The previous siman assigned the wordings: this scent takes בורא עצי בשמים, that one עשבי בשמים. This one asks the question that comes first: does this scent call for a blessing at all? A single measure answers it — was the scent made to be smelled — and two further bars stand beside it. Hebrew text, translation and explanation of the ח׳ seifim, with a section of practical cases.

One thing is settled from the previous siman: every good scent has its wording. This siman starts there and asks something else — is there a blessing to say here at all? Its answer lies in one phrase: נעשה להריח. A scent is blessed only if it was made to be smelled. Everything else in the siman is the application of that measure: the perfumer’s shop, which satisfies it; scents that mask a bad smell, which do not; the perfumed garment, whose scent has left its body; scents it is forbidden to smell; and, in doubt, the majority. We study here at the level of principle; for personal practice one turns to one’s Rav.

📑 Plan of the study

A. חנותו של בשם (seif 1) — the perfumer’s shop, and how often one blesses there
B. נעשה להריח (seifim 2-3) — the spices of the dead, of the privy, the oil, the mugmar and the scent without a body
C. ריח שאסור להריח בו (seifim 4-6) — the erva, idolaters, their banquet
D. הולכים אחר הרוב (seifim 7-8) — outside the town, and mingled scents
1-3. Practical cases and questions for comprehension

A. חנותו של בשם — the perfumer’s shop

בֹּשֶׂם — the bassam is the perfume merchant, and his shop is full of many kinds. The Rambam had already written this case: נכנס לחנותו של בושם שיש בה מינין הרבה מברך עליו בורא מיני בשמים (רמב״ם הלכות ברכות פרק ט הלכה ה). And why a blessing over a mere scent? Because smell is a pleasure like any other:

Seif 1: one who enters the shop of a perfumer in which there are kinds of spices blesses “boré miné vesamim”. If he sat there all day long, he blesses only once. If he goes in and out, in and out, he blesses each time. And this is precisely when he did not have in mind to return; but if he had in mind to return, he does not bless.
The Gemara’s objection, and its answer. The Gemara had just established that a scent not intended to be smelled is not blessed — למימרא דכל היכא דלאו לריחא עבידא לא מברכין עלויה? (ברכות נ״ג ע״א) — and objects from the baraita of the perfumer, whose stock was piled there to be sold. It answers: אין, לריחא נמי הוא דעבידא, כי היכי דנירחו אינשי וניתו ונזבון מיניה (ברכות נ״ג ע״א). summary: the perfumer positively wants the scent to escape and draw people in — so his display is indeed made to be smelled.
Everything turns on the exact place. The Magen Avraham had already laid down the rule: וא״כ כשמונח בחדר ואינו בחנות אינו מברך אפי׳ כונתו להריח כיון שהבשמים לא נעשו שם להריח (מגן אברהם או״ח סימן רי״ז). summary: the back room is not the shop; what is not on display is not displayed to be smelled, and one blesses there only by taking the spice in hand.
Must one mean to smell? The Turei Zahav holds the stricter view: נ״ל מזה דאין חיוב בברכה זו אלא בנכנס ונתכוין להריח אבל בלא״ה אלא שהריח אתי ממילא אין חייב (ט״ז או״ח סימן רי״ז). summary: for the Turei Zahav a scent that reaches you unsought obliges nothing; for most decisors it is enough that the place is made for it and that one enjoys it.
Why “boré miné vesamim” rather than each wording separately? משום שבחנות של בשמים נמצאים בו עצי ועשבי בשמים לפיכך מברך מיני בשמים (משנה ברורה, מ״ב רי״ז:ג), and above all משא״כ הכא שאינו נוטל בידו שום בושם אלא כשנכנס עולה לו ריח מן כמה מיני בשמים כאחת לפיכך מברך ברכה כוללת (משנה ברורה, מ״ב רי״ז:ג). summary: nothing was taken in hand and nothing singled out — a cloud of scents rises together, and an inclusive wording suits it.
Sitting all day, or going in and out. The siman sets the two cases side by side; the Mishna Beroura explains the first: ולא נ״מ בזה אם הסיח דעתו או לא כיון שהריח עולה לו תדיר כ״ז שהוא יושב בחנות (משנה ברורה, מ״ב רי״ז:ד), and adds about the shopkeeper himself: ובעל החנות גופיה נמי פעם ראשון שבכל יום שנכנס לחנותו צריך לברך עליו לפי שנהנה מריח ותו לא (משנה ברורה, מ״ב רי״ז:ד). As for the second: וכ״ש כשהלך לחנות של בושם אחר בודאי צריך לברך שם פעם אחרת (משנה ברורה, מ״ב רי״ז:ה). summary: as long as one is steeped in the scent one blessing suffices, even having been distracted; it is leaving, not distraction, that opens a new blessing.
But meaning to return changes everything. The Tur brings the source of the ruling: כתב הר״ם מרוטנבורק דוקא כשלא היה דעתו לחזור אבל אם היה דעתו לחזור לא יברך דהא לא אסח דעתיה (טור או״ח סימן רי״ז). The Mishna Beroura narrows it: ודוקא כשהיה דעתו לחזור מיד (משנה ברורה, מ״ב רי״ז:ו), and conversely ואם הלך לעסקיו או להתפלל בבהכ״נ הוי הפסק וצריך לברך שנית (משנה ברורה, מ״ב רי״ז:ו); she even adds ואפילו כשחוזר ומריח בבשמים אחרים ג״כ א״צ לברך (משנה ברורה, מ״ב רי״ז:ז). summary: it is not the threshold crossed that counts but the mind — to step out meaning to come straight back is not to have left.

