Acharonim agreed there, that during the term he cannot go back in any way, even if he dies the rental is not canceled, even if the heir protests; so writes the Eliyah Rabbah, and many other Acharonim; however, if one rented from him without specifying and he died, it is reasonable that the rental is canceled by itself, as the Taz says. On seif ח: « וה״ה אם מכר לאחר והטעם דשכירות ליומא נמי ממכר הוא ואין יכול למכור הזכות שנתן כבר לאחר ויש מחמירין במכר » (משנה ברורה שפ״ב ס״ק כ״ט) — the same if he sold to another; the reason: a rental for a day is also a sale, and he cannot sell the right he has already given to another; and some are stringent regarding a sale. The Rav's text on these two cases is at Level 4, point ד.

4. His wife, his hired worker and his seasonal worker (seif יא)

Seif יא: one rents from his wife, his hired worker or his seasonal worker, even if he protests. The Gemara compares one who rents to one who makes an eruv: « וּמָה מְעָרֵב אֲפִילּוּ שְׂכִירוֹ וּלְקִיטוֹ, אַף שׂוֹכֵר אֲפִילּוּ שְׂכִירוֹ וּלְקִיטוֹ » (עירובין ס״ו ע״א) — as for one who makes an eruv [it is effective] even [through] his hired worker or his seasonal worker, so too for one who rents, even [from] his hired worker or his seasonal worker. For the wife, the Beis Yosef reports the Mordechai: « וכתב המרדכי בר״פ הדר ונראה דשוכרין מאשתו של כותי או מא׳ מבני ביתו דהא אמרינן בפרק חלון (עירובין פ.) בעובדא דטורזינא דשוכרין מאשתו » (בית יוסף או״ח שפ״ב) — it seems that one rents from the non-Jew's wife or from one of his household, for we say in the chapter חלון, in the episode of טורזינא, that one rents from his wife; and the Rashba: « וכ״כ הרשב״א בתשובה אפילו בקשו ממנו לשכור ולא רצה שוכרין מאשתו ואפילו משכירו ולקיטו וכמעשה דטורזינא ושלא מדעתו ואפילו מוחה קאמר » (בית יוסף או״ח שפ״ב) — even if they asked him to rent and he refused, one rents from his wife, and even from his hired or seasonal worker; and the episode of טורזינא is meant [as a rental done] without his knowledge, and even if he protests.

When the master of the house protests. The Taz: « מו״ח ז״ל כת׳ שחילק בזה בין אשתו לשכירו ולקיטו ולא מהני בשכירו ולקיטו מוחה ואנו אין לנו אלא כמ״ש כאן ע״פ הרשב״א » (ט״ז או״ח שפ״ב ס״ק י״ג) — my father-in-law [the Bach] wrote, distinguishing here between his wife and his hired or seasonal worker: from his hired or seasonal worker it is not effective if he protests; and we have only what is written here, following the Rashba. The Mishnah Berurah: « כיון דמעיקר הדין אין דירתו אוסרת אלא כדי שלא ילמוד ממעשיו הקילו בה להיות אפילו שכירו נחשב לענין זה כבעה״ב וכתב הגר״א בביאורו דזהו רק לדעה הראשונה שבסימן שס״ז אבל לדעת י״א שם גם באשתו אינו יכול לשכור ממנה אם הבעל מוחה בה בפירוש שלא תשכיר » (משנה ברורה שפ״ב ס״ק ל״ד) — since, by strict law, his dwelling forbids only so that one not learn from his deeds, they were lenient, to the point that even his hired worker is counted in this respect as the master of the house; and the Vilna Gaon writes in his Biur that this is only according to the first opinion in siman 367; but according to the opinion introduced there by some say, even from his wife one cannot rent if the husband has explicitly forbidden her to rent. The Biur Halachah refers to the Atzei Almogim, who writes: « דבעינן דוקא שיהיה לו לשכירו ולקיטו רשות להשתמש בביתו או בחצרו הא לא״ה לא » (ביאור הלכה שפ״ב) — his hired or seasonal worker must specifically have the right to use his house or his courtyard; otherwise, not.

