📑 Study Plan
1. The Text of the Shulchan Aruch
Siman רצ״ט contains 10 seifim of the Mechaber (Rabbi Yosef Karo) codifying the laws of not eating / drinking / doing melakha before havdalah.
Seif א — Forbidden to eat/drink from tzeis until havdalah
- From nightfall one may not eat or drink anything before Havdalah — neither wine nor other drinks. Only water is permitted.
- But one already seated and eating from daytime, whom night overtook, need not interrupt.
- The rule bears on starting, not on continuing.
Seif ב — Resuming drinking after announcing havdalah
- They were drinking and said: “let us make Havdalah.” If they wish to resume drinking before doing so — they need not bless again.
- And some dispute this — ויש מי שחולק בדבר.
- The issue: does saying “let us make Havdalah” end the meal, requiring a fresh berakhah?
Seif ג — No Borei Pri Hagafen on the havdalah cup if one was already drinking
- When he interrupts to make Havdalah, he need not say בורא פרי הגפן over the Havdalah cup.
- And some say he must — וי״א שצריך.
- He was already drinking wine: does the meal’s berakhah cover the cup?
Seif ד — Birkat Hamazon + Havdalah: 1 or 2 cups
- One who was eating when night fell — who, as stated, does not interrupt — finishes his meal, says Birkat HaMazon over the cup, and then makes Havdalah over it.
- If he has two cups: Birkat HaMazon over one, Havdalah over the other.
Seif ה — Ate by mistake before havdalah
- He erred and ate before making Havdalah — he may still make it afterwards.
- The lapse does not forfeit the mitzvah; it remains to be done.
Seif ו — Total oversight: until Tuesday night
- Wine + Hamavdil: until Tuesday night.
- Ner + besamim: ONLY motzaei Shabbos (lost if forgotten that very night).
- He forgot to make Havdalah at the departure of Shabbat: he makes it until the end of Tuesday.
- And some say: only through Sunday, no further.
- And only בורא פרי הגפן and המבדיל בין קודש לחול — over candle and besamim one blesses only at the departure of Shabbat.
Seif ז — Havdalah at the table: exempts wine of the meal
- One who makes Havdalah over wine at his table: even if he made it before washing his hands, that cup covers the wine drunk during the meal.
- And some say it covers only if he washed his hands before making Havdalah.
- Rama: and if he made Havdalah first, he must afterwards say the berakhah
Seif ח — Beracha acharona when havdalah exempts the meal's wine
- When that cup covers the wine of the meal, no closing berakhah is needed over the Havdalah cup either.
- But one who had only one cup, expected more wine to be brought, made Havdalah over it — and none was brought —, then said Birkat HaMazon without a cup: some say he must say the closing berakhah.
Seif ט — Don't bring bread to the table before havdalah
- If he wishes to eat immediately after Havdalah, he should not bring bread to the table before making it.
- And if he did bring it: he spreads a cloth over it and covers it.
- The reason is stated: bread comes earlier in the verse, and would have to be given precedence were it not covered.
Seif י — Forbidden to do melakha before havdalah
- If one made havdalah in tefillah (Atah Chonantanu) — melakha permitted before havdalah on the cup.
- If havdalah in tefillah not yet said + urgent need → say "Hamavdil bein hakodesh u'vein hachol" without a beracha, then do melakha.
- Women (who don't say Atah Chonantanu) → teach them to say "Hamavdil bein kodesh lechol" before any melakha.
- It is forbidden to do any work before making Havdalah.
- But if he made Havdalah in the prayer — i.e. אתה חוננתנו — it is permitted, even though he has not yet made it over the cup.
- And if he must work before even that: he says המבדיל בין הקודש ובין החול, without a berakhah, and works. Rama: and likewise women, who do not make Havdalah in the prayer.
2. General Context
What is this siman about?
Our siman codifies the prohibitions before havdalah: eating, drinking (except water), doing melakha. With particular focus on time windows (until Tuesday night for wine/Hamavdil; only motzaei Shabbos for ner/besamim) and on emergencies (women, imminent melakha).
