Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has one seif, and the Mechaber's Shulchan Aruch has one seif too; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.
This page gathers, for Siman 369, the full text of the Rav with its translation, where his text differs from the Mechaber's, and the practical conduct that follows from it.

In what manner the eruv is transferred; it contains a single seif:
One who gives money (ma'os) to a baker (nachtom) and says to him: “If the residents of the courtyard come to buy a loaf from you for the eruv, acquire for me [a share] in the eruv, so that I have a share with them, in exchange for this coin (ma'ah)” — it is not an eruv for him, for money does not acquire until one draws [the object to oneself] (meshichah). And even if the baker transferred the loaf to all the residents of the courtyard together, collectively, through another person, as an outright gift (matnas chinam) — and this man too is among the residents of the courtyard, and the baker intended that he too acquire and have a share in this loaf — nevertheless the baker did not intend that he acquire it through the one who acquires [for the residents] (ha-zocheh), so that the latter become his agent (shaliach) just as he becomes the agent of all the other residents of the courtyard to whom the baker transfers as an outright gift. Rather, the baker's thought is that this man already has a right in this loaf in exchange for the coin he gave him, and that it is for the other residents of the courtyard — to whom he gives an outright gift — for them alone, that he makes the zocheh an agent to acquire on their behalf. But for this man he does not make him an agent at all, and it turns out that he has no share in the eruv (but if [the baker] has in mind that the zocheh be an agent for this man as for the other residents of the courtyard, he has acquired the eruv).
And if he said to him “make the eruv for me” (arev li), he has acquired the eruv in any case, if [the baker] transferred [the loaf] to all the residents of the courtyard together, collectively: for he made him his agent to make the eruv for him in a way that will be effective. And since he can have an eruv only if [the baker] transfers it to him through another person, as to the others who did not give money, it is as if he had told him to transfer it to him through another person, as to the others, and not that he acquire by the coin alone. And there is a presumption that an agent carries out his mission (chazakah shaliach oseh shelichuso).
And even if he said “acquire for me” (zecheh li): if he gave him an article (keli) so that he transfer to him by way of kinyan sudar, he has acquired the eruv.
And if he gave a coin to a householder (ba'al habayis) and said to him “acquire for me [a share] in the eruv,” he has acquired the eruv: for a householder is not accustomed to sell bread of his own; it was with the thought that he would buy bread for him in the market with his money that he spoke to him so, and it is as if he had said “make the eruv for me,” since he made him his agent to make the eruv. And there is a presumption that an agent carries out his mission: by default (min ha-stam), he bought [bread] for him and acquired it on his behalf, or he transferred to him, through another person, of what is his own [the householder's].

Where the Rav's text differs from the Mechaber's seif
This survey compares the Rav's text with the Mechaber's seif alone, quoted side by side. It notes, among others, the points below, not every difference: thus, for the article handed over, the Rav names kinyan sudar, as Rashi and the Beis Yosef do, where the Mechaber's seif writes only “kinyan” (Level 2, section 7). It does not present these points as unique to the Rav: most of the reasons the Rav writes in the body of the law are already found, often almost word for word, in the Tur on this siman, in Rashi on the Gemara, and in the Magen Avraham and the Taz on this seif. Each point names where they are found.
נקודה א — מעות, משיכה וכוונת הנחתום (שו״ע הרב שס״ט:א)
Point א — money, meshichah and the baker's intention (Shulchan Aruch HaRav 369:1)
Why the coin does not acquire, and when the eruv is acquired nonetheless
What the Mechaber writes: « אינו עירוב אפילו עירב החנוני [לכל האחרים] וזכה גם לזה עמהם… » (שו״ע או״ח שס״ט:א), without giving the reason; the seif then moves on to the case where he said “make the eruv for me” (see point ב). Further on in the same seif, after “make the eruv for me” and the article, he writes for the baker: « וכן אם זיכה לו הנחתום ע״י אחר או שקנה במעה שנתן לו לחם מן השוק קנה עירוב » (שו״ע או״ח שס״ט:א).
