Siman 164 — The pledged field and the lease returned to the debtor
Four seifim — the Shulhan Arukh’s heading announces five, and the Hebrew editions serve four, the missing break falling inside the last block. A lender holding a field in pledge does not lease it back to its owner; an interposed third party changes the reading; a complete sale opens the one plainly permitted route; and the field promised “mine in three years” is never acquired. מי שהיתה שדה ממושכנת בידו לא יחזור וישכיר אותה לבעל השדה
One who held a field in pledge shall not turn round and rent it to the owner of the field. Eleven words, and the whole siman is set: it is not the rent that is at issue, but who pays it.

May a lender rent to the debtor the property the debtor pledged to him?
The seif lays down the prohibition:
« מי שהיתה שדה ממושכנת בידו לא יחזור וישכיר אותה לבעל השדה » (שו״ע יו״ד קס״ד:א)
« וְכֵן מִי שֶׁהָיְתָה שָׂדֶה מְמֻשְׁכֶּנֶת בְּיָדוֹ לֹא יַחְזֹר וְיַשְׂכִּיר אוֹתָהּ לְבַעַל הַשָּׂדֶה מִפְּנֵי הַעֲרָמַת רִבִּית » (רמב״ם הלכות מלווה ולווה פרק ה׳ הלכה ט״ו)
« אפילו כתוב בשטר ששהתה בידה מלוה זמן רב קודם שהחכירהו ללוה. טור. פי׳ ואפילו האמת נמי הכי ששהתה זמן רב בידו אסור » (ש״ך יו״ד קס״ד ס״ק א)

What conditions does the Rama’s gloss add?
The two conditions:
« ובלבד שלא התנה מתחילה על כך » (רמ״א יו״ד קס״ד:א)
« וגם שכבר החזיק המלוה בשדה אבל בלאו הכי לכולי עלמא אסור » (רמ״א יו״ד קס״ד:א)
« וכל שכן אם לא החזיק בה כלל המלוה דלא קנאה כלל ולא הוה כאן רק הלואה בעלמא » (ט״ז יו״ד קס״ד ס״ק א)

What does the intervention of a third party change?
The seif, and the Beit Yosef’s reason:
« משכנתא דסורא אם בא אחר ושכר אותה מהמלוה מותר לחזור ולהשכיר אותה לבעל השדה » (שו״ע יו״ד קס״ד:ב)
« מיהו אם בא אחר לחכרה מהמלוה יכול לוה לחכרה מיניה דכיון דאפסקיה אחר שרי » (בית יוסף יו״ד קס״ד)
« תמוה הוא הא פסק בסעיף א׳ דיש מי שמתיר במשכנתא דסורא דהיינו אפילו ללוה עצמו » (ט״ז יו״ד קס״ד ס״ק ד)

Why is the sale of seif 3 permitted, and on what condition?
The seif, the reason, and the condition:
« מותר למכור שדהו לאחד ולהתנות עמו שיחכירנו » (שו״ע יו״ד קס״ד:ג)
« אבל בכאן שגוף הבית מכור לו לגמרי יכול הוא להשכירו או להחכירו אח״כ למי שירצה ואף למוכר עצמו » (בית יוסף יו״ד קס״ד)
« ופשוט הוא גם כאן שצריך שיקנה הלוקח הבית תחילה בקנין גמור כדרך שהמכירה נקנית בעלמא דאם לא כן הוה כהלואה ואסור » (ט״ז יו״ד קס״ד ס״ק ה)

Does the field promised “mine if you do not pay within three years” become the lender’s?
The seif and its gloss:
