Daat HaRav — The Shulchan Aruch of the Alter Rebbe on Siman

The shitah of the Alter Rebbe on the 14 seifim that codify the rule of the three days before Shabbat (תלת-יומא קודם השבת) — when may one begin a voyage by ship or in a caravan if one knows it will extend into Shabbat. Direct application to planes, trains, cruises, and long business trips.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch of the Alter Rebbe is not a commentary on the Mechaber (מחבר) — it is an autonomous and complete Shulchan Aruch, authored by the Alter Rebbe. Its uniqueness: it combines halacha (הלכה) + טעמי המצוות + inner dimension in a single work, and rules with a unique Talmudic rigor.

For Chabad, the Alter Rebbe is הפוסק האחרון. This page gathers, for siman רמ״ח, the full text of the Rav, his originality, and the divrei haRebbe that illuminate the subject.

The law of one who sets sail on a ship or travels with a caravan on Shabbos — containing 14 se'ifim:

One does not set sail on a ship on salt waters less than three full days (me'es le'es) before Shabbos — that is, from Wednesday onward, Wednesday itself being included in the prohibition. The reason: all who sail on salt waters experience, during the first three days, distress, confusion, and a disruption of their normal rhythm; their body is shaken by the rocking of the ship, and their spirit does not return to them until after three full days. And if one were to set sail less than three days before Shabbos, he would have no oneg on Shabbos.

To what does this apply? When one sets sail for an optional matter (devar harshus); but for a matter of mitzvah it is permitted to set sail even on Erev Shabbos, even though he will have no oneg on Shabbos, since "one engaged in a mitzvah is exempt from another mitzvah."

Nevertheless, lechatchilah he should stipulate with the non-Jew who steers the ship that he rest and not steer it on Shabbos; and if afterward he does not rest, no matter.

And if he cannot stipulate with him — the non-Jew declaring even now that he will not rest on Shabbos — some say that it is forbidden for the Jew to set sail until after Shabbos.

(Nevertheless, if there is concern that the mitzvah he is traveling toward will be nullified due to the delay, one may be lenient. Likewise, if it is difficult to find another ship after Shabbos, one may be lenient in pressing circumstances.)

And if it is a brief journey — for example from Tyre to Sidon, which is only a day's travel when the wind is favorable — it is permitted to set sail even for an optional matter on Erev Shabbos in the morning, since it is possible that the wind will be favorable and they will arrive before nightfall.

But in a place where the custom is not to set sail on Erev Shabbos at all, even for a short journey, they are forbidden to deviate from the custom — in the manner explained in siman 468 and Yoreh De'ah siman 214.

All of the above pertains to the seas; but on rivers, since travelers experience no distress, it is permitted to set sail even on Erev Shabbos in any case, if the ship runs for non-Jews.

And even though one travels several parsa'os on Shabbos, there is no prohibition of techumin in this — even according to those who hold that the 12 mil are min haTorah, from the verse "אַל יֵצֵא אִישׁ מִמְּקֹמוֹ" (i.e., the Israelite camp, which was 12 mil): when one travels over the water there is no Torah prohibition, since this is unlike the Israelite camp, which was on dry land.

Although there remains a rabbinic prohibition of techumin on water, nevertheless if the ship travels more than 10 tefachim above the river bed, there is no prohibition even rabbinically — because there is doubt whether the prohibition of techumin applies above 10 tefachim even within the 12 mil on dry land (as is explained in siman 404); and since on water the 12 mil are only rabbinic according to all opinions, this is a doubt in a rabbinic matter, in which we are lenient everywhere.

But if the ship travels less than 10 tefachim — that is, there are not 10 tefachim of water between the bottom of the ship and the riverbed — it is forbidden to travel on it on Shabbos beyond the techum, even if he boarded the ship three days before Shabbos (i.e., from the eve of Wednesday onward). Even if the ship is sunk deeply in the water such that next to its sides there are 10 tefachim of water but beneath its bottom there are not 10 tefachim — this too is forbidden, even if he sits above in a place where from his seat to the bed there are more than 10 tefachim.

And some permit it when he sits more than 10 tefachim high and his feet do not dangle below 10 tefachim, if the ship travels more than 3 tefachim; according to them, the prohibition only applies when he sits on the floor of the ship itself and there are not 10 tefachim from its floor down to the bed, or when he sits on another object with less than 10 tefachim from that object to the bed. One may rely on this view when needed.

And if he is uncertain whether the ship is traveling above or below 10 tefachim, it is permitted: for whenever there is doubt in a rabbinic matter, we go to the side of leniency, and one need only be stringent when it is known with certainty that there is a rabbinic prohibition.

And if he boarded the ship before three days prior to Shabbos — that is, on Tuesday or earlier — it is permitted for him to travel in it on Shabbos beyond the techum, even if he knows it travels less than 10 tefachim, or even less than 3 tefachim: since the prohibition of techumin here is only rabbinic, they did not wish to be so stringent as to forbid boarding before three days, given that he himself does nothing — it is the ship that carries him beyond the techum.

And even if he is in a situation where the Jew may be required to desecrate Shabbos in steering the ship — even by a melachah forbidden by the Torah — for the sake of pikuach nefesh, it is nevertheless permitted for him to board before three days, since he is now boarding in a permitted manner; and when Shabbos arrives and he must perform a melachah for pikuach nefesh, it is permitted, and there is no desecration here.

But within the three days before Shabbos, it is forbidden to board — even if the ship travels above 10 tefachim — if he knows he will need to desecrate Shabbos for pikuach nefesh, even regarding a matter that is only rabbinically forbidden, since he would appear to be deliberately entering a place of danger so as to desecrate Shabbos afterward.

And the reason this is not a concern before the three days is that the first three days of the week are called "days after the past Shabbos" and do not relate to the coming Shabbos; therefore one is not obligated to be wary on those days against doing something that he knows will require him to desecrate the coming Shabbos — because when Shabbos arrives and he must desecrate it for pikuach nefesh, it will be permitted and there will be no desecration. By contrast, in the last three days of the week, called "days before Shabbos" and relating to the coming Shabbos, he is obligated rabbinically to be wary against doing anything that he knows will require him afterward to desecrate Shabbos — so as not to appear to be acting deliberately in order to be able to desecrate Shabbos afterward.

And even if he knows that he will not need to desecrate Shabbos at all — because the non-Jews do everything — nevertheless, if the principal voyage of the ship is for the sake of Jews (e.g., the majority of passengers are Jewish), it is forbidden to board within the three days before Shabbos, even if the ship travels above 10 tefachim. The reason: that which the non-Jews are doing in steering the ship on Shabbos involves a full-fledged prohibition (although they act on their own without a Jew's instruction, intending their own benefit — receiving the wage they fixed for bringing the passengers to their destination, so that they are kabbalanim whom one may allow to do their work on Shabbos; nevertheless, here) the Jew benefits on Shabbos itself from the body of the melachah that the non-Jew performs for him on Shabbos — (thus all the melachah is reckoned to the Jew's name: although the non-Jew intends for his own benefit, nevertheless, since at the very moment of the melachah's performance the Jew enjoys it, it is being done more for him than for the non-Jew — who is also intending it for the Jew, doing it for the wage he will receive. This is unlike a kabbalan who repairs vessels for a Jew on Shabbos, where the Jew does not enjoy on Shabbos itself the body of the melachah, but only after Shabbos when the work is finished and he uses it).

Therefore, there is never permission to travel on Shabbos in a ship that runs for the sake of Jews, except that on account of danger it is permitted — since they have already boarded, and if they did not travel on Shabbos they would be endangered. It follows that one should not board such a ship except before the three days prior to Shabbos, for the reason explained.

Likewise, it is forbidden for him to board the ship on Shabbos itself, even if he is going for a mitzvah, even if it travels above 10 tefachim, even to travel within the techum, and even if it runs for non-Jews: for they forbade boarding a ship at all on Shabbos — even one that is not moving but merely floating on the water (as explained in siman 339) — because he appears as though he himself were floating and swimming on the water, and swimming is forbidden on Shabbos because of the decree "lest he construct a swimmer's barrel" (people training themselves to swim on a barrel).

But when he boarded the ship from Erev Shabbos, although it sails also on Shabbos and he appears to be swimming, the Sages did not decree, since he himself is doing nothing on Shabbos: the floating happens of its own accord by virtue of his having boarded on Erev Shabbos, a time when it is even permitted to construct a swimmer's barrel. Therefore, even if it departs from shore on Shabbos itself, no matter — since he boarded it on Erev Shabbos.

However, if he disembarked onto dry land, it is forbidden for him to return to the ship on Shabbos, since this re-entry on Shabbos itself involves the prohibition of swimming.

And some permit boarding and setting sail on Shabbos if one acquired shevisah on the ship from Erev Shabbos — namely, that he was on it from the beginning of bein hashemashos until it became dark: since at the very entry of Shabbos his shevisah was within it, it becomes for him like his home. Even if he disembarks afterward and stays on shore at length — even sleeping there — he has not lost his shevisah on the ship; he need only take care to return to that same ship in which he acquired shevisah and not enter another.

This practice has spread in some places, and one should not protest, although the principal opinion is the first — since those who do so have whom to rely upon.

However, after the ship has sailed beyond the techum, they are forbidden to disembark onto dry land, even if it docks at a city surrounded by a wall for habitation — as explained in siman 405.

And some have the further practice of setting a table on the ship, kindling lights there, and reciting kiddush, in order to publicize to all that they have acquired shevisah on it, so that they not be suspected when they sail the next day.

Nevertheless, they must be careful to remain on the ship throughout the entire bein hashemashos until it grows dark, and not leave it at all during bein hashemashos: for at every moment of bein hashemashos there is doubt as to whether it is the beginning of night, and at the moment of the beginning of night one must be on the ship — as explained.

Even if Yom Tov falls on Erev Shabbos, one may acquire shevisah on it, and there is no issue of hachanah (preparing from one sacred day for another). And even if one acquired shevisah on Erev Yom Tov, it does not avail for the Shabbos that follows. Likewise, if one acquired shevisah on Erev Shabbos, it does not avail for the Yom Tov that follows Shabbos, and one must re-acquire shevisah during bein hashemashos at the conclusion of Shabbos as Yom Tov begins. The same applies to the two days of Yom Tov of the galuyos (diaspora). However, for the two days of Rosh Hashanah, the shevisah acquired on Erev the first Yom Tov suffices also for the second — as will all be explained in siman 416.

All of the above applies when one is sailing on a river, the ship runs for non-Jews, and travels above 10 tefachim.

And even if it is pulled by animals walking along the riverbank, no matter — this is not comparable to a wagon drawn by animals, where one is forbidden to ride even within the techum, on account of the decree "lest he cut a branch with which to drive the animals" (as explained in siman 305): for one who sits in a wagon is close to the animals, and at times he drives them; whereas one who sits in a ship is distant from the animals walking along the riverbank that pull the ship by means of long ropes — he is never in the habit of driving them.

And in a place where the custom is to set sail even on salt waters (on Erev Shabbos, or even on Shabbos by means of acquiring shevisah on Erev Shabbos), if they are not going merely for leisure (tiyul) but for commerce or to visit their fellows, one should not protest against them — for there is an authority who says that whenever a person travels for commerce (even if he has sustenance and is traveling for additional gain) or to see a fellow, all is considered a matter of mitzvah in this regard, so that it is permitted for him to set sail within the three days before Shabbos even though he will lose the oneg of Shabbos, and even though he may need to perform full-fledged melachah himself for pikuach nefesh. Only one who travels purely for leisure is considered to be on an optional matter.

