Siman 131 — Kosher wine made on a non-Jew's premises

A Jew came to make, in a non-Jew's cellar, a wine that will stay there and that still belongs to his host. Everything the three preceding simanim had built — the seal, the double seal, the key — stops working here, and for one reason only: the man who might touch it has nothing to fear. From this the siman draws a grid of cases whose conclusion is constant: here, only a presence guards

1. The axiom: it is not the lock that guards the wine

The starting point:

Simanim 128 to 130 had one silent constant: the wine belonged to the Jew. The non-Jew who came near it had nothing to gain and much to lose if caught. All the measures of guarding — the seal, the double seal, the key, the escort — did nothing but exploit that fear.

Siman 131 removes that constant. The wine is the non-Jew's own, and it rests in his cellar; the Jew has only produced it according to the rules so that it may be sold to Jews. The owner therefore loses nothing by being found out but a sale — and the spring of all the preceding measures slackens at a stroke.

« ישראל שעשה יינו של עובד כוכבים בטהרה כדי שיהא מותר לישראל » (שו״ע יו״ד קל״א:א).

The Rambam had already named the spring, two halakhot earlier, in the opposite case: « מִפְּנֵי שֶׁהָעַכּוּ״ם מְפַחֵד תָּמִיד וְאוֹמֵר עַתָּה יִכָּנֵס לְבֵיתוֹ פִּתְאֹם וְיִמְצָא אוֹתִי בְּתוֹךְ בֵּיתוֹ » רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה א.

And for our case he states exactly the opposite: « שֶׁכֵּיוָן שֶׁהַיַּיִן שֶׁל עַכּוּ״ם וּבִרְשׁוּתוֹ אֵינוֹ מְפַחֵד לְזַיֵּף וּלְהִכָּנֵס לַבַּיִת » רמב״ם הלכות מאכלות אסורות פרק י״ג הלכה ג.

And the line that closes the perek gives the siman its single criterion: « אָמַר רָבָא: אִם נִתְפָּס עָלָיו כְּגַנָּב — חַמְרָא שְׁרֵי, וְאִי לָא — אָסוּר » (עבודה זרה ס״א ע״ב).

💡 The marker: every time the siman looks strict, ask what the owner would risk; every time it looks lenient, ask who could walk in unannounced. There is no other variable in the whole siman.

⚖ The phrase the Acharonim place over the whole siman

The Pitchei Teshuva rules out the most tempting error — thinking the question is settled by the law of acquisition: « דהכא אין הטעם משום דינא דקנין כמו במכירת חמץ ובכור והיתר שביתת בהמה דהכא הכל תליא במרתת » (פתחי תשובה יו״ד קל״א ס״ק א). הכל תליא במרתת — everything depends on the fear.

2. The 3 reflex questions

1. Whose wine is it? The non-Jew's so long as he can hold it back — that is, so long as nothing has been paid, or he has written no receipt. Then: siman 131. Otherwise: siman 130.
2. Where is it? With the owner, with another independent non-Jew, or with another who depends on him. Three distinct regimes.
3. Who can see? A Jew in the courtyard · Jews in the city plus a door onto the street · peddlers who may enter at any hour · nobody. Four answers, four requirements.

💡 To remember: the only cell in the table where the Mehaber writes permitted with nothing is the neighbour's — and the only one where he writes forbidden regardless is the one where no one looks. The two extremes of the siman are two observations about people, not about objects.

The source is a single line of Rav Yosef: « אָמַר רַב יוֹסֵף: וְחַלּוֹן כִּרְשׁוּת הָרַבִּים דָּמֵי, וְאַשְׁפָּה כִּרְשׁוּת הָרַבִּים דָּמֵי, וְדִיקְלָא כִּרְשׁוּת הָרַבִּים דָּמֵי » (עבודה זרה ס״א ע״א).

The Tur explains the palm tree and goes beyond the obvious reason: « לא מיבעיא אם יש בו פירות שירא הנכרי שמא יעלה עליו ללקט פירותיו » (טור יו״ד קל״א).

⚖ The Taz widens the reach of the opening

One might have thought, as in siman 128, that only what lies in the line of sight is protected. The Taz refuses it: « אבל הכא אמרינן חזקה לא נכנס כלל דמרתת שמא יראוהו נכנס ויוצא או יראוהו מן הדרך כניסתו ויציאתו » (ט״ז יו״ד קל״א ס״ק ד). It is not the act that would be seen, it is the entering — so the whole room is covered.