What the Rav writes: he gives the reason of the rule, « שֶׁמָּעוֹת אֵינָן קוֹנוֹת עַד שֶׁיִּמְשׁוֹךְ » (שו״ע הרב שס״ט:א); then he writes this first case as an acquisition made through another person, « וַאֲפִלּוּ אִם זִכָּה הַנַּחְתּוֹם הַכִּכָּר לְכָל בְּנֵי הֶחָצֵר כֻּלָּם בִּכְלָל עַל יְדֵי אַחֵר בְּמַתְּנַת חִנָּם » (שו״ע הרב שס״ט:א), with, for this case, the thought he attributes to the baker, « אֶלָּא דַּעַת הַנַּחְתּוֹם הוּא שֶׁזֶּה יֵשׁ לוֹ כְּבָר זְכוּת בְּכִכָּר זֶה בִּשְׁבִיל הַמָּעָה שֶׁנָּתַן לוֹ » (שו״ע הרב שס״ט:א); then, in parentheses, the opposite case: « אֲבָל אִם יֵשׁ בְּדַעְתּוֹ שֶׁיִּהְיֶה הַזּוֹכֶה שָׁלִיחַ לְזֶה כְּמוֹ לִשְׁאָר בְּנֵי הֶחָצֵר — קָנָה עֵרוּב » (שו״ע הרב שס״ט:א).
What is already found before him: the reason is the Tur's, « שלא כיון לזכות לו במתנת חנם אלא בשביל מעה שנתן לו ומעות אינן קונות » (טור או״ח שס״ט); Rashi had already written « שאין מעות קונות עד שימשוך » (רש״י עירובין פ״א ע״א); and the Magen Avraham repeats it on the seif, « לפי שלא נתכוין ליתן לו מתנת חנם אלא בשביל מעות שנתן לו וקי״ל דמעות אינן קוני׳ » (מגן אברהם שס״ט ס״ק א); the Magen Avraham goes on to a difficulty drawn from Choshen Mishpat (siman 199, seif 3), which he leaves open (וצ״ע): Level 2 brings it (section 4). On how to read the first case, the Taz understands it as the baker transferring by himself, « פי׳ הוא עצמו מזכה להם ולו אבל לא ע״י אחר » (ט״ז או״ח שס״ט ס״ק א).
The difference: the Mechaber's seif states the rule without its reason; the Rav writes it with the reason of the Tur and of Rashi, and he writes this first case as an acquisition made through another person, where the Taz understands it as the baker himself; after him, the Mishnah Berurah understands it, as he does, as an acquisition made through others, « ר״ל ע״י זיכוי שזיכה להן ע״י אחרים » (משנה ברורה שס״ט ס״ק א). There remains the parenthesis on the opposite case: the baker's intention to make the zocheh this man's agent too. The seif, as the Taz explains it, holds acquisition through another valid without setting this condition: « פי׳ הוא עצמו מזכה להם ולו אבל לא ע״י אחר דהא ע״י אחר מהני כמ״ש אח״כ » (ט״ז או״ח שס״ט ס״ק א); and the Biur Halachah writes that, were it not for the Tur's words, he would read the Rosh thus: if the baker transferred it to him, even without naming him, together with the other residents of the courtyard, it is effective; then he adds: « ובאמת כן הוא דעת הב״י והט״ז לדינא אלא דהם פירשו כן בדברי הטור ובדברי הטור א״א לפרש כן וכמו שהוכיחו האחרונים וע״כ צ״ע לדינא » (ביאור הלכה שס״ט). As for the baker's intention, Tosafos wrote that it does not suffice, and they wrote it against Rashi's explanation on the Mishnah, whose reason is « שהרי לא נתכוון לזכות לו במתנת חנם כשאר מזכין בעירוב אלא לקנות המעה והרי אינה קנויה לו דכיון דמעות אינן קונות לא סמכה דעתיה דהאי ולא הוי דעתיה לאקנויי ונמצא מערב לו במעותיו שלא מדעתו » (רש״י עירובין פ״א ע״א): « ובחנם פירש