This siman teaches the mention of the rain in the Amida: we begin משיב הרוח ומוריד הגשם at Moussaf of שמיני עצרת and do not stop until Moussaf of the 1st day of פסח; it is forbidden to mention before the הכרזת ש״ץ; one who said גשם בימות החמה — מחזירין — or omitted it בימות הגשמים; where he returns; and the doubt cases (חזקת ל׳ יום). Our Sages taught (ברכות ל״ג. · תענית ב׳.): מַזְכִּירִין גְּבוּרוֹת גְּשָׁמִים בִּתְחִיַּת הַמֵּתִים — we mention the power of the rains in the berakha of תחיית המתים (the second of the Amida). This is not yet the request (שאלה) for rain but a praise (הזכרה), for « the rains are compared to the resurrection of the dead ». The siman fixes when we say it, how it is instituted, and what one who errs must do. We study here at the level of principle; for personal conduct, one refers to the custom and to the ruling of the Rav.

A. Mentioning the rain — the ט׳ seifim
הַזְכָּרָה — the mention (מוריד הגשם / מוריד הטל, in the 2nd berakha מחיה המתים) is a praise of the divine power ; it must not be confused with the שְׁאֵלָה — the request (ותן טל ומטר, in ברכת השנים, treated in sim. קי״ז). Winter (ימות הגשמים) runs from Chemini Atseret to Pessah ; summer (ימות החמה) is the rest of the year. Since rain out of season is a סימן קללה, mentioning it in summer makes one repeat ; omitting it in winter does too — unless it is offset by the טל.
Séif 1 — The start and the end of the mention
מתחילין לומר בברכה שנייה משיב הרוח ומוריד הגשם בתפלת מוסף של יום טוב האחרון של חג, ואין פוסקין עד תפלת מוסף של יום טוב הראשון של פסח.
Séif 1: we begin to say, in the second berakha (מחיה המתים), « משיב הרוח ומוריד הגשם » at the Amida of Moussaf of the last day of the Hag (Chemini Atseret), and do not stop until the Amida of Moussaf of the first day of Pessah.
The mention brackets the winter (ימות הגשמים) exactly: it begins at מוסף of Chemini Atseret (not in the evening, when not everyone is in the synagogue) and stops at מוסף of the 1st day of Pessah. It is set at Moussaf so the whole community begins together and does not split into אגודות אגודות.
Séif 2 — One mentions only after the chazzan's הכרזה
אסור להזכיר הגשם עד שיכריז ש״ץ (ויש אומרים שקודם שמתחילין מוסף מכריז השמש משיב הרוח וכו׳ כדי שהצבור יזכירו בתפלתן, וכן נוהגין). הלכך אף אם הוא חולה או אנוס, לא יקדים תפלתו לתפלת הצבור, לפי שאסור להזכיר עד שיאמר ש״ץ. אבל אם יודע שהכריז ש״צ, אף על פי שהוא לא שמע — מזכיר.
Séif 2: it is forbidden to mention the rain before the chazzan (שליח ציבור) has proclaimed it (some say that before beginning Moussaf the שמש proclaims « משיב הרוח » etc., so that the community will mention it in their prayer — such is the custom). Therefore, even a sick or constrained person (חולה או אנוס) shall not advance his prayer ahead of the community's, for it is forbidden to mention before the chazzan has said it. But if he knows the chazzan has proclaimed it, even without having heard it himself — he mentions.
The mention is not an individual decision: it requires a public institution. As long as the ש״ץ (or the שמש) has not proclaimed « משיב הרוח ומוריד הגשם », one does not mention. That is why even one normally allowed to precede the community (sick, constrained) does not precede here. What matters is that the proclamation took place, not that one heard it.
Séif 3 — משיב הרוח and the טל: one does not repeat
אם אמר משיב הרוח בימות החמה, או לא אמרו בימות הגשמים — אין מחזירין אותו. וכן בטל, אם הזכירו בימות הגשמים או לא הזכירו בימות החמה — אין מחזירין אותו. הגה: ואנו בני אשכנז לא מזכירין טל לא בימות החמה ולא בימות הגשמים, רק אומרים בימות החמה « רב להושיע מכלכל חיים » וכו׳.
Séif 3: if he said « משיב הרוח » in summer, or did not say it in winter — one does not make him repeat. Likewise for dew (טל): if he mentioned it in winter or did not mention it in summer — one does not make him repeat. Rama: we, the בני אשכנז, do not mention dew, neither in summer nor in winter; we only say in summer « רב להושיע מכלכל חיים » etc.
The wind (רוח) and the dew (טל) « are never withheld » — they never fully cease. Mentioning or omitting them is therefore not grave: אין מחזירין אותו. Communities differ on the טל: some say it in summer, but the בני אשכנז do not mention it at all, passing directly from « רב להושיע » to « מכלכל חיים ».
Séif 4 — He said גשם in summer: one makes him repeat
אם אמר מוריד הגשם בימות החמה — מחזירין אותו, וחוזר לראש הברכה. ואם סיים הברכה — חוזר לראש התפלה. ואפילו במקום שצריכים גשם בימות החמה, אם הזכיר גשם במקום טל — מחזירין אותו.
Séif 4: if he said « מוריד הגשם » in summer — one makes him repeat, and he returns to the start of the berakha (מחיה המתים). And if he finished the berakha — he returns to the start of the Amida. And even in a place that needs rain in summer, if he mentioned rain in place of dew — one makes him repeat.
Rain in summer is a סימן קללה; having mentioned it is an error that makes one repeat (מחזירין). If he catches it before the end of the berakha, he returns to the start of the berakha; if he has already finished the berakha, he returns to the start of the Amida (for the first three berakhot count as one — see séif 6). Even where rain would be welcome in summer, the הזכרה follows the season, not the local need.
Séif 5 — He omitted גשם in winter: repeat, unless the טל
בימות הגשמים אם לא אמר מוריד הגשם — מחזירין אותו. והני מילי שלא הזכיר טל, אבל אם הזכיר טל — אין מחזירין אותו.
Séif 5: in winter, if he did not say « מוריד הגשם » — one makes him repeat. This holds only if he did not mention dew (טל); but if he mentioned dew — one does not make him repeat.
Forgetting the rain in winter makes one repeat. But there is an exception: if, instead of « מוריד הגשם », he said « מוריד הטל » — dew too being « life to the world » and a valid praise — he does not repeat. That is why some make it a habit to say the טל all summer: thus, if they forget the rain in winter, their habit will have made them say at least the טל.
Séif 6 — Where does he return? The first three berakhot count as one
במה דברים אמורים שמחזירין אותו כשלא אמר בימות הגשמים מוריד הגשם — היינו כשסיים כל הברכה והתחיל ברכה שאחריה, ואז חוזר לראש התפלה. אבל אם נזכר קודם שסיים הברכה — יאמר במקום שנזכר. ואפילו אם סיים הברכה ונזכר קודם שהתחיל « אתה קדוש » — אין צריך להחזיר, אלא אומר משיב הרוח ומוריד הגשם בלא חתימה. הגה: שלש ברכות הראשונות חשובות כאחת, ובכל מקום שטעה בהם חוזר לראש, בין שהוא יחיד בין שהוא צבור.
Séif 6: we only say that one makes him repeat (when he omitted « מוריד הגשם » in winter) if he finished the whole berakha and began the following berakha — then he returns to the start of the Amida. But if he catches it before finishing the berakha — he says it where he stands. And even if he finished the berakha but catches it before beginning « אתה קדוש » — he need not repeat: he says « משיב הרוח ומוריד הגשם » without a conclusion (בלא חתימה). Rama: the first three berakhot count as one; wherever he erred in them, he returns to the start, whether an individual or the chazzan.
Everything depends on where he is when he catches it. Before the end of the berakha: he simply says the mention there. After the chatima, but before « אתה קדוש »: he inserts « משיב הרוח ומוריד הגשם » without a new conclusion. Only once he has entered the next berakha must he return — and since the first three berakhot are one unit, that return is to the start of the Amida.
Séif 7 — שוגג ומזיד: by mistake or deliberately
בכל מקום שאנו אומרים חוזר לברכה שטעה בה — הני מילי שטעה בשוגג, אבל במזיד ומתכוין — חוזר לראש.
Séif 7: wherever we say he returns to the berakha in which he erred — this holds only if he erred by mistake (בשוגג); but if he did so deliberately and intentionally (במזיד ומתכוין) — he returns to the start.
The « lighter » remedies (returning only to the berakha) are reserved for the unintentional error (שוגג). One who erred deliberately (מזיד) is treated more strictly: he returns to the start of the Amida. The principle runs through the whole domain of prayer errors.
