Daat HaRav — The Shulchan Aruch HaRav on Siman 376

A cistern and a well between two courtyards, in the 4 seifim of the Shulchan Aruch HaRav: the partition above the water and the beam four tefachim wide, the cistern in the middle of a path, three ruins between two courtyards, a privy between two houses or two courtyards.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has 4 seifim, and the Mechaber's Shulchan Aruch has 4 as well; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.

This page gathers, for Siman 376, the full text of the Rav with its translation, where his text differs from the Mechaber's and the Rema's, and the practical conduct that follows from it.

A cistern and a well that are between two courtyards; it contains 4 seifim:

A cistern (bor) that is between two courtyards, with no doorway or window between them through which they could make an eruv, or there is one but they did not make an eruv — one may not draw from it on Shabbos, since the domain of both of them holds sway there, unless they made for it a partition of ten tefachim above the water as a mark of separation between this domain and that one; for with this partition we say "gud achis" [it is regarded as extended] downward to the bottom of the cistern, as was explained in Siman 355, since it bears a mark and a reminder, so that they will not come to carry from courtyard to courtyard elsewhere than at the place where water is drawn; for only with water were they lenient to say "gud achis", for the reason explained there. But the courtyard wall that runs over the cistern is not treated as a partition, because it bears no mark at all, since it was not made for that purpose.

And if the partition is entirely within the water, a tefach of it must protrude above the water, so that the separation between them is recognizable. And if it is entirely above the water, a tefach of it must be sunk in the water, to keep the bucket from going and drawing water from his fellow's domain. And although even so the bucket goes under the partition into his fellow's domain, that is of no consequence: it is a leniency that the Sages granted with water, not to require for it a complete partition separating water from water entirely, but only that they appear separated, and that it not appear that this one draws from his fellow's domain, but as though each draws from his own domain.

Likewise, if they placed over the face of the cistern a beam four tefachim wide, this one draws on this side and that one draws on that side, for they were lenient with water to say "the edge of the roof descends and closes off" (pi tikra yored vesosem) on both its sides, as though the edge of the roof were a partition descending to the bottom of the cistern. And here there is no concern that it appear that this one draws from his fellow's domain, because the Sages estimated that a bucket does not travel more than four tefachim; if so, he will not draw water from the second side of the beam, which is his fellow's domain. And although he draws from under the beam, where the domain of both holds sway, that is of no consequence, for the Sages were lenient with water and were concerned only that the bucket not draw from the second side, for then it appears to the eye that he draws from his fellow's domain; which is not so under the beam: it is not so recognizable there that his fellow's domain holds sway, and he does not appear to be drawing from his fellow's domain. Likewise they were lenient with water and were not concerned that the water mixes and goes from this side of the partition or the beam to the second side, and the other draws it there.

And all this is for drawing the water and bringing it into the house, or even if he uses it in the courtyard but draws with a bucket that rested (shavas) in the house. But if it rested in the courtyard, the cistern needs no remedy (tikkun) at all for drawing from it into the courtyards, for all the courtyards are one domain for vessels that rested in them, even though they did not make an eruv, as was explained in Siman 372.

And if the cistern is not close to the two courtyards but four tefachim away from each — for example, there is a small path between the walls of two courtyards with the cistern within it — if no courtyard opens onto it by a full doorway, but they draw from it through windows that open onto it from the two courtyards: if there are ten tefachim from the windows to the water, this use of drawing being a use with difficulty — both are permitted to draw from it on Shabbos, and they do not forbid each other even if it [the cistern, or the path] belongs to both of them in partnership, since they use it only by casting the bucket through the air across a width of four tefachim, and a person does not forbid his fellow through the air (avir) [that is crossed] across a width of four tefachim, because this is not considered a use at all, and it is not enough to forbid his fellow unless it is within ten [tefachim]; see Siman 375.

But if the courtyards open onto the path, the domain of both holds sway in it, it is like a courtyard belonging to both of them, and they are forbidden in it until they make an eruv.

When does this apply? When the path is a private domain (reshus hayachid). But if it is a karmelis — for example, it opens at both its ends onto a karmelis — even if the cistern is four tefachim away from the walls of the courtyards, it is forbidden to draw from it, unless a curb (chulya) ten high surrounds it, as was explained in Siman 354.

Two courtyards with three ruins between them whose owners do not live in them, and they are surrounded by partitions on all their sides, so that they are a full private domain, except that they are breached into one another (along their full width or by more than ten amos), and each of the courtyards has windows opening onto the ruin beside it — each one is permitted, in the one beside him, to use it through his window, by lowering [objects] and throwing (shilshul uzerikah); since he has no full use of it on a weekday, having no doorway opening onto it but only a window, the breach in the partition does not forbid.

