Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has one seif, and the Mechaber's Shulchan Aruch has one seif too; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.
This page gathers, for Siman 373, the full text of the Rav with its translation, where his text differs from the Mechaber's and from the Rema's gloss, and the practical conduct that follows from it.

Laws of two balconies (gezuztraos) of two upper storeys (aliyos); it contains a single seif:
Two balconies projecting from two upper storeys, facing each other, and one placed between them a plank (neser), like a kind of bridge from one to the other, and fixed it there with a nail (masmer), so that it cannot be removed on Shabbos (or one expressly made its bittul for the whole Shabbos): if it is four [tefachim] wide, it is like an opening (pesach), and they make the eruv together; and if they wish, each [of the two] makes the eruv for itself. But if they were not facing each other — even if one is on one side and the other on the opposite side, for example one to the north and the other to the south, but one is drawn toward the east and the other toward the west, and they are not aligned facing each other —, they cannot make the eruv together: for the plank they would place from one to the other would run from the corner (keren zavis) of one to that of the other, and it does not count as an opening, for it is not the way to make an opening in a corner. When is this said? When they are drawn away from facing each other by three tefachim; but less than three tefachim is nothing, and they are [considered] aligned. And even if they are exactly aligned, if one is higher than the other by three tefachim, it does not count as an opening.
And all this is when they are distant from each other. But if the distance between them is not four [tefachim], even though there is no plank there at all, they make the eruv together, because it is easy to step from the edge of one to the edge of the other, and it is as if they were exactly adjoining. Therefore they cannot each make the eruv for itself and carry, this one in its own and that one in its own, because they forbid each other (osros), since they are close to each other within four; unless this closeness between them is not along their full extent (bimlo'o) but only in the middle of their width — where there is a projection —, while at their ends they are four apart, and also this closeness is not more than ten amos.
When is this said? For carrying on the balconies themselves. But the upper storeys beside them: each may make the eruv for itself with the houses of its courtyard, even though their balconies are close to each other, provided only that they do not carry on the balconies. And if they wish, even all the houses of the courtyard of this upper storey may make the eruv with all the houses of the courtyard of that upper storey, because the balconies are an opening between them, provided only that there are ladders (sulamos) according to their law from the houses to the upper storeys. And the same applies if the balconies are distant but one placed a plank from one to the other.

Where the Rav's text differs from the Mechaber's seif and the Rema's
This survey compares the Rav's text with the Mechaber's seif and the Rema's gloss alone, quoted side by side. It does not present these points as unique to the Rav: several of the details the Rav writes in the body of the law are already found in the Tur on this siman, and in the Magen Avraham and the Taz on this seif. Each point names where they are found, and what is not found there.
Point א — the plank fixed with a nail (Shulchan Aruch HaRav 373:1)
The plank fixed, or annulled for the whole Shabbos
What the Mechaber writes: « ונתן ביניהם נסר רחב ארבע׳ הרי הוא כפתח ומערבין יחד » (שו״ע או״ח שע״ג:א); the seif does not say how the plank is held in place.
What the Rav writes: he describes the plank « כְּמִין גֶּשֶׁר מִזּוֹ לְזוֹ » (שו״ע הרב שע״ג:א), and writes the case of a plank fixed in place: « וּקְבָעוֹ שָׁם בְּמַסְמֵר שֶׁלֹּא יוּכַל לְהִנָּטֵל בְּשַׁבָּת » (שו״ע הרב שע״ג:א); then, in parentheses: « אוֹ שֶׁבִּטְּלוֹ בְּפֵרוּשׁ לְכָל הַשַּׁבָּת » (שו״ע הרב שע״ג:א).
What is already found before him: the description “like a bridge” is Rashi's, « כמין גשר מזו לזו » (רש״י עירובין ע״ח ע״ב); and the condition of the nail the Magen Avraham writes in the name of the Shiltei HaGiborim (ש״ג): « כ׳ הש״ג דבעי׳ שיקבע הנסר במסמר שלא יוכל ליטלו בשבת » (מגן אברהם שע״ג ס״ק א).
