Four seifim, and an idea one does not expect from a tractate of vows: here, the vow serves to protect study. A father forbids himself his son’s service so that the son is not constantly disturbed. Then come three questions of property — the vow that outlives the dead, the estate suspended on a condition, and what a forbidden heir may do with property he has no right to touch.

1. The principle of the siman

One must begin by setting aside a false reading, because it comes naturally to mind: this siman is not about a father punishing his son. In the first seif it is the father who deprives himself, and he does so that his son may study without being interrupted by the thousand small services a son renders his father. The vow is here a tool of discipline — but the discipline of the man who utters it.

And yet the seif permits three services: filling a jar, lighting the lamp, roasting a small fish. Why? Because a vow is read according to what the man meant, and we presume he did not aim at trifles. The Shakh says it in a formula worth remembering: The criterion is not “is it a service?” but “does it take away study time?”.

The three following seifim leave study for property, and they form a progression. Seif ב asks how long a vow reaches — the father’s death extinguishes it, unless he expressly prolonged it. Seif ג takes an extreme case, drawn from a story in the gemara: a grandfather wants his property to skip a generation and reach his grandson only if the latter becomes a man of learning. And seif ד takes the case downstream: the vow took hold, the inheritance is here, the heir cannot use it — what is to be done with this property?

The four seifim in one sentence each. (א) The father forbade himself his son’s service to protect his study; trifles remain permitted. (ב) The vow dies with the father, unless he said “in my lifetime and after my death”. (ג) The grandfather suspends his estate on his grandson becoming a man of learning. (ד) The forbidden heir may pass the property to his brothers or his sons, or let it serve his debts — saying where it comes from.

2. The text of the Shulḥan Arukh

The four seifim, in full and in order, each followed by its breakdown.

Seif א — the vow that protects study, and the three services that remain permitted

The seif describes a case that runs against what one imagines a vow to be. The father is not punishing his son: he is depriving himself, and he does it for his son. But he did not deprive himself of everything, and the seif says exactly of what.

One who forbids himself the benefit of his son, so that the son not be diverted from his study on his account —
Everything hangs on המדיר עצמו: it is the father who is the נאסר. The motive is written into the text itself — כדי שלא יתבטל הבן מלימודו. The vow is an instrument for protecting study, not a punishment.
The siman opens with a decision of reading. The gemara (נדרים ל״ח ע״ב) says only המדיר בנו לתלמוד תורה, which can be taken either way: the father who forbids himself his son, or the father who forbids his son. The Shulḥan Arukh adopts the first reading, that of the Ramban and the Rosh. The Rambam adopts the other. Level 2 returns to it at length.
the son is permitted to fill him a jar of water, to light his lamp and to roast him a small fish.
Three services, and all of them tiny. The Shakh gives the reason: we presume the father did not mean to forbid himself מילי זוטרי, trifles that involve no real loss of study time.
And likewise it is permitted to buy for him in the market what he needs, if he is a man who is not in the habit of buying for himself, or if it is a woman who imposed the vow on her son.
The reasoning changes: it is no longer the smallness of the service but practical impossibility. The Shakh speaks of an אנן סהדי — we all testify that this is not what they had in mind. The Beit Yosef specifies, in the name of the Yerushalmi, that a man who is in the habit of buying in the market is indeed included in the vow.
Remember. The father forbade himself his son’s service in order to protect the son’s study; we presume he did not aim at trifles, nor at what he is in any case unable to do for himself.

Seif ב — the vow that stops at death, and the one that crosses it

Here the father does forbid his son, and the question is one of inheritance. Two formulations, and two opposite results — the difference lying in seven words the father did or did not add.

One who says to his son: “behold you are forbidden my benefit”, or who swore that he shall not benefit from him — if the father dies, the son inherits him.
The reason, which the Rambam gives: this formula is equivalent to “my property is forbidden to you” — and at the father’s death it is no longer “his” property. The vow falls with the ownership it fastened on.
If he forbade him his benefit and specified “both in my lifetime and after my death” — if the father dies, he does not inherit him.
The Rambam explains this one too: it is then as if he had said “these properties are forbidden to you”, designating them rather than tying them to his person. The gemara derives a principle from this: a man can forbid a thing in his possession for the time when it leaves his possession.
The Shulḥan Arukh adds here a cross-reference, which the edition prints in small type: « (וע״ל סי׳ רט״ז) » (שו״ע יו״ד רכ״ג:ב) — “and see above siman 216”. That is the siman of formulas and what they carry with them.
Remember. “You are forbidden my benefit” dies with the father; “in my lifetime and after my death” outlives him and cuts off the inheritance. Seven words.

