Siman 139 — Idols, their nullification, their appurtenances and their vessels

The first siman of the laws of idolatry. Four objects — the idol, its appurtenances, its ornaments, its offering —, two owners — the non-Jew and the Jew —, and a single question asked four times: from when is it forbidden, and can it still be nullified? Then the cases: the broken stick and the thrown stick, the locust, what is found inside the curtain, Peor and Markulis, the candles, the wax, the censer, the priests’ garments, the mitzvah lamp, and the books on which one does not write, which one does not sell or bind (Shulchan Arukh, Yoreh De'ah 139 — 15 seifim)

Why is a non-Jew’s idol forbidden as soon as it is made, and a Jew’s only once it has been worshipped?

Because two distinct verses say so, and the Taz refuses to let anyone look for the reason: « דכתיב פסילי אלהיהם תשרפון באש משפסלו נעשה להם אלוה אבל בשל ישראל כתיב ושם בסתר אינו חייב עד שישים דברים שבסתר » (ט״ז יו״ד קל״ט ס״ק א). He draws a consequence for the apostate: « ודבר פשוט נ״ל דאפי׳ ישראל מומר לעבודת כוכבי׳ נקרא ישראל ודינו עד שיעבוד דאע״פ שחטא ישראל הוא » (ט״ז יו״ד קל״ט ס״ק א). What separates an ornament (נוי) from an offering (תקרובת), and why does it matter?

The ornament beautifies the idol, the offering is presented to it as in the Temple: « נוי כגון שמדליק לפניה נרות או שטח לפניה בגדי׳ וכלים נאים לנוי ותקרובת כל שכיוצא בו קרב על גבי מזבח כמו כל מיני מאכל » (שו״ע יו״ד קל״ט:ג). The difference is decisive in seif 2: the ornament of a non-Jew’s idol can be nullified, the offering never — « ותקרובתה אין לה ביטול » (שו״ע יו״ד קל״ט:ב). What does « חייב ולא נאסר », which recurs three times in seif 3, mean?

That the one who performed the act is liable, but the object remains permitted. The Taz reports the Ran’s key: « לענין חיובא חדא מתרתי מחייב או כעין פנים ונפקא לן מזובח לאלהים יחרם או כדרך עבודתה ונפקא לן מאיכה יעבדו אבל לגבי איסור תקרובת לעולם אינו חייב אלא כעין פנים דנפקא מאשר חלב זבחימו » (ט״ז יו״ד קל״ט ס״ק ז). Are candles sold by an idol’s priest to a Jew permitted?

The Mehaber permits them, on a condition he states himself: « נרות של שעוה שמדליקין לפניה נויה הם ואסורים ואם משכנם או מכרן לישראל מותרים דכיון שכיבן לצורך עצמו זהו ביטולן » (שו״ע יו״ד קל״ט:ט). The Shakh notes that seif 12 rules the general case differently, and leaves it in צ״ע; the Bach, as reported by the Shakh, adds that according to the Rambam anything coming from inside the place of worship is suspect of being an offering — « וכל בעל נפש יש לו להחמיר » (ש״ך יו״ד קל״ט ס״ק ג). May one sell or bind idolatrous books, or write on their erased pages?

The siman distinguishes three acts. Writing: only after complete erasure, and according to some never prayers — « דאין קטיגור נעשה סניגור » (שו״ע יו״ד קל״ט:יד). Selling: the Mehaber reports the permissive view, the Rama the views that forbid, and concludes « והמחמיר תבא עליו ברכה » (שו״ע יו״ד קל״ט:טו). Binding: « ואין לקשור ספרי עובדי כוכבים חוץ מספרי הדיינים והסופרים ואם חשש משום איבה כל מה שיכול להשמט ישמט » (שו״ע יו״ד קל״ט:טו). For the application to your own situation, consult your Rav.
