Daat HaRav — The Alter Rebbe's Shulchan Aruch on Siman 311

The shita of the Alter Rebbe on the 15 seifim of corpse laws on Shabbat and other tiltul min hatzad. Conceptual framework: dignity of the corpse vs muktzeh laws.

Why a Level 4 dedicated to the Alter Rebbe? The Alter Rebbe's Shulchan Aruch is an autonomous Shulchan Aruch combining halacha + ta'amei hamitzvos + inner dimension.

For Chabad, the Alter Rebbe is the final posek.

Law of the mes (deceased) on Shabbos and the rest of tiltul min ha-tzad (indirect handling) — it contains 15 seifim:

Although the mes is muktzeh and forbidden to be moved, nevertheless if it lies in a place where one fears for it on account of a fire — one may move it in order to save it, for the Sages lifted the prohibition of tiltul so that one should not come to the grave prohibition of extinguishing the fire, since he is distraught over his dead lest it be burned.

And in any case, whatever one is able to do in a more permitted manner — one must do. That is: if one has something that is permitted to be moved not for the sake of its use or its place — such as an infant, or a kikar (loaf of bread), or other foods, or any vessel whose work is for a permitted use — one moves it by its means; that is, one places the permitted object upon the mes or beside it and moves both of them together.

And if one has nothing permitted to be moved: if the mes is lying on a bed and one has another bed — one turns him over from this bed to that bed, and from that one to this one, until one brings him to a place protected from the fire; for this is tiltul min ha-tzad, and the bed does not become a basis for the mes, since one has no need of it, for all one needs is to lay him on the ground. And if one has no other bed — one carries him on this bed; or even if he is not lying on a bed, one moves him with a full tiltul with one's hands to save him from the fire.

And if it is impossible to save it except by carrying it out into a karmelis — some permit it on account of bizayon ha-mes (the disgrace of the deceased), lest it be burned; for great is kevod ha-beriyos (human dignity), which overrides a negative commandment of the Torah, namely “You shall not turn aside from the word that they tell you, etc.” — for by this commandment we were commanded to heed all the words of the Soferim — and the prohibition of karmelis too is only of the words of the Soferim.

And nevertheless, if one has something permitted to be moved — one must carry it out together with him, in order to lighten the prohibition of tiltul. For although the karmelis prohibition is set aside because of kevod ha-beriyos, nevertheless the prohibition of tiltul, since it can be remedied by moving a permitted object — one must remedy it in whatever way possible. And although one adds to the karmelis prohibition by carrying out with him the permitted object as well — this is of no consequence, for the karmelis prohibition has already been set aside entirely in carrying out the mes. But the prohibition of tiltul, since it can be remedied, we are not to set it aside; for it is better to add within one prohibition than to set aside two prohibitions.

A mes lying in the sun, where one fears it will putrefy: if one has something permitted to be moved — one moves it by its means, from sun to shade. Otherwise — one may not move it at all, not even by turning it from bed to bed; for they permitted tiltul min ha-tzad only when one moves for the sake of a permitted thing, as will be explained, whereas here one moves for the sake of the mes, which is forbidden to be moved. And on account of the honor of the mes they permitted only the prohibition of carrying out into a karmelis, which cannot be remedied at all when there is need for it; but the prohibition of tiltul, since it can be remedied by moving a permitted object together with him — they did not permit it in any manner, even if one has no permitted object; only in a fire did they permit it, so that one should not come to extinguish.

And even if he has a permitted object but has no shaded place in the same domain — it is forbidden to carry it out into a karmelis by means of a permitted object, if a remedy can be made for it by spreading mats for shade, as will be explained. But if that is not possible, and likewise a mes lying in the house that is close to putrefying, and one has no cool place in the same domain to remove him to — some permit carrying him out into a karmelis by means of a permitted object, on account of bizayon ha-mes, lest he putrefy.

But if he has already putrefied in the house and one wishes to carry him out in order to remove his odor from the members of the household — if they have another place to go out to, one does not carry him out; rather one leaves him in his place and they go out. And if not — it is permitted to carry him out, for great is kevod ha-beriyos.

Likewise if one wishes to carry him out for the sake of his honor, so that he not be disgraced among the living — it is permitted to carry him out if they have no other place to go out to.

Likewise if he lies in some other disgrace — for example, he was on a ship and non-Jews were gathering there, which is something of a disgrace to him — it is permitted to bring him through a karmelis to the house by means of a permitted object. And so in every similar case.

