Siman 166 — The lender, his debtor’s slave, and his debtor’s courtyard

Three seifim — the Shulchan Arukh announces it itself: ובו ג׳ סעיפים. Not once is a sum added to the principal: here interest takes the shape of work one has done, of lodging one does not pay for, of rent charged below its value. The siman sorts these benefits into three regimes — forbidden from the outset, אבק רבית, רבית קצוצה — and states for each what a court may, and may not, recover (Shulchan Arukh, Yoreh De'ah 166 — 3 seifim)

המלוה את חבירו לא יעשה מלאכה בעבדו אפילו הוא בטל ולא ידור בחצרו חנם ולא ישכור ממנו בפחות

One who lends to his fellow may not have his slave do work, even if the slave is idle; he may not dwell in his courtyard for free; and he may not rent from him for less. The Mehaber does not write the reason here; the mishnah in Bava Metzia writes it in three words: מפני שהוא רבית — because it is interest.

I have just lent money to a friend: may I stay in his home for free?

No — and the Shulchan Arukh writes it at once, without distinguishing:

« המלוה את חבירו לא יעשה מלאכה בעבדו אפילו הוא בטל ולא ידור בחצרו חנם ולא ישכור ממנו בפחות » (שו״ע יו״ד קס״ו:א)
« הַמַּלְוֶה אֶת חֲבֵירוֹ לֹא יָדוּר בַּחֲצֵרוֹ חִנָּם, וְלֹא יִשְׂכּוֹר מִמֶּנּוּ בְּפָחוֹת – מִפְּנֵי שֶׁהוּא רִבִּית » (בבא מציעא ס״ד ע״ב)
The Taz explains why what was permitted yesterday is not permitted today: before the loan, putting the slave to work was even a favour to his master.
« ואי לא הלוה לו היה מותר דניחא למריה דההוא עבד שלא ילמוד דרך הבטלה כדאיתא בח״מ סימן שס״ג מ״מ הכא דהלוהו מחזי כרבית » (ט״ז יו״ד קס״ו ס״ק א)

And if his courtyard is not held for rental at all?

The prohibition still stands — that is precisely what seif 1 adds:

« אפילו בחצר דלא קיימא לאגרא (פירוש שאינה עומדת להשתכר) וגברא דלא עביד למיגר » (שו״ע יו״ד קס״ו:א)
After the fact, however, two views divide: the Mehaber gives the Ramban’s first, then the Rambam’s.
« ואם דר בו כבר כיון דחצר לא קיימא לאגרא אין צריך לתת לו אפילו לצאת ידי שמים ואפילו אם הוא גברא דעביד למיגר ולהרמב״ם אפילו אם גברא דלא עביד למגר הוי אבק רבית וצריך להחזיר אם בא לצאת ידי שמים » (שו״ע יו״ד קס״ו:א)
« וְאִם דָּר צָרִיךְ לְהַעֲלוֹת לוֹ שָׂכָר. וְאִם לֹא הֶעֱלָה לוֹ הֲרֵי זֶה אֲבַק רִבִּית לְפִי שֶׁלֹּא הִתְנָה עִמּוֹ שֶׁיַּלְוֵהוּ וְיָדוּר בַּחֲצֵרו » (רמב״ם הלכות מלווה ולווה פרק ו׳ הלכה ב׳)

What is the difference between רבית קצוצה and אבק רבית?

The Rambam gives it in one line, and it is entirely a difference of court:

« שְׁטָר שֶׁכָּתוּב בּוֹ רִבִּית בֵּין קְצוּצָה בֵּין שֶׁל דִּבְרֵיהֶם גּוֹבֶה אֶת הַקֶּרֶן וְאֵינוֹ גּוֹבֶה אֶת הָרִבִּית. קָדַם וְגָבָה הַכּל מוֹצִיאִין מִמֶּנּוּ הָרִבִּית קְצוּצָה » (רמב״ם הלכות מלווה ולווה פרק ד׳ הלכה ו׳)
« אֲבָל אֲבַק רִבִּית שֶׁהוּא מִדִּבְרֵיהֶם אֵינוֹ גּוֹבֶה מִן הַלּוֶֹה לַמַּלְוֶה וְאֵין מַחֲזִירִין אוֹתוֹ מִן הַמַּלְוֶה לַלּוֶֹה » (רמב״ם הלכות מלווה ולווה פרק ד׳ הלכה ו׳)
Seif 2 applies these two regimes to the very same lodging, according to whether the courtyard is held for rental.

What if he himself says: “lend me and dwell in my courtyard”?

Then the benefit was stipulated, and seif 2 rules according to the courtyard:

« אמר ליה הלוני ודור בחצרי אי קיימא לאגרא הוי רבית קצוצה ואי לא קיימא לאגרא הוי אבק רבית » (שו״ע יו״ד קס״ו:ב)
The Rama adds a decisive clause: once he says “in exchange for your money”, the courtyard is deemed rented out.
« ודוקא בסתם אבל אם אמר לו דור בחצרי בשכר הלואה אפי׳ לא קיימא לאגרא הוי כרבית קצוצה דמאחר שאמר לו בשכר מעותיך הוה ליה כאלו השכירו לו עכשיו » (שו״ע יו״ד קס״ו:ב)

May the borrower deduct the rent from what he still owes?

That is the question of seif 3, and the Rama rules for the second opinion:

« היכא דהוי אבק רבית יש אומרים שאפילו אם לא פרעו עדיין ותובע הלוה שינכה לו מחובו שיעור השכירות לא מנכינן ליה ויש אומרים דמנכינן ליה » (שו״ע יו״ד קס״ו:ג)
« והסברא אחרונה היא עיקר (היא סברת הרא״ש והטור ור׳ אפרים ורשב״א) » (שו״ע יו״ד קס״ו:ג)
The Pitchei Teshuva gives its limit: the deduction holds against the lender, not against other creditors.
« עיין בתשובת נו״ב תניינא חי״ד סי׳ ע״ו שכתב דדוקא בכה״ג שהלוה טוען שינכה לו בזה הכריע הרמ״א כסברא אחרונה כיון דהלוה נקרא מוחזק והמלוה בא להוציאה ממנו אבל נגד שאר בעלי חובות אין נקראים מוחזקים נגד בעל חוב זה ולא מנכינן ליה » (פתחי תשובה יו״ד קס״ו ס״ק ג)
