Siman 140 — The idolatrous object lost in the mixture

A single seif — the Shulchan Arukh announces it itself: ובו סעיף אחד. An idolatrous object has become mixed with permitted objects and no one knows which one it is. The ordinary rule of mixtures does not apply: an idol forbids in any quantity whatsoever. The siman then states, precisely, the two cases in which the mixture is nonetheless released — and the reservation that goes with them (Shulchan Arukh, Yoreh De'ah 140 — 1 seif)

אלילים ומשמשיה ותקרובתה אוסרים בכל שהוא

Idols, their accessories and their offerings forbid in any quantity whatsoever. Five words, and the whole siman: one does not ask how much permitted matter is needed to nullify the forbidden — one asks when it may be said that it is no longer there.

Why is an idol never nullified in a mixture?

Because the Mishnah lists it among the things that forbid in any quantity whatsoever: « אֵלּוּ אֲסוּרִין, וְאוֹסְרִין בְּכׇל שֶׁהוּ: יֵין נֶסֶךְ, וַעֲבוֹדָה זָרָה, וְעוֹרוֹת לְבוּבִין » (עבודה זרה ע״ד ע״א). The Mechaber writes « אלילים ומשמשיה ותקרובתה אוסרים בכל שהוא שאם נתערב אחר מהם אפי׳ באלף כולן אסורו׳ » (שו״ע יו״ד ק״מ:א), and the Shach adds the ornaments: « ונויה » (ש״ך יו״ד ק״מ ס״ק א). How, then, can a mixture become permitted again?

Not by nullification but by a double doubt: « אבל ספק ספיקא מותר כמו בשאר איסורין » (טור יו״ד ק״מ). The seif gives it two forms — the passage into further mixtures: « ואם א׳ מהתערובו׳ הראשון נתערב בשנים אחרים ונפל מהג׳ אחד לב׳ אחרים הרי אלו האחרים מותרים » (שו״ע יו״ד ק״מ:א); and the object gone from the world: « וכן אם אחד מהתערובות הראשון נפל לים או נשרף בענין שנאבד מהעולם כל הנשארים מותרים ליהנות בהם שנים שנים ביחד אבל לא האחד לבדו ובלבד שלא יהנה אדם אחד מכולם » (שו״ע יו״ד ק״מ:א). Second mixture or third?

The Mechaber permits only the third, and the Shach gives the reason: « ולעיל סימן ק״י ס״ח בדברים החשובים פסק המחבר דלא שרי אלא התערובות הג׳ ולזה אסר גם כאן התערובות השני » (ש״ך יו״ד ק״מ ס״ק ב). But he rejects that stringency: « אבל כבר כתבתי לעיל סימן ק״י ס״ק נ״א דדברי הרמב״ם הם ברורים ואינם סותרים זה את זה כלל ובכאן שרי התערובות השני לכ״ע » (ש״ך יו״ד ק״מ ס״ק ב). The Baer Hetev repeats it: « כ׳ הש״ך דהמחבר לטעמיה אזיל דס״ל בסי׳ ק״י דלא שרי אלא תערובות הג׳ אבל כבר כתבתי שם דבכאן שרי התערובות השני לכ״ע » (באר היטב יו״ד ק״מ ס״ק א). Why “two by two”, and not everything to one person?

Because the presumption remains a presumption. Siman 110 gives the reason: « ודוקא כשאוכל הנשארות שתים שתים ביחד דממה נפשך איכא חדא דהיתרא אבל לאוכלם אחת אחת אסור » (שו״ע יו״ד ק״י:ז) — and the gloss: « ואפילו לאכלם שתים שתים אסור לאדם אחד לאכול את כולם ואפי׳ ב׳ בני אדם אין לאכלם כולם בבת אחת » (שו״ע יו״ד ק״י:ז). The Taz refers there: « זה נתבאר סי׳ ק״י ס״ח גם מה שכתוב כאן שאסור להנות לאחד מכולם נתבאר שם » (ט״ז יו״ד ק״מ ס״ק א). For your own situation, consult your Rav.

One ring fallen into the sea, or two?

The Rambam requires two lost objects: « טַבַּעַת שֶׁל עֲבוֹדַת כּוֹכָבִים שֶׁנִּתְעָרְבָה בְּכַמָּה טַבָּעוֹת וְנָפְלוּ שְׁתַּיִם מֵהֶן לַיָּם הַגָּדוֹל הֻתְּרוּ כֻּלָּן שֶׁאֲנִי אוֹמֵר אוֹתָהּ הַטַּבַּעַת הָיְתָה בִּכְלַל הַשְּׁתַּיִם » (רמב״ם הלכות עבודה זרה וחוקות הגויים פרק ז׳ הלכה י׳). The Beit Yosef shows the source: « משמע שהוא סובר דע״כ לא שרי רב נחמן אלא בנפלו שתים וכדאיתא בגמרא דאמר ר״נ אנא תרתי קאמינא » (בית יוסף יו״ד ק״מ).
