Why a Level 4 devoted to the Alter Rebbe ? The Alter Rebbe’s Shulchan Aruch is not a commentary on the Mehaber (מחבר) — it is a complete, self-standing Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Habad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity : it combines halakha (הלכה) + טעמי המצוות + inner dimension in one work, and rules with a unique Talmudic rigor.
For Habad, the Alter Rebbe is הפוסק האחרון — his psak is the deciding authority. This page gathers the Rav’s way on siman In the Rav it unfolds over ה׳ סְעִיפִים (five seifim) : the בֵּית הַכִּסֵּא יָשָׁן and its מְחִצּוֹת, the הַזְמָנָה, the שְׁנֵי חֲדָרִים, the חֲפִירָה בְּמִדְרוֹן (כְּסָתוּם), and the סַפְסָל וְכִסְאוֹת נְקוּבִים.

The Alter Rebbe’s own text (Sefaria source Shulchan_Arukh_HaRav,_Orach_Chayim.83), followed by our English translation. The siman has five seifim (ה׳ סְעִיפִים ; seif k → .83.k).

Just as it is forbidden מן התורה to recite the ק״ש כְּנֶגֶד הַצּוֹאָה, so it is forbidden כְּנֶגֶד בֵּית הַכִּסֵּא יָשָׁן — a place already used once — even after the צוֹאָה has been removed, for the שֵׁם בֵּית הַכִּסֵּא has settled on it : מָאוּס הוּא, it is not a מַחֲנֶה קָדוֹשׁ. One keeps ד׳ אַמּוֹת away and כִּמְלֹא עֵינָיו in front. במה דברים אמורים ? when he made a dedicated room ; but if the place is the מְחִצּוֹת of a house or courtyard — they carry no דִּין בֵּית הַכִּסֵּא, since they are not מְיֻחָדוֹת to it, and one may recite even right beside them.

But facing it — even בְּסָמוּךְ, within ד׳ אַמּוֹת — מֻתָּר, for the naming alone does not suffice to forbid outside it.

He said « חֶדֶר זֶה יִהְיֶה לְבֵית הַכִּסֵּא וְגַם זֶה » — both are forbidden. But if he said « וְחֶדֶר זֶה » without « וְגַם זֶה » — the second is סָפֵק : לְכַתְּחִלָּה one does not recite there, בדיעבד יָצָא. Yet one who recited in a place certainly forbidden — even

But if they sometimes urinate there (וּרְגִילִים בְּכָךְ) — אָסוּר even לְהַרְהֵר בְּדִבְרֵי תּוֹרָה, all the more the ק״ש, and one keeps ד׳ אַמּוֹת and כִּמְלֹא עֵינָיו away.

The yesod : the דיני בית הכסא
The Alter Rebbe’s reading of this siman unfolds along four axes. First the בֵּית הַכִּסֵּא יָשָׁן and its שֵׁם. Then the הַזְמָנָה and the שְׁנֵי חֲדָרִים. Then the חֲפִירָה בְּמִדְרוֹן (כְּסָתוּם).
The privy’s status — the שֵׁם and מְאִיסוּת
The principle. An old privy stays forbidden even after the צוֹאָה is removed : the שֵׁם בֵּית הַכִּסֵּא made it מָאוּס, it is no longer a מַחֲנֶה קָדוֹשׁ (seif א).
The consequence. It is not the present filth that forbids but the status acquired. Cf. siman 79 (צוֹאָה כְּנֶגֶד ק״ש).
Designation — inside and facing
The principle. A room הִזְמִין לְבֵית הַכִּסֵּא, not yet used — אָסוּר לִקְרוֹת בְּתוֹכוֹ מִדִּבְרֵי סוֹפְרִים ; but facing it, even בְּסָמוּךְ — מֻתָּר (seif ב).
The consequence. Two rooms « וְגַם זֶה » — both forbidden ; « וְחֶדֶר זֶה » alone — סָפֵק, בדיעבד יָצָא ; where it is certainly forbidden — חוֹזֵר. Cf. siman 82.
The sloped pit —
The principle. A חֲפִירָה בְּמִדְרוֹן that carries away the רְעִי and מֵי רַגְלַיִם at once is כְּסָתוּם : permitted with no רֵיחַ רַע and no urinating חוּץ לַגֻּמָּא (seif ד).
The consequence. But if they urinate outside — אָסוּר even לְהַרְהֵר. Cf. siman 81.
The perforated bench —
The principle. A סַפְסָל נָקוּב or the children’s כִּסְאוֹת נְקוּבִים, מְיֻחָדִים לִפָּנוֹת עֲלֵיהֶם, are כְּבֵית הַכִּסֵּא even when clean (seif ה).
The consequence. Cover them or take them out, and keep Cf. siman 76.
A note for study. The scope of this siman — the שֵׁם בֵּית הַכִּסֵּא, the מְאִיסוּת and the כְּסָתוּם — bears on the purity of the place of קְרִיאַת שְׁמַע and תְּפִלָּה. This page presents it at the level of the principle attested in the Rav’s text, adding nothing invented. For deep study and personal conduct, study with a Habad Rav and in the texts themselves.