Seif ג — the estate suspended on the grandson becoming a talmid ḥakham

The case comes from a story in the gemara: a man whose son used to steal bundles of flax forbade him his property; he was asked what would be if his grandson turned out to be a man of learning. His answer is this seif.

He forbade his son his benefit and said: if this grandson of mine becomes a talmid ḥakham, let this son of mine acquire my property in order to convey it to him —
The legal difficulty lies entirely here: the grandson is not yet born, or at any rate is not yet a man of learning. He cannot be conveyed to directly. So the grandfather goes through his son — the very man to whom he forbade everything.
that son is forbidden in the father’s property,
The vow holds: the son may acquire, but he cannot benefit.
and the son of the son is permitted in it if he becomes a talmid ḥakham as he stipulated.
The word מותר is the knot of the whole seif, and it is read in three different ways among the Rishonim. Level 2 sets them out.
Remember. The son remains forbidden; the grandson is permitted on the stated condition. The whole discussion turns on what that “permitted” means, and on what happens if the condition is not met.

Seif ד — what the forbidden heir may do with what he may not touch

The last seif takes the situation downstream: the vow has taken hold, the inheritance has arrived, and the heir cannot use it. What is to be done with this property? The seif gives three routes, and imposes a duty to inform.

This son, who is forbidden in his father’s inheritance —
if he gave his father’s inheritance to his brothers or to his sons, it is permitted,
The Ran at once warns against reading this at face value: actually giving would yield him a טובת הנאה, the moral benefit of being the giver. His reading — מראה להם מקום, he shows them the place — is one of the positions in the debate, and the Beit Yosef holds another.
and likewise if he paid them for his debt or for his wife’s ketuba,
This is the clause that made the Tur baulk: how can one discharge one’s debt with property one has no right to benefit from? The Beit Yosef answers that the mishna in בבא קמא says so expressly. The Taz defends the Tur’s question.
and he must inform them that these are his father’s property, which he forbade him.
The Tur also asks what purpose this information serves. The Ran answers: it turns the act into a kind of abandonment — “I do not know what to do with these, take them for yourselves”. The information is not a courtesy; it is what strips the act of its character as a gift.
Remember. The forbidden heir may pass the property to his brothers or his sons, or let it serve his debts — and he must say where it comes from. Exactly how this is done, and whether it is permitted from the outset or only after the fact, occupies the whole apparatus.

3. The vocabulary of the siman

מילי זוטרי — “small matters”. It is the Shakh’s word for the three services of seif א: they are too slight for us to suppose the father aimed at them.
ביטול תורה — the interruption of study. It is the measure of the whole first seif: a service is permitted so far as it costs no study time.
אנן סהדי — “we are all witnesses”. A presumption so strong it counts as testimony. The Shakh uses it for the market purchase: no one can believe that a man incapable of going to market meant to deprive himself of it.
קני על מנת להקנות — “acquire in order to convey”. The mechanism of seif ג: an intermediary receives property for the sole purpose of passing it on. Rav Naḥman holds that it works, and his proof is the סודר, the cloth of the kinyan.
טובת הנאה — the moral benefit of being the one who gives: gratitude, social advantage. The Ran uses it in seif ד to refuse that the forbidden heir give the property himself.
מראה להם מקום — “he shows them the place”. The Ran’s solution: the heir does not give, he points out the existence of the property and withdraws — “I do not know what to do with this, take it”.

4. The sources — gemara, Rambam, Tur, Beit Yosef

The gemara — נדרים ל״ח ע״ב, for seif א

Two amoraim, two lines, and the whole of the first seif. Rabbi Yaakov gives two services, Rabbi Yitsḥak adds a third. Note that the gemara does not say which of the two, father or son, renders the service: that is precisely what the Rishonim will have to decide.

The gemara — נדרים מ״ז ע״א, for seif ב

Avimi raises a question of principle — can a man forbid a thing for the time when it will cease to be his? — and Rava resolves it with our case, which is a mishna. So seif ב answers a question wider than itself.

The gemara — נדרים מ״ח ע״ב, for seif ג

The story, then the debate. The sages of Pumbedita reject the mechanism, Rav Naḥman validates it by means of the סודר, and Rav Ashi objects twice — one of which objections, according to the Rosh and the Ran, suffices to make the operation fail.

