Level 4 — Daat HaRav (the Alter Rebbe) — Siman כ״א (ציציות שנפסקו וטליתות ישנים)

The way of the Alter Rebbe on the cut tsitsit and the worn talits: the tsitsit as תַּשְׁמִישֵׁי מִצְוָה (without kedousha of the body — יָכוֹל לְזָרְקָן), the בִּזּוּי מִצְוָה as long as they are fixed to the talit, the hiddour of the בַּעֲלֵי הַנֶּפֶשׁ (geniza, or placing them in a sefer — הוֹאִיל וְנַעֲשָׂה בָּהֶם מִצְוָה אַחַת יַעֲשׂוּ בָּהֶן מִצְוָה אַחֶרֶת), the בֵּית הַכִּסֵּא and sleep in a talit (מַלְבּוּשׁ / מְיֻחָד לְהִתְפַּלֵּל, the kittel of Yom Kippur), laundering by a נָכְרִי, and the care not to drag one’s tsitsit — in the sensibility of Chabad.

Why a Level 4 dedicated to the Alter Rebbe? The Shulchan Aruch of the Alter Rebbe is not a commentary on the Mehaber (מחבר) — it is an autonomous and complete Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Chabad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity: it combines halacha (הלכה) + the reasons of the mitzvot (טעמי המצוות) + the inner dimension in a single work, and it rules with a unique Talmudic rigor.

For Chabad, the Alter Rebbe is הפוסק האחרון — his ruling is the decisive authority. The Rebbe explicitly instructed to study the Shulchan Aruch of the Alter Rebbe (שולחן ערוך הרב) seriously. The tsitsit — תַּשְׁמִישֵׁי מִצְוָה, without kedousha of the body. The tsitsit are תַּשְׁמִישֵׁי מִצְוָה — that is, they have in themselves no kedousha; one only makes use of them for the sake of a mitzva. Therefore, after they have been cut from the talit — one may throw them away, even into the rubbish (אַשְׁפָּה). But as long as they are fixed to the talit — it is forbidden to make use of them for any profane use, for example to tie anything with them — מִשּׁוּם בִּזּוּי מִצְוָה. And there are those who say (יֵשׁ אוֹמְרִים) that even after they have been cut, one shall not treat them with contempt by throwing them into the rubbish or in any degrading place (but one may throw them in a non-degrading place), and it is not necessary to place them in geniza, since they have no kedousha. And although the halacha is like the first opinion, nevertheless one who is stringent and meticulous in the mitzvot — תָּבוֹא עָלָיו בְּרָכָה. And there are בַּעֲלֵי הַנֶּפֶשׁ who go so far as to place them in geniza or to place them in a sefer as a bookmarksince a mitzva was performed with them, let another mitzva be performed with them. The Rav’s חידוש: he makes explicit the טעם (« שֶׁאֵין בְּעַצְמָן שׁוּם קְדֻשָּׁה ») and grades three tiers — the din (to throw away, even into the אַשְׁפָּה), the מַחֲמִיר (not in a degrading place — תָּבוֹא עָלָיו בְּרָכָה), and the בַּעֲלֵי הַנֶּפֶשׁ (geniza, or a bookmark in a sefer — הוֹאִיל וְנַעֲשָׂה בָּהֶם מִצְוָה אַחַת יַעֲשׂוּ בָּהֶן מִצְוָה אַחֶרֶת).

The worn mitzva talits — אָדָם בּוֹדֵל אֶת עַצְמוֹ מֵהֶן. The mitzva talits that have worn out — a person withdraws from them: it is not permitted for him to wipe himself with them (קִנּוּחַ), nor to use them for any degrading use (תַּשְׁמִישׁ מְגֻנֶּה); but he throws them away, and they wear out of themselves (כָּלִין מֵאֲלֵיהֶן). The Rav’s חידוש: even without kedousha of the body, the worn mitzva garment retains a dignity — the conduct is the בּוֹדֵל (withdrawing from degrading uses), not the geniza: one throws it away with dignity and it vanishes of itself.

The בֵּית הַכִּסֵּא — the distinction מַלְבּוּשׁ / מְיֻחָד לְהִתְפַּלֵּל. It is permitted to enter the toilet (בֵּית הַכִּסֵּא) with a tsitsit-bearing talit, for this is not so great a contempt for the mitzva. Of what are we speaking? Of a garment made to be worn (מַלְבּוּשׁ) that is not reserved for prayer. But our mitzva talits, which are reserved only for prayer — it is not fitting (אֵין נָכוֹן) to enter the toilet with them. Likewise, one who goes to relieve himself on Yom Kippur — must remove the kittel, since it is reserved only for prayer. The Rav’s חידוש: he bases the היתר on the measure of the בזוי (« אֵין זֶה בִּזּוּי לַמִּצְוָה כָּל כָּךְ ») and draws the line מַלְבּוּשׁ / מְיֻחָד לְהִתְפַּלֵּל — hence the reservation (אֵין נָכוֹן) for our prayer talits, and the din of the kittel of Yom Kippur.