And he may use all of it, and his fellow does not forbid it to him. And although his fellow also uses it on a weekday, throwing through his own air through the breach into this ruin, nonetheless, since his fellow has [use] of it only by throwing through the air across a width of four tefachim or more, he cannot forbid it to him, and it is assigned to him, for he has convenient use of it by lowering [objects] next to his window. And his fellow may not use it on Shabbos by throwing through the air, because [the one beside it] forbids it to his fellow.

But the middle ruin, since it is far from both of them and both have use of it only by throwing through the air across a width of four tefachim, they do not forbid each other, and both are permitted in it on Shabbos, even though they did not make an eruv together.

And if all three are adjacent to the houses — for example, the middle one is opposite the two, like the three legs of a kankan — each is permitted in the ruin beside him, and the third, which is close to both of them, both are forbidden in it, because both have convenient use of it by lowering [objects] next to the window, and they forbid each other.

And these ruins, even though they have owners, the people of the courtyards adjacent to them are permitted to use them, and the owners do not forbid them, since they do not live in them, and a dwelling without its owners does not forbid, as was explained in Siman 371.

2 · The Rav's text and the Mechaber's

Where the Rav's text differs from the Mechaber's seif and the Rema's

Each point sets side by side a seif of the Mechaber's Shulchan Aruch (its numbering, 4 seifim), with the Rema's gloss where there is one, and the corresponding seif of the Shulchan Aruch HaRav (its own numbering, 4 seifim), in the order of the Rav's seifim, and notes only what the comparison of the texts shows. On this siman, the two divisions correspond seif for seif (the Rav's seif → the Mechaber's seif): 1 → 1 and the Rema's gloss; 2 → 2 and the Rema's gloss; 3 → 3; 4 → 4. What is missing from the Mechaber's text is not new for that reason: on this siman, several of the Rav's clarifications are already found, among other places, in the Gemara, in the Rambam and the Raavad's glosses on him, in the Tur, in the Beis Yosef (which brings, among others, Rashi and the Rosh), in the Rema's gloss on Siman 355, in the Magen Avraham or in the Taz, and the Mishnah Berurah, which writes after him, takes up several of them. Each point names where they are found; a clarification whose source we have not looked for is not presented on that account as the Rav's own.

Point א — The partition, the beam, and the bucket that rested in the house (Shulchan Aruch HaRav 376:1)

The partition and the bucket

What the Mechaber writes: in seif 1 he writes « אין ממלאים ממנו בשבת אלא אם כן עשו מחיצה עשרה למעלה מן המים וצריך שיהיה טפח מן המחיצה יורד בתוך המים » (שו״ע או״ח שע״ו:א); then the case of a partition entirely within the water, followed by a reason, « כדי שתהי׳ ניכרת רשות זה מרשות זה » (שו״ע או״ח שע״ו:א), and that of a beam four tefachim wide, without giving its reason; the Rema adds « ודוקא אם בא למלאות בכלים של בית אבל בכלים של חצר לא בעינן שום תיקון דהא חצירות רשות אחת הן » (רמ״א או״ח שע״ו:א), referring to Siman 372.

What the Rav writes: of the courtyard wall he writes « אֲבָל כֹּתֶל הֶחָצֵר שֶׁמְּהַלֵּךְ עַל גַּבֵּי הַבּוֹר אֵינוֹ נִדּוֹן מִשּׁוּם מְחִצָּה, לְפִי שֶׁאֵין בּוֹ הֶכֵּר כְּלָל, הוֹאִיל וְלֹא נַעֲשָׂה בִּשְׁבִיל כָּךְ » (שו״ע הרב שע״ו:א); he first sets the partition entirely within the water, then the one entirely above the water, and gives the reason for the tefach sunk in the water: « לִמְנוֹעַ הַדְּלִי מִלֵּילֵךְ וְלַחְצוֹב מַיִם מֵרְשׁוּת חֲבֵרוֹ » (שו״ע הרב שע״ו:א); for the beam: « לְפִי שֶׁשִּׁעֲרוּ חֲכָמִים שֶׁאֵין דְּלִי מְהַלֵּךְ יוֹתֵר מִד׳ טְפָחִים » (שו״ע הרב שע״ו:א); and on the case of the Rema's gloss: « וְכָל זֶה לְמַלֹּאת הַמַּיִם וּלְהַכְנִיסָם לַבַּיִת, אוֹ אֲפִלּוּ יִשְׁתַּמֵּשׁ בָּהֶם בֶּחָצֵר אֶלָּא שֶׁדּוֹלֶה בִּדְלִי שֶׁשָּׁבַת בַּבַּיִת » (שו״ע הרב שע״ו:א).