The difference: the Mechaber's seif does not mention the nail; the Rav writes it in the body of the law, in describing the case, and the Magen Avraham makes it a requirement. The parenthesis — the bittul expressly made for the whole Shabbos — is found neither in the Magen Avraham, nor in the Taz, nor in the Mishnah Berurah on this siman (checked against their entries as served by Sefaria); this page does not say where the Rav draws it from: the question is put to the Rav. After him, the Mishnah Berurah writes the nail condition in turn: « ובעינן שיקבע הנסר במסמרים שלא יוכל ליטלו בשבת » (משנה ברורה שע״ג ס״ק ב).
Practical consequence: a plank four [tefachim] wide, placed between two balconies facing each other, is an opening when it is fixed with a nail so that it cannot be removed on Shabbos, or when one expressly made its bittul for the whole Shabbos (Shulchan Aruch HaRav 373:1).
Point ב — offset from each other, or one higher (Shulchan Aruch HaRav 373:1)
Why a plank running corner to corner is not an opening
What the Mechaber writes: « אבל אם היו זו שלא כנגד זו שאחת משוכה למזרח וא׳ למערב אינם יכולים לערב יחד » (שו״ע או״ח שע״ג:א), without giving the reason; then « וכן אם היתה אחת גבוה מחבירת׳ לא חשיב פתח והני מילי כשמרוחקו׳ זו מזו ג״ט אבל אם הם תוך ג׳ זו לזו בין בריחוק בין בגובה חשיב שפיר כפתח » (שו״ע או״ח שע״ג:א).
What the Rav writes: he specifies the offset, « אֲפִלּוּ אִם זוֹ בְּרוּחַ זוֹ וְזוֹ בְּרוּחַ שֶׁכְּנֶגְדּוֹ, כְּגוֹן שֶׁזּוֹ בַּצָּפוֹן וְזוֹ בַּדָּרוֹם » (שו״ע הרב שע״ג:א), « וְאֵינָן מְכֻוָּנוֹת זוֹ כְּנֶגֶד זוֹ » (שו״ע הרב שע״ג:א); he gives the reason, « מִפְּנֵי שֶׁהַנֶּסֶר שֶׁיִּתְּנוּ מִזּוֹ לְזוֹ יָבֹא מִקֶּרֶן זָוִית שֶׁל זוֹ לְשֶׁל זוֹ וְאֵינוֹ חָשׁוּב כְּפֶתַח, שֶׁאֵין דֶּרֶךְ לַעֲשׂוֹת פֶּתַח בְּקֶרֶן זָוִית » (שו״ע הרב שע״ג:א); then he writes the measure for the offset, « בַּמֶּה דְּבָרִים אֲמוּרִים?
What is already found before him: the reason is the Tur's, « שכשיתנו הנסר מזו לזו יבא מקרן זוית של זו לשל זו ולא חשיב פתח דפתחא בקרן זוית לא עבדי אינשי » (טור או״ח שע״ג), which the Magen Avraham repeats on the seif, « שכשיתנו הנסר מזו לזו יבא מקרן זויות של זו לשל זו ופתחא בקרן זויות לא עבדי אינשי » (מגן אברהם שע״ג ס״ק ג). The Rav's precision on the offset — one to the north, the other to the south — is found neither in the Tur, nor in the Magen Avraham, nor in the Taz on this seif (checked against their entries served by Sefaria); the Ritva, reporting Rashi, already places the balconies on either side of the public domain, « אחת מהן במזרח ותחת למערב ורחב רשות הרבים ביניהם » (ריטב״א עירובין ע״ח ע״ב), and, in Rabbeinu Tam's question that he reports, the offset is on the other axis, « שהאחת נוטה כלפי צפון והאחת כלפי דרום » (ריטב״א עירובין ע״ח ע״ב) — the Rav's directions, inverted; Rashi describes balconies « ואם ישנן זו אצל זו בשתי עליות » (רש״י עירובין ע״ח ע״ב); after the Rav, the Mishnah Berurah explains balconies facing each other in the same way: « ר״ל שזה בולט מדרום לצפון וזה מצפון לדרום » (משנה ברורה שע״ג ס״ק א). On « חשיב שפיר כפתח » (שו״ע או״ח שע״ג:א) — within three tefachim, whether in offset or in height —, the Magen Avraham explains: « פי׳ דהוי כאלו הנסר מונח בשוה » (מגן אברהם שע״ג ס״ק ד).