5. The guard: יושב ומשמר and יוצא ונכנס

The mishnah itself eases the requirement: « וְאֵין הַשּׁוֹמֵר צָרִיךְ לִהְיוֹת יוֹשֵׁב וּמְשַׁמֵּר, אַף עַל פִּי שֶׁהוּא יוֹצֵא וְנִכְנָס — מוּתָּר » (עבודה זרה ס״א ע״א).

By the same token the Shach explains why the neighbour suffices: « והישראל דר בחצר. דחשיב כמו שומר דסגי ביוצא ונכנס כן כתבו הפוסקים » (ש״ך יו״ד קל״א ס״ק ב).

⚖ The boundary: the announced absence

« ויוצא ונכנס. אע״פ ששהה זמן רב אם לא הודיעו שמפליג » (ש״ך יו״ד קל״א ס״ק ט). It is not the length that breaks the guarding, it is the announcement: once the non-Jew knows the guard will not return, the fear collapses.

💡 Pitfall: the number of Jews never redeems a closed door. The Shach notes it in a word: « אף על פי שישראל דר בעיר. ואפילו הרבה ישראלים » (ש״ך יו״ד קל״א ס״ק ח). The two conditions are cumulative; they do not replace one another.

7. The deposit with another non-Jew, and כפוף תחת ידו

The Mehaber permits it — but on a condition: « והוא שלא יהא עובדי כוכבים האחר כפוף תחת יד העובד כוכבים בעל היין » (שו״ע יו״ד קל״א:א).

The source is Rava's case: « אֲמַר לְהוּ רָבָא: אַדְּרַבָּה, אֲפִילּוּ לְמַאן דְּאָמַר לָא חָיְישִׁינַן לְגוֹמְלִין, הָנֵי מִילֵּי הֵיכָא דְּלָא מִירְתַת מִינֵּיהּ, אֲבָל הָכָא, כֵּיוָן דְּמִירְתַת מִינֵּיהּ — מְחַפֵּי עֲלֵיהּ זְכוּתָא » (עבודה זרה ס״א ע״ב).

The Beit Yosef rules explicitly: « ופסקו הרא״ש והרשב״א והר״ן ז״ל הלכה כת״ק אבל מדברי הרמב״ם בפרק י״ג נראה שפוסק כרשב״א ולענין הלכה נראה דנקיטין כהרשב״א והרא״ש והר״ן » (בית יוסף יו״ד קל״א).

8. The התקבלתי receipt — the shift to siman 130

« ואם כתב העובד כוכבים לישראל התקבלתי אם כשיבא ישראל להוציאו אינו מעכב עליו הרי הוא כיינו ומותר במפתח וחותם » (שו״ע יו״ד קל״א:א).

The counter-case is in the mishnah itself: « אֲבָל אִם יִרְצֶה יִשְׂרָאֵל לְהוֹצִיא וְאֵינוֹ מַנִּיחוֹ עַד שֶׁיִּתֵּן לוֹ אֶת מְעוֹתָיו, זֶה הָיָה מַעֲשֶׂה בְּבֵית שְׁאָן וְאָסְרוּ » (עבודה זרה ס״א ע״א).

⚖ What does not count as a receipt

« דוקא כ׳ לו התקבלתי או שזקפו עליו במלוה הא לאו הכי אפילו קנאו ממנו בפני עדים כדרך מקחן של עובדי כוכבי׳ שלא יוכל א׳ מהם לחזור המקח אסורים » (ש״ך יו״ד קל״א ס״ק י״ג). A contract, even an irrevocable one, does not suffice: the receipt is needed, or the conversion of the price into a debt.

⚖ Partial payment

« ולא פרע לו מעות. היינו שלא פרע לו כלום אבל אם פרע לו מקצת בענין שיש לישראל חלק ביין » (ש״ך יו״ד קל״א ס״ק א). As soon as the deposit gives the Jew a real share in the wine, one leaves siman 131.

9. The seal within a seal: the machloket, and the three answers

« ויש מי שאומר שבחותם תוך חותם מותר בכל ענין » (רמ״א יו״ד קל״א:א).

« ויש לסמוך עליו להתירו בהנאה אבל לא בשתייה » (רמ״א יו״ד קל״א:א).

