Siman 143 — Not to build one’s house next to a house of idolatry, and when one may benefit from idolatry
Six seifim — the Shulchan Arukh announces it itself: ובו ו׳ סעיפים. The previous siman forbade benefiting from the idol; this one forbids providing benefit to it. A shared wall that collapses and is not rebuilt, a dome one does not build — though the wage for it remains permitted after the fact —, a garden and a bathhouse whose income goes to the priests, flutes, shops and a tax. Six situations, and each time the same question: to whom does what one gives arrive? (Shulchan Arukh, Yoreh De'ah 143 — 6 seifim)
מי שהיה ביתו סמוך לבית אלילים ונפל אסור לבנותו
His house adjoined a temple, and it fell: he does not rebuild it. Nine words, and the principle of the siman: what is at stake is not what one takes from the idol, but what one brings to it — even a wall.

The Hebrew text of the six seifim with a fluent English translation. The wall and the four cubits, the half-and-half division, the dome and the hall, the builder’s wage, בטובה and שלא בטובה, the flutes, the shops and the tax — explained step by step, with the Gemara of Avodah Zarah, the Tur, the Beit Yosef, the Shach, the Taz, the Ba’er Hetev and the Pitḥei Teshuva.
In-depth pilpul: the ḥakira of מהנה — a corollary of נהנה or a prohibition in its own right; the Bach against the Shach on “the house itself is worshipped”; בימוסיאות or דימוסיאות; the Rif against the Rambam on the wage for the idol itself; the three readings of בטובה and Abbaye’s two versions; the Levush against the Shach on לעובדיה.
A master table of the six seifim clause by clause, the three reflex questions, the wall and the division, the dome and the wage, the three readings of בטובה, the town treasury, the five golden rules, the mnemonic « מהנה » and the four classic pitfalls.
The practical halakha according to the ש״ך, the ט״ז, the באר היטב and the פתחי תשובה, then contemporary cases: the shared wall, the building site, the wage already received, the produce of an estate, the rent, the tax. Note: the Alter Rebbe did not write a Shulchan Arukh on Yoreh De'ah — this is a psak level, not “Daat HaRav”; and the Nekudot HaKesef do not comment on this siman.
A wall shared with a temple has collapsed: may it be rebuilt?
Not in its place: rebuilding it means benefiting the idol. He withdraws into his own ground and makes the space unusable. « מי שהיה ביתו סמוך לבית אלילים ונפל אסור לבנותו כיצד יעשה כונס לתוך שלו ובונה ואותו הריוח ממלאו קוצים או צואה כדי שלא ירחיב בבית אלילים » (שו״ע יו״ד קמ״ג:א) And the Shach supplies the measure the Mehaber left out: « ד׳ אמות כן הוא במשנה וטור ופוסקים » (ש״ך יו״ד קמ״ג ס״ק ב) For the application to your own situation, consult your Rav.
And the old wall, half of which was his?
It is judged half and half: his share remains permitted for benefit, the idol’s does not. « היה הכותל שלו ושל אלילים ידון מחצה למחצה שלו מותר בהנאה » (שו״ע יו״ד קמ״ג:א) But the stones are permitted only if he can say which were his — otherwise all is forbidden (Rama, from the Tur); and he may in any case sell them his share (Rama, in the name of the Ran). For the application to your own situation, consult your Rav.
May one work on the building site of a place of worship?
The dome, the niche, the room in which the object of worship stands: no. « אסור לבנות עם העובד כוכבים כיפה שמעמידים בה אלילים » (שו״ע יו״ד קמ״ג:ב) The ancillary buildings are permitted by the Mehaber: « אבל בונה הוא לכתחילה הטרקלין או החצר שיש בה אותה הכיפה » (שו״ע יו״ד קמ״ג:ב) But the Taz advises abstaining: « אבל למעשה ודאי ראוי לנו לפסוק כר״י שראה דברי רש״י וחלק עליהם ואליו תשמעון להרחיק מכיעור ודומה לו » (ט״ז יו״ד קמ״ג ס״ק ד) and the Ba’er Hetev records it: « כ׳ הט״ז ונראה דאין להתיר אלא דרך מסייע לחוד שיהא בונה עמהם אבל לבנות הוא לבדו אסור לכ״ע וכל זה להלכה אבל למעשה ודאי ראוי להחמיר ולהרחיק מהכיעור ודומה לו לאסור אף במסייע להם » (באר היטב יו״ד קמ״ג ס״ק ה) For the application to your own situation, consult your Rav.
And the wage for work already done?
It is permitted after the fact: « ואם עבר ובנה » (שו״ע יו״ד קמ״ג:ב) … שכרו מותר. The Rama adds that this holds even for the object of worship itself. But the Taz explains why the Rif, the Tur and the Mehaber did not write it: « וכן כתבו כל הפוסקים רק הרי״ף והטור והש״ע לא הביאו להאי רבותא דאפילו אליל עצמה שרי השכר בדיעבד ונראה טעמם שלא רצו לגלות היתר זה כדי להרחיק את האדם מכיעור עבירה זו וכדרך שאמרו בפרק מי שהחשיך עוד אחרת אמרו ולא רצו לגלותה » (ט״ז יו״ד קמ״ג ס״ק ג) For the application to your own situation, consult your Rav.
May one buy the produce of an estate attached to a place of worship?
It depends who receives and at what price. « מותר ליהנות מהם שלא בטובה ואסור ליהנות מהם בטובה » (שו״ע יו״ד קמ״ג:ג) The Rama opens a door when the property does not stand in the idol’s courtyard: « ויש לסמוך על זה להקל » (שו״ע יו״ד קמ״ג:ג) The Bach tightens it: « והב״ח פסק להחמיר היכא דלא היה מגיע זה הריוח לכומרים אם לא ע״י ישראל זה שנותנו אבל אם לא היה קונה פירות אלו או רוחץ במרחץ היו באים עובדי כוכבים וקונים פירות ורוחצים במרחץ מותר » (ש״ך יו״ד קמ״ג ס״ק ז) and the Maharshal adds: « וכתב רש״ל דהך שלא בטובה פירושו שכל העולם נהנין ממנה שלא בטובה אבל אם מוחלין ליחיד אסור דאדרבה נהנה מעובד כוכבים שמהנה אותו כדלקמן סימן קמ״ט גבי מכס עכ״ל » (ט״ז יו״ד קמ״ג ס״ק ה) For the application to your own situation, consult your Rav.
And a tax, a rent, an entrance fee?
The question is to whom the money is handed. « חנויות של אלילים אסור לשכור מהם » (שו״ע יו״ד קמ״ג:ה) « גבאים שנוטלים מכס לאלילים אסור ליתן להם » (שו״ע יו״ד קמ״ג:ו) But the Rama, twice, permits when the sum falls into a common treasury: « ואם נופל השכר למדינה והם קונים צרכיהם שרי » (שו״ע יו״ד קמ״ג:ה) « וכן בכאן אינו אסור אלא כשנופל השכר לצרכי עבודת כוכבים עצמה אבל כשנופל לכיס בני המדינה אע״פ שהם קונים צרכי עבודת כוכבים שרי » (שו״ע יו״ד קמ״ג:ו) For the application to your own situation, consult your Rav.
