This siman sets the laws of the קדיש and the מנין: a דבר שבקדושה (קדיש, קדושה, ברכו) is said only with ten free adult men ; what happens when some leave in the middle ; the צירוף (joining) of a קטן, of the עבד and the אשה ; one who is asleep, and one behind a מחיצה ; and the מקום המנין. Hebrew text, fluent English translation and explanation of the 22 seifim, with a section of practical cases.

Our Sages taught (מגילה כ״ג:): ונקדשתי בתוך בני ישראל — כל דבר שבקדושה לא יהא פחות מעשרה — anything of public sanctity (קדיש, קדושה, ברכו) is said only within an עדה of at least ten men of Israel, for « וְנִקְדַּשְׁתִּי בְּתוֹךְ בְּנֵי יִשְׂרָאֵל ». We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

A. Kaddish and the מנין — the 22 seifim
דָּבָר שֶׁבִּקְדֻשָּׁה — “a matter of sanctity” — anything of public sanctity: the קדיש, the קדושה, the ברכו (and likewise the Torah reading with its berakhot and פריסת שמע). It is said only within a מנין of ten men, for « וְנִקְדַּשְׁתִּי בְּתוֹךְ בְּנֵי יִשְׂרָאֵל » — Hachem is sanctified among the children of Israel, and there is no עדה of fewer than ten.
One says the קדיש, and does not say it with fewer than ten free adult men who have brought two hairs (13 years); likewise the קדושה and ברכו are not said with fewer than ten.
The founding principle of the siman: a דבר שבקדושה requires a מנין of ten. These ten must meet three conditions — being men (זכרים), free (בני חורין) and adult (גדולים, with the signs of puberty). The woman (אשה), the slave (עבד) and the minor (קטן) do not count.
Family B — התחיל ויצאו מקצתן: begun then a departure (séifim 2-3)
Séif 2: if one has begun the קדיש or קדושה with ten and some have left, one finishes that קדיש or קדושה, provided the majority (רוב, six) remain. Rama: leaving is still a fault — of them it is said « וְעֹזְבֵי ה׳ יִכְלוּ » — but if ten remain, it is permitted to leave. Séif 3: having begun בברכת אבות, one finishes even the קדושה. Rama: if some left after they had begun to pray יוצר, the ש״ץ does not begin the prayer aloud, for the prayer of יוצר is already completed; and if they left after he had begun aloud, and the קדושה, they may complete the whole סדר קדושה and say the קדיש שלם that follows it, for it belongs to the prayer, since one says תתקבל צלותהון etc.; but one does not read the Torah, for that is a separate matter. And the prayer of ערבית and the קדיש after it do not belong to the קריאת שמע and its blessings.
Once the דבר שבקדושה is begun in the presence of ten, one finishes it as long as the majority (רובן, six) remains. Leaving in the middle is a fault (« וְעֹזְבֵי ה׳ יִכְלוּ »), unless ten remain. Having begun the עמידה aloud, one continues to the קדיש שלם with תתקבל, which belongs to the תפילה.
Séif 4: some permit saying a דבר שבקדושה with nine by adjoining a קטן over six years old who knows to Whom one prays; but their view did not seem correct to the great decisors, and likewise the עבד and the אשה do not count. Rama: even by means of a חומש in his hand one does not adjoin him; yet some have the custom to be lenient בשעת הדחק. Séif 5: one who has not brought two hairs, even if advanced in years, is like a קטן, until the majority of his years pass — one then knows he is a סריס; if signs of a סריס appeared in him before then, he has the status of an adult. Rama: but one does not scrutinize the hairs: once he has reached the age, one holds him to be an adult, and one says in this regard that he presumably has brought two hairs.
The מנין is made of ten adults. The view that adjoins a קטן (from six, knowing to Whom one prays, with a חומש) is rejected by the great ones; one relies on it only as an extreme leniency, בשעת הדחק. The עבד and the אשה never count. One holds as adult whoever has reached the age, without examining the signs.
Family D — דין המצטרפין: who counts among the ten (séifim 6-12)
Séif 6: if one of the ten has begun to pray alone and cannot answer with them, or is asleep, he still joins them. Séif 7: when one is praying alone, it is proper that the others wait before saying קדיש until he finishes, so that he too may merit it. Séif 8: the deaf-mute who speaks but does not hear, or hears but does not speak, is like a lucid man and joins; but one who neither hears nor speaks is like a שוטה and a קטן. Séif 9: he is always a קטן until he brings two hairs after he is thirteen years and one day old; and a leap year (שנת העיבור) is of thirteen months. Séif 10: if one boy was born on the 29th of אדר ראשון of a leap year, and another boy was born in אדר שני, on its first day, and the thirteenth year is not a leap year, the one born on the 29th of the first אדר must wait until the 29th of אדר in the thirteenth year to be thirteen years old, while the one born after him, on the first of the second אדר, will be thirteen years old once the first of אדר of the thirteenth year arrives. Rama: and one who was born in אדר and becomes בר מצוה in a leap year does not become בר מצוה until the second אדר. Séif 11: the עבריין who transgressed, as long as he has not been placed under ban (נידוי), counts in the ten. Séif 12: the מנודה is not adjoined for anything that requires ten; he is, however, permitted to pray in the synagogue where he is, unless they explicitly specified to be stringent with him in this.