Those who go out with a caravan into the desert, where all know they will need to desecrate Shabbos — for, on account of the danger, they cannot remain alone in the desert on Shabbos — are forbidden to depart within the three days before Shabbos, for the reason explained above.

Unless they go for a matter of mitzvah, for example, to go up to Eretz Israel: then, if a caravan presents itself even on Erev Shabbos, they may depart. Lechatchilah they should stipulate with them to rest on Shabbos; and if afterward, when they are in the desert, the caravaneers refuse to rest, they may continue with them beyond the techum even more than 12 mil — if they fear wild beasts, or even bandits who might take their animal (leaving them unable to walk on foot), or take their money (leaving them with no means to live in the desert), or take their clothes in the cold season (in danger of dying of cold). Each of these is called pikuach nefesh, and it is permitted for him to continue with them.

And some say that since he knows with full certainty that he will have to desecrate Shabbos, it is forbidden to depart even on Sunday, even for a matter of mitzvah. According to them, the Sages allowed for a mitzvah or before three days only setting sail on a ship — where there is no full certainty that one will have to desecrate Shabbos: it is possible that when Shabbos arrives they will reach another port and remain there throughout Shabbos, in which case they will not desecrate either by melachah or by techumin, even if the water is not 10 tefachim deep. Even though it is nearly certain that he will need to desecrate, the Sages were lenient before three days, or for a mitzvah even within three days; but where it is fully certain that he must desecrate, they were not lenient at all in any way.

It is fitting to be stringent in accordance with this view, but one should not protest against those who are lenient, since they have whom to rely upon.

And even one who goes to Eretz Israel for commerce and not to settle there should not be protested against, since there is an authority who says that this too is a matter of mitzvah — for the Sages have said: "Whoever walks four cubits in Eretz Israel is assured of being a ben olam haba."

However, if he travels within three days for commerce or to visit a fellow, one should protest, since many forbid, holding that this is not at all considered a matter of mitzvah.

All of the above is the lechatchilah rule. But bedi'avad — if he has already gone out with a caravan even on Erev Shabbos, even for leisure, and reached a place where there would be danger to life in separating from the caravan — he may continue with them on Shabbos until he reaches a place where there is no danger in parting from them; there he will rest and not continue with them. Even if he is near a city, he may not enter it, since he has there only four cubits, by the law of one who has gone outside the techum.

And even if there was danger up to his entry into the city, he may not walk within it more than four cubits — even if it is surrounded by inhabited partitions — since he went out without the permission of the Sages (who forbade going out with a caravan within three days for an optional matter); and even if he went out for commerce or to visit a fellow, this is, regarding this matter, as if he went out for a purely optional matter, as has been explained.

Nevertheless, if he went out because he did not know the halachah and thought it was permitted to go out even for an optional matter, it is permitted for him to walk throughout the entire city and 2000 cubits in every direction: since at the time of his departure he did not deliberately go out in transgression, and afterward, when Shabbos arrived, he was in a place of danger; and what he walked on Shabbos beyond the techum is judged like one who goes out beyond the techum to save life — who has 2000 cubits in every direction (as explained in siman 407). Therefore, even if before reaching the city there was no concern of danger, he may enter the city if it is within those 2000 cubits.

And it goes without saying that if he went out in a permitted manner — e.g., for a true matter of mitzvah, or before the three days — he has 2000 cubits in every direction from the point where he reached a place where there was no danger of parting from the caravan.

"And if it is not possible…" — Behold, the Beis Yosef certainly does not hold like the Magen Avraham, since he rejected at the end of this siman the words of Rabbeinu Tam: "for if so, why was it necessary to find permission for those setting sail on Erev Shabbos — are not all sailing for a matter of mitzvah?" Yet what is the difficulty? Our own eyes see that they do not stipulate that the sailors rest at all, because it is impossible — the ship sails only for the non-Jews. Nor can one say that even before three days they would also need to stipulate, as the Ra'avan writes in siman 60, for the implication of the decisors is not so; particularly in the Shulchan Aruch, which inverted the language of the beraisa — examine well. The same difficulty arises with the Rama at the end of this siman. And see Magen Avraham siman 613, where it appears that even if the mitzvah would be entirely nullified, one would not set sail when one cannot stipulate; and if his intention here is similar, it is very perplexing for the position of the Shulchan Aruch, whose reason is oneg: when one goes for a mitzvah, he is exempt from the mitzvah of oneg Shabbos; how then would he forgo his mitzvah for the sake of oneg Shabbos? See also the Shach at the end of Y.D. siman 266, who also holds against the Magen Avraham — otherwise he would not have refuted anything from the Rashbatz. And a clear proof for the Beis Yosef and the Shach: it is taught that one does not lay siege to cities… but for a milchemes mitzvah it is permitted — even though oneg is nullified, according to the Rif and his school, and even though Shabbos is desecrated, according to the Razah and his school: from this, for a matter of mitzvah it is fully permitted, and stipulating is only required where possible, by way of an extra stringency, so as not to appear to be nullifying oneg Shabbos or to be desecrating it with one's own hands without the need of mitzvah or pikuach nefesh. (Perhaps it is for this reason that the Tur copied this beraisa to siman 249, in order to prove that the halachah is like Rabban Shimon ben Gamliel; those who rule like Rabbi hold that where it is possible, it is different.)