What is already found before him: the Tur writes, after Rashi's view, « ובלבד שתהא עשויה לכך להתיר למלאות » (טור או״ח שע״ו), and the Beis Yosef explains that this is « לאפוקי מר״י דאמר שם באותה משנה לא תהא מחיצה גדולה מן הכותל שביניהם » (בית יוסף או״ח שע״ו); the Magen Avraham writes in ס״ק א, on the words « שתהיה נכרת » (מגן אברהם שע״ו ס״ק א), « ולא ילך הדלי לרשות חבירו והא דלא חיישי׳ להכי בגזוזטרא ברסי׳ שנ״ה » (מגן אברהם שע״ו ס״ק א), and explains how the balcony of Siman 355 differs; the Biur Halachah, which writes after the Rav, writes on the words « וצריך שיהיה טפח » (שו״ע או״ח שע״ו:א): « ומה דבסימן שנ״ה גבי גזוזטרא לא מצרכינן לזה עיין בב״י וב״ח ומ״א » (ביאור הלכה שע״ו). For the beam, the Gemara says « הָא קָא אָזֵיל דְּלִי לְאִידַּךְ גִּיסָא, וּמַיְיתֵי? On the Rema's gloss, the Magen Avraham writes in ס״ק ג, from the Hagahos Maimoniyos, « ועכ״פ אסור להכניס המים לבית אם לא עשו תיקון » (מגן אברהם שע״ו ס״ק ג). The Mishnah Berurah, which writes after him, writes of the wall « ומחיצת הכותל שעומד ע״ג הבור אין מועיל לזה כלל דבעינן דוקא שתהא עשויה לשם כך ובתוך אוגן הבור » (משנה ברורה שע״ו ס״ק ג).

The difference: the Mechaber's seif writes a reason, « כדי שתהי׳ ניכרת רשות זה מרשות זה » (שו״ע או״ח שע״ו:א), at the end of the second case, that of a partition entirely within the water, and the Rema's gloss gives its own; for the beam, the seif writes no reason. The Rav sets the two cases of the partition in the reverse order from the Mechaber's, and gives each its reason: for the tefach protruding from the water, when the partition is entirely within the water, « כְּדֵי שֶׁתְּהֵא הַהַפְרָשָׁה בֵּינֵיהֶן נִכֶּרֶת » (שו״ע הרב שע״ו:א), close to the Mechaber's words; for the tefach sunk in the water, when it is above the water, « לִמְנוֹעַ הַדְּלִי מִלֵּילֵךְ וְלַחְצוֹב מַיִם מֵרְשׁוּת חֲבֵרוֹ » (שו״ע הרב שע״ו:א). The Magen Avraham writes that the bucket must not go into the other's domain on the words « שתהיה נכרת » (מגן אברהם שע״ו ס״ק א), which end the second case, and the Biur Halachah places the question he discusses there under the words « וצריך שיהיה טפח » (שו״ע או״ח שע״ו:א), which set out the first: to which case the Magen Avraham ties this reason, and whether the reason the seif writes also applies to the first case, this page does not decide. The Mishnah Berurah, which writes after the Rav, writes for the first case « דבעינן רק שלא יכנס הדלי בהדיא לחלק חבירו » (משנה ברורה שע״ו ס״ק ד), and on the word ניכרת « ובזה הטפח לבד סגי שלא ילך הדלי לרשות חבירו » (משנה ברורה שע״ו ס״ק ז); which tefach it speaks of there, this page does not decide either. The idea that the bucket must not go into the other's domain is already found in the Magen Avraham; the comparison with the Rav holds for that idea, not for the case to which each one ties it. For the beam, the reasons the Rav gives — notably, that the edge of the roof [formed by the beam] is seen as a partition coming down, that the bucket does not go beyond four tefachim, and that the Sages took no account of the water mixing — are already found in the Gemara, the Rambam, the Beis Yosef and the Magen Avraham (above). That the courtyard wall does not count as a partition, the Mechaber's seif does not write explicitly; the Beis Yosef reads it in the words of the Tur, which exclude the view of Rabbi Yehudah in the mishnah, and the Mishnah Berurah, which writes after the Rav, reads it in the seif's words « אלא אם כן עשו מחיצה » (שו״ע או״ח שע״ו:א): « דבעינן דוקא שתהא עשויה לשם כך » (משנה ברורה שע״ו ס״ק ג); likewise on « וכן אם עשו » (שו״ע או״ח שע״ו:א), for the beam: « אבל כשלא נעשה כדי להתיר לא » (משנה ברורה שע״ו ס״ק ח). On the Rema's gloss: the Rema requires the remedy only for drawing with house vessels; the Magen Avraham adds that in any case the water may not be brought into the house without a remedy; the Rav's text carries both: the remedy is needed to draw the water and bring it into the house, or even to use it in the courtyard when drawing with a bucket that rested in the house; with a bucket that rested in the courtyard, none is needed to draw into the courtyards.

