After the laws of the final waters (previous siman), the Choulhan Aroukh takes up here the cup (כוס) of Birkat haMazon. The siman opens with a foundational question: does Birkat haMazon require a cup? Three opinions clash (אפילו ביחיד / only for three / not at all), and the Rama rules in practice that it is a מצוה מן המובחר. The siman then settles the nature of the cup (wine, or failing that חמר מדינה, never water) and above all the great theme of the כוס פגום — the cup "diminished" by a sip — with its repairs. We study here at the level of principle; for personal conduct, one refers to the Rav's decision.

A. טעונה כוס — does Birkat haMazon require a cup

כּוֹס שֶׁל בְּרָכָה — the "cup of blessing": the cup of wine over which Birkat haMazon is recited. טָעוּן כּוֹס — "requires a cup": the debate is whether this cup is an obligation, and in what framework (an individual, a zimmun of three, or no framework at all).

Seif 1 — the three opinions on the obligation of the cup

יש אומרים שברכת המזון טעונה כוס אפילו ביחיד וצריך לחזור עליו ולא יאכל אם אין לו כוס לברך עליו אם הוא מצפה ואפשר שיהיה לו אפי׳ אם צריך לעבור זמן אכילה אחת ולפי זה אם שני׳ אוכלים יחד צריך לקחת כל אחד כוס לברכת המזון ויש אומרי׳ שאינה טעונה כוס אלא בשלשה ויש אומרים שאינה טעונה כוס כלל אפילו בשלשה: הגה ומ״מ מצוה מן המובחר לברך על הכוס: [ר״ן פ׳ ערבי פסחים]:
Seif 1: There are those who say that Birkat haMazon requires a cup, even for an individual, and that he must seek it out, and does not eat if he has no cup on which to bless, so long as he expects it and it is possible he will have one, even if he must let one meal-time pass. And according to this, if two eat together, each must take a cup for Birkat haMazon. And there are those who say it requires a cup only for three. And there are those who say it requires no cup at all, even for three. Rama's gloss: and in any case it is a mitzvah min hamuvchar to bless on the cup (Ran, chapter Arvei Pesahim).
Three opinions, one practical conclusion. The first is the most demanding: Birkat haMazon « ברכת המזון טעונה כוס אפילו ביחיד » (שו״ע או״ח קפ״ב:א) — requires a cup even alone, to the point of delaying the meal to obtain it. The second limits it to the zimmun — « שאינה טעונה כוס אלא בשלשה » (שו״ע או״ח קפ״ב:א); the third lifts it entirely — « שאינה טעונה כוס כלל אפילו בשלשה » (שו״ע או״ח קפ״ב:א). The Rama rules practically: « מצוה מן המובחר לברך על הכוס » (רמ״א או״ח קפ״ב:א) — without making it a strict obligation, it is the finest way to fulfill the mitzvah.

B. של יין / חמר מדינה — on which drink

חֲמַר מְדִינָה — the "wine of the land": the reference drink of a region where wine is not common (beer, etc.), on which the cup may be recited when there is no wine. מַיִם (water) is always excluded.

