Level 4 — Daat HaRav (the Alter Rebbe) — Siman י״ח · זמן ציצית

The way of the Alter Rebbe on the time of tsitsit: the night excluded from « וּרְאִיתֶם אֹתוֹ » — פְּרָט לִכְסוּת לַיְלָה, the machloket כְּסוּת יוֹם / כְּסוּת לַיְלָה and the ruling סְפֵק בְּרָכוֹת לְהָקֵל, the talit at Maariv (removed at « בָּרְכוּ ») and on the night of Yom Kippur (לְהִדַּמּוֹת לְמַלְאָכִים), the סְדִינִים (כְּסוּת לַיְלָה, דֶּרֶךְ הַצָּעָה), and the morning — עַמּוּד הַשַּׁחַר / מִשֶּׁיַּכִּיר בֵּין תְּכֵלֶת לְלָבָן, the מִשְׁמוּשׁ of Selichot — in the sensibility of Chabad.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch of the Alter Rebbe is not a commentary on the Mehaber (מחבר) — it is an autonomous and complete Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Chabad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity: it combines halacha (הלכה) + the reasons of the mitzvot (טעמי המצוות) + the inner dimension in a single work, and it rules with a unique Talmudic rigor.

For Chabad, the Alter Rebbe is הפוסק האחרון — his ruling is the decisive authority. The Rebbe explicitly instructed to study the Shulchan Aruch of the Alter Rebbe (שולחן ערוך הרב) seriously. סעיף א לַיְלָה לָאו זְמַן צִיצִית הוּא… פְּרָט לִכְסוּת לַיְלָה. אֲבָל כְּסוּת סוּמָא — חַיָּב בְּצִיצִית, מִפְּנֵי שֶׁיֶּשְׁנוֹ בִּרְאִיָּה אֵצֶל אֲחֵרִים.

The night is not the time of tsitsit — the ראייה as criterion. The night is not the time of tsitsit (לַיְלָה לָאו זְמַן צִיצִית), as it is said: « וּרְאִיתֶם אֹתוֹ » — excluding the night garment (פְּרָט לִכְסוּת לַיְלָה). But the garment of a blind man (כְּסוּת סוּמָא) — is obligated in tsitsit, because it is within the seeing of others (יֶשְׁנוֹ בִּרְאִיָּה אֵצֶל אֲחֵרִים); therefore, even if the blind man himself wears it — one must attach tsitsit to it. The Rav's chidush: he opens the siman with the unifying criterion — the ראייה determines the obligation (the same criterion as for the סומא, cf. siman 17): the blind man's garment remains visible to others; the night is within no one's seeing.

The machloket כסות יום / כסות לילה — and the ruling in two registers. Some say: Scripture only excluded a garment that is not within seeing at the time of wearing (בִּשְׁעַת לְבִישָׁה) — hence whatever one wears at night, even a garment designated for the day, is exempt; and whatever one wears by day, even a garment designated for the night, is obligated — one attaches tsitsit to it before wearing it. And some say: Scripture only excluded the garment designated for the night — that garment is exempt even worn by day, since from the outset it was made only to be worn at a time unfit for seeing; but a garment designated for the day, or for day-and-night, is obligated even worn at night — and he blesses on it, since it was made to be worn at a time fit for seeing. And since the halacha has not been clarified for us — one is stringent in Torah prohibitions per the stringencies of both views: attach tsitsit to a day (or day-and-night) garment even when worn at night, and attach even to a night garment when worn by day. But as for the blessing — since סְפֵק בְּרָכוֹת לְהָקֵל, he only blesses when wearing, by day, a garment designated for the day or for day-and-night. The Rav's chidush: he splits the ruling into two registers — cumulative stringency of both views for the Torah obligation, leniency for the blessing (ספק ברכות) — the most systematic formulation of the din.

סעיף ג מִי שֶׁהָיָה לָבוּשׁ טַלִּית גָּדוֹל מִבְּעוֹד יוֹם — צָרִיךְ לְפָשְׁטוֹ כְּשֶׁמַּתְחִילִין «בָּרְכוּ»… אֲבָל בְּלֵיל יוֹם הַכִּפּוּרִים — אֵין מְסִירִין אוֹתוֹ בַּלַּיְלָה.