5. One who draws close to the non-Jew: two opinions (seif יב)

Seif יב comes from the continuation of the episode of section 1. Rava: « לֵיזִיל חַד מִינַּיְיהוּ, לִיקְרַב לֵיהּ, וְלִשְׁאוֹל מִינֵּיהּ דּוּכְתָּא וְלַינַּח בֵּיהּ מִידֵּי, דְּהָוֵה לֵיהּ כִּשְׂכִירוֹ וּלְקִיטוֹ, וְאָמַר רַב יְהוּדָה אָמַר שְׁמוּאֵל: אֲפִילּוּ שְׂכִירוֹ וַאֲפִילּוּ לְקִיטוֹ — נוֹתֵן עֵירוּבוֹ וְדַיּוֹ » (עירובין ס״ד ע״א) — let one of them go and draw close [to the non-Jew], ask to borrow a place from him and put something there: he will be like his hired or seasonal worker; and Rav Yehudah said in the name of Shmuel: even his hired worker and even his seasonal worker gives his eruv, and that is enough. Rashi: « ישתדל עם הנכרי עד שיהא אוהבו וישאיל לו הנכרי מקום בחצירו לאתנוחי ביה מידי » (רש״י עירובין ס״ד ע״א) — let him make efforts with the non-Jew until he becomes his friend, and the non-Jew lends him a place in his courtyard to put something there; and on Shmuel's words: « של נכרי אם ישראל הוא נותן עירובו עם בני מבוי ודיו » (רש״י עירובין ס״ד ע״א) — [the hired worker] of a non-Jew, if he is a Jew, gives his eruv with the residents of the alley, and that is enough.

Rent, or give his eruv? The Beis Yosef reports Rashi's reading: « ופירש״י עוד אפי׳ שכירו ולקיטו של כותי אם ישראל הוא נותן עירובו עם בני מבוי ודיו וכך הם דברי רבינו ורבינו ירוחם » (בית יוסף או״ח שפ״ב) — Rashi further explains that even the hired or seasonal worker of a non-Jew, if he is a Jew, gives his eruv with the residents of the alley, and that is enough; and these are the words of our master [the Tur] and of Rabbeinu Yerucham. The Tur: « וזה תקנתם שאחד מבני החצר יתקרב אליו עד שישאיל לו שום מקום ברשותו ליתן בו שום דבר ונמצא זה כאילו הוא שכירו או לקיטו ודר עמו בביתו ונותן עירוב בשבילו ודיו » (טור או״ח שפ״ב) — this is their remedy: one of the residents of the courtyard draws close to him until he lends him a place in his domain to put something there; he is then as if he were his hired or seasonal worker, living with him in his house; he gives the eruv for him, and that is enough. And the Rambam's: « אבל הרמב״ם כתב בפ״ב מה״ע ואפילו היה שכירו או שמשו ישראל ה״ז משכיר שלא לדעתו שאל מן הכותי מקום להניח בו חפציו והשאילו הרי נשתתף עמו ברשותו ומשכיר שלא לדעתו » (בית יוסף או״ח שפ״ב) — but the Rambam writes in chapter 2 of the laws of eruvin: even if his hired worker or his attendant was a Jew, he rents without his knowledge; if he asked the non-Jew for a place to put his things and he lent it to him, he has become his partner in his domain, and he rents without his knowledge. The first opinion of seif יב writes « ומשכיר שלא מדעת העכו״ם » (שו״ע או״ח שפ״ב:יב) — and he rents without the non-Jew's knowledge; the second, « ויש אומרים שאינו צריך להשכיר אלא נותן עירובו ודיו » (שו״ע או״ח שפ״ב:יב) — and some say that he need not rent, but gives his eruv, and that is enough.