The Beit Yosef reports the opposing camp in the firmest terms: « וכתב הרשב״א בתשובה שכך היא הסכמת הגאונים והר״מ והרא״ש שיינו של נכרי שטיהרו ישראל ונתנו בחצר שהנכרי דר שם אין לו תקנה ואפי׳ בכמה חותמות אלא כשישראל יושב ומשמר » (בית יוסף יו״ד קל״א).

⚖ The Shach's two concessions

« ומכל מקום בהפסד מרובה אפשר דיש להתיר בשתיה וכדברי הב״ח » (ש״ך יו״ד קל״א ס״ק ט״ו) — and, for all three simanim at once: « ודע דבכל הסימן וכן בכל סימן קכ״ט וק״ל דחיישינן שמא נגע בו עובד כוכבים היינו דוקא במקום דאיכא למיחש שמא נגע בו לשתות או להחליף או לשום הנאה אחרת » (ש״ך יו״ד קל״א ס״ק ט״ו).

10. Seif 2 — why the sea is safer than the cellar

« עובדי כוכבים שקונים יין מישראל ומחתימין אותו חותם בתוך חותם ומוליכין אותו כמה ימים בספינה לבדם מותר » (שו״ע יו״ד קל״א:ב).

The reason comes from the Tur, in the name of Rabbenu Tam: « אבל כשמוליך יין למרחוק בטורח גדול והוצאה מרובה וגם קנה אותו חש לטרחו ולהוצאתו ולא יזייף » (טור יו״ד קל״א).

⚖ Two Acharonic refinements

The Bach holds to the letter of the seif: « וכתב הב״ח דאע״ג דמדינא להט״ו אין חילוק בין חותם א׳ לב׳ חותמות מכל מקום לא שרי הכא אלא בחב״ח כדמשמע בתוספות » (ש״ך יו״ד קל״א ס״ק ט״ז). And the Noda BiYehuda, reported by the Pitchei Teshuva, generalises the reason without daring to make it a rule: « אבל היכא שהעובד כוכבים משלם שכר השמירה חושש להפסד הוצאותיו ושפיר מרתת » (פתחי תשובה יו״ד קל״א ס״ק ה).

The Rama adds to seif 2 the case of partnership: « אם יש על היין עוד חותם אחד הוי חותם בתוך חותם כמו שנתבאר לעיל סימן ק״ל ולא חיישינן לשותפות העובד כוכבים » (רמ״א יו״ד קל״א:ב).

And the Shach gives the reason: « דהכא שאני דכיון דאית לישראל שותפות בעובד כוכבים מרתת ונתפס עליו כגנב » (ש״ך יו״ד קל״א ס״ק י״ח).

11. The 6 golden rules

  1. A seal is not a barrier, it is a mark. Its force comes from the eye that will read it, not from its strength.
  2. The owner fears nothing. Where the wine belongs to the man who might touch it, no closure replaces a watching eye.
  3. An unpredictable presence is worth more than two seals. The Jewish neighbour dispenses with everything; an announced absence cancels everything.
  4. City and door are cumulative. Neither Jews without an open door, nor an open door without Jews.
  5. The receipt changes the siman. התקבלתי plus the absence of withholding move the case from 131 to 130.
  6. What one has paid for, one does not spoil. Seif 2 and the Noda BiYehuda both draw the same conclusion from investment.

Five letters, five doors. If none of them is passed, the guard remains — and nothing else.

13. The 5 classic pitfalls

  1. Transposing siman 130 to here. Two seals suffice there and fail here. The Taz says it in one line: « שאין עובד כוכבים מרתת מליגע כיון שהוא שלו מה שאין כן ביין של ישראל ברשות עובד כוכבים דמותר בחת״ח או בחותם אחד בדיעבד דמרתת טפי » (ט״ז יו״ד קל״א ס״ק ג).
  2. Thinking the contract suffices. The Shach expressly rules out an irrevocable sale with no receipt (s.k. 13).
  3. Counting Jews without looking at the door. The two conditions are cumulative (s.k. 8).
  4. Relying on a deposit with a third party without checking his independence. A subordinate depositary is equivalent to the owner himself.
  5. Extending seif 2 to seif 1. The leniency of the voyage rests on an investment, not on a closure; the Bach keeps its strict letter.