B. נעשה להריח — the scent made to be smelled

נַעֲשָׂה לְהָרִיחַ — “made to be smelled”. This is the siman’s single measure, and the Tur states it with its three examples in one breath: אין מברכין על הריח אלא אם כן נעשה להריח הילכך אין מברכים על בשמים של מתים ושל בית הכסא ושמן העשוי להעביר הזוהמא שלא נעשו אלא להעביר ריח רע (טור או״ח סימן רי״ז). A scent whose office is to cover another remains a good scent — yet it was not made to be smelled, and no blessing is said over it.

Seif 2: one does not bless over a scent unless it was made to be smelled. Therefore one does not bless over the spices of the dead placed above the bier, since they are there only to drive off the odour of the corpse; but if they are placed below it, one does bless, for I say: they were made for the honour of the living. And likewise one does not bless over the spices of the privy, nor over oil made to remove greasy soil.
The measure that governs the whole siman. The Mechaber sets it at the head of the seif, and the Rambam made of it a full classification: שלשה מיני ריח טוב אין מברכין עליהן ואלו הן. ריח טוב שאסור להריח בו. וריח טוב שעשוי להעביר ריח רע. וריח טוב שלא נעשה להריח בעצמו של ריח זה (רמב״ם הלכות ברכות פרק ט הלכה ז). summary: three families of scent fall outside blessing — the forbidden, the one that drives off a bad smell, and the one not made to be smelled for its own sake. The seifim that follow merely walk through them.
The spices of the dead — and the difference of half a metre. The Beit Yossef brings the Yerushalmi’s distinction that the Mechaber adopted: ובירושלמי של מתים הדא דתימא כשנתונין למעלה ממטתו של מת אבל נתונין למטה מברכין שאני אומר לכבוד החיים הם עשויין (בית יוסף או״ח סימן רי״ז); and the Mishna Beroura explains “for the honour of the living”: כדי שיריחו ויהנו (משנה ברורה, מ״ב רי״ז:ט). summary: the same incense, above the bier, masks an odour — and below it, honours those standing there. Purpose, not substance, decides.
The privy and the oil. This is Rav Huna’s statement: אמר רב הונא: בשמים של בית הכסא, ושמן העשוי להעביר את הזוהמא — אין מברכין עליו (ברכות נ״ג ע״א). The Mishna Beroura describes the first case: שמוליך איסטניס לביה״כ להעביר הריח רע אם הולך אדם ומריח מרחוק ריח בשמים אלו א״צ לברך כיון דבעלים לא עשאום אלא להעביר הר״ר ואפילו במתכוין להריח נמי אין מברך (משנה ברורה, מ״ב רי״ז:י); and the second: כגון אדם שגופו מזיע הרבה וצריך לסוך גופו בשמני בשמים להעביר זוהמת הזיעה שריחה רע (משנה ברורה, מ״ב רי״ז:יא), with this consequence: ואין נ״מ בין שמן סתם לשמן אפרסמון דחשיבא ובכל ענין אין מברך עליהם שום ברכה כיון שלא באו אלא לסלק הזוהמא (משנה ברורה, מ״ב רי״ז:יא). summary: even the costliest balsam, used to remove an unpleasant smell, receives no blessing at all — even if one means to smell it.
What this yields today. The Aroukh haShulchan applies the rule to soap: ולכן אין מברכין על הבורית שקורין זיי״ף שיש בהם ריחות טובות, לפי שעיקרו של בורית הוא להעביר זוהמת הגוף והראש (ערוך השלחן או״ח סימן רי״ז). summary: scented soap serves to remove an odour, not to give one; the perfume in it is only a means, and it is not blessed.

