Level 4 — Daat HaRav (Alter Rebbe) — Siman קפ״ב · דִּינֵי כּוֹס בִּרְכַּת הַמָּזוֹן וְשֶׁלֹּא יִהְיֶה פָּגוּם

The Alter Rebbe’s way on דִּינֵי כּוֹס בִּרְכַּת הַמָּזוֹן וְשֶׁלֹּא יִהְיֶה פָּגוּם : whether birkat hamazon requires a cup ; a cup of wine or chamar medina ; inferior beverages ; a cup that must not be pagum ; repairing a pagum cup ; and repair by water and in pressing need — in the Habad sensibility.

Why a Level 4 devoted to the Alter Rebbe ? The Alter Rebbe’s Shulchan Aruch is not a commentary on the Mehaber (מחבר) — it is a complete, self-standing Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Habad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity : it combines halakha (הלכה) + טעמי המצוות + inner dimension in one work, and rules with a unique Talmudic rigor.

For Habad, the Alter Rebbe is הפוסק האחרון — his psak is the deciding authority. This page gathers the Rav’s way on siman קפ״ב — דִּינֵי כּוֹס בִּרְכַּת הַמָּזוֹן וְשֶׁלֹּא יִהְיֶה פָּגוּם, which unfolds in the Rav over ו׳ סְעִיפִים (six seifim) : from the question whether birkat hamazon requires a cup (and the present custom), to the requirement that the cup be of wine — or of chamar medina where wine is not available —, to the exclusion of too-inferior beverages, to the prohibition of a pagum cup and its repair, up to repair by a little water and conduct in pressing need (bishaat hadhak).

סעיף א יֵשׁ אוֹמְרִים שֶׁבִּרְכַּת הַמָּזוֹן טְעוּנָה כּוֹס — וְהַמִּנְהָג כְּהַמְּקִלִּין.

דִּין כּוֹס בִּרְכַּת הַמָּזוֹן, וְשֶׁלֹּא יִהְיֶה פָּגוּם, וּבוֹ ו׳ סְעִיפִים:יֵשׁ אוֹמְרִים שֶׁבִּרְכַּת הַמָּזוֹן טְעוּנָה כּוֹס אֲפִלּוּ בְּיָחִיד, וְצָרִיךְ לְחַזֵּר אַחֲרָיו כְּדֶרֶךְ שֶׁמְּחַזְּרִין אַחַר כָּל מִצְוֹת שֶׁהֵן חוֹבָה. וְלֹא יֹאכַל אִם אֵין לוֹ כּוֹס לְבָרֵךְ עָלָיו וּמְצַפֶּה שֶׁיִּהְיֶה לוֹ אַחַר כָּךְ, וַאֲפִלּוּ אִם צָרִיךְ לַעֲבֹר זְמַן אֲכִילָה אַחַת.

בַּמֶּה דְּבָרִים אֲמוּרִים? בְּזִמּוּן, אֲבָל בְּיָחִיד — אֵין צָרִיךְ כּוֹס כְּלָל אַף לְמִצְוָה מִן הַמֻּבְחָר, וַאֲפִלּוּ יֵשׁ לוֹ.

(אֲבָל מִנְהַג הָעוֹלָם שֶׁלֹּא לְבָרֵךְ עַל הַכּוֹס כְּלָל בְּיָחִיד. וְנָכוֹן מִנְהָג זֶה עַל דֶּרֶךְ הַקַּבָּלָה):