The mishna — בבא קמא ק״ח ע״ב and ק״ט ע״א, for seif ד

This is the mishna the Beit Yosef sets against the Tur’s question: it says expressly that one returns to the sons or the brothers, and that creditors come and are paid. The gemara there adds a duty to inform very like ours — וצריך שיאמר זה גזל אבי.

The Rambam — הלכות נדרים, chapters ה׳ and ו׳

The Rambam covers all four seifim, and his text on the first matters because he takes the other reading: for him, it is the father who imposed the vow on the son because the son does not occupy himself with Torah, and it is the father who is permitted to render the three services.

The Tur and the Beit Yosef

The Tur is especially valuable here, because he lays out both readings of the first case side by side and says which one his father the Rosh adopted. And he does not refrain from saying, twice, that he does not understand the Rambam. The Beit Yosef answers each time.

The parallel in חושן משפט

Both commentators refer to חושן משפט for an exactly parallel matter: the man who robbed his father and must be rid of the proceeds. The Shakh gives the precise reference — סימן שס״ז ס״ה — and the text there is indeed the counterpart of ours. summary: the Shulḥan Arukh writes there that if the stolen property survives, the thief must get it out of his hands and give it to his brothers, settling accounts with them; that if he has no brothers he gives it to his sons; and failing sons, to his creditor or to charity — and that he must inform them, saying that this is his father’s theft. One recognises, point for point, the Maharshal’s order and the duty to inform of our seif ד. The text itself is not quoted here: our citation checker does not yet resolve references to חושן משפט, and we prefer not to produce a Hebrew citation it could not confront with its source. Reference: Shulḥan Arukh, Ḥoshen Mishpat siman 367 seif 5.

5. The apparatus, entry by entry

This siman carries fourteen entries: five of the Shakh, five of the Taz, three of the Ba’er Hetev and one of the Nekudot HaKesef. All are quoted below. Three of them are long — the Shakh’s ס״ק ד, the Taz’s ס״ק ג and ה — and they are divided into successive blocks covering them entirely, each under the same ס״ק reference.

The Shakh — five entries

One per seif, except seif ד which receives two. The fourth is the longest of the siman and reports three successive positions.

ס״ק א — “ מותר הבן ” — trifles, not supposed to be aimed at

ס״ק ב — “ וכן מותר ” — the אנן סהדי of the market

ס״ק ג — “ ובן הבן מותר ” — three readings of a single word

ס״ק ד — “ אם נתן ” — the Ran, the Beit Yosef, the Maharshal and the Drisha, in four blocks

ס״ק ה — “ אם פרעם ” — which debt is meant?

The Taz — five entries

The third and the fifth are real expositions; the fifth carries the anchor of the Nekudot HaKesef in its middle.

ס״ק א — “ חבית של ימים ” — great tasks were meant, not small ones

Rashi and the Perisha on the mechanism

ס״ק ג — “ ובן הבן מותר בהם אם יהיה ת״ח ” — why the Rambam forbids the grandson who does not study

ס״ק ד — “ לאחיו או לבנו ” — who are these brothers and sons?

ס״ק ה — “ וכן אם פרעם ” — the Taz defends the Tur’s question, in four blocks

The Ba’er Hetev — three entries

Three summaries, the last holding in one sentence the Shakh’s two entries on seif ד.

ס״ק א — “ למלאות ” — the Shakh in brief

ס״ק ב — “ ת״ח ” — and if the grandson does not study

ס״ק ג — “ נתן ” — בדיעבד only, and which debt

The Nekudot HaKesef — one entry

Nine words, and they are devastating: the fine answer the Taz advances as his own had already been given by the Drisha and the Ba’ḥ.

Entry א — On the Taz’s ס״ק ה — “said before him”

One work with no entry on this siman

The Pitḥei Teshuva has no entry on this siman. The Pitḥei Teshuva surveys later responsa; his silence means only that modern questions have not fallen on this matter, where practice is rare. He is read at the neighbouring siman 224, at siman 225 — where his entry is the most interesting of the three — and abundantly at siman 228. No entry has been manufactured here.

6. Table — each clause and its meaning

The four seifim, clause by clause, in the order of the book.