The difference: the Mechaber gives the rule without its reason, and the measure of three tefachim only once for both cases, « בין בריחוק בין בגובה » (שו״ע או״ח שע״ג:א); the Rav writes the Tur's reason, and the measure for each of the two cases. On the scope of that reason, the commentators on the seif differ: the Taz infers from the Tur's reason « משמע כל שאינם בקרן זוית שפיר מהני הנסר אע״ג דהוה בעיקום » (ט״ז או״ח שע״ג ס״ק ג); the Biur Halachah reports that the Eliyah Rabbah disputes him, « והנה בא״ר חולק עליו וסובר דאין נ״מ אלא כל שהוא מעוקם בג״ט לא מהני נסר » (ביאור הלכה שע״ג), and concludes « וכן עיקר דהרבה ראשונים ס״ל כדעת רש״י דהמשנה דגזוזטרא קאי אנסר ואפ״ה בזה שלא כנגד זה לא מהני » (ביאור הלכה שע״ג). The Rav writes the Tur's reason, without the Taz's inference or the Eliyah Rabbah's objection; this page does not say which of the two readings he follows: the question is put to the Rav.
Practical consequence: when the two balconies are far from each other, « וְכָל זֶה כְּשֶׁהֵן רְחוֹקוֹת זוֹ מִזּוֹ » (שו״ע הרב שע״ג:א): if they are offset from each other by three tefachim, they cannot make the eruv together; an offset of less than three tefachim is nothing: they are as if aligned; and even when aligned, if one is higher than the other by three tefachim, it is not an opening (Shulchan Aruch HaRav 373:1).
Point ג — without a plank, within four (Shulchan Aruch HaRav 373:1)
The Rema's gloss: its place, and the conditions the Rav writes for its case
What the Mechaber and the Rema write: right after the case of the plank, the Rema writes « ואם אין המרחק שביניהם ארבעה אפילו בלא נסר נמי דינא הכי » (רמ״א או״ח שע״ג:א); and the seif continues with the Mechaber's words « ואם רצו כל א׳ מערבת לעצמה » (שו״ע או״ח שע״ג:א).
