Daas HaRav — The Shulchan Aruch of the Alter Rebbe on Siman 330

The shitah of the Alter Rebbe on the 11 se'ifim codifying the Shabbos permissions for a woman giving birth — yoledes = presumption of pikuach nefesh, transport to maternity, care, modern application.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch of the Alter Rebbe is an independent, complete Shulchan Aruch, combining halachah + ta'amei hamitzvos + inner dimension.

For Chabad, the Alter Rebbe is the final posek. This page collects, for Siman 330, the Rav's full text, chiddushim, and the Rebbe's words.

Laws of the yoledes on Shabbos — and it contains 11 se'ifim:

The yoledes is like a sick person in danger, and we transgress Shabbos for her for whatever she needs: we call a midwife (chachamah) for her from place to place, we deliver her, and at night we kindle a lamp for her — even if she is blind, and even if the women attending to her do not need a lamp, for they could attend to her for all her needs without a lamp. Even so, we kindle on her account, for even though she does not see — her mind is more settled when she knows that there is a lamp here, for she says in her heart, "if there is anything I need, my companions see and do it for me"; whereas when she knows that there is no lamp here — there is reason to fear that she will be endangered by the dread of her heart, for she will fear that perhaps they are not doing properly what she needs.

Nevertheless, since the pains of the yoledes are natural things, and not one in a thousand dies on account of childbirth, the Sages were therefore stringent to vary (shinnui) in whatever can be varied — for example, if they need to bring her a utensil through reshus harabim (the public domain), her companion should bring it to her hanging from her hair, which is carrying out (hotza'ah) not in its usual manner, and involves no Torah prohibition; and likewise in all similar cases.

And if she needs oil — her companion should not smear oil on her own hair and come to her and wring it out; rather, she should bring it in a utensil hanging from her hair, for it is better to carry out in a utensil by means of a variation (shinnui), with no other prohibition, than to add the prohibition of wringing (sechitah), even though wringing hair is forbidden only mi-divrei soferim, as was explained in siman 326:

A non-Jewess (nochris) — we do not deliver her on Shabbos, even with something that does not involve chillul Shabbos, for example when the child has already been uprooted to come out, so that bringing it out does not involve [the prohibition of] uprooting a thing from where it grows (oker davar mi-gidulo). And even if the Jewess is a recognized midwife and is paid a fee, so that she is permitted to deliver non-Jewesses on a weekday because of eivah (enmity) — nevertheless on Shabbos there is no eivah here, for she can deflect by saying: "our women, who keep Shabbos — it is permitted to deliver them on Shabbos; but yours, who do not keep Shabbos — it is forbidden for us to deliver them on Shabbos".

And even Ishmaelite women, who do not worship idolatry (and it is not forbidden to deliver them on a weekday, as with idolatrous non-Jews, whom [the Sages] forbade because she delivers a son for idolatry — nevertheless on Shabbos) — it is forbidden, because of a melachah done without need, as will be explained in siman 332 (since it is possible to deflect without eivah).

But the Karaites, since they keep Shabbos — it is permitted to deliver them (for a fee, with something that does not involve chillul Shabbos, because of eivah).

And even with idolatrous non-Jews, if it is impossible to deflect without eivah — it is permitted with something that does not involve chillul Shabbos:

From when is she called a yoledes, to transgress Shabbos for her? From when she sits on the mashber (birthing seat), or from when the blood flows and descends, or from when her companions carry her on their arms because she has no strength to walk: as soon as any one of these is seen — we transgress Shabbos for her for all her needs that can be done here without delay. But to call the midwife from place to place, which is a matter requiring time and delay — that is permitted earlier, from when she feels [it] a little, even in doubt.

And it is good to take care that when the woman reaches the 9th month, one should prepare everything from erev Shabbos, so that they will not need to transgress Shabbos:

Throughout the first 3 days she is considered certainly in danger (mesukenes vadai), because her limbs are dislocated and she is crushed; therefore we transgress Shabbos for her.

Even if she says "I do not need transgression", but her companions say that she does need it — even if there is neither a midwife nor a doctor among them — we do for her all her needs, for the things that are done for a chayah (a woman after childbirth) on a weekday are known to all.

And even if she eats the food of other people — we say that she does not feel [it] at the time, and if she eats cold food or other things that a person in danger does not eat — they will bring her to danger.

But if a midwife or doctor says that she does not need transgression — we listen to them, for there are many women after childbirth for whom chamin (hot things) are not made every day. And so is the practice nowadays in some places, that they eat on Shabbos chamin from the previous day:

From the 3rd to the end of the 7th day, if she said "I do not need" — we do not transgress, even if her companions say that she needs, because she is not presumed to be in danger with respect to those things that her companions are accustomed to do for her on a weekday, and it is possible that she can wait until evening.

Unless a midwife or doctor says that she needs, for then we transgress, as we do also for other sick people, as was explained in siman 328.

And all this is when she says "I do not need"; but in an unspecified case (stam), when she says nothing and her companions do not know — we transgress.

But if her companions say that she does not need — we do not transgress.

Unless she says "I do need", for then even if a hundred doctors say that she does not need — we transgress, for "the heart knows the bitterness of its soul", as will be explained in siman 618 regarding other sick people.