Seif 3: the mugmar with which one perfumes vessels — one does not bless over it, since it was not made so that the mugmar itself be smelled, but to give a scent to the vessels. And likewise, one who smells vessels that have been perfumed does not bless, since there is no body there, only a scent without a body.
What the mugmar is. ששורפין בשמים ומעבירין כלים או בגדים ע״ג עשן הבשמים ונקלט הריח בכלים או בבגדים (משנה ברורה, מ״ב רי״ז:יב). summary: spices are burned and garments passed over the smoke, which settles in them — the ancestor of scented laundry.
The mugmar itself is not blessed. בין המגמר בעצמו בין אדם אחר שהולך ומריח (משנה ברורה, מ״ב רי״ז:יג); but מיהו אם מתכוין לגמור כליו וגם להריח צריך לברך עליו דהא עומד גם לריח (משנה ברורה, מ״ב רי״ז:יד). summary: neither the one perfuming nor the passer-by blesses, since the smoke serves to impregnate the cloth; if he also means to smell it for itself, it becomes again a scent made to be smelled.
And the garment once perfumed: the scent without a body. This is the Rambam’s language: וכן המריח בבגדים שהן מגמרים אינו מברך לפי שאין שם עקר בשם אלא ריח בלא עקר (רמב״ם הלכות ברכות פרק ט הלכה ח), and the Beit Yossef supplies its ground: וטעמו של הרמב״ם נראה שהוא משום שסובר דריח כיון שאינו צורך הגוף כל כך כשאין לו עיקר אע״פ שנהנה אין לו לברך עליו (בית יוסף או״ח סימן רי״ז). summary: the scent has left its source and floats alone; the pleasure is real, but too slight to carry a blessing.
The Tur’s objection. And he rejects the comparison with a bad smell: ואינו דומה דבהנאה תליא מילתא והרי נהנה וראוי לברך עליו (טור או״ח סימן רי״ז). summary: for the Tur the cloth was perfumed precisely so that it be smelled — hence his surprise. The Mechaber nonetheless adopted the Rambam.
The practical consequence, flagged twice. ובע״ב שאין להם בשמים להריח במוש״ק ונוטלין מדוכה שדכו בה בשמים ונקלט בה ריח ומריחין ומברכין ברכתן לבטלה הוא וכמש״כ כאן שהיא ריח שאין לו עיקר (משנה ברורה, מ״ב רי״ז:טו); and the Turei Zahav likewise: ראיתי קצת בעלי בתים שאין להם בשמים להבדלה רק הכלי שדוכין בו בשמים יש לו ריח אם הוא של עץ מברכין עליו והם עושים ברכה לבטלה לכל הדיעות (ט״ז או״ח סימן רי״ז). summary: the mortar in which spices were ground, or the empty box that keeps their scent, carry no blessing — it would be a blessing in vain.

רֵיחַ שֶׁאָסוּר לְהָרִיחַ בּוֹ — “a scent it is forbidden to smell”. Second of the Rambam’s three categories, it covers two different prohibitions: that of the erva and that of idolatry — בשמים של עכו״ם ובשמים של ערוה מן העריות אין מברכין עליהן לפי שאסור להריח בהן (רמב״ם הלכות ברכות פרק ט הלכה ח). And the rule that follows takes three words in the Mishna Beroura: ואאיסור אין מברכין (משנה ברורה, מ״ב רי״ז:יט).

