Daat HaRav — The Shulchan Aruch HaRav on Siman 377

Two storeys of upper rooms, facing each other, open onto a small courtyard: one made a pit near its gallery, the other did not. Who may pour his water, depending on the eruv they made? The single seif of the Shulchan Aruch HaRav, compared with the single seif of the Mechaber and the Rema's gloss.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch HaRav is not a commentary on the Mechaber: it is a Shulchan Aruch in its own right, written by the Alter Rebbe, with its own division and its own numbering of the seifim. Here the Shulchan Aruch HaRav has one seif, and the Mechaber's Shulchan Aruch has one seif too; the references on this page follow the Rav's numbering, except where the Mechaber's Shulchan Aruch is named.

This page gathers, for Siman 377, the full text of the Rav with its translation, where his text differs from the Mechaber's and from the Rema's gloss, and the practical conduct that follows from it.

Law of two upper storeys (aliyos) facing each other, open onto the courtyard; it contains a single seif:

Two storeys (diyutaos) of upper rooms (aliyos), facing each other, open onto a small courtyard which does not have four amos by four amos — into which one does not pour water on Shabbos unless a pit (guma) holding two se'ah was made in it, as was explained in Siman 357 —, and the upper rooms of this storey made a pit in the courtyard near their gallery (mirpeses), and the storey opposite did not: if the two storeys made the eruv with the people of the courtyard, all are permitted to pour into the courtyard, relying on the pit that one storey made, for one pit permits even a thousand residents of the courtyard, for the reason explained in Siman 357.

And if they made the eruv for themselves and did not make the eruv with the people of the courtyard — so that they are forbidden to take out into the courtyard utensils that “rested” (shavsu) in the upper rooms [that is, that were there when Shabbos began], as was explained in Siman 375 —, nevertheless the storey that made a pit in the courtyard near its gallery is permitted to pour its water onto its gallery, and the water flows down from the gallery to the pit near it, because they did not decree on one's “force” (kocho) in a courtyard without an eruv, as was explained in Siman 357. But the storey that did not make a pit near its gallery is forbidden to pour even onto its gallery so that the water flows down from it to the courtyard and to the pit: since the pit is not near its gallery, and the water must go through the courtyard until it reaches the pit, there is reason to fear that they will be concerned about spoiling the courtyard, and will carry the water by hand to the courtyard and to the pit, in utensils that “rested” in the upper rooms.

And likewise, if in the second storey the upper rooms did not make the eruv together — so that they are forbidden [to use], on their gallery, any utensils that “rested” in the upper rooms, because they forbid one another; and this is a “foot forbidden in its own place, which forbids outside its place” (regel ha'asurah bimkomah ve'oseres shelo bimkomah), that is, in the courtyard, as was explained in Siman 375 —, therefore the storey that made a pit, even if it made the eruv with the people of the courtyard, is not permitted to take out into the courtyard utensils that “rested” in the upper rooms. And nevertheless it is permitted to pour from the upper rooms onto its gallery, and the water flows down to the pit near it. But the second storey, which did not make the eruv for itself: some say (yesh omrim) that it is forbidden to pour even in the upper rooms, because of a decree lest they be concerned about spoiling the upper rooms and pour onto the gallery, to which they are forbidden to take out [utensils] from their upper rooms.

2 · The Rav's text and the Mechaber's

לשון הרב מול סעיף המחבר והרמ״א

Where the Rav's text differs from the Mechaber's seif and the Rema's

This survey compares the Rav's text with the Mechaber's seif and the Rema's gloss alone, quoted side by side. It does not present these points as unique to the Rav: several of the details the Rav writes in the body of the law are already found, among others in what the Beis Yosef reports on this siman in the name of the Tosafos and the Rosh, and in the Magen Avraham on this seif. Each point names where they are found, and what is not found there.