The Mishnah Berurah explains the first opinion: « אבל בלא שכירות לא יועיל דלא עדיף הישראל העומד במקומו ממנו » (משנה ברורה שפ״ב ס״ק ל״ט) — but without a rental it would not help, for the Jew who stands in his place is no better than he; and the second: « ס״ל לדעה זו דל״ד שכירות מתיר בעכו״ם ה״ה שאלה וממילא שאילתו מועיל בעד כולם כמו בההיא דס״ט לענין שכירות וע״כ די במה שנותן בעירוב עם שאר בני החצר » (משנה ברורה שפ״ב ס״ק מ) — this opinion holds that, just as a rental permits [carrying] where there is a non-Jew, so does a loan; his loan therefore works for all, as in seif ט for a rental, and it is enough that he gives [his share] in the eruv with the other residents of the courtyard. Then: « ולכתחלה נכון לחוש לסברא הראשונה » (משנה ברורה שפ״ב ס״ק מ״א) — a priori, it is proper to take the first opinion into account. The Rav's text on this seif is at Level 4, point ה.

6. A Jew and a non-Jew, or two non-Jews, in one house (seif טו)

Seif טו: « אם ישראל ועכו״ם דרים בבית א׳ צריך לשכור מהעכו״ם ולערב עם הישראל » (שו״ע או״ח שפ״ב:טו) — if a Jew and a non-Jew live in one house, one must rent from the non-Jew and make an eruv with the Jew. The Beis Yosef reports a statement of Rabbi Yochanan in the Yerushalmi, which Tosafos raise against the rule of the hired worker: « ישראל וכותי שהיו דרים בבית אחד צריך ישראל לבטל והכותי להשכיר » (בית יוסף או״ח שפ״ב) — a Jew and a non-Jew who lived in one house: the Jew must renounce and the non-Jew must rent; and their two answers: « וי״ל דהתם ששניהם שותפין בבית ישראל וכותי דלא הוי כשכירו ולקיטו דהכא ועוד יש לחלק דאם ייחד הכותי לישראל שהוא שכירו ולקיטו חדר אחד שלא יוכל הכותי להשתמש בו דהוי השתא הכותי מסולק מישראל ואין יכול לסלק הישראל בכה״ג לא אמרי׳ נותן עירובו ודיו » (בית יוסף או״ח שפ״ב) — there, the two, the Jew and the non-Jew, are partners in the house, and [the Jew] is not like the hired or seasonal worker here; and one can further distinguish: if the non-Jew assigned to the Jew, his hired or seasonal worker, a room the non-Jew cannot use, the non-Jew is then excluded from the Jew and cannot remove the Jew, and in such a case we do not say that he gives his eruv and that is enough. On the Tur's words each has his own dwelling, the Beis Yosef writes: « ומ״ש שלכל אחד דירתו בפני עצמו הוא כתירוץ שני דתוספות » (בית יוסף או״ח שפ״ב) — this follows the second answer of Tosafos.

The Rema's gloss. « אם יש לכל א׳ דירה בפני עצמו וה״ה שני (עכו״ם) הדרים בכה״ג בבית אחד צריך לשכור (משניהם) » (רמ״א או״ח שפ״ב:טו) — if each has a dwelling of his own; and the same for two (non-Jews) who live this way in one house: one must rent (from both). For non-Jews, the Beis Yosef reports the Hagahos Asheri: « אם יש מבעלי בתים כותים אפילו י׳ ודרים כולם עמו בבית צריך למיגר מכולהו » (בית יוסף או״ח שפ״ב) — if among the householders there are non-Jews, even ten, all living with him in the house, one must rent from all of them; and he derives: « ומשמע דאם ב׳ כותים דרים בבית א׳ דינם שוה לישראל וכותי הדרים בבית וצריך לשכור משניהם » (בית יוסף או״ח שפ״ב) — it follows that if two non-Jews live in one house, their law is that of a Jew and a non-Jew living in the house: one must rent from both.