Seif 4 — בשמים של ערוה

בשמים של ערוה כגון קופה של בשמים תלוי בצוארה או אוחזת בידה או בפיה אין מברכין עליהם לפי שאסור להריח בהם שמא יבא לידי הרגל נשיקה או קירוב בשר:
Seif 4: the spices of an erva — for instance a basket of spices hanging from her neck, or which she holds in her hand or in her mouth — one does not bless over them, since it is forbidden to smell them, lest one come to the habit of kissing or of bodily closeness.
What the Mechaber means exactly. His wording is the Abudraham’s, brought by the Beit Yossef: וכתב הר״ד אבודרהם דבשמים של ערוה היינו כגון קופה של בשמים תלויה בצוארה או שאוחזת בידה או בפיה ואסור להריח באותם הבשמים שמא יבא לידי הרגל נשיקה או קירוב בשר (בית יוסף או״ח סימן רי״ז). summary: it is not the perfume that is at issue but the closeness it implies; to smell it is to draw near.
A married woman — and an unmarried one? The Magen Avraham is the source of the leniency: אפשר דדוקא של ערוה אבל של פנויה מברכין (מגן אברהם או״ח סימן רי״ז). summary: the letter of the siman speaks of an erva; many Acharonim nonetheless extend the prohibition, because of the thoughts it stirs.
“Hanging from her neck” — or simply her habit. יש מאחרונים שכתבו דל״ד בשהוא תלוי בצוארה אלא רגילות נקט דבשמים שהיא רגילה לשאת בצוארה אפילו הם מונחים כעת על השלחן ג״כ אין לברך עליהם דעי״ז יבוא לידי הרהור אם מכירה ויודעה (משנה ברורה, מ״ב רי״ז:יז); and the Turei Zahav in the same sense: נ״ל דרגילות נקט שהיא רגילה בכך אבל מ״מ אפילו אם הסירה משם ומונח אסור לברך עליהם דהא עשויה לדבר ערוה (ט״ז או״ח סימן רי״ז). summary: the siman’s words describe the ordinary case, not a condition; the object lying elsewhere calls for the same restraint once one knows whose it is.
The reason, in one sentence. אשה שנושאת עליה בשמים כדי שיריח ממנה ריח טוב ויקרבו אליה, אפילו היא פנויה - אסור לברך על בשמים כאלו, שהן סיוע לדבר עבירה, וזהו בשמים של ערוה (ערוך השלחן או״ח סימן רי״ז). summary: where the perfume serves to attract, it serves a transgression — and what serves a transgression is not blessed.

Seif 5 —

Seif 5: the spices of idolaters — one does not bless over them, since it is forbidden to smell them.
One of the Rambam’s three categories. בשמים של עכו״ם ובשמים של ערוה מן העריות אין מברכין עליהן לפי שאסור להריח בהן (רמב״ם הלכות ברכות פרק ט הלכה ח), and the Mishna Beroura specifies what is meant: היינו שהוקטרו לעבודת גלולים (משנה ברורה, מ״ב רי״ז:יח). summary: not every perfume belonging to a gentile is meant here, but what was burned as an offering.
The general rule the seif illustrates. And the Gemara teaches that willingly smelling such a scent is already a sin: תנו רבנן: היה מהלך בשוק של עבודה זרה נתרצה להריח — הרי זה חוטא (ברכות נ״ג ע״א). summary: there is no blessing over a prohibition — and here the scent itself is at issue, not merely the wording.

Seif 6 —

Seif 6: a banquet of idolaters — one does not bless over their spices, for such a banquet of theirs is ordinarily for idolatry.
From the perfume itself to the banquet where it is found. This is the Rambam’s language: בשמים של מסבה של עכו״ם אין מברכין עליהם שסתם מסבת עכו״ם לעבודת כוכבים (רמב״ם הלכות ברכות פרק ט הלכה ט), and the Mishna Beroura explains the word: כשמסובין לאכול ולשתות (משנה ברורה, מ״ב רי״ז:כ). summary: we do not know what this particular perfume served, but we know what such gatherings ordinarily are — and that suffices to withhold the blessing.
Outside a banquet, however. ודוקא במסיבה אבל שלא במסיבה מותר לברך אבשמים של עובד גלולים (משנה ברורה, מ״ב רי״ז:כא); and the Magen Avraham notes the difficulty: ואף על גב שעכשיו אין עומדין הבשמים במסיבת ע״א מ״מ סתם עכו״ם עשוי׳ למוכרן למסיבת ע״א ואסור (מגן אברהם או״ח סימן רי״ז). summary: it is the setting of the banquet that forbids, not the ownership; outside it, one blesses.