נקודה א — שתי דיוטאות, המרפסת והחצר הקטנה (שו״ע הרב שע״ז:א)

Point א — two storeys, their gallery and the small courtyard (Shulchan Aruch HaRav 377:1)

The setting: two storeys of upper rooms, the gallery, the pit

What the Mechaber writes: «

What the Rav writes: he writes « שְׁתֵּי דְיוּטָאוֹת שֶׁל עֲלִיּוֹת זוֹ כְּנֶגֶד זוֹ הַפְּתוּחִים לְחָצֵר קְטַנָּה שֶׁאֵין בָּהּ ד׳ אַמּוֹת עַל ד׳ אַמּוֹת » (שו״ע הרב שע״ז:א); he recalls the rule of this courtyard, « שֶׁאֵין שׁוֹפְכִין לָהּ מַיִם בְּשַׁבָּת אֶלָּא אִם כֵּן עָשׂוּ בָהּ גּוּמָא מַחֲזֶקֶת סָאתַיִם, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שנ״ז » (שו״ע הרב שע״ז:א); and he places the pit near the gallery: « וְהָעֲלִיּוֹת שֶׁבִּדְיוּטָא זוֹ עָשׂוּ גוּמָא בֶּחָצֵר סָמוּךְ לְמִרְפֶּסֶת שֶׁלָּהֶן » (שו״ע הרב שע״ז:א).

What is already found before him: the Beis Yosef reports Rashi's explanation, « ופירש״י דיוטאות עליות וחצר פחותה מד״א לפניהם ששופכין בה מימיהם » (בית יוסף או״ח שע״ז); the pit holding two se'ah is the rule the Mechaber writes in Siman שנ״ז, « לכך צריך לעשות גומא שתהא חללה מחזקת סאתים » (שו״ע או״ח שנ״ז:א), to which the Rav refers. On the gallery: the Taz, who opens his comment on this seif with « בסעיף זה העתיק לשון הטור ובאמת הסכנתי נפשי מאוד לישב זה ולא עלתה בידי » (ט״ז או״ח שע״ז ס״ק א), asks what the storey's eruv for itself is doing here, « עירוב זה מאי בעי הכא ומה פי׳ יש לו כיון שאין כאן עירוב חצר ביחד מה עירוב תעשה העליי׳ לעצמה בלא החצר » (ט״ז או״ח שע״ז ס״ק א), and reports that his father-in-law (מו״ח) explained it by a gallery in front of the storey, without being satisfied with it: « ולמו״ח ז״ל ראיתי שפי׳ בזה שיש שם מרפסת להעליי׳ וכל רוא׳ דבריו בזה לא ימצא ישוב ותי׳ כלל על התימהון שיש כאן » (ט״ז או״ח שע״ז ס״ק א). The Magen Avraham also speaks of the gallery (ס״ק א, quoted in point ד). After the Rav, the Mishnah Berurah writes: « ומיירי בשיש מרפסת לפני כל עליה ועליה ונכנסין הכל להמרפסת דרך פתח העליה וממנה יורדין לחצר » (משנה ברורה שע״ז ס״ק ד).

The difference: the Mechaber writes « שתי עליות » (שו״ע או״ח שע״ז:א) — two upper storeys, which Rashi identifies with the diyutaos of the Mishnah, « דיוטאות עליות » (בית יוסף או״ח שע״ז) —, and a courtyard « שאין בה ד׳ אמות » (שו״ע או״ח שע״ז:א); the Rav writes « שְׁתֵּי דְיוּטָאוֹת שֶׁל עֲלִיּוֹת » (שו״ע הרב שע״ז:א) — for him the aliyos are within the storey (diyuta), « וְהָעֲלִיּוֹת שֶׁבִּדְיוּטָא זוֹ » (שו״ע הרב שע״ז:א), and this page renders them “upper rooms” —, a small courtyard which does not have four amos by four, the measure of the pit with its reference to Siman שנ״ז, and the place of the pit, near the gallery of one of the storeys. The setting of the gallery is the explanation the Taz reports from his father-in-law, without accepting it; in the cases that follow (points ג and ד), the Rav gives a role to the eruv made by the upper rooms of a storey; this page does not say that the Rav thereby answers the Taz's question.

