Siman 145 — Idols one may benefit from

Nine seifim — the Shulchan Arukh announces it itself: ובו ט׳ סעיפים. The previous simanim said what an idol forbids; this one asks what, though worshipped, remains permitted. The answer fits in four words, תפיסת יד אדם: what the hand of man neither made nor shaped — the mountain, the spring, the tree that grew by itself, the animal — does not become an idol. Then, case by case, the exact line where the hand of man begins: the plating, the house, the stone, the planted tree, the dug ground, the slaughtered animal, the exchange (Shulchan Arukh, Yoreh De'ah 145 — 9 seifim)

כל שאין בו תפיסת יד אדם ולא עשהו אדם אע״פ שנעבד הרי זה מותר בהנאה

Whatever bears no grip of the hand of man, and which man did not make — even if it was worshipped, it remains permitted for benefit. The siman’s first sentence, and its single criterion: it is not worship that makes the idol, it is the hand.

Why does a worshipped mountain remain permitted?

Because the hand of man did not touch it: « כל שאין בו תפיסת יד אדם ולא עשהו אדם אע״פ שנעבד הרי זה מותר בהנאה » (שו״ע יו״ד קמ״ה:א). The Taz gives the verse: « דכתיב אלהיהם על ההרים ולא ההרים אלהיהם » (ט״ז יו״ד קמ״ה ס״ק א). For your own situation, consult your Rav.

Are stones that broke off the mountain permitted?

The Mechaber permits them, with the Rambam; the Ran, the Ramah and the Raavad forbid them out of doubt. The Shach decides from the Jerusalem Talmud: « וא״כ לא שבקינן מאי דפשיטא לירושל׳ משום מאי דמספקא לש״ס דידן ועוד דהרי ר׳ יוחנן גופיה חיבר הירושלמי וא״כ ע״כ ר״י עצמו אומר שהוא אוסר וא״כ הדבר ברור דקי״ל כחזקיה דשרי » (ש״ך יו״ד קמ״ה ס״ק א). And a spring, or a river?

Permitted, because attached to the ground — and the Shach specifies that “public” is not restrictive: « כתב העט״ז דל״ד אלא אשגרת לישנא דש״ס (דף מ״ו ע״א) נקיט וה״ה נהר ומעיין של יחיד כיון דטעמא הוא דמחובר אינו נאסר אלא דלענין נסכים יש חילוק בין רבים ליחיד ודבריו נכונים ע״פ הש״ס שם » (ש״ך יו״ד קמ״ה ס״ק ב). But water detached by hand is forbidden: « מיהו מ״ש העט״ז דבתלושים יש חילוק בין רבים לשל יחיד אינו נ״ל דבש״ס מוכח דתלושין אפילו של רבים נאסרים מטעמא דלמא קא סגיד » (ש״ך יו״ד קמ״ה ס״ק ב). Is a worshipped house forbidden like a mountain?

No — detached and then reattached counts as detached: « אָמַר רַב: הַמִּשְׁתַּחֲוֶה לְבַיִת — אֲסָרוֹ. אַלְמָא קָסָבַר תָּלוּשׁ וּלְבַסּוֹף חִבְּרוֹ כְּתָלוּשׁ דָּמֵי » (עבודה זרה מ״ז ע״ב). The Mechaber therefore writes « בית שבנאו מתחילה שיהא הבית עצמו נעבד וכן המשתחוה לבית בנוי הרי זה אסור בהנאה » (שו״ע יו״ד קמ״ה:ג); and the Shach specifies that a non-Jew built it, « אבל בנאו ישראל אינו אסור עד שישתחוה לו כדלעיל ר״ס קל״ט דעבודת כוכבים של ישראל אינה אסורה עד שתעבד » (ש״ך יו״ד קמ״ה ס״ק ח). Does a Jew who slaughters his fellow’s animal for the idol forbid it?

No: « ודוקא עובד כוכבים אוסר דבר שאינו שלו אבל ישראל אינו אוסר של חבירו שודאי אינו מכוין אלא לצערו » (שו״ע יו״ד קמ״ה:ח) — even by a complete slaughter, « אפילו במעשה רבה דהיינו ששחט בה ב׳ סימנים. רש״י והר״ן והרא״ש וכ״נ דעת הט״ו » (ש״ך יו״ד קמ״ה ס״ק כ״ב); except the apostate, or one who was forewarned. The non-Jew forbids by the smallest act: « כלומר אפילו מעשה כל דהו וה״ה חצי סימן כדאיתא בש״ס ורש״י ותוס׳ בחולין (דף מ׳) וכן הוא בתה״א ד׳ י׳ ע״ב » (ש״ך יו״ד קמ״ה ס״ק כ״א). What is an “exchange of the exchange”?

Animals received for an idol are forbidden; what one then receives for those animals is the exchange of the exchange. The Tur permits it, the Rambam forbids it — « ודוקא חליפין אבל חליפי חליפין כגון שהחליף בעלי חיים בחליפי אליל מותרין והרמב״ם ז״ל אסר אפי׳ חליפי חליפין » (טור יו״ד קמ״ה). The Shach gives the verse: « משום רישא נקט ב״ח אבל אין הכי נמי דלסברא זו כל חליפי חליפים דעבודת כוכבים מותרין כדאיתא בש״ס ודרש לה מדכתיב כי חרם הוא הוא ולא חליפי חליפים » (ש״ך יו״ד קמ״ה ס״ק כ״ד).