D. הולכים אחר הרוב — the rule of the majority

הוֹלְכִין אַחַר הָרוֹב — “we follow the majority”. The last two seifim add no new rule: they say how to apply the earlier ones when the source of the scent is unknown. The Aroukh haShulchan sums up the condition in a line: דלברכה צריך ריח טוב בלא רע ובלא איסורים ושלא יכוין שילך הריח למקום אחר (ערוך השלחן או״ח סימן רי״ז).

Seif 7 — היה הולך חוץ לכרך

היה הולך חוץ לכרך והריח ריח טוב אם רוב העיר עע״א אינו מברך ואם רוב ישראל מברך:
Seif 7: if he was walking outside the town and smelled a good scent — if the majority of the town serve idolatry, he does not bless; and if the majority are Jews, he blesses.
The baraita from which the seif comes. תנו רבנן: היה מהלך חוץ לכרך והריח ריח, אם רוב גוים — אינו מברך, אם רוב ישראל — מברך (ברכות נ״ג ע״א), and the Mishna Beroura explains the reasoning: דתלינן הריח בתר רוב ובודאי של עובדי גלולים הם שעשאום במסיבה ולפיכך מריח מרחוק (משנה ברורה, מ״ב רי״ז:כב). summary: one does not see the source of the scent; one judges by what the town is in the main.
A second reason to abstain, wider than prohibition. From the same principle: המהלך בערבי שבתות בטבריא ובמוצאי שבתות בצפורי והריח ריח, אינו מברך, מפני שחזקתו אינו עשוי אלא לגמר בו את הכלים (ברכות נ״ג ע״א). summary: the majority does not only measure prohibition — it first tells us whether the scent, in general, was made to be smelled.
And at an even split? But the Beour Halakha hesitates: ולענ״ד קשה כיון דהוא מחצה על מחצה הו״ל ספיקא דאורייתא (ביאור הלכה סימן רי״ז). summary: the Mishna Beroura permits in doubt, by analogy with the havdala flame; the Beour Halakha objects that a doubt about a prohibition is resolved stringently.
And is intent to smell required here? כבר כתבנו בראש הסימן די״א דוקא היכי שמתכוין להריח ובלא״ה אין צריך לברך אבל רוב הפוסקים חולקין ע״ז וס״ל דמברך בכל ענין כיון שעכ״פ נהנה מהריח שעולה (משנה ברורה, מ״ב רי״ז:כד). summary: the Mishna Beroura refers back to the dispute at the head of the siman, and holds that one blesses so long as one enjoys the rising scent.

Seif 8 —

Seif 8: a scent over which one blesses became mingled with a scent over which one does not bless — we follow the majority.
The last seif is the Rambam’s. The Beit Yossef says so: נתערב ריח שמברכין עליו בריח שאין מברכין עליו וכו׳ כ״כ הרמב״ם בפרק ט׳ (בית יוסף או״ח סימן רי״ז). summary: it is not a new rule but the way of applying the earlier ones when two scents mingle.
What exactly does this majority bear on? The Beour Halakha brings a restrictive reading: הוא לשון הרמב״ם וכתב בעל שמן רוקח דלא קאי אלא על שמן ובשמים של מתים ושל ביה״כ וכדומה שאינם לריח (ביאור הלכה סימן רי״ז). summary: for the Shemen Rokeach the rule concerns only the mixture of an ordinary scent with one not made to be smelled — not with a forbidden scent, which is not nullified.
The siman in one measure. דלברכה צריך ריח טוב בלא רע ובלא איסורים ושלא יכוין שילך הריח למקום אחר (ערוך השלחן או״ח סימן רי״ז). summary: for there to be a blessing one needs a good scent, free of prohibition, and not directed elsewhere — which is exactly what the eight seifim unfolded.
The siman in one sentence: a good scent is blessed only if it was made to be smelled — hence the blessing in the perfumer’s shop, and its absence over what masks a bad smell, over the garment whose scent has left its body, and over what it is forbidden to smell; and where the source of the scent is unknown,

