Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and numbering of the seifim. Here the Shulchan Aruch HaRav announces 4 seifim at the head of the siman, and the Shulchan Aruch of the Mechaber has 4 as well. Sefaria serves the Rav's text in 4 blocks, which this page reproduces and numbers as they stand (section 1). Each seif of the Rav corresponds to the seif of the same rank in the Mechaber: the Tzeduki in seif 1 (the Mechaber's seif א), the Kuti in seif 2 (ב), the mumar in seif 3 (ג), the Jew who converted and has a house in the Jewish quarter in seif 4 (ד). In the English text of this page, the Rav's seifim are designated by their numeral (385:3, seif 3), the Mechaber's by their Hebrew letter (the Mechaber's seif ג); in the Hebrew addresses in parentheses, both numberings are in letters, and the address always names the work (שו״ע או״ח for the Mechaber, שו״ע הרב for the Rav).
This page gathers, for Siman 385, the full text of the Rav with its translation, where his text differs from that of the Mechaber, and the practical conduct that follows from it.

The law of the Tzeduki (Sadducee) and the mumar (apostate) in the eruv; it contains 4 seifim:
The Tzedukim are like Jews and renounce the domain (mevatlim reshus), and one need not rent from them in order to keep one's dwelling away from them, since they keep Shabbos and are not idol-worshippers. But their eruv is not effective, since they do not acknowledge the eruv:
סעיף ב כּוּתִי הֲרֵי הוּא כִּשְׁאָר נָכְרִים, וְאֵין לוֹ…
כּוּתִי הֲרֵי הוּא כִּשְׁאָר נָכְרִים, וְאֵין לוֹ תַּקָּנָה אֶלָּא בִּשְׂכִירוּת:
A Kuti is like other non-Jews (nochrim), and he has no remedy (takanah) except by renting (bis'chirus):
A Jew who is an apostate (mumar) to idolatry (avodah zarah), or to desecrating Shabbosos in public (b'farhesya), even if he desecrates it only through prohibitions of rabbinic order (issurei divrei soferim), is like a non-Jew in all respects (l'chol devarav), and one must rent from him. And he is not like the Tzeduki — they who also desecrate prohibitions of rabbinic order in public — because the Tzedukim are coerced (anusim), for they hold to the conduct of their fathers (ma'aseh avoseihem bideihem). And if he desecrates it only in private (b'tzin'a), even if he desecrates it through Torah prohibitions, he is like a Jew in all respects, and renounces the domain (or makes an eruv).
And he is called “an apostate to desecrating Shabbosos in public” only when he is accustomed to it and does not guard against it at all; but not when he desecrated it once, merely by chance (b'akrai), when he was pressed at the moment:
A Jew who converted [to another religion] and has a house in the quarter (sh'chunah) of the Jews, who made an eruv for the whole year, and he too made the eruv with them: if he has no other opening at all except to this quarter, he prohibits [them] every Shabbos that falls after he converted, until he rents [out his domain], for his eruv was already annulled when he converted to idolatry. But if he has another opening to the quarter of the non-Jews, even if it is a small and narrow opening (which he is never accustomed to use, and even if it is not a proper opening but a window of four [tefachim] by four), he does not prohibit them (for it is that opening or window, which open onto the quarter of the non-Jews, that he prefers, more than the large opening of the quarter of the Jews, since he converted to their religion; and this opening becomes as though he were not accustomed at all to go through it to the quarter of the Jews; and he does not prohibit them even though he brings in and takes out camels and wagons by way of them all day long, as will be explained in Siman 389):

לשון הרב מול סעיף המחבר
Where the Rav's text differs from the Mechaber's seif
Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 4 seifim, designated by their letter; there is no gloss of the Rema in this siman) and the corresponding seif of the Shulchan Aruch HaRav (its own numbering, also 4 seifim), in the order of the Rav's seifim, and notes only what the comparison of the two texts shows. A point noted is not thereby peculiar to the Rav: where this page has found where it is already written — in the Rambam, in the Mechaber's own Beis Yosef, in the Magen Avraham and the Taz, before the Rav — it names them; it also cites the Mishnah Berurah and the Biur Halachah, later than the Rav, and the contrary views the Mishnah Berurah reports.
Not listed here as a separate point is a detail in the Rav's words that explains the corresponding seif of the Mechaber and that the Mishnah Berurah also writes: in seif 4 the Rav gives the reason why the convert prohibits, « שֶׁכְּבָר נִתְבַּטֵּל עֵרוּבוֹ כְּשֶׁהֵמִיר לַעֲבוֹדָה זָרָה » (שו״ע הרב שפ״ה:ד), and writes that he prohibits « עַד שֶׁיַּשְׂכִּיר » (שו״ע הרב שפ״ה:ד); the Mishnah Berurah, later than the Rav, writes « וכיון שהמיר בטל חלקו בעירוב ואוסר עליהן לשבתות אחרות עד שישכרו ממנו » (משנה ברורה שפ״ה ס״ק ז).