To complete the ten it suffices to be present among them — no need to answer: one still praying the עמידה, or even one who is asleep (one wakes him), joins, provided the majority answers. The עבריין remains of Israel and counts (« חטא ישראל »), as long as he is not מנודה.
Family E — מקום המנין: one place, the מחיצה, the town (séifim 13-22)
Séif 13: the ten must be in one place with the ש״ץ; one standing in the doorway, from the doorstop outward — that is, when the door is closed, from the place of the inner edge [שפה] of the thickness of the door, and outward — is “outside.” Séif 14: one who stands behind the synagogue with a window between them — even several storeys high, even if it is not four [טפחים] wide — and shows them his face from there, joins them for the ten. Rama: roofs and upper storeys are not included in “the house,” and one who stands on them does not join. Séif 15: if some are inside and some outside, the ש״ץ in the doorway joins them. Séif 16: a small courtyard breached along its full width into a large one — that is, the small one was breached at the place where it joins the large one, and the whole wall that separated them fell, while in the large one there remained, of that fallen wall, פסים [that is, a little straight and even wall] on either side: the large one is as if set apart from the small one, but the small one is not set apart from the large one; rather it is like a corner (קרן זוית) of it. Therefore, if nine are in the large one and one in the small one, they join together, for the small one is drawn after the large one and is as if it were inside the large one, since the majority is in the large one; but if there were nine in the small one and one in the large one, or five in this one and five in that one, they do not join together. Séif 17: if the ש״ץ was in the small one and the congregation in the large one, he discharges them of their obligation, for he is drawn after them; but if the ש״ץ was in the large one and the congregation in the small one, he does not discharge them of their obligation, for the majority is not drawn after the individual. Séif 18: if some of the ten are in the synagogue and some in the courtyard (עזרה), they do not join together. Séif 19: the ש״ץ on the תיבה and nine in the synagogue join together, even though it is ten high and four wide and has partitions ten high, because it is subsumed relative to the synagogue; and there is one who wrote that this applies only when the partitions do not reach the ceiling of the roof. Séif 20: if ten were in one place saying קדיש and קדושה, even one who is not with them may answer; and some say that no filth (טינוף) or עכו״ם (idolatry or an idolater) must intervene. Séif 21: a town of ten — one compels the one who wishes to leave on the Days of Awe to stay or to hire a replacement; and if they are eleven and two wish to leave, both of them hire one [man] in partnership in their place, and both pay equally; and if one is poor and one is rich, they pay half according to wealth and half according to persons; and the wage of the חזן falls on those who leave as on those who remain. Rama: and there is no difference whether he wishes to go a long time before the festival or not, as long as he does not return for the festival. Séif 22: one compels hiring [someone] to complete the מנין only on the Days of Awe, and when only one or two are missing, unless there is a fixed and well-known custom in the town to compel hiring even when three or four are missing; if there is a מנין among the residents of the town, one compels them to hire a חזן. Rama: and likewise, in a place where there is not always a מנין in the synagogue, they compel one another with fines so that a מנין always comes to the synagogue, so that the regular [prayer] (התמיד) is not discontinued; and see below, at the beginning of siman 150, whether they compel one another to build a synagogue.
The ten must share one and the same place with the ש״ץ; whatever separates (מחיצה, threshold, roof) excludes, unless one shows his face to the others. To answer a קדיש that is heard, however, no מחיצה bars — provided there is no screen of טינוף. One even compels hiring a tenth on the ימים נוראים.
The siman in one sentence: a דבר שבקדושה — קדיש, קדושה, ברכו — is said only with a מנין of ten free adult men (« וְנִקְדַּשְׁתִּי בְּתוֹךְ בְּנֵי יִשְׂרָאֵל »); begun with ten, one finishes it as long as the majority remains; the קטן, the עבד and the אשה do not count; the ten must be in one place, and one counts the one asleep or still praying, as well as the עבריין who is not מנודה.
Practical cases
Case 1 — The מנין: who counts among the ten
Situation: whom does one count in the מנין of ten?
Conduct: one counts ten free adult men (from 13 with the signs). The מנין does not depend on each one answering: one still praying, one asleep, or a partial deaf-mute, joins as long as the majority can answer אמן. The עבריין who is not מנודה also counts.
Case 2 — Completing with a child or one asleep
Situation: one person is missing: may one complete with a child, or with one who is asleep,
Conduct: the מנין requires ten adults. Adjoining a קטן (even over six, with a חומש) is rejected by the great decisors; some tolerate it only בשעת הדחק, and one relies on this only for ברכו and a קדיש of obligation, not for an optional קדיש. One who is asleep, however, counts in the ten — one takes care to wake him. For any concrete application, one follows one s Rav.
Case 3 — The קדיש begun then a departure (רובן)
Situation: one has begun the קדיש with ten, then someone leaves — may one continue?
Conduct: yes, if the majority (רובן, six of ten) remains: one finishes that קדיש or קדושה already begun, and even the whole order up to the קדיש שלם with תתקבל. Leaving in the middle remains a fault (« וְעֹזְבֵי ה׳ יִכְלוּ »), unless ten remain. One does not begin a new דבר שבקדושה with fewer than ten.
