Siman 159 — Lending at interest to a non-Jew and to an apostate
Three seifim — the Shulhan Arukh says so itself: ובו ג׳ סעיפים. This is the first siman of the laws of interest, which run through siman 177. It opens not with a prohibition but with a permission: to whom may one lend at interest, and from whom may one not borrow. The non-Jew, the apostate, and then the Kutim, the Karaites and the captive child. (Shulchan Arukh, Yoreh De'ah 159 — 3 seifim)
דבר תורה מותר להלוות לעובד כוכבים ברבית
By Torah law it is permitted to lend to a non-Jew at interest. Six words, and the whole block of the laws of interest opens with a permission: the prohibition binds only between brothers.

Why is it permitted to lend at interest to a non-Jew?
The seif opens with Torah law:
« דבר תורה מותר להלוות לעובד כוכבים ברבית » (שו״ע יו״ד קנ״ט:א) And the Tur gives the reason:
« דבר תורה מותר להלוות לעובד כוכבים ברבית דטעמא דרבית דכתיב וחי אחיך עמך ועובד כוכבים לא היו מצווין להחיותו » (טור יו״ד קנ״ט) For practical application, consult your Rav.
If the Torah permits it, why had the Sages forbidden it — and why is it permitted today?
The decree and its three exceptions are in the seif:
« וחכמים אסרוהו אם לא כדי חייו או לת״ח או ברבית דרבנן והאידנא מותר » (שו״ע יו״ד קנ״ט:א) The Shakh gives the reason:
« וחכמים אסרו. משום גזירה שמא ילמוד ממעשיו ובת״ח ליכא למיחש להכי » (ש״ך יו״ד קנ״ט ס״ק א) And he explains why it no longer holds:
« אם כן לא שייך ברבית שמא ילמוד ממעשיו טפי משאר משא ומתן » (ש״ך יו״ד קנ״ט ס״ק ב) For practical application, consult your Rav.
May one lend at interest to a Jew who has become an apostate?
Seif 2 permits it, and forbids the reverse:
« מומר מותר להלוותו ברבית ואסור ללוות ממנו ברבית » (שו״ע יו״ד קנ״ט:ב) But the gloss holds to a stringency:
« ויש מחמירין אף במומר להלוותו (המרדכי והגהות מיימוני בשם ראבי״ה ורש״י וסמ״ג ובמהרי״ל) וטוב להחמיר אם אפשר להשמט ממנו » (רמ״א יו״ד קנ״ט:ב) And the Pithei Teshuva specifies what that stringency means:
« עיין בתשובת תפארת צבי שם שכתב דעכ״פ ודאי דאסור להלוות לו בלא רבית וכן מוכח לשון רמ״א שכתב אם יכול להשמט אבל בלא רבית אסור רק לא ילוה כלל » (פתחי תשובה יו״ד קנ״ט ס״ק ד) For practical application, consult your Rav.
Why may one not borrow at interest from an apostate, if one may lend to him?
The Shakh gives the two prohibitions:
« ואסור ללוות ממנו. משום לא תשיך ומשום לפני עור לא תתן מכשול » (ש״ך יו״ד קנ״ט ס״ק ג) And the Taz explains the asymmetry:
« אבל להלוות ממנו ולתת לו רבית ודאי אסור שהרי הוא עושה איסור במה שלוקח ממך א״כ שייך בנותנו משום לא תשיך לאחיך דאעפ״י שחטא ישראל הוא » (ט״ז יו״ד קנ״ט ס״ק ג) For practical application, consult your Rav.
Seif 3 speaks of Kutim and Karaites: what remains of that distinction?
The seif states the two statuses:
« כותיים יש להם דין מומר לעבודת כוכבים. הקראים אין להם דין מומרים ואסור להלוותם ברבית » (שו״ע יו״ד קנ״ט:ג) The Shakh disputes the consequence drawn for the Kutim:
« אלא ודאי הם עובדי כוכבים גמורים לכל דבר ואם כן מותר להלוות מהן גם כן ברבית » (ש״ך יו״ד קנ״ט ס״ק ה) And the Pithei Teshuva answers him:
« ועיין בתשובת תפארת צבי שם שתמה עליו דנהי דעשאום כעובדי כוכבים אף להקל מ״מ מי הפקיע אותם מהמצות דנימא דאינם מצווים שום דבר דלא נעבור על לפ״ע והעלה להחמיר דאסור ללוות מהם ברבית » (פתחי תשובה יו״ד קנ״ט ס״ק ה) For practical application, consult your Rav.