And therefore one must say that the Magen Avraham wrote thus only where one knows it will be possible to accomplish the mitzvah by setting sail after Shabbos, exactly as if he were setting sail before Shabbos: then he ought not nullify the mitzvah of oneg with certainty, but only with doubt — i.e., by stipulating, for it is possible that the non-Jew will keep faith and rest. Otherwise, one does not push aside the mitzvah of oneg, which is a "passing" mitzvah, before this mitzvah which is not "passing," as the Rama writes at the end of siman 687; the Magen Avraham there only objected because the mes mitzvah would be left in indignity. Here it is analogous to what is said in siman 72, that one does not remove the dead near the time of the Shema — see there. But where there is concern that the mitzvah may be nullified after Shabbos, one need not enter into doubt for the sake of the mitzvah of oneg Shabbos: for one already occupied with a mitzvah is exempt from another mitzvah, even if it is certainly "passing," and even if he could perform both, he need not trouble after it (as explained in siman 38). Yet by rabbinic enactment, he should lechatchilah begin with the "passing" one; but when the second is also possibly "passing," he should not set it aside, since it came to his hand first: "one does not pass over mitzvos," and they have said "the mitzvah that comes to your hand — do not let it sour." Therefore, they besiege cities when they are ready, for perhaps after Shabbos some cause will arise and they will no longer be able to muster strength to besiege as now. (But one cannot say that there is something special there, that on each day they are ready to besiege without doing so they transgress "you shall surely destroy them.") And likewise in the Shach's case: it is forbidden to leave the child uncircumcised — otherwise, in all mitzvos without fixed time we would say the same, that whenever one can fulfill them without doing so he transgresses the command obligating their fulfillment. Moreover, it is explicit in the Magen Avraham siman 444:11 — "this is not so with milah…" Yet study is still required from what is said in simanim 249 and 568.

In any case, in practice the matter is clear: in pressing circumstances or where there is concern of mitzvah-loss, one is lenient. Even if one were to say the Magen Avraham is stringent here too, in such a case one may rely on the Tur, the Beis Yosef, the Rama, and the Shach to be lenient in a rabbinic matter in pressing circumstances or where there is concern of mitzvah-loss.

"And some permit…" — See the Bach, whose view is to be entirely lenient. Even the Re'em was only stringent when sitting below 10 tefachim, see there. The Magen Avraham refuted the Bach's words; but the words of the Re'em we have no warrant to refute in order to be stringent in a rabbinic matter, for "whoever is stringent in a rabbinic matter, upon him is the burden to bring proof and reason for his words," as we learn in Yadayim ch. 4.

The Magen Avraham follows his own approach: in siman 266 he holds that when a horse walks on the ground, it is as though the person himself walks on the ground; and so too here, the ship's travel below 10 tefachim is as though the person walks there. But the Beis Yosef there does not hold so. Such is also the view of the Even Ha'Ozer siman 246 (see there), who refuted the Magen Avraham from the Yerushalmi of Berachos that "azla mecham'sei" (it goes by its own heat) — as is found in chapter one of Bava Metzia: we do not say so, and certainly not regarding a ship. And since the Re'em, the Beis Yosef, and the Even Ha'Ozer are lenient, they suffice to rely upon at time of need to be lenient in a rabbinic matter.

The Magen Avraham himself, at the start of his discussion there, only forbade in the case of the horse because of its functional use, making it as ar'a smichta (firm ground), like the wagon for the Beis Yosef there. Although from Rashi's language it implies that anything not as still as a column is not ar'a smichta, nevertheless the Beis Yosef there relied on the Ritba who holds that even a wagon is ar'a smichta — see Ritba, brought also in Ralbach siman 28 as the practical ruling. According to this, the reason a ship is not ar'a smichta must be that it does not walk on the ground as the wagon or the horse do; and if so, there is no place to distinguish between above 10 tefachim and below 10 tefachim, but only between below 3 tefachim (where it leaves the rule of levud) and above 3 tefachim, which is not deemed as walking on the ground.

This is not similar to what is written in simanim 356 and 376: there leniency was granted in water, as the gemara states in many places, and this is the view of the Aguda cited by the Magen Avraham in siman 366 sk 5, who holds that the halachah is like Rav Huna and Rav Yosef, while Abaye is merely setting aside, and Rav Ashi only explains Abaye's setting aside — but the halachah remains like Rav Huna against Rav Nachman, who was far greater than him. According to this, only regarding permitting carrying in water do we say "gud" (extension), but not regarding carrying within the ship itself. Even for stringency we do not say gud, as is explained in the Tur and Shulchan Aruch siman 355, that leniency for a gezuzta (balcony) was only granted if a window opens onto it — see Magen Avraham, Tosafos, and Rosh at the start of chap. Kol Gagos, and study well. Thus in our case as well one may say we do not apply gud.

And even if we were to say we do apply gud — and even according to the Magen Avraham at the start of his discussion in siman 366 like Rav Nachman — nevertheless in our case one must say that even so it is not ar'a smichta regarding techumin: for otherwise, even where the ship travels above 10 tefachim, how would it differ from a wagon, if we said gud?

And according to this, even when traveling below 3 tefachim, seemingly it would not be forbidden according to the Re'em, for the stringency in such a case regarding the column in Hazoreq implies the concern of gud; one cannot make a stringency from levud alone — for we do not invoke levud so far as to deem the body as reaching the ground; yet it counts toward the 10 tefachim as the Magen Avraham writes at the end of siman 632. But with gud, the body need not actually reach the ground: the edge is drawn… Even for stringency: one who throws onto a gezuzta is liable. And what is written in siman 632 sk 2 is because of chavut rami, where the body is considered to have reached below.

Yet in the first chapter of Eruvin regarding ropes and in Hazoreq daf 97 and many places it is explained that they invoked levud even for stringency, to render one liable who throws to it from a true reshus harabbim. One must say that the Magen Avraham only wrote thus regarding invalid s'chach, where the essence of levud is invoked only for stringency to join the invalid items — but here its essence is not only for stringency. According to this, in our case one should be stringent when the ship travels below 3 tefachim by virtue of the rule of levud. And even if one were to say our case resembles one where its essence is only for stringency, nevertheless the Magen Avraham siman 502 writes that in such a case we say levud even for stringency — see there and at siman 632, and study well.

