Siman 178 — Not following the customs of the nations
Three seifim. The siman is short and carries the principle of the whole block that follows: on what condition does a usage coming from the nations become a ḥok one may not follow? Seif 1 enumerates — garment, hair, building — and then the Rama’s gloss gives the criterion: licentiousness, or the absence of a reason. Seif 2 wholly exempts one close to the government. Seif 3 leaves dress for the table and forbids setting a whole loaf there beside the crumbs. (Shulchan Arukh, Yoreh De’ah 178 — 3 seifim)

One does not follow the customs of non-Jews, and one does not resemble them. Nine words, and the whole siman is set: it is not the usage that is judged but what it means.

The seif enumerates forms, and the Rama’s gloss gives the criterion:

« וכל זה אינו אסור אלא בדבר שנהגו בו העובדי כוכבים לשם פריצות כגון שנהגו ללבוש מלבושים אדומים והוא מלבוש שרים וכדומה לזה ממלבושי הפריצות » (רמ״א יו״ד קע״ח:א)
« או בדבר שנהגו למנהג ולחוק ואין טעם בדבר דאיכא למיחש ביה משום דרכי האמורי ושיש בו שמץ עבודת כוכבים מאבותיהם » (רמ״א יו״ד קע״ח:א)
Two signs make a usage forbidden: a mark of licentiousness, or the absence of any reason — in which case one suspects the ways of the Emorites and a trace of ancient worship. For the application to your situation, ask your Rav.
Is everything that comes from them forbidden, then?
No, and the gloss says so expressly:
« אבל דבר שנהגו לתועלת כגון שדרכן שכל מי שהוא רופא מומחה יש לו מלבוש מיוחד שניכר בו שהוא רופא אומן מותר ללובשו » (רמ״א יו״ד קע״ח:א)
« וכן שעושין משום כבוד או טעם אחר מותר » (רמ״א יו״ד קע״ח:א)
« לכן אמרו שורפין על המלכים ואין בו משום דרכי האמורי » (רמ״א יו״ד קע״ח:א)
A usage adopted for a benefit is permitted — the Rama chooses the example of the physician’s distinctive garment — and likewise what is done out of honour. He closes with what is burned for kings, which the Taz explains as their utensils, out of regard for them. For the application to your situation, ask your Rav.
Which haircuts does the siman aim at?
Two are named, and a third reading is proposed by the Taz:
« ולא יגלח מהצדדין ויניח השער באמצע ולא יגלח השער מכנגד פניו מאוזן לאוזן ויניח הפרע » (שו״ע יו״ד קע״ח:א)
« אבל הב״ח חלק עליו וכתב דמלתא באפי נפשה היא דלא יגדל ציצת ראשו הוא שמגדלין השער לנוי וליופי כמו הבתולות דרך שחץ וגאוה וכ״כ הפרישה: » (ש״ך יו״ד קע״ח ס״ק א)
« זה דברי רמב״ם נראה דאף בלא שום גילוח נאמר איסור זה דהיינו שדרך העובדי כוכבים בעלי מלחמות בהרבה מדינות לגדל שער שלהם מאד ואינם מגלחים עצמם כלל לא יעשה כן ישראל » (ט״ז יו״ד קע״ח ס״ק א)
The sides shaved with the hair left in the middle — the bellorit — and the front shaved from ear to ear with the hair behind. The Bach and the Prisha read the first clause as a rule of its own: growing the hair for beauty. The Taz sees in it the never-cut hair of fighting men. May one build a hall on the model of theirs?
The seif forbids, and the Bach restricts:
« ולא יבנה מקומות כבנין היכלות של עבודת כוכבים כדי שיכנסו בהם רבים כמו שהם עושים » (שו״ע יו״ד קע״ח:א)
« אבל כגון אותם העשוים לועד שלהם להתיעץ על עסקיהם ולמשפט אין איסור לבנות כתבנית אותם היכלות. » (ש״ך יו״ד קע״ח ס״ק ב)
« כתב על זה הראב״ד איני יודע מהו זה אם שלא יעשה צורות כמו שהם עושים או שלא ישים סימן לקבץ בו הרבים כדרך שהם עושים עכ״ל על כן יש לאסור בשניהם: » (ט״ז יו״ד קע״ח ס״ק ג)
What is forbidden is building a place made like their cultic halls so that many may gather there. The Bach removes council, business and court buildings from the prohibition; the Taz, on the Raavad’s words, holds that one must forbid on both possible readings. What does the siman find wrong with a whole loaf set on the table?
Seif 3 aims at a precise act, and the Taz gives its reason:
« מי שאכל ושייר פתיתין על שלחנו לא יביא פת שלימה ויניח על השלחן: » (שו״ע יו״ד קע״ח:ג)
« משום שנאמר העורכים לגד שלחן פירוש לשם עבודת כוכבים אבל בפתיתין לחוד יש מצוה להניחם שיהא מוכן לעני: » (ט״ז יו״ד קע״ח ס״ק ו)
« משמע דוקא להביא שם ולהניחו אצל הפתיתין אסור משום העורכים לגד שלחן אבל אם היה שם א״צ להסירו » (ש״ך יו״ד קע״ח ס״ק ה)
Bringing a whole loaf to set beside the crumbs after the meal leaves a place laid — and that is what is forbidden, as “those who set a table for Gad”. A loaf that was already there need not be removed, and crumbs left alone are a mitzva, for they stay ready for a poor man. For the application to your situation, ask your Rav.
