Interest of the Torah, which is by way of a loan and for a fixed amount, comes out through the judges. Two conditions, and they decide everything that follows: the way of a loan, and the sum fixed at the time of the loan.

What is the difference between רבית קצוצה and אבק רבית?
Seif 5 defines Torah interest by two conditions:
« רבית דאורייתא שהוא בדרך הלואה בדבר קצוב יוצאה בדיינים » (שו״ע יו״ד קס״א:ה)
And the Rema’s gloss says what all the rest is:
« כללא דרבית דכל שהוא אגר נטר אסור בין שהוא דרך מקח בין שהוא דרך הלואה אלא שבדרך מקח אינו רק אבק רבית שהוא מדרבנן » (רמ״א יו״ד קס״א:א)
Stipulated interest — loan and fixed sum — is of the Torah and is recovered at law. Every other wage for waiting is only “dust of interest”, rabbinic. For the application to your own case, ask your Rav.
If dust of interest is not recovered at law, may one keep it?
No, and the seif says so in the same sentence:
« אבק רבית אינה יוצאת בדיינים ואם בא לצאת ידי שמים חייב להחזיר » (שו״ע יו״ד קס״א:ב)
“Not recoverable” never means “permitted to keep”. The gloss excepts only interest paid in advance and interest paid afterwards. For the application to your own case, ask your Rav.
Why is dust of interest not recovered?
Seif 4 gives the reason, and it is not that the thing became licit:
« לא אמרו דאבק רבית אינה יוצאה בדיינים אלא בשאכל המלוה מדעת הלוה » (שו״ע יו״ד קס״א:ד)
Remove the consent, and it becomes recoverable again:
« אבל אם קודם שאכל טען עליו שלא יאכל והוא הוציא ממנו על כרחו בדיני העובדי כוכבים או בדיין ישראל שטעה והכריחו לשלם יוצאה בדיינים » (שו״ע יו״ד קס״א:ד)
It is the borrower’s consent that protects the lender. A sum extorted, or obtained from a judge who erred, is recovered. For the application to your own case, ask your Rav.
What exactly does “it comes out through the judges” mean?
The seif states the enforcement and its limit together:
« שהיו כופין ומכין אותו עד שתצא נפשו אבל אין בית דין יורדין לנכסיו » (שו״ע יו״ד קס״א:ה)
The Beit Yosef explains:
« דהא דאמרינן יוצאה בדיינים היינו לומר דכופין אותו משום מ״ע דוחי אחיך עמך ומכין אותו עד שתצא נפשו כדי שיקיים המצוה אבל אין ב״ד יורדין לנכסיו » (בית יוסף יו״ד קס״א)
And the Shach names the commandment:
« כדין שאר מצות עשה דכתיב וחי אחיך עמך » (ש״ך יו״ד קס״א ס״ק ז)
It is not the execution of a debt but coercion applied to bring about the fulfilment of a positive commandment — hence the absence of any seizure of property. For the application to your own case, ask your Rav.
Must a lender’s heirs return the interest he had taken?
Seif 6 is clear, and it lays down two conditions:
« לקח רבית קצוצה ומת אין הבנים צריכים להחזיר אלא אם כן היה דבר מסויים כגון פרה וטלית ועשה אביהם תשובה ולא הספיק להחזיר עד שמת » (שו״ע יו״ד קס״א:ו)
The Shach gives the reason:
« שאז חייבים להחזיר משום כבוד אביהם » (ש״ך יו״ד קס״א ס״ק י)
They owe nothing, unless the object is still identifiable in kind and their father had set about making amends. It is not an inherited debt but their father’s honour. For the application to your own case, ask your Rav.
What is collected from a deed that carries interest?
Seif 11 distinguishes according to the legibility of the deed:
« שטר שיש בו רבית בין של תורה בין של דבריהם גובה את הקרן לבדו והוא שיהא ניכר שהוא רבית » (שו״ע יו״ד קס״א:י״א)
And if the two are merged:
« אבל אם אינו מפורש אלא שכולל הקרן עם הרבית אינו גובה בו אפילו הקרן » (שו״ע יו״ד קס״א:י״א)
The principal alone, if the interest is recognizable — and the deed must nonetheless be torn. If principal and interest are merged into a single figure, nothing is collectible, not even the principal. For the application to your own case, ask your Rav.
