From when is the evening Shema read (Siman 235)?
The Mehaber opens the siman with the hour itself: « זמן קריאת שמע בלילה משעת יציאת שלשה ככבים קטנים ואם הוא יום מעונן ימתין עד שיצא הספק מלבו » (שו״ע או״ח רל״ה:א). The mishnah had said it through a priestly image — « מֵאֵימָתַי קוֹרִין אֶת שְׁמַע בָּעֲרָבִין? מִשָּׁעָה שֶׁהַכֹּהֲנִים נִכְנָסִים לֶאֱכוֹל בִּתְרוּמָתָן » (ברכות ב׳ ע״א) — and the Gemara at once translates the image into a sign in the sky: « מִכְּדִי כֹּהֲנִים אֵימַת קָא אָכְלִי תְּרוּמָה? — מִשְּׁעַת צֵאת הַכּוֹכָבִים » (ברכות ב׳ ע״א). The Mishnah Berurah supplies the verse and the reason: « דכתיב ובשכבך וקודם לילה לאו זמן שכיבה הוא ולילה מקרי משנראו ברקיע ג׳ כוכבים בינונים » (משנה ברורה, מ״ב רל״ה:א); and while the law itself is satisfied with medium stars, practice requires the small ones, « אך מפני שאין הכל בקיאין ויבואו לטעות בגדולים » (משנה ברורה, מ״ב רל״ה:א), and therefore « החמירו גבי ק״ש דאינו קורא עד שיראו ג׳ קטנים » (משנה ברורה, מ״ב רל״ה:א). For one who cannot see the sky, a measure of time is given: « ואם הוא יודע מתי שקעה החמה ימתין כשיעור ד׳ מילין שהוא ע״ב מינוט » (משנה ברורה, מ״ב רל״ה:ד). And the Aruch HaShulchan sums up the consensus of the decisors: « אבל קריאת שמע של ערבית פסקו כל רבותינו הראשונים והאחרונים דזמנה בלילה כשיצאו ג׳ כוכבים בינונים » (ערוך השלחן או״ח סימן רל״ה).
May one begin a meal before reading the evening Shema (Siman 235)?
No — and not even in the half hour that precedes it: « אסור להתחיל לאכול חצי שעה סמוך לזמן קריאת שמע של ערבית » (שו״ע או״ח רל״ה:ב). The reason is the Gemara’s own — the meal that stretches on and the sleep that overtakes: « והטעם שמא ימשך בסעודתו ופעמים ישתקע עי״ז גם בשינה וישכח לקרות שמע » (משנה ברורה, מ״ב רל״ה:טז) — yet a mere tasting remains permitted, « ואפילו לאכול קמעא אסור ומ״מ טעימה בעלמא מיני פירות או אפילו פת בכביצה שרי » (משנה ברורה, מ״ב רל״ה:טז). One who began after the time had come does not finish undisturbed: « ואם התחיל לאכול אחר שהגיע זמנה מפסיק וקורא קריאת שמע בלא ברכותיה וגומר סעודתו ואחר כך קורא אותה בברכותיה ומתפלל » (שו״ע או״ח רל״ה:ב). The mishnah in Shabbat had already drawn the line: « מַפְסִיקִין לִקְרוֹת קְרִיאַת שְׁמַע וְאֵין מַפְסִיקִין לִתְפִלָּה » (שבת ט׳ ע״ב); and the Mishnah Berurah explains why here one interrupts while at Minha one does not: « ולא דמי להתחיל סמוך למנחה דאינו מפסיק בדיעבד אם כבר נטל ידיו כדמבואר לעיל בסי׳ רל״ב דבמנחה כיון דזמנה מועט מירתת ולא אתי למפשע משא״כ בערבית דזמנה בדיעבד כל הלילה גזרינן דלמא אתי למפשע ויסמוך על אריכותה של לילה » (משנה ברורה, מ״ב רל״ה:כד). The Rama adds the two edges of the case: « אבל אין צריך להפסיק לתפלה הואיל והתחיל לאכול אבל אם לא התחיל לאכול אע״פ שנוטל ידיו צריך להפסיק » (שו״ע או״ח רל״ה:ב); and if no time remains at all, « ואם אין שהות להתפלל מפסיק אף לתפלה » (שו״ע או״ח רל״ה:ב). From this the Magen Avraham draws his summer warning: « וצריך ליזהר בימות הקיץ שלא לאכול בסעודה גדולה שיודע שתמשך » (מגן אברהם או״ח סימן רל״ה).
Until when may the evening Shema be read (Siman 235)?
Seif 3 sets the boundary: « לכתחלה צריך לקרות ק״ש מיד בצאת הככבים וזמנה עד חצי הלילה » (שו״ע או״ח רל״ה:ג). That “midnight” is not the Torah’s limit but a rabbinic fence: « דרבנן גדרו שאסור להתאחר בקריאת שמע ביותר מחצות שלא לבוא לידי מכשול ואם מתאחר מקרי עובר על דברי חכמים » (משנה ברורה, מ״ב רל״ה:כז); for by Torah law, « דמן התורה לכו״ע זמנה כל הלילה דובשכבך כ״ז שבני אדם שוכבין משמע » (משנה ברורה, מ״ב רל״ה:כח). Hence the Mehaber continues: « ואם עבר ואיחר וקרא עד שלא עלה עמוד השחר יצא י״ח » (שו״ע או״ח רל״ה:ג) — and so the halakhah was decided in the Gemara, « אָמַר רַב יְהוּדָה, אָמַר שְׁמוּאֵל: הֲלָכָה כְּרַבָּן גַּמְלִיאֵל » (ברכות ח׳ ע״ב). Once dawn has risen the door closes: « לא יצא ידי חובתו אלא א״כ היה אנוס כגון שכור או חולה וכיוצא בהן » (שו״ע או״ח רל״ה:ד); the Beur Halakhah notes that the word “compelled” makes all the difference here, « דבלא אונס אפילו קראה תיכף משעלה עה״ש ג״כ אינו יוצא ובאונס אפילו קראה אח״כ כל שלא הנץ החמה יוצא » (ביאור הלכה או״ח סימן רל״ה). And that compelled man does not say the blessing of lying down: « ואנוס שקרא אז לא יאמר השכיבנו דכיון שעלה עמוד השחר אינו זמן שכיבה » (שו״ע או״ח רל״ה:ד) — not even by beginning it further on, « מתבאר בפוסקים דאפילו אם ירצה לדלג תיבת השכיבנו ולהתחיל מן ותקננו בעצה וכו׳ נמי אינו נכון » (משנה ברורה, מ״ב רל״ה:לב) — but he does say the others: « אבל שאר הברכות דהיינו שנים שלפני קריאת שמע וברכת אמת ואמונה עד השכיבנו אומר » (שו״ע או״ח רל״ה:ד).
