Yoreh De'ah — Nedarim

Siman 221 — the vow that forbids benefit from another

Fourteen seifim, and a single question asked fourteen times: what can a vow take away from a man? The mishna says it in a word — even the indulgence no one charges for is forbidden — and the siman draws from it the right of way across a field. Then it opens three breaches: the debt one settles is only an indirect effect, the household one feeds is a benefit that comes of itself, the mitzva one performs was not given for benefit. The rest is civil law — the תפיסת יד in a leased asset, the tenant’s שעבוד that a קונם cannot displace, the shopkeeper who is no agent so long as nothing is owed him, and the gift the circumstances belie. (Shulḥan Arukh, Yoreh De’ah 221 — 14 seifim)

Reuven who forbade his property to Shimon, or who forbade himself Shimon’s property — the one bound may not walk across the other’s field. The siman opens on the two directions of the vow, and on its least expected consequence: a mere right of way.

The fourteen seifim in Hebrew, with fluent translation and a clause-by-clause breakdown: the four formulas of seif 1, the debt and the household, the sick man and the standing posture, the shared bed and bath, the תפיסת יד, the קונם against the שעבוד, the shopkeeper and the labourers, the belied gift, the flame, the slaughter, the shofar and the lulav. The hundred and sixty apparatus entries — Shakh, Taz, Ba’er Hetev, Pitḥei Teshuva, Nekudot HaKesef — cited one by one.

A synthesis arranged by mechanism rather than by number: what the vow reaches, what it does not, the measure of the fee, what passes through a third party, the estate and its transfer, and the mitzva. Note: the Admur HaZaken did not write a Shulḥan Arukh on Yoreh De’ah — a level of psak, not “Daat HaRav”.

Frequently asked questions — Siman 221

What is a vow forbidding benefit, and how far does it reach?

The siman opens on the two possible directions, then on a consequence no one expects:

Crossing an open field in the dry season, where no one minds: that is what the vow forbids. The reason is in the gemara — even the customary indulgence, ויתור, is a benefit. For your own situation, consult your Rav.

May I pay the debt of someone who forbade himself benefit from me?

Seif 2 permits it, and it is one of the most used permissions in the siman:

But the Shakh adds two conditions the text does not write:
without the debtor’s knowledge, and — per the Ba’h he cites — not where the debt carries a deed or a pledge. Two conditions absent from the text: ask your Rav.

Why may one feed his wife and children but not his beast?

Seif 2 makes exactly that division:

And the Shakh gives the two reasons:
The household is a benefit that comes of itself; the beast is fattened, and its value rises. That is a full benefit.

May I route help through a third party?

That is the whole of seif 8, and its device is ingenious:

Everything hangs on the parenthesis: he is not obliged to pay him. The Shakh gives the reason in a line:
And the seif marks the boundary at once: promising to the crowd is permitted, commanding is forbidden, and addressing a single man is forbidden. Ask your Rav.

May I perform a service that is normally paid for — slaughtering a beast, say?

This is the sharpest maḥloket in the siman, and it is open. The Rama permits:

The Shakh gives the reason — he spoils the beast more than he improves it:
But the Taz refuses, in very firm terms:
The Nekudot HaKesef refute him point by point, and the Pitḥei Teshuva brings from the Peni Aryeh a middle way hedged with conditions. Do not decide from memory: ask your Rav.