הַאִם בִּרְכַּת הַמָּזוֹן טְעוּנָה כּוֹס. There are those who say that birkat hamazon requires a cup even for an individual, and that one must seek after it as one seeks after everything pertaining to the mitzvot that are an obligation. And he shall not eat if he has no cup over which to bless but expects to have one afterward, even if he must for this let one meal-time pass.
According to this, if two eat together — each one must take a cup for birkat hamazon; unlike three who make zimun together — the one who blesses over the cup discharges them of their obligation of the cup, just as he discharges them of birkat hamazon.
And there are those who say that birkat hamazon requires a cup only when one blesses in zimun. And there are those who say that even with three or with ten it does not require a cup as an obligation, but only as a mitzvah min hamuvchar if he has one, yet without needing to seek after it as one seeks after the mitzvot that are an obligation (and so is the custom now).
In what case does this apply? In zimun; but for an individual — he needs no cup at all, not even as a mitzvah min hamuvchar, and even if he has one.
And there are meticulous ones who, when they bless alone, place the cup on the table and do not hold it in hand, so as to be quit according to all: for according to those who say it requires a cup even for an individual — behold, the cup is before him, and holding it is only a mitzvah min hamuvchar according to all.
(But the widespread custom is not to bless over a cup at all when alone. And this custom is correct according to the way of Kabbalah.)

סעיף ב כּוֹס בִּרְכַּת הַמָּזוֹן — שֶׁל יַיִן אוֹ חֲמַר מְדִינָה.

כּוֹס בִּרְכַּת הַמָּזוֹן אֵינָהּ אֶלָּא שֶׁל יַיִן וְלֹא שֶׁל שְׁאָר מַשְׁקִין, אֲפִלּוּ קָבַע סְעוּדָתוֹ עֲלֵיהֶם, שֶׁכָּל כּוֹס שֶׁל בְּרָכָה לֹא תִּקְנוּ אֶלָּא מִיַּיִן שֶׁהוּא "מְשַׂמֵּחַ אֱלֹקִים וַאֲנָשִׁים".

וּמִכָּל מָקוֹם, מִצְוָה מִן הַמֻּבְחָר לְבָרֵךְ עַל יַיִן. וְכָל שֶׁכֵּן אִם יֵשׁ לוֹ יַיִן בְּבֵיתוֹ, שֶׁאֵין זֶה הִדּוּר כְּלָל לְבָרֵךְ עַל שְׁאָר מַשְׁקִים, אֶלָּא אִם כֵּן יֵשׁ לוֹ מְעַט לְצֹרֶךְ קִדּוּשׁ, שֶׁקִּדּוּשׁ קֹדֶם לְבִרְכַּת הַמָּזוֹן, מִפְּנֵי שֶׁהוּא טָעוּן כּוֹס לְדִבְרֵי הַכֹּל. וְאַף שֶׁאֶפְשָׁר לְקַדֵּשׁ עַל הַפַּת, מִכָּל מָקוֹם, עִקַּר הַקִּדּוּשׁ נִתְקַן עַל הַיַּיִן, כְּמוֹ שֶׁיִּתְבָּאֵר בְּסִימָן רע״א:

כּוֹס שֶׁל יַיִן אוֹ חֲמַר מְדִינָה. The cup of birkat hamazon is only of wine and not of other beverages, even if he established his meal upon them, for every cup of blessing was instituted only from wine, which “gladdens God and men.”
And in places where wine is not available, and beer or other beverages are the chamar medina (“the wine of the land”) — that is, that most of the people of the place are accustomed to establish their meal upon them, as one establishes upon wine in places where it is available — one blesses birkat hamazon over them, even though there is wine in the city. And whenever there is not much wine growing within a day’s journey around the whole city, even if a little grows near the city and much wine is also available in the shop — this is not called “available,” since it is expensive, and certainly most of the city’s people do not always establish their meal upon it.
Nevertheless, it is a mitzvah min hamuvchar to bless over wine. And all the more so if he has wine in his house, for it is no beautification at all to bless over other beverages — unless he has only a little, needed for kiddush, since kiddush precedes birkat hamazon, because it requires a cup according to all. And although it is possible to make kiddush over bread, nevertheless the essence of kiddush was instituted over wine, as will be explained in siman רע״א.