Practical consequence: two courtyards that did not make an eruv together do not draw on Shabbos from the cistern between them, to bring the water into the house or with a bucket that rested in the house, until a partition of ten tefachim is made above the water (the courtyard wall running over the cistern does not count), a tefach of which protrudes from the water if it is within the water, or is sunk in it if it is above, or a beam four tefachim wide is placed over the cistern; with a bucket that rested in the courtyard, one draws into the courtyards without a remedy (376:1).

Point ב — The cistern in the path: the distance, the windows, the doorways, the karmelis (Shulchan Aruch HaRav 376:2)

The path between two courtyards

What the Mechaber writes: in seif 2 he writes « באר שבאמצע השביל בין שני כותלי חצירות אע״פ שהיא מופלגת מכותל זה ד״ט ומכותל זה ד״ט שניהם ממלאים ממנה ואינם צריכים זיזים על גבן שאין אדם אוסר על חבירו דרך אויר » (שו״ע או״ח שע״ו:ב); the Rema adds « ודוקא כשאין חצרות פתוחות בשביל רק בחלונות » (רמ״א או״ח שע״ו:ב), then « וי״א דאם אינן מופלגים ארבעה אוסרים אפילו בכה״ג » (רמ״א או״ח שע״ו:ב), giving as his source, in parentheses, the Beis Yosef in the name of Rashi.

What the Rav writes: he sets out the case « וְאִם אֵין הַבּוֹר קָרוֹב לְב׳ הַחֲצֵרוֹת אֶלָּא רָחוֹק מִכָּל אֶחָד ד׳ טְפָחִים » (שו״ע הרב שע״ו:ב); he places a condition on the permission, « אִם יֵשׁ מִן הַחַלּוֹנוֹת לְמַיִם י׳ טְפָחִים, שֶׁתַּשְׁמִישׁ מִלּוּי זֶה הוּא תַּשְׁמִישׁ בְּקֹשִׁי » (שו״ע הרב שע״ו:ב); he writes « וְאֵינָן אוֹסְרִים זֶה עַל זֶה אֲפִלּוּ הוּא שֶׁל שְׁנֵיהֶם בְּשֻׁתָּפוּת » (שו״ע הרב שע״ו:ב), and « וְאֵינוֹ כְּדַאי לֶאֱסוֹר עַל חֲבֵרוֹ אֶלָּא אִם כֵּן הוּא בְּתוֹךְ עֲשָׂרָה, עַיֵּן סִמָּן שע״ה » (שו״ע הרב שע״ו:ב); for courtyards that open onto the path, « אֲבָל אִם חֲצֵרוֹת פְּתוּחוֹת לַשְּׁבִיל — רְשׁוּת שְׁנֵיהֶם שׁוֹלֶטֶת בּוֹ וַהֲרֵי הוּא כְּחָצֵר שֶׁל שְׁנֵיהֶם, וַאֲסוּרִים בּוֹ עַד שֶׁיְּעָרְבוּ » (שו״ע הרב שע״ו:ב); and he limits all this to a path that is a private domain: « אֲבָל אִם הוּא כַּרְמְלִית, כְּגוֹן שֶׁמְּפֻלָּשׁ בִּשְׁנֵי רָאשָׁיו לְכַרְמְלִית — אֲפִלּוּ אִם הַבּוֹר מֻפְלָג מִכָּתְלֵי הַחֲצֵרוֹת ד׳ טְפָחִים אָסוּר לְמַלֹּאת מִמֶּנּוּ, אֶלָּא אִם כֵּן מַקִּיפָתוֹ חֻלְיָא גָּבוֹהַּ עֲשָׂרָה » (שו״ע הרב שע״ו:ב).