What the Rav writes: he writes this case after those of the offset and the height, and opens it with « וְכָל זֶה כְּשֶׁהֵן רְחוֹקוֹת זוֹ מִזּוֹ » (שו״ע הרב שע״ג:א); he writes the gloss's rule with its reason, « אֲבָל אִם אֵין הַמֶּרְחָק שֶׁבֵּינֵיהֶן ד׳, אַף שֶׁאֵין שָׁם נֶסֶר כְּלָל — מְעָרְבִין יַחַד, מִפְּנֵי שֶׁנּוֹחַ לִפְסוֹעַ מִשְּׂפַת זוֹ לִשְׂפַת זוֹ » (שו״ע הרב שע״ג:א); and he draws from it: « וְלָכֵן אֵינָן יְכוֹלִים לְעָרֵב כָּל אַחַת לְעַצְמָהּ וּלְטַלְטֵל זוֹ בְּשֶׁלָּהּ וְזוֹ בְּשֶׁלָּהּ, מִפְּנֵי שֶׁהֵן אוֹסְרוֹת זוֹ עַל זוֹ, כֵּיוָן שֶׁהֵן קְרוֹבוֹת זוֹ לְזוֹ בְּתוֹךְ ד׳ » (שו״ע הרב שע״ג:א), « אֶלָּא אִם כֵּן קֵרוּב זֶה שֶׁבֵּינֵיהֶן אֵינוֹ בְּמִלּוּאוֹ אֶלָּא בְּאֶמְצַע רָחְבָּן בִּלְבָד, שֶׁיֵּשׁ שָׁם בְּלִיטָה, אֲבָל בִּקְצוֹתֵיהֶן הֵן רְחוֹקוֹת זוֹ מִזּוֹ ד׳, וְגַם אֵין בְּקֵרוּב זֶה יוֹתֵר מֵעֲשָׂרָה אַמּוֹת » (שו״ע הרב שע״ג:א). The option of each making the eruv for itself he writes for the plank: « הֲרֵי הוּא כְּפֶתַח וּמְעָרְבִין יַחַד, וְאִם רָצוּ, כָּל אַחַת מְעָרֶבֶת לְעַצְמָהּ » (שו״ע הרב שע״ג:א).
What is already found before him: the Magen Avraham, on « כפתח » (שו״ע או״ח שע״ג:א) at the end of the seif, reserves for distant balconies the measure of three tefachim for the offset, and refers close balconies to the gloss's measure of four, « ודוקא כשהן רחוקות זו מזו » (מגן אברהם שע״ג ס״ק ה) and « אבל אם הם סמוכות זו לזו ממש שיערו בארבע כמ״ש בהג״ה ואין צריך נסר » (מגן אברהם שע״ג ס״ק ה); the reason is the Taz's, « כיון דיכול לפסוע מזה לזה » (ט״ז או״ח שע״ג ס״ק ב), who reports from Tosafos, in the name of Rabbeinu Tam, on balconies within four, and connects the Rema's gloss to it: « היכא דליכא ד׳ מזו לזו מערבין שנים ואם רצו א׳ כו׳ והיינו כמ״ש » (ט״ז או״ח שע״ג ס״ק ב); the two conditions are the Magen Avraham's, « ודוקא כשאין כל משך הגזוזטראות סמוך רק במשך י׳ אמות הם סמוכים דהוי פתח » (מגן אברהם שע״ג ס״ק ב) and « אבל אם סמוכין זו לזו יותר מי׳ אמות מערבין א׳ ואין מערבין ב׳ והוא הדין כשכל משך אורך הגזוזטראות סמוך אפי׳ פחות מי׳ דהוי כנפרוץ במלואו » (מגן אברהם שע״ג ס״ק ב), and he adds « וכ״כ במ״מ בשם הרשב״א וכ״כ הב״ח » (מגן אברהם שע״ג ס״ק ב) — the Maggid Mishneh served by Sefaria does not mention ten amos there (see Level 2); and the Beis Yosef reports from the Maggid Mishneh that the Rashba proved from Tosafos « שאם אין ביניהם מרחק ד׳ אינו צריך נסר מזו לזו אלא אף בלא נסר מערבין אחד ואין מערבין שנים כל שהן זו כנגד זו » (בית יוסף או״ח שע״ג) — the Maggid Mishneh served by Sefaria writes, for his part, that the Rashba draws his ruling from the Tosefta (see Level 2).