סעיף ג מַשְׁקִים גְּרוּעִים — אֵינָם חֲמַר מְדִינָה.

וְכָל זֶה בְּמַשְׁקִים חֲשׁוּבִים כְּשֵׁכָר וְכַיּוֹצֵא בּוֹ, אֲבָל מַשְׁקִים גְּרוּעִים, כְּמוֹ מַה שֶּׁקּוֹרִין בִּמְדִינוֹת אֵלּוּ (קְוַוא״ס) אוֹ (בָּארְשְׁ״ט) — אֵין לָהֶם חֲשִׁיבוּת יוֹתֵר מִמַּיִם, וְאֵין מְבָרְכִים עֲלֵיהֶם בִּרְכַּת הַמָּזוֹן אֲפִלּוּ בְּמָקוֹם שֶׁדֶּרֶךְ רֹב אַנְשֵׁי הָעִיר לִקְבֹּעַ סְעוּדָה עֲלֵיהֶם, וְאֵין צָרִיךְ לוֹמַר קִדּוּשׁ וְהַבְדָּלָה, לְפִי שֶׁאֵינוֹ נִקְרָא חֲמַר מְדִינָה אֶלָּא מַה שֶּׁיֵּשׁ לוֹ חֲשִׁיבוּת בְּאוֹתָהּ מְדִינָה כְּעֵין חֲשִׁיבוּת יַיִן בְּכָל הַמְּדִינוֹת.
וַאֲפִלּוּ אֵינוֹ שְׁתִיַּת רֹב אַנְשֵׁי הָעִיר, אֶלָּא שׁוֹתִין אוֹתוֹ לִפְרָקִים בִּלְבַד מִפְּנֵי חֲשִׁיבוּתוֹ, כְּמוֹ (מֶע״ד) בִּמְדִינוֹת אֵלּוּ — לֹא נִגְרָע מִפְּנֵי זֶה לְבָרֵךְ וּלְקַדֵּשׁ עָלָיו, כֵּיוָן שֶׁזֶּהוּ מִפְּנֵי חֲשִׁיבוּתוֹ, שֶׁהוּא חָשׁוּב יוֹתֵר מִן הַשֵּׁכָר, וְלָכֵן רָאוּי יוֹתֵר לְכוֹס שֶׁל בְּרָכָה מִן הַשֵּׁכָר, וְגַם הוּא חֲמַר מְדִינָה יוֹתֵר מִמֶּנּוּ, כֵּיוָן שֶׁחָשׁוּב יוֹתֵר, שֶׁהֲרֵי כָּל מַעֲלַת הַיַּיִן לְכוֹס שֶׁל בְּרָכָה אֵינוֹ אֶלָּא מִפְּנֵי חֲשִׁיבוּתוֹ, וְלֹא מִפְּנֵי שֶׁהוּא רֹב הַשְּׁתִיָּה בִּמְקוֹמוֹת שֶׁהוּא מָצוּי לָרֹב, שֶׁהֲרֵי אַף בִּמְקוֹמוֹת שֶׁשְּׁאָר מַשְׁקִים הֵם רֹב הַשְּׁתִיָּה, אַף עַל פִּי כֵן מִצְוָה מִן הַמֻּבְחָר בְּיַיִן מִפְּנֵי חֲשִׁיבוּתוֹ, אִם כֵּן כָּל מַשְׁקֶה שֶׁחָשׁוּב יוֹתֵר הוּא קָרוֹב לְיַיִן יוֹתֵר.
וּמַה שֶּׁנָּהֲגוּ הֶהָמוֹן כְּשֶׁשּׁוֹתִין שֵׁכָר בַּסְּעוּדָה וְאַחַר הַסְּעוּדָה קוֹבְעִים עַצְמָם לִשְׁתּוֹת מֵי דְּבַשׁ וּמְבָרְכִין בִּרְכַּת הַמָּזוֹן עַל הַשֵּׁכָר בְּאָמְרָם שֶׁהוּא חֲמַר מְדִינָה — הוּא בִּזּוּי מִצְוָה, וְהוּא בִּכְלַל מַה שֶּׁאָמְרוּ: "שֶׁלֹּא יְהֵא שֻׁלְחָנְךָ מָלֵא וְשֻׁלְחַן רַבְּךָ רֵיקָם". וְעוֹד, כֵּיוָן שֶׁמֵּי דְּבַשׁ חָבִיב עָלָיו מֵהַשֵּׁכָר — הוּא מֻקְדָּם לִבְרָכָה, כְּמוֹ שֶׁיִּתְבָּאֵר בְּסִימָן רי״א:

מַשְׁקִים גְּרוּעִים. And all this is with important beverages like beer and its like; but inferior beverages, such as what are called in these countries (kvass) or (borscht) — have no more importance than water, and one does not bless birkat hamazon over them even in a place where most of the city’s people are accustomed to establish a meal upon them, and needless to say neither kiddush nor havdala — for only that which has importance in that country, resembling the importance of wine in all countries, is called chamar medina.
And even if it is not the drink of most of the city’s people, but they drink it only occasionally because of its importance, like (med / mead) in these countries — it is not diminished thereby from blessing and making kiddush over it, since this is because of its importance, being more important than beer: it is therefore more fitting for a cup of blessing than beer, and it is also more chamar medina than it, being more important — for all the superiority of wine for the cup of blessing is only because of its importance, and not because it is the predominant drink in places where it is available in abundance; for even in places where other beverages are the predominant drink, it remains a mitzvah min hamuvchar to bless over wine because of its importance. Thus, any beverage that is more important is closer to wine.
And what the multitude are accustomed to do, when drinking beer at the meal and after the meal establishing themselves to drink mead, blessing birkat hamazon over the beer saying it is chamar medina — is a disgrace of the mitzvah, and is included in what they said: “that your table not be full while your teacher’s table is empty.” And moreover, since the mead is dearer to him than the beer — it takes precedence for the blessing, as will be explained in siman רי״א.

סעיף ד כּוֹס שֶׁל בְּרָכָה — שֶׁלֹּא יִהְיֶה פָּגוּם.

כּוֹס שֶׁל בְּרָכָה צָרִיךְ שֶׁלֹּא יְהֵא פָּגוּם, שֶׁאִם שָׁתָה מִמֶּנּוּ — פְּגָמוֹ. וַאֲפִלּוּ לֹא הִקְרִיב אֵלָיו אֶת פִּיו, אֶלָּא שָׁפַךְ לְתוֹךְ פִּיו. אֲבָל אִם שָׁפַךְ מִמֶּנּוּ לְתוֹךְ יָדוֹ אוֹ לְתוֹךְ כְּלִי וְשָׁתָה — אֵין בְּכָךְ כְּלוּם.
וְהוּא שֶׁלֹּא שָׁפַךְ אֶלָּא מְעַט, בְּעִנְיַן שֶׁעֲדַיִן שֵׁם מָלֵא עָלָיו, אוֹ שֶׁאַחַר כָּךְ שְׁפָכוֹ לְתוֹךְ כּוֹס קָטָן מִמֶּנּוּ וְהוּא מָלֵא, אוֹ שֶׁזּוֹרֵק לְתוֹכוֹ אֵיזֶה דָּבָר לְהַגְבִּיהַּ הַיַּיִן שֶׁיְּהֵא הַכּוֹס מָלֵא, שֶׁאֵינוֹ צָרִיךְ לִהְיוֹת מָלֵא כֻּלּוֹ מִיַּיִן, כִּי דַּי בִּרְבִיעִית, רַק שֶׁלֹּא יִהְיֶה חָסֵר.
וַאֲפִלּוּ שָׁתָה מֵהַכַּד אוֹ מֵחָבִית שֶׁל חֶרֶס שֶׁהִיא קְטַנָּה — נִפְגַּם כָּל הַיַּיִן שֶׁבָּהֶם. אֲבָל אִם שָׁתָה מֵחָבִית שֶׁל עֵץ שֶׁהִיא גְּדוֹלָה — אֵין לְהַקְפִּיד. וְיֵשׁ מַחֲמִירִין. וְיֵשׁ לָחֹש לְדִבְרֵיהֶם לְכַתְּחִלָּה, שֶׁלֹּא לְהַנִּיחַ לִשְׁתּוֹת אֲפִלּוּ מִפִּי בַּרְזָא מֵחָבִית גְּדוֹלָה:

כּוֹס שֶׁלֹּא יִהְיֶה פָּגוּם. The cup of blessing must not be pagum (defective): for if he drank from it — he made it pagum. And even if he did not bring his mouth to it, but poured into his mouth. But if he poured from it into his hand or into a vessel and drank — that is nothing.
And this, provided he poured out only a little, in such manner that the designation of “full” still remains upon it; or that he afterward poured it into a cup smaller than it and it is full; or that he throws into it some object to raise the wine so that the cup be full — for it need not be entirely full of wine: a revi‘it suffices, only that it not be deficient.
And even if he drank from the jug or from a small earthenware barrel — all the wine in them is made pagum. But if he drank from a large wooden barrel — one need not be strict. And there are those who are stringent. And it is fitting to be concerned for their words lechatehila, not to allow drinking even from the tap of a large barrel.

סעיף ה תִּקּוּן כּוֹס פָּגוּם — עַל יְדֵי תּוֹסֶפֶת יַיִן.

כּוֹס פָּגוּם יְכוֹלִים לְתַקְּנוֹ עַל יְדֵי שֶׁיּוֹסִיפוּ עָלָיו מְעַט יַיִן, שֶׁעִקַּר הַפִּגוּם מִשּׁוּם שֶׁשָּׁתָה מִמֶּנּוּ, וּכְשֶׁחוֹזֵר וּמוֹסִיף עָלָיו — מִתַּקֵּן בְּכָךְ, כְּמוֹ פְּגִימַת הַמִּזְבֵּחַ שֶׁמִּתַּקֵּן אִם חוֹזֵר וְסוֹתְמוֹ. וְכֵן אִם הֶחֱזִיר יַיִן שֶׁבְּכוֹס פָּגוּם לַקַּנְקַן — נִתְבַּטֵּל בְּתוֹכוֹ בְּרֹב וְכָשֵׁר. וּמִכָּל מָקוֹם, אֵין לַעֲשׂוֹת כֵּן, וְלָכֵן נוֹהֲגִים לְהוֹסִיף עָלָיו מְעַט מֵהַקַּנְקַן וּבָזֶה מִתַּקֵּן, וְאַחַר כָּךְ שׁוֹפְכִים אוֹתוֹ לְתוֹךְ הַקַּנְקַן, וְחוֹזְרִים וּמוֹצִיאִים אוֹתוֹ מֵהַקַּנְקַן לְשֵׁם בְּרָכָה, כְּמוֹ שֶׁיִּתְבָּאֵר בְּסִימָן קפ״ג:

תִּקּוּן כּוֹס פָּגוּם. A pagum cup can be repaired by adding a little wine to it: for the essence of the pegam comes from his having drunk from it, and when one adds to it again — it is repaired thereby, like the breach of the altar (pegimat hamizbeach) which is repaired if one seals it again. And likewise, if he returned the wine of a pagum cup to the jug — it is nullified within it by the majority and becomes valid. Nevertheless, one should not do so; therefore they are accustomed to add to it a little from the jug, and thereby it is repaired; and afterward they pour it into the jug, and again draw it out from the jug for the sake of the blessing, as will be explained in siman קפ״ג.