The force of the Alter Rebbe’s psak
A comparison of the Alter Rebbe’s way with those of the Mehaber, the Mishna Beroura (משנה ברורה) and the Aroukh haShulchan (ערוך השולחן) on the key points of siman פ״ג. The Alter Rebbe’s Shulchan Aruch (שולחן ערוך הרב) row is highlighted — it shows the Rav’s own sensibility as it emerges from his five seifim.

The lines of force of the Rav’s way on this siman
Three orientations that mark the Alter Rebbe’s sensibility on this siman. Each follows the structure : principle of the siman → the Rav’s reading → practical consequence. Each line rests on the Rav’s real text (§1).
Principle of the siman : the status (שֵׁם) of בֵּית הַכִּסֵּא forbids even with no צוֹאָה present — יָשָׁן, חֶדֶר מְיֻחָד, סַפְסָל נָקוּב (seifim א, ב, ה).
The Rav’s reading : it is the מְאִיסוּת of the status, not present filth, that removes the מַחֲנֶה קָדוֹשׁ. Cf. siman 79.
Practical consequence : treat a place devoted to a privy as forbidden even emptied and closed.
Line 2 — הֶפְסֵק and מְחִצּוֹת
Principle of the siman : dedicated מְחִצּוֹת carry the דִּין בֵּית הַכִּסֵּא ; those of a house or courtyard do not (seif א).
The Rav’s reading : distinguish the dedicated partition from a plain wall ; keep ד׳ אַמּוֹת and כִּמְלֹא עֵינָיו. Cf. siman 82.
Practical consequence : beside a non-dedicated wall one may recite even right against it.
Line 3 — כְּסָתוּם and distance in practice
Principle of the siman : the sloped pit is כְּסָתוּם ; but urinating חוּץ לַגֻּמָּא restores the שֵׁם בֵּית הַכִּסֵּא (seif ד).
The Rav’s reading : the leniency depends on the absence of רֵיחַ רַע and the real use of the place. Cf. siman 81.
Practical consequence : do not recite or think Torah where one urinates, even if momentarily clean.
Habad practice
Points of conduct that follow directly from siman פ״ג in the sensibility of the Alter Rebbe and Habad — presented at the level of the principle, deferring to the Rav for the detail of cases.
For the Habad Hassid — Siman
A place already used as a privy stays אָסוּר even once the צוֹאָה is removed ; keep ד׳ אַמּוֹת and כִּמְלֹא עֵינָיו away. Basis : SA HaRav פ״ג seif א.
A room designated but not yet used — do not recite inside it (מִדִּבְרֵי סוֹפְרִים) ; but facing it, even בְּסָמוּךְ — מֻתָּר. Basis : SA HaRav פ״ג seif ב.
« וְגַם זֶה » — both forbidden ; « וְחֶדֶר זֶה » alone — סָפֵק (לְכַתְּחִלָּה not, בדיעבד יָצָא) ; recited where surely forbidden — חוֹזֵר. Basis : SA HaRav פ״ג seif ג.
A sloped pit = כְּסָתוּם — permitted with no רֵיחַ רַע ; but if they urinate outside — אָסוּר even לְהַרְהֵר.
A perforated bench and children’s perforated chairs — cover or remove, even clean, כְּבֵית הַכִּסֵּא. Basis : SA HaRav פ״ג seif ה.
⚠ This section presents Habad conduct grounded in the Alter Rebbe’s Shulchan Aruch, siman פ״ג (real text reproduced in §1). It does not replace a rabbinic decision for a particular case. For any concrete question — the בֵּית הַכִּסֵּא יָשָׁן, the הַזְמָנָה, the חֲפִירָה בְּמִדְרוֹן, the סַפְסָל נָקוּב — consult your Rav, and for Habad, a Habad Rav.