Practical consequence: the seif deals with two storeys of upper rooms facing each other, open onto a small courtyard which does not have four amos by four, into which one does not pour water on Shabbos without a pit holding two se'ah (Siman שנ״ז); the pit is made in the courtyard, near the gallery of one of the storeys (Shulchan Aruch HaRav 377:1).

נקודה ב — עירבו עם בני החצר (שו״ע הרב שע״ז:א)

Point ב — the eruv with the people of the courtyard (Shulchan Aruch HaRav 377:1)

One pit for the whole courtyard

What the Mechaber writes: « אם עירבו יחד שתיהן מותרו׳ לשפוך מימיהן » (שו״ע או״ח שע״ז:א).

What the Rav writes: « אִם עֵרְבוּ ב׳ הַדְּיוּטָאוֹת עִם בְּנֵי הֶחָצֵר, כֻּלָּן מֻתָּרִים לִשְׁפּוֹךְ בֶּחָצֵר עַל סְמַךְ גּוּמָא שֶׁעָשְׂתָה דְּיוּטָא הָאַחַת » (שו״ע הרב שע״ז:א), with the reason: « לְפִי שֶׁגּוּמָא אַחַת מַתֶּרֶת אֲפִלּוּ לְאֶלֶף דִּיּוּרִין שֶׁבֶּחָצֵר מִטַּעַם שֶׁנִּתְבָּאֵר בְּסִמָּן שנ״ז » (שו״ע הרב שע״ז:א).

What is already found before him: the Beis Yosef reports the Gemara: « אמר רבא ל״ש אלא שלא עירבו אבל עירבו מותרים » (בית יוסף או״ח שע״ז). After the Rav, the Mishnah Berurah writes, on these words of the Mechaber: « אפילו תוך הגומא להדיא » (משנה ברורה שע״ז ס״ק ג).

The difference: the Mechaber writes « אם עירבו יחד » (שו״ע או״ח שע״ז:א); the Rav writes « ב׳ הַדְּיוּטָאוֹת עִם בְּנֵי הֶחָצֵר » (שו״ע הרב שע״ז:א), and gives the reason why the pit of one storey permits all, with a reference to Siman שנ״ז. This page notes no other difference in this case.

Practical consequence: if the two storeys made the eruv with the people of the courtyard, all may pour into the courtyard, relying on the pit that one storey made (Shulchan Aruch HaRav 377:1).

נקודה ג — עירבו לעצמן: הגומא הסמוכה למרפסת (שו״ע הרב שע״ז:א)

Point ג — the eruv for themselves: the pit near the gallery (Shulchan Aruch HaRav 377:1)

Who may pour, when the storeys did not make the eruv with the courtyard

What the Mechaber and the Rema write: « ואם לא עירבו יחד והאחת עירב׳ לעצמ׳ והשני׳ לא עירב׳ כלל זו שלא עירב׳ אסור׳ ושעירבה מותרת » (שו״ע או״ח שע״ז:א), « ובלבד שלא תשפוך להדיא בגומא אלא תשפוך בעלייה והם יורדים לגומא » (שו״ע או״ח שע״ז:א); and the Rema: « דכחו בחצר שאינה מעורבת שרי » (רמ״א או״ח שע״ז:א).