כן דאפילו מתכוין לו להקנות לו בחנם ואפילו זיכה לו ע״י אחר או לקח המעה וקנה לו מן השוק אינו עירוב » (תוספות עירובין פ״א ע״א); they conclude, however, that Rashi's wording a little further on supports them, « ולשון הקונטרס נמי מוכיח כן בסמוך » (תוספות עירובין פ״א ע״א); and the Rosh, who copies this Rashi, wonders that he makes the eruv depend on the payer's consent, « ותימה מה תולה עירוב במעות שלא מדעתו » (רא״ש עירובין פרק ז׳ סימן י״ג); the Rosh also wonders at Tosafos, and the Taz cites them, writes « והרא״ש תמה ע״ז » (ט״ז או״ח שס״ט ס״ק ד), and defends them against that astonishment, « כנלע״ד דברי התו׳ שאין בהם תמוה בזה » (ט״ז או״ח שס״ט ס״ק ד); and the Beis Yosef traces the Tur's sentence on acquisition through another, which the seif repeats, to the Rosh and not to Tosafos, « גז״ש מדברי הרא״ש ושלא כדברי התוס׳ » (בית יוסף או״ח שס״ט); the Taz writes that the Rosh ruled so, and so did the Tur and the Shulchan Aruch, « ומ״ה פסק דזיכה לו ע״י אחר מהני וכ״כ הטור וש״ע » (ט״ז או״ח שס״ט ס״ק ד). In this case the Rav's parenthesis writes the opposite of what Tosafos write; whether it follows Rashi's explanation on the Mishnah, which Tosafos set aside and whose end concerns the payer's consent, this page does not say; consult your Rav. Another difference, measured on the two texts: the Rav does not repeat, for the baker, the Mechaber's clause quoted above (« וכן אם זיכה לו הנחתום ע״י אחר… » (שו״ע או״ח שס״ט:א)); bread bought in the market, « פַּת מִן הַשּׁוּק » (שו״ע הרב שס״ט:א), appears in his text only for the householder (point ב). The Mishnah Berurah understands that clause of the Mechaber as the case where the baker named him, « ר״ל שפרט שמו בהדיא » (משנה ברורה שס״ט ס״ק ה); the Rav's parenthesis speaks of the baker's intention. This page does not say whether the Rav's parenthesis answers the Mechaber's clause; consult your Rav.
Practical consequence: one who gave a coin to the baker saying “acquire for me” (zecheh li) has no share in the eruv, even if the baker transferred the loaf to all the residents of the courtyard together, through another person, as an outright gift — unless the baker had in mind to make the zocheh this man's agent too (369:1).
נקודה ב — ערב לי, בעל הבית, וחזקה שליח עושה שליחותו (שו״ע הרב שס״ט:א)
Point ב — “make the eruv for me,” the householder, and the presumption about the agent (Shulchan Aruch HaRav 369:1)
The presumption that an agent carries out his mission
What the Mechaber writes: « אבל אם אמר לו ערב לי קנה עירוב ואפילו אם אמר זכה לי אם נתן לו כלי בתור׳ קנין שיקנה לו בו קנה עירוב » (שו״ע או״ח שס״ט:א), and « ואם נתן מעה לבעל הבי׳ ואמר לו זכה לי בעירוב קנה עירוב » (שו״ע או״ח שס״ט:א) — without giving the reasons. The Magen Avraham gives them: for “make the eruv for me,” citing the Tur, « הרי עשאו שליח לערב לו באופן שיועיל » (מגן אברהם שס״ט ס״ק ב); for the householder, « דאין דרך בע״ה למכור משלו » (מגן אברהם שס״ט ס״ק ג).