And from the end of the 7th day onward, even if she said "I do need" — we do not transgress Shabbos for her; rather she is, up to 30 days, like a sick person without danger (choleh she-ein bo sakanah), all of whose needs are done by a non-Jew, except concerning fire (medurah): if she needs it, it is made for her by a Jew, because the cold is a danger for her all 30 days, even in tekufas Tammuz (the summer season). And whether others are permitted to warm themselves by this fire — was explained in siman 276:

These days are not counted me-eis le-eis (24h to 24h); rather, if she gave birth on Wednesday close to evening — when the start of Shabbos night arrives, it is already the 4th day from her birth, even though 3 days me-eis le-eis have not been completed until close to evening on Shabbos. And likewise regarding the seven and the thirty [days]:

She who sits on the mashber and dies — we bring a knife on Shabbos, even through reshus harabim, we cut open her belly and extract the child, in case he be found alive. And even though most of the time he dies before his mother, nevertheless in pikuach nefesh we do not follow the majority, and sometimes he can live after his mother's death. And even though this fetus never had a presumption of life (chezkas chayus) — we transgress for him out of doubt, as for one who had a presumption of life.

And the reason we do not do so nowadays, even on a weekday, is because we are not expert in [recognizing] the mother's death so quickly that it is still possible for the child to live, for perhaps she has fainted, and if they cut open her belly they will kill her; so they must wait, and in the meantime the child certainly dies:

The child born on Shabbos — we do all his needs for him: we bathe him and salt him so that the flesh will harden, we bury the afterbirth (shilya) so that the child will be warm, and we cut the umbilical cord (tabbur), for all these things cause him distress if they are not done for him; and since they involve no melachah of the Torah, the Sages permitted them.

To what does this apply? To a viable child (velad shel kayyama) — that is, one born at 9 or at 7 months with certainty (for example, if her husband separated from her after cohabiting). But one born at 8 months, or safek 7 / safek 8 — we do not transgress for him, neither in these things nor even in things whose omission poses a danger to him, such as clearing a heap [of debris] from over him — unless his hair and nails are complete, for then he was certainly completed at 7 [months], only he lingered in coming out of his mother's womb after his completion. And therefore, even if he is certainly an 8-month child, for example if her husband separated from her after cohabiting — his law is like that of a certain 7-month child in every respect, and we circumcise him on Shabbos.

But if his hair was deficient and his nails are not complete according to their nature, even if he is [only] a doubtful 8-month child — his law is like that of a certain 8-month child in every respect, even with regard to pikuach nefesh, for which we transgress out of doubt even for a fetus that never had a presumption of life (chezkas chayus), because we are concerned that perhaps his months were completed and his hair and nails already finished; but this one, in whom we see that they are not finished — it is close to certain that he is an 8-month child, who would not have been completed until the 9th month and hastened to come out before his time, and he is a nefel (non-viable).

And even handling him (tiltul) is forbidden, just as it is forbidden to handle a stone; and therefore we do not circumcise him on Shabbos. And we do not say "let him be circumcised mimah nafshach (either way): if he is a 7-month child, his circumcision overrides Shabbos, and if he is an 8-month child, there is no chillul Shabbos in this circumcision, for it is like merely cutting flesh"; for since it is close to certain that he is an 8-month child, the Sages did not want to permit handling for the sake of his circumcision where it is close to certain that his circumcision is nothing.

And some disagree with this and say that since it is possible that he is a 7-month child — and no 7-month child is a nefel, even if his hair and nails were not completed — therefore there is no prohibition at all to handle him on Shabbos, and likewise we circumcise him on Shabbos mimah nafshach.

But according to all opinions, we do not transgress Shabbos for him, neither in a matter whose omission poses a danger to him, nor in the things that were permitted to be done for a newborn on the day of his birth because of his distress, even though they involve no melachah of the Torah.

And according to this view, nowadays we circumcise every child, even one born at 8 [months], for we are not expert in the months of pregnancy: sometimes the woman conceives close to her immersion (tevilah), and sometimes she does not conceive until afterward, and it is possible that he is a 7-month child; and even though his hair and nails were not completed we circumcise him, and likewise it is permitted to handle him on Shabbos.

(And as for the halachah: in matters mi-divrei soferim, follow the lenient view; therefore one who is lenient regarding handling in accordance with the latter view — has not lost. But regarding circumcision on Shabbos — "shev ve-al ta'aseh adif" (sitting and not acting is preferable), and it is good to be concerned for the words of those who forbid. And even though there is no prohibition in handling him — there is a prohibition in circumcising him on Shabbos without need, just as there is a prohibition in cutting the umbilical cord on Shabbos even according to the latter view, as was explained):

Even a certain 8-month child, who is forbidden in tiltul (handling) according to all — his mother bends over him and nurses him, because of the pain of the milk that pains her. Likewise she herself may extract by hand the milk that pains her, for since this milk goes to waste, it involves [the prohibition of] mefarek (extracting) only mi-divrei soferim, and because of her pain they did not decree:

We straighten the limbs of the viable newborn (velad shel kayyama) that have been dislocated due to the pain of birth.

To what does this apply? On the day of the birth; but afterward it is forbidden, because it appears like building (boneh). But to wrap him in his garments in order to straighten his limbs — is always permitted, because that is his usual way even on a weekday, and it does not appear like building on Shabbos. But an infant whom one does not wrap on a weekday, and whose limbs became bent on Shabbos — it is forbidden to wrap him in order to straighten them:

If the palate (orlas ha-garon, lit. "foreskin of the throat", uvula) of the child has fallen — it is permitted to place a finger into his mouth and to restore the "orlah" to its place, even though sometimes he may vomit as a result:

Chiddush 1 — presumption (330:1-3)

Not to verify, to act

The Rav's chiddush: the Alter Rebbe articulates: for the yoledes, presumption of pikuach nefesh — don't check actual severity, act immediately. Life of mother and baby at stake.

Practical consequence: tool for the Chabad home: prepare an emergency plan for end-of-pregnancy Shabbos.
