All idolatrous statues found in villages are forbidden, for by default they were made for the idols; those of large cities are permitted, for they were certainly made for ornament. The whole siman lies in this word: what for was this figure made — and, further on, what one may make of it.

Why is a statue found forbidden in a village and permitted in a city?
Because we do not know the intention of its maker, and we presume it from the place. The Mehaber writes « כל הצלמים של עבודת כוכבים הנמצאים בכפרים אסורים דסתמא לשם אלילים נעשו והנמצאים בכרכים מותרים דודאי לנוי נעשו » (שו״ע יו״ד קמ״א:א). Two signs overturn the city’s presumption — the gate and the attribute: « אא״כ עומדין על פתח המדינה… והיה ביד הצורה צורת מקל או צפור או כדור או סייף או עטרה וטבעת » (שו״ע יו״ד קמ״א:א). The Shakh specifies that a real doubt remains forbidden: « ואה״נ בספק אם נעשו לשם אלילים או לנוי אסורים דבעינן דוקא למידע בודאי שנעשו לשם נוי כדקאמר בסיפא » (ש״ך יו״ד קמ״א ס״ק א).
Why is a fragment of an idol permitted, and not a hand on its base?
Seif 2 says « המוצא שברי צלמים מושלכים או בתוך שברי נחושת או אפילו שברי אלילים עצמן מותרים אבל מצא תבנית יד או רגל והוא עומד על בסיסו אסור » (שו״ע יו״ד קמ״א:ב). The fragment proves that its owner rejected it; the hand set on a base looks as if it were made that way, and such limbs are worshipped. The Shakh nevertheless finds the Rambam better grounded: « אבל באמת דברי הרמב״ם נראין עיקר בש״ס דכל שברי אלילים אסורים אפילו אינם עומדים על בסיסם דחיישינן שמא לא בטלום העובדי כוכבי׳ אבל שברי צלמים מותרים דאיכא ספק ספיקא ספק נעבדו או לא ואת״ל נעבדו שמא בטלום העובדי כוכבים » (ש״ך יו״ד קמ״א ס״ק ז).
Is a cup engraved with a sun forbidden?
No: the cup is a lowly vessel, from which one drinks, and on which nobody engraves in order to worship. Seif 3: « אם הכלים מכובדים אסורים שודאי נעשו לשם אלילים ואם הם מבוזים מותרים שלא נעשו אלא לנוי » (שו״ע יו״ד קמ״א:ג). And nowadays the Rama permits even benefit from honoured vessels, without keeping them: « והמנהג כסברא הראשונה ובזמן הזה שאין העובדי כוכבים עובדין לצורות הללו מותרים בהנאה אם מוצאן אבל אין להשהותן » (רמ״א יו״ד קמ״א:ג).
What may a Jew not draw?
Seif 4: « אסור לצייר צורות שבמדור שכינה כגון ד׳ פנים בהדי הדדי וכן צורות שרפים ואופני׳ ומלאכי השרת וכן צורת אדם לבדו כל אלו אסור לעשותם אפילו הם לנוי ואם עובד כוכבים עשאם לו אסור להשהותם » (שו״ע יו״ד קמ״א:ד). The source is the verse לא תעשון אתי, read as “My servants” — the four faces, the angels, the luminaries — and “Me” — the human figure. But sunken, or for study, it is permitted: « ואם הם להתלמד להבין ולהורות כולן מותרות אפי׳ בולטות » (שו״ע יו״ד קמ״א:ד).
May one make a seven-branched Menorah?
Not if it is of metal: seif 8 says « אבל עושה של חמשה קנים או של ששה או שמונה אבל של שבעה לא יעשה אפילו משאר מיני מתכות ואפילו בלא גביעים וכפתורים ופרחים ואפי׳ אינה גבוהה י״ח טפחים » (שו״ע יו״ד קמ״א:ח). The Shakh permits wood and earthenware, invalid in the Temple: « שאע״פ שאינה של זהב כשרה במקדש אבל אינה של מתכות כגון של עץ וכה״ג שרי דפסולה במקדש » (ש״ך יו״ד קמ״א ס״ק ל״ה).
