A siman of a single seif, with no heading, holding in seven words what the Tur unfolds over a column: oaths and vows are released, even one sworn on the Name. The Rama adds three limits — and the last of them moves the siman from the law of vows to the law of property.

Plan of study

1. The principle — and two notes on the edition
2. The text of the Shulḥan Arukh, clause by clause
3. The vocabulary:
4. Where it comes from: נדרים כ״ב ע״ב, the Rambam, the Tur
5. The apparatus, entry by entry — and one absence
6. The revision table
7. Three real situations
8. Check yourself

1. The principle — and two notes on the edition

First note, before anything else: this siman carries no heading at all. Where its neighbours open with a formula of the shape דין … סעיפים, this one begins straight away with “ ובו סעיף אחד: ” (שו״ע יו״ד ר״ל:א). The English title of these pages is our own wording: it describes the seif, it does not reproduce a heading of the Shulḥan Arukh, because there is none. Siman 225 is in the same case.

Second note. The text carries, in square brackets and preceded by an asterisk, an editorial gloss: “ פי׳ שאדם עושה בינו לבין עצמו ” (שו״ע יו״ד ר״ל:א) — “that is, what a man makes between himself and himself”. It is not the Meḥaber’s hand: it is a printer’s clarification, restricting the sentence to vows a man takes upon himself, as opposed to oaths he imposes on another. We copy it exactly as printed, neither removing it nor merging it into the text.

The siman in one sentence. Oaths and vows are released — even one sworn with mention of the Name. The Rama then sets three limits: not a priori, only under pressure; never where the release carries a trace of transgression; and an opinion which, in civil law, draws from the breach of an oath the annulment of the act itself.

2. The text of the Shulḥan Arukh

The siman has a single seif. Here it is in full, with its opening line exactly as the edition gives it — without a heading — and then clause by clause.

Single seif — what is released, and on what conditions

One releases oaths and vows
The verb is the present of practice: one releases. This is neither a theoretical permission nor a favour: it is what the court does. Note the order of the words — שבועות before נדרים. It was the oath that raised the difficulty, not the vow; so the Shulḥan Arukh opens with the harder case.
even if he swore with mention of the Name
Here is the hard case. An oath sworn “by the God of Israel” remains releasable. The Shulḥan Arukh at once adds its warrant: “ כן נהגו על פי ש״ס ופוסקים עיין בית יוסף ” (שו״ע יו״ד ר״ל:א) — such is the practice, grounded in the Talmud and the decisors. That parenthesis is not ornamental: it answers Geonim who held the opposite (see section 4).
And nevertheless one should not ask [for release] a priori, but only under pressure; and see above siman 203.
The Rama does not dispute the power: he regulates its use. מדוחק — under pressure. The Shakh will widen it by a single case: “ או לצורך מצוה כן הוא בריב״ש בשם הרמב״ן שמביא בית יוסף ס״ס זה והוא פשוט ” (ש״ך יו״ד ר״ל ס״ק ב) — “or for the need of a mitzvah”.
Any vow whose release carries a trace of transgression is not to be released.
נדנוד עבירה — literally the tremor of a sin. The Shakh points to where the rule is developed: “ נדנוד עבירה כו׳.
Some say: whoever swore not to do a thing — for instance, swore not to sell a certain object — and transgressed and sold it: his sale is nothing, since he transgressed his oath.
Here the siman changes ground: it moves from the law of vows to the law of property. The question is no longer “does the oath hold?” but “does the sale hold?”. That is what the four apparatus entries argue over, and they do not all pull the same way — see section 5.

3. The vocabulary of the siman

התרת נדרים — the release of a vow. It is not an annulment going forward: the sage uproots the vow from its origin, by establishing that the man would not have uttered it had he known. Hence it requires real regret, not a formality.
הזכרת השם — mention of the Name. An oath may be sworn without naming God, by a כינוי or on a sacred object; naming Him is the gravest degree. Our seif says that even that degree is released.
מדוחק — under pressure, in straits. The Rama’s word, which separates the power to release, which is entire, from its use, which must remain exceptional.
נדנוד עבירה — the shadow, the tremor of a transgression. A vow that guarded a man from a fault is not released merely because it weighs on him: one does not reopen through the door of release what it was good to have closed.
אי עביד לא מהני — “if he did it, it does not take effect”. A talmudic principle argued in the first chapter of תמורה: is an act done against the word of the Torah also void? The Taz names that sugya as the reason behind the opinion the Rama reports.