Sleep and the washerman — permitted. But it is permitted to sleep even in mitzva talits, for this is not so great an indignity (אֵין זֶה גְּנַאי כָּל כָּךְ). Likewise, it is permitted to give them to a washerman (כּוֹבֵס), even a non-Jew (נָכְרִי). The Rav’s חידוש: he applies the same rule of measure — sleep and laundering are not a גְּנַאי sufficient to be forbidden, even for talits reserved for prayer; he thus rules in permission where others reported stricter practices.

The גְּרִירָה — not dragging one’s tsitsit. One shall take care that his tsitsit do not drag on the ground (נִגְרָרִים עַל גַּבֵּי קַרְקַע)מִשּׁוּם בִּזּוּי מִצְוָה. The Rav’s חידוש: the בִּזּוּי מִצְוָה of seif א holds not only for profane uses — it also governs the daily bearing of the tsitsit while one wears it: the vigilance of every instant is part of the respect of the mitzva.

The yesod: the תשמישי מצוה, the ביזוי מצוה, the בית הכסא, the גרירה of the tsitsit

The Alter Rebbe’s reading of this siman unfolds in four movements. First, he lays the yesod: the tsitsit are תַּשְׁמִישֵׁי מִצְוָה — « שֶׁאֵין בְּעַצְמָן שׁוּם קְדֻשָּׁה » — so, once cut, יָכוֹל לְזָרְקָן; and he grades the hiddour in three tiers, up to the בַּעֲלֵי הַנֶּפֶשׁ (seif א). Then, he maintains the dignity: as long as the threads are fixed — בִּזּוּי מִצְוָה; and the worn talits — אָדָם בּוֹדֵל אֶת עַצְמוֹ מֵהֶן (seifim א-ב). Then he measures the בזוי: the בֵּית הַכִּסֵּא is permitted for a garment of מַלְבּוּשׁ, but אֵין נָכוֹן for our talits reserved for prayer (and the kittel of Yom Kippur) — while sleep and the כּוֹבֵס נָכְרִי remain permitted (seifim ג-ד). The principle (seif א). The tsitsit are תַּשְׁמִישֵׁי מִצְוָה — no kedousha in themselves, only a use לְשֵׁם מִצְוָה. After cutting — יָכוֹל לְזָרְקָן אֲפִלּוּ לָאַשְׁפָּה.

The principle (seif א). As long as the threads are קְבוּעִין בַּטַּלִּית — every profane use is forbidden (to tie anything): בִּזּוּי מִצְוָה — the status during the mitzva differs from the status after.

The worn talits (seif ב). אָדָם בּוֹדֵל אֶת עַצְמוֹ מֵהֶן — no קִנּוּחַ nor תַּשְׁמִישׁ מְגֻנֶּה; one throws them away with dignity, וְהֵן כָּלִין מֵאֲלֵיהֶן.

בית הכסא, שינה, כובס — מדידת הבזוי

The dividing line (seif ג). Entering the toilet in a tsitsit-bearing talit — permitted (« אֵין זֶה בִּזּוּי לַמִּצְוָה כָּל כָּךְ ») for a garment of מַלְבּוּשׁ; but for our talits מְיֻחָדִים רַק לְהִתְפַּלֵּלאֵין נָכוֹן; and the kittel of Yom Kippur must be removed.

Sleep and laundering (seif ד). To sleep even in mitzva talits — permitted (אֵין זֶה גְּנַאי כָּל כָּךְ); to give them to a כּוֹבֵס even נָכְרִי — permitted.

The principle (seif ה). יֵשׁ לִזָּהֵר that his tsitsit not drag on the ground — מִשּׁוּם בִּזּוּי מִצְוָה.

The scope. The respect of the mitzva is not exercised only at moments of rupture (cut threads, worn talit) — it governs the bearing of every instant while one wears the tsitsit.

Four orientations that characterize the Alter Rebbe’s sensibility on the cut tsitsit and the worn talits — beyond the mere application of the rules. Each follows the structure: principle of the siman → the Rav’s reading → practical consequence. Each line rests on the Rav’s real text (§1).

Principle of the siman: the cut tsitsit threads may be thrown away — they are תשמישי מצוה, without kedousha of the body (seif א of the Mehaber).