Place within Hilchos Shabbos
- Siman 296-298 — Havdalah (wine, besamim, ner)
- Siman 299 — Prohibitions before havdalah (our siman)
- Siman 300 — Melaveh Malka (escort meal)
3. Key Halachic Concepts
4. Overview of the 10 Seifim
| Seif | Topic | Halachah |
|---|---|---|
| א | Forbidden to eat/drink | From tzeis until havdalah (water OK) |
| ב | Resuming drink | Permitted without new beracha (Sephardi) |
| ג | Borei Pri Hagafen on havdalah cup | Not required if already recited earlier |
| ד | Birkat Hamazon + Havdalah | Same cup OK; 2 cups preferable |
| ה | Ate by mistake | May still make havdalah afterwards |
| ו | Total oversight | Wine+Hamavdil until Tuesday; ner+besamim only motzaei |
| ז | Havdalah exempts meal's wine | No new beracha needed |
| ח | Beracha acharona | Normally covered by Birkat Hamazon |
| ט | Bread at table | Cover before havdalah (priority of the pasuk) |
| י | Melakha before havdalah | Forbidden; say "Hamavdil..." without beracha for urgency |
5. The Mishnah Berurah — First Entries
The Mishnah Berurah of Rabbi Yisrael Meir Kagan (Chofetz Chaim) has 40 entries on this siman. Here are the first ones — to better understand the seifim's meaning:
For the full text of the 40 entries, see Sefaria: Mishnah Berurah 299.
6. The Position of the Rama
Where the Rama (Rabbi Moshe Isserles) adds a הגהה (gloss), he generally specifies Ashkenazi nuances over the Sephardi Mechaber. Carefully check the Hebrew text above for passages introduced by הגה.
- Seif א: minhag follows the first opinion (continue meal if already begun).
- Seif ז: if havdalah made before netilas, say beracha acharona 'Al Hagefen' afterwards.
- Seif י: women should be taught to say "Hamavdil bein kodesh lechol" before melakha. Lighting candles permitted from "Borchu" of the tzibbur (common minhag).
7. Modern Practical Cases
| Situation | Practical halachah |
|---|---|
| Drink water after tzeis, before havdalah | Permitted (sole exception). |
| Coffee / tea / juice before havdalah | Forbidden. Water only. |
| Seudah Shlishis lasting past tzeis | Continue (lay cloth, make havdalah, finish); minhag follows the first opinion. |
| Turning on lights before havdalah | If Atah Chonantanu already said: permitted. Otherwise: say "Hamavdil bein kodesh lechol" without beracha + permitted (Rama). Minhag tolerates after the tzibbur's Borchu. |
| Woman at home needing to light | Say "Hamavdil bein kodesh lechol" first, then light. |
| Totally forgot havdalah motzaei Shabbos | Make on Sunday, Monday, or Tuesday with wine + Hamavdil (no ner, no besamim). |
| Past Tuesday night, no havdalah | Lost, but consult Rav (exceptional case). |
| Ate by oversight | Make havdalah as soon as one realizes (even after the meal). |
8. Practical Synthesis of the Siman
- No eating/drinking (except water) from tzeis until havdalah.
- Meal that extends past tzeis: common minhag — finish the meal (first opinion).
- No melakha before havdalah — unless Atah Chonantanu was said, or in urgency with "Hamavdil bein kodesh lechol."
- Make-up window: until Tuesday night for wine+Hamavdil; only motzaei for ner+besamim.
- Ate by mistake: make havdalah afterwards — the mitzvah is not lost.
- Havdalah at the table exempts the meal's wine — no new beracha needed.
9. Comprehension Questions
- What may one drink between tzeis and havdalah? Why this exception?
- If Seudah Shlishis lasts past tzeis, must I stop or continue?
- Why cover the bread at the table if havdalah is not yet made?
- Until when can one make up havdalah (wine) if forgotten? And the ner/besamim?
- What formula allows doing melakha before formal havdalah?
- Does the Atah Chonantanu of the Amidah suffice to do melakha?
- If I ate by mistake without havdalah, have I lost the mitzvah?