והרבה פוסקים חולקים אדברי רמ״א ולדידהו אפי׳ משתמשים ביחד בכל החדרים לא מיקרי ישראל שכיר ולקיט וצריך לשכור מן העכו״ם דוקא וכן בסיפא בשני עכו״ם נמי צריך לשכור משניהם דוקא והטעם דלא תקנו חכמים דיהיה ידו כיד בעה״ב אלא בשכיר ולקיט דנגרר אחריו אבל לא בשותפים שכח כל אחד מהם שוה בבית ואין כל אחד טפל לחבירו » (משנה ברורה שפ״ב ס״ק נ״א) — that is, in rooms reserved for each; but if they live in partnership in the whole house, or even if they divide the whole house but one room is open to the use of both, one need rent only from one of them, as above in seif יג; and many poskim disagree with the Rema's words: according to them, even if they use all the rooms together, the Jew is not called a hired or seasonal worker, and one must rent from the non-Jew specifically; likewise, at the end [of the gloss], for two non-Jews, one must rent from both specifically; the reason: the Sages instituted that his hand be like the householder's only for the hired or seasonal worker, who is drawn after him, and not for partners, whose power in the house is equal, neither being subordinate to the other. The Biur Halachah: « ונראה דאין להחמיר בזה כ״א לענין בע״כ » (ביאור הלכה שפ״ב) — it seems there is room to be stringent in this only for [a rental done] against the will [of the other]; when one rents from one of them without the other's knowledge, it is reasonable, he writes, that the other, whose power is equal, generally consents to what his partner does.

The Shulchan Aruch HaRav treats these cases in its seif 16: see Level 4.

7. Two courtyards, one inside the other (seif יז)

Seif יז comes from several teachings. Rav Yehudah in the name of Rav: « יִשְׂרָאֵל וְגוֹי בַּפְּנִימִית, וְיִשְׂרָאֵל בַּחִיצוֹנָה. בָּא מַעֲשֶׂה לִפְנֵי רַבִּי, וְאָסַר, וְלִפְנֵי רַבִּי חִיָּיא, וְאָסַר » (עירובין ס״ה ע״ב) — a Jew and a non-Jew in the inner one, and a Jew in the outer one: the case came before Rebbi, and he forbade; before Rabbi Chiya, and he forbade. After the discussion, Rav Huna son of Rav Yehoshua establishes it thus: « לְעוֹלָם כְּרַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב, וּכְרַבִּי עֲקִיבָא, וְהָכָא בְּמַאי עָסְקִינַן? כְּגוֹן שֶׁעֵירְבוּ, וְטַעְמָא דְּאִיכָּא גּוֹי דַּאֲסִיר, אֲבָל לֵיכָּא גּוֹי לָא אֲסִיר » (עירובין ס״ה ע״ב) — in fact, according to Rabbi Eliezer ben Yaakov and according to Rabbi Akiva; what is the case here? When they made an eruv, and the reason [for the prohibition] is that there is a non-Jew; without a non-Jew, it would not be forbidden. Rav had been asked about the one in the inner courtyard, in his own place: « פְּנִימִי בִּמְקוֹמוֹ מַהוּ? וְאָמַר לָהֶן: מוּתָּר » (עירובין ס״ה ע״ב) — he told them: it is permitted. For the reverse case, « בְּעָא מִינֵּיהּ רַבִּי אֱלִיעֶזֶר מֵרַב: יִשְׂרָאֵל וְגוֹי בַּחִיצוֹנָה וְיִשְׂרָאֵל בַּפְּנִימִית מַהוּ » (עירובין ס״ה ע״ב) — Rabbi Eliezer asked Rav: a Jew and a non-Jew in the outer one, and a Jew in the inner one, what is the law? And Rav answered: « תֵּן לְחָכָם וְיֶחְכַּם עוֹד » (עירובין ס״ה ע״ב) — give to the wise, and he will become wiser still.