What the Rav writes: he first writes the case where the storeys made the eruv for themselves, and not with the people of the courtyard: « וְאִם עֵרְבוּ לְעַצְמָן וְלֹא עֵרְבוּ עִם בְּנֵי הֶחָצֵר, שֶׁהֵם אֲסוּרִים לְהוֹצִיא לֶחָצֵר כֵּלִים שֶׁשָּׁבְתוּ בָּעֲלִיּוֹת, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שע״ה » (שו״ע הרב שע״ז:א); then « אַף עַל פִּי כֵן אוֹתָהּ דְּיוּטָא שֶׁעָשְׂתָה גוּמָא בֶּחָצֵר סָמוּךְ לְמִרְפֶּסֶת שֶׁלָּהּ מֻתֶּרֶת לִשְׁפּוֹךְ מֵימֶיהָ בְּמִרְפֶּסֶת שֶׁלָּהּ, וְהַמַּיִם יוֹרְדִים מִמִּרְפֶּסֶת לַגּוּמָא הַסְּמוּכָה לָהּ » (שו״ע הרב שע״ז:א), « לְפִי שֶׁלֹּא גָזְרוּ עַל כֹּחוֹ בְּחָצֵר שֶׁאֵינָהּ מְעֹרֶבֶת » (שו״ע הרב שע״ז:א); and « אֲבָל אוֹתָהּ דְּיוּטָא שֶׁלֹּא עָשְׂתָה גוּמָא סָמוּךְ לְמִרְפֶּסֶת שֶׁלָּהּ אֲסוּרָה לִשְׁפּוֹךְ אֲפִלּוּ בְּמִרְפֶּסֶת שֶׁלָּהּ, שֶׁיֵּרְדוּ הַמַּיִם מִמֶּנָּהּ לֶחָצֵר וְלַגּוּמָא » (שו״ע הרב שע״ז:א), with the reason: « יֵשׁ לָחוּשׁ שֶׁמָּא יָחוּסוּ עַל קִלְקוּל הֶחָצֵר, וְיוֹלִיכוּ הַמַּיִם בְּיָדָם לֶחָצֵר וְלַגּוּמָא בְּכֵלִים שֶׁשָּׁבְתוּ בָּעֲלִיּוֹת » (שו״ע הרב שע״ז:א).

What is already found before him: the Beis Yosef reports, in the name of the Tosafos and the Rosh, « וי״ל דמיירי בשאינן שופכין ממש לתוך העוקא בחצר אלא שופכין על הדיוטא והן יורדין לעוקה » (בית יוסף או״ח שע״ז) and « ואותן שלא עשו עוקה אסורין כדאמרן דילמא אתי לאפוקי מיא במאני דבתים להכא שיורידו מן הדיוטא בכלים מלאין מים לשפת העוקה שרחוקה מהם דאין רוצין שיפלו המים למטה ויקלקל החצר » (בית יוסף או״ח שע״ז); this second passage is found in the Tosafos (quoted in Level 1), not in the Rosh as Sefaria serves it, which has the question and the answer. After the Rav, the Biur Halachah writes, in the name of the Acharonim: « לפי מה שצייר המחבר מתחלה דהאחת לא עשתה גומא יהיה זה הדין אפילו בששניהם עירבו כ״א לעצמו אותה שעשתה גומא מותרת ואותה שלא עשתה גומא אסורה » (ביאור הלכה שע״ז).

The difference: in the Mechaber's seif, the one that made the eruv for itself is permitted, and the one that made none at all is forbidden; the Rav first writes the case where the storeys made the eruv for themselves, and there the permission and the prohibition follow the pit: the storey that has it near its gallery pours onto its gallery, the other does not pour even onto its own, so that the water runs down from it to the courtyard and to the pit. That the permission follows the pit is not the Rav's own: the Mishnah writes it, « את שעשו עוקה מותרין ואת שלא עשו עוקה אסורין » (בית יוסף או״ח שע״ז), and Tosafos, whom the Beis Yosef reports, explain the prohibition of those who did not make the pit by the pit « שרחוקה מהם » (בית יוסף או״ח שע״ז); the Magen Avraham writes it in the name of the Bach for the one that made the eruv without making the pit, noting that the wording of the Remazim does not imply it; and the Biur Halachah, in the name of the Acharonim, reads it in the case set by the Mechaber, for two storeys that each made the eruv for itself. The Mechaber writes « תשפוך בעלייה » (שו״ע או״ח שע״ז:א); the Rav writes « מֵימֶיהָ בְּמִרְפֶּסֶת שֶׁלָּהּ » (שו״ע הרב שע״ז:א). The reason the Rav gives for the permission — they did not decree on one's “force” in a courtyard without an eruv — is that of the Rema's gloss, in the name of the Tur. The Rav does not write the words « ובלבד שלא תשפוך להדיא בגומא » (שו״ע או״ח שע״ז:א); he writes that, in this case, they are forbidden to take out into the courtyard utensils that “rested” in the upper rooms, with a reference to Siman שע״ה.