The difference: the Rema writes « דינא הכי » (רמ״א או״ח שע״ג:א) without saying whether, in this case, each may make the eruv for itself, and the option of doing so follows his gloss in the seif. The Rav places this case after the offset and the height, and restricts what precedes to distant balconies — the Magen Avraham (ס״ק ה) did so for the measure of three tefachim for the offset —; he writes for this case that each may not make the eruv for itself and carry each on its own balcony, with the reason that they forbid each other, and he allows it only under the two conditions the Magen Avraham writes (ס״ק ב). After him, the Mishnah Berurah writes these conditions in turn, starting from the option: « כמו בנסר שיכולין לערב יחד כשירצו ואם רצו מערבין שנים ודוקא שסמיכת הגזוזטראות זו לזו לא היה באורך כל הכותל דאלו אם היה סמיכתן באורך כל הכותל או שהיה נמשך הסמיכה זו לזו ביותר מעשר אמות אז מערבין אחד ולא שנים » (משנה ברורה שע״ג ס״ק ה). It also sets a limit of ten amos on the option of each making the eruv for itself in the case of the plank, « ודוקא כשאין הנסר מחזיק רק מארבעה טפחים עד עשר אמות אבל אם הוא מרוצף בנסרים יותר מעשר אמות מערבין אחד ולא שנים » (משנה ברורה שע״ג ס״ק ו); the Rav does not write it for the plank in this seif. This page does not say whether he holds it from elsewhere (for the ten amos, the Magen Avraham refers to siman שע״ב, seif ז): the question is put to the Rav. The Rav also writes, for balconies within four, that each may not make the eruv for itself to carry on the balconies — a refusal he at once restricts to carrying on the balconies themselves (point ד) —, where the Taz reads in Tosafos and in the Rema's gloss that they may make two eruvin, or one if they wish: on how the Taz reconciles this reading with the Beis Yosef, see point ד.
Practical consequence: without a plank, if the distance between the two balconies is not four [tefachim], they make the eruv together; they may not each make the eruv for itself and carry each in its own, unless this closeness is only in the middle of their width — their ends remaining four apart — and is not more than ten amos (Shulchan Aruch HaRav 373:1).
Point ד — the balconies themselves, and the upper storeys with the houses of their courtyard (Shulchan Aruch HaRav 373:1)
When is this said: carrying on the balconies
What the Mechaber and the Rema write: the seif does not distinguish between carrying on the balconies and the eruv of the upper storeys with their courtyard.
What the Rav writes: « בַּמֶּה דְּבָרִים אֲמוּרִים?
What is already found before him: on the case without a plank, within four, the Beis Yosef reports the rule quoted in point ג, « שאם אין ביניהם מרחק ד׳ אינו צריך נסר מזו לזו אלא אף בלא נסר מערבין אחד ואין מערבין שנים כל שהן זו כנגד זו » (בית יוסף או״ח שע״ג); the Taz notes the contradiction, « והנה זה סותר מ״ש בשם התו׳ ודברי הרמ״א ולק״מ » (ט״ז או״ח שע״ג ס״ק ב), and distinguishes: « דזה מיירי במערב לטלטל מגזוזטרא לחברתה והם רחבות הרבה » (ט״ז או״ח שע״ג ס״ק ב), « משא״כ בדברי תו׳ ורמ״א כאן שהגזוזטרא אינם רחבים ואינו רוצה להשתמש שם רק שעל ידיהם יהיה פתח מחצר לחצר ובזה מערבין כמו שרוצים » (ט״ז או״ח שע״ג ס״ק ב).
The difference: the Rav distinguishes between carrying on the balconies themselves and the eruv of the upper storeys with the houses of their courtyard; the Taz distinguished between an eruv made to carry from one balcony to the other, when they are very wide, and balconies that are not wide, which one wants only as an opening from one courtyard to the other. The two distinctions are not worded the same way — the Taz speaks of the width of the balconies, the Rav does not —: this page does not say whether they coincide; the question is put to the Rav. The condition of the ladders, « רַק שֶׁיִּהְיוּ סֻלָּמוֹת כְּדִינָם מֵהַבָּתִּים לָעֲלִיּוֹת » (שו״ע הרב שע״ג:א), is found neither in the Tur, nor in the Magen Avraham, nor in the Taz, nor in the Mishnah Berurah on this siman; this page does not say which laws the word « כְּדִינָם » (שו״ע הרב שע״ג:א) refers to: the question is put to the Rav. After him, the Mishnah Berurah writes in turn that each may make the eruv of his courtyard with his houses and his upper storey: « אבל מ״מ אפילו לא עירוב יחד יכולים כ״א לערב לעצמו החצר עם בתיו ועליה שלו » (משנה ברורה שע״ג ס״ק ו).