For the non-Jew in the inner courtyard, Rabbi Elazar: « וְגוֹי הֲרֵי הוּא כְּרַבִּים. סְתָם גּוֹי, אִי אִיתָא דְּאוֹגַר — מִיפְעָא פָּעֵי » (עירובין ע״ה ע״ב) — and the non-Jew is like many. Why does the Jew not forbid? Because whoever knows, knows, and whoever does not know thinks: he made an eruv. For the non-Jew too, let us say: whoever knows, knows, and whoever does not know thinks: he rented! An ordinary non-Jew, had he rented, would have made it known everywhere. The Beis Yosef reports Rashi's explanation: « אם דר כותי בפנימית וב׳ ישראלים בחיצונה אוסרת דריסת רגלו עליהן עד שישכור » (בית יוסף או״ח שפ״ב) — if a non-Jew lives in the inner one and two Jews in the outer one, his right of passage forbids them, until one rents.

A single Jew in the outer courtyard: the last opinion of seif יז. The Beis Yosef quotes the Rambam in chapter 4, then writes: « ואם היה כותי בפנימית הרי הוא כרבים ואוסר על החיצונה עד שישכרו מקומו נראה מדבריו שאפילו ביחיד בחיצונה אוסר » (בית יוסף או״ח שפ״ב) — if there was a non-Jew in the inner one, he is like many and forbids the outer one until they rent his place; it appears from his words that even with a single [Jew] in the outer one, he forbids. The Magen Avraham: « זה דקדק הרב״י מלשון הרמב״ם פ״ד ול״נ דא״א לו׳ כן » (מגן אברהם שפ״ב ס״ק י״ד) — this is what the Beis Yosef inferred from the Rambam's wording in chapter 4; and it seems to me that it is impossible to say so; after his proofs, he concludes: « לכן נ״ל דהרמב״ם קאי כששני׳ בחיצונ׳ אלא שסתם כמנהגו » (מגן אברהם שפ״ב ס״ק י״ד) — therefore it seems to me that the Rambam refers to the case where two are in the outer one, but wrote without specifying, as is his manner. The Taz: « והא דכ׳ כאן בש״ע ויש מי שאומר שאפי׳ עכו״ם בפנימית כו׳ אזיל לשיטתיה לדעת הרמב״ם ואינו כן וליכא מאן דס״ל הכי כנלע״ד פשוט » (ט״ז או״ח שפ״ב ס״ק י״ח) — what is written here in the Shulchan Aruch, and there is one who says that even a non-Jew in the inner one…, follows his own reading of the Rambam's view, and it is not so; and no one holds this, it seems to me, it is plain. The Mishnah Berurah: « דאע״ג דבכל מקום ישראל אחד עם עכו״ם אינו אסור אפילו אם דרים בחצר אחד ס״ל דהכא גרע טפי דבחצר שהוא לפנים מחצר לאו כו״ע ידעי מי ומי דר בו ויחשבו כי דרים בו גם ישראל מלבד עכו״ם וכי חזו דמטלטלי בחיצון אתו למימר דשרי בלי שכירות במקום עכו״ם ומ״מ להלכה לא נקטינן כן כי הרבה אחרונים דחו זה מהלכה » (משנה ברורה שפ״ב ס״ק נ״ט) — although everywhere a single Jew with a non-Jew is not forbidden, even if they live in one courtyard, [this opinion] holds that here it is worse: of a courtyard inside another courtyard, not everyone knows who lives there; one would think that a Jew also lives there besides the non-Jew, and seeing people carry in the outer one, they would come to say that it is permitted without a rental where there is a non-Jew; nevertheless, for halachah we do not hold so, for many Acharonim have rejected it from the halachah.

On the first two cases of the seif, the Biur Halachah: « עיין במג״א שהביא בשם הגהת אשר״י שמקיל בשני אופנים הראשונים לדידן דקיי״ל רגל המותרת במקומה אינה אוסרת שלא במקומה » (ביאור הלכה שפ״ב) — see the Magen Avraham, who brings in the name of the Hagahos Asheri [a view] lenient in the first two cases, for us who hold that a foot permitted in its own place does not forbid outside its place; he then brings Rishonim who are stringent, and concludes: « וע״כ קשה להקל בזה » (ביאור הלכה שפ״ב) — therefore it is difficult to be lenient in this.