"They did not wish to be stringent." — So it is in the Mahariq. Although from the language of the Darkhei Moshe and the Magen Avraham sk 3 one might learn that this applies only where there is danger if he disembarks on Shabbos, analogous to seif 4, nevertheless from the brief language of the Rama in his gloss it implies that in any case it is permitted, since he made no mention at all that he would have to desecrate, until afterward. So too in Darkhei Moshe it appears that he agreed with the Mahariq in practical halachah, only noting that from the Mahariq it emerges that according to the Rif — who does not distinguish, regarding techumin, between before three days and within three days — there would be no prohibition of techumin on a ship at all (like the Rashbam), since the ship moves of its own accord; and the Beis Yosef contested this from a responsum of the Rambam, and indeed we do not rule like the Rashbam. Nevertheless, this prohibition is not Toraic even regarding a wagon, even according to the view that the 12 mil are Toraic: for all agree that techumin does not apply when the conveyance is moving, as the Mahariq explains in line with Rabbeinu Yitzchak. The Beis Yosef contested the leniency before three days even rabbinically, holding that the Sages did not decree so far; and his reasoning is that since the travel itself is not under the prohibition of techumin but the Sages only forbade boarding so that the ship not bring him on Shabbos beyond the techum, before three days they did not decree (as Rabbeinu Chananel). The Rif, who disputed Rabbeinu Chananel, held like the Rashbam that boarding is permitted. On this, the Darkhei Moshe wrote that nevertheless the main view is that of Rabbeinu Chananel — before three days they did not decree; and he brought proof from the fact that they did not decree against setting sail toward a place of danger before three days, even when one knows he will desecrate with his own hands — all the more so here, where he knows the ship will carry him beyond the techum. And a clear proof from Rabban Gamliel, Rabbi Yehoshua, Rabbi Elazar ben Azariah, and Rabbi Akiva, who traveled by ship beyond the techum on a rakak (shallow stream) without 10 tefachim; even if one were to say they set sail before three days, an ordinary shallow stream poses no danger to remain on it on Shabbos. One cannot say they stipulated with the captain who did not keep his word, for in any case how would they rely lechatchilah on his stipulation if there were a prohibition involved? A non-Jew is not trustworthy on this, as written in siman 246 (nor can one say "in his presence is different," for the end proved he did not rest). So too it is explicit in the Rif and Rosh that even for a mitzvah after stipulation, the permission exists only when the depth is 10 tefachim. The Beis Yosef's objection to the Mahariq according to the Rif requires great study; study well.

"He disembarked from it…" — But if he did not disembark, it is permitted to go from one ship to another, as is explicit at the start of ch. 4 of Eruvin regarding one who jumps from ship to ship. What the Magen Avraham writes at the end of siman 339 applies to the view of the Alter Rebbe in the gloss, which speaks of where one disembarked, and the permission is only because it has become like his home — therefore another ship is forbidden.

"Or even…" — See the Ralbach who permitted even without acquiring shevisah (and so write the Maggid Mishneh, Beis Yosef, and Darkhei Moshe in the name of the Mahariq); on this the Magen Avraham wrote that one should not be lenient. But when one has acquired shevisah, on what basis would we protest on Shabbos more than on Erev Shabbos — given that we consider this a matter of mitzvah and they are therefore exempt from oneg, and even if one would have to desecrate it the Sages did not decree for a mitzvah since at the time of his departure he is not desecrating at all? Thus on Shabbos as well, what basis is there for protest? Particularly according to what the Magen Avraham wrote in the name of the Behag: it is as though he is entering his home.

"Merely for leisure…" — See the Magen Avraham at the end of siman 339, who wrote that Rabbeinu Yehudah HaLevi's statement concerns setting sail on Shabbos without acquiring shevisah. But here, if his intention is to forbid according to Rabbeinu Tam, study is required: for it appears from Rabbeinu Tam that whatever is not strictly leisure is not called an "optional matter." So writes Or Zarua plainly. Moreover, in going to earn one does not even know if he will earn, as we say in chap. Makom Shenahagu — no man knows by what he profits. Moreover, Rabbeinu Tam derives it from Chol HaMoed, and on Chol HaMoed it is certainly permitted, in a case of doubtful davar ha'aved, even to do full melachah for a non-festival need — for it is a doubt of davar ha'aved, see Magen Avraham siman 537. All the more so to cut hair and launder during the moed are permitted even for one who goes out to earn, where in such cases it is forbidden to do full melachah for a non-festival need merely for profit, and even perakmatya is forbidden, see siman 537; study required.

And even if they travel beyond 12 mil, we have no power to protest, in line with what the Tosefes Shabbos writes — since most decisors disagree with the Rambam on this point; and even if they carry burdens by hand, all is rabbinic in the desert, which is karmelis in our time, see siman 345.

And even for commerce we have no power to protest, since the Rama wrote thus even regarding travel outside Eretz Israel. The force of the psak (פסק) of the Alter Rebbe

Comparison of the Alter Rebbe's position with those of the Mechaber (מחבר), the Rama (רמ״א), and the Mishnah Berurah (משנה ברורה) on the key points of siman רמ״ח.

