The shita of the Alter Rebbe on the single seif that codifies the permission to place a cold dish on a hot dish on Erev Shabbos so it reheats progressively. Application to preheating food before Shabbos.

Why a level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber — it is an autonomous and complete Shulchan Aruch, written by the Alter Rebbe. Its singularity: it combines halacha + taamei ha-mitzvos + inner dimension in a single work, and rules with unique Talmudic rigor.

מֻתָּר לְהַטְמִין מִבְּעוֹד יוֹם, בֵּין תַּבְשִׁיל חַם בֵּין תַּבְשִׁיל קַר, עַל גַּבֵּי קְדֵרָה רוֹתַחַת, וְאֵין זֶה כְּמַטְמִין עַל גַבֵּי דָּבָר הַמּוֹסִיף הֶבֶל שֶׁאָסוּר אֲפִלּוּ מִבְּעוֹד יוֹם, לְפִי שֶׁאֵין הַקְּדֵרָה הָרוֹתַחַת נִקְרָא מוֹסִיף הֶבֶל, שֶׁהֲרֵי חֻמָּהּ הוֹלֵךְ וּמִתְמַעֵט.

It is permitted to place on Erev Shabbos a cold thing upon a hot thing — and it contains one seif:

It is permitted to insulate (hatmanah) while it is still day, whether it be a hot dish or a cold dish, upon a boiling pot. And this is not like one who insulates upon something that adds heat (mosif hevel), which is forbidden even while it is still day; because the boiling pot is not called mosif hevel, since its heat is going and diminishing.

להטמין כו'. עיין במה שנתבאר בסימן רנ״ז דהטור ושו״ע לשיטתייהו אזלי, שאף שהקדרה מגולה מיקרי הטמנה, ולכן הוצרך הב״י לפרש שאין הקדרה מוספת הבל. ומכל מקום הדין דין אמת אף לדידן דקיימא לן דכשהקדרה מגולה למעלה לא מיקרי הטמנה, כמ״ש רמ״א סי' רנ״ג והט״ז כאן, וכן דעת הרמב״ם ומגיד משנה סוף פ״ד, וכגון שהיא טמונה למעלה. ולאפוקי מדברי הרב רבינו יונה שהביא הר״ן שפירש ההיא דכוזא כו' בכהאי גוונא ולאיסור, אלא ס״ל בהדיא כפירוש התוס' ורא״ש וטור ושו״ע בסי' שי״ח (ובהא אתי שפיר מה שנוהגין להטמין מבעוד יום מיני עיסה בקדרה קטנה תוך גדולה אע״ג דהוה ליה הטמנה ממש עיין סי' שכ״ו).

ולא העתקתי מה שכתב המג״א כאן, משום דבהדיא מבואר בש״ע סי' שי״ח ס״ח שהכריע להקל דלא דמי לכירה כמו שכתב המג״א עצמו שם עיין שם בס״ק כ״ו, דאף במיחם על גבי מיחם שיש תבשיל ורוטב בהעליון דבכהאי גוונא מיירי הכא והתם בס״ז נקטינן נמי כדברי המיקל, עיין במה שנתבאר בסי' רנ״ג ודו״ק:

"Lehatmin etc." See what has been explained in siman 257: that the Tur and the Shulchan Aruch follow their own shitah, according to which even when the pot is uncovered it is still called hatmanah (insulation); and therefore the Beis Yosef had to explain that the pot does not add heat (einah mosefes hevel). Nevertheless the halachah is a halachah of truth even according to us who hold (kaima lan) that when the pot is uncovered on top it is not called hatmanah, as the Rema writes in siman 253 and the Taz here; and so too is the opinion of the Rambam and the Maggid Mishneh at the end of chapter 4 — namely, when it is insulated on top. And this excludes the words of Rabbeinu Yonah brought by the Ran, who explained the case of the kuza etc. in this fashion and to forbid. Rather, [the Shulchan Aruch] explicitly holds like the explanation of Tosafos, the Rosh, the Tur, and the Shulchan Aruch in siman 318 (and through this is well understood the custom of insulating, while it is still day, kinds of dough in a small pot inside a large one, even though this is true hatmanah — see siman 326).

And I did not copy what the Magen Avraham wrote here, since it is explicitly explained in the Shulchan Aruch siman 318:8 that he ruled leniently because it is not similar to a kirah, as the Magen Avraham himself writes there (see sk. 26): that even for an urn upon another urn (meichem al gabei meichem) when there is a dish and gravy in the upper one — which is the case under discussion here and there in seif 7 — we likewise take the words of the lenient one (hamekil). Passive preheating

Classical position:

The chidush of the Rav: the Alter Rebbe articulates: what matters is the action, not the result. If one places without intervening and the dish reheats by convection = OK. The result (heating) is secondary to the mode of operation (passive).

Practical consequence: tool for practice: use passive convection broadly to prepare Shabbos dishes without active intervention.