8. Through windows, or through a doorway (seif

אֲמַר לֵיהּ: אִין » (עירובין ע״ד ע״ב) — an alley one side of which belongs to a non-Jew and one side to a Jew: one does not make an eruv for it through windows in order to permit it through the doorways to the alley; Abaye asked Rav Yosef: did Rav say it even of a courtyard? He answered: yes. The Gemara gives the reason: « הַשְׁתָּא דְּאָמַר רַב אֲפִילּוּ חָצֵר, טַעְמָא דְּרַב דְּקָא סָבַר אָסוּר לַעֲשׂוֹת יָחִיד בִּמְקוֹם גּוֹי » (עירובין ע״ה ע״א) — now that Rav said even a courtyard, Rav's reason is that he holds it is forbidden to make a [Jew] alone where there is a non-Jew.

And through a doorway? Rashi: « להכי נקט חלונות שאין דרך בני אדם לעשות פתחים גדולים מבית לבית » (רש״י עירובין ע״ד ע״ב) — he mentioned windows because people do not usually make large doorways from one house to another. The Beis Yosef derives: « ומשמע שאם היה פתח פתוח מבית לבית ה״נ דאין מערבין דרך הפתח » (בית יוסף או״ח שפ״ב) — it follows that if there were a doorway from one house to another, one would not make the eruv through the doorway either. He reports the other reading: « אבל התוס׳ והרא״ש כתבו בשם ר״י דכיון דמסיק בגמרא דטעמא משום דאסור לעשות יחיד במקום כותי כלומר שאסור לעשות סיוע ליחיד וכו׳ לפיכך לא יערבו אלו עמו ולא ישתמשו עמו במבוי כדי שיהא יחידי וכו׳ א״כ דוקא נקט חלונות משום דכי לא מערבי בהדי הדדי מירתת ישראל ולא דייר בהדי כותי וכי מערבין אהדדי לא מירתת אבל דרך פתחים כיון דאפילו לא מערבי שכיח דדייר ולא מירתת דכיון שיש פתח ביניהם נראה לו כאילו דר עמו בביתו שרי לערב בהדיה כיון דבלאו עירוב נמי שכיח דדייר » (בית יוסף או״ח שפ״ב) — but Tosafos and the Rosh write in the name of the Ri: since the Gemara concludes that the reason is that it is forbidden to make a [Jew] alone where there is a non-Jew, that is, it is forbidden to help one who is alone…, these will therefore not make an eruv with him nor use the alley with him, so that he remain alone…; if so, the word windows is precise: when they do not make an eruv together, the Jew is afraid and does not live with the non-Jew, and when they make an eruv together, he is not afraid; but through doorways, since even without an eruv it is common that he lives [there] without fear, for, with a doorway between them, it seems to him that he lives with him in his house, it is permitted to make an eruv with him, since even without an eruv it is common that he lives [there]. The Tur: « אבל אם פתח פתוח ביניהן מותר לר״י ולרש״י אף אם פתח פתוח ביניהן אסור » (טור או״ח שפ״ב) — but if there is a doorway open between them, it is permitted according to the Ri; and according to Rashi, even if there is a doorway open between them, it is forbidden. Seif יט writes the permission, then brings the opinion that forbids even with a doorway.

The Mishnah Berurah explains the permission: « דאפי׳ בלא עירוב לא מסתפי ישראל לדור כאן יחידי שהרי הישראל מצוי תדיר כאן דרך פתחו ולהכי לא גזרו בזה שלא יהני עירובו » (משנה ברורה שפ״ב ס״ק ס״ח) — even without an eruv, the Jew is not afraid to live there alone, since the [other] Jew is constantly present there through his doorway; therefore they did not decree here that his eruv be ineffective; and on the second opinion: « ויש להחמיר כדעה זו ועיין ביאור הלכה » (משנה ברורה שפ״ב ס״ק ס״ט) — one should be stringent according to this opinion; and see the Biur Halachah.