לְטַלְטֵל בִּגְזוּזְטְרָאוֹת עַצְמָן » (שו״ע הרב שע״ג:א): each upper storey may make the eruv for itself with the houses of its courtyard, even if the balconies are close to each other, provided they do not carry on the balconies; and, if they wish, all the houses of the courtyard of one upper storey may make the eruv with all those of the courtyard of the other, the balconies being an opening between them, provided there are ladders according to their law from the houses to the upper storeys; likewise if the balconies are distant but one placed a plank from one to the other (Shulchan Aruch HaRav 373:1).

The practical Chabad conduct
Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 373, in the Chabad sensibility. The siman has a single seif: each point refers to that seif, in the order of the text.
For the Chabad Chassid — Siman 373
- ① The plank between two balconies facing each other: if it is four [tefachim] wide and fixed with a nail so that it cannot be removed on Shabbos — or if one expressly made its bittul for the whole Shabbos —, it is an opening: they make the eruv together, and, if they wish, each for itself. See section 2. Reference: Shulchan Aruch HaRav 373:1.
- ② Balconies offset from each other, or one higher than the other: when they are far from each other, « וְכָל זֶה כְּשֶׁהֵן רְחוֹקוֹת זוֹ מִזּוֹ » (שו״ע הרב שע״ג:א): offset from each other by three tefachim, they cannot make the eruv together, « מִפְּנֵי שֶׁהַנֶּסֶר שֶׁיִּתְּנוּ מִזּוֹ לְזוֹ יָבֹא מִקֶּרֶן זָוִית שֶׁל זוֹ לְשֶׁל זוֹ וְאֵינוֹ חָשׁוּב כְּפֶתַח, שֶׁאֵין דֶּרֶךְ לַעֲשׂוֹת פֶּתַח בְּקֶרֶן זָוִית » (שו״ע הרב שע״ג:א); offset by less than three tefachim, they are as if aligned; and even when aligned, if one is higher than the other by three tefachim, it is not an opening. See section 2. Reference: Shulchan Aruch HaRav 373:1.
- ③ Without a plank, within four [tefachim]: they make the eruv together, for it is easy to step from the edge of one to the edge of the other; they may not each make the eruv for itself to carry each on its own balcony (see ④), unless the closeness is only in the middle of their width — their ends remaining four apart — and is not more than ten amos. See section 2. Reference: Shulchan Aruch HaRav 373:1.
- ④ The upper storeys and the houses of their courtyard: « בַּמֶּה דְּבָרִים אֲמוּרִים? לְטַלְטֵל בִּגְזוּזְטְרָאוֹת עַצְמָן » (שו״ע הרב שע״ג:א); each upper storey may make the eruv for itself with the houses of its courtyard, provided they do not carry on the balconies; and, if they wish, the houses of both courtyards may make the eruv together, « לְפִי שֶׁהַגְּזוּזְטְרָאוֹת הֵן פֶּתַח בֵּינֵיהֶן, רַק שֶׁיִּהְיוּ סֻלָּמוֹת כְּדִינָם מֵהַבָּתִּים לָעֲלִיּוֹת » (שו״ע הרב שע״ג:א); and likewise if the balconies are far apart but a plank was placed from one to the other, « וְהוּא הַדִּין אִם הַגְּזוּזְטְרָאוֹת רְחוֹקוֹת אֶלָּא שֶׁנָּתַן נֶסֶר מִזּוֹ לְזוֹ » (שו״ע הרב שע״ג:א). See section 2. Reference: Shulchan Aruch HaRav 373:1.