Séif 8 — The doubt in summer: the thirty-day presumption
בימות החמה אם נסתפק אם הזכיר מוריד הגשם אם לא — עד ל׳ יום בחזקת שהזכיר הגשם וצריך לחזור. הגה: והוא הדין לדידן דאין מזכירין טל בימות החמה, אם נסתפק לו אם אמר מוריד הגשם בימות הגשמים — כל ל׳ יום חוזר, דודאי אמר כמו שרגיל, והרי לא הזכיר לא טל ולא גשם. לאחר ל׳ יום אינו חוזר.
Séif 8: in summer, if he doubts whether he said « מוריד הגשם » — during the first thirty days he is presumed to have mentioned rain and must repeat. Rama: the same holds for us, who do not mention dew in summer: if he doubts whether he said « מוריד הגשם » in winter, during the first thirty days he repeats, for surely he said as he is accustomed — and he mentioned neither dew nor rain. After thirty days he does not repeat.
In doubt, one follows the habit (חזקה). During the first thirty days after the change of season, the tongue is still set on the old formula: one who doubts is presumed to have continued as before, hence to have erred, and he repeats. After thirty days, the tongue has grown accustomed to the correct formula: in doubt, one presumes he said it properly, and he does not repeat.
Séif 9 — The ninety-times procedure (צ׳ פעמים)
אם ביום ראשון של פסח אומר ברכת « אתה גבור » עד « מוריד הטל » צ׳ פעמים — כנגד ל׳ יום שאומר אותה ג׳ פעמים בכל יום — משם ואילך, אם אינו זוכר אם הזכיר גשם, הרי הוא בחזקת שלא הזכיר גשם ואינו צריך לחזור. הגה: וכן אם אמר בשמיני עצרת צ׳ פעמים « אתה גבור » עד « מוריד הגשם », אם נסתפק אחר כך אם הזכיר או לא — חזקה שהזכירו.
Séif 9: if, on the first day of Pessah, he repeats the berakha « אתה גבור » up to « מוריד הטל » ninety times — corresponding to the thirty days on which one says it three times a day — from then on, if he no longer remembers whether he mentioned rain, he is presumed not to have mentioned it and need not repeat. Rama: likewise, if at Chemini Atseret he said « אתה גבור » up to « מוריד הגשם » ninety times, and then doubts whether he mentioned it — he is presumed to have mentioned it.
One can build the חזקה in advance. Thirty days × three prayers = ninety times. By repeating the berakha צ׳ פעמים with the new formula on the very first day of the season, one trains one's tongue at once — and from then on the doubt is resolved according to the new formula (at Pessah: without rain; at Chemini Atseret: with rain), without waiting thirty days.
The siman in one sentence: we say משיב הרוח ומוריד הגשם from Moussaf of Chemini Atseret to Moussaf of the 1st day of Pessah, after the הכרזה of the ש״ץ; the wind and the dew do not make one repeat, but גשם in summer (מחזירין) and the omission of גשם in winter (unless he said טל) do; one returns according to where one catches the error (the first three berakhot counting as one), gently in שוגג and to the start in מזיד; and in doubt, one follows the חזקת ל׳ יום, which can be anticipated by the צ׳ פעמים.
Practical cases
Case 1 — The latecomer and the הכרזה
Situation: he arrives at the synagogue at Moussaf of Chemini Atseret; the community has already begun. May he mention מוריד הגשם?
Conduct: what matters is that the הכרזה took place. If he knows the ש״ץ (or the שמש) proclaimed « משיב הרוח ומוריד הגשם », he mentions, even without having heard it himself. Conversely, as long as the proclamation has not taken place, even a חולה or an אנוס does not precede the community. For the practical application, one follows one's Rav.
Case 2 — He said גשם in summer (or omitted it in winter)
Situation: in summer he said מוריד הגשם; or in winter he forgot מוריד הגשם. Must he repeat?
Conduct: גשם in summer — מחזירין: he returns to the start of the berakha (or to the start of the Amida if he finished it). Omission of גשם in winter — he also repeats, unless he said טל (מוריד הטל), in which case he does not repeat. If he catches it before finishing the berakha, he inserts it where he stands, without repeating. For borderline cases, one follows one's Rav.
Case 3 — The doubt « did I mention the rain? »
Situation: a few days after the change of season, he no longer remembers whether he mentioned the rain correctly. Must he repeat?
Conduct: one follows the חזקה. In the first thirty days, one presumes he said as before (by habit) — so he repeats; after thirty days, one presumes he said correctly — he does not repeat. One who wishes to be free of doubt may repeat the berakha צ׳ פעמים on the very first day. For borderline cases, one follows one's Rav.
