Siman 134 — Libated wine that has become mixed

A mixture is not judged but measured — and before volume come three questions: of which kind, in which direction, and through what stream. From the משהו of a drop to manufactured drinks, by way of the barrel, the six parts of water and rinsing (Shulchan Arukh, Yoreh De’ah 134 — 13 seifim)

Why does one drop of forbidden wine suffice here, when elsewhere sixty are required?

Because the measure follows the kind before it follows the quantity. The mishna sets out both regimes at a stroke: « יֵין נֶסֶךְ אָסוּר וְאוֹסֵר בְּכׇל שֶׁהוּא, יַיִן בְּיַיִן וּמַיִם בְּמַיִם בְּכׇל שֶׁהוּא, יַיִן בְּמַיִם וּמַיִם בְּיַיִן בְּנוֹתֵן טַעַם » (עבודה זרה ע״ג ע״א), and the gemara gives the reason for the stringency: « בִּשְׁלָמָא יֵין נֶסֶךְ, מִשּׁוּם חוּמְרָא דַּעֲבוֹדָה זָרָה, אֶלָּא טֶבֶל מַאי טַעְמָא » (עבודה זרה ע״ג ע״ב). The Mehaber restates it in the first seif: « יין שנתנסך לעבודת כוכבים שנתערב ביין של היתר אוסר בהנאה בכל שהוא » (שו״ע יו״ד קל״ד:א); but once the kind changes, the measure becomes the ordinary one: « מים שנתערבו ביין או יין במים בנותן טעם מפני שהם מין בשאינו מינו » (שו״ע יו״ד קל״ד:ג). Does the direction of the pouring really change the law?

Yes, and it is the clause most easily missed in the siman. The Mehaber himself limits his stringency: « בד״א כשהורק היין המותר על טפה של יין נסך » (שו״ע יו״ד קל״ד:א), and in the other direction he permits — « אבל אם עירה יין נסך מצרצור קטן » (שו״ע יו״ד קל״ד:א) — for then « ראשון ראשון בטל ». The Shach, in the name of the Ran, gives the foundation in one line: « וטעמא דמלתא שאותו דבר שעומד במקומו חשוב יותר מן הבא עליו » (ש״ך יו״ד קל״ד ס״ק א). What stands in place prevails over what comes upon it. For the application to your own case, consult your Rav.

Why a small flask and not a barrel, when the quantity may be the same?

Because it is not the volume that decides but the flow. The Mehaber says it in five words: « מפני שהעמוד היורד מפי החבית גדול » (שו״ע יו״ד קל״ד:א), and the gemara had already set it down: « וְדַוְקָא צַרְצוּר קָטָן, דְּלָא נְפִישׁ עַמּוּדֵיהּ, אֲבָל חָבִית דִּנְפִישׁ עַמּוּדֵיהּ — לָא » (עבודה זרה ע״ג ע״א). The Ran found the boundary too vague: « ולא ידעתי באיזה דבר החילוק שבין צרצור קטן לחבית דהיאך נתן דבריו לשיעורים בכיוצא בזה » (ש״ך יו״ד קל״ד ס״ק ה), and resolved it by shifting the criterion from size to usage. The Shach adds a practical condition: this holds only where the stream was not interrupted (ש״ך יו״ד קל״ד ס״ק ו). For the application to your own case, consult your Rav.

Nowadays, is stam yeinam nullified in sixty?

Here the two traditions part company, and the siman says so itself. The Mehaber maintains the measure of the Talmud: « נתערב סתם יינם ביין מותר הרי זה אוסר בכל שהוא בשתייה » (שו״ע יו״ד קל״ד:ב). The Rama reports the contrary view — « ויש אומרים דכל סתם יינם בזמן הזה בטל בששים » (רמ״א יו״ד קל״ד:ב) — and adds the words on which all Ashkenazi practice rests: « וכן נוהגין להקל ». But the Shach at once narrows its reach: the leniency was born of loss, and does not dispense with removing the gain — « אבל איך יהנה לכתחלה מהיין נסך שנפל לשם אלא יוליך הנאה לים המלח ומותר בשתייה נ״ל » (ש״ך יו״ד קל״ד ס״ק ט״ו). The Beer Hetev reports the dispute between the Bach and the Shach (באר היטב יו״ד קל״ד ס״ק ו), and the Pitchei Teshuva adds the position of the Noda BiYehuda (פת״ש יו״ד קל״ד ס״ק ד). Wine spilt on food: does rinsing suffice?

It depends on one thing only — did the liquid get in? On whole grapes the Mehaber rules: « אם הם שלימות ידיחם והם מותרות באכילה » (שו״ע יו״ד קל״ד:ח); on lentils and barley the same — but with a clock: « ואם עבר עליהם זמן רב ודאי בלעו ואין להם היתר בהדחה » (שו״ע יו״ד קל״ד:י). And on wheat, never: « נפל על גבי חטים אין להם היתר בהדחה מפני שמתוך שיש בהם סדק היין נבלע בהם » (שו״ע יו״ד קל״ד:י״א). How long is “a long time”? The Taz makes it very short: « משמע דזמן מועט הוא מועט דומיא דמיד וכל שיש שהות יותר מזה מקרי מרובה » (ט״ז יו״ד קל״ד ס״ק י); the Shach gives twenty-four hours: « נראה דמעת לעת בעינן כמ״ש לעיל סימן ק״ה ס״ק ב׳ » (ש״ך יו״ד קל״ד ס״ק כ״ז).