סעיף ו תִּקּוּן עַל יְדֵי מַיִם, וּבִשְׁעַת הַדְּחָק — כּוֹס פָּגוּם.

וּבִשְׁעַת הַדְּחָק, שֶׁאֵין לוֹ לֹא יַיִן וְלֹא מַיִם — מוּטָב לְבָרֵךְ עַל כּוֹס פָּגוּם מִלְּבָרֵךְ בְּלֹא כּוֹס כְּלָל, בִּמְקוֹמוֹת שֶׁשְּׁאָר מַשְׁקִים אֵינָם חֲמַר מְדִינָה, אוֹ שֶׁאֵין לוֹ:

תִּקּוּן עַל יְדֵי מַיִם וּבִשְׁעַת הַדְּחָק. Even by a little water added to it — it is repaired, whether wine or other beverages that are chamar medina, if it is impossible to repair them with their own kind. And this, provided they are not spoiled by the water to the point of no longer being fit to drink. And a cup of wine, even if he has more wine — he may repair it by water, so long as he does not spoil it thereby, since one is accustomed to dilute it with water.
And if the water is itself pagum — it is invalid even to dilute with it a wine that is not pagum, for the water is not nullified in the wine by the majority, since the taste of the water is perceptible in the wine, a diluted wine not being equal in its taste to an undiluted one.
And in pressing need (bishaat hadhak), where he has neither wine nor water — it is better to bless over a pagum cup than to bless without a cup at all, in places where other beverages are not chamar medina, or where he has none.

The Habad practical conduct

Points of conduct flowing directly from siman קפ״ב in the Alter Rebbe’s and Habad sensibility — presented at the level of the principle, referring to the Rav for the detail of the cases.

For the Habad Hassid — Siman קפ״ב (דִּינֵי כּוֹס בִּרְכַּת הַמָּזוֹן וְשֶׁלֹּא יִהְיֶה פָּגוּם)

  • ① Seif א. Does birkat hamazon require a cup? According to the views — required even alone, or only in zimun, or only as a mitzvah min hamuvchar. The Rav concludes: and so is the custom now — for an individual no cup is required, not even min hamuvchar, and the widespread custom is not to bless alone over a cup, which is correct by the way of Kabbalah. Some meticulous ones, when alone, place the cup on the table without holding it to satisfy all views.
  • ② Seif ב. The cup is of wine; where wine is not available and beer or another beverage is the chamar medina (upon which most establish their meal), one blesses over it. Expensive/scarce wine is not “available.” Mitzvah min hamuvchar: to bless over wine, all the more if he has it at home — except to reserve the little wine for kiddush, which requires a cup according to all.
  • ③ Seif ג. Inferior beverages (kvass, borscht) are no better than water: no birkat hamazon, no kiddush, no havdala over them. A beverage drunk occasionally but important (mead) remains fit, for it is importance that makes chamar medina. Drinking mead after the meal and blessing over the beer is a bizuy mitzvah.
  • ④ Seif ד. The cup must not be pagum: drinking from it (even by pouring into the mouth) renders it defective. Pouring into the hand or a vessel then drinking does not pegam. A revi‘it suffices, with no deficiency. Drinking from a jug or a small earthenware barrel makes all its contents pagum; from a large wooden barrel — no strictness, but lechatehila one heeds the machmirim.
  • ⑤ Seif ה. Repairing a pagum cup: add a little wine (like sealing the altar’s breach), or return it to the jug (nullification in the majority). The practice: add a little from the jug to repair, pour back, then draw out again for the sake of the blessing (siman קפ״ג).
  • ⑥ Seif ו. Repair is possible with a little water (wine or chamar medina), so long as the beverage is not thereby spoiled; wine is commonly diluted with water. But water that is itself pagum is invalid, even to dilute a non-pagum wine (the taste of the water is perceptible). Bishaat hadhak, without wine or water: better to bless over a pagum cup than without a cup.