Point א — why one need not rent from the Tzedukim (Shulchan Aruch HaRav 385:1)
The Tzeduki
What the Mechaber writes: « צדוקי הרי הוא כישראל ומבטל רשות אבל עירוב אינו מועיל כיון שאינו מודה בעירוב » (שו״ע או״ח שפ״ה:א). He gives no reason for the first clause.
What the Rav writes: the same rule, and, before the sentence on the eruv, « וְאֵין צָרִיךְ לִשְׂכּוֹר מֵהֶם כְּדֵי לְהַרְחִיק דִּירָתוֹ מֵהֶם, הוֹאִיל וְהֵם שׁוֹמְרֵי שַׁבָּת וְאֵינָם עוֹבְדִים אֱלִילִים » (שו״ע הרב שפ״ה:א).
The difference: the Mechaber's seif א states that the Tzeduki is like a Jew and renounces his domain; the Rav's text writes explicitly that one need not rent from him, and gives the reason: the Tzedukim keep Shabbos and are not idol-worshippers.
In the Rambam: before the Rav, he already writes this reason, of the heretics « שֶׁאֵין עוֹבְדִין עֲבוֹדַת כּוֹכָבִים וּמַזָּלוֹת וְאֵין מְחַלְּלִין שַׁבָּת » (הלכות עירובין פ״ב הט״ז): « וְאֵין שׂוֹכְרִין מִמֶּנּוּ לְפִי שֶׁאֵינוֹ כְּעוֹבֵד כּוֹכָבִים וּמַזָּלוֹת. See Level 2, section 2.
Among the Mechaber's commentators: on the Tzeduki who desecrates prohibitions of rabbinic order in public, the commentators differ: see point ב.
Practical consequence: according to the Rav's text, the Tzeduki renounces his domain and one need not rent from him, but he cannot make the eruv with the others, since he does not acknowledge the eruv (385:1). See section 4, point ①.
Point ב — the mumar is like a non-Jew in all respects, and how he differs from the Tzeduki (Shulchan Aruch HaRav 385:3)
The mumar and the Tzeduki
What the Mechaber writes: « ישראל מומר לעבודת אלילים או לחלל שבתות בפרהסיא אפילו אינו מחללו אלא באיסור דרבנן הרי הוא כעכו״ם ואם אינו מחלל אלא בצינע׳ אפילו מחללו באיסור דאוריית׳ הרי הוא כישראל ומבטל רשות » (שו״ע או״ח שפ״ה:ג). He does not say how this case differs from that of the Tzeduki in seif א.
What the Rav writes: the mumar « הֲרֵי הוּא כְּנָכְרִי לְכָל דְּבָרָיו וְצָרִיךְ לִשְׂכּוֹר מִמֶּנּוּ » (שו״ע הרב שפ״ה:ג); then « וְאֵינוֹ דוֹמֶה לִצְדוֹקִי, שֶׁהֵם מְחַלְּלִים גַּם כֵּן בְּאִסּוּרֵי דִּבְרֵי סוֹפְרִים בְּפַרְהֶסְיָא, לְפִי שֶׁהַצְּדוֹקִים אֲנוּסִים הֵם, שֶׁמַּעֲשֵׂה אֲבוֹתֵיהֶם בִּידֵיהֶם » (שו״ע הרב שפ״ה:ג); and one who desecrates only in private « הֲרֵי הוּא כְּיִשְׂרָאֵל לְכָל דְּבָרָיו, וּמְבַטֵּל רְשׁוּת (אוֹ מְעָרֵב) » (שו״ע הרב שפ״ה:ג).
The difference: where the Mechaber writes « הרי הוא כעכו״ם » (שו״ע או״ח שפ״ה:ג) and « הרי הוא כישראל ומבטל רשות » (שו״ע או״ח שפ״ה:ג), the Rav's text writes « לְכָל דְּבָרָיו » (שו״ע הרב שפ״ה:ג) in both cases, writes explicitly that one must rent from the mumar and, in parentheses, that one who desecrates only in private may also make an eruv; and it writes in the seif why the Tzeduki is not like the mumar: the Tzedukim are coerced, for they hold to the conduct of their fathers. For the public mumar, the Rambam, before the Rav, already writes « הֲרֵי הוּא כְּעוֹבֵד כּוֹכָבִים וּמַזָּלוֹת לְכָל דְּבָרָיו » (הלכות עירובין פ״ב הט״ז) (see Level 2, section 4). This page does not decide the scope of these words beyond the laws of eruv (question for the Rav).