Seif 2 — wine, chamar medina, and the exclusion of water

כוס ברכת המזון אינו אלא של יין ולא משאר משקים אפילו קבע סעודתו עליהם ואם אין יין מצוי באותו מקום והשכר או שאר משקין הוו חמר מדינה מברכין עליהם חוץ מן המים: הגה ומה שנוהגין במדינות אלו לברך על השכר אין למחות דהא יש אומרים דאינו טעון כוס כלל ועוד דהא עיקר חמר מדינה הוא שכר וקובעין הסעודה עליו ואע״ג דיין נמצא בעיר מ״מ לא מקרי מצוי לדבר זה שהוא ביוקר ואי אפשר לקנות יין בכל סעודה לברך עליו אמנם המצוה מן המובחר לברך על יין [ד״ע] ויש מדקדקין כשמברכין ביחיד על היין שלא לאחוז הכוס בידם רק מניחין אותו על השלחן לפניהם ונכון מנהג זה על דרך הקבלה (ב״י):
Seif 2: The cup of Birkat haMazon is only of wine, and not of other drinks, even if he fixed his meal on them. And if there is no wine available in that place, and beer or other drinks are the "wine of the land" (חמר מדינה), one blesses on them — except water. Rama's gloss: and the custom in these lands to bless on beer, one does not protest it, for there are those who say no cup is required at all, and moreover the principal chamar medina there is beer, on which the meal is fixed; and even though wine is found in the city, it is not therefore called "available" for this, being expensive and one cannot buy wine at every meal to bless on it; nevertheless, the mitzvah min hamuvchar is to bless on wine. And there are scrupulous ones who, when blessing alone on wine, do not hold the cup in their hand but place it on the table before them — and this custom is correct, by the way of the Kabbalah (Beit Yossef).
Wine first, chamar medina failing that, never water. The principle: « כוס ברכת המזון אינו אלא של יין ולא משאר משקים » (שו״ע או״ח קפ״ב:ב), « אפילו קבע סעודתו עליהם » (שו״ע או״ח קפ״ב:ב). But « ואם אין יין מצוי באותו מקום » (שו״ע או״ח קפ״ב:ב) and other drinks are חמר מדינה, « מברכין עליהם חוץ מן המים » (שו״ע או״ח קפ״ב:ב) — one blesses on them, except water. The Rama does not protest the custom of blessing on beer (« אין למחות », רמ״א או״ח קפ״ב:ב), while recalling that « המצוה מן המובחר לברך על יין » (רמ״א או״ח קפ״ב:ב).

C. כוס פגום — the cup drunk from

כּוֹס פָּגוּם — a "diminished" cup: one that has already been drunk from directly. One does not recite the cup of blessing over such a cup without repairing it.

Seif 3 — what makes the cup pagum, and what does not spoil it

צריך שלא יהא פגום שאם שתה ממנו פגמו אבל אם שפך ממנו לתוך ידו או כלי אין בכך כלום ואפי׳ שתה מהכד או מחבית קטנה הוי פגום אבל אם שתה מחבית של עץ גדולה אין להקפיד יש מי שאומ׳ שאפי׳ מים פגומים פסולים למזוג בהם כוס של ברכ׳:
Seif 3: It must not be pagum, for if he drank from it, he made it pagum; but if he poured from it into his hand or a vessel, there is nothing to it. And even if he drank from the jug or from a small barrel, it is pagum; but if he drank from a large wooden barrel, one need not be strict. There is one who says that even pagum water is invalid for mixing into the cup of blessing.
Drinking spoils the cup; pouring does not. The basic din: « צריך שלא יהא פגום שאם שתה ממנו פגמו » (שו״ע או״ח קפ״ב:ג) — it is drinking directly from the cup that makes it pagum. Conversely, « אבל אם שפך ממנו לתוך ידו או כלי אין בכך כלום » (שו״ע או״ח קפ״ב:ג) — pouring into the hand or a vessel does not spoil it. The rule extends even to what one drank from: the jug or a small barrel become פגום, but for a large barrel « אין להקפיד » (שו״ע או״ח קפ״ב:ג). Finally, per one opinion, even « מים פגומים פסולים למזוג בהם » (שו״ע או״ח קפ״ב:ג) — pagum water is unfit to be added to the cup.

D. כוסות המסובין — the guests' cups

Seif 4 — when the guests' cups are pagum

אם היו כוסות המסובין פגומים צריך לתת מכוס הברכה לתוכם ויש מי שאומר שאינו צריך [וע״ל סי׳ ק״ץ וסי׳ ער״א]:
Seif 4: If the cups of those seated were pagum, he must pour into them from the cup of blessing; and there is one who says he need not (cf. supra siman 190 and siman 271).
Making the guests' cups valid. According to the first opinion, « אם היו כוסות המסובין פגומים צריך לתת מכוס הברכה לתוכם » (שו״ע או״ח קפ״ב:ד) — one pours a little of the (non-pagum) cup of blessing into the guests' diminished cups to repair them. But another opinion is lenient: « ויש מי שאומר שאינו צריך » (שו״ע או״ח קפ״ב:ד). The Mehaber refers to simanim 190 and 271, where the same theme recurs regarding Kiddush and Havdalah.