4. The sources — Gemara, Rambam, Tur

The Gemara —

There the decisive rule is given as a הלכתא, a settled conclusion:

“The halakha: one opens with regret, and one takes up the [oath sworn by the] God of Israel.” The second half is exactly our seif: the most solemn oath still answers to the sage.

The Rambam —

The Rambam puts the two cases on one footing — in private or in public — then adds the hard case, word for word that of our seif. Note his defective spelling, ואפלו and המיחד: we copy it as it stands.

The Tur — why this siman runs to one line where the Tur runs to a column

The Tur devotes a whole discussion to this siman, because in his day the matter was not settled. He first reports the Rif, who restricts sharply:

Then Rav Hai Gaon, more restrictive still:

And finally the Rosh, the author’s father, who rules against these positions:

“And I said to release for them vows and oaths.” The Tur’s whole column resolves into that sentence — and it is that sentence the Shulḥan Arukh compressed into seven words, with the warrant “ כן נהגו על פי ש״ס ופוסקים עיין בית יוסף ” (שו״ע יו״ד ר״ל:א). The siman is short because the controversy is closed, not because it never happened.

5. The apparatus, entry by entry

This siman carries nine entries: four of the Shakh, one of the Taz, two of the Ba’er Hetev, two of the Pitḥei Teshuva. Each is quoted below with its reference.

The Shakh — four entries

The Shakh reports a responsum of the Maharam Mintz: when he releases for people who take vows lightly, he imposes something on them.

The reason is given without circumlocution: “for he says — what do I care? I shall swear whatever I wish, I shall go to a sage and he will release me.” The remedy is not to refuse the release; it is to give it a price. And the Shakh concludes: “and so it is right to do”.

ס״ק ג — a bare cross-reference, but one worth following:

ס״ק ד — on the Rama’s closing opinion. The Shakh sets four decisors against one another:

And he supports the Baḥ from a responsum of the Rosh, which distinguishes two kinds of act:

The distinction is fine and it carries the whole debate: where the act cannot be undone, אי עביד לא מהני; where it can — a takana, a ḥerem — the Rosh grants that it does take effect. A sale is of the second kind.

The Taz — one entry

ס״ק א — on the Rama’s opinion, whose reason he gives and then sets aside:

The Taz does not argue with the logic: he observes that in Ḥoshen Mishpat 208 and here at siman 228:35 the halakha was not fixed that way. It is an argument from where the law stands, not from reasoning — and it is exactly the argument the Shakh will turn the other way.

The Ba’er Hetev — two entries

ס״ק א reports the Maharam Mintz after the Shakh:

ס״ק ב condenses the Ḥoshen Mishpat debate:

A point to flag. The Shakh writes “ ובח״מ סי׳ ר״ח כתב הרב בסתם דמכירתו מכירה ” (ש״ך יו״ד ר״ל ס״ק ד) — Ḥoshen Mishpat 208 — while the Ba’er Hetev, condensing him, writes “ ובח״מ סי׳ ר״א כתב הר״ב בסתם דמכירתו מכירה ובסמ״ע פסק שם כהי״א דהכא ” (באר היטב יו״ד ר״ל ס״ק ב), that is Ḥoshen Mishpat 201. The Taz too names siman 208. We copy both exactly as printed and correct nothing.

The Pitḥei Teshuva — two entries

ס״ק א, on “ שלא למכור ” (רמ״א יו״ד ר״ל:א), brings the Noda BiYehuda’s distinction:

In other words: if the oath forbade the sale itself, the act could not come into being except in transgression. But if it forbade only selling without so-and-so’s knowledge, the sale could perfectly well have been done permissibly; the transgression accompanies the act, it does not constitute it — “and this resembles one who slaughters on Shabbat”, whose sheḥita is valid though the act is forbidden.