The talit at Maariv — removed at « בָּרְכוּ »; the night of Yom Kippur. One who was wearing the talit gadol from while it was still day (מִבְּעוֹד יוֹם)must remove it when they begin « בָּרְכוּ »: since nowadays the talit is worn only for the mitzva of tsitsit, if the talit remained on him at night — he would appear to hold that the night is the time of tsitsit. But on the night of Yom Kippur — all are accustomed to wrap in a talit gadol and bless on it while it is still day, and it is not removed at night, for the matter is known (הַדָּבָר יָדוּעַ) that it is not worn for the mitzva of tsitsit, but in order to resemble the angels (לְהִדַּמּוֹת לְמַלְאָכִים), who wear white and wrap in white. The Rav's chidush: he grounds the removal at « בָּרְכוּ » in appearance — one's conduct must not proclaim a false din; and he extracts the criterion that saves the night of Yom Kippur: הַדָּבָר יָדוּעַ (the intention is notorious).

סעיף ד כָּל הָעוֹבֵר לִפְנֵי הַתֵּבָה אֲפִלּוּ לוֹמַר סְלִיחוֹת — צָרִיךְ לְהִתְעַטֵּף… מֻתָּרִים לְהִתְעַטֵּף אֲפִלּוּ בַּלַּיְלָה, מִפְּנֵי כְּבוֹד הַצִּבּוּר.

Before the teva — כְּבוֹד הַצִּבּוּר, even at night. Whoever passes before the teva, even to say Selichot and supplications — must wrap in a talit gadol, out of honor for the congregation (כְּבוֹד הַצִּבּוּר). And even to say kaddish yatom — there is one who says (יֵשׁ מִי שֶׁאוֹמֵר) that he must wrap. Therefore they are permitted to wrap even at night: the matter is known (הַדָּבָר יָדוּעַ) that they do not intend the mitzva of tsitsit, but the honor of the congregation. The Rav's chidush: the same criterion as in seif ג — once the intention is notoriously other (כבוד הצבור), wrapping at night no longer proclaims that the night is the time of tsitsit.

סעיף ה סְדִינִים וְכָרִים… נִקְרָאִים כְּסוּת לַיְלָה וּפְטוּרִים מִן הַצִּיצִית… הַמִּנְהָג פָּשׁוּט שֶׁלֹּא לְהָטִיל בָּהֶם צִיצִית כְּלָל… יַעֲשֶׂה קֶרֶן אַחַת עֲגֻלָּה.

סְדִינִים וְכָרִים אַף־עַל־פִּי שֶׁאָדָם יָשֵׁן בָּהֶם לִפְעָמִים בַּיּוֹם, כֵּיוָן שֶׁעִקָּרָם לֹא נַעֲשָׂה אֶלָּא בִּשְׁבִיל הַלַּיְלָה, לָכֵן נִקְרָאִים כְּסוּת לַיְלָה וּפְטוּרִים מִן הַצִּיצִית. וּלְדִבְרֵי הָאוֹמְרִים כְּסוּת לַיְלָה חַיָּב בְּצִיצִית אִם לוֹבְשׁוֹ בַּיּוֹם — צָרִיךְ לְהָטִיל הַצִּיצִית לִסְדִינִים וְכָרִים, שֶׁהֲרֵי אָדָם יָשֵׁן בָּהֶם בַּבֹּקֶר. וְאַף־עַל־פִּי־כֵן הַמִּנְהָג פָּשׁוּט שֶׁלֹּא לְהָטִיל בָּהֶם צִיצִית כְּלָל, בֵּין שֶׁהֵם שֶׁל צֶמֶר בֵּין שֶׁהֵם שֶׁל פִּשְׁתָּן, מִפְּנֵי שֶׁיֵּשׁ אוֹמְרִים שֶׁלֹּא חִיְּבָה תּוֹרָה אֶלָּא אוֹתָן בְּגָדִים שֶׁאָדָם מִתְכַּסֶּה בָּהֶן דֶּרֶךְ לְבִישָׁה, שֶׁנֶּאֱמַר: «אֲשֶׁר תְּכַסֶּה בָּהּ», אֲבָל דֶּרֶךְ הַצָּעָה כְּגוֹן סְדִינִים וְכָרִים — אֵינָן נִקְרָאִים כְּסוּת כְּלָל. וּמִכָּל מָקוֹם, כֵּיוָן שֶׁיֵּשׁ חוֹלְקִין עַל סְבָרָא זוֹ, לָכֵן אִם הַסְּדִינִים אוֹ הַכַּר שֶׁל צֶמֶר — יַעֲשֶׂה קֶרֶן אַחַת עֲגֻלָּה, כְּדֵי לִפְטֹר מִן הַצִּיצִית לְדִבְרֵי הַכֹּל:

