Siman 155 — Being healed by a non-Jew

Three seifim — the Shulchan Arukh says so itself: ובו ג׳ סעיפים. The siman is not about medicine: it is about what a sick person accepts in order to be healed. In whose hands does he place his body when the illness is grave? By what means does he consent to be treated? And of what substance may the remedy be made? (Shulchan Arukh, Yoreh De'ah 155 — 3 seifim)

Every wound and every illness that carries danger, those for which one desecrates the Sabbath — one is not healed of them by a non-Jew who is not an expert recognised by the public. The siman opens with the measure: it is not medicine that says when the question arises, it is the Sabbath.

Frequently asked questions — Siman 155

May one be treated by a non-Jewish physician?

The seif does not speak of every treatment: it addresses an illness grave enough that one desecrates the Sabbath for it, and it then forbids being healed by a non-Jew who is not an expert recognised by the public. The Shakh (ס״ק ג) gives the reason: a craftsman does not ruin his craft. And the Rama adds that where there is payment it is permitted in every case, and that such is the custom. Why is the doubt treated more strictly than certain death?

Because the calculation changes. As long as a chance of living remains, accepting treatment from a man whose hand one fears is a plain risk; when death is certain there is nothing left to lose, and a brief span of life is not taken into account. The Taz (ס״ק ב) reports Tosafot’s answer to the difficulty this raises with Yoma: here and there, we act for his benefit. For application to your situation, consult your Rav.

May one follow a non-Jew’s advice about a drug?

Yes — the advice, but not the purchase. The Shakh explains the permission (ס״ק ד) by his fear that others may be asked too, and the prohibition (ס״ק ה) by what a seller is capable of in order to sell. The Baer Hetev (ס״ק ב) joins the two. For application to your situation, consult your Rav.

What does the siman say about healing by incantation or invocation?

A plain incantation is permitted, because it exposes the body to nothing (Shakh ס״ק ז). But once one knows it names an idol it is forbidden — even if one knows one will die without it; and the Rama adds that one does not learn it either. This is the harshest clause in the siman, and it exactly reverses the rule of the dying man. For application to your situation, consult your Rav.

May one take a medicine containing a forbidden substance?

Seif 3 proceeds in two questions. Where there is danger, one is healed with all the Torah’s prohibitions except the three the Rambam names. Where there is no danger, everything turns on the manner of enjoyment — and kilei hakerem and meat in milk remain forbidden even outside that manner. The Rama’s gloss finally closes the door: nothing forbidden is permitted if the remedy exists in a permitted form. For application to your situation, consult your Rav.