Practical cases

Case 1 — I walk into a perfume shop

Situation: I push open the door of a perfume shop; the scent takes hold of me at the entrance. Must I bless, and with which wording?
Practice: The siman treats exactly this case: אין, לריחא נמי הוא דעבידא, כי היכי דנירחו אינשי וניתו ונזבון מיניה (ברכות נ״ג ע״א), and the Mechaber derives the halacha in seif 1. The wording is the one the Mishna Beroura explains: משא״כ הכא שאינו נוטל בידו שום בושם אלא כשנכנס עולה לו ריח מן כמה מיני בשמים כאחת לפיכך מברך ברכה כוללת (משנה ברורה, מ״ב רי״ז:ג). If I step out and come back in without having meant to return, I bless again; if I meant to come straight back, I do not — ודוקא כשהיה דעתו לחזור מיד (משנה ברורה, מ״ב רי״ז:ו). The Beour Halakha even discusses the pharmacy: ובאמת אינו מוכרח סברתו דג״כ ניחא להו דנירחו מבחוץ וידעו ששם יש אפטייק (ביאור הלכה סימן רי״ז). summary: one blesses בורא מיני בשמים on entering; the rest depends on what one had in mind on leaving. For practice, follow your Rav.

Case 2 — Scented soap, a scented shirt

Situation: I wash my hands with a strongly scented soap, then put on a shirt that has kept the smell of the laundry. Is there a blessing?
Practice: No, and for two distinct reasons. The soap belongs to seif 2: ולכן אין מברכין על הבורית שקורין זיי״ף שיש בהם ריחות טובות, לפי שעיקרו של בורית הוא להעביר זוהמת הגוף והראש (ערוך השלחן או״ח סימן רי״ז). The shirt belongs to seif 3: וכן המריח בבגדים שהן מגמרים אינו מברך לפי שאין שם עקר בשם אלא ריח בלא עקר (רמב״ם הלכות ברכות פרק ט הלכה ח) — and the reason is the Beit Yossef’s: וטעמו של הרמב״ם נראה שהוא משום שסובר דריח כיון שאינו צורך הגוף כל כך כשאין לו עיקר אע״פ שנהנה אין לו לברך עליו (בית יוסף או״ח סימן רי״ז). summary: scented soap serves to remove an odour, and the cloth carries only a scent without a body — neither calls for a blessing. For practice, follow your Rav.

Case 3 — The havdala spice box, but empty

Situation: At havdala I have no cloves left; the box itself has kept its scent. May I bless over it?
Practice: No. This is precisely the example the Acharonim give: ובע״ב שאין להם בשמים להריח במוש״ק ונוטלין מדוכה שדכו בה בשמים ונקלט בה ריח ומריחין ומברכין ברכתן לבטלה הוא וכמש״כ כאן שהיא ריח שאין לו עיקר (משנה ברורה, מ״ב רי״ז:טו), and the Turei Zahav in the same terms: ראיתי קצת בעלי בתים שאין להם בשמים להבדלה רק הכלי שדוכין בו בשמים יש לו ריח אם הוא של עץ מברכין עליו והם עושים ברכה לבטלה לכל הדיעות (ט״ז או״ח סימן רי״ז). The ruling is that of seif 3: וכן המריח בבגדים שהן מגמרים אינו מברך לפי שאין שם עקר בשם אלא ריח בלא עקר (רמב״ם הלכות ברכות פרק ט הלכה ח). summary: a box that smells with nothing inside is a scent without a body; blessing over it would be a blessing in vain. For practice, follow your Rav.

Questions for comprehension

Check your understanding:
  1. Why did the Gemara have to justify the blessing in the perfumer’s shop (seif 1)?
  2. What changes between spices placed above the bier and below it (seif 2)?
  3. What is ריח בלא עיקר, and why does the Tur find it surprising (seif 3)?
  4. Seif 4 speaks of a basket “hanging from her neck”: is that a condition or a description