In the Beis Yosef: he writes that, according to the answer of Tosafos, « ולפי דבריהם הני צדוקים דשכיחי גבן כיון דעברי אמילי דרבנן בפרהסיא הרי הם כעו״ג ושוכרין ואין מבטלים » (בית יוסף או״ח שפ״ה); then, for the view of the Rambam, « נראה דהני צדוקים לדידיה לא חשיבי מומרים אע״פ שעוברין בפרהסיא אמילי דרבנן » (בית יוסף או״ח שפ״ה), because « מזיד דידהו כאונס הוי דמעשה אבותיהן בידיהם » (בית יוסף או״ח שפ״ה). It is this second reading that the Rav's text writes.
Among the Mechaber's commentators: the Magen Avraham, before the Rav, writes on the Tzeduki « ואף על פי שמחלל שבת במילי דרבנן מ״מ אנוסים הם דמנהג אבותיהם בידיהם » (מגן אברהם שפ״ה ס״ק א); the Taz, before the Rav, writes « צדוקים דהאידנא לא חשיבי מומרים אף על פי שעוברים בפרהסיא אמילי דרבנן דמזיד דידהו כאונס דמי » (ט״ז או״ח שפ״ה ס״ק א), and refers to the Beis Yosef. The Mishnah Berurah, later than the Rav, writes « צדוקי שאני שמוחזק כך מימי אבותיו ומנהג אבותיו בידו כ״כ ב״י » (משנה ברורה שפ״ה ס״ק א), and then « ודעת כמה פוסקים שאף צדוקי כשמחלל שבת בפרהסיא דינו כעכו״ם » (משנה ברורה שפ״ה ס״ק א). On the mumar for a desecration of rabbinic order, he writes « ר״ל לענין זה שאינו מועיל שוב ביטול רשות אלא דוקא שכירות » (משנה ברורה שפ״ה ס״ק ה), and « ולענין שארי דברים יש מן האחרונים שסוברין שאינו חשוב כמומר ע״י חילול שבת באיסור דרבנן » (משנה ברורה שפ״ה ס״ק ה).
Practical consequence: according to the Rav's text, one must rent from a Jewish apostate to desecrating Shabbosos in public — one who is habituated to it, not one who desecrated it once by chance (point ג) — even through prohibitions of rabbinic order; one who desecrates it only in private renounces his domain, or makes an eruv (385:3). The Tzeduki is not in this category: the Rav's text holds him to be coerced (385:3); the Mishnah Berurah reports a contrary view (above): consult your Rav. See section 4, points ① and ③.
Point ג — who is called an apostate to desecrating Shabbosos in public (Shulchan Aruch HaRav 385:3)
Who is called a public mumar
What the Mechaber writes: seif ג (cited in point ב) does not say what makes someone an apostate to desecrating Shabbosos in public.
What the Rav writes: he is called so only « אֶלָּא כְּשֶׁרָגִיל בְּכָךְ וְאֵינוֹ נִזְהָר כְּלָל, אֲבָל לֹא כְּשֶׁחִלְּלוֹ פַּעַם בְּאַקְרַאי בְּעָלְמָא, כְּשֶׁהָיָה דָחוּק לְפִי שָׁעָה » (שו״ע הרב שפ״ה:ג).
The difference: the Mechaber's seif ג gives no definition; the Rav's text gives one: one who is accustomed to it and does not guard against it at all, and not one who desecrated it once, by chance, when pressed at the moment.
Among the Mechaber's commentators: the Magen Avraham, before the Rav, writes « ואם חילל שבת בחד זימנא לא מקרי מומר » (מגן אברהם שפ״ה ס״ק ב). The Mishnah Berurah, later than the Rav, writes « ודוקא בשרגיל בעון זה אבל אם חילל שבת בחד זימנא בפרהסיא לא מיקרי מומר וי״א דאפילו בחד זימנא מקרי מומר » (משנה ברורה שפ״ה ס״ק ד); he adds « ודע דכל זה כשהוא עובר לתיאבון אבל להכעיס אפילו בשאר עבירות ואפילו שלא בפרהסיא דינו כעכו״ם » (משנה ברורה שפ״ה ס״ק ד). The Biur Halachah writes « היינו כשעושה זה בפריקת עול אבל אם הוא מוטעה בדבר שחשב שמותר לו לעשות כן מסתברא שאין זה בכלל מומר » (ביאור הלכה שפ״ה).
Practical consequence: according to the Rav's text, one who desecrated Shabbos once, by chance, when pressed at the moment, is not called an apostate to desecrating Shabbosos in public (385:3). The Mishnah Berurah reports a contrary view on a single desecration, and writes that all this applies to one who transgresses out of appetite (l'teiavon), not to one who does so out of spite (l'hachis); the Biur Halachah adds the case of one who errs (above): consult your Rav. See section 4, point ③.
