Daat HaRav — The Shulchan Aruch of the Alter Rebbe on Siman

The Shitah of the Alter Rebbe on the 22 seifim codifying the concept of מוקפים לדירה (enclosed for dwelling) — structural distinction between enclosures for dwelling (reshus hayachid) and purely utilitarian enclosures (variable status).

Why a level 4 dedicated to the Alter Rebbe? The Shulchan Aruch of the Alter Rebbe is not a commentary on the Mechaber — it is an independent and complete Shulchan Aruch, written by the Alter Rebbe himself. Its singularity: it combines halacha + ta'amei hamitzvos + pnimius (inner dimension) in one work, with uniquely rigorous talmudic precision.

For Chabad, the Alter Rebbe is הפוסק האחרון. This page collects, for siman שנ״ח, the full text of the Rav, his chiddushim, and the words of the Rebbe that illuminate the topic.

Law: which places are called mukafim le-dira (enclosed for the sake of dwelling) — and it contains 22 seifim:

Any enclosure of partitions that was not enclosed for human dwelling, for constant entry and exit — such as a rechavah (back-yard) behind houses, or a karpef (which is a large enclosure for bringing in firewood for storage), or a garden (ginnah) and orchard (pardes) surrounded by a fence ten tefachim high, and any similar places (which will be explained in siman 362) — Chazal forbade carrying within them beyond four amos, just as in reshus ha-rabim. And even though they are full-fledged reshus ha-yachid from the Torah, and one who throws into them from reshus ha-rabim is liable — since they are proper partitions, only that they lack dwelling — they are karmelis by the words of the Sofrim; for since they were not made for dwelling, they may be confused with reshus ha-rabim when the enclosure is large. But a small enclosure is not confused with reshus ha-rabim, and one may carry within it even though it was not enclosed for dwelling:

And what is the measure of a small enclosure? Up to and including a bes se'asayim, like the courtyard of the Mishkan, which was a hundred long and fifty wide — that is, twice fifty by fifty; and fifty by fifty is a bes se'ah, which is 2,500 square amos, and se'asayim are 5,000 square amos. And any place that contains this measure, whether it is round or perfectly square — for example, seventy amos and two-thirds plus a trifle — and Chazal did not exact concerning this, and likewise its width, whether it is long and narrow, e.g. a hundred long and fifty wide — one may carry in all of it, provided its length is not greater than twice its width by even one amah; just as the Mishkan's courtyard was not longer than twice its width by even one amah. But less than an amah is nothing and does not forbid:

And Chazal attached these measurements to those of the courtyard of the Mishkan, for all of the melachos of Shabbos and their laws we learn from the Mishkan, and the Mishkan's courtyard too was not enclosed for dwelling, yet one would carry throughout it. Therefore Chazal did not wish to forbid up to and including that measure. But beyond this measure, even by a trifle — it is forbidden to carry there except within four amos; likewise to take out from the courtyard into it and from it into the courtyard:

And even when less than this measure, it is not permitted to carry from it into the courtyard or from the courtyard into it, except utensils that rested within it or in the courtyard. But utensils that rested in the house and were brought out into the courtyard — it is forbidden to carry them into it. Likewise utensils that rested within it and were brought into the courtyard — it is forbidden to carry them into the house (and even utensils that rested in the courtyard and were brought into the house or into it — it is forbidden to carry them from one to the other unless he sets them down in the courtyard in between), since this place that was not enclosed for dwelling is a reshus of its own, separate from the house, which is a real place of dwelling.

But with the courtyard it is one reshus, even though the courtyard is called "mukaf le-dira". And even if the courtyard belongs to one person, and the karpef or a similar place that was not enclosed for dwelling belongs to another, and they did not make an eruv together — one may carry from one to the other, as will be explained in siman 372.

But to carry from the house to a karpef and the like, or from it to the house — an eruv is of no help. And even if they belong to one person, it is forbidden by the words of the Sofrim, because it is like taking out from reshus to reshus — except for the rechavah behind the houses, which is one reshus with the houses, as will be explained in siman 359:

Every place that was enclosed for dwelling — that is, for constant entry and exit — such as a dir (sheep-pen), sahar (cattle-pen) and courtyard, even if it contains several mil — one may carry in all of it, and from it to the house and from the house to it. So too the roof of a house, which is reshus ha-yachid in the manner explained in siman 345: one may carry in all of it even if it is larger than a bes se'asayim, and from the roof to the house beneath it or vice versa.