But to carry it out into a full reshus ha-rabbim (public domain) — it is forbidden even in a fire. And even according to those who say that carrying out the mes is not forbidden by the Torah but only by the words of the Soferim, because it is a melachah she'einah tzerichah legufah (a labor not needed for its own sake), as was explained in siman 278 — they did not permit it on account of kevod ha-beriyos, since its essence is from the Torah, that is, if it were needed for its own sake; which is not so of karmelis, whose essence is from the words of the Soferim.

And even by a non-Jew it is forbidden in reshus ha-rabbim, because it is a disgrace to the mes that people should say full chillul Shabbos was done on his account, even though the desecration was done by a non-Jew; which is not so of karmelis — everyone knows that it is not among the melachos and that its essence is from the words of the Soferim.

They permitted tiltul by means of a permitted object only for the mes alone; but other things forbidden to be moved — it is forbidden to move them by means of a permitted object, even if one is not moving for the sake of the forbidden thing but for the sake of a permitted thing. For they permitted tiltul by means of another object, for the sake of a permitted thing, only when one moves the permitted item with one's hands and the forbidden item is moved along with it; but when one moves the forbidden item with one's hands and the permitted item is moved along with it — they permitted it only for the mes alone.

And even for the mes they only permitted it for the sake of his honor — but not for the sake of Kohanim, so that they may remain in their houses, or for the sake of some other matter, even if it is a matter of mitzvah.

But it is permitted to move him by means of a non-Jew for the sake of a mitzvah, such as a wedding, even not by means of a permitted object, for any shevus di-shevus is permitted in a case of mitzvah. And needless to say, wherever it is permitted to move him by means of a permitted object for the sake of his honor, it is permitted to move him by means of a non-Jew even not by means of a permitted object.

All this concerns full tiltul; but tiltul min ha-tzad (indirect handling), that is, turning him over from bed to bed — is permitted even for the sake of Kohanim, or if one needs the place of the mes, or the thing on which the mes is lying; because they forbade tiltul min ha-tzad only when one moves for the sake of the forbidden thing, that is, for the sake of the mes, which is forbidden to be moved; but here one is not moving for the sake of the mes but for the sake of another, permitted thing.

And if one has no other bed — it is permitted to move him on this bed, since it is impossible to shake it so as to drop him off it onto the ground, for then one could no longer move him by tiltul min ha-tzad; and whatever cannot be shaken off — it is permitted to move it in its usual manner when one is not moving it for the sake of the forbidden thing, as was explained in siman 309 regarding one who forgets a stone on the mouth of a barrel.

They only required placing a permitted object upon the mes when the mes is naked, or clothed in tachrichim (shrouds), which are bittel to him and forbidden to be moved like him. But a mes who is clothed in the garment he wore during his lifetime — there is no need to place anything upon him, for this garment is permitted to be moved, since it is not bittel to him, because they are going to strip it off him and clothe him in tachrichim.

A mes lying in the sun and they have no place to remove him to, or they did not wish to move him from his place — it is permitted to make an ohel arai (temporary tent) over him by means of a ha'arama (subterfuge), for the sake of the living. How? Two people come and sit on the ground on his two sides. When they are hot from below, from the heat of the ground that the sun has heated — this one brings his bed and sits on it, and that one brings his bed and sits on it. When they are hot from above — this one brings a mat and spreads it over himself for shade, and that one brings a mat and spreads it over himself. This one stands his bed upright, removes it from there, slips away and goes off, and that one stands his bed upright and removes it, slips away and goes off — and a partition is found to have been made of itself: for the mat of this one and the mat of that one have their tops adjoining one another, and their two ends on the ground on the two sides of the mes. For they permitted making an ohel arai for the sake of the distress of the living and not for the sake of the mes; therefore they required that they first sit until they become hot from below, and then bring beds to sit on — although the beds are of no use at all for making the tent — so that it should appear that the spreading of the mats is not in order to make a tent over the mes by joining the two of them, but in order that each one spread over himself to protect against the sun, for also when they were hot from below each one brought his bed and they sat on them. And for this reason they must stand their beds upright and remove them from there and leave the spread mats standing, so that here too it should appear that the spreading of the mats was not for the sake of the mes but to protect them from the sun: for when he was hot from below he brought a bed and sat on it, and when he got up he stood it upright and went off.

It is permitted to anoint the mes and to rinse him, provided that one does not move any limb of his — for any muktzeh, just as it is forbidden to move all of it, so it is forbidden to move part of it.

And even by means of a permitted object it is forbidden to move him in order to wash him, unless he was soiled with mud and excrement to the point that he is repulsive in the eyes of those who see him; for they permitted moving the mes by means of a permitted object only to save him from disgrace — such as when he lies in the sun, lest he putrefy, or some other disgrace, as was explained above.