The Rav’s reading: he gives the טעם (« שֶׁאֵין בְּעַצְמָן שׁוּם קְדֻשָּׁה ») and builds a ladder — din / מַחֲמִיר (תָּבוֹא עָלָיו בְּרָכָה) / בַּעֲלֵי הַנֶּפֶשׁ (geniza, bookmark in a sefer: יַעֲשׂוּ בָּהֶן מִצְוָה אַחֶרֶת).

Practical consequence: throwing away the cut threads is permitted (with dignity); the hiddour — the geniza or keeping them for another mitzva; each according to his tier (seif א).

קו ב — ביזוי מצוה בעודן קבועין

The ביזוי מצוה as long as they are fixed

Principle of the siman: as long as the threads are fixed to the talit — forbidden to make use of them (seif א of the Mehaber).

The Rav’s reading: the status during the mitzva is not the status after — every profane use (לִקְשֹׁר בָּהֶם שׁוּם דָּבָר) is בִּזּוּי מִצְוָה; and the worn talit retains a dignity (בּוֹדֵל).

Practical consequence: never make use of the tsitsit of the worn talit (to tie, to fasten); do not make the old talit into a rag — throw it away with dignity (seifim א-ב).

קו ג — מדידת הבזוי: בית הכסא, שינה, כובס

The measure of the בזוי: toilet, sleep, laundering

Principle of the siman: permitted to enter the toilet in tsitsit (seif ג of the Mehaber) — unlike the tefilin.

The Rav’s reading: everything is measured by the degree of בזוי — permitted for a garment of מַלְבּוּשׁ, אֵין נָכוֹן for the talit reserved for prayer (including the kittel of Yom Kippur); sleep and the כּוֹבֵס נָכְרִי — permitted.

Practical consequence: the talit katan worn all day — one may enter the toilet and sleep with it; the prayer talit — do not wear it there; for local practices → consult a Rav (seifim ג-ד).

קו ד — גרירת הציציות

The גרירה — the vigilance of every instant

Principle of the siman: to take care that the tsitsit not drag on the ground (seif ד of the Mehaber).

The Rav’s reading: the גרירה belongs to the same בִּזּוּי מִצְוָה as seif א — the respect of the mitzva is a continuous bearing, not only a din of the moments of rupture.

Practical consequence: adjust the length and the manner of wearing the talit katan so that the tsitsit do not drag; daily vigilance (seif ה).

הלכה למעשה — מנהג חב״ד

Halacha le-maaseh — the Chabad conduct

Six points of conduct that flow directly from siman כ״א in the sensibility of the Alter Rebbe and of Chabad — presented at the level of principle, referring to the Rav for the detail of particular cases and minhagim.

For the Chabad Chassid — Siman כ״א (ציציות שנפסקו וטליתות ישנים)

  • ① Cut threads — throwing them away with dignity is permitted. The tsitsit are תַּשְׁמִישֵׁי מִצְוָה without kedousha of the body: once cut from the talit, one may throw them away — the din permits them even to the אַשְׁפָּה, the hiddour is not to throw them in a degrading place. Basis: SA HaRav seif א.
  • ② The hiddour of the בַּעֲלֵי הַנֶּפֶשׁ — geniza or another mitzva. One who is מַחֲמִיר — תָּבוֹא עָלָיו בְּרָכָה; the בַּעֲלֵי הַנֶּפֶשׁ place them in geniza or in a sefer as a bookmark — הוֹאִיל וְנַעֲשָׂה בָּהֶם מִצְוָה אַחַת, יַעֲשׂוּ בָּהֶן מִצְוָה אַחֶרֶת. Basis: SA HaRav seif א.
  • ③ As long as they are fixed — no profane use. Forbidden to make use of the tsitsit of the talit (to tie anything with them) — בִּזּוּי מִצְוָה. Basis: SA HaRav seif א.
  • ④ An old worn talit — not a rag. אָדָם בּוֹדֵל אֶת עַצְמוֹ מֵהֶן — no קִנּוּחַ nor degrading use; one throws it away with dignity and it wears out of itself. Basis: SA HaRav seif ב.
  • ⑤ Toilet and sleep — the Rav’s line. With the talit katan worn as a garment — one may enter the בֵּית הַכִּסֵּא and sleep with it; the talit reserved for prayer — אֵין נָכוֹן to wear it there (and the kittel of Yom Kippur must be removed); to give it to a כּוֹבֵס even נָכְרִי — permitted. Basis: SA HaRav seifim ג-ד.
  • ⑥ Not dragging one’s tsitsit. Take care that the tsitsit do not drag on the ground — מִשּׁוּם בִּזּוּי מִצְוָה. For a concrete case — consult a Rav. Basis: SA HaRav seif ה.