And one may carry from the roof to a karpef and the like, just as from the courtyard and the like to a karpef:

And even a karpef and the like, if its partitions were enclosed for dwelling — its status is in every respect like a courtyard, both to permit carrying within it beyond four amos, even if it is larger than a bes se'asayim, and from it to the house and from the house to it.

And what is this "mukaf le-dira" that one made within it initially? A watchman's hut in which the watchman dwells by day and by night; or one first built a dwelling-house in it — even though one does not live there permanently — and afterwards enclosed it with partitions; or even one first opened a single doorway from his house (or the doorway was already open beforehand) and afterwards enclosed three more partitions adjoining the wall of the house in which the doorway is — this is mukaf le-dira, for since it is open to a dwelling-house, it is regarded as a dwelling-house, like the courtyard of a house. Only, it is required that at the time its partitions are made, they be made for dwelling:

Therefore, if he enclosed it with partitions and afterwards built a dwelling within it, or opened to it afterwards a doorway from his house — it accomplishes nothing. And even if at the time of erecting the partitions he had the intention of doing them for that purpose, to build in it and to open to it afterwards — this is of no avail at all.

Nevertheless, it is not required that all its partitions be made for dwelling; rather, even if he enclosed it with three complete partitions, only that the fourth was breached more than ten amos — for such a breach nullifies the partitions, as will be explained in siman 362 — and before he fenced in the excess beyond ten he made in it a sukkah or a dwelling-house, or a doorway from a dwelling-house — this is mukaf le-dira. And if he built a dwelling next to this breach, and fences in the excess beyond ten, leaving the ten, which are a doorway from this dwelling — this too is mukaf le-dira.

Likewise, if it was already entirely enclosed not for dwelling, he may breach in it more than ten and fence it in for dwelling, or fence in only the excess beyond ten, and the ten amos are the doorway:

And if he breaches one amah and fences it in for dwelling, then breaches another amah and fences it in, and continues doing so until he has completed it to more than ten — it is permitted as if he had breached at once, since "new faces have come here", as with one who breaches at once and fences afterwards. And if he breached more than ten and made there a tzuras hapesach for dwelling — it is effective, like one who fences in for dwelling:

And if it is difficult for him to breach the wall, there are those who say there is a remedy by placing earth against the wall on both its sides, at a height of less than ten tefachim, the earth being four tefachim wide or more, over a length of more than ten amos along the length of the wall; and if the wall is not twenty tefachim high, so that there are not ten tefachim in the height of the wall from the height of the earth upward — it is considered as if breached there, in the place of the earth. For there is a foothold from the ground onto the earth, since it is not ten tefachim high, and anything less than ten tefachim is as if breached and completely open; and from the earth there is a foothold onto the wall, which there is not ten high, so it is as if completely breached there. And the earth should lie thus for at least one Shabbos, and before he clears it away from there he should make within it a dwelling-house or open to it a doorway from a dwelling-house; and afterwards, when he clears it away from there and the wall becomes ten high, this is as if he built it anew for dwelling. And although this is a partition that comes into being by itself, through the clearing away of the earth outside it, this does not matter, as will be explained in siman 362.

And others dispute this, saying that his having designated the earth to lie there for one Shabbos is of no use at all to nullify the wall so that it be considered breached, since he intends to clear it away from there later. And the earth can nullify the wall only if he designated it to lie there forever — and if so, with what will he fence it in for dwelling? Therefore earth is of no use unless it itself is ten tefachim high and he has distanced it from the wall by three tefachim, for then it becomes a new partition and nullifies the first partition beside it over a length of more than ten amos, as will be explained. And then it need not be four tefachim wide, nor need it be placed on both sides of the wall, but on its inner side only; on the outer side, however, it is of no use at all. And as to the halachah, in the words of the Sofrim follow the lenient:

There are those who say that ordinary karpefos of ours are mukafim le-dira, since one is accustomed to open the doorway first and then enclose. And there are still others who say that any karpef that is within the techum is called mukaf le-dira, since on Shabbos one's mind is upon it. But this is not the main view, as was explained above regarding the rechavah behind the houses, that when it exceeds a bes se'asayim it is a karmelis, and as will be explained in siman 359:

A mound (tel) ten tefachim high has the status of a karpef: up to se'asayim one may carry in all of it, because we apply gud asseq ["draw up"] its partition above ten tefachim, and behold it is enclosed. And more than a bes se'asayim, one may carry in it only within four amos, since it was not enclosed for dwelling:

A karpef larger than a bes se'asayim in which one planted trees to lessen its open space — this is no reduction, since it is the way of karpefos to have trees in them. Therefore, even if the trees were ten high and four wide, so that they constitute a reshus of their own, they do not reduce. So too pits in gardens, even ten deep and four wide — they are an appurtenance of the garden, for watering it, and they do not reduce. But something else that is not a need of the garden (and is not usually found in it) — does reduce:

But if the lower ones became absorbed and the upper remained — it becomes permitted through them, even though it is a partition that came into being by itself. But a mound greater than a bes se'asayim upon which one made partitions for dwelling — it is effective even if one did not distance them three tefachim from its edge; and although there we apply gud asseq from its partitions upward above its edge all around, so that there are partitions upon partitions — nevertheless, since he dwells in the air of these upper partitions, which he has now made for dwelling, this is mukaf le-dira, even if he made only one partition of more than ten:

A karpef larger than a bes se'asayim that was enclosed for dwelling, and one planted most of it with trees, even if they are not arranged in rows — they do not nullify the dwelling, for it is usual to shelter in the shade of the trees constantly. But if most of it was sown — the crops nullify the dwelling even if their area is not a bes se'asayim, since it is not the way to dwell among crops; and the minority that was not sown is nullified to the majority that was sown, and all of it is forbidden, as if it had not been enclosed for dwelling at all.

If a minority of it was sown: if the sown area is only a bes se'asayim — one may carry in all of it; for although in the sown place the dwelling has been nullified, it contains no more than a bes se'asayim, and the rest that was not sown is not nullified to the sown area so as to combine with it and bring it to more than a bes se'asayim, since the sown area is the minority. But it is forbidden to carry from this karpef to the house and from the house into it, for in the sown place the dwelling has been nullified, and its law is that of a karpef not enclosed for dwelling, from which one may not carry to the house, as was explained above; and if so, even in the remainder that was not sown it is forbidden, since no partition separates them and they are breached to each other in their full width. And some permit in the remainder that was not sown, for they said "a breach in its full width forbids" only when it is breached into a place forbidden in its own right, such as a full karmelis; but here, where the forbidden sown place is forbidden only on account of the house, it does not forbid the rest that was not sown, even though it is breached to it in its full width. And one should be stringent in accordance with the first view.

But if the sown minority is less than a bes se'asayim — one may carry even from within it to the house and from the house into it. And although every karpef of a bes se'asayim or of less than a bes se'asayim is alike, in that if it was not enclosed for dwelling one may not carry from it to the house, nevertheless here, where the majority is not sown and is enclosed for dwelling, the minority is nullified to it — unless it contains se'asayim, like the courtyard of the Mishkan, for then it is a significant place and is not nullified. And some forbid carrying to the house from the sown place, and permit from the place that is not sown. And as to the halachah, in the words of the Sofrim follow the lenient.

And if the sown minority is more than a bes se'asayim — it is forbidden to carry in the whole karpef except within four amos, for the sown area is a karmelis, like the law of a karpef larger than a bes se'asayim that was not enclosed for dwelling, and the rest that was not sown is breached to it in its full width.

And all this is in a karpef larger than a bes se'asayim that was sown. But if it contains only a bes se'asayim, and even if all of it was sown, there is room for doubt whether the crops nullify the dwelling. And likewise there is room for doubt regarding a courtyard or a rechavah behind the houses most of which was sown — whether the crops nullify their dwelling; for perhaps they nullify only the dwelling of a karpef larger than a bes se'asayim, which is not regarded as a dwelling to that extent, even though one enclosed it for dwelling. And one should be stringent in all this.

Therefore, one who has a sown garden in his courtyard with no proper partition between them: if the sown area is the majority of the courtyard, even if there is not a bes se'asayim in the whole courtyard together with the sown area — he should not carry from the sown area and from the courtyard to the house, nor from the house to them; for perhaps the crops nullify the dwelling of the courtyard and the minority is nullified to the majority, and the whole courtyard is then like a karpef not enclosed for dwelling, from which, even if it is less than a bes se'asayim, one may not carry to the house. And if the whole courtyard together with the sown area is more than a bes se'asayim — one may not carry in the whole courtyard except within four amos, like the law of a karpef larger than a bes se'asayim that was not enclosed for dwelling. And although the courtyard is enclosed for dwelling, it combines with the sown area within it to bring it to more than a bes se'asayim, since it is nullified to it, being the minority.