The sedinim (sheets and pillows) — כְּסוּת לַיְלָה, דֶּרֶךְ הַצָּעָה, the rounded corner. Sheets and pillows — even though one sometimes sleeps in them by day — since their essence was made only for the night (עִקָּרָם… בִּשְׁבִיל הַלַּיְלָה), they are called כְּסוּת לַיְלָה and are exempt from tsitsit. And according to those who say a night garment worn by day is obligated — one would have to attach tsitsit to sheets and pillows, since one sleeps in them in the morning. Nevertheless, the widespread custom (הַמִּנְהָג פָּשׁוּט) is to attach no tsitsit to them at all, whether of wool or of linen, because some say the Torah only obligated garments with which one covers oneself in the manner of wearing (דֶּרֶךְ לְבִישָׁה) — « אֲשֶׁר תְּכַסֶּה בָּהּ » — but in the manner of bedding (דֶּרֶךְ הַצָּעָה), like sheets and pillows, they are not called a garment at all. Still, since some dispute this reasoning — if the sheets or the pillow are of wool, one should make one corner rounded (קֶרֶן אַחַת עֲגֻלָּה), to be exempt from tsitsit according to all. The Rav's chidush: he grounds the exemption in the עִקָּר (the essential purpose), justifies the custom by the דֶּרֶךְ הַצָּעָה, and gives the practical device — the rounded corner (for wool, whose obligation is of the Torah; cf. the hierarchy of fabrics in siman 9).

סעיף ו מֵאֵימָתַי מְבָרֵךְ עַל הַצִּיצִית? מִשֶּׁיַּכִּיר בֵּין תְּכֵלֶת לְלָבָן… וְיֵשׁ אוֹמְרִים מִשֶּׁיַּעֲלֶה עַמּוּד הַשַּׁחַר — וְכֵן נוֹהֲגִין.

מֵאֵימָתַי מְבָרֵךְ עַל הַצִּיצִית? יֵשׁ אוֹמְרִים מִשֶּׁיַּכִּיר בֵּין תְּכֵלֶת שֶׁבָּהּ לְלָבָן שֶׁבָּהּ, שֶׁנֶּאֱמַר: «וּרְאִיתֶם אֹתוֹ», מִשְּׁעַת רְאִיָּה וְהַכָּרַת הַתְּכֵלֶת — מַתְחִיל הַחִיּוּב. וְיֵשׁ אוֹמְרִים דִּשְׁעַת רְאִיָּה נִקְרָא מִשֶּׁיַּעֲלֶה עַמּוּד הַשַּׁחַר, שֶׁאָז יְכוֹלִים לִרְאוֹת אֶת הַצִּיצִית, וְאַף־עַל־פִּי שֶׁאֵינוֹ מַכִּיר בֵּין הַתְּכֵלֶת שֶׁבָּהּ לַלָּבָן שֶׁבָּהּ — יָכוֹל לְבָרֵךְ עָלֶיהָ, דִּכְבָר חָל עָלֶיהָ שְׁעַת הַחִיּוּב. וְכֵן נוֹהֲגִין. וּמִכָּל מָקוֹם, טוֹב לִזָּהֵר לְכַתְּחִלָּה שֶׁלֹּא לִלְבּשׁ אֶת הַטַּלִּית בִּבְרָכָה עַד שֶׁיַּכִּיר בֵּין תְּכֵלֶת שֶׁבָּהּ לְלָבָן שֶׁבָּהּ:

מֵאֵימָתַי מְבָרֵךְ — the two morning thresholds. From when does one bless on the tsitsit? Some say: from when one can distinguish between its תְּכֵלֶת and its לָבָן (מִשֶּׁיַּכִּיר) — as it is said « וּרְאִיתֶם אֹתוֹ »: from the time of seeing and recognizing the techelet, the obligation begins. And some say: the time of seeing is from when עַמּוּד הַשַּׁחַר rises — for then one can see the tsitsit; and although he does not yet distinguish the techelet from the white — he may bless on it, for the time of obligation has already taken hold of it. וְכֵן נוֹהֲגִין (and such is the custom). Nevertheless, it is good to take care lechatchila not to don the talit with a blessing until he distinguishes the techelet from the white. The Rav's chidush: he upholds the custom (עלות השחר — the obligation already rests on the garment), while keeping the first view's demand as lechatchila (טוֹב לִזָּהֵר) — the two thresholds are ranked, not conflated.

סעיף ז הַמִּתְעַטֵּף קֹדֶם שֶׁיַּעֲלֶה עַמּוּד הַשַּׁחַר, כְּגוֹן בִּימֵי הַסְּלִיחוֹת — לֹא יְבָרֵךְ… וְלִכְשֶׁיֵּאוֹר הַיּוֹם — יְמַשְׁמֵשׁ בְּצִיצִיּוֹתָיו וִיבָרֵךְ.

הַמִּתְעַטֵּף בְּצִיצִית קֹדֶם שֶׁיַּעֲלֶה עַמּוּד הַשַּׁחַר, כְּגוֹן בִּימֵי הַסְּלִיחוֹת — לֹא יְבָרֵךְ עֲלֵיהֶן, וְלִכְשֶׁיֵּאוֹר הַיּוֹם — יְמַשְׁמֵשׁ בְּצִיצִיּוֹתָיו וִיבָרֵךְ עֲלֵיהֶן, מִשּׁוּם דְּהַמְמַשְׁמֵשׁ הוּא כְּאִלּוּ לוֹבְשָׁן עַכְשָׁו, וְאִם לֹא יְמַשְׁמֵשׁ בָּהֶן — אֵיךְ שַׁיָּךְ לְבָרֵךְ עַכְשָׁו עַל מַה שֶּׁלָּבַשׁ כְּבָר קֹדֶם שֶׁעָלָה עַמּוּד הַשַּׁחַר:

Before dawn (Selichot) — no blessing, then the מִשְׁמוּשׁ. One who wraps in tsitsit before עַמּוּד הַשַּׁחַר rises — as in the days of Selichotshall not bless on them; and when the day lights up — he palpates his tsitsit (יְמַשְׁמֵשׁ) and blesses on them, because the one who palpates is as though wearing them now (כְּאִלּוּ לוֹבְשָׁן עַכְשָׁו); and if he did not palpate them — how could he bless now on what he already donned before עמוד השחר rose? The Rav's chidush: he does not merely prescribe the mishmush — he gives its mechanism: the mishmush counts as a new לבישה, the only possible support for the blessing after the fact.

After Arvit — no more blessing; before, until צֵאת הַכּוֹכָבִים. If one wraps in tsitsit after having prayed Arvit — he shall not bless on them, for he has already made that hour into night by his prayer (עָשָׂה לְאוֹתָהּ שָׁעָה לַיְלָה בִּתְפִלָּתוֹ). But if he has not yet prayed — he may bless on them until צֵאת הַכּוֹכָבִים. The Rav's chidush: the Arvit prayer creates a subjective night — his own prayer has made it night for him, even while it is still day; hence the objective limit (צאת הכוכבים) for one who has not prayed.