Therefore one must protest against the practice that has spread of lifting the mes off the cushions by means of a permitted object even where there is no concern that he may putrefy. And even if there is concern that he will putrefy from the heat of the cushions — one slides the cushions out from under him, and one does not move him.

And it is permitted to sprinkle vinegar on the garments of the mes so that he not putrefy by the conclusion of Shabbos, and they will be able to attend to his taharah; and there is no issue of libbun (whitening) here, for vinegar does not whiten; and the decree lest one wring out, too, is decreed only for a whitening liquid, as was explained in siman 301.

And nowadays the custom has spread to close his eyes on Shabbos and to move a limb so that it not become distorted, and they say that there is danger in the matter; and one should not protest against them.

This is the general rule for tiltul by means of another object: whenever there are two things, one forbidden to be moved and one permitted to be moved, and they are next to each other, or one in the other, or one on the other, and it is in a manner that the permitted one has not become a basis for the forbidden one, as was explained in siman 309, and when one of them is moved the second is moved along with it: if one moves the forbidden one with one's hand and the permitted one is moved along with it — they did not permit it in any manner, except for the mes alone.

And even if one moves the permitted one with one's hands and the forbidden one is moved along with it, if in this tiltul one intends it for the sake of the forbidden one — needless to say if one moves it for the sake of the forbidden item itself, to protect it from some damage or loss, or to put it away, or for some other purpose, but even if one moves it because one needs the forbidden item to make some permitted use of it, such as to sit or lie on it, which is permitted, as was explained in siman 308, or such as a lamp, to use its light in another place, and anything similar — since it is being moved for the sake of the forbidden item, it is forbidden.

But if one has no need at all of the forbidden item itself, and one moves it by means of the permitted one only for the sake of a permitted thing, such as to clear its place — this is the tiltul min ha-tzad that the Sages permitted, in the manner explained in siman 309 regarding a stone on the mouth of a barrel and coins on a cushion.

And needless to say if one has no intention at all of moving the forbidden item, for one has no need of it at all, only of moving the permitted item, except that one cannot move the permitted item unless one moves the forbidden one by its means — such as a detached radish buried in the ground with some of its leaves exposed — one takes it by them and pulls it out, even though in taking it one moves earth from its place. This is provided that it has not taken root, for then there is no issue of tolesh (uprooting), even if one intended it for planting when one buried it there, as was explained in siman 310. And even if it grew because of the moisture of the ground — that is of no consequence, so long as it has not taken root. And the radish has not become a basis for the earth on top of it, even if one had in mind that it should remain lying there the whole of Shabbos, because one's intention was not that the radish should serve the earth, but that the earth should serve the radish. And likewise in every similar case.

And if none of its leaves are exposed — some permit inserting a spindle or a knife into the radish and pulling it out with them, and the earth on top of it shakes off by itself. And although at the start of lifting the radish one lifts the earth on it as well — that is of no consequence, since it is for the sake of a permitted thing. And some forbid inserting into the earth, because it looks like making a hole (guma). And as for the halachah, in matters of the words of the Soferim — follow the lenient view.

But fruits buried in straw or chaff that are muktzeh for kindling — according to all it is permitted to insert a spindle or a knife into the fruits and take them out, for the prohibition of making a hole applies only to earth and the like, as will be explained in siman 506. And if one designated the straw and the chaff for burying the fruits in them — they have left the category of muktzeh and are permitted to be moved. And the same law applies to earth that one designated for this, as was explained.

And all of this is with regard to handling with one's hands by means of another object; but to handle muktzeh with one's body and not with one's hands — it is permitted, even when moving it for the sake of the forbidden item; for example, straw, which is muktzeh because ordinarily it stands for kindling: if it was placed on the bed not for lying on, and on Shabbos one comes to lie on it — it is permitted to shake it with one's body so that it be fluffed up, soft and comfortable to lie on.

And if one placed a cushion or a sheet on it while it was still day — it becomes as though one had sat or lain on it while it was still day, and it is thus prepared for sitting or lying; and from now on it has the status of a vessel, and it is permitted to move it with one's hands. Likewise if while it was still day one had in mind to sit or lie on it, as was explained in siman 308, with an item that is also usually designated for sitting or lying. And if one designated it for animal fodder while it was still day — it is permitted to move it in any manner.

And all this is in places where straw ordinarily stands for kindling; but in places where it ordinarily stands for animal fodder or for lying on — it is permitted to move it in any manner, as was explained there.