E. החזיר לקנקן — pagum wine returned to the jug

Seif 5 — קמא קמא בטיל: the reintegrated wine is nullified

אם החזיר יין של כוס פגום לקנקן היין שבקנקן כשר משום דקמא קמא בטיל:
Seif 5: If he returned the wine of a pagum cup to the jug, the wine in the jug is valid, because "the first, first is nullified" (קמא קמא בטיל).
The diminished wine dissolves into the mass. One might fear that pouring pagum wine back into the jug would render the whole content pagum. The Mehaber rules otherwise: « אם החזיר יין של כוס פגום לקנקן היין שבקנקן כשר » (שו״ע או״ח קפ״ב:ה), « משום דקמא קמא בטיל » (שו״ע או״ח קפ״ב:ה) — each drop of pagum wine, as it falls, is immediately nullified in the majority of valid wine in the jug; the whole thus remains fit for the cup of blessing.

F. תיקון הכוס — repairing the pagum cup

Seif 6 — adding wine, or even water

יכולין לתקן כוס פגום ע״י שיוסיפו מעט יין ואפי׳ ע״י שיוסיפו עליו מים מיתקן:
Seif 6: One can repair a pagum cup by adding a little wine; and even by adding water to it, it is repaired.
A pagum cup is repaired by a simple addition. The Mehaber gives the remedy: « יכולין לתקן כוס פגום » (שו״ע או״ח קפ״ב:ו) — one can repair the diminished cup, « ע״י שיוסיפו מעט יין » (שו״ע או״ח קפ״ב:ו) by adding a little wine; and even adding water suffices — « ואפי׳ ע״י שיוסיפו עליו מים מיתקן » (שו״ע או״ח קפ״ב:ו). The addition restores the cup's "whole" character.

G. שעת הדחק — in pressing circumstances

Seif 7 — blessing on a pagum cup in pressing circumstances

בשעת הדחק מברכין על כוס פגום:
Seif 7: In pressing circumstances (בשעת הדחק), one blesses on a pagum cup.
When nothing else is possible. All the requirements above apply when one can do otherwise; but « בשעת הדחק מברכין על כוס פגום » (שו״ע או״ח קפ״ב:ז) — in pressing circumstances (no other cup, nothing to repair it with), one blesses nonetheless on a pagum cup, rather than forgo the cup of blessing.
The siman in one sentence: Birkat haMazon has a cup — three opinions on the obligation, but a מצוה מן המובחר to bless on it; this cup is of wine (failing that, חמר מדינה, never water), it must not be pagum (the one drunk from), and a diminished cup is repaired (adding wine or water, wine returned to the jug) — except בשעת הדחק, where one blesses even on a pagum cup.

Practical cases

Case 1 — Blessing on beer

Situation: I have no wine on hand, but I have beer. May I recite Birkat haMazon over a cup of beer?
Conduct: if the beer is חמר מדינה in the place, « מברכין עליהם חוץ מן המים » (שו״ע או״ח קפ״ב:ב) — one may bless on it (never on water), and the Rama notes that this custom is not protested (seif 2). Nonetheless, « המצוה מן המובחר לברך על יין » (רמ״א או״ח קפ״ב:ב). For the details (what is chamar medina in one's place), follow your Rav.

Case 2 — A cup someone already drank from

Situation: the cup I want to use for Birkat haMazon has already been used: someone drank from it. May I bless on it as is?
Conduct: not as is — « שאם שתה ממנו פגמו » (שו״ע או״ח קפ״ב:ג), it is pagum. But one repairs it easily: « יכולין לתקן כוס פגום ע״י שיוסיפו מעט יין » (שו״ע או״ח קפ״ב:ו), or even by adding water (seif 6). For the exact conduct, refer to your Rav.

Case 3 — Nothing but a diminished cup

Situation: I have only a pagum cup and nothing to repair it with (no wine or water to add). What do I do?
Conduct: in such a constraint, « בשעת הדחק מברכין על כוס פגום » (שו״ע או״ח קפ״ב:ז) — one blesses nonetheless on the pagum cup (seif 7), rather than lose the cup of blessing. For practice, follow your Rav.