What is already found before him: the Tur writes « ואם אין הבור קרוב להם אלא רחוק מכל אחד ד׳ טפחים כגון שיש שביל קטן בין שתי החצירות והבור בתוכו ואין דיורין פתוחין לו אלא ממלאין דרך חלונות » (טור או״ח שע״ו); the Beis Yosef brings Rashi's explanation, « דאי לאו הכי דמופלג הוי תשמישו בנחת » (בית יוסף או״ח שע״ו), then what he infers from the Rambam's words: « ולפ״ז מופלג דנקט שמואל אינו בדוקא כפירש״י אלא לרבותא נקט מופלגת בד׳ וכ״ש בפחות מכאן » (בית יוסף או״ח שע״ו); on the Mechaber's words the Magen Avraham writes « וכ״ש בפחו׳ מד׳ (דאז) אף על פי שהחצירו׳ פתוחות לשביל שרי לסברא זו » (מגן אברהם שע״ו ס״ק ד), and on the Rema's « אבל כשהחצירות פתוחות לשביל רשות שניהם שולטות בו והוי השביל כחצר שאינ׳ מעורב׳ ואסור » (מגן אברהם שע״ו ס״ק ה); and for a path that is not a private domain, the Beis Yosef brings from Tosafos an explanation of the Ri, « א״נ כגון שאותו הפסק שבין שתי חצירות שהבור עומד שם אינו רה״י אלא ר״ה או כרמלית ומחיצות הבור גבוהים י׳ דכשממלאים מהבור לחצר מביאין דרך מלמעלה מי׳ דהוי מקום פטור » (בית יוסף או״ח שע״ו). Elsewhere in this siman, the Beis Yosef writes that the Tur wrote the case of the path according to Rashi's view: « שתשמיש בני החצירות בבור אינו אלא דרך אויר לדעת רש״י שסתם רבינו דבריו לדעתו » (בית יוסף או״ח שע״ו); and the Taz, who writes in ס״ק ג that the view the Rema brings is Rashi's, writes « דלרש״י שהוא כשיטת הטור לא תמצא שם תרתי לריעותא » (ט״ז או״ח שע״ו ס״ק ג). The Raavad, on the Rambam (Hilchos Eruvin 3:23), already requires, without distinguishing, a curb ten high, for then the air of the public domain does not forbid it, nor does his fellow's domain, by way of the air; the Maggid Mishneh wonders at this (level 2, section 9).

The difference: the Mechaber's seif permits « אע״פ שהיא מופלגת » (שו״ע או״ח שע״ו:ב) four tefachim, and the Magen Avraham reads in these words that, according to this view, at less than four it is all the more permitted; the Rema brings the view that forbids at less than four tefachim, even through windows. The Rav writes the permission for a cistern four tefachim away from each courtyard, in the words of the Tur, which the Beis Yosef and the Taz tie to Rashi's approach — that of the view the Rema brings; his seif 2 opens with « וְאִם אֵין הַבּוֹר קָרוֹב לְב׳ הַחֲצֵרוֹת אֶלָּא רָחוֹק » (שו״ע הרב שע״ו:ב), after seif 1, which deals with the cistern between two courtyards; a cistern that is closer he does not address in this seif, and this page does not decide what he holds about it; the Mishnah Berurah, which writes after him, writes of the view the Rema brings « ופסקו האחרונים כדעה זו » (משנה ברורה שע״ו ס״ק ט״ו). For courtyards with doorways onto the path, the Rav writes what the Rema and the Magen Avraham write in ס״ק ה, on the gloss; in ס״ק ד, on the words of the seif, the Magen Avraham writes on the contrary that, according to this view, it is permitted even when the courtyards open onto the path (above) — he writes it right after what he says of a cistern less than four tefachim away, and this page does not decide whether he says it at four as well. The Mechaber's seif writes « ואינם צריכים זיזים על גבן » (שו״ע או״ח שע״ו:ב); the Rav does not mention projections. Among what the Rav writes that neither the Mechaber's seif nor the Rema's gloss writes are, notably, the condition of ten tefachim from the windows to the water, which he ties to Siman 375 — in seif 2 of that siman, in the Shulchan Aruch, additions in parentheses, in the name of the Tur, write « ובתוך עשרה למרפסת » (שו״ע או״ח שע״ה:ב) for the mound; this page does not say it is the same condition —; and the path that is a karmelis, for which he requires a curb ten high — the Ri's explanation that the Beis Yosef brings already speaks of a cistern in such a path, whose walls are ten high, and the Raavad already requires a curb ten high (above).

Practical consequence: a cistern in a path that is a private domain, four tefachim away from each courtyard, from which one draws through windows ten tefachim above the water: both courtyards draw from it on Shabbos, even if it [the cistern, or the path] belongs to both in partnership; if the courtyards have doorways onto the path, they are forbidden in it until they make an eruv; if the path is a karmelis, it is forbidden to draw from it even at four tefachim, unless a curb ten high surrounds it (376:2). For a cistern less than four tefachim away, this seif does not give the rule: consult your Rav.

Point ג — The three ruins, and ruins that have owners (Shulchan Aruch HaRav 376:3)

The ruins

What the Mechaber writes: in seif 3 he writes « שתי חצרות וביניהם ג׳ חורבות כל א׳ מותר באותה שאצלו להשתמש בה דרך חלונות על ידי זריקה והאמצעי׳ מותרת לשניהם » (שו״ע או״ח שע״ו:ג), then the case of the three ruins adjacent to the houses; he does not say whether the ruins have owners.