The Alter Rebbe's reading of this siman unfolds in four movements. First, he sets the criterion: the night is not the time of tsitsit — « וּרְאִיתֶם אֹתוֹ » excludes the כְּסוּת לַיְלָה, but the כְּסוּת סוּמָא remains obligated (seeing by others) (seif א). Then, he decides the machloket in two registers: the stringencies of both views for the obligation, סְפֵק בְּרָכוֹת לְהָקֵל for the blessing — one blesses only by day, on a day garment (seif ב); and the sedinim stay without tsitsit (כסות לילה, דרך הצעה — rounded corner for wool) (seif ה). Next, he regulates the talit at night: remove it at « בָּרְכוּ », keep it on the night of Yom Kippur (לְהִדַּמּוֹת לְמַלְאָכִים), wrap before the teva even at night (כבוד הצבור) — all by the criterion of הַדָּבָר יָדוּעַ (seifim ג-ד, ח). The כְּסוּת סוּמָא. The blind man's garment remains obligated — יֶשְׁנוֹ בִּרְאִיָּה אֵצֶל אֲחֵרִים (the same logic as the סומא of siman 17): the seeing of others suffices; the night is within no one's seeing.

The two views (seif ב). First view: the time decides (worn at night → exempt, worn by day → obligated). Second view: the garment (a garment designated for the night is exempt even by day; a day garment is obligated even at night — and one would bless).

The ruling. Stringency of both views for the obligation (attach in both cases of doubt); סְפֵק בְּרָכוֹת לְהָקֵל for the blessing — bless only by day, on a day or day-and-night garment. And the sedinim (seif ה): exempt (their essence is for the night; the custom rests on the דֶּרֶךְ הַצָּעָה) — rounded corner if of wool.

Maariv (seif ג). Remove the talit gadol at « בָּרְכוּ » — keeping it at night would proclaim that the night is the time of tsitsit. After Arvit (seif ח): no more blessing — his prayer has made it night for him; before Arvit, until צֵאת הַכּוֹכָבִים.

The notorious exceptions. The night of Yom Kippur: all wrap and bless מִבְּעוֹד יוֹם, without removing at night — לְהִדַּמּוֹת לְמַלְאָכִים; before the teva (Selichot, kaddish yatom): wrap even at night — כְּבוֹד הַצִּבּוּר. The common criterion: הַדָּבָר יָדוּעַ (seif ד).

The morning threshold (and the mishmush)

The two thresholds (seif ו). מִשֶּׁיַּכִּיר בֵּין תְּכֵלֶת לְלָבָן (the effective seeing) or עַמּוּד הַשַּׁחַר (the obligation already rests) — וְכֵן נוֹהֲגִין; yet good lechatchila to wait for מִשֶּׁיַּכִּיר.

The מִשְׁמוּשׁ (seif ז). Wrapped before dawn (Selichot) — no blessing; when the day lights up, palpate the tsitsit and bless: the mishmush counts as כְּאִלּוּ לוֹבְשָׁן עַכְשָׁו.

קו א — הראייה קובעת

The ראייה as criterion (the night excluded)

Principle of the siman: the night is not the time of tsitsit — « וּרְאִיתֶם אֹתוֹ » excludes the כסות לילה (seif 1 of the Mehaber).

The Rav's reading: the criterion is the ראייה — hence the כְּסוּת סוּמָא remains obligated (יֶשְׁנוֹ בִּרְאִיָּה אֵצֶל אֲחֵרִים), and the same ראייה will fix the morning threshold (seifim א, ו).

Practical consequence: no blessing on the tsitsit at night; in the morning, the blessing follows the return of the ראייה — for borderline cases, consult a Rav (seifim א, ו).

For the Chabad Chassid — Siman י״ח (זמן ציצית)

  • ① The night is not the time of tsitsit — yet the double stringency. « וּרְאִיתֶם אֹתוֹ » excludes the כסות לילה; nevertheless, one attaches tsitsit to a day (or day-and-night) garment even worn at night, and even to a night garment worn by day — stringency of both views. Basis: SA HaRav seifim א-ב.
  • ② The blessing — only by day, on a day garment. סְפֵק בְּרָכוֹת לְהָקֵל: one blesses only when wearing, by day, a garment designated for the day or for day-and-night. Basis: SA HaRav seif ב.
  • ③ At Maariv — remove the talit at « בָּרְכוּ »; on the night of Yom Kippur — keep it. The talit gadol worn since daytime is removed when they begin « בָּרְכוּ » (appearance); on the night of Yom Kippur, all wrap and bless מִבְּעוֹד יוֹם and do not remove it — לְהִדַּמּוֹת לְמַלְאָכִים.