SeifTextMeaning
One who forbids himself the benefit of his son, so that the son not be diverted from his study on his account —
א « מותר הבן למלאות לו חבית של מים ולהדליק לו את הנר ולצלות לו דג קטן » (שו״ע יו״ד רכ״ג:א) the son is permitted to fill him a jar of water, to light his lamp and to roast him a small fish.
א « וכן מותר לקנות לו מהשוק מה שצריך אם הוא אדם שאין דרכו לקנות בעצמו או אם היא אשה שהדירה את בנה: » (שו״ע יו״ד רכ״ג:א) And likewise it is permitted to buy for him in the market what he needs, if he is a man who is not in the habit of buying for himself, or if it is a woman who imposed the vow on her son.
ב « האומר לבנו הרי אתה אסור בהנאתי או שנשבע שלא יהנה בו אם מת יירשנו » (שו״ע יו״ד רכ״ג:ב) One who says to his son: “behold you are forbidden my benefit”, or who swore that he shall not benefit from him — if the father dies, the son inherits him.
» (שו״ע יו״ד רכ״ג:ב) If he forbade him his benefit and specified “both in my lifetime and after my death” — if the father dies, he does not inherit him.
ג « אסר בנו מהנאתו ואמר אם יהיה בן בני זה תלמיד חכם יקנה בני זה נכסי כדי להקנותם לבנו » (שו״ע יו״ד רכ״ג:ג) He forbade his son his benefit and said: if this grandson of mine becomes a talmid ḥakham, let this son of mine acquire my property in order to convey it to him —
ג « הרי זה הבן אסור בנכסי האב » (שו״ע יו״ד רכ״ג:ג) that son is forbidden in the father’s property,
ג « ובן הבן מותר בהם אם יהיה תלמיד חכם כמו שהתנה: » (שו״ע יו״ד רכ״ג:ג) and the son of the son is permitted in it if he becomes a talmid ḥakham as he stipulated.
This son, who is forbidden in his father’s inheritance —
ד « אם נתן ירושת אביו לאחיו או לבנו הרי זה מותר » (שו״ע יו״ד רכ״ג:ד) if he gave his father’s inheritance to his brothers or to his sons, it is permitted,
ד « וכן אם פרעם בחובו או בכתובת אשתו » (שו״ע יו״ד רכ״ג:ד) and likewise if he paid them for his debt or for his wife’s ketuba,
ד « וצריך להודיעם שאלו נכסי אביו שאסרם עליו: » (שו״ע יו״ד רכ״ג:ד) and he must inform them that these are his father’s property, which he forbade him.

7. Practical cases

Four situations, and in each the question of what the vow really aimed at.

A father wants his son to study undisturbed

This is the case of seif א, and it is commoner than one thinks in other forms. But uttering a vow to obtain an educational result is a grave step: once made, the vow holds, and a התרת נדרים will be needed to undo it. The seif describes what happens if it was done; it does not advise doing it.

Is the service “small”?

The Shakh’s measure is explicit: things that do not involve so much interruption of study. So it is not absolute duration but the relation to study. And note: according to the Shakh and the Taz, if the vow were of the other kind — the father forbidding his son because he does not study — even these small things would be forbidden.

A conditional will

Seif ג is not a case of an ordinary will — it is a vow combined with a mechanism of acquisition. A modern conditional bequest belongs to the law of succession far more than to our siman; but the underlying question the seif poses remains the same: at what moment does the acquisition occur, and what is then left to convey?

An heir who cannot touch his inheritance

This is seif ד, and it is the case most likely to arise. Three things to know before doing anything: the Ran holds that the heir does not give himself but shows the place; the Beit Yosef and the Maharshal allow an actual gift to the father’s heirs; and the Prisha and the Ba’ḥ hold that all this is permitted only after the fact, not from the outset. A real case goes to a Rav before any step is taken.

8. Comprehension questions

  1. In seif א, who is the נאסר: the father or the son? By what word of the text can one tell?
  2. Why are the three services permitted? Give the Shakh’s reason in his own terms.
  3. Why is buying in the market permitted only for certain people? And to whom is it forbidden, according to the Beit Yosef?
  4. Which formula, in seif ב, makes the vow outlive the father’s death? And what reason does the Rambam give for the other case?
  5. In seif ג, what exactly does it mean that the grandson is “מותר”? How many readings does the Shakh report?
  6. The Tur writes that he does not understand the Rambam in seif ד. What is his objection, and what does the Beit Yosef answer?
  7. What purpose does the duty to inform serve in seif ד? Give the Ran’s answer.
  8. What do the Nekudot HaKesef say, and to whom are they addressed?

To go further

This siman itself refers to siman 216, on what formulas carry with them, and the Shakh refers to siman 221 for the payment of a debt. Continue then with siman 224, which takes two men at random, and siman 225, where everything turns on one word. To undo a vow that has taken hold, see siman 228.