What the Rav writes: he describes the ruins, « שֶׁאֵין בַּעֲלֵיהֶן דָּרִין בָּהֶן, וּמֻקָּפוֹת מְחִצּוֹת הֵן מִכָּל רוּחוֹתֵיהֶן וַהֲרֵי הֵן רְשׁוּת הַיָּחִיד גְּמוּרָה, אֶלָּא שֶׁהֵן פְּרוּצוֹת זוֹ לְזוֹ (בְּמִלּוּאָן אוֹ בְּיוֹתֵר מֵעֶשֶׂר אַמּוֹת) » (שו״ע הרב שע״ו:ג); each uses the one beside him « דֶּרֶךְ חַלּוֹנוֹ עַל יְדֵי שִׁלְשׁוּל וּזְרִיקָה » (שו״ע הרב שע״ו:ג), and he gives the reason: « הוֹאִיל וְאֵין לוֹ בָּהּ תַּשְׁמִישׁ גָּמוּר בְּחֹל, שֶׁאֵין לוֹ פֶּתַח פָּתוּחַ לָהּ אֶלָּא חַלּוֹן, אֵין פִּרְצַת הַמְּחִצָּה אוֹסֶרֶת » (שו״ע הרב שע״ו:ג); and at the end of the seif he writes « וְחֻרְבּוֹת אֵלּוּ, אַף עַל פִּי שֶׁיֵּשׁ לָהֶם בְּעָלִים, מֻתָּרִים בְּנֵי חֲצֵרוֹת הַסְּמוּכוֹת לָהֶן לְהִשְׁתַּמֵּשׁ בָּהֶן וְאֵין הַבְּעָלִים אוֹסְרִים עֲלֵיהֶן, הוֹאִיל וְאֵינָן דָּרִים בָּהֶם, וְדִירָה בְּלֹא בְעָלִים אֵינָהּ אוֹסֶרֶת » (שו״ע הרב שע״ו:ג), referring to Siman 371.

What is already found before him: the Beis Yosef brings Rashi, who describes the ruins, « מחיצות פרוצות זו לזו ואין בהם דיורים ואין להם בעלים אלא בני הבתים הללו ויש חלונות בבתים פתוחים לחורבה » (בית יוסף או״ח שע״ו), then gives the reasons, « הואיל ואין לו בה תשמיש גמור בחול שאין לו בה פתח פתוח לה אלא חלון אין פירצת המחיצה אוסרתו ומותר להשתמש בכולו » (בית יוסף או״ח שע״ו), and « הואיל ויש לחבירו בה תשמיש נוח בשלשול סמוך לחלונו » (בית יוסף או״ח שע״ו); on what Rashi writes of the owners, the Rosh objects « וקשה דהא קי״ל דירה בלא בעלים לא שמה דירה » (בית יוסף או״ח שע״ו), and the Beis Yosef writes « ורבינו סתם דבריו כדעת הרא״ש » (בית יוסף או״ח שע״ו); indeed the Tur writes « ואפי׳ יש לחורבות בעלים אינן אוסרים כיון שאין דרים בהם » (טור או״ח שע״ו).

The difference: the Mechaber's seif does not say whether the ruins have owners; the Biur Halachah wonders at this, « ולפלא על השו״ע שלא הבית דעתו בזה » (ביאור הלכה שע״ו), and sets Rashi on one side and on the other « אבל בתוספות הביאו בשם ר״י שחולק על רש״י וס״ל דאפילו יש להן בעלים ג״כ מותר לפי שאינה בית דירה וכן הוא ג״כ דעת הרא״ש והרשב״א » (ביאור הלכה שע״ו), suggests that the Mechaber may have said so by his silence, « ואפשר מדסתם ולא חילק משמע ג״כ דבכל גווני שרי » (ביאור הלכה שע״ו), then writes « ובלבוש פסק בהדיא דמותר אפילו ביש להן בעלים וכן פסק הגר״ז » (ביאור הלכה שע״ו). The Rav writes explicitly, like the Tur and the Rosh, that owners who do not live in them do not forbid. He also writes « שִׁלְשׁוּל וּזְרִיקָה » (שו״ע הרב שע״ו:ג) where the Mechaber's seif writes « על ידי זריקה » (שו״ע או״ח שע״ו:ג), and gives the reasons in Rashi's terms, which the Mishnah Berurah, writing after him, takes up in ס״ק י״ז and י״ח.