SubjectMechaberRama (רמ״א)Mishnah Berurah (משנה ברורה)Shulchan Aruch of the Alter Rebbe
Rule of the three days before Shabbat (תלת-יומא קודם השבת) OC 248:1 — the rule is stated in seif א, and for a דבר הרשות: « אבל לדבר הרשות אין מפליגין בספינה בפחות מג׳ ימים קודם השבת » (שו״ע או״ח רמ״ח:א). The Mechaber gives no reason here — he gives it in seif ב. The braisa it is drawn from is in שבת י״ט ע״א. Hagaha on OC 248:1 — summary: the gloss does not deal with the mitzvah, which the Mechaber has already handled in the body of the seif, but with what remains permitted before the three days, then with the short route and with local custom. « אבל קודם שלשה ימים שרי אפי׳ בספינה שמושכין אותו ע״י בהמות אפי׳ אין בגובה המים י׳ טפחים » (הגהת רמ״א או״ח רמ״ח:א); for a one-day route, מצור לצידון, one may set sail on Friday morning — except where the custom is not to set sail at all that day. MB 248 ס״ק ד — the count of the three days is disputed, and the difference falls on Wednesday. The Magen Avraham, in the name of many Acharonim, forbids Wednesday — דהיינו ביום רביעי בשבת אסור מ״א בשם הרבה אחרונים; the Vilna Gaon brings in the name of many Rishonim that the three days are counted together with Shabbos itself, so that Wednesday is permitted — אבל הגר״א הביא בשם הרבה ראשונים דהג׳ ימים נחשבין עם השבת גופא וביום רביעי מותר, adding that the Tosefta and the Yerushalmi bear this out. The braisa itself says three days, not four: אין מפליגין בספינה פחות מג׳ ימים קודם לשבת (שבת י״ט ע״א, quoted at ס״ק א). Shulchan Aruch of the Alter Rebbe רמ״ח:א — the Rav says in one seif what the Mechaber spreads over two, and he adds the reckoning: « אֵין מַפְלִיגִים בִּסְפִינָה בְּיַמִּים הַמְּלוּחִים פָּחוֹת מִג׳ יָמִים מֵעֵת לְעֵת קֹדֶם הַשַּׁבָּת, דְּהַיְנוּ מִיּוֹם ד׳ וְאֵילַךְ, וְיוֹם ד׳ בִּכְלַל הָאִסּוּר » (שו״ע הרב רמ״ח:א). The three days are counted מעת לעת, and Wednesday is included in the prohibition. The reason is given in the same seif: « צַעַר וּבִלְבּוּל וְשִׁנּוּי וֶסֶת, וְגוּפָם מִשְׁתַּבֵּר מִנִּעְנוּעַ הַסְּפִינָה, וְאֵין רוּחָם חוֹזֶרֶת עַד לְאַחַר שְׁלֹשָׁה יָמִים מֵעֵת לְעֵת » (שו״ע הרב רמ״ח:א).
Distinction salt waters / sweet waters OC 248:2 — the reason, and the limit it imposes: the rule rests on עונג שבת, the first three days bringing צער ובלבול, and it therefore holds only for salt waters. « ודוקא למפליגים במים המלוחים אבל בנהרות אין שום צער למפליגים בהם ולפיכך מותר להפליג בהם אפילו בערב שבת » (שו״ע או״ח רמ״ח:ב). On a river the condition is not to disembark before Shabbat: it is the depth. It must not be established that the bottom is less than ten טפחים away, otherwise the prohibition of תחומין returns. Hagaha on OC 248:2 — summary: the Rama tightens the river permission wherever the traveller will himself come to a מלאכה. « וכן בספינה שיצטרך הישראל לבא לידי מלאכה בשבת אסור ליכנס בה שלשה ימים קודם השבת אפי׳ הם נהרות הנובעים » (הגהת רמ״א או״ח רמ״ח:ב). He adds, on the other hand, that being towed by animals along the bank raises no difficulty. MB 248 ס״ק י״ב-י״ד — on this point the Mishnah Berurah does not classify rivers. She notes that on a river one need not even stipulate with the boatman that he rest — « ואין צריך לפסוק עמו שישבות » (מ״ב רמ״ח ס״ק י״ב) — and then treats the ten טפחים and the reach of the תחומין prohibition over water (ס״ק י״ג-י״ד). Shulchan Aruch of the Alter Rebbe The Rav takes up the reason of צער, and adds two conditions the Mechaber does not set there: that the boat go בשביל נכרים, and that it pass above ten טפחים. In seif ד he settles the doubt about the depth: « שֶׁכָּל שֶׁיֵּשׁ סָפֵק בְּדִבְרֵי סוֹפְרִים הוֹלְכִין לְהָקֵל » (שו״ע הרב רמ״ח:ד).
Mitzvah (דבר מצוה) — leniency OC 248:1 — the leniency is in seif א, in the sentence that opens the siman: « מותר להפליג בספינה אפילו בערב שבת אם הולך לדבר מצוה ופוסק עמו שישבות ואם אחר כך לא ישבות אין בכך כלום » (שו״ע או״ח רמ״ח:א). The Mechaber does not hierarchize types of mitzvah. In seif ד he applies the same principle to travel to ארץ ישראל. Hagaha on OC 248:4 — summary: the Rama adds no condition; he widens the דבר מצוה far beyond mitzvos in the strict sense. « י״א שכל מקום שאדם הולך לסחורה או לראות פני חבירו חשוב הכל דבר מצוה ואינו חשוב דבר הרשות רק כשהולך לטייל » (הגהת רמ״א או״ח רמ״ח:ד). Only going to stroll remains a דבר הרשות. MB 248 ס״ק ב-ג — the Mishnah Berurah draws up no grid of mitzvos: she discusses the reach of the פסיקה and the case of Shabbat itself. « כתב המ״א דבשבת אסור להפליג אפילו לדבר מצוה דהא לא יוכל לפסוק עמו שישבות ולא ילך » (מ״ב רמ״ח ס״ק ב); at ס״ק ג she reports that most Acharonim hold this פסיקה to be a מצוה בעלמא, which does not condition the permission. Shulchan Aruch of the Alter Rebbe The Rav does not hierarchize mitzvos: he sets a limit. The דבר מצוה lifts the prohibition of embarking, and lifts it broadly — even below ten טפחים, even on a boat that goes בשביל ישראל. But it does not go so far as to permit desecrating Shabbat: « אֲבָל לְחַלֵּל שַׁבָּת לְצֹרֶךְ מִצְוָה, אֲפִלּוּ בְּדָבָר שֶׁאֵין בּוֹ אֶלָּא אִסּוּר שְׁבוּת מִדִּבְרֵי סוֹפְרִים — לֹא הִתִּירוּ, אֶלָּא אִם כֵּן הוּא שְׁבוּת דִּשְׁבוּת » (שו״ע הרב רמ״ח:ח). And lechatchilah one stipulates with the נכרי that he rest (seif ז).
Land caravans (שיירא) OC 248:4 — the siman has only four seifim, and the caravan is in the last. It falls under the same stringency, not under a milder rule: « היוצאים בשיירא במדבר והכל יודעים שהם צריכים לחלל שבת… What opens Friday is not a possible stop, it is the דבר מצוה: one going up to ארץ ישראל may depart even on the eve of Shabbat, and stipulates with them to rest. Hagaha on OC 248:4 — summary: the Rama says nothing about a stop. He records a custom — in some places people are lenient about setting sail and about the caravan within the three days, because they reckon everything a דבר מצוה. « וע״כ נהגו בקצת מקומות להקל בענין הפלגת הספינות והליכת שיירא תוך שלשה ימים כי חושבים הכל לדבר מצוה » (הגהת רמ״א או״ח רמ״ח:ד); and he does not protest against those who rely on it. MB 248 ס״ק ל״ה-ל״ו — the Mishnah Berurah does not treat railways. On the caravan she tightens, rather, the lenient custom the Rama reported: « ודעת מ״א בשם כמה פוסקים דבהליכת שיירא אין להקל » (מ״ב רמ״ח ס״ק ל״ה); and at ס״ק ל״ו she adds that where the custom is not lenient it is not fitting to be lenient lechatchilah, several poskim requiring a מצוה גמורה. Shulchan Aruch of the Alter Rebbe רמ״ח:י״ג-י״ד — the Rav gives the caravan no regime of its own; he places it under the reason already set out: « אֲסוּרִים לָצֵאת תּוֹךְ ג׳ יָמִים לִפְנֵי הַשַּׁבָּת, מִטַּעַם שֶׁנִּתְבָּאֵר לְמַעְלָה » (שו״ע הרב רמ״ח:י״ג). Friday opens only for a Seif י״ד is the בדיעבד: « וְכָל זֶה לְכַתְּחִלָּה, אֲבָל בְּדִיעֲבַד שֶׁכְּבָר יָצָָא בְּשַׁיָּרָא אֲפִלּוּ בְּעֶרֶב שַׁבָּת, וַאֲפִלּוּ לְטַיֵּל » (שו״ע הרב רמ״ח:י״ד) — such a one, having reached a place it is dangerous to leave, may continue as far as the first safe place, and there he rests.
Modern application — planes and long-haul travel — (modern travel — planes, transoceanic steamboats, long-haul trains — is obviously not codified by the Mechaber in the 16th century) — (parallel to the Mechaber) — (the Mishnah Berurah of this siman treats neither the steamboat nor any mechanical transport: her last ס״ק deals with the lenient custom reported by the Rama and with the requirement of a מצוה גמורה.) A transposition, not a citation — the Rav writes nothing about the plane or the steamboat, and this row does not make him say what he did not say. The criteria one may transpose are his, each at its own seif: the salt waters and the צער of the first days (seif א), the boat that goes בשביל ישראל (seif ו), the דבר מצוה and its limit שבות דשבות (seifim ז-ח), the בדיעבד of the caravan (seif י״ד). None of these seifim names a modern means of transport; applying them to a concrete case is for the Rav one asks.

