Siman 163 — Converting a debt into wheat at today’s rate
Three seifim — the Shulchan Arukh announces it itself: ובו ג׳ סעיפים. In the previous siman wheat was lent; here money is owed, and that debt is converted into wheat at the day’s price. The mechanism is the same and the answer reverses: the commodity is needed for the full amount, and no market rate stands in for it. The reason is that a sum was lent first. אם יש לו חטים כשיעור מעותיו מותר
If he has wheat to the measure of his money, it is permitted. Eight words, and the whole difference from the previous siman: there a single measure sufficed for a hundred; here the full measure is needed, because the money went first.

May a money debt be paid in goods, at today’s rate?
The seif answers with a single condition: the debtor must have the goods, for the whole amount.

Why is the full measure needed here, when a single se’ah sufficed at siman 162?
Because it is no longer a loan but a sale: a loan rolls on itself, a sale bears only on what exists. The Shach says it in one sentence:
« ול״ד לדלעיל סי׳ קס״ב ס״ב דביש לו מעט מאותו המין לוה עליו כמה סאין דהתם כיון שלוה סאה אנו רואין כאילו לוה סאה כנגד סאה שיש לו וכן לעולם אבל במכירה אין המכירה חלה אלא על מה שיש לו » (ש״ך יו״ד קס״ג ס״ק ב)
And the Taz describes the previous siman’s mechanism to show it cannot operate here:

Why is it permitted even when the goods have no market rate?
Because the goods are acquired to the creditor from now: were the debtor to retract, he would fall under מי שפרע. That is Rashi’s reason, which the Shach reports:
« משום דזכי ביה מהשתא ואע״ג דלא משיך כי מייקרי ברשותיה מייקרי ולא ה״ל רבית הואיל ואם בא לחזור קאי עלייהו במי שפרע » (ש״ך יו״ד קס״ג ס״ק ג) For the application to your own situation, consult your Rav.
And if the debtor has no goods but has the money to buy them?
This is the most disputed question in the siman. The Shach, with the Beit Yosef, the Darkhei Moshe and the Bach, forbids:
« דוקא אם יש לו חטים אבל אם יש לו מעות כשיעור שיכול לקנות בהן חטים אסור » (ש״ך יו״ד קס״ג ס״ק א)
The Taz demonstrates the contrary at length, then himself refuses to draw a leniency from it:
« והנראה לע״ד כתבתי להלכה ולא למעשה להקל כיון שהוא מחמיר » (ט״ז יו״ד קס״ג ס״ק ד) For the application to your own situation, consult your Rav.
What is the הערמת רבית of seif 3?
An arrangement each of whose steps is lawful and whose whole comes to returning a hundred for ninety. The seif gives the sequence, then the way out:
« אמר לו הלויני מנה א״ל מנה אין לי חטים במנה יש לי ונתן לו חטים במנה כמו שהוא השער וחזר ולקחם ממנו בצ » (שו״ע יו״ד קס״ג:ג)
« אם פרע לו לבסוף המנה בפירות מותר אבל אסור לפרוע במעות מפני הערמת רבית מאחר שא״ל תחלה הלויני מנה » (שו״ע יו״ד קס״ג:ג)
And the Shach specifies what decides everything — the first words spoken:

If the arrangement was carried out, does the court make the difference be returned?
The Mehaber, following the Rambam, says no: the creditor recovers the hundred.
« ואם עבר ועשה הרי הוא מוציא ממנו ק׳ בדין שאפי׳ אבק רבית אין כאן » (שו״ע יו״ד קס״ג:ג)
The gloss reports the contrary view, in the name of the Ramban and the Rosh:
« וי״א דהוי אבק רבית » (רמ״א יו״ד קס״ג:ג)
And the Beit Yosef, in the last line of his commentary, decides:
