Siman 180 — Tattooing, and the baldness and gashing made for a dead person

Twelve seifim. The title names two things — the כתובת קעקע and the קריחה for a dead person — and the siman treats three, gashing coming to stand between them. What unites them is one family: marks made in the body, which the Tur counts among the customs of the nations. What separates them is more instructive still: the tattoo is judged by what is done, gashing and baldness by what they are done for. (Shulchan Arukh, Yoreh De’ah 180 — 12 seifim)

A כתובת קעקע, that is: that he gashes his flesh and fills the place of the gash with kohl, ink or other dyes that leave a mark. One definition, and the whole first block of the siman follows from it: what is aimed at is not the image but the making.

Shulchan Arukh, Yoreh De'ah 180:1

Frequently asked questions — Siman 180

What makes a mark a כתובת קעקע?

The seif defines it by its making, in two acts:

There must therefore be a gash and a filling with a substance that marks; one without the other leaves one exempt, and the Chakh adds in the name of the Bach that the order of the two is immaterial. For the application to your situation, consult your Rav.

Is the one who receives a tattoo implicated?

The seif exempts him, and the Chakh at once adds a reservation:

The exemption concerns the penalty; the prohibition is derived from the following siman, where we learn that it exists even without assisting. For the application to your situation, consult your Rav.

Why is ash upon a wound permitted?

The gemara begins by forbidding it, then concludes otherwise:

And the Taz shows that the permission does not rest on the trace fading: it holds even for hard ash whose mark remains. For the application to your situation, consult your Rav.

Is gashing forbidden in itself?

No: seif 5 ties it to two motives, and the gemara excludes the rest:

Outside of the dead and the idol there is no liability; and the gloss on seif 6 even permits for another grief, while the Bach, reported by the Chakh, maintains a prohibition there. For the application to your situation, consult your Rav.

How many hairs make a קרחה?

The seif gives a measure, then another, then a view that gives none:

And the gloss on seif 12 adds an instruction that depends on no measure: to warn against tearing out hair over a dead person, lest one come to baldness. For the application to your situation, consult your Rav.