What the Rav writes: for “make the eruv for me,” he specifies « קָנָה עֵרוּב בְּכָל עִנְיָן אִם זִכָּה לְכָל בְּנֵי הֶחָצֵר כֻּלָּם בִּכְלָל » (שו״ע הרב שס״ט:א), and writes the reason in the body of the law, « שֶׁהֲרֵי עֲשָׂאוֹ שָׁלִיחַ לְעָרֵב לוֹ בְּעִנְיָן שֶׁיּוֹעִיל » (שו״ע הרב שס״ט:א); likewise for the householder, « לְפִי שֶׁאֵין דֶּרֶךְ בַּעַל הַבַּיִת לִמְכּוֹר פַּת מִשֶּׁלּוֹ » (שו״ע הרב שס״ט:א); he writes in both cases the presumption that an agent carries out his mission, and draws from it, for the householder, what is assumed by default: « וַחֲזָקָה שָׁלִיחַ עוֹשֶׂה שְׁלִיחוּתוֹ, וּמִן הַסְּתָם קָנָה לוֹ וְזָכָה בִּשְׁבִילוֹ, אוֹ זִכָּה לוֹ עַל יְדֵי אַחֵר מִשֶּׁלּוֹ » (שו״ע הרב שס״ט:א).
What is already found before him: for “make the eruv for me,” the reason is the Tur's, « שהרי עשאו שליח לערב לו בענין שיועיל » (טור או״ח שס״ט), and the presumption is found in Rashi, « אבל אם אמר ערב לי שליחא שוויה וסמכא דעתיה דקיימא לן חזקה שליח עושה שליחותו » (רש״י עירובין פ״א ע״ב). For the householder, the Rav follows the Tur almost word for word, presumption included: « לפי שאין דרך בע״ה למכור משלו ולדעת שיקנה לו במעותיו אמר לו וכאילו אמר לו ערב לי שעשאו שליח לערב וחזקה שליח עושה שליחותו » (טור או״ח שס״ט); the Taz writes it too, « וכאלו אמר ערב לי שעשאו שליח וחזקה שליח עושה שליחותו » (ט״ז או״ח שס״ט ס״ק ה). Level 2 brings these texts (sections 6 and 9).
The difference: the Mechaber's text does not name this presumption; the Rav writes it in the body of the law for both cases, with the Tur's words for the householder. For “make the eruv for me”, the Tur already writes that it is as if he had asked to have it acquired for him as for the others, « הוי כאילו אמר שיזכה לו כמו לאחרים » (טור או״ח שס״ט), and the Magen Avraham repeats it, « והוי כאלו אמר שיזכ׳ לו כמו לאחרים » (מגן אברהם שס״ט ס״ק ב); but neither they nor the Taz write the words « בְּכָל עִנְיָן » (שו״ע הרב שס״ט:א) of the Rav's precision, « בְּכָל עִנְיָן אִם זִכָּה לְכָל בְּנֵי הֶחָצֵר כֻּלָּם בִּכְלָל » (שו״ע הרב שס״ט:א), which the Mishnah Berurah writes in turn in its own way, « גם בכאן מיירי שזיכה לו הנחתום בכלל עם אחרים » (משנה ברורה שס״ט ס״ק ג). Where the Tur, the Magen Avraham (ס״ק ב) and the Taz (ס״ק ב) write only “as for the others”, the Rav writes by what path: « יְזַכֶּה לוֹ עַל יְדֵי אַחֵר, כְּמוֹ לַאֲחֵרִים שֶׁלֹּא נָתְנוּ מָעוֹת » (שו״ע הרב שס״ט:א), and « וְלֹא יִזְכֶּה בְּמָעָה בִּלְבַדָּהּ » (שו״ע הרב שס״ט:א); the Mishnah Berurah, after him, writes “as an outright gift”, « והוי כאלו אמר לו בהדיא שיזכה לו במתנת חנם כמו לאחרים » (משנה ברורה שס״ט ס״ק ג), without naming the intermediary. For the householder, the Rav also names the bread, « לִמְכּוֹר פַּת מִשֶּׁלּוֹ » (שו״ע הרב שס״ט:א) and « בְּמָעוֹתָיו פַּת מִן הַשּׁוּק » (שו״ע הרב שס״ט:א), which neither the Tur, nor the Taz, nor the Magen Avraham names at this point (see above); others named it before him: Rashi, for the custom of selling, « דהואיל ואין בעל הבית רגיל למכור ככרות » (רש״י עירובין פ״א ע״ב), and the Rambam, who writes this law under eruvei techumin, for the purchase, « נוֹתֵן אָדָם מָעָה לְבַעַל הַבַּיִת כְּדֵי שֶׁיִּקַּח לוֹ פַּת » (רמב״ם הלכות עירובין פ״ו ה״כ); Level 2 brings them (sections 2 and 9). Among the points that neither the Tur, nor the Magen Avraham, nor the Taz writes on this siman: the last clause, « וּמִן הַסְּתָם קָנָה לוֹ וְזָכָה בִּשְׁבִילוֹ, אוֹ זִכָּה לוֹ עַל יְדֵי אַחֵר מִשֶּׁלּוֹ » (שו״ע הרב שס״ט:א), whose second branch the Mishnah Berurah writes in turn, « וע״כ אפילו אם לקח מככרו וזיכה לו עם כל אנשי החצר ג״כ מהני » (משנה ברורה שס״ט ס״ק ח).
Practical consequence: one who told the baker “make the eruv for me” (arev li) has acquired the eruv in any case, if the baker transferred the loaf to all the residents of the courtyard together; one who gave a coin to a householder saying “acquire for me [a share] in the eruv” has acquired the eruv (369:1).

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 369, in the Chabad sensibility. The siman has a single seif: each point refers to that seif, in the order of the text.
For the Chabad Chassid — Siman 369
- ① A coin given to the baker, with “acquire for me”: it is not an eruv for the one who paid, for money does not acquire without meshichah; and this even if the baker transferred the loaf to all the residents of the courtyard together through another person, as an outright gift — unless the baker had in mind to make the zocheh this man's agent too. See section 2. Reference: Shulchan Aruch HaRav 369:1.
- ② “Make the eruv for me”: the eruv is acquired in any case, if the baker transferred [the loaf] to all the residents of the courtyard together; it is as if he had asked him to transfer it to him through another person, « וְלֹא יִזְכֶּה בְּמָעָה בִּלְבַדָּהּ » (שו״ע הרב שס״ט:א). Reference: Shulchan Aruch HaRav 369:1.
- ③ “Acquire for me,” with an article: « אִם נָתַן לוֹ כְּלִי שֶׁיַּקְנֶה לוֹ בְּתוֹרַת קִנְיַן סוּדָר, קָנָה עֵרוּב » (שו״ע הרב שס״ט:א). Reference: Shulchan Aruch HaRav 369:1.
- ④ A coin given to a householder, saying “acquire for me [a share] in the eruv”: the eruv is acquired: a householder is not in the habit of selling bread of his own, « לְפִי שֶׁאֵין דֶּרֶךְ בַּעַל הַבַּיִת לִמְכּוֹר פַּת מִשֶּׁלּוֹ » (שו״ע הרב שס״ט:א); it was with the thought that he would buy him bread in the market that he said this to him, « וּלְדַעַת שֶׁיִּקְנֶה לוֹ בְּמָעוֹתָיו פַּת מִן הַשּׁוּק אָמַר לוֹ כֵּן » (שו״ע הרב שס״ט:א); it is as if he had said “make the eruv for me”, making him his agent; and, since an agent is presumed to carry out his mission, by default the householder bought [bread] for him and acquired it on his behalf, or transferred to him, through another person, of what is his own. See section 2. Reference: Shulchan Aruch HaRav 369:1.