Practical consequence: when the storeys made the eruv for themselves and not with the people of the courtyard, one does not take out into the courtyard utensils that “rested” in the upper rooms; the storey that made the pit near its gallery may pour its water onto its gallery, the water flowing down to the pit; the storey that did not make a pit near its gallery does not pour, even onto its gallery, so that the water runs down from it to the courtyard and to the pit (Shulchan Aruch HaRav 377:1).

נקודה ד — הדיוטא השנייה, שלא עירבו עליותיה ביחד (שו״ע הרב שע״ז:א)

Point ד — the second storey, whose upper rooms did not make the eruv together (Shulchan Aruch HaRav 377:1)

The foot forbidden in its own place, and the view the Rav reports as “some say”

What the Mechaber writes: « והשני׳ לא עירב׳ כלל זו שלא עירב׳ אסור׳ ושעירבה מותרת » (שו״ע או״ח שע״ז:א), without saying whether the prohibition [to pour] extends to pouring in its own house.

What the Rav writes: « וְכֵן אִם דְּיוּטָא הַב׳ לֹא עֵרְבוּ הָעֲלִיּוֹת שֶׁבָּהּ בְּיַחַד, שֶׁהֵם אֲסוּרִים בְּמִרְפֶּסֶת שֶׁלָּהֶם בְּכָל כֵּלִים שֶׁשָּׁבְתוּ בָּעֲלִיּוֹת, מִפְּנֵי שֶׁאוֹסְרִים זֶה עַל זֶה » (שו״ע הרב שע״ז:א); « וַהֲרֵי זוֹ רֶגֶל הָאֲסוּרָה בִּמְקוֹמָהּ וְאוֹסֶרֶת שֶׁלֹּא בִמְקוֹמָה, דְּהַיְנוּ בֶּחָצֵר, כְּמוֹ שֶׁנִּתְבָּאֵר בְּסִמָּן שע״ה » (שו״ע הרב שע״ז:א); « וְלָכֵן אוֹתָהּ דְּיוּטָא שֶׁעָשְׂתָה גוּמָא, אֲפִלּוּ אִם עֵרְבָה עִם בְּנֵי הֶחָצֵר, אֵינָהּ מֻתֶּרֶת לְהוֹצִיא לֶחָצֵר כֵּלִים שֶׁשָּׁבְתוּ בָּעֲלִיּוֹת » (שו״ע הרב שע״ז:א); « וְאַף עַל פִּי כֵן מֻתֶּרֶת לִשְׁפּוֹךְ מֵהָעֲלִיּוֹת עַל מִרְפֶּסֶת שֶׁלָּהּ וְהַמַּיִם יוֹרְדִים לַגּוּמָא הַסְּמוּכָה לָהּ » (שו״ע הרב שע״ז:א); and finally: « אֲבָל דְּיוּטָא הַב׳ שֶׁלֹּא עֵרְבָה לְעַצְמָהּ — יֵשׁ אוֹמְרִים שֶׁאֲסוּרָה לִשְׁפּוֹךְ אֲפִלּוּ בָּעֲלִיּוֹת » (שו״ע הרב שע״ז:א), « מִשּׁוּם גְּזֵרָה שֶׁמָּא יָחוּסוּ עַל קִלְקוּל הָעֲלִיּוֹת וְיִשְׁפְּכוּ בְּמִרְפֶּסֶת הָאֲסוּרָה לָהֶם לְהוֹצִיא לָהֶם מֵעֲלִיּוֹתֵיהֶם » (שו״ע הרב שע״ז:א).