ס״ק ב points to the responsa literature:

One work with no entry on this siman

The Nekudot HaKesef have no entry here. That is to be expected: they are the Shakh’s reply to the Taz, and the Taz writes only one line here, which the Shakh does not contest head-on. They are found in force close by — four entries at siman 229, four at siman 232. Not one entry has been manufactured here to fill a column.

6. Table — each clause and its sense

AuthorTextSense
Meḥaber “ מתירין שבועות ונדרים ” (שו״ע יו״ד ר״ל:א) The power to release exists, for oaths as for vows.
Meḥaber “ אפילו נשבע בהזכרת השם ” (שו״ע יו״ד ר״ל:א) It extends to the gravest case: an oath sworn on the Name.
Rama “ ומ״מ לא ישאל עליו לכתחלה אלא מדוחק ועיין לעיל סימן ר״ג ” (רמ״א יו״ד ר״ל:א) The power is entire; its use is reserved for pressing need.
Rama “ כל נדר שיש בהתרתו נדנוד עבירה אין להתירו ” (רמ״א יו״ד ר״ל:א) A substantive limit: release must not reopen a transgression.
Rama “ י״א כל מי שנשבע שלא לעשות איזה דבר כגון שנשבע שלא למכור חפץ פלוני ועבר ומכרו אין במכירתו כלום הואיל ועבר על שבועתו ” (רמ״א יו״ד ר״ל:א) An opinion (י״א) voiding, in property law, an act done in breach of an oath.
Shakh “ אבל הב״ח שם פסק דספיקא דדינא הוי והמע״ה וכן עיקר ” (ש״ך יו״ד ר״ל ס״ק ד) In practice, a doubt in law: the claimant bears the burden of proof.

7. Practical cases

A man swore “by the God of Israel” never to speak to his brother again

The oath is releasable: that is precisely what our seif says. But two questions come before the release — is there דוחק, and is peace between brothers here a צורך מצוה in the Shakh’s sense at ס״ק ב? In this very case the two meet, and it is the textbook instance. The step is taken before a Rav, not alone.

A man vowed to stop smoking and asks to be released

This is the case of נדנוד עבירה. The vow guarded him from something better left undone; releasing it so as to return to it reopens what the vow had closed. The Rama says not to release it, and the Shakh at ס״ק ג refers to siman 228:15 where the rule is developed. A question for a Rav, who will weigh the particular case.

A man had sworn not to sell his father’s flat, and sold it

Two distinct questions, and they must not be run together. Did he transgress? Beyond argument, yes. Does the sale hold? That is the debate of section 5, and it is not settled one way: the Shakh concludes “ אבל הב״ח שם פסק דספיקא דדינא הוי והמע״ה וכן עיקר ” (ש״ך יו״ד ר״ל ס״ק ד) — a doubt in law, so whoever would take the money out of the other’s hands must prove his claim. This is a matter for a beit din, not for private conscience.

8. Questions for review

  1. Why does the Shulḥan Arukh write “שבועות” before “נדרים”, against the usual order?
  2. What is the bracketed gloss, and why have we not merged it into the text?
  3. The Rama says “לא ישאל עליו לכתחלה”. Does this contradict the Meḥaber? State the difference in one sentence.
  4. What word does the Shakh add to “מדוחק”, and on whose authority?
  5. The Rosh, in the responsum quoted by the Shakh at ס״ק ד, distinguishes two kinds of act. Which, and on which side does a sale fall?
  6. The Noda BiYehuda distinguishes two forms of oath about a sale. Find them, and say which leaves the sale valid.
  7. The Nekudot HaKesef write nothing here. What may be concluded from that — and what may not?

Going further

The mechanism of release itself — פתח, חרטה, מומחה, three הדיוטות — is at siman 228. What happens when a vow has been released only in part is at siman 229. Who may release, and why a self-annulment condition is worth nothing, is at siman 231.
