Siman 136 — The empty cask entrusted to a non-Jew

A single seif — the Shulchan Arukh announces it itself: ובו סעיף אחד. Vessels set aside for wine are shipped by the hand of a non-Jew; they are empty, and yet they must be sealed, because what is feared is not that the wine be touched but that the cask be used. One seal or two, the weight of an hour, the kashering that was missed, and large casks at the craftsman’s (Shulchan Arukh, Yoreh De'ah 136 — 1 seif)

So that it be recognizable if the non-Jew has put wine into them. Six words, and the whole siman: the seal prevents nothing — it makes the fraud visible.

Why must a vessel that leaves empty be sealed?

Because the danger is not contact but use. The Mechaber writes: « השולח ביד עובד כוכבים כלים המיוחדים ליין צריך להחתימם בחותם אחד כדי שיהא ניכר אם הכניס בהם העובד כוכבים יין » (שו״ע יו״ד קל״ו:א). The vessel is empty; what is feared is that the carrier will put his own wine into it along the way, and that nothing will show it. The seal closes nothing: it makes the opening ascertainable. One seal, or a seal within a seal?

The Mechaber rules for one and reports the other view: « ויש מי שמצריך חותם בתוך חותם » (שו״ע יו״ד קל״ו:א). The Shach gives the reason in the name of the Ran — the number of seals is measured by the forger’s gain: « דהתם אין העובד כוכבים יכול להחליפו אלא ביין מבושל או בחומץ שהוא גרוע ממנו מעט שאם היה שבחו של זה מרובה ממנו היה חלופו ניכר ומיתפס עליו כגנב ומשום שבחא פורתא לא טרח ומזייף אבל כאן משום תשמיש מרובה טרח ומזייף. הר״ן » ((ש״ך יו״ד קל״ו ס״ק ב)). And he reports the Bach for the after-the-fact case: « כתב הב״ח ובדיעבד כדאי הם המתירין בחותם א׳ לסמוך עליהם וע״ל סימן ק״ל ס״ב » ((ש״ך יו״ד קל״ו ס״ק א)). Does one hour in non-Jewish hands count?

Yes, and it is the most counter-intuitive point of the siman. The Shach writes in the name of the Tur: « ושהה אפילו שעה אחת ביד העובד כוכבים צריך הכשר כפי ענין כו׳ טור » ((ש״ך יו״ד קל״ו ס״ק ג)), and he adds Rabbenu Yeruḥam: « וכ״כ ר׳ ירוחם דצריך הכשר אפי׳ לא שהה בידו אלא לפי שעה » ((ש״ך יו״ד קל״ו ס״ק ג)). The reason lies in the Gemara: a wine vessel is a storage vessel, and the decree holds there even for a short while. For the application to your situation, consult your Rav.

And if one forgot to seal?

The Rama answers in two stages: « ואם עבר ושלחם בלא חותם יש להכשירו כפי ענין ההכשר אם היה של עובד כוכבים » (שו״ע יו״ד קל״ו:א) — the vessel must be kashered, according to siman 135 (« ועל הדרך שנתבאר סי׳ קל״ה: » ((ש״ך יו״ד קל״ו ס״ק ד))); but if it has already been used, he does not forbid after the fact. The Taz refuses this second point: « לעיל סי׳ קכ״ב סעיף ט׳ הארכנו דלא קי״ל כן אלא אף בדיעבד אסור » ((ט״ז יו״ד קל״ו ס״ק ב)). For the application to your situation, consult your Rav.

Why do large casks fall outside the rule?

Because the presumption ceases to be plausible: « ואם הם חביות גדולות מותר להשהותן בבית העובד כוכבים אומן יום או יומים לתקנם דבכלי גדול כזה אין רגילים להשתמש בו לפי שעה » (שו״ע יו״ד קל״ו:א). The reason is written in the text itself — one does not fill a container of that size for two days. The Shach, however, sets a limit: « מיהו כתבו יש פוסקים דלכתחלה יש ליזהר בכל מאי דאפשר וכ״כ האחרונים » ((ש״ך יו״ד קל״ו ס״ק ה)). For the application to your situation, consult your Rav.