What is already found before him: the Magen Avraham proposes (ול״נ) a reason why the seif writes that the second made no eruv at all: « ול״נ דנקט והשניה לא עירבה כלל דאם עירבה השניה לעצמה אין אוסרת החצר ומותרת אותה שעשאה גומא לשפוך להדיא לגומא אבל כל שלא עירבה כלל ה״ל רגל האסורה במקומה ואוסרת החצר » (מגן אברהם שע״ז ס״ק ב), and concludes « וצ״ע עמ״ש סימן שס״ד ס״ג » (מגן אברהם שע״ז ס״ק ב). On the storey that did not make the eruv, he writes: « אפי׳ עשתה גומא דהא אסורה להוציא על המרפס׳ וא״כ אפי׳ לשפוך בביתה אסור׳ דחיישי׳ שתה׳ חס על קלקול ביתה ותטלטל הכלים למרפסת » (מגן אברהם שע״ז ס״ק א). After the Rav, the Mishnah Berurah writes it in turn: « אלא אפילו לשפוך בביתה שילך המים מעצמו למרפסת ומשם ירד למטה ג״כ אסור » (משנה ברורה שע״ז ס״ק ה).

The difference: the Mechaber writes that the one that did not make the eruv is forbidden [to pour], without saying whether the prohibition extends to pouring in its own house; the Rav writes, as the Magen Avraham proposes (ס״ק ב, ול״נ … וצ״ע), that upper rooms which did not make the eruv together are a “forbidden foot” which forbids the courtyard, and draws from it that the storey that made the pit, even if it made the eruv with the people of the courtyard, does not take out into the courtyard utensils that “rested” in the upper rooms — while it may pour from the upper rooms onto its gallery. The prohibition on the second storey to pour even in its upper rooms, which the Magen Avraham (ס״ק א) writes on the seif without attributing it to others, the Rav introduces with « יֵשׁ אוֹמְרִים » (שו״ע הרב שע״ז:א); this page does not say why he writes it so, nor how he rules; consult your Rav. The Magen Avraham further writes that, if the second made the eruv for itself, the one that made the pit may pour directly into the pit; the Rav, in the case where the storeys made the eruv for themselves and not with the people of the courtyard (point ג), writes the permission to pour onto the gallery and the prohibition to take utensils out into the courtyard: this page does not say whether the two cases coincide; consult your Rav.

Practical consequence: if the upper rooms of the second storey did not make the eruv together, the storey that made the pit, even if it made the eruv with the people of the courtyard, does not take out into the courtyard utensils that “rested” in the upper rooms, but it may pour from its upper rooms onto its gallery, the water flowing down to the pit; for the second storey, the Rav reports the view of “some” who forbid it to pour even in its upper rooms (Shulchan Aruch HaRav 377:1).

נקודה ה — חצר גדולה: הגהת הרמ״א שאינה כתובה בסעיף הרב (שו״ע הרב שע״ז:א)

Point ה — the larger courtyard: the Rema's gloss that the Rav's seif does not write (Shulchan Aruch HaRav 377:1)

A courtyard of more than four amos

What the Rema writes: at the end of the seif, « וה״ה אם החצר יותר מד׳ אמות דשתיהם מותרים בכה״ג ואין צריכים לגומא » (רמ״א או״ח שע״ז:א).

What the Rav writes: he sets the case « לְחָצֵר קְטַנָּה שֶׁאֵין בָּהּ ד׳ אַמּוֹת עַל ד׳ אַמּוֹת » (שו״ע הרב שע״ז:א), and does not write, in this seif, the case of a larger courtyard.