The chiddushim (חידושים) specific to the Rav on this siman

Originalities that distinguish the Alter Rebbe on siman רמ״ח. Each chiddush (חידוש) follows the structure: classical position → chiddush (חידוש) of the Rav → practical consequence.

חידוש א — the reason of צער, stated in the seif itself (רמ״ח:א)

Chiddush #1 — the reason of צער, stated in the seif itself (רמ״ח:א).

The rule of the 3 days and its reason in a single seif

Classical position: the Mechaber does give the reason — משום עונג שבת, and the צער ובלבול of the first three days — but he gives it in seif ב, once the rule has been stated in seif א.

The chiddush of the Rav: the Alter Rebbe brings the two together in seif א alone, and he spells out the צער where the Mechaber only names it: « צַעַר וּבִלְבּוּל וְשִׁנּוּי וֶסֶת, וְגוּפָם מִשְׁתַּבֵּר מִנִּעְנוּעַ הַסְּפִינָה, וְאֵין רוּחָם חוֹזֶרֶת עַד לְאַחַר שְׁלֹשָׁה יָמִים מֵעֵת לְעֵת » (שו״ע הרב רמ״ח:א). In the same movement he draws from it the reckoning the Mechaber leaves open — three days מעת לעת, Wednesday included in the prohibition.

Practical consequence: the reckoning is the one point the Rav settles here, and he settles it strictly: this is the Magen Avraham's reading, against the Vilna Gaon's which the Mishnah Berurah reports at ס״ק ד. What one may draw from it for modern travel is a transposition, not a psak of the Rav: this siman knows only the sea, the river and the caravan.

חידוש ב — two conditions added to the river, and the doubt settled (רמ״ח:ג-ד)

Chiddush #2 — two conditions added to the river, and the doubt settled (רמ״ח:ג-ד).

The river permitted, but under two conditions

Classical position: the Mechaber permits the river even on the eve of Shabbat, and attaches only one reservation — that it not be established that the bottom is less than ten טפחים away.

The chiddush of the Rav: in seif ג the Alter Rebbe takes up the permission with the same reason — there is no צער on a river — but he attaches two conditions the Mechaber does not set there: that the boat go בשביל נכרים, and that it pass above ten טפחים.