Practical consequence: when three ruins whose owners do not live in them are enclosed by partitions and breached into one another (fully or by more than ten amos), and each courtyard has windows onto the ruin beside it, each courtyard uses, through its window, the ruin beside it, by lowering [objects] or throwing, and may use all of that ruin; the other courtyard does not use it on Shabbos by throwing through the air; the middle ruin, far from both, is permitted to both without an eruv; if the three stand like the three legs of a kankan, the third, close to both, is forbidden to both; owners who do not live in the ruins do not forbid (376:3).

Point ד — A privy between two houses or two courtyards (Shulchan Aruch HaRav 376:4)

The privy

What the Mechaber writes: in seif 4 he writes « בית הכסא שבין שני הבתים ולא עירבו יחד רשות שניהם שולטת בו ואסורים » (שו״ע או״ח שע״ו:ד), followed, in parentheses, by a reference to Siman 355.

What the Rav writes: he adds the case of two courtyards and sets a condition: « אוֹ אֲפִלּוּ עוֹמֵד בֵּין ב׳ חֲצֵרוֹת וְכָל אֶחָד נִפְנֶה לוֹ מֵחֲצֵרוֹ, אִם הוּא שֶׁל שְׁנֵיהֶם בְּשֻׁתָּפוּת וְלֹא עֵרְבוּ יַחַד — אֲסוּרִים לִפָּנוֹת לוֹ לְכַתְּחִלָּה בְּשַׁבָּת » (שו״ע הרב שע״ו:ד); he gives the reason, « וְהַצּוֹאָה הִיא כְּכֵלִים שֶׁשָּׁבְתוּ בַּבַּיִת, וְאָסוּר לְהוֹצִיאָם אֲפִלּוּ מֵחָצֵר לְחָצֵר » (שו״ע הרב שע״ו:ד), and writes « עַד שֶׁיְּעָרְבוּ יַחַד אוֹ יַעֲשׂוּ לוֹ תִּקּוּן » (שו״ע הרב שע״ו:ד).

What is already found before him: the Magen Avraham writes « דדמי לכלים ששבתו בבית » (מגן אברהם שע״ו ס״ק ט); the Beis Yosef brings from the Hagahos Maimoniyos « בית הכסא שבין שני בתים אם יש ביניהם פתח שיכולין לערב יחד מערבין ומותרים בו ואם לאו רשות שניהם שולטת בו ואסורין » (בית יוסף או״ח שע״ו), and gives the reason: « וטעמא משום דדמי לבור שבין ב׳ חצירות ואין מחיצה תלויה מועלת בבית הכסא כמו בבור » (בית יוסף או״ח שע״ו); and the Mordechai, whom he cites next, brings a view that permits: « אך כתב שה״ר יעקב מקינון מתיר משום דצואה מקום פטור הוא » (בית יוסף או״ח שע״ו). The parenthesis of seif ד refers to Siman 355; the Rema's gloss there writes, in seif ג, « בית הכסא העומד בין שני בתים אסור לפנות שם אם לא עירבו יחד ולא עשו לו תיקון מבע״י כמו שנתבאר סעיף ב׳ דאז שרי דלא הוי אלא כמו חצר שאינה מעורבת כדלקמן סי׳ שנ״ו ועסי׳ שע״ו ס״ד » (רמ״א או״ח שנ״ה:ג), and « וכל זה דוקא לכתחלה אבל דיעבד ששכחו ולא ערבו מותר דגדול כבוד הבריות » (רמ״א או״ח שנ״ה:ג); seif ב of that siman, to which it refers, writes « ואם עשה דף או קנה פחות מג׳ שתפול הצואה עליו קודם שתפול למים אין צריך מחיצות » (שו״ע או״ח שנ״ה:ב), and the Mishnah Berurah, which writes after the Rav, explains this reference: « היינו תיקון דדף או קנה. אבל תיקון דמחיצה תלויה אינו מועיל הכא עד שיורדת עד למטה » (משנה ברורה שנ״ה ס״ק ל״ה) — the remedy meant is, according to it, the board or the reed, not the hanging partition that the same seif permits for a privy over water; the Beis Yosef too writes that a hanging partition does not help for a privy (above).

The difference: the Mechaber's seif speaks of two houses and sets no condition of ownership; the Rav adds, notably, the two courtyards and the condition « אִם הוּא שֶׁל שְׁנֵיהֶם בְּשֻׁתָּפוּת » (שו״ע הרב שע״ו:ד); the word « לְכַתְּחִלָּה » (שו״ע הרב שע״ו:ד) and the remedy alongside the eruv are already found in the Rema's gloss on Siman 355, to which the parenthesis of seif ד refers; the reason of the vessels that rested in the house, in the Magen Avraham. The Rav and the Rema both compare the place to a courtyard, but not toward the same conclusion: in the Rav, « לְפִי שֶׁהוּא כְּחָצֵר שֶׁל שְׁנֵיהֶם » (שו״ע הרב שע״ו:ד) gives the reason for the prohibition; in the Rema, « כמו חצר שאינה מעורבת » (רמ״א או״ח שנ״ה:ג) comes after « דאז שרי » (רמ״א או״ח שנ״ה:ג), once the remedy has been made, and the Mishnah Berurah writes on the reference that follows « דשם מבואר דבחצר שאינה מעורבת לכו״ע מותר כחו » (משנה ברורה שנ״ה ס״ק ל״ו). What applies after the fact the Rav's seif 4 does not say; the Rav writes it in Siman 355, in the seif that follows: « וְכָל זֶה לְכַתְּחִלָּה. אֲבָל בְּדִיעֲבַד, שֶׁשָּׁכְחוּ וְלֹא עֵרְבוּ — מֻתָּר מִשּׁוּם כְּבוֹד הַבְּרִיּוֹת » (שו״ע הרב שנ״ה:י״ג), as does the Rema's gloss on Siman 355 (above); and the Mishnah Berurah, which writes after the Rav, refers to Siman 355 and writes « דאם שכח ולא עירב בדיעבד מותר לפנות דגדול כבוד הבריות » (משנה ברורה שע״ו ס״ק כ״ד). In ס״ק כ״ג it explains the Mechaber's seif as a case where the seat belongs to each one alone and the pit to both, and writes « אבל אם גם מקום המושב היה שייך לשניהם מותר » (משנה ברורה שע״ו ס״ק כ״ג); the Rav writes the condition of partnership without distinguishing the seat from the pit, and this page does not decide how the two texts fit together.

Practical consequence: a privy between two houses, each relieving himself into it from his house, or between two courtyards, each relieving himself into it from his courtyard, that belongs to both in partnership: if they did not make an eruv together, they do not relieve themselves into it lechatchilah on Shabbos, until they make an eruv together or a remedy (376:4); for this case, the Rav writes in Siman 355 (seif 12) a board or a reed, and the Mishnah Berurah (355 ס״ק ל״ה) and the Beis Yosef write that a hanging partition does not help there. For one who forgot to make the eruv, the Rav writes in Siman 355 (seif 13) that after the fact it is permitted, because of human dignity, as do the Rema's gloss on Siman 355 and the Mishnah Berurah; consult your Rav.

The practical Chabad conduct

Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 376, in the Chabad sensibility, in the order of its seifim. The seif numbers are the Rav's.

For the Chabad Chassid — Siman 376

  • ① The cistern between two courtyards: two courtyards that did not make an eruv together do not draw on Shabbos from the cistern between them, to bring the water into the house or with a bucket that rested in the house, without a partition of ten tefachim above the water made for that purpose — a tefach of it protruding from the water if it is within the water, or sunk in it if it is above —, or without a beam four tefachim wide placed over the cistern; the courtyard wall running over the cistern does not count as a partition; with a bucket that rested in the courtyard, one draws into the courtyards without any remedy. Reference: Shulchan Aruch HaRav 376:1.
  • ② The cistern in a path: in a path that is a private domain, a cistern four tefachim away from each courtyard, from which one draws through windows ten tefachim above the water, is permitted to both courtyards, even if it [the cistern, or the path] belongs to both in partnership; if the courtyards have doorways onto the path, they are forbidden in it until they make an eruv; if the path is a karmelis, one does not draw from it without a curb ten high around the cistern. For a closer cistern, see section 2, and consult your Rav. Reference: Shulchan Aruch HaRav 376:2.
  • ③ The three ruins: between two courtyards, three ruins enclosed by partitions and breached into one another (fully or by more than ten amos), each courtyard having windows onto the ruin beside it: each courtyard uses the ruin beside it through its window, by lowering [objects] or throwing, and the other courtyard does not use it on Shabbos by throwing through the air; the middle one, far from both, is permitted to both without an eruv; when they stand like the three legs of a kankan, the third, close to both, is forbidden to both; owners who do not live in the ruins do not forbid: « וְדִירָה בְּלֹא בְעָלִים אֵינָהּ אוֹסֶרֶת » (שו״ע הרב שע״ו:ג). Reference: Shulchan Aruch HaRav 376:3.
  • ④ The shared privy: a privy between two houses or two courtyards, each relieving himself into it from his house or courtyard, belonging to both in partnership, is not used lechatchilah on Shabbos until an eruv or a remedy is made (for this case, a board or a reed, not a hanging partition: section 2, point ד); for one who forgot to make the eruv, the Rav writes that after the fact it is permitted, because of human dignity (Siman 355, seif 13: section 2, point ד); consult your Rav. Reference: Shulchan Aruch HaRav 376:4.