Point ד — the opening or window onto the quarter of the non-Jews (Shulchan Aruch HaRav 385:4)
The opening onto the non-Jewish quarter
What the Mechaber writes: « אבל אם יש לו פתח אחר לשכונת העכו״ם אפילו הוא פתח קטן שלא היה רגיל בו מתחיל׳ דוחין אותו אצל פתח הפתוח לשכונת העכו״ם » (שו״ע או״ח שפ״ה:ד). He does not mention a window, and gives no reason.
What the Rav writes: even a small and narrow opening, « וַאֲפִלּוּ אֵינוֹ פֶּתַח גָּמוּר אֶלָּא חַלּוֹן ד׳ עַל ד׳ » (שו״ע הרב שפ״ה:ד); then, in parentheses, the reason: « לְפִי שֶׁבְּאוֹתוֹ פֶּתַח אוֹ חַלּוֹן הַפְּתוּחִים לִשְׁכוּנַת הַנָּכְרִים הוּא חָפֵץ בָּהֶם יוֹתֵר מִבְּפֶתַח הַגָּדוֹל שֶׁלִּשְׁכוּנַת הַיְּהוּדִים, כֵּיוָן שֶׁהֵמִיר לְדָתָם » (שו״ע הרב שפ״ה:ד); he adds that he does not prohibit even if he brings camels and wagons in and out all day long, and refers to Siman 389.
The difference: where the Mechaber writes « דוחין אותו » (שו״ע או״ח שפ״ה:ד), without a reason, the Rav's text extends the case to a window of four by four and gives a reason: it is through the opening onto the non-Jewish quarter that the convert prefers to pass. The Rav's seif 4 does not use this word.
In the Beis Yosef: he reports a responsum of the Rashba: « אפילו אין לו אלא פתח אחד צר כד׳ על ד׳ לצד הכותי דוחין אותו אצל אותה פתח » (בית יוסף או״ח שפ״ה), and two reasons, « וכל שכן שאין צריך עירוב ודוחין אותו אצל שכונת הכותי כדי שלא יאסור ועוד שזה דעתו מעורבת עם הכותי ורגיל אצלם » (בית יוסף או״ח שפ״ה).
Among the Mechaber's commentators: the Mishnah Berurah, later than the Rav, writes « ועכ״פ בעינן שיהיה בו ד״ט על ד״ט דבפחות מזה לא חשיב פתח » (משנה ברורה שפ״ה ס״ק י), and gives both reasons: « דכופין אותו על מדת סדום כדי שלא יאסור עליהן » (משנה ברורה שפ״ה ס״ק י״א), « וגם דבודאי כיון שנתנכר ורגיל עם העכו״ם ניחא ליה בההוא פתחא טפי » (משנה ברורה שפ״ה ס״ק י״א). The Rav's text, in seif 4, writes the second.
Practical consequence: according to the Rav's text, the Jew who converted, has a house in the Jewish quarter and had made the eruv with them prohibits them every Shabbos after his conversion if he has an opening only onto their quarter; if he also has an opening, even a window of four by four, onto the non-Jewish quarter, he does not prohibit them (385:4). See section 4, point ④.

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 385, in the Chabad sensibility. Each point refers to its seif of the Rav, in the order of the text.
For the Chabad Chassid — Siman 385
- ① The Tzeduki: the Tzedukim are like Jews: they renounce their domain, and one need not rent from them; but their eruv is not effective, since they do not acknowledge the eruv (385:1). The Rav's text distinguishes them from the mumar because they are coerced (385:3); on the Tzeduki who desecrates prohibitions of rabbinic order in public, the commentators differ (section 2, point ב). Reference: Shulchan Aruch HaRav 385:1, 3.
- ② The Kuti: he is like other non-Jews; there is no remedy except by renting (385:2). Reference: Shulchan Aruch HaRav 385:2.
- ③ The mumar: a Jew who is an apostate to idolatry, or to desecrating Shabbosos in public, even through prohibitions of rabbinic order, is like a non-Jew in all respects, and one must rent from him; if he desecrates only in private, even Torah prohibitions, he is like a Jew, and renounces his domain (or makes an eruv). He is called an apostate to desecrating Shabbosos in public only when he is accustomed to it and does not guard against it at all, not when he desecrated it once, by chance, when pressed at the moment (385:3). The Mishnah Berurah reports a contrary view on a single desecration, and the commentators add further distinctions (section 2, point ג). The Rav's text does not say who today falls into these categories, and this page does not decide it: consult your Rav. Reference: Shulchan Aruch HaRav 385:3.
- ④ The Jew who converted: a Jew who converted, who has a house in the Jewish quarter and had made the eruv with them for the whole year: if he has an opening only onto their quarter, he prohibits them every Shabbos that falls after his conversion, until he rents [out his domain]; if he also has an opening onto the non-Jewish quarter, even small and narrow, even a window of four [tefachim] by four, he does not prohibit them (385:4; the Rav refers to Siman 389).