Practical consequence: the Rav does, on the other hand, settle the doubt leniently when the depth is uncertain: « שֶׁכָּל שֶׁיֵּשׁ סָפֵק בְּדִבְרֵי סוֹפְרִים הוֹלְכִין לְהָקֵל » (שו״ע הרב רמ״ח:ד). This shifts the practical question from the kind of water to the question of for whom the conveyance runs — a criterion that does transpose without straining the source.

חידוש ג — the דבר מצוה lifts the embarking, not the desecration (רמ״ח:ז-ח)

Chiddush #3 — the דבר מצוה lifts the embarking, not the desecration (רמ״ח:ז-ח).

How far the דבר מצוה goes, and where it stops

Classical position: the Mechaber permits embarking for a דבר מצוה even on the eve of Shabbat (seif א), and the Rama widens the דבר מצוה as far as commerce and visiting a friend (seif ד). Neither grades mitzvos by degree.

The chiddush of the Rav: the Alter Rebbe grades them no more than they do — he draws a boundary. In seif ז the דבר מצוה lifts the prohibition broadly: even below ten טפחים, even on a boat that goes בשביל ישראל, even if he will later, through פקוח נפש, come to מלאכות גמורות.

Practical consequence: the question is therefore not to weigh the weight of the mitzvah, but to separate two things that get confused: departing, which the mitzvah permits, and desecrating on the way, which it does not — barring פקוח נפש, or שבות דשבות. And lechatchilah, one first stipulates with the נכרי that he rest (seif ז).

חידוש ד — the caravan under the same reason, and the בדיעבד (רמ״ח:י״ג-י״ד)

Chiddush #4 — the caravan under the same reason, and the

The caravan is not a regime of its own

Classical position: the Mechaber puts the caravan in seif ד under the same stringency as the sea — forbidden to depart within the three days, Sunday to Tuesday only — and opens Friday only for one going up to ארץ ישראל.

The chiddush of the Rav: far from creating a milder regime for land, the Alter Rebbe expressly attaches the caravan to the reason already set out for the sea: « אֲסוּרִים לָצֵאת תּוֹךְ ג׳ יָמִים לִפְנֵי הַשַּׁבָּת, מִטַּעַם שֶׁנִּתְבָּאֵר לְמַעְלָה » (שו״ע הרב רמ״ח:י״ג). This is the opposite gesture to an analogy with a steadier means of travel; the מדבר is not less dangerous than the sea, it is dangerous otherwise.

Practical consequence: what the Rav adds is a seif of בדיעבד, and that is where a stop does appear — but after departure, not before: « וְהִגִּיעַ לְמָקוֹם שֶׁיֵּשׁ לוֹ חֲשַׁשׁ סַכָּנָה לְהִפָּרֵד מֵהַשַּׁיָּרָא — יָכוֹל לָלֶכֶת עִמָּהֶם בְּשַׁבָּת עַד שֶׁיַּגִּיעַ לְמָקוֹם שֶׁאֵין לוֹ חֲשַׁשׁ סַכָּנָה לְהִפָּרֵד מֵהֶם, וְשָׁם יִשְׁבּוֹת » (שו״ע הרב רמ״ח:י״ד). It does not license a late departure; it governs the conduct of one already on the road.

The Chabad conduct in practice

Points of halachic conduct that flow directly from the Shulchan Aruch of the Alter Rebbe siman רמ״ח, in the Chabad sensibility.

For the Chabad Chassid (חסיד) — Siman רמ״ח

  • ① Verify the margin of the 3 days. For any long-haul plane, ship, or night train trip, board at least 3 full days before Shabbat (so before Tuesday evening / Wednesday for a Shabbat). Without this margin, intrinsic problem except for justifications. Reference: Shulchan Aruch of the Alter Rebbe רמ״ח:א.
  • ② Ask for whom the conveyance runs. The chiddush ב of the Rav: it is not the kind of water that decides alone, but whether the boat goes בשביל נכרים or בשביל ישראל. Where the passage is chartered for Jews, the Rav forbids entering it within the three days even on a river and even above ten טפחים. Reference: Shulchan Aruch of the Alter Rebbe רמ״ח:ג-ד and רמ״ח:ו.
  • ③ Separate "departing" from "desecrating on the way". The chiddush ג of the Rav. A דבר מצוה lifts the prohibition of embarking within the three days, and lifts it broadly; it does not thereby lift the prohibition of performing a מלאכה during Shabbat, even a mere שבות, barring שבות דשבות or פקוח נפש. The Rama, for his part, holds commerce and visiting a friend to be a דבר מצוה (או״ח רמ״ח:ד); the Mishnah Berurah resists and requires a מצוה גמורה (ס״ק ל״ו). This page reports that gap and does not settle it. Reference: Shulchan Aruch of the Alter Rebbe רמ״ח:ז-ח.
  • ④ Do not count on the stop in order to leave late. The chiddush ד of the Rav. The stop is not a licence to depart: it belongs to the seif of בדיעבד, and governs the conduct of one already on the road who reaches a place it is dangerous to leave — he goes as far as the first safe place, and there he rests. Reference: Shulchan Aruch of the Alter Rebbe
  • ⑤ Plane, train, ship: a transposition, and it says so. Neither the Shulchan Aruch, nor the Rama, nor the Mishnah Berurah, nor the Shulchan Aruch of the Alter Rebbe names a mechanical means of transport in this siman. The four points above are what the source gives; applying them to a flight, a train or a cruise is an argument from analogy, and belongs to the Rav one asks. No reference is given here, because there is none.
  • ⑥ The reckoning, and the point where the poskim part. The Rav counts the three days מעת לעת and includes Wednesday in the prohibition (רמ״ח:א) — the Magen Avraham's reading. The Mishnah Berurah reports at ס״ק ד that the Vilna Gaon, in the name of many Rishonim, counts the three days together with Shabbat itself, so that Wednesday is permitted. For the Chabad Chassid: the Shulchan Aruch of the Alter Rebbe rules explicitly here, and rules stringently; it is the one followed.