And if the sown area is the minority of the courtyard: if it alone contains more than a bes se'asayim — it forbids the whole courtyard, so that one may carry in it only within four amos, since the courtyard is breached to it in its full width. And if it contains only a bes se'asayim — one should be stringent not to carry from any part of the courtyard to the house. And if it does not contain a bes se'asayim — one may be lenient even to carry from the sown area to the house or vice versa:

But if there is between them a partition as required by law, the sown area does not forbid the courtyard at all; only, if the sown area is more than a bes se'asayim — it is forbidden to carry from the courtyard into it, even within four amos. And if it is a bes se'asayim or less — it is permitted with utensils that rested in it or in the courtyard, but not with utensils that rested in the house. Therefore it is fitting not to eat or drink in a garden on Shabbos, since it is impossible to be careful in this, and "enclosing for dwelling" is of no avail in a garden, since the crops nullify the dwelling, as was explained:

A karpef larger than a bes se'asayim that was enclosed for dwelling and into which water entered: if it is fit for drinking — it does not nullify the dwelling, for there is no finer dwelling than this; and even if the place over which it spread is more than a bes se'asayim, even if it is very deep.

And if it is not fit for drinking — its status is like that of crops, provided its depth is ten tefachim. But if its depth is not ten tefachim, it is like mud and puddles (tit ve-rekak), which do not constitute a reshus of their own.

And when its depth is ten tefachim, if the ten tefachim are gathered within a span of four amos — the water itself is regarded as a partition between it and the rest of the karpef, as was explained in simanim 345 and 356, and the rest of the karpef is not forbidden on account of being breached to it in its full width:

A karpef of three se'in that was not enclosed for dwelling, and a bes se'ah of it was roofed — one may carry in all of it (for we view the edge of the roofing as though it were a partition descending and sealing, separating the two bes se'in from the third). And even if the roofing is sloped (regarding which we do not say "the edge of the roof descends and seals", as will be explained in siman 361 — here they were lenient), nevertheless we view it as though there were a full partition at the end of the roofing:

A karpef of an exact bes se'asayim that was not enclosed for dwelling, which was breached in its full width onto a courtyard — the karpef is forbidden, since the place of the breached partition adds to it, and it becomes greater than a bes se'asayim. And the courtyard is permitted if this breach is not in its full width and is not more than ten amos (for instance, where the karpef is narrow here and further on gradually widens; for otherwise its length would exceed twice its width, and one may not carry in it except within four amos even if it was not breached at all).

But if it was not breached in its full width, but wall-stubs (gipufin) remained on either side, the place of the breach does not add to it, since the inner edge of the gipufin descends and seals, and from their inner edge outward it is a reshus of its own — for which reason it is forbidden to carry from the house to the threshold if there is no lintel four wide above it, as was explained in siman 346.

(And even if it was breached in its full width — it is forbidden only if the walls along its length protrude and enter into the space of the courtyard, and are three tefachim away there from the walls along the courtyard's length; for otherwise it is permitted by means of the gipufin of the courtyard, as will be explained in siman 360):

A karpef larger than a bes se'asayim that was not enclosed for dwelling, and afterwards he opened in it a doorway from a dwelling-house — which doorway is of no use — and afterwards he made a second partition of more than ten, and it was permitted through this [second] partition, made after the opening of the doorway, through which the first partition, which had not been made for dwelling, was nullified; and afterwards this second partition fell — it returns to its prohibition, and we do not say of it "since it was permitted — it remains permitted", so that the first partition would now be effective for it:

The Rav's special chiddushim on this siman

Originalities distinguishing the Alter Rebbe on siman שנ״ח. Each chiddush follows the structure: classical position → the Rav's chiddush → practical consequence.

Intent creates reshus hayachid (358:1-5)

The intention of dwelling as the criterion

The Rav's chiddush: the Alter Rebbe articulates: it is not the physics of the fence that decides, but the human intention behind it (dwelling or not).

Practical consequence: Knowing the status of every enclosed space by its actual use.

Practical Chabad halacha

Points of halachic conduct flowing directly from the Shulchan Aruch of the Alter Rebbe siman שנ״ח, in the Chabad sensibility.

For the Chabad chassid — Siman

  • ① Mukafim le-dira (enclosed for dwelling) = reshus hayachid. The Rav's chiddush א. Reference: Shulchan Aruch HaRav 358:1-5.
  • ② Not enclosed for dwelling (garden without a house) = different status. Reference: Shulchan Aruch HaRav 358:6-15.