What is already found before him: the gloss comes from the Beis Yosef, « ודע דמיירי בחצר פחותה מד״א ואם יתירה מד״א אין שופכין לתוכה ממש אא״כ עירבו ואם לא עירבו כל אחת שופכת ברשותה והמים הולכין מכחו לחצירן שאינה מעורבת » (בית יוסף או״ח שע״ז). The Taz says one must examine the Beis Yosef's words, « לעיין בדברי הב״י כאן שכתב » (ט״ז או״ח שע״ז ס״ק א); he tries to explain them, « ויש קצת ליישב » (ט״ז או״ח שע״ז ס״ק א), and concludes « אבל תימה לי שהרמב״ם כתב דין זה פ״ד וכתב המ״מ דמיירי בחצר שהיא ד׳ על ד׳ וצ״ע » (ט״ז או״ח שע״ז ס״ק א). After the Rav, the Biur Halachah reports « והנה הט״ז מפקפק על דברי הב״י » (ביאור הלכה שע״ז), and writes « ורבים מהאחרונים דחו ראיתו » (ביאור הלכה שע״ז).

The difference: the Rema writes that, in a courtyard of more than four amos, both are permitted in such a case (בכה״ג), without a pit — according to the Beis Yosef quoted above, each pouring in its own domain, the water flowing by his force (מכחו) to the courtyard; the Rav's seif deals with a small courtyard, and does not write this case. This page does not say what the Rav holds for a larger courtyard; consult your Rav.

Practical consequence: the case of the seif is that of a small courtyard, which does not have four amos by four (Shulchan Aruch HaRav 377:1); for a larger courtyard, this page draws no conduct from this seif: consult your Rav.

The practical Chabad conduct

Points of halachic conduct that flow directly from the Shulchan Aruch HaRav Siman 377, in the Chabad sensibility. The siman has a single seif: each point refers to that seif, in the order of the text.

For the Chabad Chassid — Siman 377

  • ① The eruv with the people of the courtyard: if the two storeys made the eruv with the people of the courtyard, all may pour into the courtyard, relying on the pit — holding two se'ah (Siman שנ״ז) — that one storey made, « לְפִי שֶׁגּוּמָא אַחַת מַתֶּרֶת אֲפִלּוּ לְאֶלֶף דִּיּוּרִין שֶׁבֶּחָצֵר מִטַּעַם שֶׁנִּתְבָּאֵר בְּסִמָּן שנ״ז » (שו״ע הרב שע״ז:א). See section 2. Reference: Shulchan Aruch HaRav 377:1.
  • ② The eruv for themselves, not with the courtyard: one does not take out into the courtyard utensils that “rested” in the upper rooms; the storey that made the pit near its gallery may pour its water onto its gallery, the water flowing down to the pit; the storey that did not make a pit near its gallery does not pour, even onto its gallery, so that the water runs down from it to the courtyard and to the pit: « יֵשׁ לָחוּשׁ שֶׁמָּא יָחוּסוּ עַל קִלְקוּל הֶחָצֵר, וְיוֹלִיכוּ הַמַּיִם בְּיָדָם לֶחָצֵר וְלַגּוּמָא בְּכֵלִים שֶׁשָּׁבְתוּ בָּעֲלִיּוֹת » (שו״ע הרב שע״ז:א). See section 2. Reference: Shulchan Aruch HaRav 377:1.
  • ③ The second storey, whose upper rooms did not make the eruv together: the storey that made the pit, even if it made the eruv with the people of the courtyard, does not take out into the courtyard utensils that “rested” in the upper rooms, but it may pour from its upper rooms onto its gallery, the water flowing down to the pit; for the second storey, the Rav writes: « אֲבָל דְּיוּטָא הַב׳ שֶׁלֹּא עֵרְבָה לְעַצְמָהּ — יֵשׁ אוֹמְרִים שֶׁאֲסוּרָה לִשְׁפּוֹךְ אֲפִלּוּ בָּעֲלִיּוֹת » (שו״ע הרב שע״ז:א). See section 2. Reference: Shulchan Aruch HaRav 377:1.
